Dear Mr. Houghton:
Enclosed are copies of 1981 correspondence requesting that the
assessment for L. I .D. No. 314, which would normally fall against
lot one of Renton short plat No. 014-81, be formally transferred
by the City of Renton from lot one to lots two and three of the
short plat.
This letter is to renew the earlier request in light of the fact
that the L. I .D. is nearing certification.
Please note that the engineers on the project have segregated the.
amount of the preliminary assessment among the three lots in the
short plat, and have indicated to us that the tranfer of the
assessment can readily be accomplished if the City of Renton
approves it.
Please contact us if any further documentation or information is
required to process this request.

In connection with the above-referenced short plat, our clients,
Banyon Investment Group (Herman M. Allenbach) has agreed with the
purchasers of lot one of the short plat to pay for the above LID
assessment against lot one when and if it becomes final.
This letter is to formally request that at the time the final
assessment role is approved the assessment amount which would
normally become a lien against lot one of the above-referenced
short plat be shifted to lots two and three of the short plat.
We have informed the consulting engineers (Ed Rudloff at Jones &
Associates) of this request. Please notify the undersigned if
additional documentation is necessary to complete this transfer
of assessment.

is enclosed.
During our calculation of the final assessment roll we will calculate
separate assessments for each lot of the short plat, as we would do

an assessment from one parcel to another. This can only be done upon
specific instructions from the City of Renton. For that reason I

REPORT AND DECISION .

SUMMARY OF REQUEST: The applicant seeks approval of a four-lot short plat for future
commercial uses.
SUMMARY OF ACTION: Planning Department Recommendation: Approval with restrictive
covenants
Hearing Examiner Decision: Approval of three-lot plat
PLANNING DEPARTMENT The Planning Department preliminary report was received by the
REPORT: Examiner on March 10, 1981 .
PUBLIC HEARING: After reviewing the Planning Department report, examining
available information on file with the application, and field
checking the property and surrounding area, the Examiner
conducted a public hearing on the subject as follows:
The hearing was opened on March 17, 1981 at 10:00 a.m. in the Council Chambers of the
Renton Municipal Building.
Parties wishing to testify were affirmed by the Examiner.
It was reported that the Hearing Examiner and the applicant had received and reviewed the
Planning Department preliminary report. Roger Blaylock, Associate Planner, presented the
report, and entered the following exhibits into the record:

Exhibit #2: Short Plat with staff comments
Mr. Blaylock indicated the Planning Department's concern regarding the narrow width of
the land in consideration of existing industrial zoning, although he felt the condition
could be mitigated through location of offices in the front and storage yards in the
rear of the lots. The Examiner inquired regarding the square footage contained in each
lot, and indicated concern regarding the number of curb cuts onto East Valley Road, a
major arterial . Mr. Blaylock indicated that Lot 1 contains approximately 49,000 square
feet, Lot 2 contains approximately 40 to 42,000 square feet, and Lots 3 and 4 each contain
more than an acre of land.
The Examiner requested testimony by the applicant. Responding was:

Mr. Lentz indicated that the specific square footage contained in Lot 1 is 72,898 square
feet, and information regarding the size of the remaining lots could be supplied to the
Examiner in a supplemental report. The Examiner requested that specific information be
submitted.
The Examiner requested further testimony in support of the application. Responding was:

Mr. Sheppard stated that ultimate land use on Lots 2, 3 and 4 would be compatible with
proposed use of Lot 1 with development of office space or professional offices. Responding
to the Examiner's inquiry regarding the number of proposed curb cuts onto East Valley Road,
Mr. Sheppard indicated the possibility of combining two of the lots for development
purposes and utilizing a joint entrance. Mr. Lentz confirmed that one curb cut could be
provided for Lot 1 and a shared entrance to the remaining lots could be proposed.

