Renton Planning Department , 201 Mill Ave. So . , 'Renton ,
WA 98055 - PLEASE RETURN .
Mr . Hite was advised that he would probably have to
leave the papers at the King County Assessor ' s office
and receive the recording number later .

REPORT AND RECOMMENDATION .
APPLICANT: Renton Property Venture FILE NO. Short Plat 201-78
W-209-78
LOCATION: Between Hardie Avenue S.W. and Rainier Avenue S. , just south
• of S. 2nd Street.
SUMMARY OF REQUEST: Applicant requests. approval of a proposed three-lot short plat
• and waiver of off-site improvement requirements of the
Subdivision Ordinance.
SUMMARY OF ACTION: Planning Department Recommendation: Approval of short plat
and approval of indefinite deferral of waiver.
Hearing Examiner Decision: Approval subject to restrictive
covenants.
PLANNING DEPARTMENT The Planning Department staff report was received by the
REPORT: Examiner on July 27, 1978 and August 17, 1978.
PUBLIC HEARING: After reviewing the Planning Department report, examining
available information on file with the application, and
field•checking the property and surrounding area, the
Examiner conducted a public hearing on the subject as
follows:
The hearing was opened on August 1, 1978 at 9:15 a.m. in the Council Chambers of the
Renton Municipal Building. Gordon Y. Ericksen, Planning Director, reported receipt of
information this date of the applicant's intent to apply for a waiver concurrently with
the short plat request, and recommended continuance of the application until August 22,
1978 to allow review of the waiver request. The Examiner asked the applicant if he
concurred in the recommendation of the Planning Director. Responding was:

Mr. Hite indicated his concurrence, also noting' concurrence in the recommendations of
' the Planning Department contained in the staff report.
The Examiner reported that the application would be continued: until August 22, 1978 and
would be placed second on the agenda. The hearing was subsequently closed at 9:17 a.m. •
CONTINUANCE:
The hearing was opened on August 22, 1978 at 9:40 a.m. in the Council Chambers of the
Renton Municipal Building.
Parties wishing to testify were affirmed by the Examiner.
It was reported that the Hearing Examiner and the applicant had received and reviewed
the Planning Department reports and the reports were entered into the record as Exhibit #1.
Michael Smith, Planning Department, reviewed Exhibit #1, and entered the following
additional exhibits into the record:
Exhibit #2: Letter to the Planning Department from
John N. Hite, dated August 1, 1978,
request for waiver.
Exhibit #3: Short Plat Map '

The Examiner asked 'the applicant if he concurred in Exhibit #1. Mr. Hite indicated his
concurrence and reported that because of existing terrain and absence of improvements
on Hardie Avenue S.W. , an indefinite postponement of improvements was appropriate.
The Examiner noted the recommendation contained in Exhibit #1 pertained to requirement
of improvements upon development of Parcel 3 or as directed by the city. Mr. Hite did
not anticipate such direction by the city because improvements currently do not exist
on Hardie Avenue S.W. He also noted his intent to provide full utility service and

access to Parcel 3 from Rainier Avenue S.
The Examiner requested further testimony in support of the application. Responding was:

Mr. Houser referenced departmental comments submitted by the Public Works Department
attached to Exhibit #1 which he read as follows: "rather than waive the off-site
improvements, the Public Works Department suggests a covenant go with the property
requiring the improvements to Hardie Avenue S.W. when the property (Parcel 3), develops
or when directed by the city. " He encouraged similar treatment for the applicant as
had been extended to other developments on Hardie Avenue S.W. such as the Century 21
building and the Farrell duplex, noting installation of asphalt paving 'with extruded
curbs and drain pipe in open ditches. He advised the applicant's intent to provide
restrictive covenants to ensure similar improvements on the subject property. Mr.
Houser indicated the applicant's concern regarding the necessity for street widening
due to the proximity of the street to the steep slope located on Parcel 3 and the
indefinite nature of proposed improvements. Mr. Hite requested clarification of the
off-site improvement requirements. The Examiner reported city policy to require curbs,
gutters, sidewalks and half-street paving. Mr. Smith indicated that developments in
the area referenced by Mr. Houser may not have occurred through the subdivision process
and improvements may have been determined through application of other ordinances. He
indicated that further research would be necessary to determine if the developer had
met city standards to date.
The Examiner requested further testimony in support of the application. Responding was:

Mr. Pasco indicated that the Farrell duplex development on the west side of Hardie Avenue
S.W. located one-half block from the subject site had not installed off-site improvements,
and noted the parking strip currently contains crushed rock. He felt that an inconsistent
application of city ordinances would be evident if such off-site requirements were imposed
upon the applicant.
The Examiner requested further testimony in support or opposition to the request. There
was no response. He requested further comments from Mr. Smith. Mr. Smith reiterated
previous comments relating to possible inapplicability of subdivision requirements to
other developments in the area, and noted that the Public Works Department was responsible
for requiring such improvements.
The Examiner asked Mr. Smith if off-site improvements installed along Rainier Avenue S.
were satisfactory. Although Mr. Smith was uncertain if final approval had occurred, he
felt that improvements met with the department's satisfaction. The Examiner referenced
Analysis No. 3 contained in the addendum to Exhibit #1 relating to previously established
city policy that in lieu of granting a full waiver, restrictive covenants be required,
and asked if the policy was established for commercial properties only. Mr. Smith advised
that the policy was the same for all development with added requirements of the off-site
improvements ordinance administered by the Public Works Department for any development
of over $10,000 in value. He advised the policy established by the City Council not to
grant full waivers to ensure that improvements are installed at a later date.
The Examiner indicated his recommendation to close the public hearing and obtain information
from the Public Works Department relating to off-site improvement requirements of other
developments in the area, i.e. Farrell duplex and Century 21 development. He noted that
all correspondence regarding this matter would be attached to the published. Examiner's
Report and Recommendation. Mr. Houser indicated the applicant's desire to be apprised
of specific improvements to be incorporated into restrictive covenants. Mr. Smith
reported that off-site improvements would consist of curbs, gutters, sidewalks, street
paving and storm drainage provisions related to street construction. He also noted
separate requirements for water and sewer service. Mr. Hite reported his concern with
full improvements of the street, and indicated a desire for modification to that
requirement in the ordinance to allow temporary improvements as had been accomplished.
by adjacent properties until such time as major improvements occurred to the entire street.
He also noted that emphasis had been minimized for access from Hardie Avenue S.W. to
Parcel 3, with major access planned from Rainier Avenue S. Responding to the Examiner's
inquiry regarding whether access was planned from Hardie, Mr. Hite indicated that
although definite plans had not been formulated, possible access would be provided from
Hardie Avenue S.W. .

Mr. Smith entered an additional exhibit to designate current access provisions from
Rainier Avenue S. The exhibit was labeled by the Examiner as follows:
Exhibit #4: Plan of Grades, Storm Sewers and Detention
Mr. Smith explained the plan and designated the area of steep slope along the westerly
portion of Parcel 3. The Examiner noted that improvements would abut the property line
of Parcel 3 and mayor may not affect the property in retention of fill or grade material.
He inquired if parties in attendance had any objection to securing previously mentioned
information regarding other developments in the area from the Public Works Department
and attach all correspondence to his final report. There was no objection.
The Examiner requested further comments. Since there were none, the hearing on File No.
Short Plat 201-78 and W-209-78 was closed by the. Examiner at 10:15 a.m.,
FINDINGS, CONCLUSIONS & RECOMMENDATIONS: . Having reviewed the record in this matter, the
Examiner now makes and enters the following:
FINDINGS:
1. The request is for approval of a three-lot short plat and waiver of off-site improvements
along Hardie Avenue S.W.
2. The Planning Department report accurately sets forth the issues, applicable policies
and provisions, findings of fact, and departmental recommendations in this matter,
is uncontested, and is hereby attached as Exhibit #1 and incorporated in this report
by reference as set forth in full therein.
3. Pursuant to the City of Renton's Environmental Ordinance and the State Environmental
Policy Act of 1971, as amended by R.C.W. 43.21.C. , Gordon Y. Ericksen, responsible
official, determined the proposal to be exempt from the threshold determination and
EIS requirements.
4. Plans for the proposal have been reviewed by all city departments affected by the
impact of this development and no adverse comment was expressed.
5. There was no opposition to the proposal expressed.
6. All existing utilities are available and in close proximity.
7. The proposal is compatible with the required setbacks, lot coverage and lot area
requirements of Sections 4-711 (B-1) and 9-1108.24.E (Subdivision Ordinance) of
Title IV, Ordinance No. 1628, Code of General Ordinances.
8. Accompanying the short plat application is an affidavit attesting to ownership of
the property by the applicants (Section 9-1106.3.H. (1) ) .
9. Abutting streets of Hardie Avenue S.W. and Rainier Avenue S. are dedicated public
streets (Section 9-1106.3.H. (2) ) . On Exhibit #3, Short Plat Map, Hardie Avenue S.W.
was shown as 91st Avenue S. , which requires connection.
10. The short plat map, Exhibit #3, represents a survey conducted by a licensed land
surveyor (Section 9-1106. 3.H. (3) ) .
11. Off-site improvements have been installed on Rainier Avenue S. (Section 9-1106.3.H. (5) ) .
12. A title, insurance policy was not provided per Section 9-1106.
13. Certification by the King County Health Department and the King County and Renton
Finance Departments will occur prior to, at or immediately following filing of the
final plat (Section 9-1106. 3.H. (4) , (7) and (8) ) .
14. . Development has occurred on two of the three proposed lots. Specific plans were not
indicated for the third lot, but access to the lot was stated to include Hardie
Avenue S.W. The normal off-site improvements do not exist along Hardie Avenue S.W.
in the near vicinity. At least in two instances (Century 21 and Farrell properties
per attached memorandum of August 30, 1978 from the Public Works Department) off-site
improvements have been deferred for two years by the Board of Public Works. These
improvements were not waived.
A single 30-foot driveway serves the three lots from Rainier Avenue S. This driveway
fulfills the Fire Department requirements per Exhibit #1.

