DECLARATION OF RESTRICTIVE COVENANTS
WHEREAS, Charles Petchnick and his wife Hazel M. Petchnick are the owners of
the following real property in the City of Renton, County of King, State of
Washington; and Thomas R. Dahlby and his wife Kathleen I . Dahlby have contracted to
purchase the following real property in the City of Renton, County of King, State of
Washington, described as follows :
Lot 23, Block 21 , C. D. Hillman 's Earlington Garden Addition to the
City of Seattle, Division No. 1 , Recorded in Volume 17 of Plats , Page 74,
in King County, Washington Less State Highway.
WHEREAS, the owners and purchasers of said described property, hereinafter "the
property", desire to impose the following restrictive covenants running with the land
as to use, present and future, of the property;
NOW, THEREFORE, the aforesaid owners and purchasers hereby establish , grant and
impose restrictions and covenants running with the land as to the use of the land
hereinabove described with respect to the use by the undersigned, their successors,
heirs and assigns , as follows:
SETBACKS
A twenty (20) foot setback shall be required from Maple Avenue S .W. in which no
structures may be built. The westerly ten (10) feet of the setback shall be
required to be landscaped subject to the approval of the City_._ of._Ren_ton's

JOINT ACCESS
Joint access shall be required between the subject site and the lot immediately
adjacent to the north. Such access plan shall be subject to the approval of the
Building and Zoning Department , City of Renton, prior to issuance of a building
permit on the subject site.
DURATION
These covenants shall run with the land and expire on December 31 , 2025. If at any
time improvements are installed pursuant to these covenants , the portion of the
covenants pertaining to the specific installed improvements as required by the
Ordinances of the City of Renton shall terminate without necessity of further
documentation.
Proper legal procedures in the Superior Court of King County may be instigated by
either the City of Renton or any property owners adjoining subject property who are
adversely affected by any violation or breach of these restrictive covenants .
Reasonable attorneys ' fees incurred during an enforcement proceeding will be borne
by the parties whom the court determines are in error and shall b entered as a
judgment in such action.

1983 Joint Funds reported King County is preparing Block Grant applications for
1983 Joint funds and will be submitting requests to continue the
Affordable Monthly Payment Loan (AMPL) program ; also to initiate a
program to rehabilitate one to four unit rental properties for low
income tenants. The letter requested motion or resolution passed
by the City Council and submitted to the County by 7/20/82 in
order to cosponsor the AMPL and rental rehab programs. MOVED BY

CHANGING THE ZONING CLASSIFICATION OF CERTAIN
PROPERTIES WITHIN THE CITY OF RENTON FROM

WHEREAS under Chapter 7 , Title IV (Building Regulations)
of Ordinance No . 1628 known as the "Code of General Ordinances of
the City of Renton" , as amended, and the maps and reports adopted
in conjunction therewith, the property hereinbelow described has
heretofore been zoned as Residence District (R-1) ; and
WHEREAS a proper petition for change of zone classification
of said property has been filed with the Building and Zoning
Department on or about March 30 , 1982 , which petition was duly
referred to the hearing Examiner for investigation , study and public
hearing , and a public hearing having been duly held thereon on
or about May 13 , 1982 , and said matter having been duly considered

APPOINTMENT OF Mayor Shinpoch varied from the agenda to introduce Michael Mulcahy,
FINANCE DIRECTOR her choice to fill the position of Finance Director for the City.
Effective 6,'22/82 Mr. Mulcahy is presently Manager of the Budget Division for Metro,
has had experience as Systems and Programming Officer for the City
of Tacoma and as manager of Metro' s Computer Services Division.
He has a BA Degree in mathematics from Washington State University
and is a Certified Data Processor. MOVED BY TRIMM, SECOND BY REED,
COUNCIL CONCUR IN THIS RECOMMENDATION. CARRIED.
AUDIENCE COMMENT Bill Grimm, 1725 SE 16th Place, requested the Council vary from the
Street Vacation agenda and advance to SE 18th Street Vacation and the assessment of

