On May 13, 1981 , the Hearing Examiner approved the above
application with conditions. Section 9-1105-10 of the Renton
Subdivision Ordinance requires that the approved plat be
filed with the King County Department of Records and Elections
within one (1 ) year of the date of submission or the plat
shall be null and void. The applicant did not request a
six (6) month extension of this approval as permitted by
the Section. Therefore, the approval is considered expired
and the file and all pertinent documents are being transmitted
to your office.

SUMMARY 0'" REQUEST: The applicant seeks approval of a four-lot short plat
together with a variance from the Subdivision Ordinance
for a half-street without curbs and sidewalks.

PLANNING DEPARTMENT The Planning Department preliminary report was received by
REPORT: the Examiner on April 30, 1981 .
PUBLIC HEARING: After reviewing the Planning Department report , examining
available information on file with the application, and field
checking the property and surrounding area, the Examiner
conducted a public hearing on the subject as follows:
The hearing was opened on May 5, 1981 at 9:00 a.m. in the Council Chambers of the Renton
Municipal Building.
Parties vishing to testify were affirmed by the Examiner.
It was reported that the Hearing Examiner and the applicant had received and reviewed
the Planring Department preliminary report. Roger Blaylock, Associate Planner, presented
the report, and entered the following exhibits into the record:

Mr. Blaylock advised that subsequent to processing of the previous application, Exhibit
3, the designation for exception had been changed to variance. He also corrected
Section _.7, line 7, to reflect reference to Short Plat 039-81 in lieu of Short Plat
401-79, 3s denoted.
The Examiner requested testimony by the applicant. Responding was:

Mr. Heat:`, advised that reapplication had been made because the surveyor had delayed
submitting the final plat, and expiration of that plat had occurred. Regarding
requirements for installation of sidewalks , he indicated that access to the plat is
via Park Avenue N. , N. 28th Street , Meadow Avenue N. , and N. 26th Street, which currently
do not have sidewalks; and although he did not object to the cost of those improvements,
he felt they would be inconsistent in the area. Mr. Heath proposed that 30 feet of
right-of-way be dedicated to the city to be reserved in the event an LID is formed in
the futLre for installation of sidewalks and other improvements.
Referencing staff comments from the Engineering Department which recommend installation
of off-site improvements on N. 26th Street, Mr. Heath expressed his opinion that although
he concirs in the requirement to provide improvements at the location where Park Place N.
abuts N. 26th Street, improvement of 26th should not be his responsibility.
There was no response to the Examiner's request for supporting testimony. Testifying in
opposit on was:

Mr. Norri!. was affirmed by the Examiner. His objection to the proposal related to
prohibition of parking on either side of Park Place N. because paving is only 24 feet
wide and .'ehicle parking would eliminate all but eight feet for purposes of travel and
circulation which would cause future traffic hazards , particularly if through access
is allowed at a future date to Tract 27.
The Examiner requested final comments. Since none were offered, the hearing regarding
File No. Short Plat 039-81 was closed by the Examiner at 9:20 a.m.
FINDINGS, CONCLUSIONS & DECISION: Having reviewed the record in this matter, the
Examiner now makes and enters the following:
FINDINGS:
1 . The request is for approval of a four-lot short plat of +1 .2 acres of land in the
vicirity of 1303 N. 26th Street together with a variance to allow a half-street with
24 feet of paving and no curbs or sidewalks.
2. The application file containing the application, SEPA documentation, the Planning
Department report, and other pertinent documents was entered into the record as
Exhil:it #1 .
3. Pursuant to the City of Renton's Environmental Ordinance and the State Environmental
Polii.y Act of 1971 , R.C.W. 43.21 .C. , as amended, the subject proposal has been
determined exempt from the threshold determination by the Environmental Review
Committee, responsible official .
4. Plans for the proposal have been reviewed by all city departments affected by the
impact of this development . A similar short plat was approved for the property
File No. Sh. Pl . 401-79) , but was permitted to expire without recording.
5. All existing utilities are available and in close proximity.
6. The oroposal is compatible with the required setbacks, lot coverage and height
requirements of Section 4-729 (General) of Title IV, Ordinance No. 1628, Code of
General Ordinances.
7. The subject site slopes from east to west. The site is covered with scrub brush
and blackberries and some significant stands of deciduous trees.
An existing single family residence is located on proposed Lot No. 3. The remainder
of the site is undeveloped.
8. The area is developed predominantly with single family homes. The subject site is
located west of 1-405 with views west down to Lake Washington.
Renton Senior High School is located about three miles from the subject site with
the other middle school and grade school located at lesser distances.
9. Access to the site is quite limited with a number of turns on substandard streets
required to reach the site from either 1-405 or Lake Washington Boulevard.
Access to Tract 27 south of the subject site is limited by topography and vacated
right-of-ways. The Planning Department recommended that access to this parcel be
proiided pursuant to Section 9-1108.23•A• (8) through the subject parcel by dedicating
right-of-way for the eventual construction of roadway. They recommended that in the
interim, a cul-de-sac with a temporary turnaround easement serve the proposed four
lots for access.
10. None of the streets in the area are developed to more than half width and some roads
are less than half width. The Public Works Department indicated that a 30-foot
right-of-way would be satisfactory in this area, but that there should be full curbs,
gutters, and a sidewalk on one side of the roadway. The Planning Department made
the same recommendation.
CONCLUSIONS:
1 . The subject proposal appears to serve the public use and interest. The large lots
are quickly becoming out of character in this area. The four lots proposed by the
applicant are all of sufficient size to provide adequate building space and meet
a1 ' the zoning requirements of the G-6000 zone in which they will be developed.
2. Th(t access to the subject site and the surrounding area is somewhat indirect but
beGause of the topography of the area only half-streets exist in the area. The

