Lt be known that although I agree to participate in the proposed L I D under
the terms of my application for re-zone, File #R-068-82 CU 169-82, on the
SE Corner of Monroe and NE 4th St., I do not want my support of thisproposal
to be misunderstood.
The proposed $34,928.00 for the purchase of right of way for parcel #1 -
Greenwood Memorial Park does not agree with the $100,00.00 which appears
in the REPORT and RECOMMENDATION TO THE CITY COUNCIL for my rezoning of the
SE Corner of Monroe St. and NE 4th St. , File #R-068-82 CU-069-82.
This was granted on January 23, 1983 under Ordinance #3704. Enclosed is a
copy of letter granting the approval.

AN ORDINANCE OF THE CITY OF RENTON , WASHINGTON
CHANGING THE ZONING CLASSIFICATION OF CERTAIN
PROPERTIES WITHIN THE CITY OF RENTON FROM
GENERAL CLASSIFICATION DISTRICT (G-1) TO PUBLIC USE
DISTRICT (P-1) (R-068-82 HOLMS , INC . )
WHEREAS under Chapter 7 , Title IV (Building Regulations) of
Ordinance No . 1628 known as the "Code of General Ordinances of the
City of Renton" , as amended , and the maps and reports adopted in
conjunction therewith, the property hereinbelow described has
heretofore been zoned as General Classifciation District (G-1) ; and
WHEREAS a proper petition for change of zone classification
of said property has been filed with the Building & Zoning Department:
on or about October 28 , 1982 , which petition was duly referred to the
Hearing Examiner for investigation , study and public hearing, and a
public hearing having been held thereon on or about November 30 , 1982 ,
and said matter having been duly considered by the Hearing Examiner
and said zoning request being in conformity with the City ' s
Comprehensive Plan , as amended , and the City Council having duly

First Reading Ways and Means Committee Chairman Clymer presented a report
recommending the following ordinance for first reading:
Zoning Map An ordinance was read adopting the Zoning Map as official designation
for zoning classifications in City of Renton. MOVED BY CLYMER,
SECONDED BY HUGHES, THIS MATTER BE REFERRED BACK TO COMMITTEE FOR
TWO WEEKS. CARRIED. Concern was expressed by Council that large size
of Zoning Map makes reference to it difficult , and Council members do
not have zoning information readily available to them during meeting,. .
Library Board Ways and Means Committee Chairman Clymer presented a report
Appointment recommending concurrence in the Mayor's appointment of John Simpson,
John Simpson P.O. Box 34, Talbot Hill resident, to the Library Board to succeed
Mr. James E. Hurner, effective to June 1 , 1987 (five year term) .
Mr . Simpson has served as school board member in Missouri , has been
politically active in Alaskan politics as one-time advisor to the
governor for that state, and, being Sioux Indian, as an Indian
interpreter for U .S. Government officials. MOVED BY CLYMER, SECONDED
BY HUGHES, COUNCIL CONCUR IN THE MAYOR'S APPOINTMENT OF MR . JOHN
SIMPSON TO THE LIBRARY BOARD FOR A FIVE YEAR TERM. CARRIED.
LID Policy Ways and Means Committee Chairman Clymer presented a report recommends

district (P-1 ) (Holms, Inc. R-068-82) . MOVED BY CLYMER, SECONDED
BY HUGHES, THIS MATTER BE REFERRED BACK TO COMMITTEE FOR ONE WEEK.
CARRIED. Responding to Councilman Stredicke's concern that only a portion
of the entire cemetery site is included in the rezone, Mr. Clemens
advised rezone requested instead of conditional use permit for
purposes of mausoleum construction on one acre, existing use is legally
non-conforming, and the entire site was not rezoned to P-1 by choice
of the applicant who would then be required to provide all improvements
on N.E. 4th Street in future project along frontage of applicant 's
property.
Sales Tax An ordinance was read amending Section VI of Ordinance No. 3647 which

NEW BUSINESS Council President Trimm announced that an Executive Session would
Executive be held following audience comment to discuss results of police
Session arbitration and receive update on Forbes lawsuit.
ADMINISTRATIVE Mayor Shinpoch updated a previous report regarding Metro ridership
REPORT decrease, noting ridership in Renton has not declined as in surrounding
Metro Ridership areas.
Fire Training Attention was called by Mayor Shinpoch to three day fire training
Session session at Carco Park hosted for third year by Renton Fire Department
and attended by 100 firemen from all jurisdictions. The department
was commended for quick response time in aid call to a downtown
restaurant in recent incident.
Health Mayor Shinpoch reported that negotiations regarding the Seattle-King
Contract County Department of Public Health contract are completed for
execution of the contract. Council President Clymer, representative
on the negotiation committee, indicated he was not notified of the
meeting by King County.
Senior Center Mayor Shinpoch announced she officiated at swearing-in ceremony
this date for new officers of the Senior Citizens Advisory Committee.
Compliments were extended by the committee to members of Council
for their support of senior center activities and programs. It was
noted that Sarah Johnson, faithful participant at the center, recently
celebrated her 90th birthday. Councilman Reed was notified of
resolution of parking problem at the senior center, arrangements having
been made with representatives of Carpenters ' Hall for use of parking
space.

ADMINISTRATIVE REPORT continued
Mayor Shinpoch announced that Downtown Merchants ' Association will
be reminded that Christmas decorations must be removed.
Responding to Councilman Mathews ' inquiry, Mayor Shinpoch advised
inclusion in Council material of copy of the contract agreement
with the City of Tukwila for animal control services, in which costs
and services are outlined.

