DECLARATION OF RESTRICTIVE. COVENANTS
WHEREAS, Donald J. Rohrssen is the owner of the following real property in the
City of Renton, County of King, State of Washington, described as follows:
(See Short 'Plat Mylar' for legal description)
WHEREAS, the owner of said described property, hereinafter "the property, " desires
to •impose the following restrictive covenants running with the land as to use, present
and future, of the property;
NOW, THEREFORE, the aforesaid owner hereby establishes, grants and imposes
restrictions and covenants running with the land as to the use of the land hereinabove
described with respect to the use by the undersigned, his successors, heirs and assigns,
as follows:
PRESERVATION OF NATURAL AMENITIES
The existing natural stream on the property shall be protected and retained; and existing
trees shall be retained as much as possible and incorporated into any future development
on the subject site.

DURATION
These covenants ,shall run with the land and expire on December 31, 2025. If at any
time improvements are installed pursuant to these covenants, the portion of the covenants
pertaining to the specific installed improvements as required by the Ordinances of the
City of Renton shall terminate without necessity of further documentation.
These covenants do not limit the owner's status to apply for future major subdivision of
the property within the limits of zoning and use restrictions then in force.
Proper legal procedures in the Superior Court of King County may be instigated by either
the City of Renton or any property owners adjoining subject property who are adversely
affected by any violation or breach of these restrictive covenants. Reasonable attorneys'
fees incurred during an enforcement proceeding will be borne by the parties whom the
court determines are in error and shall be entered as a judgment in such action.

DECLARATION OF RESTRICTIVE COVENANTS
WHEREAS, Roger Lewis, trustee for the estate of Donald J. Rohrssen, is the
owner of the following real property in the City of Renton, County of King, State
of Washington, described as follows:
(See legal description contained in File No. Short Plat 399-79)
WHEREAS, the owner of said described property, hereinafter "the property,"
desires to impose the following restrictive covenants running with the land as
to use, present and future, of the property;
NOW, THEREFORE, the aforesaid owner hereby establishes, grants and imposes
restrictions and covenants running with the land as to the use of the land
hereinabove described with respect to the use by the undersigned, his successors,
heirs and assigns, as follows:
INSTALLATION OF OFF-SITE IMPROVEMENTS
The owner of the above described property, his successors, heirs and assigns,
hereby agrees and covenants to participate in, sign a petition in support of,
and accept any future Local Improvement District (LID) or city initiated
proposal, and pay his fair share therefore, for the purposes of providing the
necessary off-site improvements on Talbot Road South required by the Renton
Subdivision Ordinance. Said improvements shall include but may not be limited
to the installation of curbs, gutters, sidewalks, street paving, sanitary sewers,
storm sewers, undergrounding of utilities, and street lighting.
The owner is also required to independently install off-site improvements if and
when the subject property is further subdivided or developed.
DURATION
These covenants shall run with the land and expire on December 31, 2025. If at
any time improvements are installed pursuant to these covenants, the portion of
the covenants pertaining to the specific installed improvements as required by
the Ordinances of the City of Renton shall terminate without necessity of further
documentation.
Proper legal procedures in the Superior Court of. King County may be instigated
by either the City of Renton or any property owners adjoining subject property
who are adversely affected by any violation or breach of these restrictive
covenants. Reasonable attorneys' fees incurred during an enforcement proceeding
will be borne by the parties whom the court determines are in error and shall be
entered as a judgment in such action.

As you know, the referenced application was final on January 3, 1980,
the expiration date of the appeal period. However, in order to file
the previously approved short plat mylar, restrictive covenants must
be signed and notarized and accompany the mylar when filed with King
County.
We have been notified this week that a sale of one of the lots
contained within the short plat is pending with the county, but in
order to finalize the procedure of the sale, the mylar must be
filed with that jurisdiction.
Upon receipt of the aforementioned restrictive covenants, this
office will expedite and finalize the matter.

2. The Planning Department report sets forth the issues, applicable policies and provisions,
and departmental recommendations in this matter, and is hereby entered as Exhibit #1.
3. Pursuant to the City of Renton's Environmental Ordinance and the State Environmental
Policy Act of 1971, R.C.W. 43,21.C. , as amended, the subject proposal has been
determined exempt from the threshold determination by Gordon Y. Ericksen, responsible
official.