The Examiner requested further comments in support or opposition to the application.
There was no response. He then requested final comments from the Planning Department
staff. Mr. Blaylock advised that a variance from the provisions of the Parking and
Loading Ordinance would be required if a shared driveway were proposed.
The Examiner requested final comments . Since there were none, the hearing regarding
File No. Short Plat 014-81 was closed by the Examiner at 10: 15 a.m.
FINDINGS, CONCLUSIONS & DECISION: Having reviewed the record in this matter, the Examiner
now makes and enters the following:
FINDINGS:
1 . The request is for approval of a four-lot short plat on approximately 5.03 acres.
2. The application file containing the application, SEPA documentation, the Planning
Department report , and other pertinent documents was entered into the record as
Exhibit #1 .
3. Pursuant to the City of Renton 's Environmental Ordinance and the State Environmental
Policy Act of 1971 , R.C.W. 43.21 .C. , as amended, the subject proposal has been
determined exempt from the threshold determination by the Environmental Review
Committee, responsible official .
4. Plans for the proposal have been reviewed by all city departments affected by the
impact of this development.
5. There was no opposition to the proposal expressed.
6. All existing utilities are available and in close proximity.
7. The subject property is located in the vicinity of 3750 East Valley Road. The
property is located on the east side of the East Valley Road and is between that
road and SR-167.
8. The site is essentially level . The vegetation on the subject site is generally
scrub grass and weeds. The site is undeveloped.
9. The site was annexed into the city in 1959. A major portion of the site was
reclassified to its current classification of L-1 (Light Industry) in December of
1959 by Ordinance No. 1805 and the remainder to L-1 in 1979 by Ordinance No. 3323.
10. The applicant proposed dividing the subject site into four lots pursuant to Section
9-1105. Information regarding square footage contained in each lot was furnished to
the Examiner following closure of the public hearing in a letter dated March 18, 1981 .
Lot No. 1 would contain 72,898 square feet (1 .67 acres) ; Lot No. 2 would contain
45, 175 square feet (1 .04 acres) ; Lot No. 3 would contain 47,905 square feet (1 . 10
acres) ; and Lot No. 4 would contain 50,830 square feet (1 . 17 acres) . Each of the
lots would front on the East Valley Road. The largest of the lots, Lot No. 1 , would
contain a proposed restaurant , but there are no proposals for the remaining lots at
this time.
11 . The Comprehensive Plan indicates that the area in which the subject property is
located is suitable for the development of manufacturing park type uses.
12. The subject property has a total frontage on the East Valley Road of 620 feet.
The applicant proposes creating four separate lots which share that frontage in
the following manner: 230 feet, 130 feet , 130 feet and 130 feet for Lots 1 through
4, respectively.
13. The Arterials and Streets Plan of the Renton Urban Area Report designates East
Valley Road as a major arterial .
14. The applicant indicated that a three-lot short plat, with proposed Lot No. 1 maintained,
as proposed, would be a reasonable alternative to limit the number of driveways
intersecting the East Valley Road.
CONCLUSIONS:
1 . A short plat of the subject site will enable the applicant to create reasonably
sized lots to serve the growing industrial and commercial operations in the valley.
The Comprehensive Plan indicates that industry needs fairly large, level sites for
development. Although a short plat of the property will serve a legitimate purpose
and appears to serve the public use and interest, the creation of four lots will
increase the number of curb cuts on the East Valley Road, an identified major arterial .

2. In order to provide safe and efficient traffic ways in the city, the number of curbs
should be limited to a minimum on arterial streets. Access from abutting property
should be minimized pursuant to Policy 7.C.3 of the Streets Objective of the Policies
Element of the Comprehensive Plan (Page 16) .
3. One method to limit the number of curb cuts, especially in industrial areas, would
be to preserve the large lots and limit the potential number of lots which may be
created on any major arterial . The applicant had proposed four lots for the subject
property which would vary in size from an acre and two-thirds to just over an acre.
If the applicant divided the parcel into three lots of about an acre and two-thirds
each, the result would be one less lot requiring access. Installation of 10 feet of
landscaping along East Valley Road would make the subject property compatible with the
Manufacturing Park designation in the Comprehensive Plan. The applicant indicated
willingness to divide the property into three lots instead of the four originally
requested, and this alternative would better serve the public use and interest and
assure compatibility to the Comprehensive Plan and its Policies Element.
4. The resultant lots would each be approximately equal in size or about 72,000 square
feet each (about 1 .66 acres) . The lot size would still permit the applicant
reasonable use of the subject property and provide the large lots necessary for
industrial development. Rather than lock the applicant into a specific lot size,
the applicant may desire some alternative arrangement. Therefore, the short plat
will be approved for a three lot short plat and the applicant may set the lot lines
as necessary to divide the subject site into three lots.
DECISION:
The short plat is approved for a three-lot division of the subject property-subject to
the installation of required off site improvements and installation of 10 feet of
landscaping along the East Valley Road.

