HomeMy WebLinkAboutL_Declaration of Covenant_Lot2_Merlino_signed_and_notarized_V2RECORDINGREQUESTEDBYANDWHENRECORDEDMAILTO:CITYCLERK’SOFFICECITYOFRENTON1055SOUTHGRADYWAYRENTON,WA98057DECLARATIONOFCOVENANTFORMAINTENANCEANDINSPECTIONOFFLOWCONTROLBMPSCurtisLangHomes,Inc.Grantor:________________________________________Grantee:CityofRentonLOT2RENTONSP#LUAJ4-000568-SHPL-ALegalDescription:REC#20170301900008SDSPBEINGPORE1/2OFNW1/4OFNW1/4OFNW1/4STR20-23-5AdditionalLegal(s)on:2023059165AssessorsTaxParcelID#:_______________________________________________________________________INCONSIDERATIONoftheapprovedCityofRenton(checkoneofthefollowing)Iresidentialbuildingpermit,commercialbuildingpermit,clearingandgradingpermit,subdivisionpermit,or14-000568LJshortsubdivisionpermitforApplicationFileNo.LUA/SWP_____________________relatingtotherealproperty(“Property”)describedabove,theGrantor(s),theowner(s)infeeofthatProperty,hereby covenants(covenant)withCityorRenton,apoliticalsubdivisionofthestateofWashington,thathe/she(they)willobserve,consentto,andabidebytheconditionsandobligationssetforthanddescribedinParagraphsIthrough8belowwithregardtotheProperty.Grantor(s)herebygrants(grant),covenants(covenant),andagrees(agree)asfollows:1.Grantor(s)orhis/her(their)successorsininterestandassigns(“Owners”)shallretain,uphold,andprotectthestormwatermanagementdevices,features,pathways,limits,andrestrictions,knownasflowcontrolbestmanagementpractices(“BMPs”),shownontheapprovedFlowControlBMPSitePlanforthePropertyattachedheretoandincorporatedhereinasExhibitA.2.TheOwnersshallattheirowncost,operate,maintain,andkeepingoodrepair,theProperty’sBMPsasdescribedintheapprovedDesignandMaintenanceDetailsforeachBMPattachedheretoandincorporatedhereinasExhibitB.3.CityorRentonshallprovideatleast30dayswrittennoticetotheOwnersthatentryonthePropertyisplannedfortheinspectionoftheBMPs.Afterthe30days,theOwnersshallallowtheCityofRentontoenterforthesolepurposeofinspectingtheBMPs.InlieuofinspectionbytheCity,theOwnersmayelecttoengagealicensedcivilengineerregisteredinthestateofWashingtonwhohasexpertiseindrainagetoinspecttheBMPsandprovideawrittenreportdescribingtheircondition.Iftheengineeroptionischosen,theOwnersshallprovidewrittennoticetotheCityofRentonwithinfifteendaysofreceivingtheCity’snoticeofinspection.Within30daysofgivingthisnotice,theOwners,ortheengineeronbehalfoftheOwners,shallprovidetheengineer’sreporttotheCityofRenton.Ifthereportisnotprovidedinatimelymannerasspecifiedabove,theCityofRentonmayinspecttheBMPswithoutfurthernotice.4.IftheCitydeterminesfromitsinspection,orfromanengineer’sreportprovidedinaccordancewithParagraph3,thatmaintenance,repair,restoration,and/ormitigationworkisrequiredfortheBMPs,TheCityshallnotifytheOwnersofthespecificmaintenance,repair,restoration,and/ormitigationwork(Work)requiredunderRMC4-6-030.TheCityshallalsosetareasonabledeadlineforcompletingtheWorkorprovidinganengineer’sreportthatverifiescompletionoftheWork.Afterthedeadlinehas passed,theOwnersshallallowtheCityaccesstore-inspecttheBMPsunlessanengineer’sreporthasbeenprovidedverifyingcompletionoftheWork.IftheworkisnotcompletedproperlywithinthetimeframesetbytheCity,theCitymayinitiateanenforcementaction.FailuretoproperlymaintaintheBMPsisaviolationofRMC4-6-030andmaysubjecttheOwnerstoenforcementundertheRMC1-3,includingfinesandpenalties.5.Apartfromperformingroutinelandscapemaintenance,theOwnersareherebyrequiredtoobtainwrittenapprovalfromtheCityorRentonbeforeperforminganyalterationsormodificationstotheBMPs.6.AnynoticeorapprovalrequiredtobegivenbyonepartytotheothertindertheprovisionsofthisDeclarationofCovenantshallbeeffectiveuponpersonaldeliverytotheotherparty,orafterthree(3)daysfromthedatethatthenoticeorapprovalismailedwithdeliveryconfirmationtothecurrentaddressonrecordwitheachParty.Thepartiesshallnotifyeachotherofanychangetotheiraddresses.7.ThisDeclarationofCovenantisintendedtopromotetheefficientandeffectivemanagementofsurfacewaterdrainageontheProperty,anditshallinuretothebenefitofallthecitizensoftheCityofRentonanditssuccessorsandassigns.ThisDeclarationofCovenantshallrunwiththelandandbebindinguponGrantor(s),andGrantor’s(s’)successorsininterestandassigns.8.ThisDeclarationofCovenantmaybeterminatedbyexecutionofawrittenagreementbytheOwnersandtheCityofRentonthatisrecordedbyKingCottntyinitsrealpropertyrecords.
