HomeMy WebLinkAboutD_Boeing_Temp_Fence_TUP_230118_v1DEPARTMENT OF COMMUNITY AND ECONOMIC DEVELOPMENT D_Boeing Temp Fence TUP_230118_v1 PLANNING DIVISION TIER 1 TEMPORARY USE PERMIT EVALUATION FORM & DECISION DATE OF DECISION: January 20, 2023 PROJECT NUMBER: LUA23-000018, TP PROJECT NAME: Boeing Temporary Fencing PROJECT MANAGER: Alex Morganroth, Senior Planner APPLICANT: Mark Clement PO Box 3707, MS 1W-09, Seattle, WA 98124 OWNER: Same as applicant CONTACT: Same as applicant PROJECT LOCATION: Boeing S1, S3, E3, and E6 Parking Lots (APN 0723059001, 0886610020, 0886610030, 0886610040, 0823059209, 0823059019, 0886610060) DATE OF EXPIRATION: September 20, 2023 PROJECT DESCRIPTION: The applicant, Mark Clement on behalf of The Boeing Company, is requesting a Tier 1 Temporary Use Permit (TUP) pursuant to Renton Municipal Code Section 4-9-240 in order to install temporary chain-link fencing panels along the perimeter of four (4) Boeing-owned surface parking lots (APN 0723059001, 0886610020, 0886610030, 0886610040, 0823059209, 0823059019, 0886610060). The temporary fencing is proposed on the south side of the S3 lot, the east side of the S1 lot, the south and west sides of the E6, and the south and east side of the E3 lot (see site plan, attached). The proposed temporary six (6) foot tall uncoated chain-link fencing would be anchored via 33 pound ballast weights placed on the panel feet. The applicant is not proposing the installation of gated access to the parking lots and will not include fencing elements that restrict the movement of vehicles entering or exiting the lots. According to the applicant, the purpose of the temporary fencing is to improve security for parking lot users while Boeing develops a permanent fencing plan for the various parking lots. A conceptual permanent fencing plan was submitted by the applicant with the intent to implement a final plan in the second half of 2023 (see site plan, attached). The proposed permanent fencing would require a Special Administrative Fence Permit, at which time the proposal would be reviewed for compliance with all fence standards in RMC 4-4-040, including but not limited to those related to material, landscaping, and setbacks. All four (4) parking lots where the temporary fencing would be located are in the Urban Center -2 (UC-2) zoning designation. No ground disturbance activity is proposed and no vegetation is proposed for removal. The applicant submitted an Abatement Agreement, dated January 18, 2023, with the application (attached). Per RMC 4-9-240, the Administrator may approve, deny, modify, or condition an application for a temporary use permit, based on consideration of the following factors: 1. The temporary use will not be materially detrimental to the public health, safety, or welfare, nor injurious to property or improvements in the vicinity of the temporary use; and 2. Adequate parking facilities and vehicle ingress and egress are provided to serve the temporary use and any existing uses on the site; and 3. Hours of operation of the temporary use are specified, and would not adversely impact surrounding uses; and 4. The temporary use will not cause nuisance factors such as noise, light, or glare which adversely impact surrounding uses; and 5. If applicable, the applicant has obtained the required right-of-way use permit. Staff Comment: Based on the temporary nature of the fencing and its location in a highly urbanized, auto- centric environment, staff determined that the temporary use will not be materially detrimental to the public health, safety, or welfare, nor injurious to property or improvements in the vicinity. No reduction to parking or change to ingress/egress would occur as a result of the temporary fencing installation and the fencing is not anticipated to cause nuisance factors such as noise, light, or glare. No right-of-way use permit is required as the temporary fencing would be located on private property. The Temporary Use Permit is hereby Approved with Conditions* : *CONDITIONS OF APPROVAL: 1. The sites occupied by the temporary use shall be restored to the original condition when the proposed permanent fencing is installed, or upon expiration of the TUP on September 20, 2023, whichever comes first. 2. The applicant shall submit a complete Special Administrative Fence Permit application for the proposed permanent fencing within ninety (90) days of TUP issuance, unless an extension is granted by the Current Planning Project Manager for justifiable cause. 3. The future permanent fencing shall comply with the landscape requirements within RMC 4-4-040 and RMC 4-4-070, unless otherwise approve by the Current Planning Project Manager. Compliance with the subject landscape requirements shall be reviewed and approved by the Current Planning Project Manager prior to issuance of a Special Administrative Fence Permit. 4. No barbed wire, razor wire, or similar shall be incorporated into the temporary fencing. 5. The fencing shall not restrict vehicle movement in the public ROW or result in the removal of any ingress/egress into the four (4) parking lots. The approval body may modify his decision if material evidence not readily discoverable prior to the original decision is found or if he finds there was misrepresentation or fact. After review of the Reconsideration request, if the approval body finds sufficient evidence to amend the original decision, there will be no further extension of the appeal period. Any person wishing to take further action must file a formal appeal within the 14-day appeal time frame. APPEALS: Appeals of permit issuance must be filed in writing on or before 5:00 p.m. on February 3, 2023. Appeals must be submitted electronically to the City Clerk at cityclerk@rentonwa.gov or delivered to City Hall 1st floor Lobby Hub Monday through Friday. The appeal fee, normally due at the time an appeal is submitted, will be collected at a future date if your appeal is submitted electronically. The appeal submitted in person may be paid on the first floor in our Finance Department. Appeals to the Hearing Examiner are governed by RMC 4- 8-110 and additional information regarding the appeal process may be obtained from the City Clerk’s Office, cityclerk@rentonwa.gov. EXPIRATION: A Temporary Use Permit is valid for up to one (1) year from the effective date of the permit, unless the Community & Economic Development Administrator or designee establishes a shorter time frame or an applicant can request that a permit be valid beyond the one year expiration, for up to five years at the time of application or prior to permit expiration. EXTENSIONS: Extension requests do not require additional fees and shall be requested in writing prior to permit expiration to the Department of Community & Economic Development Administrator.