4. Plans for the proposal have been reviewed by all city departments affected by the
impact of this development.
5. There was no opposition to the proposal expressed.
•
6. The subject property is currently zoned "G" (General; Single Family Residence;
minimum lot size 35,000 square feet) .
7. The applicant indicated that no plans exist to further develop the subject property.
Currently the existing residence on Lot No. 1, segregated off from the entire lot
in the short plat, is the only development on the lot.
The subject property, especially Lot No. 2, about eight acres, cannot' be further
divided without the benefit of a regular subdivision for a period of five years.
8. There has been no further change to the subject property since the short plat was
granted.
9. There are no immediate improvements anticipated for Talbot Road in the vicinity of
the subject property.
10. The area' is characterized by large lots ranging in size from one to ten acres.
CONCLUSIONS: •
1. The applicant has generated no further burden on Talbot Road in the vicinity of the
subject property because of the approved short plat.. There are no immediate plans to
further develop the vacant portion of the subject property.
2. The character of the property, except for the legal division of the subject property
into two lots has not changed. The existing residence has not further burdened
Talbot Road and the city has no plans to improve Talbot Road in the vicinity of—the
subject property.
3. The applicant indicated that he would be willing to participate in an LID if one is
organized for this area along Talbot Road and would install off-site improvements
. on Talbot Road if he further developed the subject property.
4. Approval of the requested waiver will not create any detriment to the area in which
the subject property is located.
DECISION:
The waiver request is approved subject to the execution of restrictive covenants to do
the earlier of the following:
1. Participate in an LID for the improvement of Talbot Road South at the time such LID
is organized; or
2. Independently install off-site .improvements when and if the subject property is
. further subdivided or developed.

J. ENVIRONMENTAL ASSESSMENT/THRESHOLD DETERMINATION:
Pursuant to the City of Renton 's Environmental Ordinance and the
State Environmental Policy Act of 1971, as amended, RCW 43-21C, the
subject proposal is exempt from the determination of environmental
significance.

J. PLANNING DEPARTMENT ANALYSIS :
1, The approved short plat , file 399-79 , allowed the subdivision
of ten acres into two lots. The sole purpose of the subdivi-
sion was to allow the sale of the existing house on the front
two acres adjacent to Talbot Road to be sold to the present
renter. The waiver request is based upon the fact that the
improvements would cost more than the money obtained out of
the sale of the residence.
2, Lot #2 of the short plat , consisting of eight acres, is not
planned for development at this point . Until that develop-
ment occurs, there will be no additional impacts resulting
or the site or upon the neighborhood from the filing of the
short plat . Therefore, the development of required improve-
ments on Talbot Road would appear to be actually linked to
the development of Lot #2, Any further subdivision activity
within the next five years would require a full subdivision
on the lot to allow development. Required improvements
could be installed at that time.
3. Development in the neighborhood is residential in character
on mainly large lots, usually of at least one acre in size
with many of the parcels up to ten acres in size. It would I
appear that many other developmental questions concerning
access, sewer and water would have to be answered prior to
development of the area in general. Therefore, growth is
seen at a fairly slow rate in the future. The improvements
of this segment of Talbot Road would not appear to adversely
affect the neighborhood if not constructed at this time.
K. DEPARTMENTAL RECOMMENDATIONS :
Based on the above analysis, it is recommended that the waiver
request , file W-440-79, be approved subject to the filing of
restrictive covenants which require that the street improvements
be installed either by LID prior to development of the property
or concurrently with the property, whichever comes first .

is slow, and the erosion hazard is slight . Stream overflow is
a severe hazard. This soil is used for row crops , pasture, and
hay. Urban land (Ur) is soil that has been modified by disturb-
ance of the natural layers with additions of fill material sev-
eral feet thick to accommodate large industrial and housing
installations. The erosion hazard is slight to moderate. No
capability or woodland classification.

3. Vegetation : The easterly portion of the site (Lot 1) consists
primarily of low scrub grass and lawn with scattered medium
growth trees while the westerly section (lots 2-4) is composed
of numerous tall elms, maples, and poplars with very dense
undergrowth.
4. Wildlife: The existing vegetation provides suitable habitat
for birds and small mammals.
5 . Water: A small pond is located in the yard of the existing
single family residence and a small spring enters the site at
the northeasterly corner on the Talbot Road frontage.
6 . Land Use: An existing single family dwelling is located on
proposed Lot #1 near the Talbot Road frontage.
E. NEIGHBORHOOD CHARACTERISTICS :
The surrounding properties are principally large lot , single family
residential in nature.
F. PUBLIC SERVICES :
1. Water and Sewer: A 20" low pressure watermain runs north-south
on Talbot Road South adjacent to the subject site, and an 8"
sanitary sewer is located on the same road approximately 1000
feet north of the site. A high pressure watermain would have
to be brought in 1000 feet from the north.
2. Fire Protection: Provided by the Renton Fire Department as per
ordinance requirements.
3. Transit : Metro Transit Route #145 operates along S .W. 43rd
Street within 1/2 mile to the north of the subject site.
4. Schools : The subject site is not in close proximity to any
existing schools, and the proposed short plat will not have a
significant effect on existing schools.
5. Recreation : The subject site is within 1* miles to the south
of Talbot Hill Park. In addition, the grounds of Valley General
Hospital (within 1/2 mile to the north) may provide some recrea-
tional opportunities.

