Dear Mr. Ka'fman,
The following comments are from my Earlington file
notes about the attitudes of the property owners in
Block 29 of CD Hillmans Earlington Gardens about selling
their properties . The implications are for commercial
uses .
Lots 17 and 18 , Hill . Hill signed a rezone application
to be rezoned in conjunction with the Beckmann rezone
application. I encouraged this accompanying application
to make my future sales non contingent upon rezone to get
my commissionis quicker. Beckmann did not want to make
his application any more complicated and did not include
the Hill application with his . VACANT Lot
Lots 22 , 23, 24, 25 and 26. Washburn. Mr Washburn did
not want to be included in the Beckmann application. He
will not name a nrice as of my last inquiry and did not
encourage my solicitation questioning would he look at an
offer at this time. He lives in Earlington Flats east of
Lind Avenue and has purchased this property for investment .
He also made an offer on the subject property prior to the
contract entered by Beckmann. VACANT LAND.
Lots 27 ,28 and 6 and 7 . Spinaker Investment . Currently
on the market under open listing agreements . I thought I
had made a sale two weeks ago on this property for another
builder similar to Pre Cut International. Still might be
a deal here but is tentative. TWO RENTAL HOUSES.
Lots 29 ,30,31 ,32 . Precut International .
Lots 16, 15 , 14, 13. The Chief, Mr. Griffin. An elderly
gentleman who gets around quite good. In his 90' s . Not a
seller yet , but soon. Doesn ' t want to sell until he needs
to go to a rest home. Understands the commercial flavor of
the area and has no complaints . OWNER OCCUPANT.
Lots 11, 12 . Mrs . Gaoiran. Pronounced GaWEEran . Was on the
market December of 1981. Asking $75 ,000 or $12 . 50 a square foot .
Took property off market because she was asking too much money at
the time. Still asking too much money. Will sell at that price
anytime.OWNER OCCUPANT
Lots 10, 9, 8 . Jensen. Not sellers at this time. Are holding
for investment purposes . Can not pay capital gains taxes on this
sale at this time and reinvest on a property that would offer better
investment potential. RENTAL HOUSE
Lots 5 -4,3, 2 . McKee. Recent widow. Is considering selling.
OWNER OCCUPANT.
Lot 1 , Stotts Would sell for $20.00 a squarefoot. Has one

WHEREAS under Chapter 7 , Title IV (Building Regulations)
of Ordinance No. 1628 known as the "Code of General Ordinances of
the City of Renton" , as amended, and the maps and reports adopted

WHEREAS a proper petition for change of zone classification

Councilman Stredicke requested his "no" vote and the
following comments be recorded: He objected to expenditure
of $55, 000 in taxpayers money to solve a drainage problem
which should have been the responsibility of the developers/
owners of Heather Downs subdivision, and feared the same
problem will be created as a result of Northward development.
Councilman Mathews indicated at the time of its development,
the Heather Downs plat was still in King County.
Voucher Approval Ways and Means Committee Chairman Clymer presented

private property after recent election.
Utilities Committee Utilities Committee Chairman Mathews presented a report

Storm Drainage Department to purchase Lot 1, Block 1, Heather Downs II
Problem from Leonard Construction for the agreed amount of $17, 200
plus remaining sewer assessment against the property. The

BUILDING & ZONING The Building & Zoning Department Report was
DEPARTMENT REPORT: received by the Examiner on October 11, 1983.
PUBLIC HEARING: After reviewing the Building and Zoning Department
Report, examining available information on file with the
application and field checking the property and surrounding
area, the Examiner conducted a public hearing on the
subject as follows:
The heari:ig was opened on October 18, 1983, at 9:30 a.m.in the Council Chambers of the
Renton Municipal Building. Parties wishing to testify were affirmed by the Examiner.
The follov%ing were entered into the record as exhibits:
Exhibit #1: Yellow file containing the application, staff
report, and other pertinent documents
relating to posting and publication.
Exhibit #2: Assessor's Map showing the subject site in
yellow.
Exhibit #3: Schematic development plan showing how the
typical standards in the R-1 zone have been
applied.
Roger Bit.ylock, Zoning Administrator, presented the staff report. He stated the basic site
could ace 3mmodate a 5,000 sq. ft. building; that when the new B-1 Zone becomes effective,
this site could not be developed solely with residential uses. He further indicated that the
right-of-way on S.W. 13th between Seneca Avenue S.W. and Raymond Avenue S.W. is
substandard and needs to be improved so that the pavement is at least 20 feet in width to allow
for emergency vehicle access to the subject site.
Mr. Blaylock further reported the subject site is bounded on the east by an R-4 zone, on the
south by 1-405, on the north and west by an R-1 zone. Also, there has been a request from two
surrounding property owners for rezoning of their property since this application was received
and that-the general area is in a transition state at the current time. The Policy Development
Department has recommended site approval by the Hearing Examiner before issuance of a
building lermit because the plan submitted by the applicant does not sufficiently address the
issues of buffering and aesthetics that may be necessary in this transition area.