Rolling Hills VACATION. CARRIED. Letter from Public Works Director Houghton was
read recommending a cost of $.75 per square foot versus the appraisal
recommendation of $.45 per square foot. Mr. Houghton noted that the
Administration recommended against this street vacation. James Lawrence,
2203 Jones Place, spoke against the street vacation to facilitate
emergency vehicle access and additional entrance to Rolling Hills.
MOVED BY ROCKHILL, SECOND BY TRIMM, TO ACCEPT THE RECOMMENDATIONS OF
THE PUBLIC WORKS DIRECTOR REGARDING THE COST OF THE STREET VACATION.
MOTION CARRIED. ROLL CALL VOTE: AYES: CLYMER, TRIMM, MATHEWS ,
ROCKHILL. NOS: REED, STREDICKE, HUGHES. Councilman Stredicke noted
an alternative to the $5,079.86 street vacation cost would be to apply
for a Street Use Permit. Policy Development Director Clemens advised
the street can only be vacated to abutting property owners and Rolling
Hills Homeowners Association required to replat the entire Rolling Hills
plat to acquire the land.
Tukwila CoLncil Councilman Hughes introduced May Harris, Council Member from Tukwila,
Woman Visitor from the audience. The Mayor welcomed the Council Member.

PUBLIC HEARING This being the date set and proper notices having been posted, pub-

Valley Highway hearing to consider LID 314 assessments according to agreement made,
Improvements with property owners involved, to re-evaluate the assessments after
the bids had been received. LID 314 includes installation and con-
struction of sanitary sewers , water main, fire hydrants, curbs, gutters ,
sidewalks, street lighting and all necessary appurtenances in the vicinity
of East Valley Highway and Southwest 16th Street. Public Works Director
Houghton outlined the history of LID 314, emphasizing the benefits of
having the project completed under one construction bid and noting this
meeting for discussion of assessments.
Audience Comment Those speaking against LID 314: Woodrow L. Taylor, 200 SW 34th Street ,
attorney representing Garfield and Associates; Harry C. Wilson, Wilson
and Reardon, Attorneys at Law, representing approximately 95% of the
property owners on the east side of East Valley Highway; Emilio Pierotti ,
3412 East Valley Road; Gary Merlino, 9125 Tenth Avenue South; and Del
Bennett 18004 SE 147th. Protests concerned alleged excessive LID and
consulting engineering costs, several parties noting prior Public Works
Director' s indication that the project was to be bid in two separate
construction contracts. Debra Mets, 13016 SE 236th Place, Kent, pre-
sented a petition asking re-evaluation of environmental impact on wild-
life habitat and breeding gound. Those speaking for LID 314: Bob
Grafer, Austin Company, and Don Bodmer, representing Glacier Park.
Letters of protest were announced.
Continued Public Works Director Houghton explained that Administrative costs
include right-of-way purchase, bond counsel , City Clerk's costs, interest
on interim financing, construction engineering, and various costs other
than design engineering. Discussion ensued as to feasibility of splitting
the construction into two projects without losing the present bid. City
Attorney Warren advised that when construction is completed and the
Council sets as a Board of Equalization , all input from property owners
will be taken into consideration. Councilman Stredicke noted that the
present bid is far too reasonable to risk losing. MOVED BY STREDICKE,
SECOND BY REED, THAT THE HEARING BE CLOSED. CARRIED. MOVED BY STREDICKE,
SECOND BY TRIMM, THAT THE MAYOR AND CITY CLERK BE AUTHORIZED TO SIGN THE
CONTRACT, ACCEPTING THE LOW BID OF CASCADE SEPTIC SERVICE IN THE AMOUNT

Coulon Park Councilman Stredicke inquired as to the number of people present at
Use Coulon Park last weekend. Mayor Shinpoch responded that over 24,000
people had used the park over Friday, Saturday and Sunday. Council-
man Stredicke commented on the parking overflow onto Lake Washington
Blvd. Mayor Shinpoch stated that the Boeing Company had been approached
regarding use of their parking lot for additional parking and that the
question will be discussed with staff.
Farewell Councilman Stredicke reported attending the farewell party given by
Parties Metro for Mike Mulcahy, new City of Renton Finance Director, and
announced the retirment party to be given for long-time King County
employee, Wanda Thompson, on Thursday, 6/24/82, at Longacres.