applicant should not be required to provide a fifty-foot street to service the
four lots he proposes. Such a large street would be out of character but the
provision of full curbs and gutters, and a sidewalk on one side of the roadway will
provide safe access for both automobiles and pedestrians.
3. The area to the south of the subject site would also encounter access problems, and
the division of the subject property will place more development pressure on these
southern properties so that the applicant should provide a dedicated right-of-way
to these southern properties through the p-oposed subdivision (Section 4-1108.23.A(8)) .
4. The variance to permit the construction of a street of less than the minimum
requirements will not adversely affect the public welfare nor harm neighboring
properties. Most of the streets in the area have been developed to less than the
minimum requirements , and in this case, curbs, gutters and sidewalks will provide
for access by pedestrians out of the traffic flow. Granting the variance will
permit the development of the subject property in a manner similar to other
developments in the area.
5. Stancard on-site and off-site improvements shall be installed including but not
limited to curbs , gutters , street lights and sidewalks.
6. A temporary cul-de-sac may be provided on site per Exhibit #2 with a 45-foot turning
radius until such time as Park Court N. is required to be extended to the south for
acce.,s to Tract 27 per Section 9-1108.23.A(8) .
DECISION
Exhibit 12 is approved subject to the following conditions:
1 . The .Dedication of the 30 feet of right-of-way indicated in Exhibit #2 including access
to Tract 27.
2. The installation of full curbs and gutters and a sidewalk on one side of the 30-foot
right-of-way except for the southerly 50 feet of the right-of-way.
The variance for a 30-foot right-of-way is approved subject to the installation of full
curbs and gutters , and a sidewalk on one side of the right-of-way.

Pursuart to Title IV, Section 3015 of the City's Code, request for reconsideration must
be filed in writing on or before May 27, 1981 . Any aggrieved person feeling that the
decisicn of the Examiner is based on erroneous procedure, errors of law or fact, error
in judcament, or the discovery of new evidence which could not be reasonably available
at the prior hearing may make a written request for review by the Examiner within fourteen
14) days from the date of the Examiner's decision. This request shall set forth the
specific errors relied upon by such appellant, and the Examiner may, after review of the
record, take further action as he deems proper.
An appeal to the City Council is governed by Title IV, Section 3016, which requires that
such appeal be filed with the City Clerk accompanying a filing fee of $25.00 and meeting
other specified requirements. Copies of this ordinance are available for inspection in
the Fiiance Department, first floor of City Hall , or same may be purchased at cost in
said department.

