E . PHYSICAL BACKGROUND :
1 . Topography : Relatively level with only slope rising east-west
at southwest corner of property .
2 . Soils : Alderwood gravelly sandy loam (AgC ) . Permeability
is moderately rapid in the surface layer and subsoil . Runoff
is slow to medium and the erosion hazard is moderate . This
soil is used for timber, pasture , row crops , berries and
urban development . Ragnar- Indianola association , sloping
RdC ). Slopes are 2-15%. Permeability is moderately rapid
to rapid ; runoff is slow to medium and the erosion hazard is
slight to moderate . This soil is used for timber and urban
development .
3 . Vegetation : The subject site includes scrub grass and black-
berries together with a significant stand of Douglas Fir and
other evergreens .
4 . Wildlife : Existing vegetation on the site may provide suitable
habitat for birds and small mammals .
5 . Water : A small stream flows through the middle portion of the
property in an east-west di ,'ection . This stream ultimately
becomes part of the Honeycreek/May Creek drainage system.
5 . Land Use : The site consists of two single family dwellings
in the northwest portion and undeveloped land in the remainder .
F . NEIGHBORHOOD CHARACTERISTICS :
The area consists of a variety of land uses . Commercial uses
oriented towards the intersection of Sunset and Duvall . Multi -family
uses are located to the north, south and southwest of the subject
site with low density single family residences interspersed along
along Sunset Blvd . The area can be considered in a growth
transitional area from single family residence to higher intensity
uses , principally due to the influence of the major arterials .
Existing platted single family residential areas are located
generally south and west of the subject site .
G . PUBLIC SERVICES :
1 . Water and Sewer : A 12" water main exists along Sunset
Blvd . N . E . together with a 12" sewer main and a 12" storm
sewer.
2. Fire Protection : Provided by the Renton Fire Department as
per Ordinance requirements .
3 . Transit : Metro Transit Route #107 operates along Union
Avenue N . E . and N . E . 12th Street within 2 mile to the west
of the subject' site .
4. Schools : The site is within 1 mile of Honeydew and Sierra
Heights ELementary Schools and within 2 miles of McKnight
Junior High School and within 4 mile of Hazen High School .
5 . Parks : The subject site is within 1 mile of Kiwanis Park
and within 1 mile of the proposed King County park west of
Sierra Heights Elementary Schools .

C . PURPOSE OF REQUEST :
To provide the zoning consistent with development of a fast
food restaurant and an additional commercial use to be developed
later .
D. HISTORY/BACKGROUND :
The subject site was annexed into the City by Ordinance #2408
dated May 27 , 1968, at which time the existing G zoning was applied .
The site was within a general area which was the subject of a
Comprehensive Plan amendment on March 9 , 1977 by Ordinance #3112 .
The property adjacent to the easterly boundary was rezoned from
G" to B-1 and R-2 by Ordinance #3152 dated August 15 , 1977 .

3 . The subject property is a portion of a larger zoned
area which currently provides a separation of ' B-1 zoned
parcels at Duvall and Sunset , from similar B-1 zoned parcels
at Union and Sunset. To the north and south are existing
developed R-3 parcels . To the east and southeast are vacant
R-2 and SR ( King County) residence areas . To the extreme
southeast is Hazen High School . The Comprehensive Plan
identifies "minor retail centers or neighborhood shopping
districts will be located near the perimeters of several
neighborhoods and at the intersection of major roads and
and arterials . " ( Emphasis added ) (Land Use Report , 1965 ,
Commercial , page 11 . ) Approval of the subject rezoning
would conflict with this goal in that it would create a
continuous strip of commercial activity from west of Union
Avenue N . E . to east of Duvall Avenue N . E . Such strip
commercial development would encourage small scale commercial
uses inviting numerous driveways , high traffic circulations
and increased turning movements . This situation would appear
to directly conflict with the Arterials and Streets Plans
Objectives (page 3 ) :
a . Provision for safe , efficient and covenient movement
of peoples and goods . "
b . Arterial ---patterns---complimentary to the general land
use plan . "
c . Adequate and safe access--- (for ) efficient utilization . "
4 . The Comprehensive Plan clearly indicates a separation
of land uses in this area including buffers between commercial
uses and between commercial and single family areas . The subject
property is identified as being for Medium Density Multiple
Family or R-3 zoning . The R-3 District would provide
for approximately 110 dwelling units on the subject site .
5 . The land use designation of Medium Density Multiple Family
appears to be consistent with policy statements of the
Comprehensive Plan , including " In medium and high density
residential use districts---other compatible uses may include---
shopping districts and other functions which are not
detrimental to the maintenance of desirable living conditions . "
Land Use Report , 1965 , Residential , page 11 ) .
6 . It should also be noted that the Comprehensive Plan states
that residential uses provide for preservation of "natural
features and amenities--- (which ) should be utilized to best
advantage for the use and benefit of the community. " (Land Use
Report , 1965 , Residential , page 11 . ) The site with its
centrally located stream and interior stands of firs lends
itself to a well designed residential use. Preservation of
the stream and vegetation is crucial to the attainment of
the highest and best use of the site.
7 . The Fire Department indicates that the proposed use must
meet fire flow hydrant location and. access requirements of
the Department.
8 . The Engineering Division has noted that upon future
development that Anacortes Avenue N . E . must be improved and
dedicated and that storm water retension and clean-up of
Honeydew Creek is required .
9 . Other departmental comments are attached for consideration .

J . IMPACT ON THE NATURAL SYSTEMS :
Rezone of the subject site will not have a direct impact upon
the natural systems . However, future development of the site
will disturb soil , vegetation and the stream, increase storm
water runoff and have an effect on traffic and noise levels
in the area . Through proper development controls and procedures
these impacts can be mitigated , however .
K. SOCIAL IMPACTS :
The proposed rezoning to commercial will provide for those
interactions associated with commercial uses . If the
Comprehensive Plan designation of medium density multiple family
is followed , new neighborhood interactions , friendships , and social
ties will eventually take place.
L. .ENVIRONMENTAL ASSESSMENT/THRESHOLD DETERMINATION :
Pursuant to the City of Renton ' s Environmental Ordinance and the
State Environmental Policy Act of 1971 , as amended , RCW 43-21C ,
a declaration of non-significant impact has been issued for the
rezoning only. , This declaration is based upon preservation
of significant trees and incorporationof the existing creek into
future development plans in a manner satisfactory to its natural
character.

