PROJECT DESCRIPTION: The applicant is requesting a Shoreline Exemption and Critical Area Exemption for the
purpose of geotechnical boring and fiber optic line potholing at two (2) locations (Tabor-
Crowall Site and Brodell Site) on the right bank of the Cedar River. The boring and
potholing would occur between the Ordinary High-Water Mark (OHWM) of the Cedar
River and the edge of pavement of State Route 169 (SR 169); proposed work would be
within the highway right-of-way. The boring and potholing are necessary for future
revetment repair along the Cedar River and SR 169.
The proposal is within the Shoreline High Intensity designation and is within Reach C of
the Cedar River. Proposed work would occur as close as approximately 20 feet (20')
landward of the OHWM. Work would consist of four (4) potholing locations of the fiber
optic line and three (3) geotechnical borings. No tree removal or tree pruning is
anticipated to be necessary. Light pruning of shrubs is expected. Parking lot access for
Riverview Park from SR 169 is proposed to be cordoned off so that the parking lot can
be used as an equipment staging area. A separate right-of-entry permit approved by City
of Renton Parks and Recreation would be required.

CRITICAL AREAS EXEMPTION JUSTIFICATION/DECISION: An exemption from critical area regulations, is hereby
APPROVED on the proposed project in accordance with RMC 4.3.050C “Exempt, Prohibited and Nonconforming
Activities” and for the following reasons:
Site investigative work is exempt from permit requirements within critical areas and associated buffers in
accordance with RMC 4.3.050C3bii Site Investigative Work, within Flood Hazard Areas, Geological Hazard Areas,
Streams and Lakes and Wellhead Protection Zones subject to the following standards:
Site investigative work necessary for land use application submittals such as surveys, soil logs, percolation tests and
other related activities. Investigative work shall not disturb any more than five percent (5%) of the critical area and
required buffer. In every case, impacts shall be minimized, and disturbed areas shall be immediately restored at a
one-to-one (1-1) ratio. Within shoreline jurisdiction, this includes the marking of property lines or corners on state-
owned lands, when such marking does not significantly interfere with the normal public use of the surface water.
Limitation on site exploration and investigative activities are defined in WAC 173-27-040(2)(m) for properties
within shoreline jurisdiction.
SHORELINE EXEMPTION JUSTIFICATION/DECISION: An exemption from a Shoreline Management Substantial
Development Permit is hereby Approved with Conditions* on the proposed project in accordance with RMC 4-9-
190C “Exemption from Permit System” and for the following reasons:
Site exploration and investigation activities that are prerequisites to preparation of an application for development
authorization under the Shoreline Master Program, if:

i.The activity does not interfere with the normal public use of the surface waters.
ii.The activity will have no significant adverse impact on the environment including, but not limited to fish,
wildlife, fish or wildlife habitat, water quality, and aesthetic values.
iii.The activity does not involve the installation of a structure, and upon completion of the activity the
vegetation and land configuration of the site are restored to conditions existing before the activity.
iv.A private entity seeking development authorization under the Shoreline Master Program first posts a
performance bond or provides other evidence of financial responsibility to the Planning Division to ensure
that the site is restored to pre-existing conditions.
v.The activity is not subject to the permit requirements of RCW 90.50.550.
CRITICAL AREA EXEMPTION FINDINGS: The proposed development is consistent with the following findings
pursuant to RMC section 4-3-050C2d:
i.The activity is not prohibited by this or any other provision of the Renton Municipal Code or State or
Federal law or regulation;
ii.The activity will be conducted using best management practices as specified by industry standards or
applicable Federal agencies or scientific principles;
iii.Impacts are minimized and, where applicable, disturbed areas are immediately restored;
iv.Where water body or buffer disturbance has occurred in accordance with an exemption during
construction or other activities, revegetation with native vegetation shall be required; and
v.If a hazardous material, activity, and/or facility that is exempt pursuant to this Section has a significant
or substantial potential to degrade groundwater quality, then the Administrator may require
compliance with the Wellhead Protection Area requirements of this Section otherwise relevant to that
hazardous material, activity, and/or facility. Such determinations will be based upon site and/or
chemical-specific data.
SHORELINE EXEMPTION FINDINGS: The proposed development is:
i.Consistent with the policies of the Shoreline Management Act.
ii.Not applicable to the guidelines of the Department of Ecology where no Master Program has been
finally approved or adopted by the Department.
iii.Consistent with the City of Renton Shoreline Master Program.
*CONDITIONS OF APPROVAL:
1.Prior to work commencing, the applicant shall apply for and receive a right-of-entry permit from City of
Renton Parks and Recreation.
DECISION: The Cedar River Geotechnical Borings and Fiber Optic Line Potholing Critical Areas and Shoreline
Substantial Development Permit Exemption, LUA23-000048, SME, CAE is hereby Approved with Conditions.