CONCLUSIONS:
1. The proposal conforms to the Comprehensive Plan and zoning requirements. Except
for the requested waiver of off-site improvements, the proposal conforms to the
Subdivision Ordinance.
2. Off-site improvements that exist in Hardie Avenue S.W. do not conform to the
Subdivision Ordinance, Section 9-1108.7.H (Section 9-1105.6.B) . Per the attached
memorandum of August 30, 1978 .from the Public Works Department at least two'
developments have had these improvements deferred, not waived.
The precedence seems clear, therefore, of not granting waivers along this street.
The applicant will not be deprived of any rights or privileges by disapproval" of
the waiver (Section 9-1109.1.B) . Although some difficulty may occur' in providing
.these improvements, insufficient justification was given to substantiate that
deprivation of reasonable use of the -property would occur (Section' 9-1109.1.A) . •
•
Testimony. was not provided showing the waiver to not be' detrimental to the public
welfare or other properties (Section 9-1109.1.C) . If the aforementioned two
properties are to install the improvements, they may be prejudiced by a waiver on
this property.
On the basis of this information it seems reasonable to deny a complete waiver
and approve a limited waiver subject to the applicant attesting in covenants to
participation in an LID at such time as the off-site improvements are required
by the city. The improvements are required but at a time when an LID is formed
for the street. However, the applicant may desire to install these improvements
prior to that time, e.g. , when the driveway to Hardie Avenue S.W. is constructed.
3. Certification per 9-1106.3.H. must occur prior to final approval of the short plat
by staff per Section 9-1105.7, except for Sections 9-1106.3.H. (4) and (7) .
DECISION:
•
Based upon the record, testimony, findings and conclusions, it is the decision of the
Examiner to approve the short plat (Exhibit #3) subject to completion of certification
per Section 9-1106.3.H. per approval of the Planning and Public Works Departments and
compliance with all other applicable regulations and ordinances.
It is also the Examiner's' decision to approve a waiver of off-site improvements ih
Hardie Avenue S.W. subject to completion. of restrictive covenants agreeing to participate
in an LID for these improvements on a fair and equitable basis at some time in the future
as required by the city.

To allow subdivision of the subject site into three lots for continuance
of the two business uses on Rainier Avenue and the future development of

D. HISTORY/6ACKGROUND:
The subject site was annexed into the City by Ordinance No. 1320 dated
July 8, 1948.
E. PHYSICAL BACKGROUND:
1. Topography: The site rises from east to west at approximately a 10%
slope.
2. Soils: Beausite gravelly sandy loam (BeC); runoff is medium and the
erosion hazard moderate. This soil is used for timber and pasture
and for urban development.

3. Vegetation: The eastern two-thirds of the site has been asphalted
with some existing landscaping located in the northeast portion and
some planned for the southeast. The western one-third is dominated
by a dense cover of native shrubs and numerous alder trees.
4. Wildlife: The existing vegetation of the site provides suitable
habitat for birds and small mammals.
5. Water: There is no surface water evident on the site.
6, Land Use: The land use of the site consists of a restaurant in the
northeast portion of the site, a muffler repair shop in the southeast,
and undeveloped land in the western one-third, There exists to the
west of the subject site a duplex and some single family homes. To
the north is an existing service station and to the east and south are
commercial uses.
F. NEIGHBORHOOD CHARACTERISTICS:
The area is primarily commercial in nature with some scattered residential
uses.
G. PUBLIC SERVICES:
1. Water and Sewer: Existing 6-inch watermains run along Hardie Avenue
S.W. and Rainier Avenue South while a 6-inch sanitary sewer extends
along Rainier.
2. Fire Protection: Provided by the Renton Fire Department as per ordinance
requirements.
3: Transit: METRO Transit route 107 operates along Rainier Avenue South
adjacent to the subject site.
4. Schools: Earlington Elementary School is located approximately one and
one-quarter miles to the northwest, and Fred Nelsen Junior High School
one and three-quarters miles to the southwest and Renton Senior High
within one-quarter mile to the northeast.
5. Parks: Jones Park and Cedar River Park are located approximately
three-quarters of a mile east of the subject site and Talbot Hill Park
is within one and one-quarter miles to the south with Phillip Arnold
Park situated approximately one and one-half miles to the southeast.

future use. A 30-foot easement for ingress-egress and utilities is
proposed to control the access and reduce potential traffic problems.

A. SUMMARY OF REQUEST:
The applicant requests a waiver of the off-site improvement require-
ments of the Subdivision Ordinance related to the proposed Short
Plat No. 201-78.
B.-P. This report shall be considered as an addendum to the preliminary
staff report for the Renton Property Venture Short Plat No. 201-78,
dated August 1, 1978. The recommendation for such short plat remains
as stated in such previous report.
ADDITIONAL ANALYSIS:
1. Required improvements exist along Rainier Avenue South, but modi-
fications were necessary as part of development of lots 1 and 2
(Pizza Hut and Midas Muffler) .
2. The waiver request is for the curb, gutter, sidewalk, and street
paving along Hardie Avenue S.W. adjacent to the undeveloped
parcel 3.
3. The Public Works Department has recommended per previously estab-
, lished City policy that in lieu of granting a full waiver, a re-
strictive covenant be required which will require that improvements
be installed when the property (parcel 3) develops or as directed
by the City.
PLANNING DEPARTMENT RECOMMENDATION:'
Approval of an indefinite deferral as recommended in item 3 above.
Approval of the plat shall also be subject to applicable Fire Code
regulations at the time of construction.

C. PURPOSE OF REQUEST:
To allow subdivision of the subject site into three lots for continuance
of the two business uses on Rainier Avenue and the future development of
a third on Hardie Avenue.
D. HISTORY/BACKGROUND:
The subject site was annexed into the City by Ordinance No. 1320 dated
July 8, 1948.
E. PHYSICAL BACKGROUND:
1. Topography: The site rises from east to west at approximately a 10%
slope. �-
2. Soils: Beausite °gravelly sandy loam (BeC); runoff is medium and the
erosion hazard moderate. This soil is used for timber and pasture
and for urban. development.

3. Vegetation: The eastern two-thirds of the site has been asphalted
with some existing landscaping located in the northeast portion and
some planned for the southeast. The western one-third is dominated
by a dense cover of native shrubs and numerous alder trees.
4. Wildlife: The existing vegetation of the site provides suitable
habitat for birds and small mammals.
5. Water: There is no surface water evident on the site.
6. Land Use: The land use of the site consists of a restaurant in the
northeast portion of the site, a muffler repair shop in the southeast,
and undeveloped land in the western one-third. There exists to the
west of the subject site a duplex and some single family homes. To
the north is an existing service station and to the east and south are
commercial uses.
F, NEIGHBORHOOD CHARACTERISTICS:
The area is primarily commercial in nature with some scattered residential
uses.
G. PUBLIC SERVICES:
1. Water and Sewer: Existing 6-inch watermains run along Hardie Avenue
S.W. and Rainier Avenue South while a 6-inch sanitary sewer extends
along Rainier.
2. Fire Protection: Provided by the Renton Fire Department as per ordinance
requirements.
3: Transit: METRO Transit route 107 operates along Rainier Avenue South
adjacent to the subject site.
4. Schools: Earlington Elementary School is located approximately one and
one-quarter miles to the northwest, and Fred Nelsen Junior High School
one and three-quarters miles to the southwest and Renton Senior High
within one-quarter mile to the northeast.
5. Parks: Jones Park and Cedar. River Park are located approximately
three-quarters of a mile east of the,subject site and Talbot Hill Park
is within one and one-quarter miles to the south with Phillip Arnold
Park situated approximately one and one-half miles to the southeast. -

1. The subject proposal is consistent with the Comprehensive Plan which
designates the site commercial .
2. The proposal is compatible with adjacent commercial uses and similar
lot sizes in the area.
3. The size of the property is such that the proposed short plat can be
considered a reasonable use of the land.
4. Utilities are available to the subject site. Drainage plans must be
approved by the Public Works Department as part of site development.
5. Off-site improvements exist along Rainier Avenue. Such improvements
are not existing along Hardie Avenue S.W., but are required as part of
subdivision land development. A waiver has not. been requested. •
6. A Midas Muffler Shop is located on Parcel No. 1, and .a Pizza Hut
restaurant is located on Parcel No. 2. Parcel No. 3 is presently
undeveloped, but zoned for commercial use.
7. Suitable frontage and access exists along public rights-of-way (Rainier
Avenue South and Hardie Avenue, S .W.) for the proposed subdivision and
future use. _A 30-foot easement for ingress-egress and utilities is
proposed to control the access and reduce potential traffic problems.
P. PLANNING DEPARTMENT RECOMMENDATION:
Recommend approval 'of the short plat as requested subject to:
