The applicant requests the approval of a rezone from
R-2 , Residence Two Family District to R-3 , Multiple Family
Residential District. This to permit construction on the subject
site of two proposed duplex units .

C . PURPOSE OF REQUEST :
The purpose of the request is to provide zoning consistent with
the proposed multiple family housing .
D. HISTORY/BACKGROUND :
The subject site was part of the original plat of the
City of Renton .
E. PHYSICAL BACKGROUND :
1 . Topography: The site is generally level .
2 . Soils : Alderwood gravelly sandy loam 6-15% slopes (AgC ) .
Permeability is moderately rapid in the surface layer and
subsoil and very slow in the substratum. Runoff is slow to
medium and the erosion hazard is moderate. This soil is used
for timber, pasture, berries , row crops and for urban
development.

3. Vegetation : Some deciduous trees are located near the
western property line but the majority of the site is
composed of lawn grass .
4. Wildlife : Existing vegetation on the site may provide
suitable habitat for birds and small mammals .
5. Water: No water was observed on the subject site .
6. Land Use : The land use of the site consists of two
existing duplex residences . All adjacent lots are developed
with duplex units .
F. NEIGHBORHOOD CHARACTERISTICS :
The 'site and surrounding area consist almost entirely of duplex
residences .
G. PUBLIC SERVICES :
1 . Water and Sewer : Six inch water mains run north-south along
the west side of Jefferson Avenue N . E. and east-west on the south
side of N . E . 16th Street. An 8" sanitary sewer runs north-south
on the east side of Jefferson and a second 8" sewer
extends east-west on the south side of .N . E. 16th . Storm drainage
is not available to this site .
2 . Fire Protection :. Provided by the Renton Fire Department
as per ordinance requirements .
3. Transit : Metro Transit Route #142 operates along N . E. 16th
Street within 500 feet to the north of the subject site .
4. Schools : Hillcrest Elementary School is within 1 /8 of a mile
to the north of the subject site and McKnight Junior High School
is within 1/2 mile to the west while Hazen Senior High is within
1 3/4 miles to the east.
5. Parks : North Highlands Park is within 300 feet to the north of
the subject site and Kennydale Lions Park is within 1 1 /4
miles to the northwest and Kiwanis Park is within 1 1/2 miles
to the southeast.

J . IMPACT ON THE NATURAL SYSTEMS :
Rezoning of the subject site will not have a direct impact on the
natural systems ; however , subsequent development of the site will
disturb soil and vegetation , increase storm water runoff and
have an effect on traffic and noise levels in the area . However ,
through proper development controls and procedures , these impacts
can be mitigated .

K. SOCIAL IMPACTS :
Approval of the rezone and subsequent construction of the
proposed units may result in additional social interaction at
the site as well as the surrounding area.
L. ENVIRONMENTAL ASSESSMENT/THRESHOLD DETERMINATION :
Pursuant to the City of Renton ' s Environmental Ordinance and
the State Environmental Policy Act of 1971 , as amended , RCW 43-21C ,
a declaration of non-significance has been prepared for the subject
proposal on the basis that this is a rezoning only and that if
further development of the property occurs , further environmental
review can be made of a specific development proposal .

0. PLANNING DEPARTMENT ANALYSIS :
1 . The subject proposal is consistent with the Comprehensive
Plan land use designation of medium density multiple family
for the site.
2. The existing zoning in the area is predominantly R-2 with
intersperced R-3. The subject proposal appears to be
consistent with the existing R-2 zoning in the immediate
proximate of the site.
Ordinances 2285 ( 1966) and 2313 ( 1967) are facing Kirkland
N. E. , and Ordinance 2314 ( 1967 ) on Index , are previous R-2
to R-3 rezonings . In 1977 an R-2 to R-3 rezoning was approved
on Index to the west of the subject site subject to covenants
including 5 ' landscape screening on north and south , 10 '
landscaping on east, and landscaping adjacent to the buildings
to the approval of the Planning Department .
3. Existing uses adjacent to the property are duplexes or
low density multiple family in character. Two single family
residences are located to the east across Jefferson Avenue N . E .
4. The proposed parking layout is consistent with the design
and landscaping requirements of the Parking and Loading
Ordinance ; however, the proposed plan has not been thoroughly
reviewed as a part of this proposal .
5. The Utilities Engineering Division advises that the water and
sanitary sewer facilities and storm drains may require enlarge-
ment. Regarding water, the Fire Department will require
adequate hydrants to be installed .
6. ` In its review, the Fire Department advises that for this
type of occupancy the requirements of the Uniform Fire Code will
have to be satisfied . In addition , a 4-foot walkway for access
to each building is required .

