SUMMARY. OF REQUEST: Applicant seeks approval for a variance to Section
4-706(C)(4)(a) to reduce the front yard setback from
twenty (20) feet to ten (10) feet; File V-067-83 and
approval of a variance to the Shorelines Master Program to
reduce the rear yard setback from the shoreline of Lake
Washington from twenty (20) feet to fifteen (15) feet, File
V-069-83, and SME-004-83 (exemption from Shorelines
Master Program).
SUMMARY OF ACTION: Building and Zoning Department Recommendation:
Approval.
Hearing Examiner Decision: Both variances are approved.
BUILDING & ZONING The Building & Zoning Department Report was
DEPARTMENT REPORT: received by the Examiner on November 15, 1983.
PUBLIC HEARING: After reviewing the Building and Zoning Department
Report, examining available information on file with the
application, and field checking the property and
surrounding area, the Examiner conducted ,a public hearing
on the subject as follows:
The hearing was opened on November 22, 1983, at 9:00 a.m. in the Council Chambers of the
Renton Municipal Building. Parties wishing to testify were affirmed by the Examiner.
The following were entered into the record as follows:
Exhibit #1: Yellow file containing the application, staff
report, and other documents relative to
posting and publicatibn.
Exhibit #2: Site plan showing the specific request and
an area map of the subject site.
Roger Blaylock, Zoning Administrator, presented the staff report. He indicated the request was
for a front yard setback of 10' rather than 20' to allow construction of a single-family
residence on the subject site and also for a variance from the Shorelines Master Plan, which has
joint criteria to be met from both the city and the State of Washington. Further, Mr. Blaylock
indicated the Comprehensive Plan designation for this area is single-family residential and is
located at the northern end of the Gene Coulon Memorial Beach Park.
Mr. Blaylock reported the lot is 4,000 sq. ft., but that some of the lot extends out into the lake
area 280 feet. He noted this was incorrectly stated in the staff report and amended Item B(5)
to reflect the reference to "land area". He also stated the city has not allowed filling in this
area for residential purposes and the lot could not be extended; and that Mountain View Avenue
North is not a public street and access is provided solely by an easement over Burlington
Northern property.

It was pointed out by Mr. Blaylock that previous variances have been granted to two neighboring
property owners, through V-314-77 and V-402-80, for the same situation and that the
neighboring properties will not be affected by the approval of this variance request; that the
approval of this request will not grant any special privilege for the subject property; and that
the subject property covers less of the total lot area than the two neighboring site plans do.
With reference to the shoreline variance, Mr. Blaylock noted the hardship is a result of the
small lot which is only 4,000 sq. ft., and this will not be detrimental to the general public, nor
intrude into the present public's use of the shoreline.
Mr. Blaylock further noted the city has plans to use Mountain View Avenue North for access
into the Gene Coulon Memorial Beach Park and this will not interfere with the plans of the city
for that. He noted, however, that there was one concern and that was with respect to sanitary
sewers. There is a sanitary sewer line located within this subject property and an easement
should be granted to the city for future maintenance and access by the city. He noted this
would become a requirement of issuance of the building permit.
The Examiner questioned the existence of a city sewer on private property without an already
existing easement.
Mr. Blaylock stated the staff recommends approval of both variance requests.
The Examiner called on the applicant for testimony at this time. Responding was:

Mr. Ellison noted that when the property search was done on the property, the easement was
present in that title search. He offered no further testimony.
The Examiner called for further testimony. No one else was present at the hearing.
There being no further testimony, the Examiner closed the hearing at 9:30 a.m. He noted his
report would be issued within 14 days and that the matter would then be forwarded to the State
of Washington for approval.
FINDINGS, CONCLUSIONS & DECISION: Having reviewed the record in this matter, the
Examiner now makes and enters the following:
FINDINGS:
1. The applicant, Jeffrey W. Ellison, filed a request for approval of a variance from the
provisions of the Shoreline Master Program, together with a variance from the zoning
code.
2. The application file containing the application, the State Environmental Policy Act
SEPA) documentation, the Building & Zoning Department Report, and other pertinent
documents, was entered into the record as Exhibit #1.
3. Pursuant to the City of Renton's Environmental Ordinance and SEPA, RCW 43.21C, 1971,
as amended, the subject proposal has been determined to be exempt from the threshold
determination by the Environmental Review Committee (ERC).
4. Plans for the proposal have been reviewed by all city departments affected by the impact
of this development.
5. The subject proposal met with no opposition from the public.
6. The subject property is located at 2801 Mountain View Avenue N. The site is just north of
Gene Coulon Memorial Beach Park. Currently, the subject site is vacant.
7. The subject site is located along the shores of Lake Washington and while the site is level,
only approximately 4,000 sq. ft. of the site is not submerged. The site, therefore, only has
a 4,000 sq. ft. buildable lot.

