On behalf of my neighbors and myself, we wish to express our M
opposition to the above noted rezone .
We are opposed to this rezone because of the long-term
detrimental effects on our neighborhood. If allowed, this Id
rezone will remove any hopes that we have of maintaining our
area in it's present state.

Contrary to the Planning Department report, this area is not
in a state of transition to smaller lots . We have in the past
resisted efforts to increase the density of buildings in this g
area. The most recent effort to rezone and sub-divide was the II
attempt by Harold P. Peterson (R-882-76) .
This is a very unique area, an area that was developed according
to the existing zoning. The Planning Department makes referencegl
to the smaller lots surrounding the Stewart' s Highland Acre Tracts,
the proposal remains compatible with the established single
family residential character surrounding the Highland Acre Tract O
which this is a part" (Pg. 3 #2 ) , this is exactly what we are
opposed to, becoming just like the rest of the area.
It is interesting to note that the surrounding area was not
developed according to the zoning at the time. In many cases , 1640
this area was developed in violation of the building codes Til
including insufficient water and sewer mains and narrow streets .
Problems that are still with us today simply because of o0
economic exploitation. I
We feel that this is a very special area and that is the reason c
we have chosen to live here . The majority of homeowners have C)
been here since the area was developed. In fact, to be able to 0
purchase a home here, it almost requires that the present
ownership be relinquished involuntarily, as in death. Many of
the homeowners built their homes with their hands, sweat and
sacrifice and intend to remain until their death.

Each of us has the opportunity to sell our property at a g
tremendous profit because of the uniqueness and the size of lai
the lots. We are not interested in profits, but remaining here albecausewetreasurewhatwehave.

On September 8,1976, the Planning Commission ruled that the
Harold P. Peterson rezone would be detrimental to this area
and denied the rezone. The City Council sustained this decision
by denying the appeal to this decision on October 18, 1976 for
the same reason. Only the dates and names have changed, the
Steven Whitson Rezone would be just as detrimental if not more
so. We urge that in the interest of fairness and consistency 0
you deny this request .

Recommend approval of the requested rezone from GS- 1 to R-1
based upon the above analysis , the compatibility of the proposed
use to the existing uses and Comprehensive Plan Policies and that
the site has not been previously considered by a specific or
an area-wide zoning review.

J . ENVIRONMENTAL ASSESSMENT/THRESHOLD DETERMINATION :
Pursuant to the_ City of Renton ' s Environmental Ordinance and
the State Environmental Policy Act of 1971 , as amended , RCW 43-21C ,
a negative declaration of environmental impact has been issued .
This declaration is conditional upon the retention of as many
existing trees on the site as possible per Planning Department
approval .

L . PLANNING DEPARTMENT ANALYSIS : .
1 . The proposed rezone is consistent with the Comprehensive Plan
land use element which designates the site and general area
as single family residential .
2 . Although the requested rezone would result in a zoning
classification permitting smaller lot sizes (from GS-1 ,
minimum lot size 35 ,000 square feet to R-1 , minimum lot size
7200 square feet) , the proposal remains compatible with the
established single family residential character surrounding the
Highland Acre Tract which this is a part. Lots as small as
5 , 500 square feet exist adjoining or within one block .
3. The applicant' s proposed construction of an additional
single family residence on the site will require submittal
of a short plat and approval by the Hearing Examiner . Due to
the width of the lot an exception to the Subdivision Ordinance
for a pipestem lo.t on the westerly portion of the property
will also be required .
4. Review of the Planning Department records indicates no area-wide
rezoning has been considered in the vicinity other than the
general analysis in 1965 relating to adoption of the Comprehensive
Plan. However , Tract #14 at the east end of N . E . 7th Street
was rezoned to R-1 in 1961 .
5 . Suitable water is available to the subject site . However ,
sanitary sewers are not presently available in the vicinity .
This will need to be resolved for any future residential
construction as a result of this rezone .
6. The site contains a number of significant evergreens . These
should be preserved as much as possible to mitigate the
environmental impact.
7 . A number of property owners in the vicinity have telephoned
the Planning Department expressing the belief that certain
restrictive covenants limiting lot size to the present
28 ,700 square feet apply to the subject parcel . Review of
the municipal records does not indicate any such requirement
by the City or the existance of said covenants .
8. . The subject area is in transition from relative large lots
to smaller lots as evidenced by division of lots 1 & 4
of Block 1 to 12 ,000 square feet and lot 7 of Block 2 to
14,000 square feet , and lot 1 of Block 2 to 6 ,000 square feet.
Based upon this transitional condition Section 4-3014(b)
indicates that the property is potentially zoned for the use
proposed .