Mr. Blayloi;k stated the staff would recommend the rezone request be recommended to the City
Council for approval, subject to the following conditions:
1. That restrictive covenants be executed, requiring:
a.Site plan approval, including landscaping approval;
b.Building setback requirements of twenty (20) feet from S.W. 13th Street.
The Examiner called on the applicant or representative. Responding was:

Mrs. Beckmann stated the adjacent property owners have also contemplated rezoning to L-1 or
business u:,es; because of the size of the small lot, there are limitations on what can be built;
consequeni.ly, they would request no side yard setback requirements for this site. Mrs.
Beckmann further stated she does not feel they need to widen the whole setback.
The Examiner stated that this was a condition of the ERC and was not subject to modification
at this hearing.
The Examiner then called for further testimony. Responding was:

Ms. Ryan indicated she was the real estate agent for this development; that all of the adjacent
property owners, with the exception of one man in a mobile home in the block north of this
property are contemplating selling their homes also; that they are all aware this is a transition
area and the single family flavor of their area has been deteriorating over the past twenty
years. Ms. Ryan stated she would provide the Examiner with a document of typed comments
from 38 people she had talked with in the area who supported this transition to L-1.
The Exam ner entered the document into the record as follows:
Exhibit #4: Written comments from residents in the
vicinity of the proposed rezone.
The Examiner called for further testimony in support of the application. There was none.
The Examiner then called for testimony in opposition to the application. There was none.
The Examiner closed the hearing at 10:00 a.m. and indicated he would have his recommendation
prepared within 14 days and that the City Council would take action at a future Council
Meeting fallowing that time period.
FINDINGf, CONCLUSIONS & DECISION: Having reviewed the record in this matter, the
Examiner now makes and enters the following:
FINDING;:
1. The applicant, Beckmann Homes, Inc., filed a request for approval of reclassification of
appzoximately 8,640 sq. ft. of property from R-1 (Single Family Residential) to L-1 (Light
Industry).
2. The application file containing the application, the State Environmental Policy Act
SEPA) documentation, the Building and Zoning Department Report, and other pertinent
documents, was entered into the record as Exhibit H.
3. Pur:.uant to the City of Renton's Environmental Ordinance and SEPA, a Declaration of
Non-Significance has been issued for the subject proposal by the Environmental Review
Committee (ERC), responsible official.

