PROJECT DESCRIPTION: The project applicant has requested a Routine Vegetation Management Permit (RVMP)
and Critical Areas Exemption for the removal of 30 trees on the subject property. The property is zoned Residential-
8 (R-8) and located within the Residential Medium Density land use designation. The property is 63,850 square
feet (1.47 acres) in size and contains a detached dwelling unit and accessory structure. The applicant submitted an
Arborist Report prepared by Washington Forestry Consultants dated August 17, 2022 with Basic Tree Risk
Assessment Forms dated January 9, 2023. A Geotechnical Report prepared by Geo Group Northwest, Inc dated
November 15, 2022 was also submitted. The Arborist Report indicates the subject property contains 56 significant
trees. The report provides an inventory of 43 trees that are located on the eastern portion of the property and has
provided assessment forms for 10 of those trees. Since the date of the report, two (2) trees (#3 and #10) along the
eastern portion have fallen. Tree removal is proposed along the eastern portion of the property and is a
combination of high-risk trees, dead trees, and trees that obstruct solar access to rooftop photovoltaic devices
located on the property’s detached dwelling unit. The applicant has also requested trees not determined to be
high-risk to be removed. The Geotechnical Report indicates the subject property contains a sensitive slope along
the eastern portion of the property and protected slope in the northeast corner of the site. Planning staff
conducted a site visit to the subject property on September 22, 2022.
DECISION AND ANALYSIS: The RVMP and Critical Areas Exemption are partially approved based on the analysis,
review criteria, justification, and findings below. Conditions of this partial approval are provided above the
signature of this decision. The following tree numbers from the Arborist Report (Attachment 1) are approved for
removal: 1, 2, 4, 5, 6, 7, 8, 9, 14, 17, 25, 32, 33, 37, 38, 41, 42, and 43. Following a site visit by Planning staff, it was
determined that trees 1,2,4,5,6,7,8,9,41,42, and 43 were obstructing solar access to the applicant ’s photovoltaic
panels on the subject property. The conditions of trees 33 and 37 were identified as poor and very poor,
respectively, in the arborist report however the assessment forms did not identify them as high-risk. Due to the

health conditions noted in the assessment forms, staff finds these trees may be removed as they would count
towards the minor tree removal activities allowance set forth in RMC 4-4-130C.9. The remaining trees allowed for
removal are either dead or high-risk as provide in the tree risk assessment forms. Staff finds no compelling reason
in the Arborist Report or Geotechnical Report (Attachment 2) to allow requested removal of non high-risk trees or
removal of trees not accompanied with an assessment form at this time.
GENERAL REVIEW CRITERIA 4-9-195D4:
YES 1. The lot shall comply with minimum tree credit requirements pursuant to RMC 4-4-130,
Tree Retention and Land Clearing Regulations.
Staff Comments: King County Department of Assessments has identified the subject
property as 1.47 acres in size. Pursuant to RMC 4-4-130H.b.i, tree credit requirements shall
apply at a minimum rate of 30 credits per net acre and therefore the subject property would
be required to maintain 44 tree credits. Following the removal of trees granted by this
permit, the lot would contain at least 153 tree credits. The total count is higher than this
amount as the tree credit value of the 13 trees located on the western portion of the site
were not assessed in the arborist report as no removal in or around the western portion of
the property is proposed.
YES 2. The land clearing and tree removal shall be consistent with restrictions for critical areas,
pursuant to RMC 4-4-130, Tree Retention and Land Clearing Regulations, and RMC 4-3-
050, Critical Areas Regulations.
Staff Comments: The applicant has requested to remove high-risk trees from mapped
sensitive and protected slopes. A Geotechnical Report (Attachment 2) was submitted with
the application. The report did not identify any adverse impacts associated with the tree
removal. Pursuant to RMC 4-3-050C.3.c.iii, dangerous tree removal is an exempt activity
in geologic hazard areas. As the activity is exempt in the critical areas regulations and the
geotechnical report identified no impacts, the proposed tree removal is consistent with
restrictions noted in this review criterion.
YES 3. Removal of a landmark tree shall meet the review criteria for removal off landmark tree,
pursuant to RMC 4-4-130, Tree Retention and Land Clearing Regulations.
Staff Comments: The following trees associated with this RVMP meet the landmark trees
definition: #17 , #25 , and #38 . As provided in the Tree Risk Assessment Forms (Attachment
3), these trees have been rated as high-risk as it relates to likelihood of failure, impact, and
consequences. Pursuant to RMC 4-4-130F.2.c.i a, removal of a landmark tree may be
granted where the tree is determined to be a high-risk tree. Therefore, the removal of the
landmark trees noted above are consistent with the limitations of this review criterion.
YES 4. Street frontage and parking lot trees and landscaping shall be preserved unless otherwise
approved by the Administrator.
Staff Comments: Trees along the street frontage would remain and the subject property
does not contain a parking, therefore the limitations of this criterion have been met.
N/A 5. The land clearing and tree removal shall not remove any landscaping or protected trees
required as part of a land development permit.
Staff Comments: Not applicable. The subject property does not contain landscaping or
protected trees required as part of a land development permit.

