a. Proposed Vacation of Right-of-Way Between NE 4th St. and Union Ave. NE, Michael Mastro,
VAC-I5-79, Public Hearing - September 7, 1979 - Planning Department report recommended that the
vacation be granted subject to the creation of a standard cul-de-sac at the end of the vacated
right-of-way for turnarounds and the landscaping of all other right-of-way areas that are vacated.
Discussion was held of the areas to be landscaped, it being noted that the matter of using the
area is subject to the Hearing Examiner's decision. There are utilities in the area so ease-
ments will be required. Moved by DAVE CLEMENS, seconded by PAUL LUMBERT, the matten be continued
bon one week. MOTION CARRIED.
b. Proposed Vacation of a Portion of SW 12th St., East of Oaksdale Ave. SW, David A. Sabey,
VAC-16-79, Public Hearing - September 24, 1979 - The Planning Department report noted the appli-
cant was requesting vacation of a portion of SW 12th St and the alley within Block 41 to con-
struct an office complex and associated parking lots and recommended the vacation be granted
subject to appropriate purchase by the applicant. Mr. Gonnason noted that this was the last
piece of unvacated right-of-way in that area. Discussion was held regarding the value of the
land, it being noted that it was zoned B-I. Moved by GAVE CLEMENS, seconded by JOHN WESLEY,
that the Board neeommend to the Council that the street be vacated subject to any easements'
requited and at a valuation o6 $1.80 pelt square boot, noting the at/met and attey weal not
necesaw.y to the City's tta66.i.e avrcu,ectcon. MOTION CARRIED.
c. Proposed Vacation of a Portion of Tacoma Ave. NE, North of NE 17th St. Between Shelton

SHORT PLAT
The applicant is requesting a deferral of all off-site
improvements based on the fact that there are no other
improvements in the area and the property is the key to
the access of most of the surrounding neighborhood.
It is felt that the improvements should be done at one
time.
RECOMMENDATION :
It is recommended that the request for deferral be
denied based on the fact that both the condominium
complex and the subdivision are under construction
at this time. The approval of the short plat gives
the applicant one year from the date of application
which would give them until June, 1980 , for completion.

Request for Reconsideration.
Dear Mr. Robison:
I have this date received and reviewed your request for reconsideration.
Upon review I have determined that the arguments you make in your letter
requesting reconsideration are persuasive and that the short plat should
have been approved as submitted.
The proposed lots with their generally more expansive areas are more
compatible with the area and surroundings. Also the lots are easier
to construct residences upon and would permit wider side yards and
more privacy for the occupants. As you indicate, uniform building line
is preferable to the staggered building line that the Examiner's decision
would necessitate.
The pipestem lot is not favored since it too infringes on privacy, but
because of the layout of the subject property it presents a reasonable
alternative for access. As you pointed out, there is another similar
lot in the area which uses a pipestem for access, and therefore, the
approval of the pipestem lot would not convey a privilege to the
applicant.
The decision shall be changed to reflect the matters considered in this
response to your request for reconsideration.
DECISION:
Exhibit #2 is approved.
The Exception for the pipestem lot (Lot No. 1) is approved.
The requested Waiver of the required off-site improvements is denied.

