Appointment Commission. (Mr. Gain was appointed 2/23 to complete the term of James

Prohibited regarding dangerous weapons including Nun-Chaka Sticks. Councilman
Perry inquired of Lt. Phelan re sticks and was advised it is oriental
offensive weapon, outlawed, consisting of two clubs 2" to 18" joined

First Reading , The Ways and Means Committee Report recommended first reading of an
Liquor Code ordinance amending the Penal Code relating to liquor. Following read-
ing, it was explained by City Attorney Shellan the ordinance was requested
by the Police Department prohibiting patrons after closing hours except
authorized personnel . MOVED BY STREDICKE, SECONDED BY CLYMER, COUNCIL
REFER ORDINANCE BACK TO THE WAYS AND MEANS COMMITTEE. CARRIED.
First Reading The Ways and Means Committee Report recommended first reading of an
Divelbiss Rezone ordinance rezoning property from General Classification District (G) to
R-016-77 Light Industrial District (L-1 ) known as the Divelbiss Rezone. Follow-
ing reading, it was MOVED BY STREDICKE, SECONDED BY PERRY, REFER THE
ORDINANCE BACK TO THE-WAYS AND MEANS COMMITTEE. CARRIED,
First Reading The Ways and Means Committee Report recommended first reading of an
Amending - ordinance amending procedural matters of the Land Use Hearing Examiner

Rezone R-009-77 from G to SR-1; property
located at N.E. 23rd Street and Duvall
Avenue N.E. ; rbferred to ascertain whether
park and open Space requirements are meeting
present ordinafice.
OBSERVATIONS:
The purpose of the proposed rezone is to allow
platting of the property into an eighteen lot single-family
subdivision.
The total site is approximately 4 . 8 acres with ldts
ranging in size from 8 ,250 square feet to 11,250 square
feet. All lots would exceed the 7 ,500 square foot lot
area minimum of the SR-1 zone and would provide adequate
private open space.
RECOMMENDATION:
The Committee, after review of the Subdivision
Ordinance and the proposed development, feels that
requiring the dedication of a park or open space in a plat
of such limited size would not create usable public area.
The Committee is researching the matter of requiring
parks and open space in new developments , and will make
more specific recommendations at a future date.

Divelbiss Letter from City Clerk recommended a Public Hearing date of May 16,
Annexation 1977 for the 10% Petition of the Divelbiss Annexation. The area is
Public Hearing generally located south of Victoria Park, east of Talbot Road, north
May 16, 1977 of Carr Road, and west of Benson Road , area is approximately 207
acres. Council concurrence recommended.
Vouchers The Ways and Means Committee recommended Council authorization for
payment of Vouchers No. 13317 through No. 13479 in amount of
192,113. 85 having received departmental certification that merchan-
dise and/or services have been received or rendered. Council con-
currence recommended.
Travel to WA Letter from Acting Fire Chief Richard Geissler requested permission
Fire Chief' s to attend the Washington State Fire Chiefs Association Meeting on
Association June 2, 3 and 4th in Spokane; total cost to be $150.00 with city
car for transportation. Council concurrence recommended.

Public Works Public Works Director Gonnason announced that the convention of the
Convention American Public Works Association was being held at the Renton-Sheraton
in Renton Inn beginning on Tuesday, April 12. He extended invitation to the
Administration and Council to attend some of the sessions. (See
attached meeting notice) .

Committee Report
Comprehensive
Plan Land Use Planning and Development Committee Chairman Perry presented
Designation committee report recommending that the Comprehensive Plan land
N. 30th St. use designation on both sides of N. 30th Street from FAI-405 to
Park Avenue North remain commercial (approximately 125 feet
in depth) and that the multi-family residential designation
be deleted. The committee report further explained that though
the Council went on record indicating that a public hearing
would be held prior to any further change in the Kennydale
Comprehensive Plan, it was the consensus of all interested
parties and representatives of both sides of the issue that met
with the committee, that another public hearing was not desired.
The report further recommended referral to the Ways and Means
Committee for appropriate legislation. MOVED BY GRANT, SECONDED
BY SHINPOCH, COUNCIL CONCUR IN THE RECOMMENDATION OF THE COMMITTEE,
President Perry introduced Kennydale Community Club spokesman ,
Gary Spoor, 3210 Park Ave. N. (representing Kennydale residents
against multi-family zoning) who stated agreement to the Comp,
rehensive Plan changes as outlined and that no additional pub-
lic hearing was desired. The presence of Mr. George Sidebotham
was noted. The City Council requested the City Clerk to notify
in writing all interested parties of record, Mayor Delaurenti
so ordering. MOTION CARRIED.
Talbot Roadway Councilwoman Thorpe inquired about an item on the 3/28/77 Consent
Construction Agenda re Final Payment on the Talbot Roadway Construction requested
Final Payment by Public Works Director Gonnason and was concerned about the cost
overrun, change order and authorized extra work and why an item
like that was put on the Consent Agenda. Mr. Gonnason said the
department would prepare a report on all the expenditures and what
the program is.. MOVED BY STREDICKE, SECONDED BY THORPE, SUBJECT
MATTER BE REFERRED TO THE MAYOR' S OFFICE AND THE PUBLIC SERVICES
COMMITTEE. MOTION CARRIED.
Public_ Services Public Services Committee Chairman Bruce presented committee report
Committee Report on sewer service for properties in the vicinity of Edmonds Ave. N.E.
for Charlie Shane which recommended the Council concur in the report
of the Public Works Director. The Clerk read Mr. Gonnason' s report
on providing sewage disposal service for Mr. Shane' s proposed develop-
ment easterly of Edmonds Ave. in the vicinity of N.E. 23rd St. and
outlined what would be required and the schedule for accomplishing
the project. MOVED BY PERRY , SECONDED BY STREDICKE, TO CONCUR IN
THE COMMITTEE REPORT. MOTION CARRIED.

CHANGING THE ZONING CLASSIFICATION OF CERTAIN •
PROPERTIES WITHIN THE CITY OF RENTON FROM
GENERAL CLASSIFICATION DISTRICT (G) TO SUBURBAN
RESIDENTIAL DISTRICT (SR-1)
WHEREAS under-. Chapter 7 , Title IV (Building Regulations)
of Ordinance No. 1628 known as the "Code of General Ordinances .
of the City of_ Renton" ,. as amended, and the maps and reports adopted
in conjunction therew.ith, _the property hereinbelow described has
heretofore been .zo.ned. as .G_erieral Classification District (G) ; and
WHEREAS a proper. petition for change of zone classification'
of said property has .been filed with the• Planning Department on
or about January . l8,, 197.7 which petition was duly referred to the ,
Hearing Examiner for investigation, study and .public hearing , and .
a public , he ring having been held thereon on or about February 15 ,

as hereinbelow specified; the Planning Director is hereby authorized
and directed to change the maps of the Zoning Ordinance , as amended ,
to evidence said rezoning , to-wit:

Rezone R-009-77 • to conditions, for rezone of MacPherson's, Inc. property located 200 ft.
south of NE• 23rd St. on west side of Duvall Ave. N.E. (138th Ave. SE) ,
from General classification district, residential to SR-1 (suburban
residential district) in order to permit subdivision and development of
property for single family residential purposes. The report noted that
public hearing was held by the. Land Use Hearing Examiner's office on
2/15/77 and appeal period expired on 3/1/77. Recommendation: Refer to

