C . HISTORY/BACKGROUND :
The subject site was annexed into the City by Ordinance #2249 da ed
June 22, 1966. The existing G zoning was applied upon annexatio .
D. PHYSICAL BACKGROUND:
1. Topography : The property rises from west to east at approxi ately
a 5% grade .
2. Soils : Alderwood Gravelly Sandy Loam (AgC ) . Permeability is
moderately rapid in the surface layer and subsoil and very s ow
in the substratum. Runoff is ,slow to medium and the erosion
hazard is moderate . This soil is used for timber , pasture , ,erries ,
row crops and for urban development.

from Union Avenue NE , they will have to be extended across City
of Renton or other properties .
6. The Fire Department indicates that all hydrants and access shall
be installed and serviceable prior to any building construction .
Hydrants and watermains shall be installed per water engineering
requirements and future structures shall meet " the 'aniform Fire
Code for occupancy type . See other. comments .
7. The Utilities Engineering Division noters .that.'water and sewer
plans will have to be approved and hookup fees will' be; assessed .

M. DEPARTMENTAL RECOMMENDATIONS :
Based upon the apparent access difficulty that exists , R-.3 zoning
may be approved only if appropriate direct public access is . assured.
This can be accomplished by the applicant providing dedication
and improvement of a public street with' 36 ' curb-to-curb w-idth .
including: Curb ,.' gutter, `sidewalk , street paving , storm- dr-ainage',
and street .lighting ' at a location to 'the 'approval :.of the Planning
and Public Works Departments . Such rezone,,is further subject to
the following conditions in the form of -restrictive covenants run-
ning With the Land .
1 . Site development. approval . Specific site development, plans
including site plan , landscape plan , building elevation _design ,
and parking ,and circulation shall be reviewed and approved by
the ' Hearing .Examiner-,
2 . Existing evergreen trees shall be preserved as much as possible
and incorporated into site design , development and landscape
plans . No such trees shall be cut or removed without approval

Pursuant to the City of Renton' s Environmental Ordinance and the
State Environmental Policy Act of 1971 , as amended , RCW 43-21C•, a
negative declaration of environmental impact has, been prepared ' or
rezone only, and subject to, further environmental review at the time
of site development..

L. ' PLANNING DEPARTMENT ANALYSIS :
1 . The ,proposed:,rezoneto R-3is . consistent with most of the l : nd use
element of the Comprehensive Plan ,..except' for the greenbelt portion
in the westerly section of the' site corresponding to the po erline
right-o.f-way bisecting the site .
2.'. -The: proposal is generally consistent with existing ' zoning and
land uses in the vicinity (i .e . R-3 , B-1 zone , newly const ucted
apartment complex and existing business uses to the. north) ,
3. .: The , Stone Property immediately adjacent to the north was r=zoned
to R-3 by Ordinance #3247' of' September 22 , 1978 . The' •Wehr an
property to the northwest and the Swanson property to the orth wer(
rezoned to B- 1 at the same time . The Examiner' s conclusio s
and recommendations are attached . ,
4. Although the proposal is consistent with the Comprehensive
Plan Map Element, the Comprehensive Plan Land Use Report ,
Residential , Page 11 , states that "convenient access to major
arterials and highways is important. " The purposes and objectives
of the , comprehensive plan , streets and arterials also stat- s that
street patterns compatible with and complimentary to the !eneral
land use plan . . " should be considered . The only apparent
access to the site is an unimproved 30-foot wide road exte ding
westerly from Union Avenue NE. This would not. meet City o Renton
requirements for direct public access .. The applicant has nit
addressed this matter in the application . In R-165-78 the Examiner
stressed in Conclusion #1 that "Adequate access to the site
per applicable city requirements must be. provided . " In his
recommendation , the Examiner made 'this one of his 'conditions
of approval for the rezone. It would seem reasonable , th- refore,
that this and the other conditions would be appropriate for the
subject request given the . close:::prox'imi ty to and simi l ari oy
of circumstances to the Stone rezone ,
5. It is unclear as to how utilities will be provided to the site .
If they are to be provided from NE 4th Street , they will ave to be
extended the entire distance across the apartment complex
1. The proposal generally Forms to the Comprehensive Pla Section 4-3014. (B) )
except for access. Adeeuace access should be provided t ne site prior to
development of the site. Perhaps the most appropriate and expeditious solution
would be to incorporate this needed access into the development of adjacent
properties. However, access becomes critical relative to actual development,' not
the reclassification. Adequate access to the site per applicable city requirements
must be provided. This can be reviewed during review by the Examiner of the
development site plan.
2. The area immediately surrounding the property 'is undeveloped despite the B-1 zoning
to the north. ' Low -density single family: zoning, (G) directly abuts the B-1 zone
without benefit of buffer or. transition. Some transition or buffer is necessary
between the two zones at the subject site. This would be the appropriate use of
land use principles. . ." and the' ". . .coordinated development of undeveloped
areas." (Summary, page 9, Comprehensive Plan, Renton Urban Area, July, 1965) .
Otherwise, potential multi-family and/or commercial development might be ". . .of
incompatible uses which would. . .prevent the development of orderly growth patterns."