Pursuant to Title IV, Section 3015 of the City's Code, request for reconsideration must
be filed in writing on or before April 13, 1981 . Any aggrieved person feeling that the
decision of the Examiner is based on erroneous procedure, errors of law or fact , error
in judgment, or the discovery of new evidence which could not be reasonably available at
the prior hearing may make a written request for review by the Examiner within fourteen
14) days from the date of the Examiner's decision. This request shall set forth the
specific errors relied upon by such appellant, and the Examiner may, after review of the
record, take further action as he deems proper.
An appeal to the City Council is governed by Title IV, Section 3016, which requires that
such appeal be filed with the City Clerk accompanying a filing fee of $25.00 and meeting
other specified requirements. Copies of this ordinance are available for inspection in
the Finance Department, first floor of City Hall , or same may be purchased at cost in
said department.

The subject site was annexed into the City by Ordinance
No . 1743 of April 15, 1959. It was rezoned from R-9 .6
and A-i to L-1 by Ordinance No. . 1805 of December 8 ,
1959 . In addition a triangular-shaped parcel in the
southeast portion of the property was rezoned from G-9600
to L-1 by Ordinance No . 3323 of June 22 , 1979.

1 . Topography: The site is essentially level .
2. Soils : Urban land (Ur) is soil that has been modified
by disturbance of the natural layers with additions
of fill material several feet thick to accommodate
large industrial and housing installations . The
erosion hazard is slight to moderate .
3. Vegetation: Virtually the entire site is covered
with scrub grass and weeds.
4. Wildlife : The existing vegetation may provide
some habitat for birds and small mammals.
5. Water : No surface water was observed on the subject
site (March 5 , 1981 ) .
6 . Land Use: The subject site is presently undeveloped .
To the north is a construction company office and
to the east is the East Valley Freeway. The properties
to the south and west are vacant.
E. NEIGHBORHOOD CHARACTERISTICS:
The surrounding properties are developing into a mixture
of varied commercial and warehousing uses .
F . PUBLIC SERVICES:
1 . Water and Sewer : A 12" sanitary sewer and 12"
water main are located along the East Valley Road
adjacent to the westerly border of the subject
site .
2. Fire Protection : Provided by the City of Renton

on the East Valley Road by approximately 1390 vehicle

J . ENVIRONMENTAL ASSESSMENT/THRESHOLD DETERMINATION:
Pursuant to the City of Renton ' s Environmental Ordinance
and the State Environmental Policy Act of 1971 , as amended,
RCW 43-21C , the subject proposal is exempt from the
threshold determination of environmental significance .

1 . The proposed short plat is consistent with the
Comprehensive Plan land use designation of Manu-
facturing Park and L-1 zoning for the subject site
and surrounding area.
2. A +8,460 square foot restaurant is proposed for
Lot No. 1 of the plat while as yet undetermined
commercial and industrial uses are planned for
Lots No . 2 - 4. These uses can be considered com-
patible with those of the surrounding properties .
3. The proposal complies with the subdivision standards
for industrial developments under Section 9-1108(24) .
4 . The Engineering Division advises that a covenant
for participation in the L . I .D. #314 for street
and storm improvements will be required along the
East Valley Road. (Note: On February 25 , 1981 ,
the Board of Public Works agreed to defer the off-site
improvements adjacent to proposed Lot No. 1 for
a period of one year subject to posting of a bond.
The bond amount of $150, 000 or alternatively , an
irrevocable letter of credit is to be posted with
the Engineering Division prior to filing the subject
short plat) . See other comments.
5. Drainage channels , if needed , should be dedicated
as noted by the Building Department .
6. Future construction shall meet all city fire codes
and ordinances as per Fire Department comment .