AUDIENCE COMMENT Richard Pierce, 10433 Kent-Kangley Road, Kent, requested a response
Taxicab to an earlier complaint relating to unlicensed taxi cab operations in
Ordinance the City of Renton. Mayor Shinpoch reported allegations were
confirmed upon investigation and offending firms will be notified of
city requirements. Further, since citations may be issued solely on
witnessed violations or filing a formal complaint, making enforcement
of ordinance difficult, referral to the Public Safety Committee for
review of the ordinance is recommended. Mr. Pierce suggested that

D. PHYSICAL BACKGROUND:
1 . Topography: The subject site is basically level.
2. Soils: Arents Everett Material (An) . This is
a level to gently sloping, dark-brown gravelly
or very gravelly sandy loam. Permeability is rapid
and the available water capacity is low. Runoff
is slow and the erosion hazard is slight. This
soil is used for urban development.
3. Vegetation: The site consists of some scrub brush,
low shrubs and a few Douglas Fir trees.
4 . Wildlife: The existing vegetation may provide
suitable habitat for birds and small mammals.
5. Water : No surface water was observed on the subject
site (November 19 , 1982) .
6. Land Use: The subject site is undeveloped at this
time. To the east and south is the Greenwood Memorial
Cemetery. On the west are some light commercial
uses while the Renton Vo-Tech, a service station
and an apartment complex are situated to the northwest
and north.
E. NEIGHBORHOOD CHARACTERISTICS:
The surrounding properties are a combination of commercial,
light industrial, institutional and multiple family
uses.

Pursuant to the City of Renton' s Environmental Ordinance
and the State Environmental Policy Act of 1971, as amended,
RCW 43-21C, the Environmental Review Committee issued
a final declaration of non-significance with conditions
for the subject proposal on November 15 , 1982.

L. DEPARTNENT ANALYSIS:
1 . The applicant is seeking a rezone from G-1 , General
Use District, to P-1 , Public Use District, along
with approval of a conditional use permit to allow
the construction of a mortuary. The mortuary has
been determined by the Building and Zoning Department
to be a commercial enterprise. Therefore, the
applicant must seek a conditional use permit under
Section 748 (D) ( 2) (a) which would allow a B-1 use
in the P-1 district.
2. The area proposed for the rezone occupies the identical
site as the area proposed by the conditional use
permit. The total area is approximately 1 . 84 acres
with dimensions of 200 feet by 400 feet located
on the southeast corner of the intersection of
Monroe Avenue N.E. and N.E. 4th Street. The background
information for both the rezone and the conditional
use permit are identical. Analysis is now broken
into two segments based upon the different criteria
imposed for the rezone and conditional use permit.
REZONE
3. The rezone request from G-1 to P-1 , Public Use,
conforms to the Public/Quasi-public land use design-
ation imposed on the subject site by the Comprehensive
Plan.

None of the policies of the Comprehensive Plan
can be specifically directed to the development
of a mortuary in a P-1 zone. However , the policies
established under 3.B, District Objectives, generally
support the concept of identifying use districts
and encouraging the efficient and functional relationship
between various land uses within that district.
A mortuary, even though it is a business activity,
is a compatible use to the,=adjacent cemetery.
In fact, it increases the efficiency of the funeral
process. If would appear that both the Comprehensive
Plan map and the Goals and Policies support the
rezone request. [Section 4-3014 (C) ( 1 ) (b) . ]
4 . The site has not been considered for rezoning since
it was annexed into the city in 1966. This would
support the second criteria which requires that
a reclassification has not been considered since
the last time of land analysis which was in December
of 1981 . [Section 4-3014 (C) (1 ) (a) . ]
5. The general area has undergone significant development
from both public agencies and private developers.
Monroe Avenue N.E. is being improved by the City
of Renton and King County and provides the major
access to both the city and county shop facilities
and the District Court facility. Private developments
include a major apartment complex on the north
side of N.E. 4th Street, and commercial and apartment
complexes to the east. This is the last major
property owner along N.E. 4th Street to propose
recent development. This would comply with Section
4-3014 (C) (1 ) (c) .
6. The final test to determine if the change of zoning
classification is advisable and in the public interest
is timeliness. The requested rezone to P-1 , Public
Use, is a direct result of the location of the
adjacent cemetery. Both the cemetery and mortuary
would be owned and operated by the same company.
The general development of the area would suggest
that rezoning the subject property and developing
it into a more intense activity would be timely.
However , this is only true if it serves the public
interest. As stated above, the cemetery represents
the last portion of property to be developed or
reviewed for development between Monroe Avenue
N.E. and Union Avenue N.E. along N.E. 4th Street.
The City of Renton has recognized the need for
major improvement along this major arterial corridor
and has required, through previous land use actions
the acquisition of additional right-of-way to widen
N.E. 4th Street to alleviate the access problem.
Even though, the proposal appears to be in general
harmony with the Comprehensive Plan, the potential
effects on the public interest must be weighed
when increasing the land use intensity of the area.