Stolen Painting Letter from Municipal Arts Commission Chairman, Charmaine Baker, noted
Replaced payment to the city of $195 by insurance carrier .for city's claim for
stolen painting "Ilwaco. " The letter reported the artist,, Jess Cauthorn,
agreed to replace this work with another from his collection at the.
replacement value awarded by the insurance company. The letter requested
transfer of $195 form Cumulative Reserve Account to the Arts Commission
budget for replacement painting, also recommending referral to the Ways
and Means Committee. MOVED BY PERRY, SECONDED BY GRANT, COUNCIL CONCUR
IN REQUEST. CARRIED.
LID 300 Sewers Letter from Public Works Director Gonnason submitted final assessment
Olympic View roll, LID 300 in sum "of $75,342.25 and recommended, public hearing be
set for April 18,1.977. MOVED BY PERRY,.:SECONDED BY BRUCE, COUNCIL CON-
CUR IN REQUEST AND SET PUBLIC 'HEARING FOR 4/18/77. CARRIED.
AUDIENCE COMMENT Versie Vaupel', 221 Wells N. , having previously filed complaint with the
City's Human Rights & Affairs Commission. reaardina the naming of Kiwanis
Human Rights Air Park, objected to Council ' s decision 3/8/77 to retain the name fol-
lowing the Commissions conclusion that in naming the park the city is
condoning discrimination; also objecting that she was not notified of .
Special .Council meeting re complaint she filed. Mrs. Vaupel expressed
intent to continue observance and checking of Council regarding city's
adherence to adopted policies.
Monster Kay Johnson, 300 Rainier Ave. N.•,, thanked Council for support in theRoadRRXingMonsterRoadRRCrossingmatter. City Attorney Shellan explained the
3/15/77 hearing held by Washington Utilities & Transportation Commission
in Olympia: from 9:,30 a.m. to 7:30 p.m. allowing industry to present new
or different evidence. ' The city has been asked to prepare brief re
alternate route Grady Way bridge and he suggested an .independent firm
make findings with other industries sharing cost= noting Monster crossing
to remain open in interim. Councilman Stredicke inquired re liability of
still dangerous railroad crossing at Monster Road, 'being advised by the
City Attorney that the city's liability will •not be greater than it has •
been, noting negligence on the part of persons involved in previous
accidents.
OLD BUSINESS Councilman Grant inquired re reply to. communication with McGrath in `
connection with exchange of property for Glencoe Park, being advised
by City Attorney Shellan that after unsuccessful attempt to reach Mr.
Grath by'"phone, certified letter(was sent 3/16/77 with no response;

that in later phone call Mr. McGrath indicated a change of mind and'.
reported there would be no exchange. of real estate. Chronological events
in the"attempt 'to establish a park in the Glencoe area were discussed.
MOVED BY STREDICKE, SECONDED BY THORPE, COUNCIL GO ON ' RECORD AS WANTING
A PARK IN THE GLENCOE AREA AND DIRECT THE ADMINISTRATION TO PROCEED IMMEDI-
ATELY TO ACQUIRE A SMALL PARK IN THAT AREA. John Meeko, 2015 Vashon Ave.
N.E. , and Charles Blanton., 2008 Vashon Ave. N.E. favored development -of
a park in the Glencoe area and expressed dissapointment at the loss of
the -McGrath property. City Attorney Shellan noted need of 'funding for
development of city property owned by the Utility Fund, noting State law
prohibits use of utility property for park purposes without leasing or
payment. of .fair market value. MOTION CARRIED. .

