the easement as shown on the short-plat was reserved for lot 10
only as shown on the Plat of Farrell ' s 1st Add. Vo . . 105/53-55

In regards to the request for a short plat on June 4 , 1982 , John
Gahan has delivered the technical corrections to me. We have met
all the requirements to the point where we think this request has
been dragging on. Something should be done as we have spent a lot
of time and money on this situation so far.
We were led to believe that we have to give 20 feet of property to
the City of Renton before the short plat could be recorded. We are
enclosing a copy of a signed deed to your satisfaction and we are
seriously hoping we can get this miserable thing cleared up.
We are enclosing a self-addressed envelope so that you may send
your agreement in writing that all documents will be recorded when
you receive the original deed, which I will deliver to you personally
after I receive your reply.
I own this land and I think I have been fair on my side of the deal .

We have received the subject short plat and found it unacceptable as submitted for
the following reasons:
1. The legal description on the face of the short-plat should be revised to
conform with the description as shown on the amended short-plat certificate
P.N.T.L:. Title Report#A-292417) .
v 2. The recording number of the easement along the south boundy of the short-
plat should be shown.
3. The 20 foot-strip adjacent to the east line of Lot Z of the short-plat
should be deeded to the City of Renton for road purposes.
Attached please find a QuiE Claim Deed with the legal description of said
20 feet which will have to be executed by the grantor.

Pederson is the record owner of the following-described real
property in King County, Washington:
North 97 feet of the East 200 feet of the following:
1 North Half of the South Half of the Southeast Quarter
of the Northwest Quarter of Section 3, Township 23 y
North, Range 5 East, H.M., in King County, Washington, 4
lying West of the centerline of the New Castle Road,
as located thereon on December 18, 1973. (Hereinafter
the Pederson land").
Developer is the record owner of the following-described real
property in King County, Washington:
Warrell's 1st Addition, according to plat thereof
recorded in Volume 105 of Plats, pages 53, 54 and
55, records of King County, Washington.
Tract 'A' of said plat abuts the Pederson land on the west,
and Lot 9 of said plat abuts a major part of the Pederson land on the
south. A;Eispete has arisen between the parties as to the location
of the common boundary line marking the westerly boundary of the
Pederson land and the easterly boundary of a portion of said pint.
The parties desire by this Agreement to resolve their L

BUILDING & ZONING The Building & Zoning Department report was received by the
DEPARTMENT REPORT:Examiner on July 13, 1982.
PUBLIC HEARING: After reviewing the Building & Zoning Department report,
examining available information on file with the application,
and field checking the property and surrounding area, the
Examiner conducted a public hearing on the subject as follows :
The hearing was opened on July 20, 1982 at 9:00 a.m. in the Council Chambers of the
Renton Municipal Building. Parties wishing to testify were affirmed by the Examiner.
Roger Blaylock, Zoning Administrator, presented the Building & Zoning Department report ,
and entered the following exhibits into the record:

surrounding the subject site
Mr. Blayloek advised that a carport located on Parcel A intrudes into the required
setback and is therefore an existing non-conforming use.
The Examiner requested testimony by the applicant. Responding was :

Responding to the Examiner' s inquiry regarding the understanding that construction on
Lot B cannot occur until an adequate method of sewerage is provided , Mr. Pederson
indicated fis understanding.
The Examiner requested further testimony in support of the application. Responding was :

Mrs . Pederson requested clarification of the sewer restriction. The Examiner advised
that application could be made to King County for septic service; however, if the land
does not percolate, construction on Lot B would be delayed until the moratorium is
lifed in the area, and although the lot could be sold, the building restriction would
remain on legal documents. Mrs . Pederson inquired if the existing sewer stub could be
utilized if sewers are approved in the area. Mr. Blaylock stated his assumption that
since dry stubs already exist, another connection would not be required; however, the
applicant may wish to utilize dry sewers not, leaving a gap and connecting to a septic
tank.
The Examiner requested additional time in which to publish a report on the matter.
Since there was no objection, the hearing regarding File No. Short Plat 049-82 was
closed by the Examiner at 9: 15 a.m.

