REPLACE ANY AND EVERY TREE LOST OR, IN THE OPINION OF THE OWNER'S RETAINED. ALL OF THE FOLLOWING TREE PROTECTION MEASURES SHALL APPLY: REPRESENTATIVE, IRREPARABLY DAMAGED AS A RESULT OF FAILURE OF THE CONTRACTOR a. CONSTRUCTION STORAGE IS PROHIBITED: DO NOT FILL, EXCAVATE, STACK OR STORE ANY TO PROTECT OR TO ADEQUATELY MAINTAIN EXISTING TREES. PROTECTED TREES WHICH FAIL EQUIPMENT, DISPOSE OF ANY MATERIALS, SUPPLIES OR FLUIDS, OPERATE ANY FULLY TO FOLIATE LESS THAN 50% OF CANOPY IN THE FIRST SPRING FOLLOWING EQUIPMENT, INSTALL IMPERVIOUS SURFACES, OR COMPACT THE EARTH IN ANY WAY COMPLETION OF CONSTRUCTION OPERATIONS WILL BE PRESUMED LOST DUE TO WITHIN THE AREA DEFINED BY THE DRIP LINE OF ANY TREE TO BE RETAINED. CONSTRUCTION OPERATIONS. b. FENCED PROTECTION AREA IS REQUIRED: PRIOR TO DEVELOPMENT ACTIVITIES, ERECT 4. THE CONTRACTOR SHALL GUARANTEE THAT ALL PROTECTED TREES SHALL LIVE AND SHOW AND MAINTAIN SIX—FOOT (6') HIGH CHAIN LINK TEMPORARY CONSTRUCTION FENCING NO SIGNS OF DECLINE FOR A PERIOD OF ONE YEAR FROM FINAL ACCEPTANCE. SITE RESULT OF CONTRACTOR'S FAILURE TO PROTECT OR MAINTAIN TREES TO REMAIN. ACCESS TO INDIVIDUALLY PROTECTED TREES OR GROUPS OF TREES SHALL BE FENCED 6. IN THE EVENT A DAMAGED OR LOST TREE CANNOT BE REPLACED IN KIND, CONTRACTOR AND SIGNED. INDIVIDUAL TREES SHALL BE FENCED ON FOUR (4) SIDES. IN ADDITION, SHALL PAY TO THE OWNER'S REPRESENTATIVE AS LIQUIDATED DAMAGES: PROVIDE SUPERVISION WHENEVER EQUIPMENT OR TRUCKS ARE MOVING NEAR TREES. a. A SUM EQUAL TO THE VALUE OF EACH LOST TREE AS DETERMINED BY THE MOST c. PROTECTION FROM GRADE CHANGES: IF THE GRADE LEVEL ADJOINING TO A TREE TO BE CURRENT "GUIDE FOR ESTABLISHING VALUES OF TREES AND OTHER PLANTS" BY THE RETAINED IS TO BE RAISED, CONSTRUCT A DRY ROCK WALL OR ROCK WELL AROUND COUNCIL OF TREE AND LANDSCAPE APPRAISERS, ISA, PLUS AN AMOUNT OF $2,000.00 THE TREE. THE DIAMETER OF THIS WALL OR WELL SHALL BE EQUAL TO THE TREE'S PER TREE IN COMPENSATION FOR THE EFFORTS OF THE OWNER'S REPRESENTATIVE AND DRIP LINE. PROJECT ARBORIST IN ADMINISTERING AND OVERSEEING THE REPLACEMENT; OR d. RESTRICTIONS ON GRADING WITHIN THE DRIP LINES OF RETAINED TREES: THE GRADE b. A SUM OF $8,000.00, WHICHEVER IS LARGER. LEVEL AROUND ANY TREE TO BE RETAINED SHALL NOT BE LOWERED WITHIN THE GREATER OF THE FOLLOWING AREAS: 7. LOCATE AND INSTALL REPLACEMENT TREES IN ACCORDANCE WITH THE INSTRUCTIONS OF d.1. THE AREA DEFINED BY THE DRIP LINE OF THE TREE, OR THE OWNER'S REPRESENTATIVE AND PROJECT ARBORIST. d.2. AN AREA AROUND THE TREE EQUAL TO ONE AND ONE—HALF FEET (1-1/2') IN 8. IN THE EVENT OF INJURIES TO THE CROWN, TRUNK OR ROOT SYSTEM OF ANY TREE TO DIAMETER FOR EACH ONE INCH (1") OF TREE CALIPER. A LARGER TREE REMAIN RESULTING FROM THE CONTRACTOR'S FAILURE TO PROTECT AND/OR MAINTAIN SUCH PROTECTION ZONE BASED ON TREE SIZE, SPECIES, SOIL, OR OTHER CONDITIONS TREE, THE OWNER'S REPRESENTATIVE MAY ELECT TO RETAIN THE TREE AND HOLD THE MAY BE REQUIRED. CONTRACTOR LIABLE FOR COMPENSATION, THE JUST VALUE OF WHICH IS DETERMINED BY THE "GUIDE FOR ESTABLISHING VALUES OF TREES AND OTHER PLANTS" REFERENCED ABOVE. e. MULCH LAYER REQUIRED: ALL AREAS WITHIN THE REQUIRED FENCING SHALL BE WEEDED AND THEN COVERED COMPLETELY AND EVENLY WITH A MINIMUM OF THREE INCHES (3") 9- GRUB STUMPS OF DEAD TREES TO THE FULL DEPTH OF THE ROOTS, AND REPAIR THE OF BARK MULCH PRIOR TO INSTALLATION OF THE PROTECTIVE FENCING.