It was stated that the B-1 property north of and adjacent to. the site is proposd
for development of 220+ multiple family dwelling units. The development plans
were not submitted or .required, but Section 4-711 (B-1) and 4-709.B (R-4) allow a
building height of.'six stories "or 95 feet. If such height is not in fact proposed,
even the density above requires transition to the low density single family G
property.
iMedium density multi-family '(R-3) can. provide this transition if appropriate
restrictions 'are placed upon the rezone. The R-3 conforms to the Comprehensive
Plan Land Use .Map designation for the subject site. The property south of and
abutting the site is. also, des'ignated .to possibly be R-3; however, until it is
developed •beyond the existing single .family• use, it should be considered as single
family (G) property.
3. The adjacent andeasterly. city-owned property (undeveloped). is compatible with
R-3 zoning. Buffering is not required along this portion_of the subject site.
Normally the R-3 zone rear yard setback is 20 feet and side' yard setback is five
feet (Sections 4-709.A. , B.-, and D. ) :' This appears insufficient when the abutting
property is G. ' The setback along the south and west portions .;of the site should
therefore be .enlarged to 30 feet.
Furthermore, the building height should be reduced from 60 feet to 35 feet, that
height for single family ,development, in- order to complete the transition and
buffering. Review of .the site plan by the Examiner in a public hearing is
appropriate for final review of compliance with this and other conditions.
4. Existing vegetation,' Particularly the substantial trees, should be retained as much
as possible to contribute. towards resolution of storm drainage problems. Drainage
and vegetation retention can be reviewed with specific development plans.
RECOMMENDATION:
Based upon the record, testimony, findings and conclusions, it is the recommendation of
the Examiner that- the City Council- approve the reclassification from G to R-3 subject
to: I
1. Provision of adequate access to and from the property per applicable city ordinances
and regulations.
2. Retention of existing vegetation as much as,. possible.
3. Building setbacks of 30: feet along the southerly and westerly boundaries of the
property.
4. Building height of 35 feet. - •
5. Review of the development site.-plan by the' Examiner in a public hearing for
compliance with the aforementioned conditions.

