agreed to defer the off-site improvements on the above plats
for a period of one year on plat No, 1 with improvements to be
- installed within one year or concurrently with •the development ' .
of the first lot within the first of two short plats and that -
• deferral of improvements for short plat #2 be granted for two
years with the exception of the sanitary sewer and waterline, if
the Utilities Division deems it necessary for intersection with ' •
the plat of Highbury Park, subject to the posting of a bond in ,
the amount of $30,500.
Please post the bond with this office as soon as possible and if

REPORT AND RECOMMENDATION .
APPLICANT: Tino Cugini, Short Plat II FILE NO. Short Plat 384-79,

LOCATION: S.W. corner of Index Avenue N.E. and N.E. 4th Street.
SUMMARY OF REQUEST: The applicant requests approval of a four-lot short plat to be
used for future commercial purposes and a waiver of off-site
improvements.
SUMMARY OF ACTION: Planning Department Recommendation: Approval with restrictive
covenants.
Hearing Examiner Decision: Approval of short plat with conditions;
Denial of waiver.
PLANNING DEPARTMENT The.Planning Department preliminary report was received by the
REPORT: Examiner on August 7, 1979.
•
PUBLIC HEARING: After reviewing the Planning Department report, examining
• available information on file with the application; and field
checking the property and surrounding area, the Examiner
conducted a public hearing on the subject as follows:
The hearing was opened on August 14; 1979 at 9:40 a.m. in the Council Chambers of the Renton
Municipal Building.
Parties wishing to testify were affirmed by the Examiner.
It was reported that the Hearing Examiner and the applicant had received and reviewed the
Planning Department report, and the report was entered into the record as Exhibit #1.
Roger Blaylock, Associate Planner, reviewed Exhibit #1, and entered the following additional
exhibits into the record: •
Exhibit #2: Short Plat as submitted
Exhibit #3: Short Plat with staff comments
Mr. Blaylock corrected Section D.6. , Physical Background, of Exhibit #1, noting that the
land is not vacant as stated but tot 2 contains a duplex structure. Responding to the
•
Examiner's inquiry regarding disposition of the structure, Mr, Blaylock indicated that to
his knowledge the building will remain on the site. The Examiner requested Mr. Blaylock
to designate on Exhibit #3 the boundary between B-1 and L-1 zoned property. Mr. Blaylock
denoted on the plat the location of the boundary which is 330 feet from the northern edge
of the site.
The Examiner requested testimony by the applicant. Responding was:

The Examiner asked Mr. Peretti if the duplex will remain on the subject site. Mr. Peretti
advised the applicant's intent to retain the duplex and add a carport to the structure.
The Examiner inquired if the applicant concurred in Exhibit #1. Mr. Peretti indicated
general concurrence; but requested clarification of the requirement for installation of
off-site improvements. The Examiner advised that the Planning Department had recommended
denial of the requested waiver of off-site improvements and had suggested application to
the Board of Public Works for a limited deferral of the requirement for a maximum period
of two years,. He pointed out that a decision to grant Or deny the waiver has not yet been
made by the Examiner, but emphasized that a separate application for deferral would be
required to the Board of Public Works, which may or may not grant the request.
Mr. Peretti stated that a portion of the applicant's property located on .N.E. 3rd Street
had previously; been donated to the City of Renton with a verbal .agreement that sewer. and
water lines would be provided in return. He noted that although water lines had been
extended, sewer .installation had not occurred, and indicated the applicant's concern
regarding the matter.

The Examiner inquired if land use of Lots 3 and 4 would comply with B-1, commercial, or
L-1, light industrial, zoning regulations. Mr. Peretti advised that the applicant had
previously agreed to conform to B-1 zoning regulations to provide conpatibility with ,
existing residential uses surrounding the site.
The Examiner requested testimony in support or opposition to the request. There was no
response. He then requested further comments from the Planning Department. Since there
were no further comments, the hearing on File No. Short Plat 384-79 and W-385-79 was
closed by the Examiner at 9:50 a.m.
FINDINGS, CONCLUSIONS, & DECISION: Having reviewed the record in this matter, the Examiner
now makes and enters the following:
FINDINGS:
1. The request is for approval of a +1.2 acre four-lot short plat to be used for future
commercial purposes together with a waiver of the required off-site improvements.
2. The Planning Department report sets forth the issues, applicable policies and provisions,
' findings of fact, and departmental recommendations in this matter, is uncontested, and
is hereby attached as Exhibit #1 and incorporated in this report by reference as set
forth in full therein.
3. Pursuant to the City of Renton's Environmental Ordinance and the State Environmental
Policy Act of 1971, R.C.W. 43.21.C. , as amended, the subject proposal has been
determined exempt from the threshold determination by Gordon Y. Ericksen, responsible
official.
4. Plans for the proposal have been reviewed by all city departments affected by the
impact of this development.
5. There was no opposition to the proposal expressed.
6. Utilities are available and may be extended and expanded to meet the needs of this
short plat.
7. The proposal is compatible with the required setbacks, lot coverage and height
requirements..of Section 4-711 (B-1, Business) of Title IV, Ordinance No. 1628, Code
of General Ordinances. The applicant has indicated that the property which is also
partially designated as L-1 (light industry) will all be developed with B-1 uses only.
8. The subject property is located at the southwest corner of Index Avenue N.E. and N.E.
4th Street. The site is level and scrub grasses grow on the site. An existing duplex
is to remain on the site. The remainder of the site is vacant.
9. The subject property is comprised of two zone classifications - the northern approximate
330 feet of the property is classified as B-1, the remaining southerly property is L-1.
10. The streets in the area are substandard but are developed to residential standards,.
The sewer main comes to within 500 feet of the subject property. The water mains in
the area are generally developed to an adequate level of service with the except�on
of a three-inch water main along the subject parcel. The Public Works Department
indicated that this main is insufficient for adequate fire flow requirements and
that the applicant would have to install an adequate main.
11. Pursuant to Section 9-1105.6B the applicant has requested a waiver of the required
off-site improvements. The applicant further indicated that the city had agreedito
install adequate water and sewer service when the subject property was annexed into
the city.
12. The area is in transition from generally undeveloped and low intensity land uses to
a mixture of multiple family, commercial and light industrial uses. There are also a
number of single family uses established north of the subject property.
13. The Comprehensive Plan indicates the area in which the subject property is located is
suitable for commercial development.
CONCLUSIONS:
1. The proposed short plat appears to serve the public interest. The division will create
four lots for potential use in commercial ventures. While the roadways are not developed
to commercial standards they do appear capable of carrying the anticipated load.