The Public Works Department has recommended that
the applicant dedicate sufficient right-of-way
to widen N.E. 4th Street and participate in the
L.I.D. for the improvement of that arterial. It
would appear that the rezone and subsequent development
are only timely if the traffic and access problems
are sufficiently addressed and resolved for the
benefit of the public interest.
CONDITIONAL USE PERMIT
7. In reviewing the conditional use permit, the Hearing
Examiner must review the following eleven criteria
under Section 4-748 (C) :
Comprehensive Plan: The proposed use shall be
compatible with the general purpose, goals, objectives
and standards of the Comprehensive Plan, the Zoning
Ordinance and any other plan, program, map or ordinance
of the City of Renton.
The proposal to construct a mortuary on the subject
site complies with the general criteria of the
Comprehensive Plan and the land use designation
map. It is functionally compatible with the intent
and present use of the adjacent cemetery.
Community Need: There shall be a community need
for the proposed use at the proposed location.
It would appear that the construction of a mortuary
adjacent to a cemetery is a complimentary function
and may, in fact, decrease some of the existing
detrimental impacts on the community as a whole,
specifically traffic congestion.
Compatibility: The proposed use shall be compatible
with the residential scale and character of the
neighborhood.
Neither the building design nor the scale of the
proposed development appears to impact or create
any undue adverse effects on adjacent properties.
The intent of the developer is to blend the cemetery
and mortuary functions together. The two story
structure will not be imposing considering the
potential adjacent and existing developments.
On the north side of N.E. 4th Street, there presently
exists a three story multiple family structure.
All of the nearby public and quasi-public installations
1 are of a scale much greater than the proposed mortuary
structure. The building itself appears to cover
an area of 9 , 000 square feet.
The proposed mortuary structure will cover slightly
less than 12% of the subject site. Since the P-1
zone does not have a maximum lot coverage and the
buildable area is limited only by required setbacks,
it would be legal to cover approximately 80% of
the subject site. However, the conditional use
criteria requires that this be reduced by 50% or
approximately 40% of this specific site could be
covered. The applicant ' s proposal complies with
the lot coverage criteria. All setback requirements
have been complied with on the proposed site plan.

Compatibility: The proposed use shall be compatible
with the residential scale and character of the
neighborhood.
The neighborhood characteristics surrounding the
subject site include a dominance of public uses
with some commercial and medium density multiple
family uses. The proposed building is smaller
than the other existing uses in the area. It would
appear to be in scale and character with the other
adjacent uses.
Parking: Parking areas shall not be allowed in
the front, side and rear yard setbacks except upon
approval by the Hearing Examiner as provided in
Section 4-708 (B) (3) (a) . Parking under the building
structure should be encouraged. Lot coverage may
be increased to as much as seventy-five percent
75%) of the lot coverage requirement of the zone
in which the proposed use is located if all parking
is provided underground or within the structure.
The proposed site plan complies with this requirement
and no parking is provided in the front, side or
rear yard setbacks.
Traffic : Traffic and circulation patterns of vehicles
and pedestrians relating to the proposed use and
surrounding area shall be reviewed for potential
effects on, and to ensure safe movement in the
surrounding area.
It would appear that the general traffic circulation
patterns would improve in the area as a result
of locating a mortuary directly adjacent to a cemetery.
A reduction in funeral processions to the site
is probable. However, the existing traffic problem
of access and turning movements onto and off of
the site must be resolved. The Public Works Department
has recommended that additional right-of-way be
dedicated for the expansion of N.E. 4th Street
to include a left turn lane. Preliminary design
work has been completed on the proposed widening
and a minimum of seven (7) feet would be required.
The dedication should not be limited to the subject
property, but should include the entire cemetery
frontage along N.E. 4th Street. The subject site
is not a separate legal lot, but an integral portion
of the existing cemetery property.
The City of Renton and King County are presently
improving the traffic and pedestrian circulation
patterns along Monroe Avenue N.E. The City of
Renton and King County constructed, at their own
expense, to service the public facilities on the
south side of N.E. 2nd Street. Therefore, the
applicant will not be responsible for installing
the normal street improvements which include curbs,
gutters and sidewalks along Monroe Avenue N.E.
Those improvements will be required along N.E.
4th Street. As a result of the magnitude of the
widening of N.E. 4th Street, the Public Works Depart-
ment recommends that the construction be accomplished
by participation in an L. I.D. Presently the city
has commitments from approximately 40% of the property
owners along N.E. 4th Street to participate in
the L. I .D. Inclusion of this property would result
in the formation of the L. I .D. under state law.

Noise, Glare: Potential noise , light and glare
impacts shall be evaluated based on the location
of the proposed use on the lot and the location
of on-site parking areas, outdoor recreational
areas and refuse storage areas.
It is not anticipated that additional noise, light
and glare will result from the project. The proposal
is heavily screened from the adjacent streets.
Landscaping: Landscaping shall be provided in
all areas not occupied by buildings or paving.
The Heariang Examiner may require additional land-
scaping to buffer adjacent properties from potentially
adverse effects of the proposed use.
The site plan attempts to retain as much of the
natural vegetation as possible and to buffer the
structure from the adjacent streets. Supplemental
landscaping will be added to complete the attempt
to focusing the mortuary to the cemetery. The
use is not required to be a highly visible commercial
activity. In fact, it is better from the applicant ' s
marketing point of view if a serene and peaceful
environment is maintained.
Accessory Uses: Accessory uses to conditional
uses such as day schools, auditoriums used for
social and sport activities, health centers, convents,
preshool facilities, convalescent homes and other
of a similar nature shall be considered to be separate
uses and shall be subject to the provisions of
the use district in which they are located.
Not applicable in this case.
Conversion: No existing building or structure
shall be converted to a conditional use unless
such building or structure complies, or is brought
into compliance, with the provisions of this Chapter.
Not applicable in this case.
Public Improvements: The proposed use and location
shall be adequately served by and not impose an
undue burden on any public improvements, facilities,
utilities and services. Approval of a conditional
use permit may be conditioned upon the provision
and/or guarantee by the applicant of necessary
public improvements, facilities, utilities and/or
services.
The only major modifications to public facilities
would be the widening of N.E. 4th Street.
SUMMARY
8. The requested rezone and conditional use permit
appears to be in the general interest of the public
and compatible with adjacent existing and future
uses. The site design has attempted to be sensitive
with the existing natural vegetation and blend
itself with the adjacent cemetery. Only one condition
appears to be necessary in the public interest
and that deals with accessibility by increasing
the right-of-way for N.E. 4th Street along with
the construction of a left turn lane.