4. Plan: for the proposal have been reviewed by all city departments affected by the impact
of this development.
5. The :ubject proposal met with no opposition from the public.
6. The :ubject site is located at 708/712 S.W. 13th Street, immediately north of I-405.
7. The :ubject site which contains an existing vacant single-family home and mobile home is
level
8. Thee pplicant proposes to develop an office/warehouse on the subject site.
9. The Comprehensive Plan designates the area in which the subject site is located as
suitable for the development of Manufacturing Park uses which includes office,
warehousing and light industrial uses.
10. The •;ubject site was annexed into the city by Ordinance 1928 in December of 1961, at
which time it was zoned G-1. A redefinition in 1982 designated the subject site R-1.
11. Similar requests to reclassify 5,000 to 10,000 sq. ft. lots to L-1 and B-1 (Business
Commercial) in the general area north and south of I-405 and between Powell Avenue and
SR-167 have been approved, although the Comprehensive Plan indicates the area is
suitable for manufacturing park zoning. (See Ordinances 3270, 3308, 3482; and Files
R-013-82 and R-062-82.)
Building setbacks and landscaping of these setbacks was governed by the standards of the
M-P (Manufacturing Park) zone, although the standards were reduced to accommodate the
considerably smaller lots. These conditions were imposed to provide some level of fidelity
to the Green River Valley Comprehensive Plan and the overall Comprehensive Plan of the
city.
12. The eLrea contains a wide variety of uses including older single-family homes, commercial
uses, and light industrial and warehousing uses. A single-family home is located north of
the s.te.
13. Zoning to the north and west of the subject site is R-1 and some older single-family
homes are still located in this area. East of the site is an R-4 (High Density Multi-family
Resic'.ential) zone. I-405, which is not zoned, is located south of the subject site.
14. The .area is in general transition from older single-family homes to light industrial and
office uses.
CONCLUS IONS:
1. The proponent of a rezone must demonstrate that the request is in the public interest, will
not impair the public health, safety, and welfare, and in addition, is in compliance with at
least one of the three criteria found in Section 4-3010, which provides in part that:
a. The subject site has not been considered in a previous area-wide rezone or land use
analysis; or
b. The subject site is potentially designated for the new classification per the
Comprehensive Plan; or
c. There has been a material and substantial change in the circumstances in the area in
which the subject site is located since the last rezoning of the property or area.
The applicant has demonstrated that the request to reclassify the subject site is justified as
conditioned below.
2. While the area is in transition from single-family to light industrial and commercial uses,
some single-family homes continue to exist in the area. Further, the goals and policies of
the Comprehensive Plans, both the general and the Green River Valley, indicate well
designed and landscaped manufacturing park type uses should be located in this area.

In crder to abide by the goals of the Comprehensive Plans, the applicant should be
required to abide by setbacks similar to those required of other properties which have
beer, reclassified in the area. These setbacks make the areas appear more spacious and
the landscaping meets the objectives of well designed and landscaped properties specified
in tie Comprehensive Plan.
3. The:a setbacks require the building to be located 20 feet from the street right-of-way
and sideyards of approximately 6 to 10 feet, depending on the circumstances. Zero side
yards would fail to give the open and spacious appearance of manufacturing parks and the
applicant must be required to provide the same.
4. This site is similar to the properties referenced in Finding 11 above. The site is
approximately 8,500 sq. ft., which is larger than most of the sites identified in Finding 11
which vary from 5,000 sq. ft. to just over 6,000 sq. ft. in the main.
Therefore, rather than impose dissimilar conditions on the applicant, similar 20 yard front
yard setbacks and 6 foot side yards should be required.
5. Similarly, in order to assure compliance with the goals and policies of the Comprehensive
Plan, site plan approval should be required.
6. While the site is limited in area, the applicant must take such limitations into account
whits still complying the goals and policies of the Comprehensive Plan. As has been
indic ated, other similar properties have been reclassified and the same conditions imposed
by the City Council.
REC OMMaNDATION:
The City Council should approve the reclassification of the subject site from R-1 to L-1,
subject to the following conditions:
1. The execution of restrictive covenants requiring landscaped setback of 20 feet in the
fron. yard and 6 feet in each of the side yards.
2. Site plan approval.

The Appearance of Fairness Doctrine provides that no ex parte (private one-on-one)
communications may occur concerning land use decisions. This means that parties to a land use
decision may not communicate in private with any decision--maker concerning the proposal.
Decision-makers in the land use process include both the Hearing Examiner and members of the
City Council.
All communications concerning the the proposal must be made in public. This permits all
interested parties to know the contents of the communication and would allow them to openly
rebut the evidence. Any violation of this doctrine would result in the invalidation of the
request by the Court.
The Doctrine applies not only to the initial public hearing but to all Requests for
Reconsider ation as well as Appeals to the City Council.
Pursuant to Title IV, Section 3015 of the City's Code, request for reconsideration must be filed
in writing on or before November 10, 1983. Any aggrieved person feeling that the decision of
the Examiner is based on erroneous procedure, errors of law or fact, error in judgment, or the

natural layers with additions of fill material several feet thick to
accommodate large industrial and housing installations. The erosion hazard is
slight to moderate. No capability or woodland classification.