. ' The propsed 58.33 foot lots would be barely sufficient for
average size houses and would require either, putting houses in .
with very small aideyards, or staggering the distances the houses
,are set back trot the street. Either alternative would produce .
an irregular,crowded, or jumbled appearance. This would run against
, . the envisioned development of this property, which was for larger
than average hoses on lots with wide sideyardp. The narrower lots
however would require smaller, lover cost houses than those envibiOned,
and that, combined with their crowded or jumbled appearance, Would.
. be detriMental to the values of the properties to the East and •
West and would also niake .development'of this property Unfeasible,
or less, feasible, by.reduCing'the value and saleability of the
homes tO be built, without reducing the land deveiopmentsoat. •
Item Two.of the conclusions states that three 58.33 x 160 foot
lots are considered superior to a 60 x 175 foot pipestem lot which
WOuldbe' 'UndulY elongated' . The first question is' whether a.60 x
175 foot lot is any more 'Unduly elongated' than a 58.33 x 160 foot
lot, and the second questiOn is, whether three such elongated lots
are superior to. one such lot. The proposal as submitted would produce
two lots.of 77.5 x .100 feet each (width equals 77.5% .of length),-
and onelot.60iX 175 feet (width equals 34%' of length) with a:
20 x 100 foot pipestem, for access. The examiners proposal iS for
three 58.33 X .160 foot lots (width equals 36% ,c1-length).. It would
stem that a 58433 x 160' foot lot.is just as elongated as a 60 x
175 foot lot, and that if .one .Unduly. elongated lOt.is considered
.undesirable then three, such elongated lots must be even less
desirable.' .
Item Seven of thpconclusions.refers to the pipestem as a
special priveledge. The pipestem is a'specialpriveledge but not
a Unique one as the property-immediately to the South has. access '
over a 15 x 120 foot pipestem.

PLANNING DEPARTMENT The Planning Department preliminary report was received by the
REPORT: Examiner on July 16; 1979.
PUBLIC HEARING: After reviewing the Planning Department report, examining
available information on file with the application; and field
checking the property and surrounding area, the Examiner
conducted a public hearing on the subject as follows:
The hearing was opened on July 17, 1979 at 9:00 a.m. in the Council Chambers of the Renton '
Municipal Building.
It was determined by the Examiner that the hearing should be continued because receipt of
Public Works Department staff comments had not occurred prior to the scheduled hearing.
The Examiner requested an estimated date of receipt of comments from Paul Lumbert,
representative of the Public Works Department. Mr. Lumbert indicated that comments
could be transmitted in .a timely manner to allow continuance for one week. The Examiner
subsequently continued the hearing to July 24, 1979 at 9:00 a.m. to be held in the Council
Chambers of the Renton Municipal Building.
•
CONTINUANCE:
The hearing was opened on July 24, 1979 at 9:25 a.m. in the Council Chambers of the Renton
. Municipal Building.
Parties wishing to' testify were affirmed by the Examiner. •
It was reported that the Hearing Examiner and the applicant had received and reviewed
the Planning Department report, and the report was entered into the record as Exhibit #1.
Roger Blaylock, Associate Planner, assisted by Dave Clemens, Senior Planner, reviewed
Exhibit #1, and entered the following additional exhibits into 'the record:

Mr. Blaylock advised that revised comments contained in Exhibit #3 which delete requirement
for an additional 15-foot right-of-way dedication over the northerly portion of the proposed
short plat would also change the Planning Department recommendation contained in Exhibit #1
to delete the requirement. He noted that the dedication would be required on the southerly
portion of an adjacent short plat. •

The Examiner requested testimony by the applicant. Responding was:

The Examiner inquired if the applicant concurred in recommendations contained in Exhibit #1
as revised. Mr. Robinson advised his concurrence in the deletion of right-of-way
dedication, but expressed concern regarding requirements for improvements because of
uncertainty in installation timing and desire for retention of the existing rural character