8. The subject site was annexed into the city in December of 1969 by Ordinance 2531. It was
zoned G-7200, a classification that was modified in 1982 to R-1 (Single-Family
Residential; minimum lot size - 7,200 sq. ft.).
9. The Comprehensive Plan designates the area in which the subject site is located as
suitable for the development of single family homes.
10. The area is essentially developed with single-family homes. Variances have been
approved to permit the construction and expansion of some of these homes located on the
shores of Lake Washington (see V-402-80 and V-314-77) because many of the lots have
substantial areas of the lots submerged under the lake while only smaller areas of
unsubmerged uplands are available for construction without fill.
11. The Shoreline Master Program requires a setback of 20 feet from the shores of Lake
Washington, while the zoning code requires a front yard setback of 20 feet. These
setbacks, coupled with the sideyard setbacks, result- in a buildable envelope of
approximately 1,200 sq. ft.
The, applicant has therefore requested two variances. One of 5 feet from the Shoreline
Program which would shrink the setback from Lake Washington to 15 feet, and one of 10
feet from the front yard provisions of the zoning code which would shrink the setback to
10 feet.
CONCLUSIONS:
1. Essentially the same criteria must be met in order to grant both variances. The criteria
are generally defined as follows:
a. The applicant suffers undue hardship because of the size, shape, or topography of
the subject site which would deprive the owner of reasonable development.
b. The approval of the variance would not create a special privilege.
c. The variance is the minimum necessary to allow reasonable development.
d. The approval will not materially harm either neighboring property or the public
welfare.
In addition, the Shoreline variance must not cause adverse effects to the shoreline
environment and must be necessitated as a result of specific bulk standards of the
shoreline act.
2. The limited area of the subject site which is not submerged is a definite topographical
constraint which denies the applicant 'full use of the subject property. Without the
variances, the applicant would be strictly limited in trying to build both a house and a
garage.
3. The neighboring property received a similar variance and the approval of these variances
will not extend to the applicant a special privilege.
4. The approval of the variance will not adversely affect neighboring properties, which too
have received variances of the same order, nor will it adversely affect the public health,
safety or welfare.
5. The approval will permit the applicant to develop a home of a size generally existing in
the area and is not more than the minimum necessary for relief.
6. The state has final review authority over the Shoreline Permit and the permit will be
issued subsequent to state review. The applicant is advised to follow the permit process
after the appeal period expires,on the city's review.
DECISION:
The variances are approved.

The Appearance of Fairness Doctrine provides that no ex parte (private one-on-one)
communications may occur concerning land use decisions. This means that parties to a land use
decision may not communicate in private with any decision-maker concerning the proposal.
Decision-makers in the land use process include both the Hearing Examiner and members of the
City Council.
All communications concerning the the proposal must be made in public. This permits all
interested parties to know the contents of the communication and would allow them to openly
rebut the evidence. Any violation of this doctrine would result in the invalidation of the
request by the Court.
The Doctrine applies not only to the initial public hearing but to all Requests for
Reconsideration as well as Appeals to the City Council.
Pursuant to Title IV, Section 3015 of the City's Code, request for reconsideration tnust be filed
in writing on or before December 13, 1983. Any aggrieved person feeling that the decision of
the Examiner is based on erroneous procedure, errors of law Or fact, error in judgment, or the
discovery of new evidence which could not be reasonably available at the prior hearing may
make a written request for review by the Examiner within fourteen (14) days from the date of
the Examiner's decisidn. This request shall set forth the specific errors relied upon by such
appellant, and the Examiner may, after review of the record, take further action as he deems
proper.
An appeal to the City Council is governed by Title IV, Section 3016, which requires that such
appeal be filed with the City Clerk, accompanying a filing fee of $75.00 and meeting other
specified requirements: Copies of this ordinance are available for inspection or purchase in the
Finance Department, first floor of City Hall.