5. Water: No surface water was observed on the site.
6. Land Use: The subject site is currently occupied by an uninhabitable house on

E. NEIGHBORHOOD CHARACTERISTICS:
The subject site is surrounded by developing commercial/industrial uses to the
north, commercial uses to the east, vacant land to the south, and industrial uses to
the west.
F. PUBLIC SERVICES:
1. Utilities:
a. Water - A twelve-inch water line runs near the subject site along
Raymond Avenue S.W. and a six--inch water line runs along S.W. 13th
Street adjacent to the subject site. The Engineering Division of the
Public Works Department has determined that the water system along
S.W. 13th is sub-standard.
b. Sewer - An eight-inch sanitary sewer line extends along the alley
adjacent to the subject property.
c. Storm Water Drainage - The Engineering Division of the Public Works
Department has determined that the existing storm water from the site
will be contained.

approximately 60 average daily trips (ADT). The project will result in a
moderate impact on the traffic problems along S.W. Grady Way.
J. ENVIRONMENTAL ASSESSMENT/THRESHOLD DETERMINATION:
Pursuant to the City of Renton's Environmental Ordinance and the State
Environmental Policy Act of 1971, as amended, RCW 43-21C, a final declaration of
non-significance was issued by the Environmental Review Committee on
September 21. 1983. The appeal period expired October 10, 1983.

L. DEPARTMENT ANALYSIS;
1. The applicant, Beckmann Homes, is requesting a rezone of .2 acres located at
708 and 712 S.W. 13th Street from R-1 to L-1 to allow the construction of a
5,000 square foot office, shop, and storage building.
2. The Environmental Review Committee determined that there were no
adverse impacts on the environmental or adjacent properties, but they have
imposed a requirement to improve S.W. 13th Street between Seneca Avenue
S.W. and Raymond Avenue S.W. to a minimum of 20 feet of paving. This is to
allow for emergency vehicle access to the subject site.
The area is not included in a general street improvement benefit area located
to the east of Lind Avenue S.W.
3. The Land Use Hearing Examiner must review four specific criteria under
Section 4-3014(C) to determine that the circumstances surrounding the
rezone request are adequate to recommend approval of the reclassification.
The following evidence clearly demonstrates the rezone request is
appropriate.
a. That substantial evidence was presented demonstrating the subject
reclassification appears not to have been specifically considered at the
time of the last area land use analysis and area zoning.
The subject site was annexed into the city in 1961. Both the city-wide
Comprehensive Plan adopted in 1965 and the Green River Valley
Comprehensive Plan adopted in 1975 clearly show the area's designation
for manufacturing park activities. The residential classification was
originally applied in 1961 and subsequently changed in 1982, as a result
in a major changed in combining several single family residential zones
into one classification.

b. That the property is potentially classified for the proposed zoned being
requested pursuant to the policy set forth in the Comprehensive Plan
and conditions have been met which would indicated that the change is
appropriate.
The proposed rezone to L-1, Light Industrial Use, is not directly in
conformance with the Comprehensive Plan Land Use Element
designation of Manufacturing Park for the subject site. However, the
City has approved a number of rezones in the general area to both B-1,
Business Use, and L-1. Light Industrial Use, as a result of the strict
application setback requirements of the Manufacturing Park Zone upon
small individual lots. In effect, enforcement of these large setback
requirements would preclude the functional development of this area.
The general policy has been established to impose restrictive covenants
establishing minimum setbacks for buildings and specific landscape
areas in this unique area. This policy has been utilized since the late
1960's with the last application in June, 1983, under Ordinance It3732.
c. That since the last previous land use analysis of the area zoning of the
subject property, authorized public improvements, permitted private
development, or other circumstances affecting the subject property
have undergone significant and material changes.
Since 1975, the general area has undergone major development changes
specifically to the west of the subject property. Large industrial
buildings and office complexes in the form of Cummings Diesel and
O.W. Properties have been located west of Raymond Avenue S.W. The
area generally between Raymond Avenue S.W. and Lind S.W. has
undergone minor changes with some commercial and industrial
developments; i.e. PreCut International and Renton West office building.
d. Timeliness: The final test to determine whether a rezone request is
appropriate is to address the question of timeliness. The subject
property is not the next incremental parcel to be developed into light
industrial use in the area. It is slightly separated from other industrial
uses and is east of non-conforming residential uses. The area is in
transition from vacant and single family to light industrial and
commercial uses. This development will create an anchor on the
western end of the block to encourage redevelopment of most of the
remainder of the area. In fact, it is the most westerly proposed
redevelopment of the small lots lying between S.W. Grady Way and
I-405. It appears that new water mains and street improvements will
be required to allow development under city codes. These are normally
anticipated costs associated with the redevelopment process. The
storm drainage issue does not appear critical at this location since it is
on the east side of Lind Avenue S.W. Thus, it would appear timely to
allow the rezoning of the subject site.
4. The Policy Development Department has recommended that the standard
condition of development plan review by the Hearing Examiner be required
prior to the issuance of any building permit. The plans submitted by the
applicant present a maximum potential that the applicant is willing to
develop on the site but it does not appear to sufficiently address the issues of
buffering and aesthetics that might be necessary in a transitioning area.
5. The Engineering Division advises the following conditions will apply:
a. That not positive drainage system exist at this time. (The assumption is
that they will be required to install the system as a condition of the
storm water drainage ordinance of the City of Renton.)

