Refer to City Attorney and Insurance Services. b. City Attorney recommends amending RMC 1-3-2.P.4 to correct a scrivener's error by changing the word "conviction" to "violation" for consistency. Refer to Public Safety Committee. c. Fire and Emergency Services Department recommends approval of the South King County Training Consortium Associate Agency Agreement in the amount of $48,240 with Kent Regional Fire Authority in order to cooperatively provide joint training services for fire protection and emergency medical services for the period 1/1/2015 - 12/31/2015. Council concur. (See 8.a. for resolution.) d. Public Works Department recommends approval of an interagency agreement with the cities of Bellevue, Kirkland, Newcastle and Redmond regarding coordinated environmental review of PSE’s proposed Energize Eastside 230 kV Transmission Line project. Refer to Planning and Development Committee. e. Transportation Systems Division recommends approval of the 2015-2016 One Card for All (ORCA) Business Passport interlocal agreement with King County, Pierce Transit, Sound Transit, Community Transit, Kitsap Transit, and the Washington State Ferries Division in the amount of $99,756 to continue the Commute Trip Reduction Program for City employees. Utility Systems Division submits CAG-14-089, South 132nd Street Sewer Extension project; and requests approval of the project, authorization for final pay estimate in the amount of $8,732.84 commencement of a 60-day lien period, and release of retainage in the amount of $15,417.70 to A Advanced Septic Services, Inc., contractor, if all required releases are obtained. The main provisions of this interagency agreement are: PSE represents that there is a need to construct a new 230 kV bulk electrical transmission line corridor and associated substation(s) and infrastructure between the existing Talbot Hill Substation in Renton and the existing Sammamish Substation in Redmond (the proposal). The purpose of this proposal is to supply future electrical capacity to the Eastside and improve the Eastside electrical grid reliability. The interagency agreement is between the five cities directly impacted by the proposal: Renton, Bellevue, Kirkland, Newcastle and Redmond. The purpose of the interagency agreement is to establish how the five jurisdictions will work cooperatively to review and respond to the proposal under SEPA. Bellevue is designated as the nominal lead agency, with the four other cities designated as co-lead agencies where the proposal traverses their city. All five cities are designated as Principal Jurisdictions. The EIS will be phased. The first phase will address the need, methods and general feasibility of the proposal. The second phase will address construction level impacts of the proposal. The list of alternatives to be analyzed shall include those agreed to by PSE, as well as those alternatives proposed by at least two Principal Jurisdictions. The Principal Jurisdictions will consult to identify a preferred alternative. Selection of a preferred alternative requires the approval of Bellevue and any other principal jurisdiction where the preferred alternative would be located. The EIS may proceed with no preferred alternative identified. An EIS Steering Committee and an EIS Collaboration Team made up of representatives of the Principal Jurisdictions will be established. Bellevue will be responsible as the primary point of contact, establishing public meetings as