7 . Density calculations for the area indicate that the west
side of Jefferson Avenue N . E . west to Harrington show
approximately 7+ dwelling units per acre. The east side of
Jefferson Avenue is somewhat less than 7 units per acre.
The applicant' s proposal for the subject property would result
in a density of 16+ dwelling units per acre.
8. The proposed rezoning is located at the middle of. an area
that will eventually transition from the current low density
multiple uses to a higher density ; the Comprehensive Plan
recommends that residential communities be "protected---from
unwarranted infiltration of incompatible uses which would
contribute to premature decay and obsolecence" (Land Use
Report, Objective #1 , page 17 ) . The proposed rezoning appears
to be premature at this location. A similar proposal at
the immediate fringe of the more intensive uses to the south
and east, however, would not.
P . PLANNING DEPARTMENT RECOMMENDATION:
Recommend denial of the rezone to R-3 for the subject site based
upon the following :
1 . The availability of suitable utilities and adequate storm
drainage facilities appears to be in serious doubt as per the
Utilities and Engineering Division comments .
2 . The proposed density of the subject proposal would be
more than two times that of the existing density of the
adjacent properties . This would not be consistent with
Objective 4 , page 17 of Objectives in Land Use Report ,
1965, which states :
Protect property values within the community
for the benefit of its residents , and property owners ,
through the effective control of land use and
the enforcement and application of building and
construction .codes . "
3 . The preponderance of R-2 zoning and the almost universal
development of the area with two family residences would seem
to have established the low density character of the area .
4. The existing R-3 zones in the vicinity appear to be
spot zones and these do not appear to be consistent with
responsible and effective comprehensive planning . (Land Use
Report , Objective 6 , page 18. )
If approval is granted , it should include the requirement of site
plan approval by the Hearing Examiner with 'adequate safeguards
to insure a compatible living environment. All utilities should
be required to be installed to serve the site , and the existingdwellingsbeupgradedtomeetallcurrentcoderequirements .

2 . Soils : Alderwood gravelly sandy loam 6-15% slopes (AgC ) .
Permeability is moderately rapid in the surface layer and
subsoil and very slow in the substratum. Runoff is slow to
medium and the erosion hazard is moderate. This soil is used
for timber , pasture , berries , row crops and for urban
development.

3. Vegetation : Some deciduous trees are located near the
western property line but the majority of the site is
composed of lawn grass .
4. Wildlife : Existing vegetation on the site may provide
suitable habitat for birds and small mammals .
5 . Water: No water was observed on the subject site .
6. Land Use : The land use of the site consists of two
existing duplex residences . All adjacent lots are developed
with duplex units .
F. NEIGHBORHOOD CHARACTERISTICS :
The 'site and surrounding area consist almost entirely of duplex
residences .
G . PUBLIC SERVICES :
1 . Water and Sewer : Six inch water mains run north-south along
the west side of Jefferson Avenue N . E . and east-west on the south
side of N . E. 16th Street. An 8" sanitary sewer runs north-south
on the east side of Jefferson and a second 8" sewer
extends east-west on the south side of N . E. 16th . Storm drainage
is not available to this site .
2 . Fire Protection : Provided by the Renton Fire Department
as per ordinance requirements .
3. Transit : Metro Transit Route #142 operates along N . E . 16th
Street within 500 feet to the north of the subject site .

Approval of the rezone and subsequent construction of the
proposed units may result in additional social interaction at
the site as well as the surrounding area.
L. ENVIRONMENTAL ASSESSMENT/THRESHOLD DETERMINATION :
Pursuant to the City of Renton ' s Environmental Ordinance and
the State Environmental Policy Act of 1971 , as amended , RCW 43-21C ,
a declaration of non-significance has been prepared for the subject
proposal on the basis that this is a rezoning only and that if
further development of the property occurs , further environmental
review can be made of a specific development proposal .

