their successors , heirs , and assigns as follows:
INSTALLATION OF OFF-SITE IMPROVEMENTS
The owner(s) of the above described property, their suc-
cessors, heirs and assigns , hereby agree and covenant to
participate in , sign a petition in support of, and accept
any future Local Improvement District (LID) or city initia •

ted proposal , and pay their fair share therefore, for the
purposes of providing the necessary off-site improvements
required by ,the Renton Subdivision Ordinance. Said improve-
ments shall include but may not be limited' to the installa-
tion of curbs , gutters , sidewalks , street paving, sanitary
sewers , storm sewers , undergrounding of utilities , and
street lighting.
These covenants are imposed in lieu of Section 9-1105(6)
of Title IX of Ordinance #1628 of the City of Renton .

DURATION •
These covenants shall run with the land and expire on
December 31, 2025. If at any time improvements are
installed pursuant to these covenants , the portion of
• the covenants pertaining to the specific installed improve-
Ch ments as required by the Ordinances 'of the City of Renton
Nshall terminate without necessity of further documentation.

ONAny violation, or breach of these restrictive covenants may be .
enforced by proper. legai procedures in the Superior Court of King
County by either the City of Renton or any property, owners adjoining
subject property who are adversely affected by said breach.

approved subject to restrictive covenants as noted on the Examiner's
report of January 24, 1979, has not been appealed within the time
period established by ordinance. Therefore, this application is
considered final and is being submitted to the City, Clerk effective
this date for permanent filing. Restrictive covenants will be filed
by the City Clerk with King County.
Please contact the Planning Department (235-2550) for information
regarding preparation of the final short plat mylar for filing
with King County.

REPORT AND RECOMMENDATION.
APPLICANT: Harold M. Syrstad FILE NO. Short Plat 275-79

LOCATION: North side of Puget Drive S.E. .approximately 350 feet east.. of
Grant Avenue S.. and adjacent to the Rolling Hills Subdivision.
SUMMARY OF REQUEST: Applicant• requests approval of a proposed three-lot short plat
together with a waiver of the required off-site improvements.
•
SUMMARY OF ACTION: Planning Department Recommendation: Approval with restrictive
covenants. •
Hearing Examiner Decision: Approval with restrictive covenants.
•
PLANNING DEPARTMENT The Planning Department staff report was received by the
REPORT: Examiner on January 16, 1979.
•
PUBLIC HEARING: After reviewing the Planning Department report, examining
available information on' file with the application, and
field checking' the property and surrounding area, the
Examiner conducted a public hearing on the subject as
follows:
. The hearing was opened on January 23, 1979 at 9:00 a•.m. in the Council Chambers of the
Renton, Municipal Building.
Parties wishing to testify were affirmed by 'the Examiner.
•
It was reported that the Hearing Examiner and the, applicant had received and reviewed
the Planning Department report, and the 'report was entered into the 'record as Exhibit #1.
Steve Munson, Planning Department, reviewed Exhibit #1, and entered the following
additional exhibits into the record: •

' The Examiner asked the applicant if he concurred in Exhibit #1. Responding was:

Mr. Syrstad indicated his concurrence, in the report. The Examiner inquired if the
applicant concurs in the 'requirement to sign restrictive covenants to ensure future
participation in a Local Improvement District on Puget Drive S.E. Mr: Syrstad indicated
his concurrence. •
•
The Examiner requested testimony in support or opposition to the request. There was no
response. He inquired if an L.I.D. scheduled for 1981 on Puget Drive S.E. had been formed
to date. Mr. Munson advised that information received from the Public Works Department
had indicated the scheduled date of completion only. •
The Examiner inquired if three conditions contained in the Planning Department
Recommendation, Section P. of Exhibit #1, were standard subdivision requirements. Mr.
• Munson responded affirmatively. •
The Examiner requested further comments. Since there were none, the hearing on File No.
' Short Plat 275-79 and W-276-79 Was closed 1y the Examiner at 9:22 a.m.
•
` • .FINDINGS, CONCLUSIONS & DECISION: Having reviewed the record in this matter, the
Examiner now makes and enters the following:

1 . The. rF:quest is for approval of a three-lot short plat and Waiver of off-site