required by SEPA, comment opportunities, general SEPA administration, identifying actions as defined by SEPA and contracting with the EIS consultant. The agreement establishes timelines for review and comments to be submitted by the Principal Jurisdictions. All of the Principal Jurisdictions are required to provide technical staff to participate in the EIS process. PSE will pay for the development of the EIS. Each Principal Jurisdiction will coordinate and negotiate with PSE reimbursement for their participating staff members and other costs. 6d. - Public Works Department recommends approval of an interagency Page 47 of 111 Ed Prince, Council President Members of the Renton City Council Page 3 of 3 January 8, 2015 Appeals: if there is an appeal, the Principal Jurisdictions will enter into an agreement stipulating proportional share of any legal defense costs not recovered from PSE. Principal Jurisdictions may become Participating Jurisdictions by amendment to the agreement. Participating Jurisdictions will not have authority over decisions, but will have the same rights and responsibilities for review and comment as the Principal Jurisdictions on draft documents. The agreement extends through the issuance of the final EIS (FEIS) and any supplements or addenda to the agreement required as a result of any appeal proceedings. Any party may withdraw from the agreement without cause upon 30-day written notice to the other parties. Except in the case of legal costs associated with appeals, this agreement shall not result in any monetary liabilities from one party to another. The preparation of the EIS, final design and permitting are scheduled to take place in 2015-2016, with construction of the proposal in 2017-2018. A Citizens Advisory Group recommended two routes for the transmission line corridor, shown as “Oak” and “Willow” in the attached graphics, as a result of a year-long series of study sessions and public meetings. These preferred routes were presented on an advisory basis to PSE. Public Works Department recommends approval of an interagency Page 69 of 111 ATTACHMENTAPROPOSALDESCRIPTIONProposalDescriptionPSEhasdeterminedthatprojectedelectricalloadgrowthintheEastsideareaofPugetSoundEnergy’soperatingsystemisoutstrippingthecapacitytodeliverreliablesourcesofelectricitytotheregion.ThisencompassestheareaeastofLakeWashingtonbetweenthecitiesofRedmondandRenton.AdetaileddescriptionoftheelectricalsystemproblemisprovidedinPSE’sNeedsReport(2012).PSE’stransmissionsystembackboneintheEastsideareacomprisesfour230kV—115kVtransformers.Thesetransformers,undercertainoperationalconditions(i.e.,coldwinterdays),areoperatingnearcapacityandsystemstudiesandmodelshaveshownthattheyareexpectedtoexceedthatcapacityasearlyasthewinterof2017/2018.InadditiontothesetransformersatPSE’sTalbotHillandSammamishsubstations,several115kVlinesarealsosubjecttooverloading.Theseoverloadsshowthatthereisaneedforadditional230kVtransmissionsupplytosupporttheEastsidearea.Thissituationcreatesoperationalconditionsthatdonotcomplywithmandatoryreliabilityrequirements.Furthermore,electricgenerationfacilitieslocatedinthisareaofKingCountyprovidelessthan10%ofthepeakelectricload;therefore,theareaisquitedependentontheelectrictransmissionsystem.ElectricalsystemstudiesperformedindependentlyandbyPSEhavedemonstratedthatdifferentpartsofthetransmissionsystemwillnotmeetminimummandatoryreliabilityrequirementsforgivensystemconditionsundercontingentoperation.TheseminimumreliabilityrequirementsaremandatedbytheNorthAmericanElectricReliabilityCorporation(NERC)andWesternElectricityCoordinatingCouncil(WECC).Anumberofsolutionswereidentifiedandanalyzedtoassessviablewaysofsolvingthetransmissionsupplyproblem.ViablesolutionshavetosolvethevariouspowerflowissuesintheEastsideareaaswellassatisfyinglongevitycriteria,beconstructible,andcosteffective.Atenyearstudyhorizonwasusedbetween2012and2022.Todevelopthepotentialsolutions,thefollowingcategorieswereidentified:demandsidereductions;generation;transformeradditionswithminimalreinforcement,andtransformerwithnewtransmissionline.EachsolutiontypewasthensubjectedtopowerflowanalysisusingthebasecasesdescribedintheNeedsReportaswellasanextensivelistofcontingencies.Basedontheresultsofthepowerflowanalysis,themostpromisingsolutionswerefurtherevaluatedfromtheperspectiveofoverallsystemperformance,operationalflexibility,andlongevity.AdditionaldetailsregardingthesolutionsconsideredtosolvetheproblemareprovidedinPSE’sSolutionsReport(2012)andothersupportingdocuments.DemandSideReduction/Non-WireTechnologiesDescription:TheadditionofdemandsidereductionorconservationmeasureswasevaluatedbyPSE’sEnergyEfficiencyGroup.Theseincludeenergyefficiency,demandresponse,anddistributedgenerationmeasures.Energyefficiencymeasuresincludethingssuchpromotingtheinstallationofmoreefficientappliances,changingoutincandescentlightbulbsforLED,updatingwindowsandinsulation,aswellasnumerousothers.PSEhasextensiveprogramstopromotesuchefficiencyimprovements,butcannotrequirethatcustomersimplementthem.Demandresponseentailsenergyreductionprogramswherespecializeddevisesareinstalledthatcanbeusedto6d. - Public Works Department recommends approval of an interagency Page 70 of 111 controluserselectricalusestobetteraccommodateandmanagepeakusage.PSEhasrunpilotprojectsusingthistechnology,butsuchprogramshavenotbeenpopularandcannotberequiredbytheutility.Installingrooftopsolarpanels,smallscalewindturbines,andwastedigestersareallformsofdistributedgeneration,againallwhichcannotberequiredbyautility’scustomers.ThesesolutionsdonotrepresentapermanentaLternativetoavoidtheneedforinfrastructureimprovementsandupgradesnecessarytooperatethesystemattherequiredreliabilitylevels;howevertheyareanecessarycomponentofthesolution(PSEScreeningStudy2014).GenerationDescription:Ithasbeendeterminedthata300MWnaturalgasfiredpowerplantlocatedwithintheEastsidecouldpotentiallysolvetheidentifiedproblem.Thissizeplantwouldbecomparabletothe325MVAnameplatecapacitiesofPSE’s230kV—115kVtransformers.Inadditiontotheconstructionofthepowerplant,morethan30milesofnewandupgraded115kVtransmissionlineswouldberequiredaswouldpossiblyanewnaturalgaspipelineand/orwaterpipeline.Thenumberandlengthofsupportinginfrastructuretransmissionlinesandpipelineswouldbedependentuponwhereagenerationfacilitycouldbedeveloped.Othergenerationtechnologieswereevaluated,butdeterminedtobeinadequateorinappropriatefortheprojectarea.Newgenerationwouldhavetobesitedsothatitcouldrelievethe230kV—115kVsubstationtransformersand115kVtransmissionlinesthatwereidentifiedasbeingatriskofoverloadinthe2013PSEEastsideNeedsAssessmentReport.NewTransformer—ExistingSubstationDescription:ThePSEplanningteamevaluatedinstallingonlyanew230kV—115kVtransformeratanexistingsubstation,suchastheexistingSammamishsubstation,TalbotHillsubstation,andLakeTraditionsubstations.Itisanticipatedthatthisalternativewouldnotrequiretheinstallationofnew230kVtransmissionlinessinceallthreesitesconsideredcurrentlyhavenearby230kVsources.However