Open Space within- Upon discussion of park facilities provided in various sub-divisions
Sub-Divisions" within the city, Planning Director Ericksen explained negotiations
with builders , preliminary plat and size requirements. It was MOVED
by Grant,. Seconded by Thorpe, the Community Services Committee look at
open space or parks in sub-divisions of 25 lots or more. SUBSTITUTE
MOTION BY STREDICKE; SECONDED BY BRUCE, COUNCIL REFER THE INVESTIGATION
OF OPEN SPACE OR PARKS WITHIN SUB-DIVISIONS TO THE PLANNING AND DEVELOP-
MENT COMMITTEE FOR. RECOMMENDATION. SUBSTITUTE MOTION' CARRIED.
Public Services Councilman Stredicke presented Public Services Committee Report estab-
Committee Report lishing criteria for transit park and ride facilities which have been . :
Park•& Ride ' accepted by both the State Highway Department and Metro and are designed
Facility to insure compatibility with surrounding communities, protection of
Criteria residential areas, minimizing all environmental concerns and insure
acceptable standards making improved transit service available to Renton
citizens. Originally, a 700-car parking lot had been proposed. The
criteria is designed for two park and ride facilities accomodating
300-350 vehicles, one in the north-northeast and one in the south sec-
tions of the city. Criteria of major significance was considered:
1 ) Site to be located compatible with surrounding area and the Compre-
hensive Plan, i .e. , not residential areas, if possible. (2) Locations
to be screened and landscaped for aesthetic reasons as well as noise
and air pollution screening, storm water control to be provided. (3)
Minimum removal of housing or industrial units. (4) Easy accessibility
from freeway for both patrons and buses (within 3 minutes) and direct
access to arterial street. (5) Location to be adjacent to -planned
commuter routes connecting nearby communities and as close to residential
areas to be served as possible. (6) Criteria applies to two lots in
Renton irrespective of current 2nd and Burnett lot. (7) Locations to'
provide travel time and cost savings for potential transit riders. (8)
Construction and maintenance costs should consider 'land, construction,
maintenance and transit access costs. (9) The two facilities must be
in proximity of the interstate highway to qualify for Federal funding.
Park. & Ride Following, acceptance of these standards, the Public Services Committee
Facilities for recommended: (1 ) Metro be instructed to seek use of some Boeing park-
Renton ing area for temporary facility; Council President Perry and Mayor
Delaurenti assist Metro in immediate negotiations with The Boeing Com-
pany for portion of the parking area near North Renton Interchange.
2) The Public Works Department immediately assist the State Highway
Department in reviewing, previous locations and any additional sites,
avoiding "zero-start" position, with report forthcoming shortly for
consideration at a public hearing in the near future. (A re-start
would mean no project before 1981 ) MOVED BY STREDICKE, SECONDED BY
SH.INPOCH, THE .CITY COUNCIL ACCEPT THE PUBLIC SERVICES COMMITTEE REPORT
ON PARK AND RIDE FACILITY CRITERIA FOR THE CITY. CARRIED. MOVED BY
STREDICKE, SECONDED BY BRUCE, COUNCIL CONCUR IN RECOMMENDATIONS. Upon
inquiry by Councilman Perry, Councilman Stredicke noted Boeing had not
been contacted and was optimistic re joining of forces with Metro.

IN THAT PORTION OF REPORT RECOMMENDING REVIEW OF PREVIOUSLY CONSIDERED
PARK AND RIDE LOCATIONS. CARRIED.
Aviation Dvn. The Public Services Committee Report, Aviation Division, recommended .
Committee Report that the low bid of Renton Construction Co. , Inc. in amount of $30,168.22
Bid Award be accepted for the Airport water system improvement Phases I and II
Airport 3/1,6/77 bid opening reported earlier and tabulation attached.) . The
Water System report recommended authorization be granted for the Mayor and City Clerk
AD execute the contract agreement and noted the contract provides for
completion of the project within 60 working days. MOVED BY BRUCE, SEC-
ONDED BY PERRY, COUNCIL CONCUR IN THE RECOMMENDATION OF THE PUBLIC SER-
VICES COMMITTEE. CARRIED.
Assignment of The Public Services Committee - Aviation Dvn - noted review of request
H.W.. Petersen from Harry W. Petersen (Eastside Air Park) and Bernell Guthmiller (Air-
Lease port Specialties) for the assignment of .the Petersen lease to Mr.
Guthmiller: The report explained five-year lease terminating 7/1/78
containing provisions which restrict use of the property exclusively to
aircraft tiedown and that Guthmiller has been a tenant on the field
Since 1975, presently developing hangar facilities northerly of subject
property. The Aviation Committee recommended Council approval of the

AUTHORIZE CITY ATTORNEY TO ACCEPT 120-DAY EXTENSION OPTION PROVISIONOFGARGABECONTRACTANDAUTHORIZETHEMAYORANDCITYCLERKTOEXECUTETHESAME. Council President Perry inquired re cost of city operated
refuse collection. MOTION CARRIED.
Lake Ave. S. Councilman Grant inquired regarding demolition of house on city
Property owned property on Lake Ave.. S. which had been donated to the city
by Property Agent for Olympic Pipeline Company. . Councilman Perry
recalled adoption of resolution rescinding Council 's action to sur-
plus property which has now been declared open space. Mayor
Delaurenti noted the matter would be reported to Council .
Earlington Park Councilwoman Seymour inquired regarding progress in acquisition of
property for Earlington Park and Mayor Delaurenti noted the matter
was progressing, communication had been directed to Mr. Belmondo,
Renton School District to consumate the transfer and awaiting funds
from King County.