The Notice of Public Hearing indicates that a variance from those
sections of the Subdivision Ordinance requiring sidewalks and curbs
has been applied for by the applicant. There is no provision
permitting a variance to be issued which eliminates the need for
required improvements. A variance is issued to avoid the impacts
of bulk and dimensional requirements of the ordinance or where

The subject site was annexed into the City by Ordinance
Nos. 1791 , 1800, 1804 , all of September 8, 1959. On
September 24 , 1979 , the Hearing Examiner approved a
four-lot Short Plat and Exception for a half street
with full curbs , gutters and a sidewalk. By October 8,
1980, the applicant had not recorded the Short Plat
and it expired.

D. PHYSICAL 4ACKGROUND:
1 . Topography: The site slopes from east to west.
2. Soils: Alderwood gravelly sandy loam, 6-15% slopes
AgC) . Permeability is moderately rapid in the
surface layer and subsoil and very slow in the
substratum. Available water capacity is low.
Runoff is slow to medium and the erosion hazard
is moderate. This soil is used for timber, pasture,
berries and row crops and for urban development.
Alderwood gravelly sandy loam, 15-30% slopes (AgD) .
Runoff is medium and the erosion hazard is severe.
This soil is used mostly for timber. Some areas
on the lower parts of slopes are used for pasture.
Arents, Alderwood material, 0-6% slopes (AmB) .
Permeability in the upper, disturbed soil material
is moderately rapid to moderately slow, depending
on its compaction during construction. The sub-
stratum is very slowly permeable. Runoff is slow
and the erosion hazard is slight. This soil is
used for urban development.
3. Vegetation: Ground cover consists principally
of scrub brush and some blackberries. Significant
stands of deciduous trees surround these features.
4 .• Wildlife: Existing vegetation on the site provides
suitable habitat for birds and small mammals.
5. Water: No surface water was observed on the subject
site (April 17 , 1981 ) .
6. Land Use: An existing residence is located on
proposed Lot No. 3 while the remainder of the site
is undeveloped. Single family residences are located
to the north, east and south of the subject site.

The surrounding properties are principally single family
residential in nature.
F. PUBLIC SERVICES:
1 . Water and Sewer ; A 6-inch water main runs east-west
along North 26th Street and 8-inch sewer lines
are located on North 26th and running north-south
in the middle portion of the site.
2. Fire Protection: Provided by the City of Renton
Fire Department per ordinance requirements.
3. Transit : Metro Transit Route No. 240 operates
along I-405 within one-half mile to the east of
the subject site.
4. Schools : Kennydale Elementary School is within
three-fourths of a mile to the northeast of the
subject site while McKnight Junior High School
is within two miles to th'3 southeast and Renton
Senior High School is within three miles to the
south.

Pursuant to the City of Renton ' s Environmental Ordinance
and the State Environmental Policy Act of 1971, as amended,
RCW 43-21C, the subject proposal is exempt from the
determination of environmental significance.

1 . The subject proposal is consistent with the existing

2. The proposal exceeds the minimum lot size and dimension
requirements of the Subdivision Ordinance and the
G-6000 Zone.
3. Access to Tract 27 , which is adjacent to the south,
is limited. Access from the east has been vacated
and North 26th Street is not constructed from the
northwest. Therefore, access should be provided
to Tract 27 through the proposed short plat.
4 . The existing single family residence located on
the proposed Lot 3 conforms to the required setback
requirements.

5. Regarding the Variance request, the Engineering
Division of the Public Works Department has advised
that a half-street would be acceptable with 24
feet of paving and a 4 feet concrete walkway.
Full off-site improvements for North 26th Street
are recommended and storm water retention/detention
will be required. In addition a plan and profile
for the off-site improvements is to be provided.
6. A turnaround of 45 feet radius center-to-curb for
emergency vehicles could be provided as per Fire
Department comment. However, a hammerhead turn-
around is another acceptable method of providing
an adequate turnaround. Minimum road access width
is to be 20 feet and the grade must not exceed
15 percent.
7. As part of the exception approval in Short Plat
401-79 and E-408-79 , the Hearing Examiner required
full curbs, gutters , and a sidewalk on one side
of the right-of-way. Conditions have not signifi-
cantly changed since that time and it would be
consistent with the Planning Department Analysis
L-6 of Short Plat 401-79 and other department
recommendations to require the same at this time.