of the area. He questioned a requirement for installation of an eight-inch water main in
N.E. 19th Street and inquired if the main would be required on lot frontage or extended
further on the street. The Examiner requested response to the inquiries from Warren C.
Gonnason, Public Works Director. Mr. Gonnason discussed requirements for off-site
improvements consisting of curbs, gutters, sidewalks, street paving and installation of
an eight-inch water main' on the frontage of the lots on N.E. 19th Street. Mr. Robinson
noted that a waiver of the storm drainage and street improvement requirements had been
requested to maintain the rural charcter in an area containing large lots. Responding
to the Examiner's inquiry regarding requirements for off-site improvements along Shelton
Avenue N.E. or N.E. 19th Street, Mr. Clemens advised that improvements would be required
on both streets abutting the plat. Mr. Gonnason stated that although N.E. 19th Street
is only partially improved, plans for development of a plat located in King County west
of the site are currently underway and would be consistent ,with other development in the
area.
•
The Examiner inquired if restrictive covenants had been signed agreeing to participate
in a future LID in the area. Mr. Robinson 'responded affirmatively. The Examiner requested
clarification of, staff recommendations regarding waiver of improvements. 'Mr: Clemens
advised that requirement for improvement of Shelton Avenue N.E. would provide primary .
access to the lots within the short. plat as well as circulation for the entire area.. He
also indicated that the same improvements including curbs, gutters, sidewalks, storm
drainage and street lighting would be required on N.E. 19th Street. Mr. Robinson stated
that although he 'concurred in the requirement for street paving, requirements for
installation of curbs, gutters, sidewalks and underground drainage was objectionable.
•
The Examiner requested further testimony in support of the application: Responding was:

Mr. Oberholtzer was affirmed by the Examiner. He indicated that although.the applicant
concurred in the recommendation for improvement of Shelton Avenue N.E. due to similar
existing improvements, he preferred delaying improvement of N.E. 19th Street until such
time as' an LID is formed and the entire street maybe improved concurrently. Otherwise,
he noted, only 300 feet Of frontage on N.E. 19th Street would be improved and would be
inconsistent with the remaining area.
The'ryExaminer requested further testimony in support or opposition ,to the application.
There was no response. He then requested final comments from the Public Works Director,
Mr. Gonnason recommended that, the waiver be denied and the applicant apply for. a deferral
of improvements through the Board of 'Public Works for both N.E. 19th Street and Shelton
Avenue N.E. to. allow installation of improvements concurrently with other developments
in the immediate vicinity at a later date.
The Examiner indicated that the hearing would remain open through discussion of the
next item On the agenda concerning a three-lot short plat on abutting property, File No.
Short Plat 368-79.
Following discussion of the next item, the hearing regarding Short Plat 366-79 and
W-367-79 was closed by the Examiner at 9:55 a.m.
• FINDINGS, CONCLUSIONS & DECISION: Having reviewed the record in this matter, the Examiner
now makes and enters the following:
FINDINGS:
1. The request is for approval, of a two-lot short plat together with a waiver of the
required off-site improvements on a +.58 acre parcel on the southeast corner of
Shelton Avenue N.E. and N.E. 19th Street.
2. The Planning Department report sets forth the issues, applicable policies and provisions,
findings of fact, and departmental recommendations in this matter, and is hereby
attached as Exhibit #1 and incorporated in 'this report by reference as set forth in
full therein.
,3. Pursuant to the City of Renton's Environmental Ordinance and the State Environmental
Policy Act of 1971, R.C.W. 43.21.C. , as amended, the subject proposal was determined
to be exempt by Gordon. Y. Ericksen,• responsible official.
4. Plans for the proposal have been reviewed by all city departments affected by the
impact of this development.
5. All existing utilities are either available or may be extended to the subject site.

