3,. Vegetation : Low scrub grass dominates the property with a
dense stand of Douglas Fir Trees extending the length of the
east boundary. Parts in the north portion have been cleared
and graded.
4'. Wildlife : Existing vegetation on the site .may provide suit-
able habitat for birds and small mammals .
5. Water : No surface water was observed on the.. subject site .
6,. Land Use : An existing single family residence and a large
shed are located in the southwest portion;.. o.f the property .
Another single family residence is locate°ds:' imm.ediately north
of the site. Additional single family dwellimg,s are found
to the south and west while the property immediately east
remains largely undeveloped.
E . NEIGHBORHOOD CHARACTERISTICS :
The area is composed principally of widely scattered single family
residences .
F . PUBLIC SERVICES :
1 . Water and Sewer : An existing 12" water main extends north-
south on the east side of Duvall adjacent to the subject site
and a 3" main is located _on the west side. An 8" sanitary
sewer runs east-west on S. E . 101st Street approximately
1 ,000 feet north of the subject site .
2. Fire Protection : Provided by the Renton Fire Department as
per ordinance requirements .
3. Transit : Metro Transit Route 107 operates along Union Ave-
nue N. E. approximately 3/4 of a mile to the southwest of the
subject site.
4. Schools : Honeydew Elementary School is approximately one
mile southwest of the subject site , and McKnight Middle
School is within 1 3/4 miles to the west , while Hazen HIgh
School is within one-half mile to the south .
5., Recreation : Kiwanis Park is located approximately one mile
to the southwest of the subject site and North Highlands Park
is within 2 miles west.

The applicant requests approval of a rezone from G to SR- 1 and
a proposed three-lot short plat. In order to allow such subdi -
vision , the applicant is also requesting an exception to the
Subdivision Ordinance to permit two 25-foot pipestem roads .
In addition , the application includes a request for waiver of

C. HISTORY/BACKGROUND :
The subject site was annexed into the City by Ordinance 2945 dated
July 17 , 1975.
D . PHYSICAL BACKGROUND :
1 . Topography : The site is generally level .
2. Soils : Alderwood Gravelly Sandy Loam (AgC) . Permeability is
moderately rapid in the surface layer and subsoil and very
slow in the substratum. Runoff is slow to medium, and the
erosion hazard is moderate. This soil is used for timber,
pasture , berries , row crops , and for urban development.

6. All the departments reviewing this proposal indicate no
objections other than the situation . in #5 :above .
7 . Analysis items 3 and 4 appear to comply with Section
4-3014, thus substantiating the proposed rezone .
M. DEPARTMENTAL RECOMMENATIONS :
Approval of the requested rezone from "G" to "SR-1" based on '
the compatibility of the proposed use with the existing uses
and that . the , site has not been previously considered by an
area-wide zoning review.
N . PLANNING DEPARTMENT ANALYSIS (SHORT PLAT) :
1. The subject proposal is consistent with the Comprehensive
Plan , which designates the site and surrounding area as
single family residential .
2. The proposal is compatible with adjacent single family
residential uses and similar patterns in the area .
3. The size of the existing property is large enough that
the proposed short plat is a reasonable use of the land .
Proposed Lot #1 is approximately 21 , 605 square feet , and
Lot #2 is approximately 105 ,4,60 square feet. ' Lot #3 with
the existing residence is approximately 18 ,496 square feet.
4. Although the lots of the proposed short plat do exceed
the minimum lot size requirement of the SR-1 zone and the
Subdivision Ordinance , the amount of frontage on Duvall
Avenue N. E. is not sufficient to meet the 75 foot standard
for each lot. The applicant is therefore proposing Lot #3
with a 125-foot frontage with Lots #1 and #2 designed as
pipestem lots with 25-foot frontages and 125 foot and 145
foot pipestem lengths respectively. .
51. The parcel immediately west and north of proposed Lot #1
is separate and apart from the subject site and contains
frontage on Duvall• Avenue• N . E . Because of this location ,
proposed Lots #1 a'nd #2 cannot meet the frontage require-
ment of the SR-1 zone . It would seem, therefore , that
reasonable justification can be provided for the exception
as proposed in #4 above. (Section 9-1109. 1A)
6. The Engineering Division of the Public Works Department
advises that if and when Lot #2 is developed , the additional
25 feet of . right-of-way in Lot #1 will have to be acquired
to provide for a full 50-foot wide street with improvements .
7 ; At this time off-site improvements along Duvall Avenue N. E .
are very limited . ' Therefore , deferring improvements until
a future time, appears warranted.. Thus , the waiver of off-
site improvements subject to restrictive covenants providing
for future LID participation appears satisfactory.
8. At such time as Parcel' #2 is further developed by a street
extension , area-wide circulation can be addressed to insure
access , if required , to rthe''east 'of this parcel .
9. At the time of this report preparation , we have received no
written comments from outside departments .

5. Traffic : The proposed short plat will generate approximately
20 additional vehicle trips per day on Monroe Avenue N . E .
This. would crease traffic flow by less than 1% per day on
this arterial .
J . ENVIRONMENTAL ASSESSMENT/THRESHOLD DETERMINATION :
Pursuant to the City of Renton ' s Environmental Ordinance and the
State Environmental Policy Act of 1971 , as amended , RCW 43-21C ,
no determination of environmental significance is required for
the short plat. However, a declaration of non-significant
impact has been prepared fo.r the rezoning due to its scope .

L . PLANNING DEPARTMENT ANALYSIS - REZONE :
1 . The proposed rezone is consistent with the Comprehensive Plan
map element which designates the site and general area as
single family residential . .
2. ,The applicant proposes to subdivide the subject site into
three parcels . This will require the approval of a short
plat by the Hearing Examiner. In addition , exceptions for
two pipestem' roads and a request for waiver of off-site
improvements: will be required.
3. The subject site, has been zoned "G" since it was annexed
in 1975. Review of the Planning Department records does
not indicate an areawide zoning review of the site since
that time.
4. The subject site is located on the east side of Duvall
Avenue N . E . The land on the west side of Duvall within
the City is presently zoned "G" also . Some properties
in King County on the west side of the street are zoned
Suburban Residential with a minimum lot size of, 7200
square feet with sewers and 15 ,000 square feet without
sewers . Portions of the properties have been subdivided
into lots 9, 000 to 13 , 000 square feet.= All properties
in the applicant ' s proposed short plat would exceed
18 , 000 square feet. The proposed rezone to SR-1app.ears
consis.tent. with the existing, properties in the area and ,
therefore , appropriate for the site . The Land Use
Report, 1965 , advises : "Encourage the development and
utilization of land to its highest and best use in such
a way as to promote thebest interest of the community
and contribute to its overall attractiveness and desir-
ability as a '-place in which to work , shop , live , and
play. " ' , (Objective 6, p. 18)
5. Suitable water supply is available to the subject site.
However , the nearest sewer line is approximately 1/4 mile
to the north of the site , and the Utilities Engineering
Division advises that pumping would be required .

COMMENTS:
Introduction The State Environmental Policy Act of 1971, Chapter 43.21C, RCW, requires
all state and local governmental agencies to consider environmental values both for their
own actions and when licensing private proposals. The Act also requires that an EIS be
prepared for all major actions significantly affecting the quality of the environment.
The purpose of this checklist is to help the agencies involved determine whether or not a
proposal is such a major action.

3 .. -.Vegetati on : ' Low scrub grass dom`i nates the property with a
dense stand of Douglas Fir Trees extending the length of the
east boundary. Parts in the north portion have been cleared
and graded.
4. Wildlife : Existing vegetation on the site may provide suit-
able habitat for birds and small mammals .
5. Water : No surface water was observed on the subject site .
6. Land Use : An existing single family residence and a large
shed are located in the southwest portion of the property .
Another single family residence is located immediately north
of the site. Additional single family dwellings are found
to the south and west while the property immediately east
remains largely undeveloped .

The area is composed principally of widely scattered single family
residences .

south on the east side of Duvall adjacent to the subject site
and a 3" main is located on thee west side. An 8" sanitary
sewer runs east-west on S . E . 101st Street approximately
1 , 000 feet north of the subject site .
2. Fire Protection : Provided by the Renton Fire Department as
per ordinance requirements .
3. Transit : Metro Transit Route 107 operates along Union Ave-
nue N. E. approximately 3/4 of a mile to the southwest of the
subject site.
4. Schools : Honeydew Elementary School is approximately one
mile southwest of the subject site , and McKnight Middle
School is within 1 3/4 miles to the west , while Hazen HIgh
School is within one-half mile to the south .

