existing driveway and installation of- crushed rock on turnaround area. Planning Department
report stated the-request was for deferral, of the paving.portion of-N.' 26th St. west of its •
current terminus to allow heavy construction vehicles to:. complete their work on a

section at this time are construction vehicles.. The report reconnended a six-months deferral

REPORT AND RECOMMENDATION .
APPLICANT: R. J. Beltz FILE NO. Short Plat 267-78

LOCATION: Vicinity of 1301 N. 26th Street.
SUMMARY OF REQUEST: The applicant requests the approval of a proposed two-lot short
plat and a waiver of required off-site improvements.
SUMMARY OF ACTION: Planning Department Recommendation: Approval withfrestrictive
covenants.
Hearing Examiner Decision: Approval with restrictive covenants.
PLANNING DEPARTMENT The Planning Department staff report was received by the
REPORT: Examiner on December 27, 1978.
PUBLIC HEARING: After reviewing the Planning Department report, examining
available information on file with the application, and
field checking the property and surrounding area, the
Examiner conducted a public hearing on the subject as
follows:
The hearing was opened on January 2, 1979 at 9:10 a.m. in. the Council Chambers of the
Renton Municipal Building.
Parties wishing to testify were affirmed by the Examiner.
It was reported that the Hearing Examiner and the applicant had received and reviewed
the Planning Department report, and the report was entered into the record as Exhibit #1.
Steve Munson, Planning Department, reviewed Exhibit #1,, and entered the following
additional exhibit into the record:

The Examiner asked the applicant if he concurred in Exhibit #1. Responding was:

Mr. Beltz indicated his concurrence in the report. He read and submitted the following
letter into the record which was labeled by the Examiner:
Exhibit #3: Letter to Hearing Examiner from R. J. Beltz,
dated December 1, 1978, regarding request for
waiver.
The Examiner also entered the following exhibit into the record:
Exhibit #4: Affidavit of Ownership
The Examiner inquired if the, applicant specifically concurred in Planning Department ,
recommendation for execution of restrictive covenants to ensure future participation
in a Local Improvement District for improvement of the extended roadway. Mr. Beltz
requested clarification of the recommendation. The Examiner explained that half-street
improvements consisting of curbs, gutters, sidewalks and paving would be required on a
fair-share basis if a Local Improvement District were formed voluntarily by 50% of
residents in the area or instigated by the City of Renton. Mr. Beltz indicated his
concurrence in the recommendation.
The Examiner requested further comments. Since there were none, the hearing on File No.,
Short Plat 267-78 and W-268-78 was closed by the Examiner at 9:30 a.m.

• FINDINGS, •CONCLUSIONS & DECISION: Having reviewed the record in this matter, the Examiner
now makes and enters the following:
FINDINGS: •
•
1. The request is for approval of a two-lot single family short plat and a waiver of
off-site improvements within N. 26th Street.
. 2. The Planning ,Department report accurately sets forth the issues, applicable policies
and provisions, findings of fact, and departmental recommendations in this matter,
is uncontested, and is hereby attached as Exhibit #1 and incorporated in this report
by' reference as set forth in full therein.
3. Pursuant to the City of Renton's Environmental Ordinance and the State Environmental
Policy Act of 1971, as amended by R.C.W. 43.21.C. , the proposal is exempt from the
threshold determination and EIS requirements of SEPA.
4. Plans for the proposal have been reviewed by all city departments affected by the
impact of this development.
•
5. There was no opposition to the proposal expressed.
•
6. All existing utilities are available and in close proximity. •
•
7. The proposal is compatible with the lot area and dimension•requirements of Section
4-729 (G) and 4-706 (R-1) of Title IV and Section 9-1108.23.F. (Subdivision Ordinance)
of Title IX, Ordinance No. 1628, Code of General Ordinances.
8. An affidavit of ownership was submitted (Exhibit #4) (Section 9-1106.3.H. (1) ) .•