YES 6. The land clearing and tree removal shall maintain visual screening and buffering between
land uses of differing intensity, consistent with applicable landscaping and setback
provisions.
Staff Comments: The tree removal associated with this permit does not affect any visual
screening or buffering functions. The abutting properties zoning designations and land
uses are also Residential-8 and contain or will contain in the near future, as is the case with
the Canopy Subdivision, detached dwelling units. No required visual landscaping buffering
is required by abutting Residential -8 zoning designations. The result of the tree removal
will not cause the subject property to fall below minimum tree credit standards and the
site will maintain a significant number of mature large species trees. Therefore, the tree
removal associated with this permit is consistent with this review criterion.
YES 7. The land clearing and tree removal shall not create or contribute to a hazardous condition,
such as increased potential for blowdown, pest infestation, disease, or other problems that
may result from selectively removing trees and other vegetation from a lot.
Staff Comments: The geotechnical report indicated that removal of the trees will unlikely
result in a negative impact on slope stability, however the report did identify
recommendations to promote stability of the slope following tree removal. Therefore, staff
recommends as a condition of approval the applicant follow the recommendations of the
geotechnical report prepared by GEO Group Northwest that include but are not limited to:
retaining the roots within the protected slope area; applying mulch to the protected slope
and sensitive slope area; and replanting the protected slope and sensitive slope areas with
native vegetation. The applicant shall mulch the area immediately following the tree
removal and revegetation shall occur within six (6) months of tree removal or one (1) from
the date of this decision, whichever occurs first. Additionally, the applicant shall schedule
an inspection of the tree removal and revegetation with the Current Planning Project
Manager within one (1) year of this decision.
CRITICAL AREA: Geologically Hazardous Area
CRITICAL AREAS EXEMPTION JUSTIFICATION: Renton Municipal Code 4-3-050C.3..c.iii – Agricultural, Harvesting,
Vegetation Management: Dangerous Trees
FINDINGS: The proposed development is consistent with the following findings pursuant to RMC section 4-
3-050C.2.d:
1. The activity is not prohibited by this or any other provision of the Renton Municipal Code or State
or Federal law or regulation;
Staff Comment: The Tree and Retention and Land Clearing Regulations allow s tree removal in
excess of the maximum allowance and landmark tree removal with Routine Vegetation
Management Permit. The Critical Areas Regulations allows dangerous trees to be removed in a
geologically hazardous area with a Letter of Exemption. Additionally, the tree removal is not
prohibited by State or Federal law or regulation.
ii. The activity will be conducted using best management practices as specified by industry standards