,whenelectricsystemmodelsandstudieswereperformed,thisscenarioshowednumerous115kVtransmissionsystemoverloads,whichindicatedthatasubstantialamountofnew115kVlineswouldneedtobeconstructedandstillwithlessthanidealsystemoperationalresults.NewTransformerandTransmissionLineDescription:Themostviablesolutiontypeconsideredwasacombinationofaddinganewsubstationwitha230kVtransformerandconnectingitwiththeTalbotandSammamishsubstationviaanew230kVtransmissionline.Thissolutionwouldprovideanew230kVtransmissionsourceandimprovereliabilityfortheEastsidearea.Toprovidethegreatestsystemefficiency,thenewtransformerwouldneedtobelocatedsomewherebetweenSR520and1-90.NoActionDescription:UndertheSEPArules,whenevaluatingalternatives,the“noaction”alternativealsoneedstobeconsideredandcomparedtotheotherreasonablealternatives(WAC197-11-440(5)(b)(ii)).Inthisinstance,thenoactionalternativeequatestonotmakingimprovementstotheelectricaltransmissionsystem.ThiswouldputtheoperationofthetransmissionsystemasriskandPSEoutofcompliancewithFERCandNERCrequirements.6d. - BACKGROUND: In order to reduce congestion and improve air quality, Washington State passed a Commute Trip Reduction (CTR) Law in the early 1990s. The CTR law requires employers with 100 or more employees arriving to work between the hours of 6:00 and 9:00 a.m. to have transportation programs for their employees that encourage the use of alternatives to single occupancy vehicles. Under the CTR law, the City of Renton is classified as a CTR affected employer. During the past 16 years the City has entered into annual agreements with transit agencies to purchase public transit passes in bulk at a reduced rate. These passes are provided to each regular City employee as a core fundamental piece of the City’s CTR Program. Sounder, light rail and bus usage cost approximately $35,500 with an additional $14,700 for VanShare (VanShare provides older Metro vans for connection between City Hall and the Sounder Station). The Guaranteed Ride Home Program costs approximately $500. The cost for the time period of March 1, 2015 to February 29, 2016 (leap year) is $498.78 per pass. This is a significant savings over buying the passes through King County Metro Transit outside of the ORCA Business Passport Program. If passes were purchased in lesser quantities, each equivalent pass could cost as much as $2,268. Additionally these passes would not include other benefits of the FlexPass Program, such as Guaranteed Ride Home or the 100% VanShare and VanPool subsidies. Transportation Systems Division recommends approval of the 2015-2016 Page 80 of 111 lostorstolencard,forty-eight(48)hoursaftertheCardBlockwasinitiatedintheORCAsystem,willberestoredtothereplacementcardviaaremoterevaluefunction.AnE-purseonablockedcardwillberestoredonthereplacementcardontheeighthdayalterthecardhasbeenissued.ThecardmustthenbetappedtoactivatetheE-pursevalue.5.10CardReplacementTheBusinessAccountisresponsiblefororderingandpayingforanynewcardsneededtoreplaceBusinessCardsthatforanyreasonceasetobeavailableorsuitableforusebytheCardholdersundertheprogramoftheBusinessAccount,includingbutnotlimitedto,iftheunavailabilityorunsuitabilityiscausedbydamage,abuse,loss,theft,CardBlock,andendofusefullife.Provided,however,andnotwithstandingtheexclusionofwarrantiesinSection14,ifaBusinessCardmalfunctionswithintwelve(12)monthsalteritwasdeliveredtotheBusinessAccount,itshallbereplacedbytheLeadAgencywithoutadditionalchargetotheBusinessAccountifthemalfunctionwascausedbyadefectindesign,materialorworkmanshipandwasnotcausedbymisuse,anintentionalact,negligenceordamage,reasonablewearandtearexcepted.TheBusinessAccountunderstandsandagreesthattoavoidthedisruptionandinconveniencecausedbysporadicfailuresasitscardsareused,itmustplanforreplacementofitsBusinessCardsonaregularbasis.AsaconditionofcontinuingundertheBusinessPassportprogram,theBusinessAccountagreesthat:(a)itwillretireallofitsORCABusinessCardsatsometimewithinfouryearsaltertheyareissuedbytheLeadAgencytotheBusinessAccount;and(b)purchasereplacementBusinessCardsatthethen-applicablerate.6.0CARDHOLDERUSEOFORCABUSINESSCARDSCardholderPrivileges.TheBusinessAccountunderstandsandagreesthat,althoughitremainstheownerofORCABusinessCardsafterdistribution,theCardholderhasthefollowingprivilegesinconnectionwiththeuseofanORCABusinessCard.6.1TheCardholdermaypresentanORCABusinessCard,loadedwithavalid,applicableBusinessPassportorBusinessChoiceProduct,toanORCAfaretransactionprocessorasproofofpaymentofalloraportionofarequiredfareonaregulartransportationserviceoperatedbyoneormoreoftheAgencies.(Provided,however,anORCAProductthatisnotsufficienttofullypayafarewillnotbeacceptedaspartialpaymentbytheWashingtonStateFerries.)Inallcases,aCardholderwillberequiredtomakeotherpaymenttotheextentafareisnotcoveredbyanORCAProduct.6.2TheCardholdermayindividuallypurchaseORCAProductsandloadthemontheBusinessCardinadditiontoanyORCAProductloadedbytheBusinessAccount.IndividualORCAProductsmaybeusedtopayalloraportionofarequiredfareonatransportationservicenotcoveredbyaBusinessPassportProductorBusinessChoiceProduct.(Provided,however,anORCAProductthatisnotsufficienttofullypayafarewillnotbeacceptedaspartialpaymentbytheWashingtonStateFerries.)Inallcases,aCardholderwillberequiredtomakeotherpaymenttotheextentafareisnotcoveredbyanORCAProduct.6.3TheCardholdermayregisterhis/hernameandothercontactinformationwiththeORCASystemandlinksuchpersonalinformationtotheserialnumberoftheBusinessCardprovidedtohim/her.SuchregistrationdoesnotgivetheCardholderanyownershiprightsinthecardbutdoesgivetheCardholdertherighttoaccesstheORCACardholderWebsitetoviewthecard’stransactionhistoryandcurrentstoredvalue,tomodifytravelzonepreferences,andtoaddretailproducts.7.0NORETURNSORREFUNDSExceptasotherwiseprovidedhereinorinSection13.2,theBusinessAccountunderstandsandagreesthatitspurchasesofBusinessCards,andBusinessPassportProductsandBusinessChoiceProductspurchasedforsuchcards,arefinalanditisnotentitledtoanyrefunds.Provided,however,theBusinessAccountmayrequestarefundoftheE-pursevalueremainingonaBusinessCardifthecardissurrenderedbytheBusinessAccounttotheLeadAgency.UponsurrenderofthesubjectBusinessCard,theLeadAgencyshallinitiateaCardBlockandtherefundprocessedapproximatelyten(10)calendardaysaltertheCardBlockwasinitiated.TheE-purseamountrefundedwillbethatwhichremainedonthesurrenderedcardforty-eight(48)hoursaltertheCardBlockwasinitiatedintheORCAsystem.Aprocessingfeeoftendollars($10)shallbepayablebytheBusinessAccounttotheLeadAgencyforeachsuchE-purserefundthatisprocessed,regardlessofe-pursevaluerefunded.TheBusinessAccount,notORCAPassportAgreementPage5of19CityofRentonBAID:2480March1,2015-February29,20166e. - Transportation Systems Division recommends approval of the 2015-2016 Page 81 of 111 