2. The Planning Department report accurately sets forth the issues, applicable policies
and provisions, findings of fact, and departmental recommendations in this matter,
is uncontested, and is hereby attached as Exhibit #1 and incorporated in this report
by reference as set forth in full therein.
3. Pursuant to the City of Renton's Environmental Ordinance and the State Environmental
Policy Act ,of 1971, as amended by R.C.W. 43.21.C. , Gordon Y. Ericksen, responsible
official, determined the proposal to be exempt from the threshold determination and
• E.I.S. requirements of SEPA.
4. Plans for the proposal have been reviewed by all city departments affected by the
impact of this development.
•
5. There was no. opposition to the proposal expressed. •
'6. All existing utilities are available and in close proximity.
7. The proposal is compatible with the required setbacks, lot dimension and area
requirements of Section 4-704 (SR-1) and 4-706 (R-1) of Title IV, and Section 9-1108.23
(Subdivision Ordinance) of Title IX, Ordinance No. 1628, Code of General Ordinances.
8. Complete certification per Section 9-1106.3.H.has not been submitted. Only an
affidavit of ownership was contained in the file of record per Section 9-1106.3.H. (1) .
9. Restrictive covenants were not submitted (Section 9-1105.3.A.) .
10. Access to each of the three lots will be onto Puget Drive S.E: Off-site improvements
have .not been constructed. The applicant requested a waiver of this requirement
and agreed to completing. restrictive covenants for participation in a local
improvement district (L.I.D.) for their installation. Per Exhibit #1, staff
testified that off-site improvements will be installed on portions of Puget Drive S.E.
within the next one or two years either through private development or L.I.D.
CONCLUSIONS:
1. The proposed short plat conforms to the Comprehensive Plan and protects ", ...the
public health, safety, welfare and aesthetics. . ." (Section 9-1101.2) .
2: Completion of certification per Section 9-1106. 3.H can be accomplished per the
requirements and approval of the Planning and Public Works Departments prior to
filing of the final plat with King County. Certification by the King County
Health Department and the Finance Departments of King County and the City of
Renton can occur at or immediately following filing of the final plat.
3. Although off-site improvements are generally lacking in the immediate area of
Puget Drive 'S.E: ; the scheduled completion of these improvements indicates that
covenanting the property to participation in the impending L.I.D. along this street
is reasonable and logical (Section 9-1105.6.B) . It was not substantiated that
requiring the applicant to install these improvements would unduly impact the
property and its intended use (Section 9-1109. 1.A) . But it is clear that the
covenant will afford the property owner similar privileges as others who will
participate in the impending L.I.D. on Puget Drive S.E. (Section 9-1109.1.B) and
that •detriment to the public welfare or other properties will .not occur (Section
9-1109.1.C) . For these reasons, the waiver application should be approved subject
• to completion of the appropriate restrictive covenants.
DECISION:
Approve the short plat as submitted, subject to completion of certification per Section
9-1106.3.H.
Approve the waiver of off-site improvements subject to completion of the standard
restrictive covenants attesting to agreement of participation in an L.I.D. for
construction of these improvements along Puget Drive S.E.

decision of the Examiner ,is based on erroneous procedure, errors of law or fact, error •
in judgment, or the discovery of new evidence which could not be reasonably available .
at 'the prior hearing may make a written request for review by the Examiner within
fourteen (14) days from the date of the Examiner's decision. This request shall, set
fOrth the specific errors, relied upon by such, appellant, and. the Examiner may, after
review of the record, take further action as he deems proper.
An appeal to the City Council is governed by Title IV, Section 3016, 'which requires

