grant and impose restrictions and• covenants running with the land
hereinabove. described with respect, to the use by the ,undersigned,

INSTALLATION OF OFF-SITE IMPROVEMENTS
The owner(s) of the above described property, their suc-
cessors , heirs and assigns , hereby agree and covenant to
participate in , sign a petition in support of, and accept
any future Local Improvement District (LID) or city initia-
ted proposal , and `pay their fair share therefore, for the
purposes of providing the necessary off-site improvements
required by the Renton Subdivision Ordinance. Said improve-
ments shall include but may not be limited to the installa-
tion of curbs , gutters , sidewalks , street paving, sanitary
sewers , storm sewers , undergrounding of utilities , and
street lighting.
These covenants are imposed in lieu of Section 9-1105(6)
of Title IX of Ordinance #1628 of the City of Renton.

December 31, 2025. If at any time improvements are

1 Subject: Deferral of Off-Site Improvements - Corner
of N. 5th St. and Garden Avenue North
Dear Mr. Lewis:
In reference to our letter of June 1 , 1979 on the same subject, "' '"
we have since talked to Mr. Steven McBride and the Engineering
Division has revised the amount of the bond required for the
deferral of the off-site improvements on North 5th Street. The
deferral was granted for a period of six months and the bond to
be posted with this office should be in the amount of $1 ,500.00.
The restrictive covenants have already been filed with the Planning ,
Department and will be recorded with the plat.

The Board of Public Works, at its meeting of May 30, 1979, agreed

noted that Lind Ave. SW is currently under construction by LID and SW 43rd is expected to be
included in an LID shortly; the remaining improvements may reasonably be expected to be installed
by LID's within a reasonable time. The report recommended deferral of off-site improvements
for one year subject to provision of an appropriate bond. It was noted that there are no
sidewalks included in the S.W. 41st St. LID so sidewalks would be required on the East Valley Rd.
The full improvements are required on S.W. 43rd St. A deferral at this time would allow the
company to finalize the plat. The bond to be furnished could be reduced as soon as the SW 43rd
St. LID is finalized. It was noted the north side of SW 43rd St. does not need sidewalks as

APPLICANT: Renton Boiler Works FILE NO. Short Plat 282-79,

LOCATION: On the north side of North 5th Street between Park Avenue North
and Garden Avenue North.
SUMMARY OF REQUEST: The applicant requests approval of a proposed three-lot short
plat and an exception to the Subdivision Ordinance to allow
a 26-foot pipestem road together with a waiver of the required
off-site improvements on Garden Avenue North.
SUMMARY OF ACTION: Planning Department Recommendation: Approval of the short
plat subject to conditions; deferral of off-site improvements
subject to filing restrictive covenants; and approval of
exception subject to conditions.
Hearing Examiner Decision: Approval of the short plat subject
to conditions; approval of waiver subject to placement of
restriction upon the plat; and approval of exception w/condition.
PLANNING DEPARTMENT The Planning Department staff report, was received by the
REPORT: Examiner on February 1, 1979.
PUBLIC HEARING: After reviewing. the Planning Department report, examining
available information on file with the application, and
field checking the property and surrounding area, the
Examiner conducted a public hearing on the subject as
follows:
The hearing was opened on February 6, 1979 at 9:07 a.m. in the Council Chambers of the
Renton Municipal Building.
Parties wishing to testify were affirmed by the Examiner.
It was reported that the Hearing Examiner and the applicant had received and reviewed
the Planning Department report, and the report was entered into the record as Exhibit #1.
Steve Munson, Planning Department representative, reviewed Exhibit #1, and entered the
following additional exhibits into the record:

Exhibit #5: Letter to Planning Department from
Roger I. Lewis, dated January 15, 1979,
regarding requests for exception and
waiver.
The Examiner asked the representative for the applicant if he concurred in Exhibit #1.
Responding was:

Mr. Lewis indicated his concurrence in the report. However, he referenced Exhibit#1,
Section P. , Department Recommendations, pertaining to approval of the request for
exception subject to paving the proposed pipestem road a width of 16 feet with a five
foot buffer strip, and requested clarification of the requirement since the existing
roadway is paved. Mr. David Clemens, Associate Planner, reviewed the requirements of
the Subdivision Ordinance to provide a minimum 10-foot paved width and landscaping on
both sides of the roadway. However, he indicated his agreement that if the existing
paving meets requirements of the Building Division, only landscaping of the westerly
side of the roadway would be required for the purpose of buffering the development from
adjacent single family residences. Mr. Lewis .advised that the paved road had been

installed in accordance to Building Division specifications at the time of construction
of the existing building.
Mr. Lewis referenced an attachment to Exhibit #1 Containing staff comments from the
Utilities Division, dated January 15, 1979, which request provision of sanitary sewer
easement for existing line, and requested clarification of the requirement. Mr. Clemens
noted that although the comment referred to obligation of the property owner to participate
in water main installation on N. 5th Street and provide easement for additional sewer
systems, he agreed that the location of the easement was unclear. The Examiner inquired
if resolution of the matter was requested by the applicant during the public hearing.
•
At. the suggestion of Planning Department staff, Mr. Lewis indicated that he would contact
the Utilities Division for clarification of the requirement.
The Examiner requested testimony in support or opposition to the request. There was no
response. He' referenced Section 9-1108.24.E. (c) , Minimum Standards for Industrial Design,
of the Subdivision Ordinance, and noted that pipestem lots are specifically prohibited.
Mr. Clemens indicated that although the language contained in the referenced. section of
the Subdivision Ordinance appears quite strict, language in other sections of the
ordinance are clearly definitive in the opposite interpretation that certain street
widths or lot sizes are required and the Examiner has the authority to grant exceptions
to the requirements of the ordinance. In this case, he advised, the applicant had
properly applied for exception from the requirements.of the ordinance and it was his
opinion that the Examiner would have the authority to review the request for exception
to allow a pipestem industrial lot.
The Examiner requested a final recommendation from Planning Department staff members.
Mr. Clemens indicated the recommendation contained in Exhibit #1 would remain as
submitted with the exception of revising the condition of approval of the exception
to require only installation of a five-foot planting strip on the westerly side of
the existing pipestem driveway.
The Examiner requested further comments. Since there were none, •the hearing on File No.
Short Plat 282-79, E-283-79, and W-285-79 was closed by the Examiner at 9:30 a.m.
FINDINGS, CONCLUSIONS & DECISION: Having reviewed the record in this matter, the Examiner
now makes and enters the following:
•
FINDINGS:
1. The request is, for approval of: 1) a three-lot short plat of industrial property;
2) an exception from Section 9-1108.24.E. (c) for one pipestem lot; and 3) a waiver •
of off-site improvements on Garden Avenue North.
2. The Planning Department report sets forth the issues, applicable policies and
provisions,, findings of fact, and departmental recommendations in this matter, •
is uncontested, and is hereby attached as Exhibit #1 and incorporated in this
report by reference as set forth in full therein.
3. Pursuant to the City of Renton's Environmental Ordinance and the State Environmental
Policy Act Of 1971, as amended by' R.C.W. 43.21.C. , Gordon Y. Ericksen, responsible
official, •has determined the proposal to be exempt from the threshold determination
and EIS requirements of SEPA.
4. Plans for the proposal have been reviewed by all city departments affected by the
impact of this development and no adverse comment was expressed.
5. There was no opposition to the proposal expressed.
•
6. All existing' utilities are available and in close proximity. Per the attached
February 15, 1979 letter from the Public Works Director, installation of a water
line in N.E. 5th Street is required. •
7. The proposal is compatible with the requirements of Section 4-712 (L-1) of Title IV,
Ordinance NO. 1628, Code of General Ordinances.
8. The proposal conforms to Section 9-1108.24.E (Subdivision Ordinance - Minimum
Standards for Industrial Design) except for the pipestem lot and the corner lot
. being the same size as the interior lot. An exception per Section 9-1109 was •
'requested per Exhibit #5 for the pipestem lot.
9: Certification per Section 9-1106.3.H has not been 'completed, except for submittal. '