0. PLANNING DEPARTMENT ANALYSIS :
1 . The subject proposal is consistent with the Comprehensive
Plan land use designation of medium density multiple family
for the site .
2. The existing zoning in the area is predominantly R-2 with
intersperced R-3 . The subject proposal appears to be
consistent with the existing R-2 zoning in the immediate
proximate of the site.
Ordinances 2285 ( 1966 ) and 2313 ( 1967 ) are facing Kirkland
N . E. , and Ordinance 2314 ( 1967 ) on Index , are previous R-2
to R-3 rezonings . In 1977 an R-2 to R-3 rezoning was approved
on Index to the west of the subject site subject to covenants
including 5 ' landscape screening on north and south , 10 '
landscaping on east , and landscaping adjacent to the buildings
to the approval of the Planning Department.
3. Existing uses adjacent to the property are duplexes or
low density multiple family in character. Two single family
residences are located to the east across Jefferson Avenue N . E.
4. The proposed parking layout is consistent with the design
and landscaping requirements of the Parking and Loading
Ordinance ; however, the proposed plan has not been thoroughly
reviewed as a part of this proposal .
5. The Utilities Engineering Division advises that the water and
sanitary sewer facilities and storm drains may require enlarge-
ment. Regarding water, the Fire Department will require
adequate hydrants to be installed .
6 . ' In its review, the Fire Department advises that for this
type of occupancy the requirements of the Uniform Fire Code will
have to be satisfied . In addition , a 4-foot walkway for access
to each building is required .

7 . Density calculations for the area indicate that the west
side of Jefferson Avenue N . E. west to Harrington show
approximately 7+ dwelling units per acre. The east side of
Jefferson Avenue is somewhat less than 7 units per acre .
The applicant ' s proposal for the subject property would result
in a density of 16+ dwelling units per acre.
8. The proposed rezoning is located at the middle of an area
that will eventually transition from the current low density
multiple uses to a higher density ; the Comprehensive Plan
recommends that residential communities be "protected---from
unwarranted infiltration of incompatible uses which would
contribute to premature decay and obsolecence" (Land Use
Report , Objective #1 , page 17 ) . The proposed rezoning appears
to be premature at this location. A similar proposal at
the immediate fringe of the more intensive uses to the south
and east, however, would not.
P . PLANNING DEPARTMENT RECOMMENDATION :
Recommend denial of the rezone to R-3 for the subject site based
upon the following:
1 . The availability of suitable utilities and adequate storm
drainage facilities appears to be in serious doubt as per the
Utilities and Engineering Division comments .
2 . The proposed density of the subject proposal would be
more than two times that of the existing density of the
adjacent properties . This would not be consistent with
Objective 4 , page 17 of Objectives in Land Use Report ,
1965, which states :
Protect property values within the community
for the benefit of its residents , and property owners ,
through the effective control of land use and
the enforcement and application of building and
construction codes . "
3. The preponderance of R-2 zoning and the almost universal
development of the area with two family residences would seem
to have established the low density character of the area .
4 . The existing R-3 zones in the vicinity appear to be
spot zones and these do not appear to be consistent with
responsible and effective comprehensive planning . (Land Use
Report , Objective 6 , page 18. )
If approval is granted , it should include the requirement of site
plan approval by the Hearing Examiner with 'adequate safeguards
to insure a compatible living environment. All utilities should
be required to be installed to serve the site , and the existing
dwellings be upgraded to meet all current code requirements .

Mr. Chastain reviewed uses of higher densities located in proximity to the subject site
such as existing North Highlands Park located just north of N.E. 16th Street; Hillcrest
Elementary School located adjacent to the site; McKnight Middle School located to the
southwest; and an unimproved special use area located south of the proposed rezone and
north of N.E. 12th Street which he felt indicate support of higher density on the
subject site. He noted the intent of the applicant for development to only one-half of
the allowable density and indicated that control of density as well as mitigation of
potential utility problems can occur through :review and approval of a specific site
development plan. Mr. Chastain advised that a precedent has been set in the area for
the requested zoning by the city, and the request is consistent with designations
contained in the Comprehensive Plan. He indicated that because the intent of the city
is to protect the investment of surrounding properties in the area, revitalization which
would occur as a result of the rezone and subsequent construction would greatly improve
the area and increase the value of surrounding properties.
The Examiner requested testimony in opposition to the request. There was no response.
Mr. Clemens• reported concern that approval of the rezone would not necessarily assure the
city that development would be limited to the density proposed by the applicant if the
property were subsequently sold. He also indicated that timing becomes a crucial issue
in consideration of the Comprehensive Plan and location of zoning categories, and he felt
that the subject request was not substantially surrounded by similar zoning to provide
an acceptable situation. Mr. Chastain maintained that the city possesses the authority
to review development and use of the site.
The Examiner entered the following exhibit into the record by reference:

The Examiner requested a final recommendation from the Planning Department. Mr. Clemens
reported that the recommendation contained in Exhibit #1 would remain as submitted.
The Examiner requested further comments. Since there were none, the hearing on File No,
R-235-78 was closed by the Examiner at 10:20 a.m.
FINDINGS, CONCLUSIONS & RECOMMENDATIONS: Having reviewed the record in this matter, the
Examiner now makes and enters the following:
FINDINGS:
1. The request is for approval of a reclassification of 22,170 square feet of R-2 zoned
property to R-3 to permit construction of two additional duplex structures.
2. The Planning Department report accurately sets forth the issues, applicable policies
and provisions, findings of fact, and departmental recommendations in this matter,
and is hereby attached as Exhibit #1 and incorporated in this report by reference
as set forth in full therein.
3. Pursuant to the City of Renton's Environmental Ordinance and the State Environmental
Policy Act of 1971, as amended by R.C.W. 43.21.C. , a Declaration of Non-Significance
has been issued for the subject proposal by Gordon Y. Ericksen, responsible official.
4. Plans for the proposal have been superficially reviewed by all city departments
affected by the impact of this development.
5. Except for the staff recommendation there was no opposition to the proposal expressed.
6. All existing utilities are available and in close proximity, but may have to be
enlarged,' depending upon design of the structure.
7. The Comprehensive Plan indicates the property to potentially be R-3, Medium Density
Multifamily (Section 4-3014. (B) ) .
8. Directly west of the subject site and across the 30-foot wide public use area is
the closest R-3 zoned area. This single lot zone was reclassified in 1977
Ordinance No. 3144; R-015-77) subject to the following conditions which were
placed in restrictive covenants:
a. No building permit shall be issued for any new construction on the subject site
unless the existing duplex is removed from the site or remodeled to existing
City of Renton building code requirements and designed to be compatible with
any construction on the site. Exterior design shall be approved by the Renton
Planning Department.

PLANNING DEPARTMENT The Planning Department staff report was received by the
REPORT: Examiner on November 1, 1978.
PUBLIC HEARING: After reviewing the Planning Department report, examining
available information on file with the application, and
field checking the property and surrounding area, the
Examiner conducted 'a public hearing on the subject as
follows:
The hearing was opened• on November 7, 1978 at 9:55 a.m. in the Council Chambers of the
Renton Municipal Building.
Parties wishing to testify were affirmed by the Examiner.
It was reported that the Hearing Examiner and the applicant had received and reviewed
the Planning Department report, and the report was entered into the record as Exhibit #1.
David Clemens, Associate Planner, reviewed Exhibit #1, and entered the following
additional exhibits into the record:

Exhibit #3: Conceptual Site Plan
The Examiner asked the representative for the applicant if he concurred in Exhibit #1.

Mr. Hickox indicated his nonconcurrence in the report. He referenced Section P.1 of
Exhibit #1 which indicates doubt of availability of suitable utilities and adequate
storm drainage facilities to the site and reported that discussion with representatives
of the Utilities Division had indicated that proper building design could mitigate
inadequate water flow to meet Uniform Fire Code requirements. Mr. Hickox felt that
other comments provided by the Utilities Division regarding standard utilities charges
and installation of separate meters for each building did not constitute disapproval,
of the application. Referencing requirements for storm water drainage, he advised that
a percolation drainage system or roof drains could be installed to mitigate the problem.
Regarding allowable density oh ,the site, Mr. Hickox reported the applicant's intent to
develop 16 units on the site which would be approximately one-half of the maximum
allowed and would provide a gradual transition to the surrounding area. He surmised
that the proposed addition ofrfour units would not affect the density average of the
surrounding block of eight units per acre, over such a large area. Mr. Hickox reported
that three previously approved rezones are closely grouped together in proximity to the
site and projected a trend towards higher intensive use at a higher rate than the
surrounding area.

Pursuant to Title IV, Section 3015 of the City's Code, request for reconsideration must
be filed in writing on or before November 27, 1978. Any aggrieved person feeling that
the decision of the Examiner is based on erroneous procedure, errors of law or fact,
error in judgment, or the discovery of new evidence which could not be reasonably
available at the prior hearing may make a written request for review by the Examiner
within fourteen (14) days from the date of the Examiner's decision. This request shall
set forth the specific errors relied upon by such appellant, and the Examiner may, after
review of the record, take further action as he deems proper.
An appeal to the City Council is governed by Title IV, Section 3016, which requires
that such appeal be filed with the City Clerk accompanying a filing fee of $25.00 and
meeting other specified requirements. Copies of this ordinance are available for
inspection in the City Clerk's office, first floor of City Hall, or same may be
purchased at cost in said office.