M. DEPARTMENTAL RECOMMENDATIONS
Based upon the above analysis, it is :recommended to
approve the Short Plat and Variance subject to the following:
1 . The dedication of 30 feet of right-of-way including
access to Tract No. 27.
2. The installation of full curbs and gutters and
a sidewalk on one side of the 30 foot right-of-way
except for the southerly 50 feet of the right-of-
way.
3. Satisfaction of items in L-5 and L-6.

SUBJECT:Heath Short Plat
After reviewing the Heath Short Plat and several other short plats which
have been approved in this general area I wondered about the narrow road-
ways and improvements.
I personally feel these are acceptable for access to small plats such as
his but why do we require it to be a public right-of-way? Is it not
possible to make the roadway a private access to the four lots. Require
say 24 ft. of paving drainage, walkway, and other improvements as necessary
but it would remain a private road with each lot having an interest in
the roadway and its maintenance.

I have reviewed your memorandum of April 17 , 1981, regarding
the appropriateness of the use of a variance to eliminate
the requirement for sidewalks and curbs in the Heath Short
Plat . The distinction that I would draw between a variance
application and a waiver application is as follows :
A waiver application is appropriate where all of the
required right-of-way is available, and there is at
least a potential for the future installation of the
improvements if it is determined desireable on the part
of the City .
A variance application, however , would be appropriate
where the applicant desires to use less than the normal
right-of-way area and there is NO provision retained
for the future installation of these improvements.

LOCATION: West and south of 1303 N. 26th Street.
SUMMARY OF REQUEST: The applicant requests approval of a proposed four-lot short
plat along with an exception request to allow a half-street
with 23 feet of paving and no curbs and sidewalks.
SUMMARY OF ACTION: Planning Department Recommendation: Approval with conditions.
Hearing Examiner Decision: Approval with conditions.
PLANNING DEPARTMENT The Planning Department preliminary report was received by the
REPORT: Examiner on September 13, 1979.
PUBLIC HEARING: After reviewing the Planning Department report, examining
available information on file with the application, and field
checking the property and surrounding area, the Examiner
conducted a public hearing on the subject as follows:
The hearing was opened on September 18, 1979 at 9:10 a.m. in the Council Chambers of the
Renton Municipal Building.
Parties wishing to testify were affirmed by the Examiner.
It was reported that the Hearing Examiner and the applicant had received and reviewed the
Planning Eepartment report, and the report was entered into the record as Exhibit #1.
Roger Bla)lock, Associate Planner, reviewed Exhibit #1, and entered the following additional
exhibits into the record:
Exhibit #2: Short Plat as submitted
Exhibit #3: Short Plat with staff comments
Mr. Blaylock advised that recent receipt of departmental comments necessitates revision
of the Planning Department recommendations as follows: Section M.4 which recommends
construction of the half street with a 24-foot paved width to include curbs and gutters,
should also include a recommendation for sidewalk installation; In Section M. 5 which
recommends construction of the temporary cul-de-sac with a minimum 45-foot diameter, the
word "diameter" should be changed to "turning radius"; and an additional recommendation,
Section M 6 should be included to recommend dedication of right-of-way between the short
plat and N. 26th Street. Referencing Section M. 3 which recommends a waiver of improvements
for the south 50 feet of the dedicated right-of-way or that portion south of the temporary
cul-de-sac, the Examiner clarified that without proper application for a waiver, the
Examiner cannot review or approve the request. He indicated that either an application
for waiver through the Hearing Examiner or an application for deferral to the Board of
Public Works may be requested.
The Examiner requested testimony by the applicant. Responding was:

Responding to Mr. Heath's request, a copy of departmental comments which had been submitted
just prior to the hearing, was provided to the applicant. Referencing Section M.1 which
recommend; provision of a 30-foot wide dedicated access to Tract 27 across proposed Lot 4,
Mr. Heath reported that Tract 27, south of the subject site, fronts on what would be an
extension of N. 24th Street which exists as an easement for the purpose of road and
utilities, and he advised his opinion that the area would be better served if access were
provided from Tract 27 to N. 24th Street. He also indicated that development of the street
and utility service as recommended by staff would create a hardship on the applicant, and
granting the easement will eliminate 1500 square feet of property from the site to provide
access to the owner of Tract 27 even though access can be feasibly provided to N. 24th Street.