10. Off-site improvements in Garden Avenue N. consist only of paving and do not exist
within a reasonable distance from the property (Section 9-1105.6.B) .
11. Restrictive covenants were not submitted (Section 9-1105.3.B.)
12. Storm drainage plans have not been submitted but are required with the building permits
for development on the property.
CONCLUSIONS:
' 1. The proposal .conforms to the Comprehensive Plan, zoning restrictions' and generally
to the Subdivision Ordinance. Minor adjustments are necessary to conform to the
Subdivision Ordinance.
•
2. In order to comply with Section 9-1108.24.E. (d) , Lot 3 (corner lot) must be expanded
slightly to be wider than Lot 2 (Exhibit #2) . Both lots feature 100-foot frontages
along Garden Avenue N. Therefore, Lot 3 must be increased to more than 100 feet.
This adjustment can be accomplished by the applicant with the Planning Department
prior to staff approval of the final plat map for recording at King County.
3. The lack of off-site improvements beyond paving on_Garden Avenue N. indicates that
a waiver of this requirement may be appropriate under the circumstances (Section
9-1105.6.B) . Requiring the improvements was not alleged to deprive the applicant
of ". . .reasonable use or development" of the property (Section 9-1109.1.A.) but was
contended to be premature since the city is considering revising this street which
may require removal and reconstruction of the improvements. . This potential
' duplication of improvements could place an ". . .undue hardship. . . " upon the applicant
(Section 9-1109.1) : Other properties in the area along Garden Avenue N. do not have
these improvements (Section 9-1109.1.B) . .Detriment to the ". . .public welfare. . .other
property. . . " is not apparent or foreseeable (Section 9-1109.1.C) . ' Therefore, the
• waiver should be granted.
However, sufficent potential exists that the off-site improvements will be necessary
at some time in the future. It appears appropriate to require that the normal
restrictive covenants be completed attesting to participation in a Local Improvement
District for construction of the improvements.
4. Section 9-1108.24.E. (d) specifically prohibits pipestem lots within an industrial
subdivision; however, an exception from this requirement was requested in Exhibit #5
• and in the attached letter of February 16, 1979 from Roger I. Lewis.
The configuration of the property and the existing building on Lot 1 (Exhibits #3
and 4) exerts some difficulty in achieving division of the property without
necessitating a pipestem lot. Very probably the only alternative is a two-lot
short plat instead of three lots as proposed (Sections 9-1109.1 and 1.A) .
It has not been substantiated that other properties in the vicinity possess similar
circumstances. . The subject site appears relatively unique in its configuration, but
the total size and size of the proposed lots seem in character with the L-1 zoned
area (Exhibit #3) . The exception appears necessary for the applicant to divide
the property which has occurred in other properties of similar zoning in the vicinity
(Section 9-1109.1.B) . • •
•
Detriment to the public or other properties is not apparent (Section '9-1109.1.C) .
To mitigate the impact of the pipestem upon the existing single family residence
at the southwest corner of the site, a 10-foot landscape strip should be dedicated .
and planted along the western'portion of the pipestem. This landscape strip should
form a buffer and transition between the home and pipestem per review and approval
of the Planning Department.
•
5. Completion of certification per .Section 9-1106.3.H can be prior to, at or immediately
following filing of the final plat with King County. The Planning. and Public Works
• Departments can adequately review the final plat for. this certification and the
Examiner's decision prior to giving their final approval of the final plat.
DECISION:
•
Approval of the short plat subject to: .
•
1. Enlargement of Lot 3 to greater than 100 feet.
2. Completion of off-site improvements, including utilities, in N.E. 5th Street. . This
condition shall be completed or deferred by the Board of Public Works prior to

Approval of the waiver of off-site improvements in Garden Avenue N. subject to completion
of the normal restrictive covenants attesting to participation in an LID for completion
of these improvements. This condition shall become a restriction to be placed upon the
final short plat map.
Approval of the exception for the pipestem configuration of Lot 1, subject to the
westerly 10 feet of the pipestem being used as a landscape buffer strip as long as the
existing adjacent single family residence continues as a residential use. The landscaping
within the strip shall be accomplished per the requirements of the Planning Department.
This condition shall become a restriction to be placed upon the final short plat map.