Introduction The. State Environmental Policy Act of 1971 , Chapter 43.21C, RCW, requires
all state and local governmental agencies to consider environmental values both for their
own actions and when licensing private proposals . The Act also requires that an EIS be
prepared for all. major actions significantly affecting the quality of the environment .
The purpose of this checklist is to help the agencies involved determine whether or not a
proposal is such a major action.
Please answer the following questions as completely as you can with the information • •
presently available to you. Where explanations of your answers are required , or where
you believe an explanation would be helpful to government decision makers , include your
explanation in the space provided , or use additional pages if necessary. You should
include references to any reports or studies of which you are aware and which are rele-
vant to the answers you provide. Complete answers to these questions now will help all

Pursuant to the_ City of Renton ' s Environmental Ordinance and
the State Environmental Policy Act of 1971 , as amended , RCW 43-21C ,
a negative declaration of environmental impact has been issued .
This declaration is conditional upon the retention of as many
existing trees on the site as possible per Planning Department
approval .

L . PLANNING DEPARTMENT ANALYSIS : .
1 . The proposed rezone is consistent with the Comprehensive Plan
land use element which designates the site and general area
as single family residential .
2 . Although the requested rezone would result in a zoning
classification permitting smaller lot sizes (from GS-1 ,
minimum lot size 35 ,000 square feet to R-1 , minimum lot size
7200 square feet) , the proposal remains compatible with the
established single family residential character surrounding the
Highland Acre Tract which this is a part . Lots as small as
5 ,500 square feet exist adjoining or within one block.
3. The applicant' s proposed construction of an additional
single family residence on the site will require submittal
of a short plat and approval by the Hearing Examiner . Due to
the width of the lot an exception to the Subdivision Ordinance
for a pipestem lot on the westerly portion of the property
will also be required .
4 . Review of the Planning Department records indicates no area-wide
rezoning has been considered in the vicinity other than the
general analysis in 1965 relating to adoption of the Comprehensive
Plan. However ,_ Tract #14 at the east end of N . E . 7th Street
was rezoned to R-1 in 1961 .
5 . Suitable water is available to the subject site . However ,
sanitary sewers are not presently available in the vicinity.
This will need to be resolved for any future residential
construction as a result of this rezone .
6 . The site contains number of significant evergreens . These
should be preserved as much as possible to mitigate the
environmental impact.
7 . A number of property owners in the vicinity have telephoned
the Planning Department expressing the belief that certain
restrictive covenants limiting lot size to the present
28 ,700 square feet apply to the subject parcel . Review of
the municipal records does not indicate any such requirement
by the City or the existance of said covenants .
8. . The subject area is in transition from relative large lots
to smaller lots as evidenced by division of lots 1 & 4
of Block 1 to 12 ,000 square feet and lot 7 of Block 2 to
14,000 square feet , and lot 1 of Block 2 to 6 ,000 square feet.
Based upon this trans=itional condition Section 4-3014(b)
indicates that the property is potentially zoned for the use
proposed .

Mr. Pearson indicated that construction of a residence on the specified location on
Exhibit #3 would require removal of a majority of existing trees on the property and
would create visual impact to his property located north of the site. He expressed
objection to the proposal which he felt would be inconsistent with the existing
character of the neighborhood.

