COMMENTS:
Introduction The State Environmental Policy Act of 1971, Chapter 43.21C, RCW, requires
all state and local governmental agencies to consider environmental values both for their
own actions and when licensing private proposals. The •Act also requires that an EIS be
prepared for all major actions significantly affecting the quality of the environment.
The purpose of this checklist is to help the agencies involved determine whether or not a
proposal is such a major action.
Please answer the following questions as completely as you can with the information
presently available to you. Where explanations of your answers are required, or where
you believe an explanation would be helpful to government decision makers , include your
explanation in the space provided, or use additional pages if necessary. You should
include references to any reports or studies of which you are aware and which are rele-
vant to the answers'you provide. Complete answers to these questions now will help all
agencies involved with your proposal to undertake the required environmental review with-
out unnecessary delay.
The following questions apply to your total proposal , not just to the license for which
you are currently applying or the proposal for which approval is sought. Your answers
should include the impacts which will be caused by your proposal when it is completed,
even though completion may not occur until sometime in the future. This will allow all
of the agencies which will be involved to complete their environmental review now, with-

The subject site was annexed by Ordinance No . 1745 of April 4 , 1959 ,
as amended by Ordinance No . 1764 of May 27 , 1959 , and Ordinance
No . 1928 of December 22 , 1961 . The current G-6000 zoning has
existed since annexation.

E. PHYSICAL BACKGROUND :
1 . Topography: The subject site is essentially a level , developed
residential lot.
2. Soils : Ur-Urban Land is soil that has been modified by disturbance
of the natural layers with the addition of fill up to several
feet thick to accommodate industry or housing .
3 . Vegatation: The site is a mixture of manicured residential
vegatation and undergrowth of natural grasses . A hedge of
trees and shrubs separates the subject site from the residence
to the east. Two mature cottonwoods and a douglas fir are
located adjacent to the right-of-way of Maple Avenue.
4. Wildlife: Due to the developed nature of the site and
immediate parcels , any wildlife is expected to be those
species adaptable to the semi -urban conditions .
5 . Water: None.
6 . Land Use : The site is equidistant between Grady Way and
Interstate 405 . Adjoining parcels on the east and west -
are developed single family residences . An existing two
story duplex is across S . E . 12th .
F. NEIGHBORHOOD CHARACTERISTICS :
The neighborhood is a mixture of residential and business uses
along with interspersed vacant lots . Some transition of uses
from a former residential character to business uses is in evidence
with concentrations of non-residential uses primarily along
Grady Way.
G . PUBLIC SERVICES :
1 . Water and Sewer: A 12" water line is existing in Maple
Avenue. A 10" water line must be extended from Lind Avenue
easterly to this site via the alley separating lots on
Grady from 12th.
2. Fire Protection : To be provided by the City of Renton
Fire Department in accordance with ordinance requirements .
3. Transit: Metro Transit Route 145 operates on Grady Way
and Route No. 150 operates on Rainier Avenue and S. R . 167 .
4. . Schools': Talbot Hill Elementary is located approximately
1 1 /2 miles southeast, with Fred Nelson Junior High another
3/4 miles east. Renton Senior High School is located

0. PLANNING DEPARTMENT ANALYSIS :
1 . The proposed rezoning is from G-6000 to L-1 Light Industrial
is not precisely in conformance with the Comprehensive Plan land
use designation of Manufacturing Park. Due' to the existing platted
condition of the subject neighborhood , the City has previously
approved a number of rezonings in this area to L-1 Light Industrial
subject to restrictive .covenants to provide compatibility with
the Comprehensive Plan . These rezonings include Ordinances 2425
August 1968) ; 2559 (April 1970 ) ; 2590 (October 1970) ; 2594 (October
1970) ; and 3053 (August 1976 ) .
The covenants attached to those previous rezoning applications
generally contained the following requirements :
a . No structure within 20-feet of any property line;
b . 10-foot landscape setback along all exterior property
lines ;
c . Any ;exterior storage to be screened by a solid fence ;
2 . The subject site contains an existing two story single family
residence containing approximately 2 ,000 square feet of floor area .
Adjoining uses on all sides are existing , occupied residential
structures .