An appeal to the City. Council is governed by Title IV, Section 3016, which requires

This letter is by way of response to your letter of February 8, 1979. I have
been in Court almost continuously since receipt of your letter, and I have been unable
to respond until today. I request that you accept this letter as the supplemental
information requested although it has not been delivered prior to February 16.
The pertinent ordinance section 9-1109, subparagraphs. A, B and C require a'
showing of special circumstances and conditions and that the exception is, necessary
to insure utilization of the property in 'a manner equal to that enjoyed by other
properties in the vicinity without detriment to public welfare or injury to surrounding
property owners. We believe the pipestem exception complies:
1. When the applicant purchased the entire parcel it was and is Sartorisville
adjacent lots 9, 10, 11 and 12, but with the southwest corner deleted.
Looking at the map, it is apparent that the orignal lots were intended as small
residential sites typical of those being developed in the 1900-1930 era. Neither, their
original residential use nor their present physical size and layout are practical in an
L-1 zone.
2. When the property was acquired, further subdivision along. the boundaries of
the Sartorisville lots was impractical. There would have been a second alternative of
dividing it into larger tracts, all fronting Garden Avenue North; and theoretically there
could have been three lots of a width 66.66 feet each in that configuration. This
would have left all three lots somewhat elongated and would have made future
construction, both as to buildings and parking lots more difficult.

3. Because of the obvious problems expressed in paragraphs 1 and 2 above, a
pipestem configuration was considered when the existing building on proposed Lot 1
was constructed. In the process of obtaining a building permit for the erection of
that structure, the pipestem was actually created and paved as the access to the new
building. It occurs to us that there was some .tacit approval of the pipestem by the
City at that time. We offer that not to say that there was irrevocable reliance on
what the City allowed us at that time but only to say that it made sense then and
it makes sense now.
4. Lot 1 with its existing building, paved access and paved parking lot physically
exists in the legal configuration suggested for Lot 1. There is no practical way to
further subdivide the remainder of the applicant's property except as two lots facing
North Fifth Street or, two lots facing Garden Avenue North. Facing them to Garden
Avenue North creates the best physical size for Utilization within the range of uses
anticipated in the zone.
4. The pipestem will serve only Lot 1. . The only property that can suffer
injury or disturbance is the dwelling house situated in the southwest corner. That
house fronts North Fifth Street and is very close to Garden Avenue North and already
suffers the brunt of Pacific Car, Boeing and Renton School District bus traffic all out
of proportion to, anything aniticpated or believed when the Sartorisville lots were laid
out. In terms Of total'traffic and use, the pipestem cannot add any substantial increase
to already existing traffic annoyances. Conversely the loss of the pipestem would still
see this property developed.within uses allowed by the zone, all of.which are contrary
to residential enjoyment; and there is no protection to be afforded to the• dwelling
house by denial of the pipestem exception. The denial would simply impose additional
limitation and hardship on the applicant in the process of developing a somewhat odd
shaped parcel. The applicant is ready, willingr and able to install the' landscape
improvements along the west edge of the pipestem and, looking at the site itself, that
gives the residential owner considerably more aesthetic enjoyment than he 'has now.
We respectfully request your favorable action on the application including the
pipestem exception.

The water utility ordinance 2849 (5/13/74) requires that a main be installed
in N. 5th St. to servethis proposed short subdivision. It should also be
noted that Renton Boiler Works signed an agreement to install said water
main whenever it was necessary. (Copy attached.)

C. PURPOSE OF REQUEST :
To allow subdivision of the subject site into three lots for
future development of commercial uses . In order to allow such
subdivision , the applicant is also requesting an exception to
the Subdivision Ordinance.
D . HISTORY/BACKGROUND :
The subject site was annexed into the City by Ordinance 156 in
1909.
E . PHYSICAL BACKGROUND :
1 . Topography : The site is basically level .
2 . Soils : Urban land (Ur) . The erosion hazard is slight to
moderate . No capability or woodland classification .