9. In Exhibit #1 the Utilities Division of the Public Works Department stated that
storm drainage facilities were apparently not available. The applicant testified
that on-site retention facilities could be constructed.
10. The predominant land use in the vicinity is duplexes per the existing R-2 zoning.
Some single family structures exist, two Of which are located directly across
Jefferson Avenue N.E. from the subject site.
CONCLUSIONS:
1. The Comprehensive Plan Land Use Map is a general guide to land use decisions •
Section 1.II.1, Ordinance No•. 2142) ,' but the goals and objectives offer more
detailed direction for these decisions. These goals and objectives appear to'
support reclassification of the property to R-3, subject to developmental ,
conditions (Section 4-3014. (B) ) . •
R-3 is reasonably close to shopping and schools and Sunset Boulevard ' (page 11,
Residential, Comprehensive Plan, Renton Urban Area, July; 1965) . The R-3 has ,
been anticipated and intended by the Land Use Map designation of Medium Density
Multifamily for the purpose of motivating renovation or replacement of existing
duplex structures (Conclusion No. 2, Exhibit #4) . This would not ". . .contribute
to premature decay and obsolescence, and prevent the development of orderly
growth patterns." (page 17, Objective No. 1, Comprehensive Plan, Land Use Report,
July, 1965) . The ". . .orderly growth patterns" envisioned by the Comprehensive
Plan seem to be, for the existing transitional nature of the neighborhood to be
directed to R-3 whereby existing ". . .decay. . ." would cease.
A rezone to R-3 should enhance the property values in the area (Ibid, Objective
No. 4) and ". . .promote the best interest of the community and contribute to its
overall attractiveness and desirability. . ." (Ibid, page 18, Objective No. 6) .
2. A clear direction for land use has been established in the neighborhood of rezoning
to R-3 (Zoning Map) . Four other small areas of R-3 exist in the neighborhood.
The most .recent instance (R-015-77; Ordinance No. '3144) is almost adjacent to the
subject site and sets a further precedent that is pertinent to the subject
application (See Finding No. '8) . It appears reasonable and appropriate that this
precedent be continued which would provide the applicant with the alternatives
of improving the existing duplexes to current building code requirements (if the
structures are nonconforming) or removal of these duplexes in order to develop
the property according to R-3 requirements. Circumstances have apparently not
changed since adoption of Ordinance No. 3144.
3. This neighborhood was created for housing during World War II (Exhibit #4;
Paragraph D, Planning Department Preliminary Report to the Hearing Examiner,

activity began in 1962, perhaps as a reflection of the transition within the
neighborhood to more up-to-date housing needs and land use trends. The adoption •
of the Comprehensive Plan in 1965 adopted this trend (See Conclusion No. 10) .
4. R-2 and R-3 zones are compatible with each other, but the conditions listed in
Finding No. 8 enhance this compatibility and mitigate any adverse impacts that
may occur (page 17, Objective No. 4, Comprehensive Plan, Land Use Report, July,
1965) .
RECOMMENDATION:
Based upon the record, testimony, findings and ,conclusions, it' is the Examiner's
recommendation that the City Council approve. a reclassification of the :property to
R-3 subject to the following' conditions being implemented in restrictive covenants
prior to Counci Lapproval of the rezone:

Subject: Rezone Application
Dear Council Members,
Due to my absence from the State through the normal appeal period,
I offer the ,following belated appeal for your consideration. It
would seem that some important considerations were not offered
for review at the recent hearing.
Inire.viewing:the Planning Department's report that recommends denial
of. the Rezone Application, there overlying objection was to maintain
the density at or near the present level , even though the Comprehensive
Plan, calls for medium density in the areas of the subject property.
I' co! cur with their recommendation as stated in Paragraph 'P-2, dealing
with protecting property values through effective controls. By
requesting approval to add only four additional units to. my property
for a. total of 8 units) which is large enough for 14 units per R-3
zon.ing, .I. hope to have demonstrated my concurrence that a smooth and
even transition to a higher density is in the best interest of the
area. Since no objection to the proposed zoning change was. introduced
other than the Planning Department's and since the Hearing Examiner's
office has chosen to approve the Rezone Application with restrictive
covenants using as a presidence File No. -015-77; Stanley D. Wolf,
dated March 21 , 1977, it becomes important to note what the, result of
said "restrictive covenants" have had on that and other properties in
the area.
As pointedout in the Planning Department's report, any significant
improvements to a property will enhance adjoining property Values and
since my property is separated only by a 30 ft.. public use area from
the property formerly owned by Wolf, referred to above, it follows that ,
my' property as well as all other surrounding properties could'. have
benefitted had Wolf continued. It would seem that due to the requirements
imposed upon that property to bring the existing structure up to
current "building codes" 'have defeated their own purpose, as Wolf
abandoned his project on Index Avenue, sold the property and it now sits
there among the other postwar structures succumbing to the "premature
decay and obsolescence" referred to in the Planning Department's
Preliminary Report, Paragraph 08 of File No. R-235-78.
A contrasting situation has occurred, only a few blocks away (corner
of 12th & Harrington), where a property_ similar to mine existed.
Currently under construction is an 18 unit 3 story apartment building
where a maximum density situation is being created. Perhaps there is
a 'middle ground where existing structures can, and should ,be upgraded
to; protect the lifestyle and environment of the neighborhood from each
of the extremes noted above. By making the existing structures comply
with current "housing codes" and not the severe requirements of the
building codes" myself and other owners of these buildings could
then afford to upgrade our properties to suitable standards.

DECLARATION OF RESTRICTIVE COVENANTS
WHEREAS, Larry L. Howe, a single man, is the owner of the following real
property in the City of Renton, County of King, State of Washington, described as
follows:
Lots 10 & 11, Block 46, Corrected Plat of Renton Highlands No. 2, as
recorded in Volume 57 of Plats, page 92, Records of King County, Washington.
WHEREAS, the owner of said described property, hereinafter "the property,"
desires to impose the following restrictive covenants running with the land as to
use, present and future, of the property;
NOW, THEREFORE, the aforesaid owner hereby establishes, grants and imposes
restrictions and covenants running with the land as to the use of the land
hereinabove described with respect to the use by the undersigned, his successors,
heirs and assigns, as follows:
ISSUANCE OF BUILDING PERMIT
No building permit shall be issued for any new construction on the subject site unless
the existing duplex is removed from the site or remodeled to existing City of Renton
building code requirements and designed to be compatible with any construction on the
site. Exterior design shall be approved by the Renton Planning Department.
LANDSCAPE/SCREENING PLAN
A detailed landscape/screening plan shall be submitted to and approved by the Renton
Planning Department at the time of application for a building permit for any new
construction or remodeling. Such landscaping plan shall include, but not be limited
to:
1) Provision of an architectural-type screening fence together with a
minimum five-foot landscape strip along the south and north property
lines.
2) Provision of an architectural fence together with a minimum 10-foot
landscape strip along the east property line.
3) Provision of additional landscaping adjacent to the buildings and
throughout the site.
DURATION
These covenants shall run with the land and expire on December 31, 2025. If at any
time improvements are installed pursuant to these covenants, the portion of the
covenants pertaining to the specific installed improvements as required by the
Ordinances of the City of Renton shall terminate without necessity of further
documentation.
Proper legal procedures in the Superior Court of King County may be instigated by
either the City of Renton or any property owners adjoining subject property who
are adversely affected by any violation or breach of these restrictive covenants.
Reasonable attorneys' fees incurred during an enforcement proceeding will be
borne by the parties whom the court determines are in error and shall be entered
as a judgment in such action.

Council Joan Moffatt, 3709 Meadow Ave. No. , noted she was out of town and
Vacancy unable to attend Thursday special meeting for interviewing of
candidates for the council vacancy. Ms. Moffatt expressed that
she is still interested in the council position.
OLD BUSINESS
Ways and Means Ways and Means Committee Chairman Clymer presented report
Committee 'Report recommending the committee retain matter of Theatre Admission
Theatre Admission Tax to review the total structure of admission taxes and fees
Tax and that collection of revenue from Theatre Admission Taxes, at
the new rate, be delayed to March 1, 1979. MOVED BY STREDICKE,
SECOND CLYMER TO CONCUR IN THE COMMITTEE RECOMMENDATION. CARRIED.
MOVED BY CLYMER, SECOND STREDICKE REFER TO WAYS AND MEANS COMMITTEE
FOR ORDINANCE. CARRIED. Councilwoman Shinpoch requested a Fiscal
Impact Statement be presented at the same time as the ordinance,
showing the amount of lost revenue.
Public Safety Councilman Perry presented Public Safety Committee report recommending
Committee Report council concur in the Police Chief's recommendation to enter into an
Housing of agreement to house prisoners for the Muckleshoot Indian Nation;
Prisoners for Mayor and City Clerk authorized to sign contract agreement. Allen
Muckleshoot Sanders,Attorney for Muckleshoot Tribe, Office of the Tribal
Indian Nation Attorney, 38811 172nd Ave. SE, Auburn, noted Tribe has its own
law enforcement, but no jail facilities. Mr. Sanders added that
the amount of jail time would probably not exceed 200 days per year, and
would mainly be used for deterrents. 30 day cancellation clause explaine
MOVED BY STREDICKE, SECOND TRIMM TO CONCUR IN THE COMMITTEE REPORT.