FINDINGS, CONCLUSIONS & DECISION: Having reviewed the record in this matter, the Examiner
now makes and enters the following:
FINDINGS:
1 . The applicants, Theodore and Rachel Pederson, filed a request for a two-lot short
plat on an approximately 19,000 square foot parcel .
2. The application file containing the application, SEPA documentation, the Building
and Zoning Department report, and other pertinent documents was entered into the
record as Exhibit #1 .
3. Pursuant to the City of Renton's Environmental Ordinance and the State Environmental
Policy Act of 1971 , RCW 43.21C, as amended, the subject proposal has been determined
exempt from the threshold determination by the Environmental Review Committee (ERC) ,
responsible official .
4. Plans for the proposal have been reviewed by all city departments affected by the
impact of this development.
5. There was no opposition to the proposal expressed.
6. The subject site is located in the vicinity of 2213 Duvall Avenue N.E.
7. The site is zoned R-1 and the Comprehensive Plan designates the area in which the
subject site is located as suitable for the development of single family uses .
8. The subject site was annexed into the city in February of 1974 by Ordinance No. 2824.
The site was reclassified to its current R-1 category in April of 1982 by Ordinance
No. 3621 .
9. Access to the subject site is provided over Lot 9 of Farrell 's First Addition as a
result of a court decree.
10. The applicant proposes subdividing the subject lot into two lots. The easterlymost
lot would be 80 feet wide and 97. 1 feet deep for a total area of 7,768 square feet.
The second lot containing the Pederson residence would contain the remaining
approximately 11 ,000 square feet.
Sections 4-706(C) (2) and (3) require a minimum lot width of 75 feet for an interior
lot, which is the case, and a minimum lot depth of 85 feet, which is also the case.
11 . The subject property is in an area under a development moratorium because of
insufficient sewer capacity and the site cannot be served by sanitary sewer. The
applicant will have to demonstrate that an acceptable method of sewerage is available
to the subject site prior to development of the new lot.
The sewer tie in on the subject site cannot currently be connected to the city system.
CONCLUSIONS:
I . The short plat proposed by the applicant appears to meet the public use and interest
except that the applicant must demonstrate that the site can be served by a method
of sewer disposal whether it is a septic system or some other system approved by
the King County Health Department.
2. Since the legal division of the lot would allow the sale of the lot to an innocent
purchaser, the plat must reflect the fact that the lot cannot now be tied in with
the city sewer system and that until an acceptable sewer system is approved, the
lot must remain nondevelopable.
3. The lot will provide an additional in-city lot capable of eventually being developed
and will increase the tax base of the city.
DECISION:
The short plat is approved subject to the provision on the face of the plat of a
statement which indicates that the subject site is undevelopable because there is no
sewer service available to the subject site or approval of an alternative sewer system
by the King County Health Department.

The subject site was annexed into the City by Ordinance

D. PHYSICAL BACKGROUND:
1 . Topography: The subject site is essentially level.
2. Soils : Alderwood Gravelly Sandy Loam (AgC) . Permeability
is moderately rapid in the surface layer and subsoil
and very slow in the substratum. Runoff is slow
to medium, and the erosion hazard is moderate.
This soil is used for timber, pasture, berries,
row crops, and for urban development. Everett
Gravelly Sandy Loam, 5-15% slopes (EvC) . Permeability
is rapid. Runoff is slow and the erosion hazard
is slight. This soil is used for timber and pasture
and urban development.
3. Vegetation: Several short-to-medium growth trees
and shrubs are located in the easterly one-half
of the subject site while the northerly and easterly
perimeters contain a number of large deciduous
trees.
4. Wildlife: The existing vegetation provides suitable
habitat for birds and small mammals.
5. Water: No surface water was observed on the subject
site (July 9, 1982) .
6. Land Use: An existing single family dwelling is
found in the western one-half of the property with
similar uses to the north, east, south, and west.
E. NEIGHBORHOOD CHARACTERISTICS:
The surrounding properties are principally single family
residential in nature.
F. PUBLIC SERVICES:
1 . Water and Sewer: A 12-inch water main runs north-south
on Duvall Avenue across the street from the subject
site while an 8-inch sanitary sewer runs east-west
on S. E. 101st Street within 200 feet to the north.
A second 8-inch sanitary sewer is currently being
installed on the west side of Duvall within 1/4
mile to the south.
2. Fire Protection: Provided by the City of Renton
as per ordinance requirements.
3. Transit: METRO Transit Route #107 operates along
Union Avenue N. E. approximately 3/4 of a mile to
the west of the subject site.
4. Schools : Honeydew Elementary School is approximately
one mile southwest of the subject site while McKnight
Middle School is within 1 3/4 miles to the west
and Hazen High School is within 3/4 of a mile to
the southeast.
5. Recreation: Kiwanis Park is located approximately
one mile to the south of the subject site and the
North Highlands Park is within 2 miles to the west.

L. DEPARTNENT ANALYSIS:
1 . The proposed two-lot short plat generally conforms
with the Comprehensive Plan designation for single
family residential and the R-1 zoning classification.
2. The original rezone request was approved by the
City Council subject to the understanding that
a building permit could not be issued for the subject
site until a suitable means of sewage disposal
was provided. That condition would still exist
irrespective of approval of the short plat or not.
However, to protect future buyers of the property
a specific note should be placed on the front of
the short plat noting the limitation.
The sewer moratorium which covered this general
area is still in effect and there does not appear
to be any immediate solutions.
3. The proposed subdivision design does not appear
to suggest any legal access according to requirements
of the short platting ordinance. Specifically,
it does not either have frontage upon Duvall Avenue
N.E. or as pipestem lot accessing the subject lot.
Access is provided in the form of an easement granted
over the pipestem for Lot No. 9 of Farrel' s First
Addition to the existing residence. This easement
is a result of a legal suit between the present
property owner Mr. T.M. Pederson and Don Farrel
and Mac-Land Inc . which resulted in a binding agreement
in 1978 . This agreement is attached showing the
existance of an easement created by court decree.