9. A survey by a licensed land surveyor has not been completed per Section 9-1106.3.H. (3) .
10. Certification from the King County Health.Department and the Finance Departments
• of King County and the City of Renton will 'occur •immediately prior to, at or following
filing of the final plat map (Sections 9-1106.3.H. (4) , (7) and (8) ) .
11. Title insurance was not provided per Section 9-1106.3.H. (6) .
12. Restrictive covenants were not submitted (Section 9-1105.3.B) .
13. Off-site improvements along N. 26th Street were requested to be waived ' (Exhibit #3) .
This right-of-way is currently unimproved and overgrown with brush and small scrub
trees. The applicant intends to construct a driveway from the existing improved
N. 26th Street to serve proposed Lot A. Agreement was expressed by' the applicant
to sign'restrictive covenants consenting to participate in a Local Improvement
District at such future time as an L.I.D. is formed.
13. According to Exhibit #.2 the existing house on Lot B encroaches approximately one
foot into the right-of-way of N. 26th Street. . This home is several years old and .
may predate annexation of the area into the city in 1959.
CONCLUSIONS: •
1. The proposal conforms to the Comprehensive, Plan and Subdivision Ordinance. Adequate
protection of the public health, safety, welfare and esthetics has been afforded
(Section 9-1101.2) .
2. Testimony did not address' compliance of the existing house on Lot B with applicable
•
building setback zoning.regulations. Prior to staff approval of the final short
plat, the Planning Department should review and establish conformance with the
setback regulations along the westerly portion of Lot B. If needed, the property
line between the two lots should be accordingly shifted.
3. Completion of certification per Section 9-1106.3.H shall occur at such time as to
facilitate approval of the final short plat by staff per Section 9-1105.7.

4. Improvements of any kind are lacking in the portion of N. 26th Street abutting the
property (Section 9-1105.6.B) . A requirement for construction of one-half of N.
' 26th Street would impose .a financial burden for the two proposed lots that is overly. '
burdensome and'would probably prevent the short plat .(Sections 9-1109.1 and 1.A) .
Other properties in the area have been allowed such subdivision of property, and
detriment to the public welfare or other properties was not shown (Sections
9-1109.1.8 and C.) . 'Therefore, under these circumstances the requested waiver
' should be granted, subject,to the usual restrictive covenants agreeing to participate

in an L.I.D.
5. Due to the pre-existing nature of the intrusion of the house on Lot B into the N.
26th Street right-of-way, this nonconforming situation does not pertain to the subject
application. The application does not increase or decrease the nonconformity of the
house.
6. The applicant proposes a 10-foot driveway to serve Lot A. This is acceptable to the
Public Works Department but the Fire Department..recommends a 12-foot improved width.
Since only 10 feet of driveway width is required within pipestem lots (Section
9-1108.23.F. (3) . (d) which are similar to the proposal, and since 'sufficient
justification otherwise is lacking in the record, it seems appropriate under the
circumstances to require only 10 feet of pavement.
A turnaround area for emergency safety vehicles can be provided either on or off
site. The on-site area recommended by the Fire Department can also be accommodated
by a slight extension of the proposed driveway, thereby creating the necessary turn-
around area. Essentially the situation is very similar to an interior lot within a
normal subdivision and it appears that provisions for emergency public safety vehicles
can be made within N. 26th Street.
DECISION:
Approval of the proposed short plat, subject to:
1. Confirmation by the Planning Department of compliance of the existing garage on
Lot B with the applicable zoning setback requirements. If needed, the westerly
property line of Lot B is to be relocated to secure compliance with the setback
requirements.
2. Completion of certification per Section 9-1106.3.H in order to enable staff approval
of the final short plat per Section 9-1105.7.
3. Provision of a 10-foot driveway pavement width and turn-around area in N. 26th Street
right-of-way per approval of the Public Works and Fire Department.
Approval of the requested waiver of off-site improvements in N. 26th Street subject to
completion of restrictive covenants attesting to participation in an L.I.D. for construction
of these improvements when required by the City of Renton.