Transportation Transportation Committee Chairman Trimm presented a report
Committee Report recommending concurrence in the Public Works Department recommendation
Award of Contract- to accept the low bid of Pacific Construction Co. , Inc. for
Bronson Way Street Federal-Aid FAUS Project, Bronson Way North and South Street Improvements
Improvements in the amount of $175,678.36. Bid opening January 4, 1979, This award
will be contingent upon receipt by the City of an "Authorization
to Award" from the Federal and State Agencies . Mayor and City Clerk
authorized to sign contract agreement. MOVED BY TRIMM, SECOND PERRY
TO CONCUR IN THE COMMITTEE RECOMMENDATION. CARRIED.
Taxing Motion by Shane city place 2% tax on Longacres. Failed for lack
Longacres of second. *Moved by Trimm, Second Stredicke the item of taxing
Longacres be referred to the Ways and Means Committee. Mr. Shane
expressed his dissatisfaction of his fellow council members. Mayor
Delaurenti asked the police representative to escort Councilman Shane
from the Council Chambers in accordance with Council 's Rules of Decorum.
Recess MOVED BY PERRY, SECOND STREDICKE TO RECESS. CARRIED. Council

PUBLIC HEARING This being the date set and proper notices having been posted,
LID 312-Street published, and mailed according to law, Mayor Delaurenti opened
Improvements, the Public Hearing to consider proposed LID 312, street improvements,
West Valley on West Valley Hwy. from SW 43rd St. to the City Limits. Improvements
Hwy. to include construction and installation of curbs, gutters and
sidewalks, storm drains, catch basins, together with a left turn lane
and all necessary appurtenances. Letter was read from Bruce Leber,
Ralph Leber Co. , PO Box 88700, Tukwila, agreeing with the LID, but
protesting the area included within the .LID, ,total cost, and the
method of assessment. Letter was read from William E. Rabel ,
Star Machinery, 241 South Lander Street, Seattle, requesting
assessment for left turn lane be based on actual linear feet of
the lane to benefit them. Letter was read from Norman K. Dewey,
President, Northwestern Hobby & Toy, 17300 West Valley Highway,
Tukwila, protesting proposed curbs and sidewalks, construction of
left turn lane and the proration of the LID expenses. Letter was
read from Warren C. Gonnason, Public Works Director, noting the
percentage of those property owners protesting their assessment is
40.23% of the estimated cost ($184,109. 15), and requested the public '
hearing be continued two weeks, allowing time to meet with property
owners in the area. Harold Hill , Mercer Island, property owner,
noted no charge should be made for improvements already completed on the
property and that there is no need for sidewalks. Bruce Rowe,
1313 E. Prospect, Seattle, part owner of Hill property, noted
need for left turn lane and opposed to installation of sidewalks.
Following discussion it was MOVED BY SHINPOCH, SECOND PERRY TO
CONTINUE PUBLIC HEARING TWO WEEKS,UNTIL FEBRUARY 5, 1979. Councilman
Stredicke requested detailed information on conditions previousl.y_ agreed
to by property owners and the actual square footage of properties
involved. Mr. Gonnason noted current bid openings showed a possible
increase in costs of the LID. MOTION CARRIED.

WHEREAS, Larry L. Howe, a single man, is the owner of the following real
property in the City of Renton, County of King, State of Washington, described as

to:

minimum five-foot landscape strip along the south and north property
lines.
2) Provision 'of an architectural fence together with a minimum 10-foot
landscape strip along the east property line.
3) Provision of additional landscaping adjacent to the buildings and
throughout the site.

I offer the following belated appeal for your consideration. It
would seem that some important considerations were not offered
for review at the recent hearing.
In reviewing the Planning Department's report that recommends denial
of the Rezone Application, there overlying objection was to maintain
the density at or near the present level , even though the Comprehensive
Plan calls for medium density in the areas of the subject.property.
I concur with their recommendation as stated in Paragraph P-2, dealing
with protecting property values through effective controls. By
requesting approval to add only four additional units to my property
for a total of 8 units) which is large enough for 14 units per R-3
zoning, I hope to have demonstrated my concurrence that a smooth and
even transition to a higher density is in the best interest of the
area. Since no objection to the proposed zoning change was introduced
other than the Planning Department's and since the Hearing Examiner's
office has chosen to approve the Rezone Application with restrictive
covenants using as a presidence File No. -015-77; Stanley D. Wolf,
dated March 21 , 1977, it becomes important to note what the result of
said "restrictive covenants" have had on that and other properties in
the area.
As pointed out in the Planning Department's report, any significant
improvements to a property will enhance adjoining property values and
since my property is separated only by a 30 ft. public use area from
the property formerly owned by Wolf, referred to above, it follows that
my property as well as all other surrounding properties could have
benefitted had Wolf continued. It would seem that due to the requirements
imposed upon that property to bring the existing structure up to
current "building codes" have defeated their own purpose, as Wolf
abandoned his project on Index Avenue, sold the property and it now sits
there among the other postwar structures succumbing to the "premature
decay and obsolescence" referred to in the Planning Department's
Preliminary Report, Paragraph 08 of File No. R-235-78.
A contrasting situation has occurred only a few blocks away (corner
of 12th & Harrington), where a property similar to mine existed.
Currently under construction is an 18 unit 3 story apartment building
where a maximum density situation is being created. Perhaps there is
a middle ground where existing structures can, and should be upgraded
to protect the lifestyle and environment of the neighborhood from each
of the extremes noted above. By making the existing structures comply
with current "housing codes" and not the severe requirements of the
building codes" myself and other owners of these buildings could
then afford to upgrade our properties to .suitable standards.

Council Councilman Stredicke inquired as to obtaining a picture of ,
Picture the present council as done previously.Mayor noted funds were not
in the budget and council would have to purchase their own
picture. MOVED BY THORPE, SECOND PERRY THAT PICTURES BE TAKEN
OF THE COUNCIL AND THE MAYOR ON THE SECOND WEEK IN JANUARY OF
EACH YEAR AND THAT SUBJECT BE REFERRED TO THE WAYS AND MEANS
COMMITTEE FOR FUNDING THIS YEAR AND BE CONTAINED IN THE BUDGET
IN FUTURE YEARS. CARRIED.
New Fire Councilman Stredicke inquired as to the completion date of the
Station new fire station and occupancy date of the old fire station.Mayor
Delaurenti noted possible completion of new station about
mid-February with the contactor having definite information
shortly,and occupancy of the old station would be about the
same time. Councilman Stredicke also noted that Burlington
Friends of Northern will be delivering 150 railroad ties to the Friends
Youth of Youth to help in the landscaping work they are doing.
Crosswalk at Councilwoman Thorpe noted need for an additional crosswalk
Rainier Ave,. at Rainier Ave. and Grady Way. Warren Gonnason, Public Works
and Grady Way Director, noted previous recommendation not to install an
additional crosswalk due to conflicting traffic movements.
Following discussion it was moved by Thorpe, second Stredicke
council direct the administration to install crosswalk at
Rainier Ave. and Grady Way. SUBSTITUTE MOTION BY SHINPOCH,
SECOND PERRY TO REFER TO THE TRANSPORTATION COMMITTEE FOR
STUDY. ROLL CALL: 4-AYE: SHINPOCH, PERRY, CLYMER, TRIMM;
3-NO: STREDICKE, THORPE, SHANE. MOTION CARRIED.

Subdivision recommendations of an "exception" not be required to determine
Regulations- placement of sidewalk, that the sidewalk location and any other
Cont. technical design considerations be determined by the Technical
Review Committee or the Public Works Director; allow the option
to the developer of either vertical curb and gutter sections or
rolled curb and gutter on streets within a subdivision classified
as access streets; eliminate the requirement for piecemeal off-
site improvements on arterials where the subdivision access is
through the interior streets, thus eliminating the need for double
frontage improvements be referred to the Planning and Development
Committee for study and recommendation. The Commitee also
recommended the matter to consider policy on burning for land
development consistent with the policy now in effect by King
County be referred to the Public Safety Committee. MOVED BY

Larry Howe Planning and Development Committee Chairman Perry presented —
Rezone and memorandum that the Committee had considered a request for ..
Appeal appeal filed by Mr. Larry Howe. (Rezone File R-235-78) The
R-235-78 committee found that Mr. Howe was misinformed to his detriment
by members of the city staff. Based on the extenuating
circumstances the Committee recommended that the appeal should
not be dismissed and recommends that the matter be referred
by the Council to the Planning and Development Committee for
consideration of the matter on the merits. Memo also included
letter from Rick Beeler, Hearing Examiner, regarding the
Larry Howe request for rezone. It noted that recommendation
was issued on November 9, 1978 and the normal 14-day appeal
period expired on November 23, 1978. However, due to the
Thanksgiving holiday the period was extended to November 27,1978
when. Mr. Beeler spoke with Mr. Howe on November 27, 1978 he
inadvertently forgot the extension of the normal appeal period.