M. DEPARTMENTAL RECOMMENDATION:
Based upon the above analysis, it is recommended that
the Hearing Examiner approvel the rezone request, R-068-82,
and conditional use permit , CU-069-82, subject to the
following conditions:
1 . Dedication of seven (7) feet of right-of-way along
the northern property line of the subject site
and cemetery.
2. Participation in an L. I.D. to widen N.E. 4th Street
from four (4) lanes to five (5) lanes.
3. Approval of detailed landscape plans by the city' s
landscape architect to focus on preservation of
the large trees within the proposed parking areas.

BUILDING & ;'_ONING The Building & Zoning Department preliminary report was received by
DEPARTMEN- REPORT: the Examiner on November 23, 1982.
PUBLIC HEARING: After reviewing the Building & Zoning Department report, examining
available information on file with the application, and field checking the
property and surrounding area, the Examiner conducted a public hearing
on the subject as follows:
The hearing was opened on November 30, 1982, at 9:00 a.m. in the Council Chambers of the Renton
Municipal Building, by the Examiner, who indicated both matters will be considered together and both will be
forwarded to the City Council for review. Parties wishing to testify were affirmed by the Examiner.
Roger Blaylock, Zoning Administrator, presented the Building & Zoning Department report and entered the
following exhibits into the record for both applications:

Mr. Blaylock advised that a conditional use permit is being sought by the applicant in accordance with a
request from the Building & Zoning Department, which determined that a mortuary is a commercial activity.
A final declaration of non-significance was issued by the Environmental Review Committee subject to
dedication tc the City of 12 feet of property along N.E. 4th Street and 12 feet of property along Monroe
Avenue N.E. for the length of the subject site for future improvement at that intersection and preservation of
dominant treus by incorporation of them into the site plan. Responding to the Examiner's inquiry concerning
the limitation of the dedication requested, Mr. Blaylock stated that, while the dedication indicated applies to
frontage alor g N.E. 4th Street and Monroe Avenue N.E., an argument will be presented later that that should
be widened.
The examine. questioned if the mortuary is considered compatible with the apartment complex immediately to
the north and was advised that It is their contention that it is due to the scale of the proposed structure in
relation to the apartment complex and, in addition, a proposed 54-foot setback from N.E. 4th Street and 32
feet from Monroe Avenue N.E. In response to the question of compatibility of use, Mr. Blaylock noted that
the style of tie building lends Itself to residential character and access, away from the residential intertie, will
be off Monroe: Avenue N.E., which serves the public facilities to the south.
It was concli ded that the proposed rezone is timely, if one area of concern is addressed: traffic and access
problems on N.E. 4th Street.

Criteria for a conditional use permit were reviewed by Mr. Blaylock. There was discussion with respect to
possible traffic impacts due to funeral processions, in particular those generated from other cemeteries. In
response to the Examiner's request for comment was:

Mr. Hoims indicated the mortuary will principally serve the Greenwood Cemetery and that, while there will
always be a problem with other mortuaries having processions coming to them, this situation is expected to
become minimal. Also, he advised that presently he does have commitments to other property owners.
Responding to the Examiner, he indicated there is a small possibility that other people will choose this
mortuary but have property in other cemeteries.
Mr. Blaylock continued his review, noting compliance in their view with conditional use criteria relating to
compatibility. He advised that the proposed site plan basically complies with parking criteria; however,
further review will be necessary upon application for a building permit, when the internal design of the
proposed structure is complete. At this time the applicant has provided 50 parking spaces on the subject
site, which would suggest approximately, 5,000 square feet of assembly rooms. The proposed building is
approximately 9,000 square feet, which may revise the parking requirement due to the need to accommodate
the various functions of this activity.
Traffic issues were reviewed as presented in the report, including the Public Works Department
recommendation that a minimum of 7 feet of additional right-of-way along the entire cemetery frontage be
dedicated for the expansion of N.E. 4th Street to include a left turn lane and participation in an L.I.D. for
installation of normal street improvements. Participation in the improvement of Monroe Avenue N.E. will not
be necessary, however, as this is being accomplished by the City and King County. Mr. Blaylock pointed
out that prohibitive costs preclude widening to the north of N.E. 4th and that a major portion of the
right-of-way has already been acquired.
Department conditions for approval were reviewed by Mr. Blaylock. Responding to the Examiner's inquiry
concerning any requirement for dedication along the Monroe Avenue frontage, he indicated the
Environmental Review Committee already provided for sufficient width. It was explained that the
right-of-way south of that is sufficient to carry any anticipated future loads.
Due to the fact that the City's Traffic Engineer had to leave to attend another function, he testified prior to
the completion of the applicant's presentation. In response to the Examiner's request for comment
concerning any public parking allowed along Monroe in this vicinity was:

Mr. Norris stated that basically there are no problems with the traffic generated from this proposal but that it
is necessary to insure that 12 feet of right-of-way are obtained along Monroe Avenue N.E., that additional
right-of-way is obtained along N.E. 4th Street, and that the applicant will participate in the L.I.D.
Responding to a request for clarification from Mr. Blaylock, who askd if 12 feet of right-of-way were
necessary along the entire cemetery property for the expansion of N.E. 4th, the Traffic Engineer indicated
that 7 feet of right-of-way, with slope easement, is sufficient. In response to the Examiner's inquiry
concerning potential parking problems along the rights-of-way, Mr. Norris advised that mortuary patrons
would not be allowed to park along Monroe or 4th.
The Examiner invited questions of the Traffic Engineer. Responding was:

Mr. Zanoni, designer on the project, indicating recognition of the problems, requested further clarification
with regard to anticipated costs associated with participation in the L.I.D. He noted that conditions for
approval of the rezone would involve dedication of right-of-way valued at somewhat over $100,000.
Additionally, consideration of a conditional use permit would involve participation in an L.I.D. along with
approximately $12,000 of off-site improvements, or a total of about $ 113,000. Their concern regarding
further costs to participate in the L.I.D. was noted. It was acknowledged that relocating access from 4th to
Monroe would provide a good situation for 4th and is a possibility. Another problem was noted relative to the
7 feet plus slope easement along 4th, in view of some people having been buried in that area and the need
to protect agreements made with their families concerning these sites. Mr. Zanoni stated that other than the
above, they do not have any major objections.

Mr. Norris advised that there is no detailed information relating to cost estimates for the L.I.D. at this time, in
response to the Examiner's inquiry. With respect to additional information regarding slope easements, the
Traffic Engineer indicated that 5 feet to 10 feet were necessary along 4th in addition to the 7 feet. However,
concerning Monroe, there will be no slope easements, and presently there is no need for the applicant to
participate in any improvements along that street. It was further added that, because of the recent
development down Monroe to N.E. 2nd, it is the Public Works Department's opinion that in the future it will be
imperative to have the right-of-way to expand Monroe to five lanes at that intersection. However, the
applicant is not being requested to participate.
There was further discussion between the Examiner and the Traffic Engineer concerning possible formations
of L.I.D.'s for these improvements. Mr. Norris indicated doubt that an L.I.D. would be required for the
widening on Monroe but that it is possible one may be necessary for the entire complex on 4th and Monroe.
Regarding the possibility of credit received for dedicated land toward an L.I.D. obligation, Mr. Norris advised
it may be stated by the applicant that he would not object to donating that property in exchange, and his
L.I.D. obligation would be prorated in accordance with the cost of the property.
In response, Mr. Zanoni noted no objections to the requirement for dedication of 12 feet of right-of-way
along N.E. 4th Street and 12 feet along Monroe Avenue N.E. However, there are concerns regarding the
additional 7 feet of right-of-way along the entire cemetery frontage and participation in an L.I.D.
The Examiner invited further comments or questions of Mr. Norris.
Discussion between Mr. Blaylock and the Traffic Engineer ensued. Noting his belief that, at the time he
requests building permit approval, the applicant will be obligated to provide off-site improvements for at least
200 feet on N.E. 4th and also whatever would be necessary for the 400 feet on Monroe, Mr. Blaylock
requested ch-.rification regarding Traffic Engineering's requirements. In response, Mr. Norris Indicated that the
applicant prc bably will not be required to provide improvements at this time due to the presence of major
power and signal control equipment on the corner of 4th and Monroe. It was agreed that there would still be
responsibility for installation of the sidewalk. It was also noted that, should the applicant participate in an
L.I.D., the B)ard of Public Works would consider deferring the necessary off-site improvements along N.E.
4th until such time as the L.I.D. is formed.
The Traffic Engineer was then excused, and the applicant requested to address the concerns as far as the
report is concerned.
Mr. Zanoni discussed provisions for preservation of trees, noting removal of approximately 12 trees on the
entire site other than those in the parking area. The basis for meeting parking requirements was also noted:
one space for each four people in attendance in a fixed seated area - 44, plus some additional spaces. The
design of the circular driveway will be revised to add several parking stalls, which could be handled during
the building permit application process. Another amendment would be to show additional parking for
cemetery oflicers and sales representatives, also at the time of building permit review. He requested that the
City be advised that they are able to change their entrance to the site to Monroe to alleviate any future
problems.
Responding to the Examiner, Mr. Zanoni indicated that there is no improved entrance to the cemetery at
present, just an old gravelled road. However, he noted current installation of curb and gutters and
improvement of the roadway by public jurisdictions and indicated they would like to be included for those two
entrances. He was referred to the Public Works Department, preferably as soon as possible.
The Examiner noted his concerns, asking if it is possible for two funerals to occur at one time, or at least
consecutively, creating a difficult parking situation. In response, Mr. Zanoni noted the general practice to
separate fur erals by at least two hours. The Examiner inquired further regarding the possibility of people
leaving their cars in the mortuary and walking to the cemetery and was advised by Mr. Zanoni that generally
there is a processional with arrangements made for traffic control. Also noted was frequent inclement
weather, which precludes any long walks.
Mr. Holmes ndicated that, should there be another funeral scheduled, a procession will be planned from the
parking area into the cemetery. He responded to the Examiner that a crematory is present on the property.
Noting no higher people in the audience to testify, the Examiner declared the public hearing closed at 9:48
a.m.
FINDINGS. CONCLUSIONS & RECOMMENDATION: Having reviewed the record in this matter, the Examiner
now makes and enters the following:
FINDINGS:
1. The applicant, Daniel E. Holms, Inc., filed a request for a reclassification of approximately 1.84 acres
of property from G-1 (General, single family residential; minimum lot size - 35,000 square feet) to P-1
Pub is/Quasi-public) together with a permit to establish as a conditional use a mortuary.