Councilman Stredicke inquired regarding two pieces of property as
to development/occupancy. Mayor Shinpoch informed him that Sun
Point had been admonished in the past to satisfy nine specific
requirements prior to issuance of occupancy permits. Since that
time, property has changed hands and new project manager is working
with the City to meet all requirements. The second property ques-
tioned (a motel operation on Sunset East near Third) is in the
process of condemnation proceedings. City Attorney Warren stated
that an appeal has been filed, with a hearing date of 7/09/82;
after appeal rights have been exhausted, Council may be approached
for funds to demolish the buildings.
Cable Television Councilman Reed explained being approached by a firm offering to
Antenna install an antenna which would enable him to receive Showtime Cable
Solicitation on his television for a $50 sale price plus monthly fee, and asked
if it were possible to distribute the cable installation schedule
to prevent unnecessary antenna purchases by citizens. City Attorney
Warren stated the City is aware of this firm, not associated with
Showtime, and has been in contact with them regarding licensing and
business practices. Councilman Stredicke suggested contacting the
newspapers regarding any complaints.
Utilities Utilities Committee Chairman Mathews submitted committee report
Committee recommending adoption of utility facility connection charges in
Facility replacement of the Community Facilities Development Charge re-
Connection pealed by state law. Following discussion, MOVED BY MATHEWS,

BUILDING & ZONING The Building & Zoning Department report was received by the
DEPARTMENT REPORT: Examiner on May 6, 1982.
PUBLIC HEARING: After reviewing the Building & Zoning Department report,
examining available information on file with the application,
and field checking the property and surrounding area, the
Examiner conducted a public hearing on the subject as follows :
The hearing was opened on May 13, 1982 at 10:28 a.m. in the Council Chambers of the
Renton Municipal Building. Parties wishing to testify were affirmed by the Examiner.
Roger Blaylock, Zoning Administrator, presented the Building & Zoning Department report ,
and entered the following exhibits into the record:

purposes only)
The Examiner requested testimony by the applicant. Responding was:

Mr. Dahlby advised that the subject site which is located to the south of the lot used
for his business was not available for purchase at the time of rezone of his lot to L-1
in 1981 . He discussed the rationale for acquisition of the subject site to allow
compliance to parking requirements imposed by the L-1 zoning category, and advised that
the proposed site plan is a result of review by himself and various members of city
staff. The rezone is timely due to recent transitional changes in the area of the
subject site, and only two occupied residences remain on Maple Avenue S.W. Although a
single family residence currently exists on the subject site, it is unoccupied and
uninhabitable due to its state of disrepair, and purchase of the subject site would allow
combining the two lots to provide a compatible project in that location.
Responding to the Examiner's inquiry regarding whether Mr. Dahlby would be the owner of
both lots which could be combined as a single use providing joint access and parking,
Mr. Dahlby indicated that would be the case. He also stated that the only reason for
creating an easement resulted from restrictions of a real estate contract on his lot at
1402 Maple Avenue S.W. , and in proposed development of the subject site additional
required parking will be provided. He also discussed plans to provide an obscuring
fence to the southern property line with dimensions similar to the existing fence, and
indicated compliance with city requirements for storm water detention, fire hydrants
and utilities.
The Examiner requested further testimony in support of the application. Responding was:

area approved by adoption of Ordinance No.s 3053, 3270, and 3482, and other recently
approved rezones , R-344-79 and R-069-81 .
The Examiner requested final comments. Since none were offered, the hearing regarding
File No. R-033-82 was closed at 10:40 a.m.
FINDINGS, CONCLUSIONS & RECOMMENDATIONS: Having reviewed the record in this matter, the
Examiner now makes and enters the following:
FINDINGS:
1 . The applicant, Thomas R. Dahlby, filed a request for a reclassification of
approximately 7,600 square feet of property from R-1 (Single Family Residential ) to
L-1 (Light Industrial ) .
2. The application file containing the application, SEPA documentation, the Building
and Zoning Department report , and other pertinent documents was entered into the
record as Exhibit #1 .
3. Pursuant to the City of Renton's Environmental Ordinance and the State Environmental
Policy Act of 1971 , RCW 43.21 .C, as amended, a Declaration of Non-Significance has
been issued for the subject proposal by the Environmental Review Committee (ERC) ,
responsible official .
4. Plans for the proposal have been reviewed by all city departments affected by the
impact of this development.
5. There was no opposition to the proposal expressed.
6. The subject property is located at 1412 Maple Avenue S.W. An existing, but vacant
house, is located on the level lot.
The existing home will be eventually removed to make way for conforming warehouse
uses if the property is reclassified for industrial uses.
7. The Comprehensive Plan designates the area in which the subject site is located as
suitable for the development of manufacturing park uses , which uses include office
us s , light industrial and commercial uses , and warehouse uses.
8. Th subject site was annexed into the city in April of 1959 by Ordinance No. 1745
at which time the site was classified G-6000 (Single Family Residential ) . The
G-6000 classification was recently retitled and is now R-1 .
9. Immediately north of the subject site is another property owned by the applicant
and developed with a storage facility. That lot is zoned L-1 , the zoning requested
in the instant case. While the lot to the south is developed with a single family
dwelling, like the dwelling on the subject site, it is vacant. This southerly lot is
zoned L- l . Other uses in the area are a mix of commercial and light industrial uses.
A Single family home is located to the west across Maple Avenue S.W. 1-405 is
located to the north and the 1-405 interchange is located immediately to the east.
10. Covenants executed for the reclassification of the northerly adjoining lot required
coordinated development of that lot and the subject site along the lines of the
requirements of the M-P zone. The Building & Zoning Department has recommended that
the subject site and the northerly lot use a joint access agreement to provide
additional parking on both sites and provide a drive-through access/one way driveway
for, the joint access.
CONCLUSIIONS:
I . The proponent of a rezone must demonstrate that the request is in the public interest
and will not impair the public health, safety and welfare. In addition, the rezone
must comply with at least one of the three criteria listed in Section 4-3014 which
provides in part that:
a. The subject site has not been considered in a previous area rezone or land
use analysis; or
b. The subject site is potentially designated for the new classification per the
Comprehensive Plan; or
c. There has been material and substantial change in the circumstances in the area
in which the subject site is located since the last rezoning of the property or

area.

The applicant has demonstrated that subject to the conditions below, the
reclassification is warranted.
2. The lots both immediately to the north and south of the subject site are
already zoned L-l . Reclassifying the subject site to L- 1 would provide consistent
and compatible zoning on the east side of Maple Avenue. The reclassification would
also further accomplish the transition to industrial use which has been occurring in
the area. The area has generally seen the elimination of residential uses and the
concurrent rise of commercial and light industrial uses in this area.
3. While the Comprehensive Plan more specifically designates the area for manufacturing
park uses , light industrial and warehousing uses are also compatible with that aim
and more clearly compatible with the limited lot sizes of area lots. The approximately
7,600 square foot lot would not accommodate the setbacks required of the manufacturing
park zone, but some setback and landscaping should be installed to at least approximate
the manufacturing park goals of the Comprehensive Plan to create open and pleasant
work environments in the city.
The setback should match the setback required on the northerly lot owned by the
applicant. A twenty foot setback in which no building or structure is erected and
of which the westerly 10 feet is to be landscaped.
4. In order to provide additional parking for both the subject lot and the northerly
lot , and to provide a more effective access for both lots , a joint access should be
created over both lots. Under joint access , maneuvering on the lots would be
simplified as would access to parking stalls. The access could be a circular drive
serving both lots.
5. While the southerly lot is zoned L-1 and the dwelling on the site is currently
vacant, the area is designated for manufacturing park types of development which
include setbacks and landscaping. In order to carry out some of these objectives ,
at least a sight obscuring fence should be provided between the properties to give
some privacy between uses.
RECOMMENDATION:
The City Council should approve the reclassification of the subject site from R-1 to
L- 1 subject to the following conditions:
1 . Execution of restrictive covenants requiring a twenty-foot (20' ) setback from Maple
Avenue S.W. in which no structures may be built, and requiring the westerly ten feet
of the setback to be landscaped subject to the approval of the city' s landscape
architect.
2. Execution of restrictive covenants requiring a joint access plan subject to the
approval of the Building & Zoning Department for the northerly adjacent lot and
the subject site.

