Property°s drai�age facilities are shown and/or listed on �xhibi�A—Site Plan. The Prop�rty's
drainage facilities shall be maintaened in corr�pliance with the operation and maintenance
schedule 6ncluded and attached herein as Exhibit B—Operations and Maint�r�ance. 6�rainage
facilities include pipes, ehanraels, flow contresl facilities, water quality facilities, on-site best
managerv7ent practices (BMPs) and other �ngineered structures designed to rrranage and/or

treat st�rmwat�r on the Prap�rty. On-site BMPs include dispersion and infiltrataon devices,
bioretention, perrrteable pavements, rainwater harvesting systems, tree retention credit,
r�duced impervious surface foatprint, ��getated roofs and other measures design�d tc� mimic
pre-developed hydrology and minimize stormwater runoff an the Prc�perty.
2. City of Rent�n shall hav� the right to ingress and egress �ver those portions af the Property
neeessary to perform inspections of the storrnwater facilities and BMPs and canduct
maintenance activiti�s specifi�d in this D�claration of Covenant and in acc�rdance with the
Renton IVlunicipal Code. City of Rent�on shall provide at least thirty(3�) days' tivritten notice to
the Owners that�r�try on the Property is planned for the inspection of drainage facilities.After
the thirty {30) days,the Owners shall allarr�r the City af Rent�n to ent�r for the sale purp�se of
inspecting drainage facilities. in lieu of inspection by the City,the Owners may elect ta enga�e
a licensed civil engineer registered An the state of Washingtnr�who has expertise ir�drainage to
inspect the drainage facilities �nd pravide a written report describing their conditic�n. If the
engineer option is chosen,the Owners sh�ll provide written natice to the City of Rentara within
fifteen (15)days of receiving the City's notice o�f inspection.Within thirty(30)days of giving this
not�ce,the C7orvners,or engineer on behalf of the Owners,shall pravide the engirreer°s report taa
the City af Rentc�n. If the report is not pravided in a ti�ely manner as specifred above,the City
of Renton rnay inspect the dralnage facilities witho�t further notice.
3. If City of €3ent�n determines from its inspection, ar from an engineer's repart provided in
accordance v�ith Paragraph 2,that maintenance, repair, restaration, and/or rnitigatior� wark is
required to �e done to any of the drair�age facilities, City�f€tenton shall r�otify the Ovuners of
the specific rnaintenance, repair, restoration, and/ar mitigation uvark (`°Work") required
pursuant to the Renton Municipal Code. The City shall aBso set a reasonable deadline for the
O�nrners to campfete the Work, ar ta provide an engiraeer's report that verifies compfetion of
th� V1�ark. After the deadline has passed, the Owners shall allaw the City access to re-inspect
the drain�ge facilities unless an engineer's report has been pravided verifyirsg compietion of
the Work, If the Work is not completed within the time frame set by the City, the City may
initaate an enforcernent actian andjor perform the Work and hereby is given access to the
Property for su�h purposes. Written notice will b� serat to the Owners stating th� City's
antentior�to perform su�h Vtlork.This llVork wri9!not commence until at least seven(7}days a�ter
such natice is mailed. If, within the sole diseretion of the City, there exists an irraminent or
present danger, the seven {7) day notice peri�d wil6 be waived and 1tliork will be�in
irnmediately.
4. T�he Owners shall assume all responsibility for the cnst of any Work, or any m�asures taken by
the City to address conditions as d�scribed in Paragraph 3. Such responsibility shall Artclude
reimbursement ta the�ity within thirty(30)days of the receipt of the invoice for any such Wark
performed. Overdue payments wifl require payrrtient of interest at the maximum le�al rate
aliowed by RCW 19.52.020 (currently twelve percent(12%}}. If the �ity initiates legal action t�
�nforce this agreement, the prevailing party in such action is entitl�d to recover reasanable
iitigation costs and attorney's fees.
5. The Owners are required to obtain written approval from City of Rer�ton priar to filling, piping,
cutting, or removeng vegetation (except in routine landscape rnaintenance) in open vegetated
stormwater 'F3ClIB$B25 (such as swales, channels, ditches, ponds, etc.}, or performing any
alterations or modifications to the drainage facilities referer�ced in this Deelaration of Carrenant.