2. The application file contained the application, SEPA documentation; the Building & Zoning
Department report, and other pertinent documents, were entered into the record as Exhibit #1.
3. ursuant to the City of Renton's Environmental Ordinance and the State Environmental Policy Act of
71, RCW 43.21C, as amended, a declaration of non-significance has been issued for the subject
oposal by the Environmental Review Committee (ERC), Responsible Official.
4. lans for the proposal have been reviewed by all City departments affected by the impact of this
development.
5. a subject property is located on the southeast corner of Monroe Avenue N.E. and N.E. 4th Street
1 mediately northwest of the Greenwood Memorial Cemetery.
6. The subject site is generally level. The site is covered with scrub brush, low shrubs and some Douglas
fir trees.
7. The subject property was annexed into the City by Ordinance #2249 in June of 1966. The current
G-1 zoning was applied at that time.
8. The subject site is an undeveloped portion of the Greenwood Memorial Cemetery located at the
intersection of N.E. 4th Street and Monroe Avenue N.E. which are both arterial streets serving the
general vicinity. N.E. 4th Street is a major arterial serving the Highia rds area of the City and is a
major east-west route connecting the residential areas of the City with the downtown and the major
nsportation corridors.
9. he cemetery is to the south and east of the subject site. Light commercial uses are located west of
e site. The Renton Vocational-Technical School is located northwest of the site. A gasoline service
station is located north of the site together with a multi-family apartment complex.
10. The above land uses reflect a mix of commercial, light industrial and residential uses in the vicinity of
the subject site reflecting the various zoning districts in to a area.
The cemetary i:; classified G-1 and continues to be a pre-existing legal non-conforming use.
West of the site a number of commercial and light industrial uses are located in an L-1 (Light Industry)
zone. North of the site is a B-1 (Business/Commercial) zone containing, among other uses, the
gasoline station and the multi-family apartment complex.
11. The Comprehensive Plan designates the area in which the subject site is locz.tert as suitable for the
development of public and quasi-public uses.
12. The applicant proposes establishing a mortuary on the subject site pursuant to Sections 4-748(D)(2)(a)
and 4-711(A)(19) which permit B-1 uses, i.e. undertaking establishments, in P-1 zones. A
conditional use is permitted pursuant to specified criteria including parking, traffic, appropriate
landscaping and noise, light and glare.
13. The proposed mortuary will be a Victorian styled building of approximately 9,000 square feet. Parking
for 50 vehicles will be provided on site. The building will be accessed via a driveway on Monroe
Avenue N.E. The structure will be two stories in height. Approximately 12% of the two hundred by
four hundred foot lot will be covered by the building.
14. The building will be setback approximately 54 feet from N.E. 4th Street and approximately 32 feet
from Monroe Avenue N.E. These respective setbacks will be landscaped. The applicant proposes
preserving the large Douglas fir trees on the site and supplement the natural vegetation with additional
plantings.
15. The City staff has recommended that the applicant provide property to permit the widening of both
N.E. 4th Street and Monroe Avenue N.E. The City and King County have jointly entered into a project
to improve Monroe Avenue N.E. and N.E. 2rd Street to provide access to county and city facilities
south of the cemetery.
he ERC has required the dedication of 12 feet of property along both rights-of-way fronting along
he proposed mortuary site. The staff has recommended an additional 7 feet along the remainder of
the cemetery frontage along with a slope easement. The applicant was unable to determine what
effect a slope easement might have upon graves located in the proposed slope easement and what
legal obstacles might result.
16. he mortuary is being developed as a complementary function to the cemetery end will be operated