3. The Comprehensive Plan suggests a number of objectives
page 17' - Land Use Report) for protecting residential uses
through the effective control of land use, " and to "prevent
blight by protecting residential and other exclusive districts
from the unwarranted infiltration of uncompatible uses which would
contribute to premature decay and obsolecence . " "Residential
districts should be free from manufacturing or commercial uses
which would be detrimental to the community. "
4. The slubject neighborhood area, is in a state of
transition from residential to business/industrial uses . Non-
residenti;al uses can be noted both east and west of the subject site
along Grady Way.
5. Interstate 405 Freeway, Rainier Avenue South and Grady Way
surround the subject site with considerable traffic and intrusive
noise levels at peak hours of the day.
6 . The Comprehensive Plan (Land' Use Report, page 11 ) speaks
to the following characteristics of industrial uses . " Basic
industry---may include both large and small enterprises employing
a few or many persons . " "The availability and access to major
transportation systems---is important. " "Unless well planned for,
certain detrimental influences such as excessive heavy traffic ,
high sound levels ,---etc . may produce blight in surrounding areas . "
7 . The following specific objectives are outlined in the Green
River Valley Comprehensive Plan :
a . "Minimize detrimental effects " ; "Promote esthetics---
so developed areas will not be detrimental to adjacent
development" ; "Promote high quality development. "
b. "Light industrial , office and warehouse uses that can
be compatible with (the) goals of the Valley" ; "Land uses
should be grouped to promote a harmonious mix. "
c. A landscape buffer should be established at the periphery
of bounding streets--- (and ) between areas of incompatible
land use ; " "Development should occur in a logical ,
systematic manner--- . "
8 . It is difficult to determine the level of incompatibility
of any future use of this property with adjoining , existing
residential uses . Any adverse effects of said future use
should be mitigated as recommended by the Comprehensive Plan.
P . RECOMMENDATION :
Approve the subject rezone from G-6000 to L-1 Light Industrail
subject to the following restrictive covenants to run with the land :
1 . Prior ta occupancyof the subject building by a commercial
or industrial use , a site plan approval by the Hearing Examiner
shall be, granted including location of parking and detailed
landscaping plans .
2 . No new structures shall be located within 20 feet of any
property , line.
3 . A 10-foot landscape setback shall be provided along all
property 'ilines , with the exception that the landscaped area along
the eastlproperty line may be expanded at the time of site
plan approval to mitigate any specific adverse effects of
this development on the adjoining single family residence.
4. No exterior storage shall be allowed east of the existing
structure' and shall be screened with a solid fence 6 to 10
feet high.

that due to the existing condition of the streets an increase in traffic would be
detrimental. Mrs. Tonelli indicated that she had not received prior notice of the
public hearing and requested additional time in which to study the proposal.

Mrs. Ballestrasse indicated that she owns seven single family residences east of the
subject property as well as being half-owner of the property located directly east of
the proposed rezone, and reported her objection to L-1 zoning.

Mr. Ballestrasse, owner of a single family residence to the east of the subject site,
objected to the proposed rezone and noted that the subject site contains 9500 square
feet, not 10,000 square feet as denoted in Exhibit #1. He indicated that property to
the north and east of the site is currently zoned B-1 and felt that L-1 zoning was
incompatible with existing uses in the area.
The Examiner requested comments from Mr. Clemens. Mr. Clemens noted that B-1 rather
than L-1 zoning category may be less detrimental to the existing residential properties
in the area and asked the applicant if he would be amenable to the revision in zoning
designation. Mr. Gray requested clarification of requirements of the B-1 zone regarding
setbacks, landscaping and parking. Mr. Clemens reported that requirements would be
similar but less restrictive in the B-1 zoning category. Mr. Gray indicated his
concurrence with the revised designation.
Responding to concerns previously discussed, Mr. Gray indicated that the proposed 'office
and storage use of the property for a business form distributorship would not require
extension of sewers and would not require additional parking space since all sales of
the product occur in the establishments of customers.
Mrs. Tonelli questioned certain impacts regarding parking, traffic and sewers, and
inquired if similar restrictions would be placed upon a subsequent owner if the property
were sold in the future. The Examiner advised that the buyer would be eligible for any
uses allowed in the zoning category as long as zoning requirements were met. Mrs.
Tonelli questioned provisions for parking, and noted limited footage on the lot as well
as limited parking capabilities of existing streets. The Examiner explained that parking
calculations would be predicated upon the uses contained in the building and would be
determined by the Planning Department following rezone of the property, although parking
would not be allowed within areas designated as setbacks. He noted that if the rezone
were approved subject to site approval, a subsequent public hearing would be conducted
to review the specific site plan which would encompass parking provisions, landscaping
and setback requirements.
Mrs. Tonelli indicated her opposition to L-1 zoning and inquired if that designation could
be excluded by the Examiner at the public hearing. The Examiner indicated that a decision
regarding zoning designation would be made during review following closure of the public
hearing. He also explained that the King County Health Department would determine
capabilities of the existing septic tank on the property and recommend sewer extension
if requirements were not met. Mrs. Tonelli requested additional time to allow opportunity
to further review the impact from a rezone to L-1, but indicated that rezone to B-1 would
not require an extension of review period.
The Examiner requested further comments. Responding was:

Mr. Hardin, owner of the subject property, reported that the previous owner had utilized
the structure as a cabinet shop, and upon purchase of the property, Mr. Hardin had been
informed that B-1 zoning existed on the site. He advised that he has been operating
a business similar in nature to that proposed by Mr. Gray and no difficulties had
resulted from excessive traffic, inadequate parking provisions, or septic tank failure,
noting that volume of use of septic tanks is greater from residential than office use.
The Examiner questioned the date of purchase of the property. Mr. Hardin indicated, that
the property had been purchased in 1975 and had been utilized for his business, Circo,

REPORT AND RECOMMENDATION TO THE RENTON CITY COUNCIL.

LOCATION: Northeast corner of Maple Avenue S.W. and S.W. 12th Street.
SUMMARY OF REQUEST: Applicant requests approval of a rezone of 10,000 square
feet located at the northeast corner of Maple Avenue S.W.
and S.W. 12th Street from G-6000. to L-1, Light Industrial,
for a future office with storage in an existing structure.
SUMMARY OF Planning Department: Recommend approval with restrictive
RECOMMENDATION: covenants.
Hearing Examiner: Recommend approval to B-1 with .
restrictive covenants.
PLANNING DEPARTMENT The Planning Department staff report was received by the
REPORT: Examiner on October 17, 1978.
PUBLIC HEARING: After reviewing the Planning Department report, examining
available information on file with the application, and
field checking the property and surrounding area, the
Examiner conducted a public hearing on the subject as
follows:
The hearing was opened on October 24, 1978 at 9:30 a.m. in the Council Chambers of the
Renton Municipal Building.
Parties wishing to testify were affirmed -by the Examiner.
It was reported that the Hearing Examiner and the applicant had received and reviewed
the Planning Department report, and the report was entered into the record as Exhibit #1.
David Clemens, Associate Planner, reviewed Exhibit #1, and entered the following
additional exhibit into the record:

The Examiner asked the applicant if he concurred in Exhibit #1. Responding was:

Mr. Gray indicated his concurrence with the exception of the 20-foot setback required on
the northern property line abutting the alleyway denoted in Recommendation No. P.2 of
Exhibit #1, and requested that the setback be reduced to 10 feet. The Examiner noted
that the applicant is not listed as the property owner on the affidavit of ownership
contained in the rezone file and requested clarification. Mr. Gray indicated that he
is proposing to purchase the property contingent upon rezone approval and other matters.
The affidavit of ownership was entered into the record as Exhibit #2 by the Examiner.
The Examiner requested .further testimony in support of the application. There was no
response. He then requested Mr. Clemens to respond to the applicant's request for
reduction in setback designation on the northern property line. Mr. Clemens indicated
that the proposal was acceptable in view of the 16-foot width of the alley and the
required 10-foot landscaping strip along that property line.
The Examiner requested testimony in opposition to the request. Responding was:

Mrs. Tonelli advised that she is half-owner .of the'property to_ the east,. and,owner of
the residence located across S.W. 12th Street to the south of the subject site. Due to
the minimum size of lots in the surrounding area, she felt that.. an: increase in use of
the subject property would infringe on existing residents in the. area and possibly
create a need for sewers to which she objects. She also objected to proposed L-1

9. Office use is proposed on the upper floor and storage in the lower floor of the
existing residence. B-1 zoning as recommended by staff appeared acceptable for
this use to all parties.
CONCLUSIONS:
1. It is very apparent that the area immediately surrounding the subject property is
in transition from single family residential land use to a more intense land use.
Less evident is whether the direction is to commercial or industrial. Commercial
B-1) uses abut the northerly portion of the site and extend along S.W. Grady Way,
but do not exhibit a strong trend to commercial land use in the area. Single
family residential land use remains the dominant land use in the area surrounding
the property. Westerly of the property exists relatively large areas of L-1 and
B-1 property separated by G-6000 property.
However, the zoning pattern of the entire area south of Grady Way, north of FAI-405
and west of SR-167 provides sufficient guidance that the direction that zoning is
taking is at least to a mixture of B-1 and L-1. Gradually the existing and
transitional single family uses are being, replaced predominantly by commercial or
industrial uses.
2. Although the Comprehensive Plan Land Use Map is merely a general guide to
implementation of the Comprehensive Plan (Ordinance No. 2142, Section 1.II.1) , the
designation of Manufacturing Park (M-P) at least indicates the reclassification
trend to more intense uses than single family. Due to the small, narrow property
configurations of the area, zoning of M-P presents difficulty of compliance with
setback, etc. requirements of the M-P zone which is actually intended for large
parcels and development.
3. The Comprehensive Plan goals and objectives seem to predominantly support
reclassification of the property to B-1 (Section 4-3014. (B) ) . Access is available
within a close proximity to FAI-405 and SR-167 (page 11, Commercial, Comprehensive
Plan, Land Use Report, July, 1965) . This will not produce or contribute to
premature decay of the neighborhood but will contribute to orderly growth
Objective No. 1, page 17, Comprehensive Plan, Land Use Report, July, 1965) . This
is effective control of the land use in the area (page 17, Objective No. 4, Ibid) .
This use will promote the best interests of the community (page 18, Objective No. 6,
Ibid) . B-1 would be a more compatible use to existing single family residences
page 5, Objectives, Green River Valley Comprehensive Plan, June, 1976) .
Zoning of the intensity oflL-1 and M-P in this triangle area appears to present
difficult development problems for the small ownership and lot configuration
that dominates the area. In some locations rezones to L-1 have recently been
approved which imposed special conditions making the zoning more similar to the
M-P zone (O'Brien, R-885-76, Divelbiss, R-016-77, and Dalpay, R-143-78) . The
circumstances surrounding these rezones appears dissimilar from the subject
application. The subject property at this time relates to the abutting B-1 and
G-6000 zones and must form some transition between the two zones.
4. Transition, buffering or an additional building setback does not appear necessary
between the northerly abutting B-1 zone and the subject recommended B-l. However,
this is not the case with the less intense G-6000 zone abutting the other portions
of the property. Between the abutting easterly G-6000 property a 20-foot landscaped
screening area for transition and buffering purposes should be maintained between
these markedly different intense zoning categories. This landscaped area should
be used for landscaping screening only and be free of structures, pavement or
parking.
Since the southerly and westerly portions of the property abut streets, not single
family development, a lesser landscape screening and buffer area of 10 feet appears
appropriate. As specified in the aforementioned condition, this landscaped area
should be for landscaping only. In addition, the building setbacks along the.
streets should be 20 feet to conform to adjacent single family development, unless
adjacent properties are reclassified to a zoning category of similar intensity or
more intense than B-1. If such reclassification occurs, the normal setbacks of
the B-1 zone should. apply.
5. Due to the proximity to single family development, it is appropriate that the
Planning Department review and approve exterior waste container enclosures. Such
containers should be enclosed by a fence that sufficiently screens the containers
from view from the single family properties. Other exterior storage should not
occur, but all materials should be stored within the building.