Mr. Smith expressed concern regarding location of existing accessory structures if rezones
to other properties occurred. The Examiner explained that the subject rezone applies
only to the specific property owned by the applicant, and instigation of zoning revisions
to other properties could only occur by requests from individual property owners in
adjacent areas. Mr. Smith inquired regarding the capacity of the subject property for
installation of an additional septic tank. The Examiner explained requirements for King
County and City of Renton approval of septic tank installation, noting that if approval
is not received by the applicant, development would be precluded or a sewer system
installation would be required. Mr. Smith inquired if approval of the subject rezone
would allow construction of apartments in adjacent areas. The Examiner advised that the
option for rezone application is available to all members of the public. Mr. Smith
reiterated his objection to the subject rezone which is adjacent to his property.

Mr. Smith discussed factors which contribute to the unique and stable character of the
area, including substantial stands of trees and large lots. He clarified the specific
area of the neighborhood which consists of N.E. 7th Street extending from Monroe Avenue
N.E. to Queen Avenue N.E. , and objected to comments contained in Section L.8 (Planning
Department Analysis) of Exhibit #1, which state that the subject area is in transition
from relatively large lots to smaller lots as evidenced by division of Lots 1 & 4 of
Block 1 to 12,000 square feet, Lot 7 of Block 2 to 14,000 square feet, and Lot 1 of
Block 2 to 6,000 square feet. Mr. Smith advised that the area is not in transition and
corrected the previous figures to 30,000 square feet for Lot 1 of Block 1, 20,000 square
feet in Lot 4 of Block 1, 40,000 square feet in two lots under one ownership contained
in Lot 1 of Block 2, and division of Lot 7 of Block 2 into two lots of approximately
14,000 square feet. He referenced Section 4-3014.B. of the Hearing Examiner Ordinance
Circumstances found to apply to grant a rezone) , which states that the property is
potentially zoned for the reclassification being requested pursuant to the policies
set forth in the Comprehensive Plan, and indicated concern regarding the impact of the
word "potential." Mr. Smith advised his opinion that approval of the subject rezone
would establish a precedent and would instigate further subdivision in the area which
would result in increased noise and imminent removal of existing trees.

Mr. Crutchfield, one of the original residents in the neighborhood, expressed objection
to the proposed rezone due to establishment of a precedent for future subdivision, and
supported retention of the character of the neighborhood in its existing condition.

Mr. Morgan expressed concern that approval to an R-1 zoning district would allow at least
three lots within 28,000 square feet contained in the property. The Examiner advised that
subdivision regulations require creation of a public street for a short plat of more than
two lots. Mr. Morgan objected to approval of a rezone of property which would require
further exception to the Subdivision Ordinance for a pipestem road in order to develop,
and he felt that appropriate assurance does not exist that application for an additional
exception of the requirement for provision of a public street would not occur to allow
development of the property. Referencing Section J. (Environmental Assessment/Threshold
Determination) of Exhibit #1 regarding the approval of a negative declaration conditioned
upon retention of as many existing trees as possible, Mr. Morgan felt that assurance of
compliance was not possible. He also felt that availability of septic systems on the
property had not been properly addressed by staff. Mr. Morgan noted that because the
subject site is centrally located in the neighborhood, a rezone would constitute spot

PLANNING DEPARTMENT The Planning Department preliminary report was received by the
REPORT: Examiner on March 14, 1979.
PUBLIC HEARING: After reviewing the Planning Department report, examining •
available information on ,file with the application, and field
checking .the property and surrounding area, the Examiner
conducted a public hearing on the subject as follows:
The hearing was opened on March 20, 1979 at 9:00 a.m. in the Council Chambers of the
Renton Municipal Building.
Parties wishing to testify were affirmed by the Examiner.
It was reported that the Hearing Examiner and the applicant had received and reviewed
the Planning Department report, and the report was entered into the record as Exhibit #1.
David Clemens, Associate Planner, reviewed Exhibit #1, and entered the following
additional. exhibits into the record:

The Examiner asked the applicant if he concurred in Exhibit #1. Responding was:

Mr. Whitson was affirmed by the Examiner. He indicated his concurrence in the report,
and stated that existence of dense stands of trees would reduce visual impact of the
proposed structure upon surrounding residents in the area.
Mr. Clemens advised receipt of a letter and petition from homeowners residing adjacent
to the subject site. The letter was read into the record by the Examiner and entered as
follows:

The letter indicated opposition to the proposed rezone due to potential adverse impact
to the unique, character of the plat of Stewart's Highland Acre Tract which contains lots
of large size. It also objected to comments contained in the Planning Department report
which state that the area is in a state of transition, and noted that a previous rezone
request ,submitted by Harold P. Peterson had been denied by the Planning Commission and.
City Council in .1976.
The Examiner requested testimony in support of the application. There: was no response.
He then requested testimony in opposition. Responding was:

FINDINGS, CONCLUSIONS & RECOMMENDATIONS: Having reviewed the record in this matter,
the Examiner now makes and enters the following:
FINDINGS:
1. The 'request is for approval of reclassifying a 28,700 square foot, GS-1 zoned,
single family lot to R-1 for future subdivision into two lots.
2. The Planning Department report accurately sets forth the issues, applicable policies
and provisions, findings of fact, and departmental recommendations in this matter,
and is hereby attached as Exhibit #1 and incorporated in this report by reference as
set forth in full therein.
3. Pursuant to the City of Renton's Environmental Ordinance and the State Environmental
Policy Act of 1971, as amended by R.C.W. 43.21.C. , a Declaration of Non-Significance
has been issued for the subject proposal by Gordon Y. Ericksen, responsible official.
4. Plans for the proposal have been reviewed by all city departments affected by the
impact of this development and no adverse comment was expressed.
5. All existing utilities are available and in close proximity; except for sanitary
sewer which must be extended from Queen Avenue N.E.
6. The proposal is compatible with the required lot area requirements of Section 4-706
R-1) of Title IV, Ordinance No. 1628, Code of General Ordinances.
7. Available records do not indicate that an area wide land use or zoning analysis
has been accomplished other than a general Comprehensive Plan analysis conducted in
1965 in connection with adoption of the existing Comprhensive Plan. The requested
zoning of R-1 for the specific property does not appear to have been specifically
considered during that analysis (Section 4-3014. (A) ) .
8. The Comprehensive Plan Land Use Map indicates the property to potentially be
Single Family Residential (Section 4-3014. (B) ) .
9. Testimony did not address the impact of public and/or private improvements upon
the subject property (Section 4-3014. (C) ) . Reclassification in the vicinity
occurred prior to 1963. Subdivision activity within Blocks 1 and 2 of Stewart's
Highland Acre Tracts (those lots abutting and on the north and south sides of N.E.
7th Street between Monroe Avenue N.E. and Queen Avenue N.E.) appears to pre-date
the existing Subdivision Ordinance.
10. Restrictions upon the plat of Stewart's Highland Acre Tracts (Exhibit #6) indicate
that the minimum lot size that can be created is 6,000 or 8,000 square feet (the
reproduction of the plat certificate renders precise reading difficult) . Although
this restriction is not enforced by the city, the applicant per Exhibit #3 intends
to divide one 28,700 square foot lot into two lots.
11. Those lots abutting N.E. 7th Street and adjacent to or across this street from the
subject site consist of the same lot size of approximately 28,700 square feet
Exhibit #2) . With one exception, lots with only frontage on N.E. 7th Street (not
additional frontage on Monroe Avenue N.E. or Queen Avenue N.E.) possess about
28,700 square feet. The one exception is a pre-Subdivision Ordinance short plat
of a 28,700 square foot lot into two lots (Lot No. 7, Block 2) . Lots fronting on
Monroe Avenue N.E. and Queen Avenue N.E. are smaller lots, ranging in size from
approximately 5,700 square feet to 20,000 square feet. Exhibit #6 indicates
that property configurations in Blocks 1 and 2 exist as recorded in 1946, except
for shortplatted Lots 3 and 7, Block 2, and rezoning to R-1 and subdivision of
Lot 14, Block 1. i
The immediate abutting areas surrounding this plat have been developed into
approximately 6,000+ square foot lots under S-1 and GS-1 zoning.
CONCLUSIONS:
1. The proposal conforms to the Single Family Residential category specified in the
Comprehensive Plan Land Use Map; however, little guidance is provided in the
Comprehensive Plan goals and objectives regarding the specific density desired
in the Single Family Residential designation.
Existing zoning regulations provide for densities of 7,200 square foot (R-1 and
S-1) , 7,500 square foot (SR-1) and 40,000 square foot (S-1) lots, depending upon
interpretation. Each of these zoning districts meets the density guideline of
six units per acre of. the Comprehensive Plan for the Single Family Residential
district (page 5, Section 4.B. , Density Plan, Renton Urban Area Report, July,
R-312-79 Page Three
zoning, unlike other rezones of property located on the periphery of a neighborhood and
not requiring pipestem access to a public street. He advised the opinion of several
residents of the existence of restrictive covenants restricting further subdivision of
lots within the tract, and requested submittal by the applicant of substantiating
documents to disprove the existence of the covenants.