3.--- Vegetation : A hedge of blackberry bushes is located adjacent
to North 5th Street , and a few deciduous trees are found
._:imme.diately to: the .north and west of the hedge . The remainder
of the site consists of asphalt paving in the eastern two-
thirds and scrub grass in the western portion .
4. Wildlife : Existing vegetation provides only minimal habitat
for birds and small mammals .
5. Water : There was no water evidenced on the subject site .
6. Land Use : The land use of the site consists of a building
used for sale and storage of certain chemicals and washing
powders with the remainder asphalted and used for parking .
F. NEIGHBORHOOD CHARACTERISTICS :
The area consists of a variety of uses including a railroad car
manufacturing plant , a few single family residences , a bus garage ,
and other commercial uses . Generally , the area is in a transi -
tional state from older single family to commercial /light
industrial .
G . PUBLIC SERVICES :
1 . Water and Sewer : A 12" water main extends north-south along
Garden Avenue North adjacent to the subject site , and a 24"
main runs east-west along North 5th Street . An 8" sanitary
sewer runs east-west on North 5th Street , and a 10" sewer
extends north-south along the westerly border of the pro-
posed short plat .
2. Fire Protection : Provided by the Renton Fire Department as
per ordinance requirements .
3 . Transit : Metro Transit Routes 42 and 240 operate along Park
Avenue North within one block to the west of the subject site.
4 . Schools : The Highlands Elementary School is located within
one and a half miles to the northeast of the subject site
while McKnight Middle School is within two miles to the
northeast , and Renton High School is within one mile
to the south .
5. Parks : Mothers Park is within one-fourth mile to the north
of the site , and Jones , Liberty , and Cedar River Parks are
all within three-fourths of a mile to the south .

4. Utilities are available to the subject site . Drainage plans
must be approved by the Public Works Department as part of
site developments ( see Engineering Division comments ) .
Also , the applicant will be required to participate in a
water main installation on North 5th Street and provide a
sanitary sewer easement for the existing line on the same
street. (See Utilities Engineering comment. )
5. Off-site improvements do not exist on North 5th Street
except for one parcel to the southwest of the subject site .
Both the Traffic Engineering Division and the Engineering
Division of the Public Works Department recommend .installa-
tion on this frontage. The applicant has agreed to do so in
a supplemental letter contained in the application . Improve-
ments do not exist on Garden Avenue North. A waiver has been
requested for improvements along Garden Avenue North . Engineering ha:
no objections subject to covenants providing for . LID participation .
Traffic recommends installation .
6. Dott' s Chemical is located on Parcel #1 , and a cabinet shop
is planned for Parcel #3 . Parcel #2 is presently undeveloped
but the applicant indicates that a future commercial use is
planned for the site .
7 . Suitable frontage and access exist along Garden Avenue North
and North 5th Street for Parcels #2 and #3. However , pro-
posed Parcel #1 does not. The applicant is requesting an
exception to the Subdivision Ordinance to permit a pipestem
lot on this site . Due to the existing on-site configuration ,
the proposed pipestem access appears reasonable .

Gentlemen:
On behalf of Renton Boiler Works , I hand you its application
for Short Sub-division in the manner shown on the preliminary
drawing.
The drawing was prepared from survey maps prepared by
Kenneth J. Olyer and final survey, map and certification will
be by Mr. Ouler.
This letter is by way of request for two exceptions as
follows:
1. For a pipestem lot figuration for lot 1. I understand from
Mr. Clemmons a pipestem configuration is acceptable if the width
is twenty feet or more and I presume the proposed design is
acceptable. My fee for the exception is enclosed.
2 . Waiver of the requirements for improvements on Garden Avenue
North.
It is my understanding that Garden Avenue North is under
consideration for extensive revision and that the installation
of improvements at this time might well be pre-mature. Further,
I believe the area qualifies under paragraph 9 A of your "Short
Plat Procedures. " There are no sidewalks or curbs on either
side of Garden Avenue North for a considerable span either side
of the subject property. I think it is fair to observe that there
simply is no predestinarian traffic in this area and that its
present uses and probable future uses are such that there will
not be any substantial predestinarian traffic in the foreseeable
future.
There are sidewalks and curbs on North Fifth and we are
prepared to install them adjacent to this property as a part of
the project.

1 . Topography : The site is basically level .
2 . Soils : Urban land (Ur) . The erosion hazard is slight to
moderate . No capability or woodland classification .