Referencing staff comments pertaining to installation of sidewalks on the half street, Mr.
Heath objected to the requirement due to inconsistency with the entire surrounding area.
He alsp indicated his preference for a 22-foot width for the half street as recommended
by the Public Works Department to maintain consistency with other streets in the area in
lieu of the Planning Department recommendation for a 24-foot width. Mr. Heath reported
that due to the revision in the temporary cul-de-sac which affects the setback requirement
on Lot 4, certain modification to the plat requiring relocation of the boundary 30 feet
to the north would be required.
The Examiner inquired if the applicant is aware of the requirement to restrict grades to
15% on the hillside. Mr. Heath indicated that the grade would be less than exists on N.
26th Street. The Examiner requested the applicant to justify approval of a half-street
rather than the required right-of-way. Mr. Heath advised that a 30-foot right-of-way
is consistent with surrounding development and streets in the area, the property as
originally platted by the city designates a 30-foot access, the adjacent property is not
available for development, and provision of the proposed access would not be detrimental
to adjacent property owners.
The Examiner requested testimony in support of the application. There was no response.
He then requested testimony in opposition to the proposal. Responding was:
Howard Banasky

Mr. Banasky was affirmed by the Examiner. He advised that existing streets in the
Kennydale area are very narrow and access is restricted for vehicles proceeding in
opposite directions, particularly N. 28th Street and Meadow Avenue N. , main thoroughfares
into the area. He stated that due to conversion of garages to other uses, on-street
parking exists which contributes to congestion for traffic movement and endangers safety
of young pedestrians. He objected to the addition of three new homes whose residents
will generate additional vehicular traffic on an existing substandard access roadway,
S. 26th Street, and encouraged city officials to enforce existing codes and regulations
for provision of fully improved right-of-ways. Mr. Banasky noted his objection to
granting of exceptions and waivers of existing requirements, and suggested provision
of an overall long-range plan for traffic circulation and access. He suggested the
possibility of providing access to Lake Washington Boulevard at some point to alleviate
existing traffic congestion.
The Examiner requested further testimony in opposition to the application. There was no
response. He then allowed the applicant to rebut previous comments. Responding was:

Mrs. Heath indicated her opinion that the applicant is not requesting privileges that
have not been granted to other residents in the area including Mr. Banasky. She noted
the possibility of improving and widening N. 26th Street, which has available additional
right-of-way, in the future.
The Examiner requested final comments from the Planning Department staff. There were no
further comments. The Examiner requested further testimony. Since there was no response,
the hearing regarding File No. Short Plat 401-79 and E-408-79 was closed by the Examiner
at 9:36 a.m.
FINDINGS, CONCLUSIONS & DECISION: Having reviewed the record in this matter, the Examiner
now makes and enters the following:
FINDINGS:
1111. The request is for approval of a four-lot short plat of +1.2 acres of land in the
vicinity of 1303 N. 26th Street together with an exception to allow a half-street with
23 feet of paving and no curbs or sidewalks.
2. The Planning Department report sets forth the issues, applicable policies and provisions,
findings of fact, and departmental recommendations in this matter, and is hereby
attached as Exhibit #1 and incorporated in this report by reference as set forth in
full therein.
3. Pursuant to the City of Renton's Environmental Ordinance and the State Environmental
Policy Act of 1971, R.C.W. 43.21.C. , as amended the subject proposal has been determined
exempt from the threshold determination by Gordon Y. Ericksen, responsible official.