or applicable Federal agencies or scientific principles;
Staff Comment: Per the conditions associated with the RVMP, the applicant will be required to
mulch and revegetate the disturbed areas following the tree removal. Additionally, the roots from
the felled trees will remain to further stabilize the slope after the trees are removed.
iii. Impacts are minimized and, where applicable, disturbed areas are immediately restored;
Staff Comment: Tree removal is limited to high-risk trees, trees that are obstructing solar access
to existing photovoltaic panels, and trees within the minor tree removal activities allowance.
Disturbed areas would be mulched and revegetated per the conditions of the RVMP.
iv. Where water body or buffer disturbance has occurred in accordance with an exemption during
construction or other activities, revegetation with native vegetation shall be required;
Staff Comment: Not applicable. The subject property is not located near a water body or
associated buffer.
v. If a hazardous material, activity, and/or facility that is exempt pursuant to this Section has a
significant or substantial potential to degrade groundwater quality, then the Administrator may
require compliance with the Wellhead Protection Area requirements of this Section otherwise
relevant to that hazardous material, activity, and/or facility. Such determinations will be based
upon site and/or chemical-specific data.
Staff Comment: Not applicable. The removal of the trees associated with this permit does not
involve hazardous material, activities, or facilities. The site is not within a Wellhead Protection
Area.
DECISION: The Kowalczyk RVMP and CAE, LUA23-000030 is Partially Approved
and subject to the following conditions:
*CONDITIONS OF APPROVAL:
1. The applicant shall follow the recommendations of the geotechnical report prepared by GEO
Group Northwest that include but are not limited to: retaining the roots from the felled trees
within the protected slope area; applying mulch to the protected slope and sensitive slope area
following tree removal; and replanting the protected slope and sensitive slope areas with native
vegetation.
2. The applicant shall mulch the area immediately following the tree removal and revegetation shall
occur within six (6) months of tree removal or one (1) from the date of this decision, whichever
occurs first. Additionally, the applicant shall schedule an inspection of the tree removal and
revegetation with the Current Planning Project Manager within one (1) year of this decision.

RECONSIDERATION: Within 14 days of the decision date, any party may request that the decision be reopened
by the approval body. The approval body may modify his decision if material evidence not readily discoverable
prior the original decision is found or if he finds there was misrepresentation of fact. After review of the
reconsideration request, if the approval body finds sufficient evidence to amend the original decision, there will
be no further extension of the appeal period. Any person wishing to take further action must file a formal
appeal within the 14-day appeal time frame.
APPEALS: Appeals of permit issuance must be filed in writing on or before 5:00 p.m. on February 23, 2023. An
appeal of the decision must be filed within the 14-day appeal period (RCW 43.21.C.075(3); WAC 197-11-680). Appeals
must be submitted electronically to the City Clerk at cityclerk@rentonwa.gov or delivered to City Hall 1st floor
Lobby Hub Monday through Friday. The appeal fee, normally due at the time an appeal is submitted, will be
collected at a future date if your appeal is submitted electronically. The appeal submitted in person may be pai d
on the first floor in our Finance Department. Appeals to the Hearing Examiner are governed by RMC 4-8-110 and
additional information regarding the appeal process may be obtained from the City Clerk’s Office,
cityclerk@rentonwa.gov.
EXPIRATION: The Routine Vegetation Management Permit shall be valid for one (1) year from the date of issuance.
An extension may be granted by the Planning Division for a period of one year upon application by the property
owner or manager. Application for such an extension must be made at least 30 days in advance of the expiration
of the original permit and shall include a statement of justification for the extension. The Critical Areas Exemption
Certificate expires five (5) years from the date of decision (date signed).