theLeadAgency,isresponsiblefortherefundingofsuchE-pursevalue,ifany,totheindividualCardholdertowhomtheBusinessCardhadbeendistributed.8.0BUSINESSACCOUNTWEBSITE8.1TheBusinessAccountWebsiteistheprimarymeansbywhichtheBusinessAccountshallpurchaseORCABusinessCards,BusinessPassportandBusinessChoiceProducts,manageitsBusinessCardsandobtaininformationabouttheuseofsaidcards.AsaconditionofparticipationintheBusinessPassportprogram,theBusinessAccountagreesthatitwillusetheBusinessAccountWebsitewhenitisavailableandthateachaccessanduseofsaidwebsiteshallbesubjecttotheTermsofUseandPrivacyStatementthatareineffectandpostedontheBusinessAccountWebsiteatthetimeofsuchaccessanduse.8.2TheBusinessAccountunderstandsandagreesthatuninterruptedaccesstoanduseoftheBusinessAccountWebsiteisnotguaranteedandagreesthatitwillcontactitsrepresentativeattheLeadAgencybyemailortelephoneifthewebsiteisnotavailable.8.3AtthetimetheBusinessAccountentersintotheORCAprogram,theLeadAgencywillprovideasinglepasswordtotheBusinessAccount’sPrimaryContact,asspecifiedinAttachment2,DesignatedRepresentatives,toenableuseraccesstotheBusinessAccount’ssecuredareaoftheBusinessAccountWebsite.TheBusinessAccountisrequiredtochangethetemporarypasswordtooneofitsowncreation.TheBusinessAccountshallbesolelyresponsibleforthenumberandidentityofthoseemployeeswithwhomtheBusinessAccount’spasswordisshared.TheBusinessAccountisalsosolelyresponsibleforcomplyingwiththesecuritystandardsspecifiedinAttachment5,SecurityStandards,whichisincorporatedinthisAgreementbythisreference.9.0INFORMATIONPROVIDEDBYTHEAGENCIESANDTHEORCASYSTEM9.1TheBusinessAccountunderstandsandagreesthatthedata,reportsoranyinformationprovidedtoitviatheBusinessAccountWebsiteorotherwise,isandremainsthesolepropertyoftheAgenciesandnothingshallbeconstruedasatransferorgrantofanycopyrightorotherpropertyinterestinsuchdata,reportsorinformation.TheAgenciesherebygranttotheBusinessAccountanon-exclusivelicensetouseanydata,reportsorinformationprovidedbytheAgencies,viatheBusinessAccountWebsiteorotherwise,foranylawfulpurposerelatedtotheadministrationofthetransportationbenefitsprogramoftheBusinessAccount.9.2TheORCASystemwillrecorddataeachtimeanORCABusinessCardispresentedtoanORCAdeviceforfarepaymentandtoloadaproduct.Suchtransactiondataincludes,butisnotlimitedto,thedate,time,andlocation(orroute)ofthetransaction.TheBusinessAccountmayroutinelyaccesssuchtransactiondatarelatedtoitsBusinessCardstotheextentprovidedviatheBusinessAccountWebsite.SaidwebsiteanditsreportsdonotprovidetheBusinessAccountBusinessCardtransactiondatalinkedtocardserialnumbers.Forthepurposeofpreventingfraud,thePrimaryContactPersonoftheBusinessAccountmaysubmitawrittenrequesttotheLeadAgencyfortransactiondatarelatedtoaspecificcardnumberorforacardnumberlinkedtoaspecifictransaction.Thewrittenrequestshallincludethefollowing:9.2.1Cardnumberorthedate,timeandotherknowndetailsaboutthespecifictransactionforwhichacardserialnumberisbeingrequested;9.2.2Astatementastowhytheinformationisgermanetothepreventionoffraud;and9.2.3ThesignatureofthePrimaryContactPerson.IftheLeadAgencydeterminesthatthesubjecttransaction(s)islinkedtoaBusinessCardissuedtotheBusinessAccount,theLeadAgencywillprovidetheBusinessAccountwiththecardserialnumberlinkedtotherequestedtransaction(s).TheBusinessAccountagreesthatitwillusesuchcardserialnumberinformationonlyforpurposesofenforcingitsRulesofUseorotherlawfulbusinesspurposes.TheBusinessAccountmustmaintainitsownrecordsifitwishestoidentifythecardserialnumberissuedtoanindividual.ORCAPassportAgreementPage6of19CityofRentonBAID:2480March1,2015-February29,20166e. - Transportation Systems Division recommends approval of the 2015-2016 Page 82 of 111 10.0PUBLICRECORDSTheBusinessAccountunderstandsandagreesthatallrecordsrelatedtoitsparticipationintheORCASystemarepublicrecordsundertheWashingtonPublicRecordsAct(Chapter42.56RCW)(‘Act”),includingbutnotlimitedto:(a)thisAgreementandthesalesactivityhereunder;(b)theorders,communications,andanyotherinformationprovidedbytheBusinessAccounttotheLeadAgency,theotherAgenciesortheORCASystem,whetherprovidedviathiswebsiteorotherwiseandwhetherprovidedinhardcopyorelectronicform;(c)anycommunications,responses,requests,reportsorinformationofanykindprovidedtotheBusinessAccountfromtheLeadAgency,theotherAgenciesortheORCASystem;and(d)alldata,reportsandinformationofanykindrelatedtotheloadingofproductson,andtheuseof,theBusinessCardsissuedtotheBusinessAccount.Aspublicrecords,theserecordswillbemadeavailableforpublicinspectionandcopyinguponrequest,unlesstheLeadAgencydeterminestheyareexemptfromdisclosure.11.0INDIVIDUALUSEOFBUSINESSCARDAFTERLEAVINGABUSINESSACCOUNTTheBusinessAccountisencouragedtocollectBusinessCardsfromCardholderswhoarenolongereligiblefortheBusinessAccount’stransportationbenefitsprogram.Inanycase,theBusinessAccountissolelyresponsibleforinitiatingaCardBlockorProductBlockinaccordancewiththisAgreementtopreventanycontinueduseof,andfinancialliabilityfor,acardthathadbeendistributedtoapersonwhoisnolongereligible.12.0ORCASERVICESSUBJECTTOCHANGETheAgenciesseektocontinuallyimproveandenhancetheORCAServices.Withthousandsofemployers,schools,andotherentitiesenteringintobusinessaccountagreementsatvaryingdatesintheyear,theAgenciesareunabletoguaranteetoeachbusinessaccountthattheORCAServiceswillnotchangeduringthetermofitsagreement.TheBusinessAccountunderstandsandagreesthatoneormoreORCAServicesmaybechanged,suspendedorterminatedfromtimetotimewithoutpriornoticeto,oragreementby,theBusinessAccount,includingbutnotlimitedtochangesinthelook,feel,contentandfunctionsoftheBusinessAccountWebsite.litheBusinessAccountisdissatisfiedwithachangeintheORCAServices,however,itmayterminatethisAgreementforitsconvenienceinaccordancewiththeprovisionsofSection13.2.13.0TERMINATION13.1TheLeadAgencymayatanytimeterminatethisAgreementiftheBusinessAccountfailstomaketimelyandeffectivepaymentofallamountsdue,orotherwisemateriallybreachestheAgreement,oractsinmannerindicatingthatitintendstonotcomply,orisunabletocomply,withtheAgreement.Toeffectsuchaterminationforcause,theLeadAgencyshallsendemailnoticetothelastknownemailaddressforthelastknownprimarycontactpersonoftheBusinessAccountdescribingthemannerinwhichtheBusinessAccountisindefaultandtheeffectivedateoftermination.Ifthebasisforterminationisafailuretoperformthatcanbecured,theterminationshallnottakeeffectsolongastheBusinessAccountcuresthedefaultwithinten(10)calendardaysofthesendingoftheemailnotice.Upontheeffectivedateofsuchtermination,theLeadAgencymayimmediatelyterminatethewebsiteaccessprivilegesoftheBusinessAccount,blocktheBusinessCardsissuedtotheBusinessAccountanddeclinetoacceptandfulfillanypendingornewordersfromtheBusinessAccount.Intheeventofsuchaterminationforcause,theBusinessAccountshallnotbeentitledtoanyrefundofanyamountspaid.13.2EithertheBusinessAccountortheLeadAgencymayterminatetheAgreementwithoutcauseandforitsownconveniencebysendingtheotherpartywrittenoremailnoticeatleastthirty(30)daysinadvanceoftheeffectivedateofthetermination.UponreceiptofanoticeofterminationforconveniencefromtheBusinessAccount,theLeadAgencymay,initssolediscretion,waivetheadvancenoticeperiodandimmediatelyterminatethewebsiteaccessprivilegesoftheBusinessAccount,initiateaCardBlockontheBusinessCardsissuedtotheBusinessAccount,anddeclinetoacceptandfulfillanypendingornewordersfromtheBusinessAccount.Intheeventofsuchaterminationforconvenienceandnotcause,theamountsdueunderthisAgreementshallbecalculatedbytheLeadAgency.