CONCLUSIONS:
REZONE
1. The proponent of a rezone must demonstrate that the request is in the public interest and will not
impair the public health, safety and welfare in addition to compliance with at least one of the three
criteria listed in Section 4-3010 which provides in part that:
a. The subject site has not been considered in a previous area-wide rezone or land use analysis;
or
b. The subject site is potentially designated for the new classification per the Comprehensive
Plan; or
c. There has been material and substantial change in the circumstances in the area in which the
subject site is located since the last rezoning of the property or area.
The applicant has demonstrated that the request to reclassify the subject property is justified.
2. The request to reclassify the subject property to P-1 is consistent with the Comprehensive Plan which
designates the area for public and quasi-public uses. The designation is also consistent with and
compatible with the Immediately adjacent cemetery usage. The cemetery is generally considered a
quasi-public use.
3.The a rea in which the subject site is located supports a variety of uses including the cemetery, the
multi-family apartment complex, the gasoline service station, commercial and light industrial uses to
the west, and the Renton Vocational-Technical School to the northwest.
The proposed P-1 zoning would be compatible with these uses and the mix of zoning districts in the
vicinity. The reclassification would also be compatible with the public uses in the P-1 district
established to the south along N.E. 2nd Street, that is, the City and County facilities.
4. The current G-1 zoning, which permits large lot single family uses, is no longer appropriate for this
corner at the intersection of two major arterials, nor would this site support the quiet amenities
generally associated with single family dwellings.
5. Significant new development including the City and County projects south of the site, as well as the
apartment complex, have changed the area since the original zoning was applied. Under the
circumstances, the City Council should approve the reclassification of the subject site to P-1.
CONDITIONAL USE PERMIT
6. The proposed use of the subject site for a mortuary appears appropriate. The site is located at the
intersection of two main arterials, contains significant trees which, if retained as proposed, can serve
as an intensive buffer, and is immediately adjacent to a large cemetery. In addition, as indicated
below, the site appears to meet the criteria necessary (Section 4-748) in order for a conditional use
permit to be approved.
7. The record does not disclose an abundance of mortuaries in the Highlands area of the City. The site,
located adjacent to the Greenwood Memorial Cemetery and operated in conjunction with the
cemetery, would satisfy the community needs for such a facility.
While the use is private, the nature of the use is not unlike other specialized services needed by the
residents of a community such as doctors' offices. The use, therefore, is more in the nature of a
public or quasi-public use and is compatible with the Comprehensive Plan for the area.
8. The well-screened facility should not have an adverse affect on neighboring properties. The structure
will cover approximately 12% of the site while the code permits up to 50% lot coverage. The site will
observe substantially greater setbacks from the property lines than is required in the P-1 zone, and
the two-story building will not overpower the tree buffer or buildings in the area. The proposal will
not c Jt off light or air to any inhabited areas.
9. The multi-family apartment complex will not be affected by the mortuary separated as it is by N.E. 4th
Stree . There are no other closely located residential uses which would be affected by the
development of the mortuary.
10. The a pplicant will provide 50 parking spaces in accordance with the requirements of the Parking and
Loading Ordinance. Additional parking would be available on the cemetery grounds it that were
requii ed.

11. he traffic generated by the proposal will not be concentrated during the peak hours and the
i mediately adjacent arterials should be quite adequate to handle the traffic generated by the
roposal. This will especially be the case after the completion of proposed improvements for both
adways. The close associaticn of the mortuary and the cemetery may also eliminate some funeral
rocessions that would otherwise occur thereby reducing potential congestion somewhat.
12. The natural landscaping and the additional landscaping proposed by the applicant should minimize any
spill of light, glare and noise from the site. The City's landscape architect should approve the
complete proposal to assure the landscaping will fulfill its intended function of both enhancing the site
for the applicant and screening the site from adjacent uses.
13. The water and sewer services in the area appear to be capable of handling the proposal. The
widening and improvement of the roadways in the area should provide sufficient capacity to handle
the traffic generated by the subject proposal although the applicant will have to participate in said
nprovement project for N.E. 4th Street. The applicant will have to execute restrictive convenants to
Participate in an L.I.D. and provide up to 7 feet of frontage along N.E. 4th Street without requiring the
City to proceed by condemnation.
14. The proposed mortuary, a Victorian type building set amidst heavy landscaping and screened from the
public rights-of-way, therefore, is an appropriate use for the subject site and a conditional use permit
should be approved.
RECOMMENDATION AND DECISION:
The City Council should approve the reclassification of the subject site from G-1 to P-1.
The conditional use permit is approved subject to the following conditions;
1. Approval of the reclassification of the subject site by the City Council.
2. xecution of restrictive covenants requiring participation in an L.I.D. for the widening of N,E. 4th
treet and the conveyance to the City of up to 7 feet of property for said widening without requiring
formal condemnation of the property.
3.Approval of the City's landscape architect of all landscaping and tree preservation efforts.
4. Conveyance of a slope easement along N.E. 4th, but subject to restraints caused by existing grave
sites.

Reasons for declaration of environmental non-significance :
Will not adversely impact the environment or adjacent properties
and that the following requirements shall be complied with :
1 ) Twelve feet of property along N .E . 4th Street and twelve
feet of property along Monroe Avenue N .E . for the length
of the subject site being rezoned must be dedicated
to the City of Renton for future
roadway widening .

COMMENTS:
Introduction The State Environmental Policy Act of 1971, Chapter 43.21C, RCW, requires
all state and local governmental agencies to consider environmental values both for their
own actions and when licensing private proposals . The Act also requires that an EIS be
prepared for all major actions significantly affecting the quality of the environment.
The purpose of this checklist is to help the agencies involved determine whether or not a
proposal is such a major action.
Please answer the following questions as completely as you can with the information
presently available to you. Where explanations of your answers are required, or where
you believe an explanation would be helpful to government decision makers , include your
explanation in the space provided, or use additional pages if necessary. You should
include references to any reports or studies of which you are aware and which are rele-

into the cemetery. You must proceed to Monroe St then make a left
turn onto Monroe and then make a "U" turn and make a right turn onto
4th, then a right turn into the cemetery.
With the construction of the Mortuary/Cemetery office a new cemetery entrance
will be made on Monroe Street.
9. Monroe Street is currently being developed by the City and would improve
traffic conditions.
10. Much commercial development and Multi-family is existing presently in the
area.
To the west of subject property "Alexanders Auction House"
To the north, a 3 story apartment complex " Monroe Place "
with medium density lot coverage.
Also to the north is Pacific Northwest Bell's repair and storage facility
To the east and south "Greenwood Memorial Park"
Many properties to the north and west are commercially zoned. Along with Renton
Vocational School which is north westerly from this site.
There are currently (2) two funeral homes in Renton. There are estimated 700
funeral services per year, and that figure will surely increase with the
population growth. A new and efficient facility combined with convenient
accessiblity would be an asset to the coriununity.
There are numerous new developments including, housing for the elderly, nursing
homes, senior citizen's center ( 1 block west) ; proposal for more elderly
housing.

