PROJECT DESCRIPTION: The applicant is requesting approval of a Routine Vegetation Management Permit
(RVMP) and Critical Areas Exemption (CAE) for tree maintenance at the apartment
complex located at 2223 Benson Rd S (APN 3376750000). The property is approximately
16.1 acres in size. The property is located within the Residential Multi-family (RMF) zone
and has a Comprehensive Land Use designation of Residential High Density (RHD). The
applicant proposed to remove three (3) significant trees including an 8.7 caliper-inch
Red alder, a 17.3 caliper-inch Lodgepole pine, and a 10.7 caliper-inch London plane. A
significant tree is defined as a tree with a caliper of at least six inches (6"), or an alder
or cottonwood tree with a caliper of at least eight inches (8") (RMC 4-11-200). The
applicant, a professionally-certified ISA arborist, submitted a TRAQ report that classified
all trees proposed for removal as ‘high-risk’ (attached). The purpose of the tree removal
is to prevent damage to nearby buildings and vehicles in the parking lot due a branch or
root failure. In addition, the applicant proposes crown cleaning to address dieback in
the upper crown for a 11.4 caliper-inch European white birch and a 10 caliper-inch
European white birch. Minor clearance pruning of approximately 84 addition trees,
identified in a second TRAQ report (attached) is also proposed across the site. The trees
proposed for removal, crown cleaning, or pruning are not concentrated in a specific area
of the site, but rather are spread out across the large, heavily treed complex. According
to COR Maps, Sensitive Slopes (15-40%), Protected Slopes (40%+), a High Erosion
Hazard, a High Landslide Hazard, a Moderate Coalmine Hazard, and a High Coalmine
Hazard, are present on the site. Per RMC 4-3-050.C, dangerous tree removal (i.e. high
risk tree) within a geologic hazard area is an exempt activity from the Critical Areas
Regulations in RMC 4-3-050. The removal of more than two (2) significant in a trees in a

one-year period. across the site exceeds the allowed tree removal activities threshold
per RMC 4-4-130 and therefore requires an approved RVMP.

EXEMPTION JUSTIFICATION: Renton Municipal Code (RMC) 4-3-050 Critical Areas Regulations:
RMC 4-3-050C.3.c.iii. Maintenance and Construction - Agricultural, Harvesting, Vegetation Management:
Dangerous Trees (i.e. high risk).
FINDINGS: The proposed development is consistent with the following findings pursuant to RMC section 4-3-
050C.2.d:
i. The activity is not prohibited by this or any other provision of the Renton Municipal Code or State or Federal
law or regulation;
ii. The activity will be conducted using best management practices as specified by industry standards or
applicable Federal agencies or scientific principles;
iii. Impacts are minimized and, where applicable, disturbed areas are immediately restored;
iv. Where water body or buffer disturbance has occurred in accordance with an exemption during
construction or other activities, revegetation with native vegetation shall be required;
v. If a hazardous material, activity, and/or facility that is exempt pursuant to this Section has a significant or
substantial potential to degrade groundwater quality, then the Administrator may require compliance with
the Wellhead Protection Area requirements of this Section otherwise relevant to that hazardous material,
activity, and/or facility. Such determinations will be based upon site and/or chemical -specific data.
ROUTINE VEGETATION MANAGEMENT PLAN GENERAL REVIEW CRITERIA 4-9-195.D.4:
YES 1. The lot shall comply with minimum tree density requirements pursuant to RMC 4-4-130,
Tree Retention and Land Clearing Regulations.
Comments: Per RMC 4-4-130.H, tree credit requirements shall comply at a minimum
rate of 30 credits per net acre. The applicant submitted a tree unit calculation
(attached) that indicated the site had a total of 1,662 tree credits. After removal of the
three (3) trees, resulting in the loss of 14 credits, the site would have a total of 1,648
credits. Based on the total area of the site, approximately 16.1 acres, a total of 484 tree
credits is required at the rate of 30 credits per acre (30 credits x 16.1 acres = 484
credits). Therefore, the site would comply with the tree credit requirement after
removal of the three (3) trees.

4. Street frontage and parking lot trees and landscaping shall be preserved unless otherwise
approved by the Administrator.
Comments: According to the applicants TRAQ report, the London plane tree proposed
for removal is located in a parking lot landscape island. In order to ensure the parking lot
complies with the landscape requirements in RMC 4-4-070, staff recommends, as a
condition of approval, the applicant shall install one new London plane tree, or an
alternative tree species approved by the Current Planning Project Manager, after removal
of the existing tree. The new tree shall be installed within 45 days of the tree removal.
YES 5. The land clearing and tree removal shall not remove any landscaping or protected trees
required as part of a land development permit.
Comments: Not applicable. The original land development permit is not on file with the
City due to the development of the site occurring prior to annexation.
YES 6. The land clearing and tree removal shall maintain visual screening and buffering between
land uses of differing intensity, consistent with applicable landscaping and setback
provisions.
Comments: The three (3) trees proposed for removal are spread out across the site and
would not significantly reduce the visual screening or buffering between the
condominium complex and the single-family homes to the west or Benson Rd S to the
east. The minor pruning and crown clearing proposed will enable the trees to continue
growing healthily and will improve the visual screening in the long term. In addition, the
significant number of remaining trees on the site will continue to provide a robust tree
canopy and screening element for residents of the complex.
YES 7. The land clearing and tree removal shall not create or contribute to a hazardous
condition, such as increased potential for blowdown, pest infestation, disease, or other
problems that may result from selectively removing trees and other vegetation from a
lot.
Comments: The permit is requested in order to mitigate the danger of a high-risk trees
and dead branches on healthy trees. The proposed work would not result in the increased
potential for issues with the remaining trees and the removed trees represent a small
fraction of the existing trees on the site.

DECISION: The Echo Mountain Tree Maintenance Routine Vegetation Management Permit and Critical Areas
Exemption is Approved with Conditions*.
1. The applicant shall install one (1) new London plane tree, or an alternative tree species approved by the
Current Planning Project Manager, after removal of the existing tree. The new tree shall be installed within
45 days of the tree removal.

RECONSIDERATION: Within 14 days of the decision date, any party may request that the decision be reopened by
the approval body. The approval body may modify his decision if material evidence not readily discoverable prior
to the original decision is found or if he finds there was misrepresentation or fact. After review of the
Reconsideration request, if the approval body finds sufficient evidence to amend the original decision, there will be
no further extension of the appeal period. Any person wishing to take further action must file a formal appeal within
the 14-day appeal time frame.
APPEALS: Appeals of permit issuance must be filed in writing on or before 5:00 p.m. on February 8, 2023. Appeals
must be submitted electronically to the City Clerk at cityclerk@rentonwa.gov or delivered to City Hall 1st floor
Lobby Hub Monday through Friday. The appeal fee, normally due at the time an appeal is submitted, will be
collected at a future date if your appeal is submitted electronically. The appeal submitted in person may be pai d
on the first floor in our Finance Department. Appeals to the Hearing Examiner are governed by RMC 4 -8-110 and
additional information regarding the appeal process may be obtained from the City Clerk’s Office,
cityclerk@rentonwa.gov.
EXPIRATION: The Routine Vegetation Management Permit shall be valid for one (1) year from the date of issuance.
An extension may be granted by the Planning Division for a period of one (1) year upon application by the property
owner or manager. Application for such an extension must be made at 30 days in advance of the expiration of the
original permit and shall include a statement of justification for the extension. Critical Areas Exemptions are valid
five (5) years from the date of decision (date signed).
