Again we would suggest as we have done so often in the past, that the
Planning Commission may consider an industrial park type. ordinance'
which undoubtedly would regulate any of the facets that are now being
considered by means:of •the .conditions precedent..
It should also be realized that based on the present:recommendations .
submitted to us by the Planning Department, there is no legal way that,
the City could enforce the various conditions imposed on the above
property owner in case they decide• to change their minds and fail to.
comply with the dedication and other covenants. We certainly hope
that the City Council, and especially the Planning Con ission,will
establish .a.,'policy. that . is legal in all respects and above criticism

We are handing you herewith.'three stencils for the.proposed rezoning
Ordinances as above captioned.- It .is suggested that the Planning Director
and City' Engineer proofread: the .legal carefully inasmuch. as two of them
have split •rezoaings.

As you can see, we .have omitted any reference to• the..conditions 'precedent
imposed by the Planning Cammission and concurred in by the 'City Council.
We have heretofore explained' again and again-that in_our opinion neither -
the Planning Commission nor the City' Council has a right .to impose
conditions precedent which would. require a property, owner, in case -of
rezoning, to give up property free of: cost to the City.• •The Courts'
have struck down' any such requirements in the -past .and undoubtedly would ,.
da so again if :challenged:
If, on theother hand, the property Owner, .on a strictly voluntary basis, '
is willing to dedicate some right oZ way, either outright or.by easement
to the City, there certainly would be no objection to accepting same and
thereafter adopting an Ordinance :rezoning the -property if such rezoning
is in the best interest of theCity and in compliance with its Ordinances.
Thereafter the deeds could then be recorded by the. City ,Clerk. '
We do not believe that_.it is Possible, from-a practical standpoint, to
get a ,bonding'company to issue a bond.covering' maintenance :of .landscaped
improvements.. We have run into this' prbblem.before and no bonding company
seems 'to be .in a position to cover this type of a condition since it is
too ' indefinite to be enforced. There seemed to be no standard at all •
which would establish the'kind of maintenance the Planning_ Department .
has in mind. .
Again we would recommend that any of these so-called, conditions imposed •
by the Planning Coamisaion.should be contained in a proper ordinance at

AN ORDINANCE OF THE CITY OF RENTON, WASHINGTON CHANGING THE
ZONING CLASSIFICATION OF CERTAIN PROPERTY WITHIN THE CITY OF
RENTON FROM GENERAL CLASSIFICATION (GS-1) TO TRAILER PARK (T-1)
WHEREAS, under Chapter VII, Title IV (Business Regulations) of Ordinance No.
1628 known as the "Code of General Ordinances of the City of Renton", as amended, and
the maps adopted in conjunction therewith, the property hereinbelow described has
heretofore been zoned as General Classification District (GS-1), and
WHEREAS, a proper petition for change of zone classification of said property
has been filed with the City Clerk on or about May 6, 1965 which petition was then
referred to the Planning Commission for investigation, study and public hearing, and
a public hearing having been held thereon, on or about May 26, 1965 all pursuant to
notice of hearing duly published and posted as provided by law; and said matter having
been duly considered by the Planning Commission, and all parties having been heard
appearing in support thereof or in opposition thereto, NOW THEREFORE
BE IT ORDAINED BY THE MAYOR AND THE CITY COUNCIL OF THE CITY OF RENTON AS

Committee and Director' s report: Recommend approval of the Pre-

south end of 85th Avenue South.
Mr iiitchings representing the plattor, stated that the owner
of the property adjoining the proposed turn around at the south end
of 85th Avenue South plans to extend the road further south for the
development of his property. He stated the easement for the turn
aroend has been filed but not ..eecorded.
After further discussion it was moved by Peretti , seconded by
Denzer, that the Preliminary Plat be recommended to the City Council
for approval. Motion carried.

Mrs . Rivily, representing the applicant , stated that they felt
this would be a proper use for this property since it is adjacent to
the Freeway and near the Racetrack . questioned as to whether they
would agree with the provisions as stated in the Director and Commit-
tee ' s report , the applicant agreed to dedicate by easement to the City
the south 15 ' of the property adjacent to South 153rd Street for
roadway and utility purposes, and further, agreed to the provisions
as stated in a, and c, of the Committee and Director's reporte
Chairman Felker asked if there were any written or oral Protests
to this rezone . There being none , it was moved by Peretti , seconded
by Denzer, to close the hearing . Motion carried.
It was then moved by Denzer, seconded by Peretti , that we recem-
mend to the City Council the rezone of the subject property to T-1