Mrs. Bach felt it is the responsibility of the purchaser of property to be aware of
existing zoning, noting that other building sites are available which are currently
zoned for the proposed use. She felt that the responsibility of adjusting to the
desires of the developer should not be expected of existing residents.
The Examiner requested further comments from Mr. Clemens. Responding to testimony from
Mr. Michael Smith, Mr. Clemens indicated that lot sizes in adjacent properties had been
reviewed, and information contained in Section L.8 of Exhibit #1 is correct and will
remain as submitted.
The Examiner requested further, comments from the applicant. Mr. Whitson indicated that
although it is his intent to retain existing trees for visual, esthetic value, as owner
of the property removal of existing trees is his option, and advised that location of
the proposed residence would allow retention of many trees on the northern portion of
the property. Mr. Whitson referenced comments from residents that approval of the
subject rezone would establish a precedent in the neighborhood and allow further
subdivision of property, and noted that if all residents oppose further rezones and
subdivision of their own property, such land use changes would not occur. He reaffirmed
his intent to subdivide the property into a maximum of two parcels for the purpose of
constructing one additional single family residence, noting that existing conditions would
preclude provision 'of a public street or several septic tanks within the site which are
required if additional lots are created. He also indicated that Planning Department staff
had determined the proposed zoning category following discussion with the applicant
regarding his intent to construct one residence. Responding to testimony from Mrs. Bach,
Mr. Whitson indicated the current unavailability of zoned, buildable single family
residential lots.
The Examiner requested further comments. Responding was:

Mrs. Hinze was affirmed by the Examiner. She indicated that her residential lot had
been rezoned to R-1 category in 1961 and access is provided to Queen Avenue N.E. However,
she advised that if the subject rezone is approved, a vacant lot to the west of her
property would be developed into four lots and would require pipestem access to N.E.
7th Street which would create adverse impact upon the neighborhood.
The Examiner inquired if city records had revealed information regarding previous division
of Lot 7 of Block 2. Mr. Clemens indicated that subdivision had occurred prior to
adoption of subdivision regulations. The Examiner requested confirmation of the
requirement of provision of a 50-foot right-of-way if subdivision of a lot into more than
two parcels occurred. Mr. Clemens confirmed the Examiner's statement, noting that
provision of a public access and cul-de-sac would possibly allow a potential increase
of the original three lots into seven or eight lots.
The Examiner asked Mr. Whitson if restrictive covenants had been included with a title
report upon purchase of the subject property in September, 1978. Mr. Whitson researched
his records and submitted a copy of the title report. The document was entered as follows:
Exhibit #6: Plat restriction contained in
Transamerica Title Report, dated
September 21, 1978.
The restriction was read into the record as follows: "No lot or portion of a. lot of the
plat excepting those lots which are hereinafter restricted to business use, shall be
divided and sold, or resold, or ownership changed or transferred, whereby the ownership
of any portion of this plat shall be less than the area required for. the use district
stated on this plat, namely 6,000 square feet for suburban use with a minimum lot width
of 60 feet."
The Examiner requested further comments. ' Since there were none, the hearing on File No.
R-312-79 was closed by the Examiner at 10:05 a.m.