1. The proposed rezone to R-3, is consistent with the Comprehensive Plan ap
element which designates: thesite and area south of the: site as medium density
multiple `family residential .
2. The proposal is .generally consistent with existing zoning- and land use- to the
north (i.e. , B-1 zone, proposed apartment complex, and existing busine•s uses).
3. -Although the proposal is consistent with the1Comprehensive Plan Map Element, the
Comprehensive-:Plan.,Land; Use Report, Residential 9: page 11, states that convenient
access to major ,arterials and highways is important". The' purposes an" objectives
of the comprehensive plan, streets and- arterials also states that' "str,et patterns
compatible with and complimentary to the general land use plan. .-" shou d be
considered. The subject site appears to- be land locked without proper public
access. -,,No consideration of access has been addressed in the applicat on.
4. It is possible with the development of an access street to the east o 'connect
to Union Avenue N.E. that sufficient access will be provided 'to the si e, However,
from the information that has been provided, no access is provided to ' he east,
north, west, or. south.
5. It is not clear how utilities will be- provided to the site. ' If they are to be
provided from N.E. 4th Street, they will need to be extended the enti e distance
across the proposed apartment complex property north and adjacent to ' he subject
site. If they are to be provided from Union Avenue N.E., they will n:ed to be
extended across City of Renton property or the Wehrman property.
P. STAFF RECOMMENDATION:
Based on the apparent access problem that exists, R-3 zoning' May be appro ed 'only if
suitable public access is assured. This could be accomplished by.dedicat ott of norther
30 feet of the subject site together with similar dedication on the adjac:nt properties
to the north (proposed apartment complex), past (City of Renton property) and north-
east (Wehrman property). Such rezone is further subject to the following conditions
in the form of restrictive covenants running with the land:
1. Site development approval. Specific site development plans includin: site plan,
landscape plan, building elevation design, and parking and circulatii•n shall be
reviewed and approved by the Hearing :Examiner. . T
2. Existing evergreen trees shall be preserved as much as possible and ' corporated
into site design, development, and landscape plans., No such trees s all be cut
or removed without approval of the Planning Department. Detailed 1. escape and
open space plans shall be approved by the Planning Department at the time of site
devleopmen` t' review.
3. All utilities shall be provided ' Public Works Department approval comprehensive

required preservation of existing evergreen trees. Mr. Munson indicated that removal
of vegetation on the easterly portion of the site would be subject to Planning Department
review and approval. The applicant referenced Section I.3 (Impact on the Natural or
Human Environment,- Schools) and stated that due to the existing power line easement on
the site, proposed density would be much less than estimated in the Planning Department
report which would subsequently reduce the impact upon school population.
The Examiner inquired regarding proposed plans for facilities which will be developed
under the transmission easement. Mr. Wolf advised that final plans have not been
completed.
The Examiner requested testimony in support of the application. Responding was:

Mr. Homer indicated that dedication to the city of sanitary sewer lines located under
the transmission easement would be completed by the end of the week. He also advised his
understanding that the intersection located at N.E. 4th Street and Union Avenue is
proposed for improvement to provide channelization for left turn movements. Mr. Clemens
confirmed the proposal contained in the first year of the Six Year Street Program to
alleviate current traffic congestion in the area.
The Examiner requested further testimony in support or opposition to the application.
There was no response. He then requested final comments from the Planning Department
staff. Since there were no further comments, the hearing on File No. R-342-79 was
closed by the Examiner at 10:45 a.m.
FINDINGS, CONCLUSIONS & RECOMMENDATIONS: Having reviewed the record in this matter, the
Examiner now makes and enters the following:
FINDINGS:
1. The request is for approval of a reclassification of +3.13 acres from General (G)
District to R-3 District for the future development of multi-family residential units.
2. The Planning Department report, as modified, sets forth the issues, applicable policies
and provisions, findings of fact, and departmental recommendations in this matter, and
is hereby attached as Exhibit #1 and incorporated in this report by reference as set
forth in full therein.
3. Pursuant to the City of Renton's Environmental Ordinance and the. State Environmental
Policy Act of 1971, R.C.W. 43.21.C. , as amended, a Declaration of Non-Significance
has been issued for the subject proposal by Gordon Y. Ericksen, responsible official.
4. Plans for the proposal have been reviewed by all city departments affected by the
impact of this development.
5. There was no opposition to the proposal expressed.
6. All existing utilities are available and in close proximity.
7. The subject site is located approximately 750 feet south of N.E. 4th Street.
The property was annexed into the city by Ordinance No. 2249, dated June 22, 1966,
and it was at that time that the present G zoning was applied.
8. Except for a single family residence in the southeast portion of the property, the
site is mostly undeveloped. The site is traversed in an approximate north-south
direction by a BPA transmission line easement. There is a significant stand of
trees in.the easterly portion of the site.
9. The land use in the area consists of the Greenwood Cemetery to the west; Leisure
Estates Mobile Home Park to the south; and scattered single family homes to the east.
A large apartment complex lies to the north along N.E. 4th Street.
This general area has been in transition from undeveloped and scattered homes to
commercial and apartment uses.
10. The Comprehensive Plan's map element indicates that this area would best be developed
as a mix of commercial, medium density residential and greenbelt. The greenbelt
designation appears to. be directed toward the power line easement in the westerly
portion of the site.