D . HISTORY/BACKGROUND : .
The subject site is the remaining ownership of Mr . Syrstad
after sale of adjacent parcels north and west to Condominium
Buil-ders ,' 'Inc . The property was rezoned from GS-1 to SR-1
by Ordinance No . 3255 dated October 20 , 1978.
E. PHYSICAL BACKGROUND :
1 . Topography : There is a general downward slope of from
6 to 8% in a northeasterly-southwesterly direction.
2 . Soils : Alderwood Gravelly Sandy Loam (AgC ) . Permeability
is moderately rapid in the surface layer and subsoil , and
very slow in the substratum. Runoff is slow to medium and
the erosion hazard is moderate .
3 . Vegetation : Significant growths of evergreen and deciduous
trees exist along the north and east borders of the property.
The rest of the site is a mixture of some medium shrubs and
considerable scrub grass .
4. Wildlife : :Existing vegetation on the site may provide suitable
habitat for birds and small mammals .
5 . Water: There is no existing water on the subject site .
6 . Land Use : An existing single family residence is located on
the westerly 'portion of the subject site with the remainder
of the site undeveloped . The Rolling Hills single family
residential subdivision is located directly adjacent to the
easterly boundary of the site. An existing townhouse

subdivision is located southeast of the site . The property
north and west of the site is being developed as condominium
units under construction at this time.

1 . Water and Sewer : Existing 12" and 16" water mains run
east-west along Puget Drive and a 12" main is located on

0. PLANNING DEPARTMENT ANALYSIS :
1 . The proposed rezone (single family residential ) is a lesser
intensive use than that indicated on the comprehensive plan land
use map element ( low density multiple family residential ) .
However, it can be considered compatible with the comprehensive
plan and existing single family residential uses and zoning in
the area . Sufficient buffering was included in the approval
of the proposed condominium project west and north of the site to
provide compatibility between that use and the proposed rezone.
2 . The applicant proposes to subdivide the subject site into three
parcels consisting of two lots of approximately 11 ,700 square
feet each and a third lot of approximately 20 ,300 square feet .
3. The proposal exceeds the minimum lot size and dimensional
requirements of the SR- 1 zone and the Subdivision Ordinance.
4 . The proposal is compatible with adjacent single family residentia
uses and similar subdivision patterns in the area .
5 . The size of the property as it exists now is large enough
that the proposed short plat is a reasonable use of this land .
Proposed Lot "A" contains an existing house . The existing house
will conform to the yard requirements of the SR-1 district
upon approval of this short plat .

Drainage plans must be approved by the Public Works
Department prior to filing the plat .
7 . The Traffic Engineering Division comment about no apparent
access to the property adjacent to the north boundary of the
subject site does not apply because that property has been
integrated into the Rolling Hills condominimum development with
access off Grant Avenue South .
8. The Engineering Division has advised that the request for
waiver of off-site improvments should not be granted . Full
improvements do exist on the south side of Puget Drive S . E .
opposite the subject site. Puget Drive is included on an L. I . D .
scheduled to be completed by 1981 . Portions of the Puget Drive
S . E . west of Grant Avenue are tentatively to be constructed
within the next year. It does not appear to be unreasonable ,
therefore , to grant the applicant a deferral of the required
improvements .
9 . Additional comments relating to utility improvements and
provision of water supply from other departments are attached
for consideration .
P . DEPARTMENTAL RECOMMENDATIONS :
Based upon the foregoing analysis , it is recommended that approval
of the short plat be granted subject to :
1 . Final Public Works Department approval of utilities and
storm drainage plans .
2. Payment of fees as per Utilities Engineering Division comments .
3. Final Fire Department approval of access and hydrants to meet
fire flow requirements of the Uniform Fire Code.
It is recommended that the request for waiver of off-site
improvements be approved subjectto establishing restrictive
covenants running with the land in which the owners or their
successors agree to participate in the future L . I . D . planned for
Puget Drive S. E .

To permit subdivision of the subject site into three lots
for the future development of single family residences . In
order to allow such subdivision , the applicant is also seeking a
waiver of required off-site improvements .