First Reading The Ways. & Means Committee Report recommended first reading of an
LID 297 Sewers ordinance authorizing installation of sanitary sewers in the Heather
Downs area, L.I. D. 297. Following reading of ordinance ordering--
construction, it was MOVED BY GRANT, SECONDED BY SHINPOCH, COUNCIL
REFER ORDINANCE BACK TO WAYS & MEANS COMMITTEE. Councilman Stredicke
requested for the record that ordinance applies to construction as
presented to Council at public hearing several weeks ago and is in
no way connected with proposed interceptors or other lines, and that
cost of trunk line facility has been separated from area charge so
that late comer's agreement can be arranged and that people in Heather
Downs are not paying full cost of the trunk line. MOTION CARRIED, .
referring the ordinance to Ways & Means Committee.
Resolution #2101 The Ways & Means Committee Report recommended reading and adoption of
Municipal Arts a resolution recommended by the Finance Director transferring funds
Painting to the Municipal Arts Commission of $195 to cover loss of painting.

REPORT AND RECOMMENDATION TO THE RENTON CITY COUNCIL.
APPLICANT: MacPherson's , Inc. FILE NO. R-009-77 .
LOCATION: Approximately 200 feet south of N.E. 23rd Street
on the west side of Duvall Avenue N.F.
SUMMARY OF REQUEST: Applicant requests a rezone from G (General
Classification District, Residential 35 ,000
square feet) to SR-1 (suburban residential
district) . .This request will establish a
zone classification that will permit subdivision
and development of the property for single family
residential purposes.
SUMMARY OF Planning Department: Approval subject to
RECOMMENDATION : conditions .

PUBLIC HEARING: • After reviewing the Planning- Department report,
examining available information on file with the
application, and field checking the property and
surrounding area, the Examiner conducted a
public hearing on the subject as follows :
The hearing was opened on February 15 , 1977 , at 9 : 00 a.m. in the
Council Chambers of the Renton Municipal Building.
Parties wishing to testify were sworn.
It was reported that the Hearing Examiner and the applicant had
received and reviewed the Planning Department report, and the report
was entered into the record by reference as Exhibit #1. '
Michael Smith, Planning Department, reviewed and summarized Exhibit #1 ,
and entered the following additional exhibits :
Exhibit #2 : Assessor's Map.
Exhibit #3.: Plot Plan, 1-40 scale.
The Examiner asked for additional comments from the Planning Department
staff. There were no further comments .
The Examiner requested comments from the representative for the applicant.
Responding was :
Mr. Scott W. Bigbie

Mr. Bigbie indicated that the applicant concurred in the Planning
Department staff findings and stipulations for the rezone. He reported
that the applicant intends to submit a preliminary plat plan for the
property within the next few weeks . He noted that the primary access
to the property would be from Anacortes Avenue N .E. rather than Duvall
Avenue N .E . which will provide access to the south of the plat , but w;v;
uncertain whether the plat map would show configuration of the streets-;
and lots .