N . PLANNING DEPARTMENT ANALYSIS :
1 . The subject proposal is for rezoning from G (Single Family)
to B-1 (Business ) in an area shown on the land use element
of the Comprehensive Plan for Medium Density Multiple Family .
2 . The subject area was reviewed as a part of the 1976
Comprehensive Plan amendments for which the medium density
multiple family designation of the subject was retained . The
specific comprehensive plan amendment related to the
property to the east now developed as the Central Highlands
Ernst-Albertson ) . The Land Use Committee of the Planning
Commission considered five ( 5) basic land use alternatives for
the properties generally between Union Avenue N . E . and Duvall .
Avenue N . E. The Committee concluded that without a more
comprehensive approach that it would concentrate on Sunset
and 'Duvall , however , the Committee ' s recommendation clearly
identifies a Medium Density Multiple Family separation between
those commercial uses generally at Sunset and Duvall , and the
commercial uses generally at Sunset and Union . The Committee ' s
recommendation was adopted by the Planning Commission and
ultimately by the City Council .

Based upon the foregoing analysis , approval of this proposed
rezoning be to R-3 , Medium Density Multiple Family and subject
to the following. conditions :
1 . In order to preserve the natural amenities for incorpora-
tion into overall residential development , plans for clear-
ing or grading shall be approved by the Planning and Public
Works Departments .
2. To the maximum extent possible , and to the approval of the
Planning and Public Works Departments , Honey Dew Creek
shall be retained in its natural state and incorporated as
an amenity in the total development plan for the site .

site with low density single family residences interspersed along
along Sunset Blvd . The area can be considered in a growth
transitional area from single family residence to higher intensity
uses , principally due to the influence of the major arterials .
Existing platted single family- residential areas are located
generally south and west of the subject site .

D. HISTORY/BACKGROUND :
The subject site was annexed into the City by Ordinance #2408
dated May 27 , 1968, at which time the existing G zoning was applied .
The site was within a general area which was the subject of a
Comprehensive Plan amendment on March 9 , 1977 by Ordinance #3112 .
The property adjacent to the easterly boundary was rezoned from
G" to B-1 and R-2 by Ordinance #3152 dated August 15 , 1977 .

3. The subject property is a portion of a larger G zoned
area which currently provides a separation of B-1 zoned
parcels at Duvall and Sunset , from similar B-1 zoned parcels
at Union and Sunset . To the north and south are existing
developed R-3 parcels . To the east and southeast are vacant
R-2 and SR ( King County) residence areas . To the extreme
southeast is ilazen High School . The Comprehensive Plan
identifies "minor retail centers or neighborhood shopping
districts will be located near the perimeters of several
neighborhoods and at the intersection of major roads and
and arterials . " ( Emphasis added ) (Land Use Report , 1965 ,
Commercial , page 11 . ) Approval of the subject rezoning
would conflict with this goal in that it would create a
continuous strip of commercial activity from west of Union
Avenue N . E . to east of Duvall Avenue N . E . Such strip
commercial development would encourage small scale commercial
uses inviting numerous driveways , high traffic circulations
and increased turning movements . This situation would appear
to directly conflict with the Arterials and Streets Plans
Objectives (page 3 ) :
a . Provision for safe , efficient and covenient movement
of peoples and goods . "
b . Arterial ---patterns---complimentary to the general land
use plan . "
c . Adequate and safe access--- ( for) efficient utilization . "
4 . The Comprehensive Plan clearly indicates a separation
of land uses in this area including buffers between commercial
uses and between commercial and single family areas . The subject
property is identified as being for Medium Density Multiple
Family or R-3 zoning . The R-3 District would provide
for approximately 110 dwelling units on the subject site .
5 . The land use designation of Medium Density Multiple Family
appears to be consistent with policy statements of the
Comprehensive Plan , including " In medium and high density
residential use districts---other compatible uses may include---
shopping districts and other functions which are not
detrimental to the maintenance of desirable living conditions . "
Land Use Report , 1965 , Residential , page 11 ) .
6 . It should also be noted that the Comprehensive Plan states
that residential uses provide for preservation of "natural
features and amenities--- (which ) should be utilized to best
advantage for the use and benefit of the community . " (Land Use
Report , 1965 , Residential , page 11 . ) The site with its
centrally located stream and interior stands of firs lends
itself to a wc.-, 1 designed residential use . Preservation of
the stream anc vegetation is crucial to the attainment of
the highest and best use of the site .
7 . The Fire Department indicates that the proposed use must
meet fire flow hydrant location and. access requirements of
the Department.
8. The Engineering Division has noted that upon future
development that Anacortes Avenue N . E . must be improved and
dedicated and that storm water retension and clean-up of
Honeydew Creek is required .

the natural systems . However, future development of the site
will disturb soil , vegetation and the stream , increase storm
water runoff and have an effect on traffic and noise levels
in the area . Through proper development controls and procedures
these impacts can be mitigated , however .

The proposed rezoning to commercial will provide for those
interactions associated with commercial uses . If the
Comprehensive Plan designation of medium density multiple family
is followed , new neighborhood interactions , friendships , and social
ties will eventually take place.
L . ENVIRONMENTAL ASSESSMENT/THRESHOLD DETERMINATION :
Pursuant to the City of Renton ' s Environmental Ordinance and the
State Environmental Policy Act of 1971 , as amended , RCW 43-21C ,
a declaration of non-significant impact has been issued for the
rezoning only. This declaration is based upon preservation
of significant trees and incorporation of the existing creek into
future development plans in a manner satisfactory to its natural
character.

1 . The subject proposal is for rezoning from G (Single Family)
to B-1 ( Business ) in an area shown on the land use element
of the Comprehensive Plan for Medium Density Multiple Family .
2 . The subject area was „reviewed as a part of the 1976
Comprehensive Plan amendments for which the medium density
multiple family designation of the subject was retained . The
specific comprehensive plan amendment related to the
property to the east now developed as the Central Highlands
Ernst-Albertson ) . The Land Use Committee of the Planning
Commission considered five ( 5) basic land use alternatives for
the properties generally between Union Avenue N. E . and Duvall
Avenue N . E . The Committee concluded that without a more
comprehensive approach that it would concentrate on Sunset
and Duvall , however , the Committee ' s recommendation clearly
identifies a Medium Density Multiple Family separation between
those commercial uses generally at Sunset and Duvall , and the
commercial uses generally at Sunset and Union . The Committee ' s
recommendation was adopted by the Planning Commission and
ultimately by the City Council .