6. The proposal is compatible with the required setbacks, lot coverage and height
requirements of Section 4-729 of Title IV, Ordinance No. 1628, Code of General
Ordinances: •
7. The applicant proposes subdividing the •+•.58 acre lot into two lots which will front
on Shelton Avenue N.E. These lots will meet and exceed the minimum lot requirements
of the Subdivision Ordinance.
8. The subject parcel is essentially level and is 'covered with high scrub grass, some
medium shrubs and a few Douglas fir trees.
9. The subject property is zoned G-7200, a classification applied when the parcel was
annexed into the city by Ordinance 2472 on March 28, 1969.
•
10. The Comprehensive Plan designates the area in which the subject property is located
as suitable for single family residential development. .
11. The subject parcel itself is undeveloped which is generally the case in the area
north of the subject property. The areas to the east, south and west are largely
developed with single family residences. Forest Brook Townhouses, for which Shelton
Avenue N.E.. serves as fire access, are presently under construction to the south. •
•
12. The Department of Public Works has recommended that off-site improvements be installed
along N.E. 19th Street and Shelton Avenue N.E. The applicant has applied for a
waiver of off-site improvements pursuant to Section 9-1105.6.B of the Subdivision
Ordinance. There are generally no off-site improvements in the area but Sierra •
Terrace Division No. 1 is installing off-site improvements along Shelton Avenue N.E, ,
and the Public Works Department indicated that N.E. 19th Street will eventually
service areas west of the city limits in this vicinity.
Further, this applicant is also proposing to subdivide an adjoining parcel with
frontage along N.E. 19th Street and the Public Works Department has similarly
recommended that that proposal also install off-site improvements.
13. The applicant has executed a restrictive covenant to participate in any future LID
initiated in the area.
CONCLUSIONS: •
•
1. The short subdivision proposed by the applicant appears to meet the goal ,of the
Comprehensive Plan and is compatible with the subject lot's, zoning classification.
The Comprehensive Plan and the zoning both indicate that the area should be
developed with single family residences.
2. Each of the proposed lots will meet the minimum requirements of the zoning., G-7200,
and will. be compatible with the existing single family character of the surrounding
development.
3. Services are, generally available and may be extended by the applicant to serve the
proposed plat.
4. The proposed subdivision will provide additional housing in compliance with the goals
of the Comprehensive Plan, is compatible with the zoning and character of the
surrounding neighborhood and will therefore serve the public interest.
5. The applicant has failed to demonstrate that a waiver for the installation of off-
site improvements is justified. Sierra Terrace Division No. 1, a nearby development,
is installing off-site improvements in conjunction with that project, and heavier
demand is expected to develop along N.E. 19th Street. In addition, the applicant's
other. short plat which is adjacent to this proposal would permit much of the south
block front along N.E. 19th Street to be simultaneously improved for better public
access. and safety along both N.E. 19th Street and Shelton Avenue N.E.
The applicant may instead apply to the Board of Public Works for a deferral of off-
site improvements. The .deferral would achieve a similar effect and provide the
Public Works Department oversight ability on this proposal.
DECISION:
Exhibit #2 is approved subject to the installation of off-site improvements pending a
deferral of such improvements if granted by the Board of Public Works. Sewer, water and
utility hookups must be approved by the Public Works Department.
The requested waiver of the required off-site improvements is denied.

1 . Topography : The site is essentially level .
2 . Soils : Alderwood Gravelly Sandy Loam (AgC) . Permeability is
moderately rapid in the surface layer and subsoil and very slow in
the substraum. Runoff is slow to medium and the erosion hazard is
moderate. This soil is used for timber , pasture , berries , row
crops , and for urban development .
3 . Vegetation : High scrub grass is the dominant feature with some
medium shrubs and a few Douglas Fir.

To Whom It May Concern,
A waiver of offsite improvements requirements, for the
shortplat applications to which this letter is attached, is
hereby requested ou the following grounds:
There are presently no sidewalks, curbs, or storm drains
on the West side of Union Ave. NE in the area of
this property.
There are about 10 houses served by the same streets as
this property,and they are adequately served by the
present improvements.
The neighborhood of this property presently has a rural-
suburban character which would be disrupted by urban
type improvements.
In keeping with the other properties in this neighborhood
these shortplats would add 5 new homes, at a density
of approximately 4 homes per acre.
In addition,to the above requested waiver, an exception
allowing a pipe stem lot in the shortplat of tax lot 259 is
required for the best utilization of that property. The
requested pipe stem will be 20 feet wide by 100 feet deep,
and will allow for ingress, egress and utilities to Lot 1
of that shortplat.