The Examiner inquired about existing vegetation on the property. In
response, Mr. Smith indicated that the site consisted of dense brush,
with several evergreen trees along the south property line to the
western portion of the site, and several medrona trees on the western
portion.
In response to the Examiner's inquiry regarding future development of
the property to the south of the subject property, Mr. Smith reported
that the property is presently zoned G, and that the property owners
to the south have previously shown an interest in rezoning and platting
the property.
The Examiner inquired if the Planning Department had posted the property
and if opposition had been indicated by adjacent property owners . Mr.
Smith indicated that the property had been posted, and that the Planning
Department had received no verbal or written communication opposing the
rezone.
The hearing on Item #R-009-77 was closed at 9 :22 a.m, by the Examiner.
FINDINGS, CONCLUSIONS & RECOMMENDATIONS : Having reviewed the record in
this matter, the Examiner now makes and enters the following:
FINDINGS:
1 . The Planning Department report accurately sets forth the issues,
findings of fact, applicable policies and provisions and
department recommendations in this matter, and being uncontested
is hereby attached as Exhibit #1 and is incorporated into this
report by reference as is set forth in full herein.
2. A final Declaration of Non-Significance was approved by Gordon
Y. Ericksen, responsible official, on January 28, 1977 .
3. The land use and zoning in the area is primarily single family
residential consisting of a mixture of platted and sparsely
developed single family residences together with a significant
amount of undeveloped land that abuts Duvall Avenue N.B.
Property to the north and west of the subject property are
developed to G-7200 standards .
4 . Utilities are available from Anacortes Avenue N.E. and 138th
Avenue S .E.
5. Mr. Bigbie, representative for the applicant, stated that he
concurred with the staff report and recommendation .
CONCLUSIONS :
1. Ordinance No . 3071 , Section 4-3014 (b) , states that the property
is potentially zoned for the reclassification being requested
pursuant to the policies set forth in the Comprehensive Land
Use Plan and conditions have been met which would indicate the
change is appropriate.
2. The Land Use Report 1965, Page 11 , Residential, states :
The successful utilization of land for low density
residential development will depend on the availability
of easily accessible areas which are relatively free -
of recurring or potential hazards such as floods , slides,
and land subsidence. Residential districts should be
free of manufacturing or commercial uses which would be
detrimental to the community and its residents . The
natural features and amenities that may exist or can be
developed should be utilized to best advantage for the
use and benefit of the community. Convenience to place
of employment, shopping districts, schools , parks and
other cultural activities should be inherent features
of the location, "

3. Policy Statement, Comprehensive Plan, Renton Urban Area 1965 ,
Page 4 ,1. The Neighborhood.
4 . The rezone is compatible with existing single family residential
uses in the area and will not be detrimental to adjacent
properties.
5 . Sufficient access is provided from both Anacortes Avenue N.E.
and Duvall Avenue N.E.
6 . The requested rezone is compatible with the existing
Comprehensive Land Use Plan.
RECOMMENDATION:
Approval of the requested rezone subject to the conditions as stated
in the Planning Department report to the Hearing Examiner:
Recommend approval of the rezone request subject to the
retention of the significant evergreen trees on the site
so that they may be incorporated into the development
plan as much as possible. "

Cs PURPOSE OF REQUEST:
The subject rezone to an SR-1 single family residential
classification is to permit future subdivision and devel -
opment of single family residences on the site .
Da HISTORY/BACKGROUND:
The subject site was annexed into the city on February
6, 1974 by Ordinance No . 2824. It was zoned S-R ( Sub-
urban Residential ) in the county and assumed the G class-
ification upon annexation as per city policy.
E. PHYSICAL BACKGROUND:
1 . Topography : The subject site is relatively level
with a small knoll toward the center of the property.
2 . Soils : The Easterly 2/3 of site consists of Alderwood
AGC ) gravelly sandy loam, which has very slow . per-
meability below a depth of 24 to 40 inches , and a
seasonable high water table . The westerly 1 /3 of
the site consists of Everett ( EVC) gravely sandy
loam. This soil is very permeable and has a low '
available water capacity.
3 . Vegetation : The site consists of dense brush within
the easterly half of the site , and Douglas Fir
scattered throughout the site .
4 . Wildlife : The existing vegetation on the site provides
suitable habitat for birds and small mammals .
5. Water : Surface water or streams are not apparent on
the site.
6. Land Use : The subject site as well as the property
directly adjacent to the south is undeveloped . A
single family residence exists adjacent to both the
northeast and southeast corners of the subject site .
Single family residences exist directly to the north
and within Glencoe to the west of the site . The east
side of Duvall Avenue NE is low density unplatted
single family residential .
Fa NEIGHBORHOOD CHARACTERISTICS:
The area consists of a mixture of platted and sparsely
developed single family residences together with sign-
ificant amounts of undeveloped land . (Also refer to Map
I and Map II )
G. PUBLIC SERVICES:
1 . Water and Sewer : There is an existing 8 inch water
main along Anacortes Avenue NE and an existing 3 inch
water main along Duval Avenue NE . There is an existing
8 inch sanitary sewer along Anacortes Avenue, NE with
a lift station at the SW corner of Duval Avenue NE
and NE 23rd Street . Storm sewers are also available
in the area .
2 . Fire Protection : Provided by the Renton Fire Dept .
