Thank you for the opportunity to provide comments on the State
Environmental Policy Act (SEPA) notice of application utilizing the
optional determination of nonsignificance (ODNS/NOA) process for
the TA Benson Petro project. Based on review of the checklist
associated with this project, the Department of Ecology (Ecology) has
the following comments: Section B Environmental Elements,
Subsection 3 Water, Subsection 7 Groundwater: Groundwater occurs
at approximately 8 feet below ground surface. Please provide the
maximum depth of excavation during the construction. Please specify
if dewatering is anticipated during the construction. Section B
Environmental Elements, Subsection 7 Environmental Health: The
proposed project is located on a site listed in the Model Toxics
Control Act (MTCA) Confirmed and Contaminated Sites List
(CSCSL) and Leaking Underground Storage Tanks List (LUST).
Please add the following contaminated site information in the SEPA
checklist: • Site Name: Texaco Fairwood • Facility Site ID: 3376675
• Cleanup Site ID: 7533 • LUST Site ID: 2063 The SEPA checklist
indicates that recent environmental assessment in 2019 did not find
petroleum contamination. However, based on historical information,
it is possible that potential contaminated soil or groundwater may be
encountered during the construction. Please have a contingency
mitigation plan in place to address the contaminated soil or
groundwater handling and disposal, hazardous waste operations
worker training, health and safety, and potential contamination
remediation. Thank you for considering these comments from