checking the property arid surrounding area, the Examiner
conducted a public hearing on the subject as follows:
The hearing was opened on May 22, 1979 at 10:30 a.m. in the Council Chambers of th- Renton
Municipal Building.
Parties wishing to testify-were affirmed by the Examiner.
It was reported that the Hearing Examiner and the applicant had received and revie ed the
Planning Department report, and the report was entered into the record as Exhibit #1.
Steve Munson, Planning Department, reviewed Exhibit #1, and entered the following additional
exhibit into the record:
Exhibit #2: King County Assessor's Map
David Clemens, Planning Department, corrected Sections I.2 and I.5 of Exhibit #1 •o state
that the- proposal will contain 94 units .and will increase traffic in the area by
approximately 570 trips 'per day.
The Examiner requested a departmental recommendation regarding proposed access si' ce the
property does not directly connect to an unimproved right-Of-way located north of the site,
and inquired if the unimproved roadway extends through city-owned property to the east.
Mr. Munson advised the intent of the applicant to utilize property currently zone• for
development located east of the site as part of future development, and confirmed that
the unimproved right-of-way extends through city-owned property.
The Examiner requested testimony by the applicant. Responding was:

Mr. Wolf indicated his understanding from review of Planning Department records. t at the
existing unimproved right-of-way ,is proposed for full improvement to a 60-foot public
street, and indicated the applicant's intent to provide, access via that right-of- ay
through property located north of ,the site. Mr'. Munson confirmed that although a full
street is proposed, dedication of the city property has not yet occurred. The Ex: iner
inquired regarding the applicant's, intent in providing utility services to the si e.
Mr. Wolf advised that an existing sanitary sewer line extends through the propert, .
adjacent to the power line easement, and a water line is available within the uni proved
right-of-way north of the site. Mr. Munson advised that participation by the property
owner to the north of the site could occur concurrently in improvement of the rig t-of-way
prior to development.
Mr. Wolf requested confirmation of. extent of improvements to the,roadway. Mr. M nson
indicated that improvements including curb, gutter, sidewalk, street paving, sto m •
drainage and street lighting as denoted in the Planning Department recommendatio would
be required. Mr. Wolf asked Mr. Munson to identify on Exhibit #2 the location o

4. There have been some recent rezones in the area immediately adjacent to the subject
property and a number of new developments have been built both north and south of the
subject property. There are also some proposals for other properties in the vicinity
in the development stage. Therefore, it is timely to consider this rezoning application
for the subject property.
5. The properties to the north have been subject to certain development conditions to
permit a smooth transition between the more intense uses along N.E. 4th Street and
the remaining G zoning. This property should also be required to balance its proposed
uses with existing conditions such as the mobile home park on the south and the G
zoning along the west. To facilitiate this transition the subject site should limit
both the height of the development and the setbacks. The 35-foot height limitation
is reasonable for a transition between the existing uses and a 30-foot setback would
create a reasonable buffer between the proposed uses and the existing uses. Development
of this property subject to the enumerated conditions should permit the development of
uses which are compatible with surrounding development and provide much needed housing
in the eastern portion of the city.
RECOMMENDATION:
It is the recommendation of the Examiner that the City Council approve the reclassification
from G to R-3 subject to:
1. Provision of adequate access to and from the property per applicable city ordinances
and regulations.
2. Retention of the existing vegetation, with the approval of the Planning Department
before any trees are removed.
3. Approval of the Planning Department of all site and landscape plans.
4. Building height is not to exceed 35 feet.
5. Building setbacks along the southern and western boundaries should be not less than
30 feet.
6. Participation in any future LID to improve access to the property; including but not
limited to Union Avenue S.E. and N.E. 4th Street.
7. Execution of restrictive covenants incorporating these conditions signed by the
owners of the property.