C . HISTORY/BACKGROUND :
The subject site was annexed into the City by Ordinance 2945 dated
July 17 , 1975.
D . PHYSICAL BACKGROUND :
1 . Topography : The site is generally level .
2 . Soils : Alderwood Gravelly Sandy Loam (AgC) . Permeability is
moderately rapid in the surface layer and subsoil and very
slow in the substratum. Runoff is slow to medium , and the
erosion hazard is moderate . This soil is used for timber ,
pasture , berries , row crops , and for urban development .

6. All the departments reviewing this proposal indicate no
objections other than the situation in #5 above .
7 . Analysis items 3 and 4 appear to comply with Section
4-3014 , thus substantiating the proposed rezone .
M. DEPARTMENTAL RECOMMENATIONS :
Approval of the requested rezone from "G" to " SR-1 " based on
the compatibility of the proposed use with the existing uses
and that the site has not been previously considered by an
area-wide zoning review.
N . PLANNING DEPARTMENT ANALYSIS (SHORT PLAT ) :
1 . The subject proposal is consistent with the Comprehensive
Plan , which designates the site and surrounding area as
single family residential .
2 . The proposal is compatible with adjacent single family
residential uses and similar patterns in the area .
3 . The size of the existing property is large enough that
the proposed short plat is a reasonable use of the land .
Proposed Lot #1 is approximately 21 , 605 square feet , and
Lot #2 is approximately 105 ,460 square feet. Lot #3 with
the existing residence is approximately 18 ,496 square feet .
4 . Although the lots of the proposed short plat do exceed
the minimum lot size requirement of the SR-1 zone and the
Subdivision Ordinance , the amount of frontage on Duvall
Avenue N . E . is not sufficient to meet the 75 foot standard
for each lot. The applicant is therefore proposing Lot #3
with a 125-foot frontage with Lots #1 and #2 designed as
pipestem lots with 25-foot frontages and 125 foot and 145
foot pipestem lengths respectively.
5. The parcel immediately west and north of proposed Lot #1
is separate and apart from the subject site and contains
frontage on Duvall Avenue N . E . Because of this location ,
proposed Lots #1 and #2 cannot meet the frontage require-
ment of the SR-1 zone . It would seem, therefore , that
reasonable justification can be provided for the exception
as proposed in #4 above . (Section 9-1109 . 1A)
6 . The Engineering Division of the Public Works Department
advises that if and when Lot #2 is developed , the additional
25 feet of right-of-way in Lot #1 will have to be acquired
to provide for a full 50-foot wide street with improvements .
7 . At this time off-site improvements along Duvall Avenue N . E .
are very limited . Therefore , deferring improvements until
a future time appears warranted. Thus , the waiver of off-
site improvements subject to restrictive covenants providing
for future LID participation appears satisfactory .
8 . At such time as Parcel #2 is further developed by a street
extension , area-wide circulation can be addressed to insure
access , if required , to the east of this parcel .
9 . At the time of this report preparation , we have received no
written comments from outside departments .

J . ENVIRONMENTAL ASSESSMENT/THRESHOLD DETERMINATION :
Pursuant to the City of Renton ' s Environmental Ordinance and the
State Environmental Policy Act of 1971 , as amended , RCW 43-21C ,
no determination of environmental significance is required for
the short plat. However , a declaration of non-significant
impact has been prepared for the rezoning due to its scope .

L . PLANNING DEPARTMENT ANALYSIS - REZONE :
1 . The proposed rezone is consistent with the Comprehensive Plan
map element which designates the site and general area as
single- family residential ..
2 . The applicant proposes to subdivide the subject site into
three parcels . This will require the approval of a short
plat by the Hearing Examiner-. In addition , exceptions for
two pipestem roads and a request for waiver of off-site
improvements will be required .
3. The subject site has been zoned "G" since it was annexed
in 1975 . Review of the Planning Department records does
not indicate an areawide zoning review of the site since
that time.
4 . The subject site is located on the east side of Duvall
Avenue N . E . The land on the west side of Duvall within
the City is presently zoned "G" also . Some properties
in King County on the west side of the street are zoned
Suburban Residential with a minimum lot size of 7200
square feet with sewers and 15 ,000 square feet without
sewers . Portions of the properties have been subdivided
into lots 9, 000 to 13 , 000 square feet . All properties
in the applicant ' s proposed short plat would exceed
18 , 000 square feet. The proposed rezone to SR-1 appears
consistent with the existing properties in the area and ,
therefore , appropriate for the site . The Land Use
Report , 1965 , advises : " Encourage the development and
utilization of land to its highest and best use in such
a way as to promote the best interest of the community
and contribute to its overall attractiveness and desir-
ability as a place in which to work , shop , live , and
play . " (Objective 6 , p . 18)
5 . Suitable water supply is available to the subject site.
However , the nearest sewer line is approximately 1/4 mile
to the north of the site , and the Utilities Engineering
Division advises that pumping would be required .