2. The use of this property for commercial purposes also appears compatible with the
surrounding uses and by conditioning the ultimate use and site plans to scrutiny via
a public hearing the nearby residential properties will not be impacted by detrimental
uses.
3. The proposal is compatible with both the zoning and the Comprehensive Plan. The applicant
has indicated his willingness to restrict use of the subject property to commercial
rather than industrial uses to further lessen the potential impact on the residential
areas nearby.

4. Because of the substandard nature of the water mains in the area it would be •
inappropriate to grant the applicant a waiver of the off-site improvement of the area.
Sewer service must also be extended to the property before it can be used for the
intended uses. It would be more appropriate for the applicant to apply to the Board
of Public Works for a possible deferral of off-site improvements pending development
of the actual lots.
DECISION:
Exhibit #2 is approved subject to approval by the Hearing Examiner of the site plans and
landscaping for the development of Parcels 1 through 4.
The waiver is denied.

An appeal to the City Council is governed by Title IV, Section 3016, which requires that

The subject site was annexed into the City by Ordinance #1549
of June 14, 1956. It was rezoned from "G" to B--1 and L-1 by Ordinance
#2085 dated April 6, 1964.

2. Soils : Arents , Everett material (An) . Permeability is rapid,
and available water capacity is low. Runoff is slow, and the
erosion hazard is slight . This soil is used for urban development .

E. NEIGHBORHOOD CHARACTERISTICS :
The area is in transition from generally undeveloped and low intensity
land uses to a mixture of multiple family, commercial and light '
industrial.
F. PUBLIC SERVICES :
1. Water and Sewer: A 16" water main runs along NE"3r.d Street in
a northeasterly-southwesterly direction and a 3" main runs east-wes
on NE 4th Street to Index Avenue NE. An 8" sanitary sewer
is located on NE 4th Street within 500 feet to the east of
the subject site.

L. PLANNING DEPARTMENT ANALYSIS :
1. The proposed short plat is consistent with the Comprehensive
Plan designation of commercial for the site.
2. The final design of the proposed businesses occupying this site
will determine if they are compatible with the neighborhood
of single family residences and public service facilities.
A careful review of each site plan should be conducted by the
City to assure compatibility of the development with the
adjoining residences.
3. The property is bounded by substandard streets. NE 3rd is
50 feet wide. It should be 56 feet since it is a curve ;
however, expansion of the roadway is limited by the 124 KV
electrical line. NE 4th Street is improved to a residential
standard. There are no curbs or sidewalks on the south side of
NE 4th.
4, A major water line ,(16" ) is located along NE .3rd Street . A 12"
water line will be installed on NE 4th Street in front of
the Highbury Park single family residential development as
required in the approval of the preliminary plat . That will leave
only the segment along the proposed short plats with a substandard
3" water line connected with a 12" in the western boundary
of the short plats and a 16" segment at the intersection of NE
3rd and NE 4th Streets.
5. The applicant has requested a waiver of off-site improvements
because the extent of those improvements and the final designs
had' not been ascertained at the time of the application for the
short plat . The basic off-site improvements will not vary whether
it is a clothing store or restaurant and it is not necessary
to wait to provide the off-site improvements. Those improv ments
should be linked directly to the short plat .
M. DEPARTMENTAL RECOMMENDATIONS ;
The staff recommends that the short plat request be approved
and the waiver request of off-site improvements be denied subject
to the following conditions :
1. Site and landscaping plan approval of each commercial
development by the Hearing Examiner in public hearing to
assure the neighborhood the opportunity to express their
views on the compatibility of the commercial development •
with the single family residential development .
2. Bonding and/or filing of restrictive covenants running with
the land which states that the property owners shall parti-
cipate in an LID for off-site improvements, if a deferral
is granted by the Board of Public Works.