RE: Tree Assessment
Dear Mr. Kowalczyk:
We have evaluated all trees on your property at 4124 Lincoln Avenue NE in Renton, WA. The
purpose was to conduct a tree inventory, determine the condition of the trees, and identify trees for
removal. An inventory was completed on July 11, 2022.
Findings and Recommendations
The Canopy site is a new residential subdivision on 10-acres in the City of Renton. An adjacent
landowner, Mac Kowalczyk at 4124 Lincoln Avenue NE, contacted Century Communities about
the potential to remove trees on his property. He was concerned about the increased risk of failure
to trees on his property due to the recent clearing on the Canopy site. Removing the trees would
also provide additional unobstructed views for the Canopy site. We conducted an assessment of
trees on the east side of the Kowalczyk parcel. An inventory of trees on the west side of the
property was also completed to account for all trees on the Kowalczyk parcel.
The tree species that are proposed to be removed are native coniferous and deciduous trees.
Species include Douglas-fir (Pseudotsuga menziesii), bigleaf maple (Acer macrophyllum), red
alder (Alnus rubra), western redcedar (Thuja plicata), and Scouler’s willow (Salix scouleriana).
The size of the evaluated trees ranges from 8 to 34 inches in diameter at breast height (DBH). The
conditions of the trees vary between ‘Dead’ and ‘Good’ with most trees being in ‘Fair’ condition.
A map with general tree locations is found in Attachment 1 and a list of all assessed trees is found
in Attachment 2.

An inventory of the remaining trees on the lot found thirteen trees in ‘Very Poor’ to ‘Good’
condition. Those additional trees are between 10 to 43 inches DBH. Tree species are red alder,
bigleaf maple, Douglas-fir, western redcedar, costal redwood (Sequoia sempervirens), horse
chestnut (Aesculus hippocastanum), weeping willow (Salix babylonica), flowering plum (Prunus
cerasifera), and Norway spruce (Picea abies). These trees were tallied but not numbered in the
field.
A total of 56 significant sized trees were found on the Kowalczyk parcel. Thirty-three (33) of
those trees are in ‘Fair’ or better condition. The remaining 23 trees are in ‘Poor’ or worse
conditions. The City of Renton requires at least 26 trees to be retained on the Kowalczyk parcel
based on the square footage of the lot. A Routine Vegetation Management Permit would be
required to remove the trees. Mr. Kowalczyk plans to remove all unhealthy trees and seven healthy
trees. Healthy trees recommended for removal are numbers 12, 24, 26, 30, 31, 36, and 39.

Summary
Fifty-six (56) significant sized trees were found on the Kowalczyk parcel in Renton, WA. Thirty-
one (33) of the trees are considered healthy long-term trees. The home owner was concerned about
potential tree failure between his home and the Canopy site from exposure due to recent clearing.
The City of Renton Code requires 26 healthy trees to be located on the parcel. Mr. Kowalczyk is
proposing to remove all trees in ‘Poor’ or worse condition and seven healthy trees. The required
tree density of 26 trees is still met with the removal of the seven healthy trees.

GEO Group Northwest, Inc., has reviewed the comments from the City of Renton pertaining to
the removal of trees on the above-subject property. We understand that the client is seeking a
Routine Vegetation Management Permit, from the City of Renton to remove up to all trees on the
property, and that the City of Renton has requested a brief geotechnical report to review the
arborist’s recommendations, assess geologic hazardous areas onsite and to provide any
recommendations for mitigation as it relates to removing trees on the slope.
SITE DESCRIPTION
The above referenced property is located in north Renton. The property is surrounded by another
single-family residential property to the south, Lincoln Avenue NE to the west, and a large, short

plat development that is currently under construction stretching over multiple parcels to the north
and east of the subject property. The site is approximately 63,850 square feet, and has a single-
story home on the flatter, west portion that was built in 1946. The property is primarily flat with
a gradual incline from the center of the property to the east most property line. There is a City of
Renton low slope hazard covering the east side of the property, a small stretch of this slope is
designated as sensitive and the north-east corner of the site is mapped as a protected slope.