main and the city would assume the cost of the oversize.
The Examiner requested a final recommendation from Planning Department representative.
Mr. Clemens advised the recommendation contained in Exhibit #1 would remain as submitted.
The Examiner requested further comments. Since there were none, the hearing on File No.
R-306-79 was closed by the Examiner at 9:50 a.m.
FINDINGS, CONCLUSIONS.& RECOMMENDATIONS: Having reviewed the record in this matter, the
Examiner now makes and enters the following:
FINDINGS:
1. The request is for approval of reclassifying 3.34 acres from G to SR-1 precedent to
subdividing the property.
2. The Planning. Department report accurately sets forth the issues, applicable policies
and provisions, findings of fact, and departmental recommendations in this matter,
is uncontested, and is hereby attached as Exhibit #1 and incorporated in this report
by reference as set forth in full therein.
3. ' Pursuant to the City of Renton's Environmental Ordinance and the State Environmental
Policy Act of 1971, as amended by R.C.W. 43.21.C. , a Declaration of Non-Significance
has been issued for the subject proposal by Gordon Y. Ericksen, responsible official.
4. Plans for the proposal have been reviewed by all city departments affected by the
impact of this development and no adverse comment was expressed.
5., There was no opposition to the proposal expressed.
6. Sanitary sewer is available within 1/4 mile of the site. Staff requires the existing
water main be enlarged.
7. Since annexation to the city .in 1975 an area land use analysis featuring the site
has not occurred (Section 4-3014. (A) ) .
8. The Comprehensive Plan Land Use Map indicates the property to be Single Family
Residential (Section 4-3014. (B) ) .
9. The proposed SR-1 requires 7,500 square foot lots (Section 4-704) . Approximately 1/4
mile northwesterly of the site is a plat' developed near this density in an SR-1 zone.
Another plat of similar density is located approximately 200 feet southwesterly in
King County.
CONCLUSIONS:
1. The trend of development in the general area (particularly the subdivision activity
and shopping center node at N.E. Sunset Boulevard and Duvall Avenue N.E.) appears
to indicate the appropriateness of changing the zoning on the site to permit a density
greater than approximately one unit per acre under the existing G zoning. This would
be '. . .effective control of land use. . ." and ". . .highest and best use in such a way
as to promote the best interest of the community. . ." (pages 17 and 18, Objectives No.
4 and .6, Comprehensive Plan, Land Use Report, July, 1965) . Greater density would
be an " . . .appropriate use of land. . ." and ". . .proper employment, of. . .land use
principles. . ." and ". . .promote. . .coordinated development of undeveloped areas." (page
9, Summary, Comprehensive Plan, Renton Urban Area Report, July, 1965) . However, the
question becomes of what density is appropriate without ". . .overcrowding the land. . ."
and producing ". . .undue concentrations of population." (Ibid)
Little guidance is provided in the Comprehensive Plan goals and objectives regarding
the amount' of density desired in_ the Single Family Residential designation .,on the
Comprehensive Plan Land Use Map. Zoning regulations'contain zoning districts of
SR-1 (7,500 square foot lots)., SR-2 (10,000 square foot lots) , R-1 (7,200 square foot •
lots) and S-1 (7,200 to 40,000 square foot lots depending upon interpretation) . Each
of these-districts meets the, density guideline of six units per acre of the Comprehensive
Plan for Single Family Residential (page 5, Section 4.B. Density Plan, Renton Urban
Area Report) : But more specific guidance as to which of the four zoning districts
is most appropriate is absent.
Exercising". . .land use principles. .. " and "coordinated development. . . " (page 9, Ibid)
the solution most compatible with adjacent development.appears to be SR-2. Large lots
dominate the land use pattern in' the area. Lot sizes of 7,200 square feet would be
less •compatible with these' large' lots than 10,000 square foot lots of the SR-2 zone.
SR-2 ,would not bean ". . .unwarranted infiltration of incompatible uses which. would
contribute to 'premature decay and obsolescence, and prevent the development of orderly

PUBLIC HEARING: After reviewing the Planning Department report, examining
available information on file with the application, and
field checking the property and surrounding area, the
Examiner conducted a public hearing on the subject as
follows:
The, hearing was opened on March 6, 1979 at 9:30 a.m. in the Council Chambers of the
Renton Municipal Building.
Parties wishing to testify were affirmed by the Examiner.
It was reported. that the' Hearing Examiner and the applicant had received and reviewed
the ,Planning Department report, and the report was entered into the record as Exhibit #1.