Inc. The Examiner advised that a non-conforming use in a zoning designation may continue,
even if the property is sold, until termination Of that use, at which .time the property
in question would be required .to conform to existing zoning regulations.
Mr. Ballestrasse reported that the previous owner of the property resided on the property,
was employed at Pacific Car & Foundry Co. , and although he may have built cabinets within
the residence, it was not a business and he did not possess a license for that purpose.
The Examiner inquired if the existing residence had been located precisely on the map in
order to establish accurate setback areas in an ,L-1 zone. Mr'. Clemens reviewed setbacks
and parking areas denoted in Section P. lR'ecommendation of Exhibit. #1, and reported' that
the proposed parking plan was acceptable' and substantial area remained for more intensive '
development if required in the future. He indicated that although the applicant proposed
only six parking spaces in accordance with office space proposed within the ,structure,
the site would allow expansion to 10 parking spaces if the entire building were utilized
for office purposes. He clarified that the lot actually contained 9500 square feet as
previously reported by Mr. Ballestrasse, but the figure ,had been rounded to 10,000 for
the purpose of the.staff analysis.
The Examiner requested a final recommendation from the Planning Department. Mr. Clemens
reviewed requirements contained'in the Green River Comprehensive Plan document and the
Land Use Map document of the Comprehensive Plan which designates the area north of Grady
Way for commercial use and _the property south of Grady Way for manufacturing park use.
He advised that to maintain conformance with the existing plans for the area, but
taking into consideration concerns of the adjacent residents, a revised recommendation to -
B-1 category was acceptable with retention of restrictive covenants to minimize detrimental
effects of building Or parking arrangements, as well as the previously reported revision
of reduction to a 10-foot setback on the northern boundary of the property abutting the
existing alley.
The Examiner requested further comments. Since there were none, the hearing on File No.
R-225-78 was closed by the Examiner at• 10:15 a.m.
FINDINGS; CONCLUSIONS & RECOMMENDATIONS: Having reviewed the record in this matter, the
Examiner now makes and enters the following:
FINDINGS:
1. The request is .f or' reclassifying 9500 square feet of property from G-6000 to L-1.
During the public hearing, staff revised its recommendation to B-1 with conditions, .
which. was acceptable to the applicant.
2. . The Planning Department report accurately sets forth the issues; applicable policies
and provisions, findings of fact,. and departmental recommendations in this matter,
and is hereby attached as Exhibit #1 and incorporated in this report by reference
as set 'forth in full therein.
3. Pursuant to the City of .Renton's Environmental Ordinance and the State Environmental
Policy Act of 1971; aaamended by R.C.W. 43.21.C. , a Declaration of Non-Significance
has been issued for the subject proposal by Gordon Y. Ericksen, responsible official.
4. Plans for the proposal have been reviewed by all city departments affected by the
impact of this development.
5. All existing utilities are available and in close proximity. If required, a sewer
line must be extended to the property (Exhibit #1) .
6. The proposal is compatible with the required setbacks, lot'coverage 'andheight
requirements of Section 4-712 ' (L-1) and 4-711 (B-1) of Title IV, Ordinance No. 1628,
Code of General Ordinances. Sufficient area for parking exists on the site while
meeting the conditions recommended by staff. Depending upon the amount of area
used in the existing house six to 10 parking spaces may be required.
7. The Comprehensive Plan Land Use Map. indicates the property to potentially be
Manufacturing Park (Section 4-3014. (B)) .
8. Northwesterly and northerly of. the site, exist commercial uses in B-1 zoning. Within
several lots westerly,' southerly and easterly of the' property. exist only residential
land uses. The subject property currently used as a business essentially in
the same manner as proposed. Testimony appeared. to:indicate that the, current '
business use began in 1975. Prior to that time the property was used as a single
family residence wherein a hobby of some woodworking occurred.

6. Review by the Examiner of the site plan seems unnecessary as long as the existing
building or any alterations or expansion thereof conforms to the conditions imposed
upon the reclassification. Section 4-711.0 (B-1) imposes a height limit of 35
feet (same as single family) , except as otherwise approved by the Examiner for
this property.
7. It is assumed that any development or use of the property shall conform to other
applicable city ordinances and regulations.
RECOMMENDATION:
Based upon the record, testimony, findings and conclusions, it is the Examiner's
recommendation that the City Council approve a reclassification of the property to B-1
subject to the following conditions being implemented in restrictive covenants:
1. A 20-foot landscape buffer along the easterly property line exclusively for screening
purposes per review and approval of the Planning Department.
2. A 10-foot landscape buffer along the southerly and westerly property lines
exclusively for screening purposes per review and approval of the Planning Department.
3. A 20-foot building setback along the southerly, westerly and easterly property
lines; except that normal building setback restrictions of 'the B-1 zone will be
applied if zoning abutting or adjacent to these property lines is changed to a use
of at least the intensity of B-1.
4. Exterior waste containers shall be screened from view by single family residences
per review and approval of the Planning Department.
5. Exterior storage of materials shall not occur.