lans for the proposal have been reviewed by all city departments affected by the
impact of this development.
5. All existing utilities are available and in close proximity.
6. The proposal is compatible with the required setbacks, lot coverage and height
requirements of Section 4-729 (General) of Title IV, Ordinance No. 1628, Code of
General Ordinances.
7. The subject site slopes from east to west. The site is covered with scrub brush and
blackberries and some significant stands of deciduous trees.
An existing single family residence is located on proposed Lot No. 3. The remainder
of the site is undeveloped.
8. The area is developed predominantly with single family homes. The subject site is
located west of I-405 with views west down to Lake Washington.
Renton Senior High School is located about three miles from the subject site with the
other grades located at lesser distances.
9. Access to the site is quite limited with a number of turns on substandard streets
required to reach the site from either I-405 or Lake Washington Boulevard.
Access to Tract 27 south of the subject site is limited by topography and vacated
right-of-ways. The Planning Department recommended that access to this parcel be
provided pursuant to Section 9-1108.23.A. (8) through the subject parcel by dedicating
right-of-way for the eventual construction of roadway. They recommended that in the
interim, a cul-de-sac with a temporary turnaround easement serve the proposed four
lots for access.
10. None of the streets in the area are developed to more than half width and some roads
are less than half width. The Public Works Department indicated that a 30-foot right-
of-way would be satisfactory in this area but that there should be full curbs, gutters,
and a sidewalk on one side of the roadway.
CONCLUSIONS:
1. The subject proposal appears to serve the public use and interest. The large lots are
quick..y becoming out of character in this area. The four lots proposed by the
applicant are all of sufficient size to provide adequate building space and meet
all the zoning requirements of the G-6000 zone in which they will be developed.
2. The access to the subject site and the surrounding area is somewhat indirect but
because of the topography of the area only half-streets exist in the area. The
applicant should not be required to provide a fifty-foot street to service the
four Lots he proposes. Such a large street would be out of character and the
provision of full curbs and gutters, and a sidewalk on one side of the roadway will
provide safe access for both automobiles and pedestrians.
3. The area to the south of the subject site would also encounter access problems and
the division of the subject property will place more development pressure on these
southern properties so that the applicant should provide a dedicated right-of-way
to these southern properties through the proposed subdivision (Section 4-1108.23.A. (8)) .
4. The exception to permit the construction of a street of less than the minimum
requirements will not adversely affect the public welfare nor harm neighboring
properties. Most of the streets in the area have been developed to less than the
minumum requirements and in this case, curbs, gutters and sidewalks will provide
for access by pedestrians out of the traffic flow. Granting the exception will
permit the development of the subject property in a manner similar to other developments
in the area.
5. Standard on-site and off-site improvements shall be installed including but not
limited to curbs, gutters, street lights and sidewalks.
6. A temporary cul-de-sac may be provided on site per Exhibit #3 with a 45-foot turning
radius until such time as Park Court N. is required to be extended to the south for
access to Tract 27 per Section 9-1108.23.A. (8) .
DECISION:
Exhibit #3 is approved subject to the following conditions:
1. The dedication of the 30 feet of right-of-way indicated in Exhibit #3 including access

2. The installation of full curbs and gutters and a sidewalk on one side of the 30-foot
right-of-way except for the southerly 50 feet of the right-of-way.
The Exception for a 30-foot right-of-way is approved subject to the installation of full
curbsVand gutters and a sidewalk on one side of the right-of-way.

be filed in writing on or before October 8, 1979. Any aggrieved person feeling that
the decision of the Examiner is based on erroneous procedure, errors of law or fact, error
in judgment, or the discovery of new evidence which could not be reasonably available at
the prior hearing may make a written request for review by the Examiner within fourteen
14) days from the date of the Examiner's decision. This request shall set forth the
specific errors relied upon by such appellant, and the Examiner may, after review of the
record, take further action as he deems proper.
An appeal to the City Council is governed by Title IV, Section 3016, which requires that
such appeal be filed with the City Clerk in writing on or before October 8, 1979
accompanying a filing fee of $25.00 and meeting other specified requirements. Copies of

C. HISTORY/BACKGROUND:
The subject site was annexed into the City by Ordinance #' s
1791 , 1800 , 1804 all of September 8 , 1959.
D. PHYSICAL BACKGROUND :
1 . Topography : The site slopes from east to west .
2 . Soils : Alderwood gravelly sandy loam, 6-15% elopes (AgC) .
Permeability is moderately rapid in the surface layer and sub-
soil and very slow in the substratum. Available water capacity
is low. Runoff is slow to medium and the erosion hazard is
moderate. This soil is used for timber, pasture , berries and
row crops and for urban development . Alderwood gravelly sandy
loam, 15-30% slopes (AgD) . Runoff is medium and the erosion
hazard is severe . This soil is used mostly for timber . Some
areas on the lower parts of slopes are used for pasture . Arents ,
Alderwood material, 0-6% slopes (AmB) . Permeability in the
upper , disturbed soil material is moderately rapid to moderately
slow, depending on its compaction during construction . The