11. The zoning in the area reflects the uses present. Toward the north the zoning is
B-1 and R-3. The cemetery to the east is designated G, and the mobile home pa is
T zoning.
12. The site has no adequate access available. The areas to the north were requir=d to
dedicate property for the eventual construction of an east-west street connect'ng
with Union Avenue N.E. The applicant stated at the hearing that by various ag,eements
the subject site will be able ,to use the .proposed new street.
13. Both the mobile home park and the apartment complex were recently developed. cross
N.E. 4th Street a proposal exists to develop a commercial office complex.
CONCLUSIONS:
1. The proponent of a rezone must demonstrate compliance with at least one of the three . .
criteria of Section 4-3014 which provides in part' that:
a. The site has not been considered in a previous area wide rezone;
b. The subject site is potentially zoned for the new classification per the
Comprehensive Plan; or
c. There have been demonstrated changes in the area since the last rezoning a tion.
The applicant and Planning Department have demonstrated that the necessary cri eria
to permit a rezone of' the subject property have been met.
2. The G classification which the property is now zoned was automatically applies to the
site when it was annexed, into the city. The procedure is followed whenever a .
annexation occurs (Section 4-729: (B) ) . The G classification is basically a pr•tective
classification which enables the city to study the area in question at a late Lime
to determine the area's appropriate use.
The Comprehensive Plan is the only action besides the annexation which dealt ith
the area in which the subject site is located. No Other actions have considered the
area's potential since annexation.
3: The Comprehensive Plan generally' indicates that the area in which the subject property
is located is suited for the classification for which the applicant has applied. The
property is divided by the transmission line.and this area is designated as g een belt.
Also a part of the area appears to have been potentially designated for comme cial use.
The Comprehensive Plan though is not an absolute indicator of a specific site s use -
zoning accomplishes that purpose. The classification which an area is zoned .hould
depend on the adjoining area's classifications as well as the best use for th- subject
property.
The zoning applied for appears to meet the objectives of the Comprehensive Plan to
provide medium density residential zoning in the area. The R-3 zoning would se
compatible with surrounding uses, as .they exist, and proposed uses of adjoini g areas.
To the north the B-1 zoning is used almost exclusively for multi-family apart ents.
The mobile home park to the south provides the amenities of single family dwellings
and would be compatible with the probable use of this property for medium density
residential development.
The subject property does suffer from the lack of adequate access which the Comprehensive
Plan indicates as necessary for the proposed use of this land. "Convenient .ccess to
major arterials and highways is. important" and "street patterns compatible w'th and
complimentary to the general land use plan" are desirable when proposing residential
development (Comprehensive Plan, Land Use Report, Residential; page 11) .
The applicant concedes that access is necessary and maintains that it will b= provided
via the property to the north. In order to insure appropriate access to the property,
such access should ,be•made a condition of approval. The condition should no'
foreclose the applicant's potential development scheme and therefore it will not
require a particular method or location for the access.
The Comprehensive Plan as previously noted showed that the transmission• line easement
was appropriate for the provision of green belt and such use of the easement is .
reasonable. Therefore, the applicant should make provision for open space/recreational
use of this area. Also, along similar lines, the applicant should preserve Js much of
the natural character of the property as possible (Comprehensive Plan, page 1) and
therefore, per the Planning Department's recommendation, the stand of trees •n the
easterly portion.of the property should be preserved.