6. Any not�c�or consent requir�d to be given or r�therwise pravided for by the provisions of this
Agreement shall be�ffective upon person�l delivery,ar three(3)days after mailing by Certified
Mail, return receipt requested.
7. With regard to the matt�rs addressed her�in,this agreement constitutes the entire agreement
between the partias, and sup�rsedes all priar discussions, n�gotiations, and all a�reements
whatsoev�r whether oral ar wrdtten.
8. This Dec9aratian of Cavenant is intended to pratect the value and d�sirability and promote
efficient and effeetive rnanagement of surface water drainage of the real property described
above, a�od shall inure to the benefit of all the citizer�s csf the City o#Renton and its s�ccessars
and assigns. This C7eclaratian csf Covenant shall run �nrith the land arad be binding upon
Grantor(s), and Grantor°s{s'}successars in interest, and assigns.
9. This C�eelaratian of Covenant ma�+ be terrr'inated by execution of a written agreemertt by th�
Qr�rners and the Cwty that ws r�corded by King County in its real prmperty r�cords.

and debris in the inlet rack.The signifmcar�ce af accurnulated trash and debris is a rr�atter ofjudgmerrt.
Offten,much of the trash and debris may be removed manualfy at the time of inspectian if a separate
maintenance visit is not yet warranted.
• If it has n�t�ained within the past 24 hours,note whether standing wat�r is observed in the biofaltration
charnber.
• Finaily,observe,quantify and record presence of invasive vegetation and the amount of trash and debris
and sedim�nt load in the biofiltr�tion chamber.Erosion of the rnulch and biofiltration media bed shauld
also be recorded. Sediment load may be rated light,mediurri�r he�vy depending on the conditions.
Loading characteristics may be determined as follows:
o Light sedirnent leaad-seddrnent is diffwcult tc�disfi�guish�mc�ng the mwlch f bers at the t�p of the
mu6ch layer;the rrru6ch appears almast�ew.
o Msdium sediment load-sediment accumul�tion is app�rent and may be concentrat�d in same areas;

� The curb iniet or inlet rack is abstructed.
• Standing wa4er is abserved in the biofiltration chamber more than 2�haurs after a rainfall event(use
discretion if the BioPod is located dowr�strearn of a storage system that�tt�nuates flow).
� l�rash and debris in the inlet rack cannat be e�sily removed at the tirne of inspection.
• Trash and debris,invasive vegetation or sediment load in the biofoltration chamb�r is heavy ar�excessive
erosion has occurred.

11�aintena�ce Proc�dur�s
Maintenanc�should be conducted during dry w�ather when na flowas are entering the system.All rnaintenanee
may be conduct�d without en#ering the BioPod structure. Oe�ce safiety measures such as traffsc control are
deplayed, the access covers may be removed and the following activities may be canducted to complete
main�enance:
• Remove alf trash and debris from the c�arb inlet and inlet rack manually or by using�vacuum truck as
required.
• Remove all trash and debris and invasive vegetation fror�the biofiltration charnber manually or by using a
vacuum truck as required.
� If the sediment load is medium or light but ermsfon of the biofiltration medi�bed is evident,redistribute
the mulch with a rake or replace missing mulch as appropriate. If erosion persists,racks may be placed in
the eroded area to help d'mssipa#e energy and prevent recurring erosion.
� If the sediment load is heavy,r�emove the mulch layer using a hoe,rake,shovel and bucket,or by using a
vacuum truck as required. If the sediment load is particularBy heavy,inspect the surface af the bi�faltration
media onee the mulch has been removed.If the media appears clogged with sediment,remove and
replace on�or two inches of biofiltration media priar to replacing the�raulch layer.
• Prune vegetation as appropriate and replace damaged or dead plar�ts as r�quired.
• Replace the tree grate andfor access cover�and sweep the area around the BioPod to leave the site cl�an.
• All rnateria!removed from th�BiaPod during mainter�ance must be disposed of in accordance vuith local
environrr�ental regulations.In most cases,the material may be handled in th�same manner as disposal
of material remaved frorrt sumped catch basins or manho9es.