Mr. Olson corrected Section F.'1. (Public Services) of Exhibit #1 'which states that a 12-inch
water main extends north-south on the east side of Duvall Avenue N.E. adjacent to the
subject site, and .he advised that only a 3-inch water main exists to serve the subject
property. He noted that extension of water lines would' be required either from the
south or north, and referenced a previous short plat request, File No. Short Plat 047-77 -
Petet, which had been approved. by the Examiner on July 11, 1977 subject to participation
in a future water line extension project on Duvall Avenue N.E.
The Examiner asked the applicant if he concurred in Exhibit #1. Responding was:

Mr. Briere indicated certain concerns regarding the report. He advised the purpose of the •
request .to allow subdivision of the property•to construct a single, small residence for
his own use: • He stated that 'other residents on Duvall Avenue N.E. had'been.allowed to
develop their properties without requirements of water line extension, and 'he requested
the same .privileges and rights for his own development, noting ,that if full, responsibility
for the installation costs were imposed, subdivision of the property would not be feasible. '
Mr. : Briere also Stated: that a maximum of 10 residences would be utilizing the existing
water line which ,shotUld not exceed the capacity of utilities. .
The,Examiner requested testimony. in support or opposition to the request. There was no
response. ' Responding to Mr: Briere's concern regarding installation of a 12-inch water
line, '.Mr. Olson clarified the departmental request for installation of an 8-inch water .

growth patterns.." ' (page 17, Objective NO. 1, Land Use Report) . this would constitute
effective control of land use. . ." (Objective No. 4, Ibid) . And SR-2 would be
the " .•.highest and best use in such a way as to promote the best interest of the
Community and contribute to its overall attractiveness and desirability as a place inwhichto : . .live. . . " (Objective No. 6, page 18, Ibid) . (Section 4-3014. (B) ) .
2. The land use, and zoning patterns have not been established for this area, leaving
a great amount .Of room for arbitrariness in this recommendation to the City Council.
Various densities and lot sizes can be found in the area, which is characteristic of
a recently annexed, undeveloped area. The Examiner's recommendation is not intended
to set a ,pr.ecedent or, establish the land Use/zoning g pattern for this area but is a
response to the specifics of this particular application. The pattern should be the
subject of, Planning Commission and City Council review pursuant to an' area wide zoning
analysis.
3. The recommended SR-2 was not specifically considered at Or during a 'previous area land
use or zoning analysis (Section 4-3014. (A) ) .
RECOMMENDATION:
Approval of a reclassification to SR-2.
Separately, it is recommended that the Planning Commission and City Council review land
use and zoning of this'area. In addition, .appropriate guidelines for establishing single
family residential densities might be reviewed for possible inclusion in the goals and
objectives of the Comprehensive Plan.

It has been brought to my attention that my recent recommendation
of March 8, 1979,. contained an error .which I would like'to correct.
Conclusion No. 1 found that zoning of SR-2 was most appropriate
for your property. . It was stated that SR-2 was a single family
residential district requiring 10,000 square foot lots. This is
in error, for SR-2 is a duplex, not single family, residential
district. Therefore, my final recommendation to the City Council
must be changed to SR-1, single family esidential .district ,
requiring,7,500 square foot lots for ccri orman'ce to the Comprehensive
Plan per: Conclusion No. 1.
Because of this change in my recommendation, the appeal or.
reconsideration period is extended to March 26, 1979. If no.
appeal is filed, the recommendation will be placed on the City
Council agenda of April 2,, 1979.

Taylor; explaining that upon mitigation of adequate access and

uphill properties by the developer, non-significant impact declara-
tion was signed; further that cost of relocation of any utilities
would have to be born by developer not City and grades would have

WHEREAS under Chapter 7, Title IV (Building Regulations) of Ordinance
No. 1628 known as the "Code of General Ordinances of the City of Renton", as
amended, and the maps and reports adopted in conjunction therewith, the property
hereinbelow described has heretofore been zoned as General Classification District (G);
