OLD BUSINESS continued
Downtown number of downtown street lights, primarily on South 2nd and South
Christmas 3rd, during the Christmas season. Also recommended was referral
Lighting to the Administration for implementation of the matter. MOVED BY
REED, SECONDED BY MATHEWS, CONCUR IN THE RECOMMENDATION OF THE
COMMUNITY SERVICES COMMITTEE. Mayor Shinpoch advised expenditure
of $3,000.00 last year for purposes of Christmas lighting, with
anticipation of increased amount this season. MOTION CARRIED .
Aviation Aviation Committee Chairman Trimm recommended approval of a new
Committee temporary lease agreement for float unit storage space for Renton
Lease Agreement Aviation. The report stated need will be temporary, two to three
Renton Aviation winter seasons with variable quantities of floats; use will be
normally inactive during summer months; 220 square feet of space
is average space requirement; and flat rate of $3.00 per month
is recommended with Renton Aviation certifying with each payment
the number of stored floats used in calculating the lump sum due.
MOVED BY TRIMM, SECONDED BY ROCKHILL, CONCUR IN THE RECOMMENDATION
OF THE AVIATION COMMITTEE. Councilman Stredicke objected to the
method of calculation of the monthly rate since it creates need for
accounting which is difficult in airport operations. MOTION
CARRIED. Councilman Stredicke requested his NO vote be recorded.

NEW BUSINESS Councilman Stredicke requested an explanation of types of

plaintiff ' s business in an undesirable and unattractive area of
the city. Warren noted that a right of hearing remains open to
the city if the Council wishes to pursue that option. The
recommendation of the magistrate may either be accepted or rejected
by the judge, and the right of hearing still remains open to the
city.

CHANGING THE ZONING CLASSIFICATION OF CERTAIN
PROPERTIES WITHIN THE CITY OF RENTON FROM
RESIDENCE DISTRICT (R-1) TO LIGHT INDUSTRY
DISTRICT (L-1) (R-062-82 - HARDEBECK)
WHEREAS under Chapter 7 , Title IV (Building Regulations)
of Ordinance No . 1628 known as the "Code of General Ordinances of the
City of Renton" , as amended , and the maps and reports adopted in
conjunction therewith , the property hereinbelow described has hereto-
fore been zoned as Residence District (R-1) ; and
WHEREAS a proper petition for change of zone classificati ,
of said property has been filed with the Building and Zoning Department
on or about August 13 , 1982 , which petition was duly referred to the
Hearing Examiner for investigation , study and public hearing , and
a public hearing having been held thereon on or about September 14 ,
1982 ,
and said matter having been duly considered by the Hearing
Examiner and said zoning request being in conformity with the City ' s

Smithers Avenue William Kline, 321 Smithers Avenue S. , requested discussion of his
Parking letter of correspondence. MOVED BY ROCKHILL, SECONDED BY MATHEWS ,
SUSPEND THE ORDER OF BUSINESS AND ADVANCE TO CORRESPONDENCE. CARRII
Letter from Mr. Kline along with petition signed by 13 owners/lesse,
of property on Smithers Avenue S. was read which reported issuance
of citations recently on Smithers Avenue S. , parking restrictions
not being previously enforced . The letter requested removal of the
two hour parking restriction to allow use of the space during
business hours. It was noted by Council that removal of the parking
restriction may legalize parking of fleet vehicles owned by
local car dealership. Responding to Mr. Kline' s concern , Captain
Don Persson , Renton Police Department , stated that the citations
recently issued were in response to a citizen complaint . MOVED BY
ROCKHILL, SECONDED BY STREDICKE, THAT REVIEW OF PARKING RESTRICTION',
ON SMITHERS AVENUE S. BE REFERRED TO THE TRANSPORTATION COMMITTEE .

Utility Iepartment Dale Nichols, 609 S.W. 3rd Place, complained of overcharge on the
Billing water bill for his rental , noting estimate made of useage for six
months since meter reader claimed he could not read the meter becau-„
of parked vehicles. As a result , a toilet leak had not been discovu
or repaired, and Mr. Nichols felt a refund was in order and the ordir
should be reviewed to require city responsibility for notifying prole
owners of leaks. MOVED BY REED, SECONDED BY ROCKHILL, MATTER OF
JTILITY BILLING BE REFERRED TO THE UTILITIES COMMITTEE . CARRIED .

rezone on the northeast corner of the intersection of the Maple

Planning As required by Ordinance No. 3076, Planning Commission submitted
Commission 1981 - 1982 Annual Report containing a 1980 census overview,
Annual Report information regarding Central Area Comprehensive Plan Amendment
and Renton Zoning Ordinance revisions, and a tabular summary of
Commission activities for the year. Information only.