Position of the Building & Zoning Department is
that this legal agreement creates legal access
to the residence and, therefore, is not required
to comply with the access criteria of the City
of Renton Subdivision Ordinance.
4. The eastern most lot does not specifically comply
with the dimensional requirements of the R-1 zone.
The minimum depth for a lot is required to be 85
feet. The proposed lot is shown at 80 feet. Moving
the property line five ( 5) feet would still allow
the structure on the western most lot to comply
with the setback requirements and the special setback
requirements for detached accessory building.
M. DEPARTMENT RECOMMENDATION:
Based upon the above analysis, it is recommended that
the short plat request, file Short Plat-049-82, be approved
subject to the following conditions :
1 . Disclosure of non-buildable nature of eastern most
lot until sewage disposal system is approved by
the Public Works Department.
2. Enlargement of the eastern most lot to comply with
the minimum depth of 85 feet.
3. Place on the face of the Short Plat the specific
easement granted to the western most lot by a court
agreement.

RE: SHORT PLAT APPLICATION/DUVALL AVENUE N.E.
Dear Mr. Pederson:
After reviewing the short plat application we find that there are three items which
need to be addressed prior to the processing of the short plat request. The first is the
submission of a new affidavit of ownership. The original affidavit submitted with the
rezone is not valid for a secondary permit request. Please find enclosed two affidavits
for your signature before a Notary Public then return to the Building and Zoning
Department.
The second item is the issue of sewer connection. The rezone was specifically
predicated upon "your understanding that the reclassification of the property to R-1
does not mitigate the necessity for acceptable sewage disposal from the subject site
according the provisions of the subdivision or building codes." Presently there is a
moratorium is this area and there is no sewer capacity for you to connect on to even
though you presently have sewer stubs to your property. Therefore, you will have to
provide an approved method by the Seattle-King County Health Department showing
that the property is acceptable for sewage disposal.
The third item is a question of the access over the adjacent lot to your present
residence. I realize that a court decision was reached which gave you those access
rights. However, a copy of that decision and subsequent easement must be attached to
the application to complete the documentation and provide the Hearing Examiner an
accurate record. It is probable that that easement will have to show on the face of
the short plat but that's only a minor adjustment to the drawings prepared by the
surveyor.
Upon submission of the above three items, we will schedule the short plat for public
hearing before the Hearing Examiner.

SUBJECT: Ted Pederson Short Plat
As you know the above subject plat is in the sewer moratorium area
and no permits are being issued in the area. However, the short
plat was allowed to be completed conditioned upon an acceptable
sewage disposal system being approved at the time of request for
building permit.
Mr. Pederson came into my office last week and was concerened
about the sewage disposal . I told him I understand the Council
said they would cross that bridge when the time came. I further
advised him not to "perk" the site since the perk permit would
probably run out before he did any building or the sewer by then
could be available for hook-up so he would be throwing money away
to do a "perk" .

collectively referred to as "Developer, " and Theodore M. Pederson and
Rachel M. Pederson, hereinafter referred to as "Pederson. "
RECITALS
Pederson is the record owner of the following-described real

lying West of the centerline of the New Castle Road,

the Pederson land") .
Developer is the record owner of the following-described real
property in King County, Washington:
Farrell ' s 1st Addition, according to plat thereof
recorded in Volume 105 of Plats, pages 53 , 54 and
55 , records of King County, Washington.
Tract "A" of said plat abuts the Pederson land on the west,
and Lot 9 of said plat abuts a major part of the Pederson land on the
south. A dispute has arisen between the parties as to the location
of thE:! common boundary line marking the westerly boundary of the
Pederson land and the easterly boundary of a portion of said plat.
The parties desire by this Agreement to resolve their
differences concerning the location of said common boundary line. It
is, therefore,
AGREED as follows :
1. Conveyances .
Developer agrees to convey to Pederson by Statutory
Warranty Deed Tract "A" of said plat, together with a permanent, non-
exclusive easement over, upon, under and across the North 20 . 02 feet
of Lot 9 of said plat for the benefit of the Pederson land and for
the benefit of Tract "A" of said plat, for ingress to and egress from

said dominant tenements, and for drainage and the installation, main-
tenance, repair and replacement of underground electric, telephone,
cable television, sewer and water service, likewise for the benefit of
said dominant tenements.
2 . Construction and Maintenance of Easement Road.
Developer agrees to construct and initially surface at

vehicular travel after the same has been surfaced and said utilities
installed.
3. Use of Facilities.
Pederson shall be permitted, without any charge by
Developer but at his own expense, to make two connections or hookups to
the sewer line installed in the land subject to said easement for the
use and benefit of Tract "A" and the Pederson land.
4. Release.
Pederson releases Developer of any and all claims to any
right, title, interest, lien or estate in and to any land lying westerly
of the said Tract "A" in said plat of Farrell' s 1st Addition.

5. Binding on Successors .
This Agreement shall be binding upon and inure to the
benefit of the heirs, personal representatives, successors and assigns
of the parties.