3. Vegetation : A hedge of blackberry bushes is located adjacent
to North 5th Street , and a few deciduous trees are found
immediately to the north and west of the hedge . The remainder
of the site consists of asphalt paving in the eastern two-
thirds and scrub grass in the western portion .
4 . Wildlife : Existing vegetation provides only minimal habitat
for birds and small mammals .
5. Water : There was no water evidenced on the subject site.
6. Land Use : The land use of the site consists of a building
used for sale and storage of certain chemicals and washing
powders with the remainder asphalted and used for parking .
F . NEIGHBORHOOD CHARACTERISTICS :
The area consists of a variety of uses including a railroad car
manufacturing plant , a few single family residences , a bus garage ,
and other commercial uses . Generally, the area is in a transi -
tional state from older single family to commercial /light
industrial .
G . PUBLIC SERVICES :
1 . Water and Sewer : A 12" water main extends north-south along
Garden Avenue North adjacent to the subject site , and a 24"
main runs east-west along North 5th Street . An 8" sanitary
sewer runs east-west on North 5th Street , and a 10" sewer
extends north-south along the westerly border of the pro-
posed short plat .
2 . Fire Protection : Provided by the Renton Fire Department as
per ordinance requirements .
3 . Transit : Metro Transit Routes 42 and 240 operate along Park
Avenue North within one block to the west of the , subject site.
4 . Schools : The Highlands Elementary School is located within
one and a half miles to the northeast of the subject site
while McKnight Middle School is within two miles to the
northeast , and Renton High School is within one mile
to the south .
5. Parks : Mothers Park is within one-fourth mile to the north
of the site , and Jones , Liberty , and Cedar River Parks are
all within three-fourths of a mile to the south .

Pursuant to the City of Renton ' s Environmental Ordinance and the
State Environmental Policy Act of 1971 , as amended , RCW 43-21C ,
this proposal is exempt from the determination of environmental
significance .

0. PLANNING DEPARTMENT ANALYSIS :
1 . The subject proposal is consistent with the Comprehensive Plan
which designates the site as light industrial .
2. The proposal is compatible with the nearby commercial and
industrial uses and lot sizes in the area . Lot #1 contains
an existing building utilized for wholesale selling .
3. The size of the property is such that the proposed short plat
can be considered a reasonable use of the land . All minimum
Subdivision Ordinance standards are complied with .
4. Utilities are available to the subject site . Drainage plans
must be approved by the Public Works Department as part of
site developments (see Engineering Division comments ) .
Also , the applicant will be required to participate in a
water main installation on North 5th Street and provide a
sanitary sewer easement for the existing line on the same
street. (See Utilities Engineering comment . )
5. Off-site improvements do not exist on North 5th Street
except for one parcel to the southwest of the subject site .
Both the Traffic Engineering Division and the Engineering
Division of the Public Works Department recommend .installa-
tion on this frontage. The applicant has agreed to do so in
a supplemental letter contained in the application . Improve-
ments do not exist on Garden Avenue North . A waiver has been
requested for improvements along Garden Avenue North . Engineering has
no objections subject to covenants providing for . LID participation .
Traffic recommends installation .
6. Dott ' s Chemical is located on Parcel #1 , and a cabinet shop
is planned for Parcel #3 . Parcel #2 is presently undeveloped
but the applicant indicates that a future commercial use is
planned for the site .
7 . Suitable frontage and access exist along Garden Avenue North
and North 5th Street for Parcels #2 and #3 . However , pro-
posed Parcel #1 does not . The applicant is requesting an
exception to the Subdivision Ordinance to permit a pipestem
lot on this site. Due to the existing on-site configuration ,
the proposed pipestem access appears reasonable .

Based upon the above analysis , recommend approval of the short
plat subject to :
1. Final Public Works Department approval of utilities and
storm drainage plans as part of site development and payment
of standard fees .
2. Installation of off-site improvements along North 5th Street
as per Subdivision Ordinance requirements .
Recommend deferral of off-site improvements on Garden Avenue
North subject to filing of restrictive covenants running with
the land , which provides' for participation in any future LID
for such street dedication and improvements .
Recommend approval of the request for exception subject to :
Paving. the proposed pipestem road a width of 16 feet with
a five foot ( 5 ' ) buffer strip adjoining the driveway for
the entire length of the 80 feet and landscaping to the
approval of the Planning Department for each .