Dear Mrs. Staley:
Your request of November 6, 1978 for reconsideration of the recommendation
on this matter contained several objections while expressing agreement
with the recommended B-1 zoning. These objections do not constitute
sufficient justification to reconsider the matter, but can be answered
from the record. Therefore, the following is provided to clarify the
recommendation.
The fact that Mr. Gray is the prospective purchaser, subject to rezoning,
of the property is clearly stated on page one of the recommendation. Mr.
Hardin is the property owner (Exhibit #2) and testified in the public
hearing (page two) . It is a normal occurrence for a rezone application
to be filed on the basis of a conditional purchase. Ordinances do not
prevent this procedure.
Finding No. 5, page 3, states that the decision of whether or not sewers
are required is yet to be made. On page two the Examiner stated that the
King County Health Department would make this decision. Nothing was
submitted into the record that this decision had been made. In any
case, this subject is not closed but remains to be decided by the King
County Health Department. Per that decision the applicant and/or
property owner must proceed with the proposal. Since this is fact, it
was not included as a condition to the recommendation.
Storm water problems in the area are not necessarily pertinent to the
rezone, but directly applicable to any construction/remodeling on the
site. The Public Works Department, not the Examiner, reviews the storm
drainage. Any existing problems should be directed to that department.
The B-1 zone 'requires a 10-foot. rear yard setback (Section 4-711.0) .
It is hoped that this information satisfies your concerns.

WHEREAS, Arnold Hardin and his wife Carolyn K. Hardin are the owners of the
following real property in the City of Renton, County of King, State of Washington;
and J. Clifford' Gray and his wife Bonnie A. Gray have contracted to purchase the
following real property in the City of Renton, County of King, State of Washington,
described as follows:

WHEREAS, the owners and purchasers of said described property, hereinafter
the property," desire to impose the following restrictive covenants running

and impose restrictions and covenants running with the land as to the use of the

LANDSCAPE BUFFERS
A 20-foot landscape buffer will be required along the easterly property line
exclusively for screening purposes per review and approval of the Planning Department.

lines exclusively for screening purposes per review and approval of the Planning
Department.
BUILDING SETBACKS
A 20-foot building setback will be required along the southerly, westerly and
easterly property lines; except that normal building setback restrictions of the
B-1 zone will be applied if zoning abutting or adjacent to these property lines
is changed to a use of at least the intensity of B-1.
WASTE CONTAINERS
Exterior waste containers shall be screened from view by single family residences
per review and approval of the Planning Department.
EXTERIOR STORAGE
Exterior storage of materials shall not occur.
DURATION
These covenants shall run with the land and expire on December 31, 2025. Any
violation or breach of these restrictive covenants may be enforced by proper legal
procedures in the Superior Court of King County by either the City of Renton or any
property owners adjoining subject property who are adversely affected by said
breach. Reasonable attorneys' fees incurred during an enforcement proceeding will
be borne by the parties whom the court determines are in error and shall be entered
as a judgment in such action.

WHEREAS under Chapter 7 , Title IV (Building Regulations)
of Ordinance No. 1628 known as the "Code of General Ordinances
of the City of Renton" , as amended, and the maps and reports adopted

is changed to a use of at least the intensity of B-1.
WASTE CONTAINERS
Exterior waste containers shall be screened from view by single family residences
per review and approval of the Planning Department.
EXTERIOR STORAGE
Exterior storage of materials shall not occur.
DURATION
These covenants shall run with the land and expire on December 31, 2025. Any
violation or breach of these restrictive covenants may be enforced by proper legal
procedures in.the Superior Court of King County by either the City of Renton or any
property owners adjoining subject property who are adversely affected by said
breach. Reasonable attorneys' fees incurred during an enfOreaent proceeding
be borne by the parties whom the court determines are in error and shall be entered
as a judgment in such action,