1 . Topography: The subject site is relatively level.
2. Soils : Urban Land (Ur) . This soil has been modified
by disturbing the natural layers with the addition
of fill to accommodate industry.
3. Vegetation: The subject site consists primarily
of tall grass, blackberries, and brambles with
a few medium growth shrubs along the westerly frontage.
4. Wildlife: The existing vegetation on the site
may provide some habitat for birds and small mammals.
5. Water: No surface water was observed on the subject
site (April 23, 1982) .
6. Land Use : The subject site consists of an existing
single family residence. To the south and to the
west are single family residences and a storage
building is adjacent on the north. On the east
is I-405 .
1 . KEIGHBORHOOD CHARACTERISTICS:
The general area is in a transitional state from undeveloped
and single family residential to commercial and industrial
uses.
PUBLIC SERVICES:
1 . Water and Sewer: A 12-inch water main extends
north-south on Maple Avenue S.W. adjacent to the
subject site and a 24-inch sanitary sewer runs
east-west on S.W. 16th Street within one-half mile
to the west.
2 . Fire Protection: Provided by the Renton Fire Department
per ordinance requirements.
3. Transit: METRO Transit Route #161 operates along
S.W. Grady Way within 1/4 mile to the northwest
of the subject site.
4 . Schools : Although the site is within the Renton
School District, no existing schools are located

5. Recreation: No existing parks are located near

and the State Environmental Policy Act of 1971, as amended,
RCW 43-21C, the Environmental Review Committee issued
a final declaration of non-significance for the subject
proposal on April 26, 1982.

L. DEPARTMENT ANALYSIS:
1 . The proposed rezone to L-1 is not directly in conformance
with the Comprehensive Plan designation of Manufacturing
Park for the subject site. However, the City has
approved some rezones in the vicinity to Light
Industial including Ordinance 3469 (September 1980) ,
and Ordinance 3597 (January, 1982) . These actions
would suggest that the site is potentially suitable
for the L-1 classification being sought. (Section
4-3014C-1c. )
2 . The subject site is in an area which is in transition
from older single family residences to commercial/
industrial uses. These single family residences
are located to the south and west, while a storage
and office facility similar to the one proposed
is adjacent to the north. I-405 is to the east
of the subject site. The single family residence
located to the south of the subject site is zoned
L-1 , Light Industrial. The development plan does
not provide a landscape buffer between the two
uses ; therefore, according to Section 4-2204 (8) (B) (1 )
of the Parking and Loading, a minimum 42 inch high
fence will be required by the Building & Zoning
Department.
3. Available City records indicate that the subject
site appears not to have been specifically considered ,
in the last area land use analysis and area zoning
Section 4-3014C-1a) .
4. Suitable utilities are available to the subject
site. The Utilities Engineering Division indicates
that community facilities connection charge for
water and sewer will be required as well as submittal
of water and sewer plans. Hydrant locations are
to be approved by the Fire Department and a fire
flow analysis will be necessary.

5. The Design Engineering Division advises that off-site
improvements will be required as well as storm
water retention/detention.
6. A specific development plan has been submitted
for the applicant. The Examiner in R-044-80 covenanted
that the setback and landscaping requirements of
the M-P zone apply if the site were developed in
conjunction with the parcel adjacent. The applicant
has already constructed a building on the northerly
parcel. The development plan submitted appears
to be functional with the adjacent building to
the north. Combining the parking areas provides
a more functional parking lot and allows better
controlled access. Joint use access easements
need to be filed on both parcels of property.
M. DEPARTMENTAL RECOMMENDATIONS:
Based upon the above analysis, it is recommended that
the rezone request, file R-033-82, be recommended for
approval subject to the following conditions :
1 . Construction of a minimum 42-inch high sight obscuring
fence along the southern property line.
2 . Granting of joint access easements on both parcels
over the parking aisle to allow common circulation.

Gentlemen:
I request rezone of the property located at 1412 Maple
Avenue Southwest, Renton, Washington, from G-6000 to
L-I (Light Industrial) . I feel this request is appropriate
and timely because:
1. The site was not considered in a previous area rezone.
The subject lot was annexed into the city in 1959 at
which time the current zoning classification of G-6000
was applied.
2 . The area is in transition from older single family
residences to commercial/industrial uses . The site
is not attractive as a residential lot because of the
high noise factor caused by traffic on FAI 405. There
are only two remaining properties used as single
family residences on the 1400 block of Maple Avenue
Southwest. The property to the south and north of
the subject site are zoned L-I.
3 . The Comprehensive Plan designates the area for Man-
ufacturing Park but the subject site is too small