D . HISTORY/BACKGROUND :
The subject site is the remaining ownership of Mr. Syrstad
after sale of adjacent parcels north and west to Condominium
Builders , Inc . The property was rezoned from GS-1 to SR-1
by Ordinance No . 3255 dated October 20 , 1978 .
E. PHYSICAL BACKGROUND :
1 . Topography : There is a general downward slope of from
6 to 8% in a northeasterly-southwesterly direction .
2 . Soils : Alderwood Gravelly Sandy Loam (AgC ) . Permeability
is moderately rapid in the surface layer and subsoil , and
very slow in the substratum. Runoff is slow to medium and
the erosion hazard is moderate .
3 . Vegetation : Significant growths of evergreen and deciduous
trees, exist along the north and east borders of the property.
The rest of the site is a mixture of some medium shrubs and
considerable scrub grass .
4. Wildlife : Existing vegetation on the site may provide suitable
habitat for birds and small mammals .
5 . Water: There is no existing water on the subject site .
6 . Land Use : An existing single family residence is located on
the westerly portion of the subject site with the remainder
of the site undeveloped . The Rolling Hills single family
residential subdivision is located directly adjacent to the
easterly boundary of the site. An existing townhouse
multiple family development is located south of the subject
site across Puget Drive. Parkwood South single family
subdivision is located southeast of the site . The property
north and west of the site is being developed as condominium
units under construction at this time.
F. NEIGHBORHOOD CHARACTERISTICS :.
Mixture of multiple family and single family residential .
G. PUBLIC SERVICES :
1 . Water and Sewer : Existing 12" and 16" water mains run
east-west along Puget Drive and a 12" main is located on
Grant Avenue . An 8" sanitary sewer is located on Grant
Avenue approximately 750 feet to the northwest of the subject
site .
2 . Fire Protection : Provided by the Renton Fire Department per
code requirements .
3. Transit: Metro Transit Route #145 operates along Benson Road
South within 4 mile to the west of the subject site.
4 . Schools : The subject site is located approximately one mile
northeast of Talbot Hill Elementary School and 4 mile north of the
Fred Nelson Junior High School , while Renton Senior High School
is within two miles to the north .
5 . Parks : Phillip Arnold Park is located approximately z mile
north of the subject site , while Talbot Hill Park is about
one mile west and Tiffany Park is within one mile to the east .

0 . PLANNING DEPARTMENT ANALYSIS :
1 . The proposed rezone (single family residential ) is a lesser
intensive use than that indicated on the comprehensive plan land
use map element ( low density multiple family residential ) .
However, it can be considered compatible with the comprehensive
plan and existing single family residential uses and zoning in
the area . Sufficient buffering was included in the approval
of the proposed condominium project west and north of the site to
provide compatibility between that use and the proposed rezone .
2 . The applicant proposes to subdivide the subject site into three
parcels consisting of two lots of approximately 11 ,700 square
feet each and a third lot of approximately 20 ,300 square feet .
3 . The proposal exceeds the minimum lot size and dimensional
requirements of the SR- 1 zone and the Subdivision Ordinance.
4 . The proposal is compatible with adjacent single family residentia'
uses and similar subdivision patterns in the area .
5 . The size of the property as it exists now is large enough
that the proposed short plat is a reasonable use of this land .
Proposed Lot "A" contains an existing house . The existing house
will conform to the yard requirements of the SR-1 district
upon approval of this short plat .

6. Suitable utilities are available to the subject site.
Drainage plans must be approved by the Public Works
Department prior to filing the plat.
7 . The Traffic Engineering Division comment about no apparent
access to the property adjacent to the north boundary of the
subject site does not apply because that property has been
integrated into the Rolling Hills condominimum development with
access off Grant Avenue South .
8. The Engineering Division has advised that the request for
waiver of off-site improvments should not be granted . Full
improvements do exist on the south side of Puget Drive S . E .
opposite the subject site. Puget Drive is included on an L . I . D .
scheduled to be completed by 1981 . Portions of the Puget Drive
S. E . west of Grant Avenue are tentatively to be constructed
within the next year. It does not appear to be unreasonable ,
therefore , to grant the applicant a deferral of the required
improvements .
9 . Additional comments relating to utility improvements and
provision of water supply from other departments are attached
for consideration .
P . DEPARTMENTAL RECOMMENDATIONS :
Based upon the foregoing analysis , it is recommended that approval
of the short plat be granted subject to:
1 . Final Public Works Department approval of utilities and
storm drainage plans .
2 . Payment of fees as per Utilities Engineering Division comments .
3. Final Fire Department approval of access and hydrants to meet
fire flow requirements of the Uniform Fire Code .
It is recommended that the request for waiver of off-site
improvements be approved subjectto establishing restrictive
covenants running with the land in which the owners or their
successors agree to participate in the future L. I . D . planned for
Puget Drive S. E.