Proposed Tree Removal
Based on the above-referenced Arborist report, a total of 56 significant sized trees were found on
the subject parcel. Thirty-three of those trees are in ‘Fair’ or better condition and the remaining
23 trees are in ‘Poor’ or worse conditions. The report states that healthy trees recommended for
removal are tree numbers 12, 24, 26, 30, 31, 36, and 39. The City of Renton requires at least 26
trees to be retained on the parcel based on the square footage of the lot, however the client is
seeking a Routine Vegetation Management Permit to remove all the trees onsite. Some of the
trees to be removed are located on the west, flat side of the lot, however the majority of the trees
to be removed are located in the 15-25% City of Renton Slope designation as well as the
sensitive and protected slope areas.
SITE INVESTIGATION
Geology
Based on a review of the geologic maps for the area, the surficial soil in the area is mapped as
Glacial Till (Qvt). Glacial Till deposits typically consist of very compact mixtures of sand, silt,
clay, and gravel that were overridden and over-consolidated by glacial ice during the Fraser
glaciation period which ended approximately 13,000 years ago.
Geotechnical Investigation:
On November 3rd, 2022, a Staff Geologist from our office visited the site to observe subsurface
conditions and locations of trees with proximity to steep slopes to assess general stability. The
site was forested and had a thick ground covering of leaves. Onsite we also observed remnants of
blackberries and plant debris. Both locations mapped as protected and sensitive slopes were
probed and observed to be dense.

To observe subsurface conditions, we used an excavator to dig two test pits onsite. Test Pit 1
(TP-1) was dug on the north-eastern side of the gentle slope. Below a thick ground cover of plant
debris, we observed dense, tan silty sand with a high silt content to a depth of 2.5 feet. The soil
appeared to lighten downwards and increase in density with depth. Towards the south-east corner
of the site, Test Pit 2 (TP-2) was dug tot total depth of 2 feet below ground surface. This tan silty
sand also lightened downwards, was dense, and had a very high silt content. We interpret these
soils to be dense, native soils. No groundwater, channels or signs of erosion were observed
onsite. For a more detailed description of subsurface soils please see Appendix A – Test Pit Logs.
Geologic Hazardous Areas – Steep Slope
The east half of the site is where the majority of trees are proposed to be removed. This east half
of the site is mapped as a City of Renton Slope hazard and it gradually slopes up towards the east
property line. The east side of the property is primarily a steady, terraced, 15%-25% slope that is
separated from the flat side of the property by a sensitive 25%-40% slope. The only area onsite
mapped as a protected slope greater than 40% is a small area less than 100 square feet in the
north-east corner of the site.
In our subsurface investigation, we observed that the site is underlain with dense to very dense
native soils approximately 2 feet below the ground surface. We also probed the sensitive and
protected slope and found them to be underlain with dense soils. In our professional opinion,
because of the dense native soils observed onsite, removing any and all trees on the sensitive and
protected slope areas is unlikely to affect slope stability.
Conclusions and Recommendations
In our opinion, due to the dense to very dense native soils that underly the site, the gentle angle
of the slope and the small size of the sensitive and protected slope areas, the removal of trees will
be unlikely to have a negative impact on slope stability and will not increase the risk of
landslides or erosion in the area. Removing the current trees, leaving the roots in the protected
slope area, and planting new, native species will likely promote stability on the slope and
mitigate the risk of erosion and landslides on the slope. The trees should be removed in the order
of priority as designated by the arborist with the dead, very poor, poor and fair condition trees
removed first. The roots of the trees should remain behind in the protected slope area, and the
client should revegetate, mulch and replant native species on locations designated as sensitive
and protected slopes.

In our opinion, provided that the included detail and recommendations provided in our report and
this letter are properly implemented, it is our opinion the proposed development will not increase
the potential for soil movement; and the risk of damage to the proposed development or from the
proposed development to the adjacent properties from soil instability will be minimal.