The ERC determined that the proposal is categorically exempt from the State of

C. HISTORY/BACKGROUND:
The subject site was annexed into the City by Ordinance 82531 of December 22,
1969. effective December 24, 1969, at which time it was zoned G-7200. The
zoning classification G-7200 was changed to R-1 with the adoption of the new
Zoning Map which' _combined several single family designations into one
classification. The Zoning Map was adopted by Ordinance #3634 of June 13. 1982.

D. PHYSICAL BACKGROUND:
1. Topography: The subject site is essentially level.
2. Soils: Alderwood Gravelly Sandy Loam (AgC). 6 to 15% slopes. Permeability
is moderately rapid in the surface layer and subsoil and very slow in the
substratum. Runoff is slow to medium and the erosion hazard is moderate.
This soil is used for timber. pasture. berries. row crops and for urban
development.
3. Vegetation: The subject site is covered by grasses, scattered cottonwood.
trees and brambles.
4. Wildlife: The existing vegetation provides some habitat for birds and small
mammals.
5. Water: No surface water was observed on the subject site.
6. Land Use: The subject site is currently vacant.
E. NEIGHBORHOOD CHARACTERISTICS:
The surrounding properties are principally single family residential in nature. The
northern entrance to Gene Coulon Memorial Beach Park is within 1.000 feet of the
subject site.
F. PUBLIC SERVICES:
1. Utilities:
a. Water - A six-inch water line runs along Lake Washington Boulevard
North near the subject site.
b. Sewer - The subject site is served by an eight-inch sanitary sewer force
main located along the east property line.
b. Storm Water Drainage - Directly into Lake Washington.
2. , Fire Protection: Provided by the City of Renton as per ordinance
requirements.
3. Transit: METRO Transit Routes $142 and 11144 operate along Burnett Avenue
North within 800 feet of the subject site.
4. Schools: Kennydale Elementary School is approximately 1/2 of a mile east of
the subject site. McKnight Middle School is approximately 1-1/3 miles to the
southeast and Renton High School is within 2-1/3 miles of the subject site.
5. Recreation: Kennydale Beach Park is approximately 1/2 of a mile to the
north and Gene Coulon Memorial Beach Park is within 1,000 feet of the
subject site.

J. ENVIRONMENTAL ASSESSMENT/THRESHOLD DETERMINATION:
Pursuant to the City of Renton's Environmental Ordinance and the State
Environmental policy Act of 1971, as amended. RCW 43-21C, the subject proposal
is exempt from the threshold determination'of environmental significance.

L. DEPARTMENT ANALYSIS;
1. The applicant Jeffery W. Ellison. is seeking two variances to allow
construction:.of a single faimily residence on a +4.000 square foot lot.
2. The proposed single family residential use of the property complies with both
the Comprehensive Plan designation and the Shoreline Master Plan
designation,
FRONT YARD VARIANCE
3. The applicant is seeking a front yard variance to allow a ten (10) foot setback
instead of the twenty (20) foot setback `under Section 4-706(C). The situation
is complicated byrthe fact that there is no legal public street (Mountain View
Avenue North) adjacent to the site is private and access is provided solely by
easement`:over Burlington Railroad property.
The applicant bases his justification upon the size of the lot and the previous
variances granted to Mr. Bitney (File V-314-77) and Mr. Anderson (File
V-402-80). The following is an analysis of variance criteria established for
review by the.Land Use Hearing Examiner.
a. , That the applicant suffers undue hardship and the variance is necessary
because of special circumstances applicable to subject property,
including ;.size. 'shape. topography, location or surroundings of the
subject property. and the strict application of the Zoning Code is found
to deprive subject property owner of rights and privileges enjoyed by
other property owners in the vicinity and under identical zone
classification.
The limited lot size of only 4,000 square feet and the fact that imposing
the specific setbacks standards would only create a 1.200 square foot
area available to build both the residence and garage is an undue
hardship.