RECONSIDERATION: Within 14 days of the decision date, any party may request that the decision be reopened by
the approval body. The approval body may modify his decision if material evidence not readily discoverable prior
to the original decision is found or if he finds there was misrepresentation of fact. After review of the
reconsideration request, if the approval body finds sufficient evidence to amend the original decision, there will be
no further extension of the appeal period. Any person wishing to take further action must file a formal appeal within
the 14-day appeal time frame.
APPEALS: This administrative land use decision will become final if not appealed in writing to the
Hearing Examiner on or before 5:00 PM on March 9, 2023. An appeal of the decision must be filed within
the 14-day appeal period (RCW 43.21.C.075(3); WAC 197-11-680). Appeals must be submitted electronically to
the City Clerk at cityclerk@rentonwa.gov or delivered to City Hall 1st floor Lobby Hub Monday through Friday.
The appeal fee, normally due at the time an appeal is submitted, will be collected at a future date if your
appeal is submitted electronically. The appeal submitted in person may be paid on the first floor in our Finance
Department. Appeals to the Hearing Examiner are governed by RMC 4-8-110 and additional information
regarding the appeal process may be obtained from the City Clerk’s Office, cityclerk@rentonwa.gov.
EXPIRATION: Two (2) years from the date of decision (date signed).

Project Narrative for Geotechnical Borings and Fiber Optic Line Potholing for the Tabor-Crowall and Brodell Revetment Repair Project
The proposed geotechnical borings and fiber optic line potholing for Tabor-Crowall and Brodell Revetment Repair Project includes conducting exploratory geotechnical boring in three locations
and fiber optic line potholing in four locations on the south side of State Route (SR) 169, within the
road right-of-way (ROW), located within shoreline jurisdiction (Cedar River). The boring and
potholing are necessary for future revetment repair along the Cedar River and SR 169. Two future
revetment repairs are proposed along the Cedar River and are referred to as the “Tabor-Crowall”
site (near Riverview Park) and the “Brodell” site (southwest of the Maplewood Golf Course). See
attached site plan exhibits (Figure 1).
The Tabor-Crowall site is located in the southwest quarter of Section 16, Township 23 N, Range 05 E, W.M. The Brodell site is located in the northeast quarter of Section 21, Township 23 N, Range 05 E, W.M. The locations of the boring and potholing are shown on the attached site plans (Figures 2 and 3).
The project will be conducted as follows:
1. First, 811 one-call will be initiated at boring locations (total of three) and at utility potholing
locations (total of four). Applied Professional Services (APS) will, in parallel, perform private
utility locates at these locations, placing paint on the pavement and/or turf to mark utilities.
2. Next, APS will perform potholing of the fiber optic line in four locations, two at each revetment repair site. See attached site plan exhibits (Figures 1, 2, and 3) for the location of the potholes. Potholing will be accomplished by a vacuum mounted on the back of small pick-up truck and the hole is typically less than 8-inches wide. All excavated material will be replaced upon completion of work. The area will then be reseeded and restored to current conditions. Potholing will be conducted as follows:
a. Fiberoptic Utility pothole #1: located at Tabor-Crowall revetment, close to Boring location T2. APS will access location from the parking area of Riverside Park. Pedestrians will have access to the bridge over the river. Vehicles will have access to the parking lot, although one of the two lanes in/out will be closed for parking of equipment. See traffic control plan (TCP) 1 (Figure 4).
b. Fiberoptic Utility pothole #2: located at Tabor-Crowall revetment site, close to Boring location T1. APS will access the location by driving up and over the sidewalk onto the grassy area. Sidewalk closure will not be necessary.
c. Fiberoptic Utility pothole #3: located at the Brodell revetment site, next to the Cedar
River Trail. This work will be accomplished without closing the trail. Signage will warn
trail users to walk, or to walk their bikes next to equipment See TCP 2. Access will be via
access trail to the west. No tree removal or tree pruning will be necessary to accomplish

this work. Light pruning of shrubs may be necessary between SR 169 and the Cedar River Trail to access this location, but no shrubs will be removed.
d. Fiberoptic Utility pothole #4: located at the Brodell revetment site next to the Cedar River Trail. This work will be accomplished without closing the trail. Signage will warn trail users to walk, or to walk their bikes next to equipment See TCP 2. Access will be via access trail to the west. No tree removal or tree pruning will be necessary to accomplish this work. Light pruning of shrubs may be necessary between SR 169 and the Cedar
River Trail to access this location, but no shrubs will be removed.
3. Lastly, the geotechnical borings will take place. Borings will be approximately 8 inches wide
and will be drilled from equipment mounted on the back of a small truck. All soil will be
stockpiled adjacent to the borehole and replaced upon completion of the work. The
exposed soil will then be reseeded and restored to current conditions. The boring work will
be conducted as follows:
a. T1, located near the Tabor-Crowall revetment: This boring location will be accessed by
bringing the truck/rig over the curb and sidewalk to that location. Geotechnical driller
Holocene will bring ‘mud mats’ to protect the turf. No closure of sidewalk, roadway, or
trail is required. A piezometer will be placed in this boring to monitor groundwater
levels. After borings are complete, the piezometer will be accessed via foot and cable
download.
b. T2, located near the Tabor-Crowall revetment: This boring location will be accessed via the Riverview Park parking lot. The boring location is in the mowed grassy area just to the east of the park entrance. Pedestrians will have access to the bridge over the river. Vehicles will have access to the parking lot, although one of the two lanes in/out will be closed for parking equipment. See the attached traffic control plan (TCP) 1 (Figure 4).
c. B1, located at the Brodell revetment: This boring is planned for the edge of the pavement of the Cedar River Trail. This work will be performed without closing the trail. Signage will be placed to warn trail users to walk or to walk their bikes next to equipment (see TCP 2, Figure 4). Access to this boring will be via the access trail to the west. A piezometer will be placed in this boring for monitoring groundwater levels. Access to this piezometer after the borings will be via foot and via cable download.