b. Storm water retention will be required.
c. Right-of-way with S.W. 13th Street adjacent to the site is substandard.
Less than sixty (60) feet - The Environmental Review Committee
recognized this condition and required that a minimum pavement of
twenty (20) feet in width be provided for emergency access to circulate
from Raymond to Seneca Streets.]
d. The alley is not currently vacated. (The site plan presented by the
applicant shows that it has an abandoned alley, however, it is still a
legal alley for access.)
6. The comments from the Traffic Engineering Division suggest that
modifications will have to occur to the parking lot which may in turn affect
the structure:
a. Driveways must be a minimum of five (5) feet from property lines.
b. Driveways should be a minimum of twenty-four (24) feet in width.
c. Only one (1) driveway is needed for the property.
The Utilities Engineering Division advises that:
a. Both a systems development charge for water and sewer are applicable
at the rate of .04¢ per square foot for both utilities.
b. That the water main in S.W. 13th Street is substandard and will have to
be upgraded with approved water plans and required hydrant locations.
13. The Fire Marshal's response that approval should be granted only for the
rezone if approved access is provided. This is basically been assured by the
ERC. In addition, the building will be required to meet all the applicable
conditions of the Uniform Building Code and the Uniform Fire Code and be
reviewed specifically at the time of the building application.
9. The site plan presents a theoritical model for a location of a future building.
It does not specifically comply with all of the city codes as presented above
in the staff comments. Specific site plans should be required as a portion of
a further public hearing.
M. DEPARTMENTAL RECOMMENDATION:
Based upon the above analysis, it is recommended that the rezone request,
R-060-83, be recommended for approval to the City Council subject to the
following conditions:
1. That the filing of restrictive covenants requiring:
a. Site plan approval including landscaping approval;
b. Building setback requirements of twenty (20) feet from S.W. 13th Street.

Dear Sirs:
I hereby request a rezone of the property located at 708 and 712
Southwest 13th Street, Renton, Washington from R-1 , Residential,
Single Family to L-1 , Light Industrial. This proposed change
appears appropriate and timely due to the following factors:
1 . ) The subject site was annexed to the city in 1961 at which
time it was zoned residential. This was prior to the
Comprehensive Plans of 1965 and 1975 which designate the
area for manufacturing park activities. Such rezone was
not specifically considered at the time of the last area
land use analysis and zoning.
2. ) Since the 1975 Comprehensive Plan analysis, the general
area has undergone a substantial transition from an older
single family residential area to an area of commercial
and industrial activities. The subject site directly faces
Interstate Highway 405 and is unsuitable as a residential
site due to the extremely high noise level caused by
freeway traffic. In the 700 block of Southwest 13th Street,
there are two abandonned homes, one of which is on the
subject site; one builder' s model home and office; and one
non-owner occupied trailer home. The zoning on this one
block presently ranges from R-1 to R-4 to L-1 , which
further reduces the suitability of the site as a single
family residential site.
3. ) The proposed rezone to L-1 is not directly in conformance
with the designation of Manufacturing Park set forth in
the Comprehensive Plan. However, the small size of the '°'`
subject site and the surrounding lots precludes development" I5 r
as such due to the setback requirements in the manufacturing Un

park zone. A rezone to L-1 would therefore approximate
the uses contemplated in the Comprehensive Plan. In
addition, the city has recently approved several rezones
to both L-1 and B-1 in the same general area.

Introduction The State Environmental Policy Act of 1971 , Chapter 43.21C, RCW, requires
all state and local governmental agencies to consider environmental values both for their
own actions and when licensing private proposals. The Act also requires that an EIS be
prepared for all major actions significantly affecting the quality of the environment.