Pursuant to Title IV, Section 3015 of the City's Code, request for reconsideration must
be •filed in writing on or before April 6, 1979. Any aggrieved person feeling that the
decision of the Examiner is based on erroneous procedure, errors of law or fact, error
in judgment, or, the discovery of new evidence which could not be reasonably available
at the prior hearing may make.a written request for review by the Examiner within
fourteen (14) days from the date of the Examiner's decision. This request shall set
forth the specific errors relied upon by such appellant, and the Examiner may, after
review of the record, take further action as he deems proper.
An appeal to the City Council is governed by Title IV, Section 3016, which requires
that such appeal be filed with the City Clerk accompanying a filing fee of $25.00 and
meeting other specified requirements. Copies of this ordinance are available for
inspection in the Finance Department, first floor of City Hall, or same may be purchased
at cost in said department.

2. Sufficient evidence was presented to demonstrate that the proposed rezone was not
specifically considered at or during a,previous area land •use analysis and area
zoning (Section 4-3014. (A) ) . However, this finding in the affirmative must be
considered together with other conclusions herein.
3. Consideration of the reclassification raises the issue of "spot. zoning" of an
individual parcel within the plat of Stewart's Highland Acre Tracts: This plat
appears to constitute a small neighborhood that remains substantially unchanged
since subdivision in 1946. Evidence indicates that •the benefit to be derived .
from the rezone accrues only to the applicant without demonstrated benefit to
the public health, safety or welfare. The requested R-1 is generally inconsistent
with the dominant character and development of this neighborhood. Potential harm
to adjoining properties,has been indicated, although with little support. This
property is a small portion of the neighborhood and constitutes an island within
it.
Therefore, the Examiner is led to the conclusion that the request appears to
essentially comprise a spot zone.' On this basis alone the application should be
denied.
4. However', the goals and policies of. the Comprehensive Plan should also be consulted.
I.t seems that appropriate ". . .land use principles. . ." and "coordinated development. . :"
page 9, Ibid) would suggest that most compatible with abutting development would
be the retention of existing development and zoning. (Section 4-3014. (B) ) . Otherwise,
R-1 would potentially be ". . .unwarranted infiltration of incompatible uses which
would contribute to premature decay and obsolescence. . ." (page 17,: Objective No.
1, Land Use Report, July, 1965) . Retention of existing zoning would constitute
effective control of land use. . ." (Objective No. 4, Ibid) and be the ". . .
highest arid best use in such a way as to promote the best interest of the community
and contribute to its overall attractiveness and desirability as a place in which
Objective No. 6, page 18, Ibid) .
Since the plat of Stewart's Highland Acre,Tracts was approved in 1946,, only slight
modifications .have Occurred in the original configuration (See Finding No. 11) .
It appears that the plat has remained in. essentially a stable condition since .
approval with encroachments occurring either at. the easterly end (Lot 14, Block 1)
or along the abutting properties in all directions surrounding the plat. Despite
considerably more dense surrounding single family' development, the plat is essentially
in the. same Configuration as adopted in 1946: This would indicate stability and
potential erosion by denser zoning and. development within the plat.
RECOMMENDATION:
Denial of the application.