(TheamountsduefortheORCAPassportProductandanyoptionalproductslistedinAttachment1shallbetheannualamountsdueproratedforthenumberofmonthsduringwhichthePassportProductandoptionalproductswereORCAPassportAgreementPage7of19CityofRentonBAID:2480March1,2015-February29,20166e. - South King County Training Consortium Associate Agency Agreement Page 108 of 111 t7LCITYOFRENTON,WASHINGTONORDINANCENO._______ANORDINANCEOFTHECITYOFRENTON,WASHINGTON,AMENDINGSECTION4-1-210,WAIVEDFEES,OFCHAPTER1,ADMINISTRATIONANDENFORCEMENT,OFTITLEIV(DEVELOPMENTREGULATIONS)OFTHERENTONMUNICIPALCODE,BYAMENDINGTHEDEFINITIONOF“AFFORDABLEHOUSING”.WHEREAS,onAugust27,2001,theRentonCityCouncilapprovedOrdinanceNo.4913(codifiedinRMC4-1-210.B)toallowcertaindevelopmentandmitigationfeesforhousingthatisforsaletobewaivedtoencouragenewowner-occupiedhousinginDowntownRenton;andWHEREAS,onFebruary1,2010,theCityCouncilapprovedOrdinanceNo.5524(codifiedinRMC4-1-210.B)toallowcertaindevelopmentandmitigationfeesforhousingthatisforsaletobewaivedtoencouragenewowner-occupiedhousingintheSunsetArea;andWHEREAS,onAugust1,2011,theCityCouncilapprovedOrdinanceNo.5617(codifiedinRMC4-1-210.C)toallowcertaindevelopmentandmitigationfeesforrentalhousingtobewaivedtoencouragenewmulti-familyrentalhousingintheSunsetArea;andWHEREAS,onAugust20,2013,theCityCouncilapprovedOrdinanceNo.5668toextendthesunsetforthesedevelopmentandmitigationfeewaiverstoDecember31,2015,unlessextendedbyCityCouncilaction;andWHEREAS,theprovisionsofSubsection4-1-210.B,Owner-OccupiedHousingIncentive,helpedtoestablishthe37-unit“55Williams”andthe50-unit“ChateaudeVille”condominiumprojectsasnewowner-occupiedhousinginDowntownRenton;andWHEREAS,theprovisionsofSubsection4-1-210.C,RentalHousingIncentive,helpedtoestablishthe8-unitGlennwoodAvenueTownhomesprojectandthe18-unitKirklandAvenueTownhomesprojectintheSunsetAreaasnewmulti-familyrentalhousing;and18a. - Amending RMC 4-1-210.C for “Affordable Housing” definition (1st Page 109 of 111 ORDINANCENO.WHEREAS,theCityseekstoencourageadditionalnewmulti-familyrentalhousingintheSunsetArea;andWHEREAS,theCityseekstoencouragetheuseofthefederallowincomehousingtaxcreditasprovidedforinSection42oftheInternalRevenueCodetohelpfinancenewaffordablemulti-familyrentalhousingintheSunsetAreaandleverageadditionalpublicandprivateinvestmenttostimulatenewcommercialandresidentialdevelopmentintheSunsetArea;andWHEREAS,thefederallowincomehousingtaxcreditsuseadifferentrentstandardthanprovidedforinthedefinitionof“affordablehousing”inSubsection4-1-210.C.2.a,RentalHousingIncentive;andWHEREAS,theCityseekstoamendthedefinitionof“affordablehousing”tohelpleverageadditionalpublicandprivatefundstosupportaffordablemulti-familyrentalhousingdevelopmentintheSunsetAreaand,morespecifically,tofacilitateuseoffederallowincomehousingtaxcreditfinancinginnewmulti-familyrentalhousingdevelopmentintheSunsetArea;NOW,THEREFORE,THECITYCOUNCILOFTHECITYOFRENTON,WASHINGTON,DOESORDAINASFOLLOWS:SECTIONI.Subsection4-1-210.C.2.a,“Affordablehousing”,ofChapter1,AdministrationandEnforcement,ofTitleIV(DevelopmentRegulations)oftheRentonMunicipalCode,isamendedasfollows:a.“Affordablehousing”meansresidentialhousingthatisrentedbyalow-incomehouseholdwhosemonthlyhousingcosts,includingrentandutilitiesotherthantelephone,donotexceedthirtypercent(30%)ofthehousehold’s28a. -