substratum is very slowly permeable . Runoff is slow and the
erosion hazard is slight . This soil is used for urban develop-
ment .
3. Vegetation : Ground cover consists principally of scrub brush
and some blackberries . Significant stands of deciduous trees
surround these features.
4. Wildlife : Existing vegetation on the site provides suitable
habitat for birds and small mammals .
5 . No water was observed on the subject site (August 30 , 1979) .
6. Land Use : An existing residence is located on proposed Lot #3
while the remainder of the site is undeveloped. Single family
residences are located to the north , east and south of the
subject site .
E. NEIGHBORHOOD CHARACTERISTICS :
The surrounding properties are principally single family residential
in nature.
F. PUBLIC SERVICES :
1 . Water and Sewer : A 6" watermain runs east-west along North 26th
Street and 8" sewer lines are located on North 26th and running
North-south in the middle portion of the site .
2 . Fire Protection : Provided by the City of Renton Fire
Department per ordinance requirements .
3. Transit : Metro Transit Route #240 operates along I-405
within 1/2 mile to the east of the subject site .
4. Schools : Kennydale Elementary School is within 3/4 of a mile
to the northeast of the subject site while McKnight Junior High
School is within 2 miles to the southeast and Renton Senior
High School is within 3 miles to the south.
5. Recreation : Lake Washington Beach Park is within 1/2 mile to the
west of the subject site and Kennydale Lions Park is within 14
miles to the east .

L. PLANNING DEPARTMENT ANALYSIS :
1 . The subject proposal is consistent with the existing
zoning and land use designation of single family residential for
the site and surrounding properties.
2. The proposal exceeds the minimum lot size and dimension
requirements of the Subdivision Ordinance and the G-6000 Zone .
3. Access to Tract 27, which is adjacent to the south , is limited.
Access from the east has been vacated and N. 26th Street is not
constructed from the northwest . Therefore , access should be
provided to Tract 27 through the proposed short plat .
4. The existing single family residence located on proposed Lot 3
conforms to the required setback requirements .
5. The question of the exception has been discussed by the Application
Review Committee. The Public Works Department recommended that
the exception is appropriate if the short plat is modified to
1) include a 40-foot diameter temporary cul-de-sac established
by an easement , which will automatically be released if the
half street is continued, (2 ) dedication of 30-foot wide right-of-
way from the southern end of the proposed street to the southern
boundary of Lot 4 ; (3) granting a waiver for improvements on the
dedication mentioned in conditions #3 as part of the exception ;
4) and require that whoever needs to use the dedication will
install the required improvement .
6 . The specific question of reducing the half street standards
was also discussed by ARC. The Public Works Department agreed
that a sidewalk was not reasonable because there were not any
other sidewalks in the vicinity . However, curbs should be
required to control runoff and the 20-foot wide half street
should be located as close to the eastern edge of the right-of-way
to allow the possible construction of a sidewalk on the west
side of the street , if ever deemed necessary .
In normal circumstances a 20-foot wide street would be
acceptable for a 4-lot short plat ; however, there is the
possibility of Tract 27 being short platted thus adding
additional traffic to the street . Travel lanes are
typically 11 or 12 feet in width.
7. Lot 3 is large enough to be redivided at some future time
into two lots and meet the G-6000 zoning requirements . Even -
though in all appearances this is a short plat , it has a potential
of a long plat in the future . Normal access and improvements
associated with a half street should be increased in anticipation
of the possibility of another lot in the future .

M. DEPARTMENTAL RECOMMENDATIONS :
The staff recommends based on the above analysis that the Hearing
Examiner approve the short plat 401-79 and the exception E-408-79
subject to the following conditions :
1 . Provision for a 30-foot wide dedicated access to Tract #27
across proposed Lot 4.
2 . Provision for an easement for a temporary cul-de-sac along with
a statement on the fact, of the short plat which will
automatically release the easement if and when the half
street south of the cul-de-sac is constructed.
3. Waiver of improvements for the south 50 feet of the dedicated
right-of-way or that portion south of the temporary cul-de-sac.
4 .
Construction of the half street with a 24-foot paved width
to include curbs and gutters.
5 .