We propose the rezone of property located at Monroe Street and 4th Street
Currently known as the northwesterly corner of the Greenwood Memorial
Park Cemetery.
The proponent nor the previous owner intended nor pursued the possibilities
of building a mortuary and cemetery office and caretakers quarters on the
subject property. Much change has come in the field and the proponent now
desires to combine the services necessary during this tender time of our lives.
The fact is that a mortuary on the cemetery grounds is becoming more and more
a part of this business. The proponents corner may have been considered as
commercial, but without a request of the directors of the Greenwood Memorial
Park. The upzoning may not have been to the best interest of the planners.
Change of ownership and the granting of the segrigation of this piece of
property to Daniel E. Holms, Inc. has also changed the property.
Former ownership; Tachell's Greenwood Cemetery, Inc. to Greenwood Memorial
Park, Inc.
Last comprehensive zoning date is December 1981 "Northeast Quadrant"
1. The city of Renton's population has grown and especially the NorthEast
area. With more population, results more deaths and greater need for
adequate funeral services.
2 A cemetery/mortuary combination will better serve the families of the
client.
3 Eliminates traffic conjection, due to funeral processions, and private
escort services. Resulting in less cost to the client.
4 . Many families that hold property at the cemetery requested that the new
owner provide complete service of funeral arrangements including, burial
mosilium, cripts and etc.
5 To better serve the families at their tine of grief, again the service
would be simplier and less costly, eliminating the extra tine of shuffeling
of family members.
6 Renton East has expanded considerably. In fact the fastest growing area
in Renton.

2. On July 31, 1981, Daniel E. Holms, Inc. purchased all of the issued
and outstanding shares of Greenwood Memorial Park, Inc. , a Washington corpo-
ration. Of those shares, one-half were purchased from A. W. Delzer and
one-half were purchased from estate of John Kosney. Upon the closing of the
sale, Greenwood Memorial Park, Inc. became a wholly-owned subsidiary of
Daniel E. Holms, Inc.
3. In August 1981, articles of dissolution were filed for Greenwood
Memorial Park, Inc. , the corporation was dissolved and all of the assets of
Greenwood Memorial Park, Inc. were distributed to Daniel E. Holms, Inc. in
complete liquidation of Greenwood Memorial Park, Inc.
4. Of the assets previously owned by Greenwood Memorial Park, Inc. ,
which were distributed upon the liquidation of that corporation to Daniel E.
Holms, Inc. , included was the real estate currently occupied by the Greenwood
Memorial Park Cemetary. A legal description of this real estate is attached
hereto as Exhibit A.
5. Daniel E. Holms, Inc. is the owner, free and clear of all of the real
estate described in Exhibit A hereto, subject to the burial rights granted both
by Greenwood Memorial Park, Inc. and its successor, Daniel E. Holms, Inc. ,

I enclose a photocopy of the preliminary title report and
supplemental reports, which we received last week. We spoke
with First American Title Company and, as far as we and they
can tell, the rezone certificate would entail nothing more than
what you get on a preliminary title report. As you will note,
the preliminary title report shows that title is vested in
Tachell ' s Greenwood Cemetary, Inc. , a corporation, which is
the same as Greenwood Memorial Park, Inc. You may also wish
to review the rest of this preliminary commitment for title
insurance. By way of explanation, if we were to insure title
at this time, item 14 in the list of exceptions could be
corrected by merely showing the articles of amendment, which
changed the corporate name. Further, copies of the various
documents which the title company requests would be easily
supplied. As you will note, the title company has a misspelling
of your last name, and thus when they did the initial search
of the corporation records, they found no filing of articles
for your corporation. Items 16 and 17 are corrected on the
attached supplemental to the preliminary title report.
I hope this will suffice for the City of Renton zoning.
Certainly, what they are interested in is to see the proper
chain of title; this preliminary title report does supply the

We are lawyers representing Daniel E. Holms, Inc. , d/b/a Greenwood
Memorial Park. Daniel E. Holms, Inc. purchased 100% of the outstandingstockofGreenwoodMemorialPark, Inc. in July 1981, and proceeded to dissolve the
corporation, at which time all assets were distributed to the parentcorporationinatransactiondesignedtocomplywithSection334(b)(2) of the Internal
Revenue Code. All of the stock of Daniel E. Holms, Inc. is owned by Daniel E.
Holms. The end result of this series of transactions is that as of the dissolu-
tion of the corporation, Daniel E. Holms, Inc. became the owner free and
clear, subject to burial rights, of all the property of the cemetary that was
previously owned by Greenwood Memorial Park, Inc. Greenwood has been
formally dissolved with articles of dissolution being properly on file with the
Secretary of the State of Washington.