CORRESPONDENCE AND CURRENT BUSINESS
Status Report on As requested by Council , Richard Houghton, Public Works Director ,
S.W. 43rd Street presented a status report on the S.W. 43rd Street project ,
Project and N. E. outlining construction progress and noting that completion ahead
4th & Union of schedule is anticipated in the spring of 1983. Status of the
Project N. E. 4th and Union Avenue N. E. project was reviewed by Mr.
Houghton, who advised violations cited by the Washington State
Department of Transportation have been resolved to date. Responding
to further Council inquiry, Mr. Houghton indicated that the impending
joint Renton and Tukwila federal funds Grady Way bridge project will
be awarded by the state, and a state engineer will be assigned to
oversee its progress.

Utilities, Utilities Committee Chairman Mathews presented a report recommending
Committee that the entire Council study and determine the policy decision of
Utility rate utility rate options since increases are associated with budget
options recommendations by the Administration. MOVED BY MATHEWS, SECONDED
BY TRIMM, COUNCIL CONCUR IN THE RECOMMENDATION OF THE COMMITTEE.
CARRIED.
LID 320 Utilities Committee Chairman Mathews presented a report recommending
concurrence in the recooiendation of the Public Works Department that
all bids be rejected without prejudice on LID 320 - Water Project
IIW-614 Bid Opening, and the project scope be reduced and rebid as
a Small Works Project. Further, it was requested that the committee
be kept advised as to the progress of the LID. MOVED BY MATHEWS,
SECONDED BY TRIMM, CONCUR IN THE RECOMMENDATION OF THE UTILITIES
COMMITTEE. CARRIED.
Shoreline Master Councilman Reed advised receipt of a transcript of his testimony
Program al a Planning Commission meeting set to review the Shoreline Master
Program as well as a letter from the City Attorney regarding a
possible violation of the Appearance of Fairness Doctrine, and he
is of the opinion following review that a violation has not occurred
and his future participation on the subject matter would be allowed.

Dunlap Canyon Councilman Stredicke noted receipt of a complaint regarding
Improvements crosswalk modifications in Dunlap Canyon area which preclude
access across the roadway from the Earlington area. Public Works
Director Houghton explained specifics of the improvement project
which resulted in restricted access due to undergrounding of
power lines. He noted that corrections will be made.

WHEREAS, Jerry L. Hardebeck and his wife Carolyn R. Hardebeck are the owners
of the following real property in the City of Renton, County of King, State of
Washington, described as follows:
The West 100 feet of Lots 26, 27, 28, and 29, Block 22, C. D. Hillman 's
Earlington Gardens Addition to the City of Seattle, Division No. 1 ,

adversely affected by any violation or breach of these restrictive covenants .
Reasonable attorneys ' fees incurred during an enforcement proceeding will be borne

PUBLIC HE/ RING: After reviewing the Building & Zoning Department report,
examining available information on file with the application,
and field checking the property and surrounding area, the
Examiner conducted a public hearing on the subject as
follows :
The hearing was opened on September 14 , 1982 at 10:00 a.m. in the Council Chambers of the
Renton Municipal Building. Parties wishing to testify were affirmed by the Examiner.
Roger Blaylock, Zoning Administrator, presented the Building & Zoning Department report ,
and entered the following exhibits into the record:

Referencing Recommendation No. M.2 of the staff report, Mr. Blaylock added the requirement
for a 20-foot building setback to be included in restrictive covenants .
The Examiner requested testimony by the applicant. Responding was :

Mr. Evans noted an error in the report , Section A. Summary and Purpose of Request , which
denotes the proposed use as a parking lot for garbage trucks . He advised use of the site
will be confined to employee parking as a backup to the applicant 's other L-1 zoned
propert / which is contiguous to the subject site. Remodeling of the existing building
on the adjoining parcel is proposed, and to meet requirements of the building permit,
storm retention will be required on the subject site to serve the other proposal .
Addressing Section L. 5, third condition, of the staff report, Mr. Evans objected to
participation
in the intersection improvements at S.W. Grady Way and Lind Avenue S.W.
because of the anticipated increased activity resulting from the rezone, and advised
that ar increase in activity will not occur since the site will be used only parking;
and, tlerefore, the condition is unreasonable. Referencing the condition requiring e10
feet o' landscaping on Lind Avenue S.W. , he stated the applicant 's

20-foo easement on the right-of-way which would be landscaped; otherwise, the
landscaping as required in the report will be provided.
The Examiner requested further comments in support or opposition. Since there was no
response, the hearing regarding File No. R-062-82 was closed by the Examiner at 10:00 a.m.
FINDINGS, CONCLUSIONS & RECOMMENDATIONS: Having reviewed the record in this matter, the
Examiner now makes and enters the following:
FINDINGS:
1 . The applicant , Jerry Hardebeck, filed a request for approval of a reclassification of
approximately 5,720 square feet of property from R- 1 (Single Family Residential ;

Minimum lot size - 7,200 square feet) to L-1 (Light Industry) .
2. The application file containing the application, SEPA documentation, the Building
and Zoning Department report, and other pertinent documents was entered into the
record as Exhibit #1 .
3. Pursuant to the City of Renton's Environmental Ordinance and the State Environmental
Policy Act of 1971 , RCW 43.21C, as amended, a Declaration of Non-Significance has
been issued for the subject proposal by the Environmental Review Committee (ERG) ,
responsible official .
4. Plans for the proposal have been reviewed by all city departments affected by the
impact of this development.
5. The subject property is located on the corner of Lind Avenue S.W. and S.W. 16th Street
in the vicinity of 412 S.W. 16th Street.
6. The subject site is essentially level . There are some large deciduous trees on the
site and along the undeveloped public right-of-way adjacent to the site.
7. The subject site is presently vacant. A storage yard operated by the applicant for
garbage trucks is located adjacent to the site to the east. The applicant proposed
developing a parking lot on the subject site for its employees ' cars. The site
would also serve as a storm water retention/detention system for the applicant's
property development plans.
8. A single family residence is located north of the subject site. Landfill operations
are being carried out on the Austin property tothe south of the subject site.
Other commercial , light industrial and older residential uses are located in the
vicinity, including a lumber yard to the west across Lind Avenue S.W.
9. The Comprehensive Plan designates the area in which the subject site is located
as suitable for the development of manufacturing park uses.
10. The subject lot is approximately 40.3 feet wide and 143.91 feet long.
11 . The subject site was annexed into the city in 1959 by Ordinance No. 1745. The site
was zoned G-6000 (General ; Single Family Residential ) upon annexation. A
terminology change in 1982 has labeled the site R- l .
12. Similar rezones have occurred in the areas just north and just south of 1-405.
These rezones include among others: Gray, 1978, Ordinance No. 3270; Dalpay, 1979,
Ordinance No. 3308; Dahlby, 1980, Ordinance No. 3469; Lewis , 1980, Ordinance No. 3482.
Restrictions generally accompanied these actions requiring setbacks similar to those
required in an M-P (Manufacturing Park) zone as an attempt to provide some fidelity
to the Comprehensive Plan for these smaller parcels. Generally a 20-foot structural
setback of which the 10 feet abutting the public right-of-way was landscaped has been
required.
13. An LID for the improvement of S.W. 16th Street and the East Valley Road is currently
under way.
Staff had recommended that the applicant participate in the costs associated with
the improvement of S.W. Grady Way and Lind Avenue S.W. Such participation would be
related to the increased activity on the subject site.
The applicant indicated that the subject property would only serve as parking for
the already operating facility it owns on the eastern lot.
14. The applicant proposed acquiring city right-of-way to provide a landscape buffer
along Lind Avenue S.W.
CONCLUSIONS:
1 . The proponent of a rezone must demonstrate that the request is in the public interest
and will not impair the public health, safety and welfare. In addition, the rezone
must comply with at least one' of the three criteria listed in Section 4-3014 which
provides in part that:
a. The subject site has not been considered in a previous area rezone or land use
analysis; or
b. The subject site is potentially designated for the new classification per the
Comprehensive Plan; or

c. There has been material and substantial change in the circumstances in the

with uses permitted in the M-P zone, that is , light industrial and warehousing uses .
The actual use proposed is passenger vehicle parking which is also compatible with
the Conprehensive Plan.

L. DEPARTMENT ANALYSIS :
1 . The proposal is not specifically consistent with
the Comprehensive Plan designation of Manufacturing
Park for the subJect site.
2 . The subject site was annexed into the City in 1959,
by Ordinance #1745 and has not been considered
for a rezone since that time. Ordinance #3634
in June, 1982, changed the zoning classification
on the property from G-6000 to R-1 .
3. There have been a series of rezones in the general
area which have been approved to allow L-1 zoning
upon small lots which cannot be developed to the
standard conditions of the Manufacturing Park zone.
These rezones include Ordinance Nos. : #2425 (August,
1968) ; #2559 (April, 1970) ; #2590 (October, 1970) ;
2594 (October, 1970) ; #3053 (August, 1976) ; #3270
December, 1978) ; #3308 (April, 1979) ; #3338 (July,
1979) ; #3469 (September, 1980) ; and #3482 (November,
1980) . Presently, the Examiner has approved a
similar case for Mr. J. Clifford Gray, north of
I-405.
These rezones were all approved subject to restrictions
for buffering and design compatibility with the
objectives of the Green River Valley Comprehensive
Plan. Normally, they require a minimum of a twenty
20) foot setback from any public right-of-way
for structures along with ten (10) feet of landscaping
adjacent to the public right-of-way and adjacent
to any single family residential structure.
These actions would indicate that the subJect site
is potentially zoned in compliance with policies
of the Comprehensive Plan as required under Section
4-3014 (C) (1 ) (b) .

4 . The general area is undergoing major development
changes b"th public and private. Private land
fills have occurred immediately south of the proposed
rezone site and to the southwest. The Austin Company
has developed a 200,000 square foot office structure
to the southwest of the site and other major complexes
have been proposed along Lind Avenue S.W. The
City is presently engaged in construction of L. I.D.
314 which will include major construction on S.W.
16th Street and East Valley Highway. Thus appearing
to comply with Section 4-3014 (C) (1 ) (c) .
5 . The Policy Development Department advises that
the rezone should be approved subJect to three
conditions.
o The first condition would be the requirement
of ten (10) feet of landscaping along all
street property lines. This would include
both Lind Avenue S.W. and S.W. 16th Street.
In affect, it would reduce the usable area
of the lot by 30%.
o The second condition, would be to review any
site development with consistency with the
Green River Valley Comprehensive Plan and
the general development in the area. This
is consistent with all of the other rezones
that have been approved in the general area
under similar circumstances.
o The third condition, would be to participate
in intersection improvements at S.W. Grady
Way and Lind Avenue S.W. because of the anticipated
increased activity resulting in the development
of the rezone.
7 . Department comments are attached for the Examiner' s
and public' s review.
M. DEPARTMENTAL REIC NDATION:
Based upon the above analysis, it is recommended that
the rezone request from R-1 to L-1 , Light Industrial,
file R-062-82, be approved subject to the following
conditions :
1 . Site plan approval of future development.
2 . Filing of restrictive covenants requiring the placement
of ten (10) feet of landscaping adJacent to the
public right-of-way for S.W. 16th Street and Lind
Avenue S.W.
3. Filing of restrictive covenants to participate
in the L. I .D. for the improvements of S.W. Grady
Way and Lind Avenue S.W.

uses. The program is city-wide in scope.

Introduct on The State Environmental Policy Act of 1971 , Chapter 43.21C, RCW, requires
all state and local governmental agencies to consider environmental values both for their
own actions and when licensing private proposals . The Act also requires that an EIS be
prepared for all major actions significantly affecting the quality of the environment.
The purpose of this checklist is to help the agencies involved determine whether or not a
proposal is such a major action.
Please answer the following questions as completely as you can with the information
presently available to you. Where explanations of your answers are required , or where
you believe an explanation would be helpful to government decision makers , include your

1. The term "mortgage," when used herein, shall include deed of trust, trust deed or other security instrument.
2. If the proposed Insured has or acquires actual knowledge of any defect, lien, encumbrance, adverse claim or other
matter of ecting the estate or interest or mortgage thereon covered by this Commitment other than those shown in
Schedule B hereof and shall fail to disclose such knowledge to the Company in writing, the Company shall be relieved

1. The term "mortgage," when used herein, shall include deed of trust, trust deed or other security instrument.
2. If the prc posed Insured has or acquires actual knowledge of any defect, lien, encumbrance, adverse claim or other
matter affecting the estate or interest or mortgage thereon covered by this Commitment other than those shown in
Schedule B hereof and shall fail to disclose such knowledge to the Company in writing, the Company shall be relieved
from liability for any loss or damage resulting from any act of reliance hereon to the extent the Company is prejudiced by
failure to so disclose such knowledge. If the proposed Insured shall disclose such knowledge to the Company or if the
Company otherwise acquires actual knowledge of any such defect, lien, encumbrance, adverse claim or other matter,
the Company at its option may amend Schedule B of this Commitment accordingly, but such amendment shall not
relieve the Company from liability previously incurred pursuant to paragraph 3 of these Conditions and Stipulations.
3. Liability of the Company under this Commitment shall be only to the named proposed Insured and such parties included
under the definition of Insured in the form of policy or policies committed for and only for actual loss incurred in reliance
hereon in undertaking in good faith(a)to comply with the requirements hereof, or(b)to eliminate exceptions shown in
Schedule B or(c)to acquire or create the estate or interest or mortgage thereon covered by this Commitment. In no event
shall suc i liability exceed the amount stated in Schedule A for the policy or policies committed for and such liability is
subject to the insuring provisions, the Exclusions from Coverage and the Conditions and Stipulations of the form of
policy or policies committed for in favor of the proposed Insured which are hereby incorporated by reference and are
made a part of this Commitment except as expressly modified herein.
4. Any actic n or actions or rights of action that the proposed Insured may have or may bring against the Company arising