b. That the granting of the variance will not be materially detrimental to
the public welfare or injurious to the property or improvements in the
vicinity and zone in which subject property is situated.
In general. reducing the setbacks and increasing the lot coverage will
not be materially detrimental to the other properties in the immediate.
vicinity because they have already developed to a greater standard that
are presently allowed in the R-1 zone. Emergency access and fire
protection can still be provided around the proposed structures.
c. That approval shall not constitute a grant of special privilege
inconsistent with the limitation upon uses of other properties in the
vicinity and zone in which the subject property is situated.
In 1977 and 1980, adjacent properties were granted similar variances to
allow construction because of the limited lot sizes. Denying the
variance request at this point would be inconsistent with previous
approvals. The variance procedure is an appropiate method to allow
unique and unusual lots the ability to develop.
d. That the approval as determined by the Examiner or Board of
A ijustment is a minimum variance that will accomplish the desired
purpose.
The variance is the minimum necessary to allow the development of the
site to the individual property owner's desire. The variance would allow
the development of a house similar in size to the adjacent houses. This
is the minimum variance that would accomplish the desired purpose.
SHORELINE VARIANCE
5. The state reviews variances for development on the upland portion from the
shoreline based on five criteria. The following analysis addresses each of the
criteria:
a. That strict application of the bulk. dimensional or performance
standards as set forth in the applicable master program precludes a
reasonable permitted use of the property.
The applicant has shown that without the reduction in both the rear and
front yard variances that buildable area would be only 1,200 square
feet. This would result in a very small residence which is not in keeping
with the other residences and deprive the property owner of like use.
b. That the hardship described in WAC 173-14-150(3)(A) above is
specifically related to the property. and is a result of unique condition
such as irregular lot shape. size. or natural features and the application
of the Master Program and not. for example. from deed restrictions or
the applicant's own action.
The hardship is a result of the small lot which is only 4.000 square feet.
c. That the design of the project will be compatible with other permitted
activities in the area and will not cause adverse effects to adjacent
properties or to the shoreline environment designation.
Other adjacent properties have been granted similar shoreline variances
under the criteria established in the Shoreline Master Program
immediately to the south of the subject site. The Anderson residence
was granted a variance in 1977 (V-038-77). while the Bitney residence
to the south of that was granted a similar variance (V-039-77).

d. That the variance authorized does not constitute a grant of special
priviledge not enjoyed by the other property owners in the area and will
be the minimum necessary to afford relief.
The variance. if granted. would not be a special priviledge. It is. in
fact. enjoyed by adjacent property owners and others including Charles
Unger(V-112-80) and Frederick Kendrick (V-027-82).
e. That the public interest will suffer no substantial detrimental affect.
Granting of the variance will not be materially detrimental to the
general public and will not intrude into present public's use of the
shoreline or create a negative impact on the adjacent Gene Coulon
Memorial Beach Park.
6. Department comments have been attached for the Hearing Examiner and the
public's review. There is no opposition to either of the variance requests.
The Public Works Department advises that the sanitary sewer located In the
front yard should have an easement underneath it to allow City maintenance.
The house has been placed so it will not conflict with the operation and
access to the sanitary sewer line. The easement can be required at issuance
of the building permit.
M. DEPARTMENTAL RECOMMENDATION:
Based upon the above analysis. it is recommended that both variance requests.
V-067-83 for the front yard variance and V-069-83 for the variance from the
Shoreline Master Program. be granted by the City of Renton.

If the applicant is seeking a variance, the applicant must include a written
justification) narrative addressing the following criteria as specified in
Section 173-14-150 of the Washington Administrative Code:

1. That the strict application of the bulk, dimensional or performance
standards set forth in the applicable City of Renton Shoreline Master
Program precludes or significantly interferes with a reasonable
permitted use of the property.

features and the application of the master program, and not, for. example,
from deed restrictions or the applicant's own actions.
3. That the design of the project will be compatible with other permitted

properties or the shoreline environment designation.
4. That the variance authorized does not constitute a grant of special
privilege not enjoyed by the other properties in the area, and will
be the minimum necessary to afford relief.
5. That the public interest will suffer no substantial detrimental
effect.

JUSTIFICATION:
15.A.1. The land portion of the property is +4000 SF. Conformance
to the required setbacks would leave an area of approximately
1200 SF for construction of residence and garage. Recently
constructed houses to the south have the following setbacks:

We are requesting a variance which is consistant with the
above, which is:
