treatstormwaterontheProperty.On-siteBMPsincludedispersionandinfiltrationdevices,bioretention,permeablepavements,rainwaterharvestingsystems,treeretentioncredit,reducedimpervioussurfacefootprint,vegetatedroofsandothermeasuresdesignedtomimicpre-developedhydrologyandminimizestormwaterrunoffontheProperty.2.CityofRentonshallhavetherighttoingressandegressoverthoseportionsofthePropertynecessarytoperforminspectionsofthestormwaterfacilitiesandBMP5andconductmaintenanceactivitiesspecifiedinthisDeclarationofCovenantandinaccordancewiththeRentonMunicipalCode.CityofRentonshallprovideatleastthirty(30)days’writtennoticetotheOwnersthatentryonthePropertyisplannedfortheinspectionofdrainagefacilities.Afterthethirty(30)days,theOwnersshallallowtheCityofRentontoenterforthesolepurposeofinspectingdrainagefacilities.InlieuofinspectionbytheCity,theOwnersmayelecttoengagealicensedcivilengineerregisteredinthestateofWashingtonwhohasexpertiseindrainagetoinspectthedrainagefacilitiesandprovideawrittenreportdescribingtheircondition.Iftheengineeroptionischosen,theOwnersshallprovidewrittennoticetotheCityofRentonwithinfifteen(15)daysofreceivingtheCity’snoticeofinspection.Withinthirty(30)daysofgivingthisnotice,theOwners,orengineeronbehalfoftheOwners,shallprovidetheengineer’sreporttotheCityofRenton.Ifthereportisnotprovidedinatimelymannerasspecifiedabove,theCityofRentonmayinspectthedrainagefacilitieswithoutfurthernotice.3.IfCityofRentondeterminesfromitsinspection,orfromanengineer’sreportprovidedinaccordancewithParagraph2,thatmaintenance,repair,restoration,and/ormitigationworkisrequiredtobedonetoanyofthedrainagefacilities,CityofRentonshallnotifytheOwnersofthespecificmaintenance,repair,restoration,and/ormitigationwork(“Work”)requiredpursuanttotheRentonMunicipalCode.TheCityshallalsosetareasonabledeadlinefortheOwnerstocompletetheWork,ortoprovideanengineer’sreportthatverifiescompletionoftheWork.Afterthedeadlinehaspassed,theOwnersshallallowtheCityaccesstore-inspectthedrainagefacilitiesunlessanengineer’sreporthasbeenprovidedverifyingcompletionoftheWork.IftheWorkisnotcompletedwithinthetimeframesetbytheCity,theCitymayinitiateanenforcementactionand/orperformtheWorkandherebyisgivenaccesstothePropertyforsuchpurposes.WrittennoticewillbesenttotheOwnersstatingtheCity’sintentiontoperformsuchWork.ThisWorkwillnotcommenceuntilatleastseven(7)daysaftersuchnoticeismailed.If,withinthesolediscretionoftheCity,thereexistsanimminentorpresentdanger,theseven(7)daynoticeperiodwillbewaivedandWorkwillbeginimmediately.4.TheOwnersshallassumeallresponsibilityforthecostofanyWork,oranymeasurestakenbytheCitytoaddressconditionsasdescribedinParagraph3.SuchresponsibilityshallincludereimbursementtotheCitywithinthirty(30)daysofthereceiptoftheinvoiceforanysuchWorkperformed.OverduepaymentswillrequirepaymentofinterestatthemaximumlegalrateallowedbyRCW19.52.020(currentlytwelvepercent(12%)).IftheCityinitiateslegalactiontoenforcethisagreement,theprevailingpartyinsuchactionisentitledtorecoverreasonablelitigationcostsandattorney’sfees.5.TheOwnersarerequiredtoobtainwrittenapprovalfromCityofRentonpriortofilling,piping,cutting,orremovingvegetation(exceptinroutinelandscapemaintenance)inopenvegetatedstormwaterfacilities(suchasswales,channels,ditches,ponds,etc.),orperforminganyalterationsormodificationstothedrainagefacilitiesreferencedinthisDeclarationofCovenant.Page2of_