1 . The requested short plat is located in a G-6000 single family
residential district which is in conformance with Comprehensive
Plan Land Use Element .
2 . The proposal is to divide a long , slender 1 ± acre parcel into
two lots . The smaller lot contains an existing single family
residence and garage . The remaining parcel is undeveloped .
3 . The applicant has requested Waiver-268-78 for the required
off-site improvements to N . 26th Street on the basis that there
are no similar improvements in the area , that drainage will be
uneffected , that the improvements would adversely effect the
character of the site , and further improvements can be installed
as required .
4 . The applicant ' s proposal in-lieu of street improvements is
to extend a 10 ' driveway along the southerly half of the existing
dedicated right-of-way to serve the new parcel to the west .
The driveway length proposed is approximately 135 feet .
5 . The proposed single family lots conform to the minimum area
requirements of the R-1 single family district . It should be
noted that the submitted drawings indicate that the existing
house is located partially into the N . 26th Street right-of-way .
The precise location can be determined during the survey of the
subject site . This is an existing condition which does not
appear to effect the proposed plat , other than any street
improvement requirement .
6 . Traffic Engineering and Engineering recommends approval of
the plat and waiver subject to covenants providing for future
street improvement .
7 . The Engineering Division recommends that the proposed paving
be placed adjacent to the street centerline and extend the full
distance east and west across the frontage of parcel B . -
8 . The Fire Department recommends a 12-foot paved driveway width
with a turn-around and maximum 15% grade .
9 . The Building Division indicates that electrical service must
be provided . -

N . DEPARTMENT RECOMMENDATIONS :
Based upon the foregoing analysis and comments from other
departments , it is recommended that the short plat be approved
subject to the following conditions regarding access .
The proposed driveway serving Parcel A shall :
( 1 ) Be located with its northerly edge at the N . 26th Street
centerline .
( 2 ) Shall have a 12 ' paved section with grades less than 15%
to the approval of the Fire and Public Works Departments .
( 3 ) Shall have a turn around on Parcel A to the approval of the
Fire Department.
(4) Shall extend from the existing paving of N . 26th Street to the
required turn around of Parcel A .
The proposed waiver should be approved subject to provision
of restrictive covenants for future installation of improvements by
LID .
This recommendation is based upon the fact that to install
improvements at this time could require removal of a part of
the existing residence thus depriving the applicant of the use of
his home . Typical improvements other than paving are not in evidence
n'ear the site and the requirement for this lot would exceed the
privileges of adjoining owners . Finally , the proposed driveway
improvements will be essentially those of a pipestem lot and should
not be injurious to the general public welfare .

Gentlemen:
Attached is an application fee of fifty dollars ($50.00) required for
consideration of requested waiver of off-site improvements applicable
to the proposed subject shortplat.
It is proposed that the off-site improvements be limited to a ten foot
wide surfaced driveway that will be located on the southerly half of the
dedicated street right-of-way shown on the subject shortplat drawing
(westerly extension of N. 26th Street) . -This driveway will be approximately
135 feet long and will service a single family residence.
Justification for granting of this waiver includes the following items :
A. The general area in which the property is located does not now have
curbs, gutters or sidewalks, and all existing roadways are of
sub-standard width.
B. Due to the extensive amount of virgin terrain located below the
proposed driveway, the water drainage due to the driveway will be
virtually unaffected.
C. Street lighting is not a problem due to the present availability
of a street light near the entrance to the driveway; additionally,
a yard light is planned at the entrance to the lot being served.
D. The waiver will not be detrimental to adjacent properties or the
general public welfare. To the contrary, the installation of the
improvements required by the ordinance would significantly detract
from the existing rural atmosphere and charm of the area.
E. Should later access to the adjacent areas be., required by other
property owners, the proposed driveway could easily be expanded
by the benefitting parties.

Gentlemen:
Attached is an application fee of fifty dollars ($50.00) required for
consideration of requested waiver of off-site improvements applicable
to the proposed subject shortplat.
It is proposed that the off-site improvements be limited to a ten foot
wide surfaced driveway that will be located on the southerly half of the
dedicated street right-of-way shown on the subject shortplat drawing
(westerly extension of N. 26th Street) . This driveway will be approximately
135 feet long and will service a single family residence.
Justification for granting of this waiver includes the following items:
A. The general area in which the property is located does not now have
curbs, gutters or sidewalks, and all existing roadways are of
sub-standard width.
B. Due to the extensive amount of virgin terrain located below the
proposed driveway; the water drainage due to the driveway will be
virtually unaffected.
C. Street lighting is not a problem due to the present availability
of a street light near the entrance to the driveway; additionally,
a yard light is planned at the entrance to the lot being served.
D. The waiver will not be detrimental to adjacent properties or the
general public welfare. To the contrary, the installation of the
improvements required by the ordinance would significantly detract
from the existing rural atmosphere and charm of the area.
E. Should later access to the adjacent areas be.required by other
property owners, the proposed driveway could easily be expanded
by the benefitting parties.