A. SUMMARY OF REQUEST :
The applicant ' s initial application was for a rezone from G
to B- 1 to permit future commercial development of the subject
site . The applicant requested continuances of this public
hearing to discuss with staff alternatives to the original
application . On February 6 , 1979 , Western Pacific Properties
agents for the applicant ) submitted a letter proposing to
amend the application to reduce the area from the original
four ( 4 ) acres (total parcel ) to one ( 1 ) acre at the north-
east corner. A copy of the letter and attachments are
attached to this report .
B . PLANNING DEPARTMENT ANALYSIS :
1 . We have reviewed the applicant ' s request for amendment
to the original application . Although this amendment
reduces the potential conflicts with the Comprehensive
Plan , we still do not feel that there is adequate justi -
fication for the applicant ' s proposed rezoning to B- 1 .
2 . The proposed reduction in the B-1 zoned area will be
more in line with the Comprehensive Plan ; however , the
proposal still reduces the non-commercial frontage on
Sunset Boulevard by approximately one-third . Based
upon the specific Comprehensive Plan analysis done for
the Ernst/ Pay ' n Save Shopping Center just to the east
of this site , it appears that the multiple family separa-
tion along Sunset Boulevard should be retained to achieve
the intent of the Comprehensive Plan to not create a con-
tinuous commercial strip .
3 . Previous Comprehensive Plan ' amendment for the vicinity
of Sunset and Duvall indicated approximately twenty ( 20 )
acres of commercial use area . At this time approximately
60% of this area remains vacant . The applicant ' s proposal
to extend the commercial area does not appear to be con-
sistent with the existing conditions , and no justifica-
tion has been presented to substantiate the need for
additional commercial zoning .
4 . Should commercial zoning be extended west of Anacortes ,
the remainder of the property should be zoned R-3 and a
significant landscape buffer be provided ( 25 ' to 50 ' )
separating the commercial and residential uses .
5 . We have reviewed the specific site development plans pro-
posed for the intended use of the property - a McDonalds
Fast Food Restaurant . The plans do not adequately address
minimum requirements for separation of the commercial use
from future residential use .
RECOMMENDATION :
Based upon the previous analysis contained in our report of Janu-
ary 23 , 1979 , if the Hearing Examiner proposes to rezone the
property , our recommendation would be to R-3 , Medium Density Mul -
tiple Family . As indicated in the foregoing analysis , the appli -
cant does not , in our view, adequately justify the proposed
extension of commercial property outside of the twenty (20 ) acre
area designated on the Comprehensive Plan . If commercial zoning is
allowed west of Anacortes Court, a minimum 25 ' - 50 ' landscape
separation should be required between the commercial and residential
uses .

Anton A. and Millie Althoff Application for Rezone
The driveway access to said site would be more or less directed to
Anacortes Ave. NE and not to NE Sunset Blvd. This would help lessen the
impact of turning vehicles on and off the major arterial, which is Sunset
Blvd. in this area.
I can see no conflict with this type of development in the area. We will
require the right-of-way on the west side of Anacortes be dedicated to
the City of Renton as per previous comments.
Gary L. and Barbara J. Carner Application for Waiver of Off-Site Improvements
Regarding off-site improvements on Talbot Road South, they should be
installed as per ordinance for off-site improvements. This area is at
the present time being developed at a fairly rapid pace with curbs,
gutters and sidewalks and storm drainage. This would be to the benefit
of the general public due to reasons of health, safety and welfare.
Dean W. Bitney Application for Rezone
Item N4 Planning Department Analysis, Preliminary Plat Approval, 5-foot
sidewalks would be required as per the ordinance. They would have to be
installed unless a variance was allowed. Item N8, right-of-way along the
westerly side of Union Ave. SE would have to be dedicated to the City of
Renton and full off-site improvements installed thereon.

The Examiner advised the applicant that conformance to submitted site and landscaping plansmayberequiredifincludedintherezonefile, and inquired if the applicant preferred
withdrawing the plans or entering the plans with the understanding that they are• conceptualincontent. Mr. Clemens indicated that although the applicant may wish to address the
matter in subsequent testimony, he felt that review of the conceptual site plan was
necessary due to its importance, in justification of the proposed rezone. The applicant
agreed that the plans could be reviewed conceptually, and they were entered as follows:

Mr. Clemens referred to a letter attached to Exhibit #2 received from the applicant which
requests application amendments to reduce the rezone of B-i to one acre in lieu of the
previous proposal to rezone the entire four-acre parcel. The letter was entered into
the record as follows by the Examiner:

Mr. Clemens advised that clarification of the word, "narrative," contained in.Exhibit #9
had been received from the applicant to refer to conceptual site and landscaping plans.
He .noted the preference of the Planning Department to discuss the entire property duringtherezonehearinginsteadoftheone-acre parcel requested by the applicant. Mr.
Clemens submitted the following letter from the Public Works Department into the record:

Exhibit #10 recommended that access to the site be directed to Anacortes Avenue N.E.
instead of Sunset Boulevard, and required dedication of right-of-way on the west side

The Examiner asked the applicant if he concurred in Exhibits #1 and 2. Responding was:

Mr. Brown indicated nonconcurrence in recommendations contained in the reports.
Referencing Exhibit, #10, he advised that dedication of the right-of-way has already
occurred, and remaining requirements by the Public Works Department include installation

Mr. Brown supported approval of the rezone of the northeast portion of the property to
B-1 to provide logical extension Of already existing commercial use east of the site. in
relationship to Sunset Boulevard, a state highway. He reported that demographic figures
indicate a. three-mile population of 55,000 and a• five-mile population of 110,000 from
the subject property. Mr. Brown advised the original choice of development site located
at the northeast corner of Duvall and Sunset Boulevard was unacceptable due to receipt
of information from the Public Works Department that sewers would not be available at
the site and a septic tank would not be allowed; and the subject site was subsequently
determined appropriate for the proposed development. Mr. Brown clarified the intent of
the amendment to the application to reduce' the size of the B-1 zoned property to one
acre at the northeast corner and the remainder of the property to R-3 zoning. He
reviewed the current demand for commercial property to accommodate retail shops, food
service business, savings and loan institutions, arid banks. Mr. Brown felt the adjacency
of the proposal to the existing shopping center On the corner of Duvall and Sunset
Boulevard would provide compatibility with the proposed use by McDonald's Corporation
on the. subject site and create less impact upon utilities .than multifamily residential
use. He also'' advised willingness of the corporation to enter into a 25-year lease
contract with option for an additional 25-year lease which would ensure stability of
use in the area.
Mr. Brown questioned the desirability of locating residential units directly on a primary
state highway with a traffic volume of 20,000 vehicles per day. While he' agreed with
the intent of th:e: Comprehensive Plan to- provide a buffer between commercial development,
he objected to the location of the buffer on the applicant's property which negatively
impacts its development potential. Mr. Brown emphasized that the potential user of the
property had 'indicated willingness to restrict access onto Anacortes Avenue N.E. in
order to comply 'with the intent of the Comprehensive Plan to discourage provision of
numerous driveways onto a major arterial. He noted that at the time the Comprehensive
Plan amendment'was adopted, the existing shopping center at the corner of Sunset and

PUBLIC HEARING: After reviewing the Planning Department report, 'examining
available information on file with the application, and
field checking the property and surrounding area, the
Examiner conducted a public hearing on the subject as
follows:
The hearing was opened on January 23, 1979 at 9:25 a.m. in the Council Chambers of the
Renton Municipal Building. David Clemens, Associate Planner, advised receipt of a
request for continuance from the applicant, and the hearing was subsequently continued
to 9:00 a.m. on February 6, 1979.
CONTINUANCE:
The hearing was opened oh February 6, 1979 at 9:00 a.m. in the Council Chambers of the
Renton Municipal Building. David Clemens, Associate Planner, indicated that'a second
continuance had been requested by the applicant to allow review and possible revision
of the application. The hearing was subsequently continued to 9:00 a.m. on February 27 ,
1979.
CONTINUANCE:
The hearing was opened on February 27, 1979 at 9:00 a.m. in the Council Chambers of the
Renton Municipal Building.
Parties wishing to testify were affirmed by the Examiner.
It was reported that the 'Hearing Examiner and the applicant had received and reviewed
the Planning Department report, dated January 23, 1979, ' and the subsequent addendum,
dated February 27, 1979. The reports were entered into the record as Exhibits #1 and 2,
respectively.
David Clemens, Associate Planner, reviewed Exhibits #1 and 2; and entered the following
additional exhibits into the record:

Mr. Clemens advised that-'Exhibit #3 was the, result of specific Planning Commission and
City Council action regarding commercial uses of the' area in question; and the amendment
of the Comprehensive Plan had been approved on March 9, 1977 by adoption of Ordinance
No. 3112.•
Mr. Clemens .indicated receipt of site and landscaping plans submitted by the applicant.

3. Pursuant to the City of Renton's Environmental Ordinance and the State Environmental
Policy Act of 1971, as amended by R.C.W. 43`.21.C. , a Declaration of Non-SignificancehasbeenissuedforthesubjectproposalbyGordonY. Ericksen, responsible official
based upon preservation of significant trees and incorporation of the existing
creek into future development plans in a manner satisfactory to its natural character. "
4. Plans for the proposal have been reviewed by all city departments affected by the
impact of this development.
5. There was no opposition to the proposal expressed.
6. All existing utilities are available and in close proximity.
7. The Comprehensive Plan amendment completed in March of 1977 (Exhibit #3) appears to
have specifically considered whether or not the commercial designation on the Land
Use Map should be extended westward across Anacortes Avenue N.E. to include the
subject property. Review of the record of this amendment indicates that consideration
was given by the City Council and. Planning Commission of buffering commercial
designations by medium density multifamily uses (Exhibit #4) . Some assumptions were
made at the beginning of analysis of the amendment, but the testimony has not claimed
or documented that these assumptions have changed relative to the subject application
Section 4-3014. (A) ) .
8. The Comprehensive Plan Land Use Map (Exhibit #4) indicates the property to potentially
be Medium Density Multifamily Residential (Section 4-3014. (B) ) .
9. Testimony did not address whether or not significant improvements in the area have
occurred since the 1977 land use analysis (Section 4-3014. (C) ) .
CONCLUSIONS:
1. The proposed B-1 zoning does not .appear to conform to the Comprehensive Plan Land Use
Map; however, the map is not intended to be a "blueprint" for development but a
general guide (page 2, Section 2, Comprehensive Plan, Renton Urban Area, July, 1965,
and Ordinance No. 2142) . The more specific goals and objectives of the Comprehensive
Plan apply but are not abundantly clear regarding this application. Upon considering
together the Land Use Map and goals and objectives it seemed that the map is an
accurate interpretation of the goals and objectives of the Comprehensive Plan.
Sufficient direction exists in the' Comprehensive Plan to support reclassification of
the entire property to R-3 (Section 4-3014. (B) ) .
Demographic information and the'.proximity of the northeast one acre of the total
property (that proposed for B-1) to the adjacent Central Highlands Plaza (Ernst-
Malmo, Pay 'n Save, and Albertons) and southerly R-3 development seem to adequately
indicate that a fast-food restaurant might do well at that location. But this
locational criteria is not actually contained in the Comprehensive Plan for consideration
by 'the Examiner. Land use control and land use principles are essentially the concern
in reviewing zoning changes.
Not at issue is the existing Central Highlands Plaza Shopping Center and the commercial
node that has developed at the intersection of Duvall Avenue N.E. and N.E. Sunset
Boulevard. This is the existing situation adjacent to the subject property. The
issue is whether or not the proposed one acre of B-1 is an appropriate expansion of
this shopping center node.
Although commercial uses are appropriate at this general location, 'B-l 'zoning of the
subject site would not be an appropriate expansion of the, Central Highlands Plaza
shopping area and commercial node since this would not produce a ". . .consistent and
orderly development pattern." (pages 6 and 7, Section F. , Comprehensive Plan, Renton
Urban Area Report, July, 1965, and page 11, Commercial, Comprehensive Plan, Land Use
Report, July, 1965) . . Such zoning would not at this time constitute ". . .appropriate
use of land. . .proper. . .land use principles, and. . .coordinated development of
undeveloped' areas." (page 9 and 10, Summary, Renton Urban. Area Report) . The
appropriate ". . .growth patterns. . . " are less intensive use than B-1 in the ". . :best
interest of the community and. . .its overall attractiveness and desirability. .'. "
page 17, Objective No. 1, and page 18, Objective No. 6, Land Use Report) .
The multifamily zoning that is developed north of the site and .across N.E: Sunset
Boulevard should be carried southerly and across the site to connect with the multi-
family zoning south of the site. This implements the Land Use Map and is an
appropriate use of land. . .land use principles and. . .coordinated development of •
undeveloped areas." (page 9, Summary; Renton Urban Area Report) . Multifamily isappropriateatthislocation (page 11, Residential Land Use Report) . Prevention of
incompatible. . . " strip commercial development and prevention of ". . .premature
decay. . ." would. occur in an ". . .orderly growth pattern." (page 17, Objective No. 1,

Duvall was 'not constructed or anticipated, and the proposal bears a natural relationship
to the pedestrian and traffic flow which is currently generated by the large commercial
center.
Mr: Brown.advised that although 'the city has indicated that 60% of properties designated
for commercial use are still undeveloped, there are' few actual available sites in the
vicinity due to encumbrances by utility lines and other factors.
The Examiner requested testimony in support or opposition to the request. . There was no
response. Mr. Clemens advised that the Comprehensive Plan amendment, Exhibit #3,
specifically occurred to 'provide for development of the shopping center on Sunset. and
Duvall, noting that the applicant was the developer of the property. Referring to
Exhibit #4, he designated potential commercial use prior to adoption of the amendment
which originally ,included a portion of the northeast section of the subject site.
Mr. Brown inquired regarding designation of potential zoning on the Comprehensive• Plan
prior to adoption. of the' amendthent. Mr. Clemens indicated that it would appear that the
previous -Comprehensive Plan designated an oblong-shaped piece of commercial property.
which included part of the northeast corner of the. subject property, although the entire
parcel had been zoned "G" since annexation.., Mr. Brown indicated his opinion as a result
of reviewing the Comprehensive Plan and contacting various staff members that the frontage
of the subject site provides good potential for commercial use. He inquired if ,the
property owner was sufficiently apprised of the public hearings regarding the Comprehensive
Plan amendment' in ,the area. Mr. Clemens indicated that required legal publications had
appeared in the newspapers although further review would be required to determine, if
individual letters .to property owners had been sent. He noted that a petition containing
17 signatures and a number of letters had been received from property owners in the. area
supporting commercial development on Sunset Boulevard. The Examiner advised that although
sufficiency Of public notice was hot a subject of the public hearing; it appeared .that
legal requirements had been met by the city.
Mr. Brown reiterated his. opinion _that the purpose of the Comprehensive Plan is to provide
a general guide to development and reflects,,,the general needs of the people at the time
of. adoption. He felt. that development of the shopping center on Sunset Boulevard impacts
the potential development of the subject site in its related proximity, and since
commercial use had at one time been designated on the Comprehensive Plan, such use would
be appropriate.
The Examiner referenced 'Section L." (Environmental Assessment/Threshold Determination) of
Exhibit #1, which states that a declaration of non-significant impact has been issued
for the rezoning only, and•inquired if' receipt of the site and landscaping plans would •
eliminate the need for further environmental review. Mr. Clemens indicated that although
the subject of.'preservation of trees had been addressed' in 'the proposal, the question of
incorporation of the, existing creek into future development plans would require further
review at the .time of development; although he noted that the declaration of non-
significance would not be crucial in review of that issue.
The ,Examiner referenced Section N.2 (Planning Department Analysis)' of Exhibit #1, regarding,
Comprehensive Plan review 'of the general area, and inquired if the amendment specifically
considered the subject site and whether or not commercial use should extend west of
Anacortes Avenue N.E. Mr. Clemens responded affirmatively.
The Examiner requested_a final recommendation from the Planning Department representative.
Mr. Clemens indicated that the recommendations contained in' Exhibits' #1 and 2 would remain
as presented.
The Examiner requested further comments:. Since there were none, the hearing on File'No.
R-272-79 was closed' by the Examiner at 10:05 a.m. •
FINDINGS', CONCLUSIONS & RECOMMENDATIONS: Having reviewed the record in this matter, the
Examiner now makes and enters the following:
FINDINGS:
1. The request is for reclassification of 3.82 acres of "G" zoned property to one acre
of B-1 and 2.82 acres of R-3 property. A fast food restaurant is proposed on the B=1
property.
2. . The Planning Department report accurately sets forth the issues, applicable policies
and provisions, findings of fact, and departmental recommendations in this matter, and
is hereby attached as Exhibit #1 and incorporated in this report by reference 'as set
forth in full therein.

Land Use Report) . • Multifamily zoning of R-3 would be an ". . .effective control of
land use. . ."• and ". . .promote the best interest of the community and contribute to
its overall attractiveness and desirability. . ." (pages 17 and 18, Objectives No. 4
and 6, Land Use Report) .
2. The Planning Commission and City Council in approving the 1977 amendment to the
Comprehensive Plan (Exhibits #3 and 4) were concerned about the potential of strip-
commercial development occurring between Union Avenue N.E. and Duvall Avenue N.E.
along N.E. Sunset Boulevard. A commercial node exists at both intersections with
transitional commercial, and various uses occurring in between. To separate the ,
two nodes a buffer of Medium Density Multifamily Residential land use was placed
upon the Land Use Map directly across the subject site.
While the merits of this action are not the subject of this public hearing, it is
clear that'almost two years ago the policy-making body responded to concerns and
exercised land use principles and planning. Testimony did not assert or document
that public or private improvements in the area have occurred since, then and impacted
the subject site sufficiently to warrant reclassification of the site to anything
beyond R-3 (Section 4-3014. (C) ) .
3. Due to the concern of the Planning Commission and City Council regarding potential
strip-commercial development along N.E. Sunset Boulevard in this area (Exhibit #3)
a reasonable conclusion is that during their. discussions and public ,hearings potential
future .request for reclassification to B-1 of the subject site' was considered, however
slightly. Additional study of land use in the area was recommended; but their
opinion appeared to be that commercial development was not appropriate for the. subject
site. . The Comprehensive Plan goals and objectives seem to support their action
Section 4-3014. (A) ) .•
4. Honey Dew Creek running through the property should be protected and incorporated
into development plans on the site. This natural feature will enhance ".:. .community
livability. . ." for prospective residents of the site. (page 17, Objective No. 2,
Comprehensive Plan, Land Use Report, July, 1965) . However,• the existing condition
of the creek on the property indicates that additional study of the attractiveness
and interface with other properties is needed prior to requiring that it.be retained.
Another natural feature of the subject site is the substantial trees that exist.
For the aforementioned reasons, these trees should be retained as much as possible
for integration into the development.
RECOMMENDATION:
Approval of R-3 subject to retention of the existing substantial trees and Honey Dew
Creek if possible and desirable upon review of specific site development.

findings, we are looking for your reconsideration of the following:
A) Ommission of Fact:
1) The fact was never brought up, but you can see, per the
attached comprehensive plan map, part of the property is
already designated for B-1- zoning. Applicant's request
for B-1 to the opposite corner of the property'was to
accomplish a more natural and orderly development in this
area.
2) This particular section of property that applicant is
requesting B-1 zoning for, wass \used until 1970 as a gas
station site for Gilmore PetrdlNm Co.
B) Misunderstanding of Judgement:
1) It is hard for the applicants to understand that if part_
of the property is comprehensively zoned B-1 and, that
there was no public opposition, why couldn't the rezone
be accomplished?

The Comprehensive Plan Land Use Map does in fact indicate that a very ' •
small corner of the northwesterly portion of the property might be _ •
suitable for commercial uses This was not mentioned in the recommendation
due to minor consequence of this inclusion by the very broad and generalized
map designation boundaries The corner of commercial was viewed as not
actually providing direction to rezone the property to B-1, but to indiCate,
withLthe remainder of the generalized commercial area on the map west of .
the Site, that should serve as a .buffer between' the' DuvailAVenUe
N,E )and Union AvenUell.E. commercial nodes or areas Since the map, as-
stated in Conclusion NO. 1 of the recommendation, is a general •guide, - it ,
was applied in this manner to define, through the rezone process and . .
application of the Comprehensive Plan goals and objectives,. that Medium
Density MUlti-faMily Residential, not Commercial, is the precise land use
that should 'occur on the site. .
Regarding your statement that the site was at one time used for a service
station, the record does not corroborate this information. Although •
assumed correct, this information was ". . .reaeonably available. . ." 'at the
hearing, and therefore, per Section 4-3015, is not justification for
keconsidering' the• recOmmendatiOn. In any case, since the station no
longer exists since 1970, its absence (Ides not appear to have bearing
uPonthe rezone application. . . .
Finally,Ithe .question of the basis for granting a' rezdne is contained in
Section 4-3014, which-Vere-re'ad at the beginning of the Examiner's public
hearing of:February 27, 1919.

Pursuant to our meeting of February 27, 1979 and ouvreview.of the
findings, we are looking for your reconsideration of the following:
A) Ommission of Fact:.
1) The fact was never brought .up, but you can ,see, per the
attached comprehensive plan map, part of the property is
already designated for B-1 zoning. Applicant's request
for B-1 to the opposite corner of the property was to
accomplish a more natural and orderly development in this
area.
2) This particular section of the property that applicant is
requesting B-1 zoning for, was used until 1970 as a gas
station site for Gilmore Petroleum Co.
B) Misunderstanding of Judgement:
1) It is hard for the applicants to understand that if part
of the property is comprehensively zoned B-1 and that
there was no public opposition, why couldn't the rezone
be accomplished?

under B-1 zoning is an appropriate expansion -of th.e commercial node at the' intersectionofDuvallAvenueN.E. and N:E. Sunset Blvd: and will produce .consistent, orderly and
coordinated development patterns in these undeveloped areas in the best interest ofthecommunity, its overall attractiveness and desirability. .,
3. Conclusion No. 1, paragraph 5, 'is in error in that the multi-family zoning that hasdevelopednorthofthesiteandacross" N.E. Sunset Blvd. should not be carried southerlyandacrossthesitetoconnectwithmulti-family zoning to the south in order to preventincompatibledevelopmentsina, disorderly growth pattern. ,
4. Conclusion No. 2, paragraph 2, .is incorrect in that testimony was clear that public
or private improvements in• the,area -..have occurred, since the, 1977 land use analysis
which have impacted the subject site sufficient to-warrant: reclassification pursuantto• Section 4-3014C.

5. Conclusion No. 3 is in error as mere -conjecture of the concern =regarding potentialstripcommercialdevelopment.
The Committee recommends that the above stated findings of error should be incorporated :into the decision of the Hearing Examiner dated March 6, 1979, and that the recommendationbeamendedtoreadasfollows:
Approval of B-1 zoning for- the one acre parcel" in the northeast corner
of the subject property; approval of R-3. zoning- for .the remainder ofthesubjectproperty. Zoning of both properties shall be subject to
the retention of the existing substant-i•al trees 'and' Honeydew Creek if
possible and desirable upon, review -of specific site development.
The Planning and Development Committee further -recommends•.that the area between the
commercial designation at Union and Sunset and. Duvall and Sunset be referred to thePlanning -Commission for reviewHand a 'change in the Comprehensive Plan, if necessary.

Development CARRIED. Hearing Examiner decision recommended approval to R-3
Committee Report zone concerning request for rezone of property located on the south-
Anton and MUTT/ west corner NE Sunset Boulevardand Anacortes Ave. NE from "G" to
Althoff Rezone B-1 ." Rezone requested by Anton Althoff to permit future commercial
R-272-78 use of the subject site. Applicant requested reconsideration on 3/12
and Appeal which was denied by the Examiner. The rezone was appealed to the City
Council on 3/19/79, objecting that designation of his property as
buffer strip was improper and capricious. Planning and Development
Committee Chairman Perry presented committee report having considered
appeal of Anton and Millie Althoff rezone 272-79 and recommended
that the City Council modify the decision of the Hearing Examiner
to approve B-1 zoning for one acre in the northwestern corner of the
site as requested by the applicant and R-3 for remainder of property:
affirming decision of the Hearing Examiner. Report listed determined
errors of fact and law and that zoning of both properties shall be
subject to the retention of the existing substantial trees and Honey-
dew Creek, if possible and desirable upon review of specific site
development. The report also recommended that the area between the
commercial designation at Union and Sunset and Duvall and Sunset be
referred to the Planning Commission for review and a change in the
Comprehensive Plan, if necessary. MOVED BY PERRY, SECOND SHINPOCH,
COUNCIL CONCUR IN PLANNING AND DEVELOPMENT COMMITTEE REPORT AND REFER
MATTER TO THE WAYS AND MEANS COMMITTEE.* Discussion ensued. Wall

appeal by Mr. Althoff was for the one acre only. Larry Brown, 11715
NE 145th, Kirkland, Real Estate representative for Mr. Althoff-,
explained location of property. MOTION CARRIED; Councilman Stredicke
requested his NO vote be recorded; Councilman Shane requested his YES
vote recorded; also restaurant under construction. MOVED BY PERRY,
SECOND CLYMER, CONCUR IN PLANNING AND DEVELOPMENT REPORT TO REFER
AREA AT UNION NE, NE SUNSET AND DUVALL NE TO THE PLANNING COMMISSION

West Hill Councilman Perry recalled Council referral of 4/2/79 of streets
Streets in the in the area of the 90-Day Moratorium on multiple building to the
Moratorium Area Planning and Development Committee. Councilwoman Shinpoch left the
Chambers and took no part in any discussion or action on this matter.

WEST HILL AREA TO THE TRANSPORTATION COMMITTEE RATHER THAN PLANNING

Traffic Jam Councilman Shane requested parking be eliminated from Park Ave.
North Renton during shift change and peak hours as 3:00 to 5:00 p.m. to ease
traffic congestion; also include North Renton Streets of 3rd and
4th. Mayor Delaurenti referred the subject to the Public Works
Director for referral to the Traffic Engineering Department.
Street Vacation Councilman Stredicke requested costs of continuing public hearing
Costs for street vacation, noting $100 fee for the vacation, inquirying if
additional charge required for hearing continuation. Mayor Delaurenti
asked Public Works Director and City Clerk to reply.

Multiple Building placing 90 day moratorium for construction, improvement and alteration
Northwest Section of any multiple apartment building, condo, commercial and/or industrial
of City. facility in the northwest section of the City from Taylor Ave. NW to
the West City Limits and Renton Ave. to the North City Limits. Ways
and Means Committee Chairman Clymer reported committee recommendation
for adoption. MOVED BY CLYMER, SECOND STREDICKE, ADOPT T4E RESOLUTION
AS READ.* Discussion ensued and City Attorney Warren noted the City
cannot require additional conditions if building meets zoning regula-
tions and the declaration filed of non-significant environmental
impact. Councilman Clymer explained the moratorium allows time for
study and review street access particularly for access by emergency
vehicles and problems that may affect public health and safety.
City Attorney Warren explained this moratorium does not affect prior
application for multiple residential building. *ROLL CALL: 3-AYES;
STREDICKE, PROCTOR, CLYMER; 2-NO: PERRY AND SHANE. CARRIED. Resolution
adopted. Further discussion ensued and request was made that the
record reflect Public Works Director Gonnason's remarks(that Mr.
Neglay' s letter was in error)that financial burden' will be born by
the developer who will be required to provide minimum of 20 ft. wide
roadway with curbs, gutters and sidewalks on all abutting properties
with continuation of Lind Ave. to Taylor.
Moratorium MOVED BY STREDICKE, SECOND CLYMER, THE ADMINISTRATION DIRECT THE
Continued PUBLIC WORKS DIRECTOR TO DENY BUILDING PERMIT FOR MULTIPLE CONSTRUC-
TION UNTIL AN ENVIRONMENTAL IMPACT STATEMENT HAS BEEN FILED. CARRIED.
Persons present opposing construction of condominium in West Hill
section: Norm Sundquist, 458 Lind Ave. , requested name of builder.

improvements and was advised by Public Works Director that Taylor

not been funded and at the present time no improvements funded.
Mr. Sundquist alleged any improvements would be for the benefit of
proposed condominimums, being advised by Councilman Perry that City
regularly repairs streets throughout the various districts.

Little, 264 Maple NW, called attention to petition presented at 10/2/78
public hearing concerning street vacation bearing more than 300 signa-
tures protesting high density construction and claimed vested rights.
Following further discussion, Public Works Director noted original
application for Lakeview Towers building permit made 3/10/78 and
not accepted until 4/2/79.
AUDIENCE COMMENT Sandy Webb, 264 Chelan Ave. NE, expressed disapproval of discussion
Continued at the expense of Staff member, explaining that Staff interprets,
executes and enforces the ordinances, but does not zone property.
Traffic Dixie Johnson, 11615 142nd SE, complained of traffic problem near
Comment Union Ave. NE and NE 4th St. , traffic from new complex near former
Autoban turning left into Cemetery Road. Public Works Director
Gonnason explained that right-turn-only was planned onto NE 4th.
Lease Renewal Versie Vaupel , 221 Wells Ave. N. , asked for Attorney General Opinion
Comment or State Auditor opinion concerning lease of property to Chamber of
Commerce, alleging subsidy of profit-oriented organization; also

AN ORDINANCE OF THE CITY OF RENTON, WASHINGTON
CHANGING THE ZONING CLASSIFICATION OF CERTAIN
PROPERTIES WITHIN THE CITY OF RENTON FROM GENERAL
CLASSIFICATION DISTRICT (G) TO BUSINESS DISTRICT (B-1)
AND RESIDENCE DISTRICT (R-3) (R-272-78)
WHEREAS under Chapter 7, Title IV (Building Regulations) of Ordinance
No. 1628 known as the "Code of General Ordinances of the City of Renton", as
amended, and the maps and reports adopted in conjunction therewith, the property,
hereinbelow described has heretofore been zoned as General Classification District (G);
and
WHEREAS a proper petition for change of zone classification of said property
has been filed with the Planning Department on or about December 15, 1978, which
petition was duly referred to the Hearing Examiner for investigation, study and public
hearing, and a public hearing having been held thereon on or about January 23, 1979,
and the matter having been appealed to the City Council and the Hearing Examiner's
Decision modified by the City Council during/ the regular City Council meeting of April
9, 1979, by adoption of the Planning and Development Committee Report dated April
9,1979, which is incorporated herein es if fully set forth, and said zoning request
being in conformity with the City's Comprehensive Plan, as amended, and the City
Council having duly considered all matters relevant thereto, and all parties having been
heard appearing in support thereof or in opposition thereto, NOW THEREFORE
THE CITY COUNCIL OF THE CITY OF RENTON, WASHINGTON, DO
ORDAIN AS FOLLOWS:
SECTION I: The following described property' in the City of Renton is
hereby rezoned to Business District (B-1) and Residence District (R-3) as hereinbelow
specified; subject to the findings, conclusions and decision dated March 6, 1979 as
amended by the Council's adoption of the Planning and Development Committee Report
dated April 9, 1979; the Plaanning Director is hereby authorized and directed to change
the maps of the Zoning Ordinance, as atnended, to evidence said rezoning, to-wit:

B-1) and Residence District (R-3) for property located on
the southwest corner of Sunset Blvd. NE and Anacortes Ave. NE,
known as the Althoff Rezone. MOVED BY CLYMER, SECOND PERRY
TO ADOPT THE ORDINANCE AS READ. ROLL CALL: ALL AYES EXCEPT
STREDICKE. CARRIED.
Ordinance #3312 An ordinance was read providing for the construction and
Fire :Lanes maintenance of fire lanes and prohibiting parking and

The purpose of this letter is to appeal the Hearing Examinier's
decision relative to the above mentioned rezone application.
I believe firmly, as a taxpayer in the City of Renton for over
twelve years, that having only my property designated as a
so called "buffer" strip is improper and very capricious. I
hope that a review of my application file will result in a mod-

Dear Mr. Althoff:
In response to your March 12, 1979, request for reconsideration, the
Examiner's recommendation of March 6, 1979, was reviewed again. It was
found that insufficient basis was presented to justify reconsidering
and changing the recommendation.
The Comprehensive Plan Land Use Map does in fact indicate that a very
small corner of the northwesterly portion of the property might be
suitable for commercial uses. This was not mentioned in the recommendation
due to minor consequence of this inclusion by the very broad and generalized
map designation boundaries. The corner of commercial was viewed as not
actually providing direction to rezone the property to B-1, but to indicate,
with the remainder of the generalized commercial area on the map west of
the site, that the site should serve as a buffer between the Duvall Avenue
N.E. and Union Avenue N.E. commercial nodes or areas. Since the map, as
stated in Conclusion No. 1 of the recommendation, is a general guide, it
was applied in this manner to define, through the rezone process and
application of the Comprehensive Plan goals and objectives, that Medium
Density Multi-family Residential, not Commercial, is the precise land use
that should occur on the site.
Regarding your statement that the site was at one time used for a service
station, the record does not corroborate this information. Although
assumed correct, this information was ". . .reasonably available. . ." at the
hearing, and therefore, per Section 4-3015, is not justification for
reconsidering the recommendation. In any case, since the station no
longer exists since 1970, its absence does not appear to have bearing
upon the rezone application.
Finally, the question of the basis for granting a rezone is contained in
Section 4-3014, which were read at the beginning of the Examiner's public
hearing of February 27, 1979.
I hope this clarifies the reasons for not reconsidering the recommendation
and responds to your claims.

Dear Mr. Beeler:
Pursuant to our meeting of February 27, 1979 and our review of the
findings, we are looking for your reconsideration of the following:
A) Ommission of Fact:
1) The fact was never brought up, but you can see, per the
attached comprehensive plan map, part of the property is
already designated for B-1 zoning. Applicant's request
for B-1 to the opposite corner of the property was to
accomplish a more natural and orderly development in this
area.
2) This particular section of the property that applicant is
requesting B-1 zoning for, was used until 1970 as a gas
station site for Gilmore Petroleum Co.
B) Misunderstanding of Judgement:
1) It is hard for the applicants to understand that if part
of the property is comprehensively zoned B-1 and that
there was no public opposition, why couldn't the rezone
be accomplished?

improvements in the 'area haveoccurred s,ince ;the_ 1977 land use analysis, as required
by Section 4-3014C.

under B-1 zoning is an:'appropri'ate expansion,'of the commercial node at the intersection
of Duvall Avenue .N.E:, and .N..E:; Sunset: Bl vd;. and, will produce consistent, orderly and
coordinated development ,patterns in theseundeveloped areas in the best interest of
the community,:_its .overal.l: attractiveness .and desirability.
3. Conclusion No. ,1, ' paragraph,:5,, is -i n, error in' .that the multi-family zoning that has
developed north of the .site and, across ,N.E. Sunset Blvd. should not be .carried southerly
and across the site to: connect with multi-family zoning to the south in' order to prevent
incompatible developments in a disorderly growth pattern.
4. Conclusion 'No. . 2,, ,paragraph ,2, is incorrect in that testimony was clear that public
or private improv.ements ,'in .the area have occurred since the 1977 land use analysis
which have impacted _the .subject •site sufficient to warrant reclassification pursuant
to Section 4-3014C. •
5. Conclusion No. 3. is. in error as mere conjecture of the concern regarding potential
strip commercial development.
The Committee, recommends that the above-stated findings of error should .be incorporated
into the decision of the Hearing Examiner dated March 6, 1979, and that the recommendation .
be. amended to read as 'follows.:
Approval, of B-1 zoning for the one acre :parcel. in the northeast corner
of the subject property;: approval of R-3 zoning for the remainder of
the subject property. , . Zoning of• both- properties sha=ll .be subject to
the retention of the existing substantial trees and Honeydew Creek if
possible and desirable upon review of specific .site development.
The Planning and Development, Committee further recommends that the area between the

RE:- ANTON AND MILLIE ALTHOFF REZONE -- .FILL NO. R-272-79
The Planning and Development Committee has considered the appeal of the above mentioned
decision dated March 6, 1979, and recommends that the City Council modify the decision
of the Hearing Examiner to approve B-1 zoning for one acre in the northwestern corner of
the site as requested by the applicant, and in all; Other respects to affirm the decision
of the Hearing Examiner, based Upon the following errors of fact and law:
1. Finding No. 9 is in error in that the testimony clearly established that significant
improvements in the area have occurred, since the 1977 land use analysis, as required
by Section 4-3014C.
2. Conclusion No. 1, paragraph 4; is in error, in that development of the subject site ,
under B-1 zoning is an appropriate expansion of the commercial node at the intersection
of Duvall Avenue N.E. and N.E. Sunset Blvd. and will produce consistent, orderly. and
coordinated development patterns in these undeveloped areas in the best interest of
the community, its overall attractiveness and ,desirability. .
3. Conclusion No. 1, paragraph 5, is in error in ,that the multi-family zoning that has
developed north of the site and across N.E. Sunset,Blvd. should not be carried southerly
and across the site to connect.with multi-family z.oning. to the .south in order to prevent
incompatible developments' in a disorderly. growth pattern.
4. Conclusion No. 2, paragraph 2, is incorrect in that ,testimony was clear that public
or private improvements in the area have occurred since then1977 land use analysis
which have impacted the subject site sufficient to .warrant reclassification pursuant
to Section 4-3014C.
5. Conclusion No. ' 3 is in error as mere conjecture of:,the. coneern regarding potential
strip commercial development.
The Committee recommends that the above stated findings of error should be incorporated
into the decision of the Hearing .Examiner dated March 6, 1979, and that the recommendation'
be amended to read as follows:
Approval of B-1 zoning for the one acre parcel. in the -northeast. corner
of the subject property; .approval of R-3 zoning. for. the remainder of
the subject property. Zoning of both properties, sha.11 ..be subject to
the retention of the existing substantial trees and Honeydew Creek if
possible and desirable upon review of,.specific:.site development. .
The Planning and Development Committee .further recommends.•that'.the -area between the •

Multiple Building placing 90 day moratorium for construction, improvement and alteration
Northwest Section of any multiple apartment building, condo, commercial and/or industrial
of City. facility in the northwest section of the City from Taylor Ave. NW to
the West City Limits and Renton Ave. to the North City Limits. Ways
and Means Committee Chairman Clymer reported committee recommendation
for adoption. MOVED BY CLYMER, SECOND STREDICKE, ADOPT THE RESOLUTION
AS READ.* Discussion ensued and City Attorney Warren noted the City
cannot require additional conditions if building meets zoning regula-
tions and the declaration filed of non-significant environmental
impact. Councilman Clymer explained the moratorium allows time for
study and review street access particularly for access by emergency
vehicles and problems that may affect public health and safety.
City Attorney Warren explained this moratorium does not affect prior
application for multiple residential building. *ROLL CALL: 3-AYES;

adopted. Further discussion ensued and request was made that the
record reflect Public Works Director Gonnason's remarks(that Mr.

with continuation of Lind Ave. to Taylor.

not been funded and at the present time no improvements funded.
Mr. Sundquist alleged any improvements would be for the benefit of
proposed condominimums, being advised by Councilman-Perry that City
regularly repairs streets throughout the various districts.

Little, 264 Maple NW, called attention to petition presented at 10/2/78
public hearing concerning street vacation bearing more than 300 signa-
tures protesting high density construction and claimed vested rights.
Following further discussion, Public Works Director noted original
application for Lakeview Towers building permit made 3/10/78 and
not accepted until 4/2/79.
AUDIENCE COMMENT Sandy Webb, 264 Chelan Ave. NE, expressed disapproval of discussion

executes and enforces the ordinances, but does not zone property.
Traffic Dixie Johnson, 11615 142nd SE, complained of traffic problem near
Comment Union Ave. NE and NE 4th St. , traffic from new complex near former
Autoban turning left into Cemetery Road. Public Works Director
Gonnason explained that right-turn-only was planned onto NE 4th.
Lease Renewal Versie Vaupel , 221 Wells Ave. N. , asked for Attorney General Opinion
Comment or State Auditor opinion concerning lease of property to Chamber of
Commerce, alleging subsidy of profit-oriented organization; also