An appeal to the City Council is governed by Title IV, Section 3016, which requires
that such appeal be filed with the City Clerk accompanying a filing fee of $25.00 and
meeting other specified requirements. Copies of this ordinance are available for
inspection in the Finance Department, first floor of City Hall, or same may be purchased

WHEREAS, Josephine O. Nunn, a single woman, is the owner of the following real
property in the City of Renton, County of King, State of Washington, described as
follows:
Tax Lot No. 21/Tax Account #162305-9021-06:
The North 1/2 of the Southwest 14 of the Northeast Is of the Northeast h of Section
16, Township 23, Range 5, EWM, less North 125 feet.
WHEREAS, the owner of said described property, hereinafter "the property,"
desires to impose the following restrictive covenants running with the land as to
use, present and future, of the property;
NOW, THEREFORE, the aforesaid owner hereby establishes, grants and imposes
restrictions and covenants running with the land as to the use of the land hereinabove
described with respect to the use by the undersigned, her successors, heirs and assigns,
as follows:
ACCESS
Development of the site shall be subject to provision of adequate access to and
from the property per applicable' city.ordinances and regulations.
The owner of the above described property, her successors, heirs and assigns,
hereby agree and covenant to participate in, sign a petition in support of, and accept
any future Local Improvement District (LID) or city initiated proposal, and pay their
fair share therefore, for the purposes of providing the necessary off-site improvements,
including but not limited to Union Avenue S.E. and N.E. 4th Street, required by the
Renton Subdivision Ordinance. Said improvements shall include but may not be limited
to the installation of curbs, gutters, sidewalks, street paving, sanitary sewers,
storm sewers, undergrounding of utilities, and street lighting.
SITE DEVELOPMENT
All site and landscape plans shall require approval by the Planning Department,
City of Renton. Retention of existing vegetation is recommended, and Planning
Department approval is required prior to removal of any trees on the site.
The building height shall not exceed 35 feet.
The building setbacks along the southern and western boundaries shall not be
less than 30 feet.
DURATION
These covenants shall run with the land and expire on December 31, 2025. If at
any time improvements are installed pursuant to these'covenants, the portion of the
covenants pertaining to the specific installed improvements as required by the
Ordinances of the City of Renton shall terminate without necessity of further
documentation.
Proper legal procedures in the Superior Court of King County may be instigated
by either the City of Renton or any property owners adjoining subject property who
are adversely affected by any violation or breach of these restrictive covenants.
Reasonable attorneys' fees incurred during an enforcement proceeding will be
borne by the parties whom the court determines are in error and shall be entered
as a judgment in such action.

AN ORDINANCE OF THE CITY OF RENTON, WASHINGTON
CHANGING THE ZONING CLASSIFICATION OF CERTAIN
PROPERTIES WITHIN THE CITY OF RENTON FROM GENERAL
CLASSIFICATION DISTRICT (a) TO RESIDENCE DISTRICT_
R-3) R-342-79/NUNN
WHEREAS under Chapter 7, Title IV (Building Regulations) of Ordinance
No. 1628 known as 'the "Code of General Ordinances of the City of Renton", as
amended, and the maps and reports adopted in conjunction therewith, the property
hereinbelow described has heretofore been•zoned as General Classification (G); and
WHEREAS a proper petition for change of zone classification of said property
has been filed with the Planning Department on or about April 24, 1979, which petition
was duly referred to the Hearing Examiner for investigation, study and public hearing,
and a public hearing having been held thereon on or about May 22, 1979,,and said
matter having been duly considered by the Hearing Examiner and said zoning request
being in conformity with the City's Comprehensive Plan, as amended, and the City
Council having duly considered all matters relevant thereto, and all parties having been
heard appearing in support thereof or in opposition thereto, NOW THEREFORE
THE CITY COUNCIL OF THE CITY OF RENTON, WASHINGTON, DO
ORDAIN AS FOLLOWS:
SECTION I: The following described property in the City of Renton is
hereby rezoned to Residence District (R-3) as hereinbelow specified; subject to the
findings, conclusions and decision dated May 25, 1979; the Planning Director is hereby
authorized 'and directed to change the maps of the Zoning Ordinance, as amended, to
evidence said rezoning, to-wit:
See Exhibit "A" attached hereto and made a part hereof
as if fully set forth herein.
Said property being located at approximately 750 feet
South of N.E. 4th St. along the Queen Ave extension
between Greenwood Cemetery on the west and the City
of Renton property on the east)'
AND SUBJECT FURTHER to that certain Declaration of Restrictive Covenants executed
by Petitioner-owners on or about June 1, 1979 and recorded in the office of the
Director of Records and Elections,Receiving No. 7906180679 and which said Covenants
hereby incorporated and made a part hereof'as if fully set forth.
SECTION II: This.Ordinance shall be effective upon its passage, approval
and five days after its publication.

CONCLUSIONS:
1. 'The proposal generally brills to the,Corhprehensive Pla ection 4-3014. (B) )
except for access. Adequate access should be provided site prior to
development of the site. Perhaps the most appropriate and expeditious solution
would be to incorporate this needed access into the development of adjacent
properties. However, access becomes critical relative to actual development, not
the reclassification. Adequate access to_the' site per applicable city requirements
must be provided. This can be reviewed during review by the Examiner of the
development site plan. : .
2. The area immediately surrounding the property .is undeveloped despite the B-1 zoning
to the' north._ Low density tingle family zoning (G) directly abuts-the B-1 zone
without benefit.of,buffer or transition. Some transition or buffer is necessary
between the two zones at the subject site. .,This would' be the appropriate use of
land use principles.,. ." and the ". . .coordinated'development'of undeveloped
areas." (Summary, page'9; Comprehensive Plan, Renton Urban Area, July, 1965) .
Otherwise, potential multi-family and/or commercial development might be ". . .of
incompatible uses which would. ..prevent the development of orderly growth patterns."

It was stated that the' B-1 property north of and adjacent to the site is proposed
for development of 220+.multiple family dwelling units. Three development plans
were not submitted or required, but Section 4-711 (B-1) and 4-709.B (R-4) allow a
building height of six; stories or 95 feet. If such height, is not in fact proposed,
even the density above' requires transition to the low density single family G
property.
Medium density multi-family (R-3) can provide this transition if appropriate
restrictions are placed upon the rezone. The R-3 conforms to the Comprehensive
Plan Land Use Map designationfor •the subject site. The property south of and
abutting the site is also _designated to possibly be R-3; however, until it is
developed beyond the existing single family use, it should be considered as single
family (G) property.
3. The adjacent and easterly city-owned property (undeveloped) is compatible with
R-3 zoning. Buffering is not required along this portion of the subject site.
Normally the R-3 zone rear yard setback is 20 feet and side yard setback is five
feet (Sections 4-709.A'. ,. B. , and D.) . This appears insufficient .when the abutting
property is G. The setback along the south and west portions 'of the site should
therefore be enlarged to- 30 feet.
Furthermore, the building height should be reduced-from 60 feet to 35 feet, that
height for single family development, in order to complete the transition and
buffering. Review of the site plan by the Examiner in a public hearing is
appropriate for final, review of compliance with this and other conditions.
4. Existing vegetation', particularly the substantial trees, should be retained as much
as possible to contribute towards resolution of storm drainage problems. Drainage
and vegetation retention can be reviewed with specific development plans.
RECOMMENDATION:
Based upon the record, testimony, findings and conclusions, it is the recommendation of
the Examiner that the City Council approve the reclassification from G to R-3 subject
to:
1. Provision of adequate access to and from the property per applicable city'ordinances
and regulations.
2. Retention of existing, vegetation as much as possible.
3. Building setbacks of, 30feet along the southerly and westerly boundaries of the
property.
4. Building .height of 35 feet.
5. Review of the development site plan `by the Examiner in a public hearing for
compliance with the aforementioned conditions.

0. STAFF ANALYSIS:
1.;' The ,proposed rezone to R-3 is consistent with the Comprehensive Plan map
element which designates the site and area south of' the site as medium density
multiple family- residential .
2. The proposal is generally consistent with existing zoning and land uses to the
north (i.e. . fl-1 zone. proposed apartment complex, and existing business uses).
3. 'Although the prbposal is consistent with the Comprehensive Plan Map Element, the
Comprehensive Plan Land Use Report, 'Residential , page ii, states that "convenient
access to major arterials and highways is important".. .The purposes and objectives
of the;comprehensive plan, streets and arterials also states that "street patterns
compatible with and complimentary to the general land use plan.." should be
considered. . The subject site appears to be land locked without proper public
access. No consideration of access has been addressed'. in the, application.
4. It is possible, with the development of an access street to the east to connect
to Union Avenue N.E. that sufficient access will be provided to the site. However,
from the. information that has been provided, no access is provided to the east,
north; west, or south.
5. It is not clear how utilities will be provided to the site. If they are to be
provided from N.E. 4th Street, they will need to be extended the entire distance
across the proposed apartment complex property north and adjacent, to the subject
site. if they are to be provided from Union Avenue N.E. , they will need- to be
extended across City of Renton property or the We'hrman property.
P. STAFF RECOMMENDATION:
Based on the apparent access problem that exists, R-3 zoning may be approved only if
suitable public access is assured. This could be accomplished by dedication of norther'
30 feet of the subject site together with similar dedication on the adjacent properties
to the north (proposed apartment complex), east (City of- Renton property), and north-
east (Wehrman property). Such rezone is further subject to the following conditions
in the form of restrictive covenants running with the land:
1. Site develcvment approval. Specific site development plans including site plan,
landscape plan, building elevation design, and parking and circulation shall be
reviewed and approved by the Hearing A . 'ner.
2. Existing evergreen trees shall be preserved as much as possible and incorporated
into site design, development, and landscape plans. No such trees shall be cut
or removed without approval of the Planning Department. Detailed landscape and
open space plans shall be approved by the Planning Department at the time of site
devleopment review.
3. All utilities shall be provided per Public Works Department approval comprehensive
utility plan at the time of si' • development.

M. DEPARTMENTAL RECOMMENDATIONS :
Based upon the apparent access difficulty that, exists , R-3 zoning
may be approved only if appropriate direct public access is assured.
This can be accomplished by the applicant providing dedication
and improvement of a public street with 36 '—curb-to-curb width
including curb , gutter, sidewalk , street paving , storm drainage,
and street lighting at a location to the approval of the Planning
and Public Works Departments. Such rezone ,.is . f_ur:ther subject to
the, following conditions in the form of restrictive covenants run-
ning with the land :

property to the northwest and the Swanson property to the north wer'
rezoned to B-1 at the same time . The Examiner' s 'conclusions
and recommendations are attached .
4. Although the proposal is consistent with the Comprehensive
Plan Map Element , the Comprehensive Plan Land Use Report ,
Residential , Page 11 , states that "convenient access to major
arterials and highways is important. " The purposes and objectives
of the comprehensive plan , streets and arterials also states that

land use plan . . " should be considered . The only apparent
access to the site is an unimproved 30-foot wide road extending
westerly from Union Avenue NE. This would not meet City of Renton
requirements for direct public access . The applicant has not
addressed this matter in the application . In R-165-78 the Examiner
stressed in Conclusion #1 that "Adequate access to the site
per applicable city requirements must be provided . " In his
recommendation , the Examiner made this one of his conditions
of approval for the rezone . It would seem reasonable , therefore ,
that this and the other conditions would be appropriate for the
subject request given the close proximity to and similarity
of circumstances to the Stone rezone.
5. It is unclear as to how utilities will be provided to the site .
If they are to be provided from NE 4th Street, they will have to be
extended the entire distance across the apartment complex

for approximately 750' . An 8" sanitary sewer is situated on NE

2. Fire Protection : Provided by the Renton Fire Department per
ordinance requirements .
3. Transit: Metro Transit Route #107 operates along Union Avenue
SE within 4 mile of the subject site .