D. PHYSICAL, BACKGROUND: ber 6, 1979.
1. Topography: The site slopes downward from east to west at a
rate of approximately 3 to 5 percent .
2. Soils : Alderwood gravelly sandy loam (AgC) . Permeability is
moderately rapid in the surface layer and subsoil and very slow
in the substratum. Runoff is slow to medium and the erosion
hazard is moderate. This soil is used for timber, pasture,
berries, row crops and for urban development . Alderwood
gravelly sandy loam (AgD) , 15-30% slopes. Runoff is medium, '
erosion hazard is severe. This soil is used mostly for timber.
Some parts on lower slopes are used for pasture. Snohomish
silt loam (So) . Permeability is moderate in the upper part of
the, profile and moderately rapid in the lower part. There is

C. HISTORY/BACKGROUND: The subject site was annexed into
the City by Ordinance #3268 dated
December 4, 1978. The present
zoning classification of "G" was
applied at that time. A two-lot
short plat was approved on Septem-
D. PHYSICAL BACKGROUND: ber 6, 1979.
1. Topography: The site slopes downward from east to west at a
rate of approximately 3 to 5 percent .
2. Soils : Alderwood gravelly sandy loam (AgC) . Permeability is
moderately rapid in the surface layer and subsoil and very slow
in the substratum. Runoff is slow to medium and the erosion
hazard is moderate. This soil is used for timber, pasture,
berries, row crops and for urban development. Alderwood
gravelly sandy loam (AgD) , 15-30% slopes. Runoff is medium,
erosion hazard is severe. This soil is used mostly for timber.
Some parts on lower slopes are used for pasture. Snohomish
silt loam (So) . Permeability is moderate in the upper part of
the profile and moderately rapid in the lower part . There is
a seasonal high water table at or near the surface. Runoff

is slow, and the erosion hazard is slight . Stream overflow is
a severe hazard. This soil is used for row crops , pasture, and
hay. Urban land (Ur) is soil that has been modified by disturb-
ance of the natural layers with additions of fill material sev-
eral feet thick to accommodate large industrial and housing
installations. The erosion hazard is slight to moderate. No
capability or woodland classification.
3. Vegetation : The easterly portion of the site (Lot 1) consists
primarily of low scrub grass and lawn with scattered medium
growth trees while the westerly section (lots 2-4) is composed
of numerous tall elms, maples, and poplars with very dense
undergrowth.
4. Wildlife : The existing vegetation provides suitable habitat
for birds and small. mammals.
5. Water: A small pond is located in the yard of the existing
single family residence and a small spring enters the site at
the northeasterly corner on the Talbot Road frontage.
6. Land Use: An existing single family dwelling is located on
proposed Lot #1 near the Talbot Road frontage.
E. NEIGHBORHOOD CHARACTERISTICS:
The surrounding properties are principally large lot , single family
residential in nature.
F. PUBLIC SERVICES :
1. Water and Sewer: A 20" low pressure watermain runs north-south
on Talbot Road South adjacent to the subject site, and '.n 8"
sanitary sewer is located on the same road approximately 1000
feet north of the site. A high pressure watermain would have
to be brought in 1000 feet from the north,
2. Fire Protection: Provided by the Renton Fire Department as per
. ordinance requirements.
3. Transit : Metro Transit Route #145 operates along S .W. 43rd
Street within 1/2 mile to the north of the subject site.
4. Schools: The subject site is not in close proximity to any
existing schools, and the proposed short plat will not have a
significant effect on existing schools.
5. Recreation : The subject site is within 1$ miles to the south
of Talbot Hill Park. In addition, the grounds of Valley General
Hospital (within 1/2 mile to the north) may provide some recrea-
tional opportunities.

J. ENVIRONMENTAL ASSESSMENT/THRESHOLD DETERMINATION:
Pursuant to the City of Renton' s Environmental Ordinance and the
State Environmental Policy Act of 1971, as amended, RCW 43-21C, the
subject proposal is exempt from the determination of environmental
significance.

J. PLANNING DEPARTMENT ANALYSIS :
1. The approved short plat , file 399-79, allowed the subdivision
of ten acres into two lots. The sole purpose of the subdivi-
sion was to allow the sale of the existing house on the front
two acres adjacent to Talbot Road to be sold to the present
renter. The waiver request is based upon the fact that the
improvements would cost more than the money obtained out of
the sale of the residence.
2, Lot #2 of the short plat , consisting of eight acres, is not
planned for development at this point . Until that develop-
ment occurs, there will be no additional impacts resulting
on the site or upon the neighborhood from the filing of the
short plat. Therefore, the development of required improve-
ments on Talbot Road would appear to be actually linked to
the development of Lot #2. Any further subdivision activity
within the next five years would require a full subdivision
on the lot to allow development. Required improvements
could be installed at that time,
3. Development in the neighborhood is residential in character
on mainly large lots, usually of at least one acre in size
with many of the parcels up to ten acres in size. It would
appear that many other developmental questions concerning
access , sewer and water would have to be answered prior to
development of the area in general. Therefore, growth is
seen at a fairly slow rate in the future. The improvements
of this segment of Talbot Road would not appear to adversely
affect the neighborhood if not constructed at this time.
K. DEPARTMENTAL RECOMMENDATIONS :
Based on the above analysis, it is recommended that the waiver
request ,, file W-440-79, be approved subject to the filing of
restrictive covenants which require that the street improvements
be installed either by LID prior to development of the property
or concurrently with the property, whichever comes first ,

Gentlemen:
On behalf of Donald Rohrssen app.licationris hereby made
for waiver of the installation of improvements on Talbot Road
South until the development of Lot 2 occurs.
The primary and present purpose of this short plat
application is to. enable the owner to sell the easterly 1. 8
acres of this ten acre parcel (the portion fronting Talbot
Road South) to the tenant that has occupied the house located
on that 1.8 acre parcel for several years past. Aside from
that legal and hence intangible change, nothing else will
happen for now.
Rohrssen realizes that when Lot 2 of the short plat is
developed, the short plat subdivision itself will be of no
practical value and a major subdivision of that 8 .2 acres with
substantial attendant on-site and off-site improvements will
occur and will have to be financed.
Even for the short plat itself, the tentative off-site
improvements on Talbot Road South are extensive and the.. engineering
department has indicated its estimate of those costs at approximately
$20, 000. 00. '
When the application for short plat was submitted, the tentative'
sale' to the tenant was to be an all cash transaction. The present
state of mortgage financing is such that the cash transaction is

no longer practical and the parties anticipate a real estate
contract; but that real estate contract will generate less than
$8, 000. 00 net cash and would leave Rohrssen in the position of
advancing $12 ,000. 00 in cash to achieve off-site improvements
and that seems to us an unfair result for the following reasons:
1. Installation of improvements along Talbot Road South
may well be premature because some widening and re-establishment
of its grade and location will be almost inevitable as that
area continues to develop and change in character.
2 . There appear to be no recent improvements on Talbot
Road South for a considerable span on either side of the subject
property.
3. The short plat itself will bring no new residents into
the area and it will not increase or change the nature of traffic
on the road. Nothing visible will happen.
The $50. 00 filing fee for a waiver application is enclosed.

Mr. Lewis, Attorney for the applicant, said his client very much needed 'the deferral as there
was a sale pending and if the plat wasn't recorded by October 26th, he would face a breach of
contract. He noted also that no change or improvement of this property is anticipated until
Lot 2, composing the rear 8 acres of this 10 acre parcel is to be developed, client is selling
1.8 acres, the other 8 acres will not be developed as a single lot. Moved by HAVE CLEMENS,

b. Underground Wiring Variance, Richard L. Hart, 1214 N. 32nd St. (Cont'd., from 10/10 Mtg.)
Mr. Clemens noted that he had reviewed the site and it didn't appear to be a major undertaking
to put the wiring underground. Mr. Nelson reported his inspector had looked at the site, the
house was built in 1972, the cable would be on the same side of the street and the cable could
be undergrounded at a minimum fee and shouldn't create too much of a hardship. Mr. Hart said
there was some concern about crossing the neighbor's property, noting it was 55 feet one way
and 75 feet the other way and one way the blacktop would have to be broken. Mr. Clemens said
it appeared the major hardship was economic and it didn't appear to be that substantial.
Moved by DAVE CLEMENS, Seconded by PAUL LUMBERT, .that .the van,i.anee be denied. MOTION CARRIED.
c. Deferral of Off-Site Improvements, Development Coordinators, Inc., Tiffany Park Div. No. 5
Planning Department report noted that Divisions 3 and 4 are currently nearing completion of
thier improvements and inclusion of Division No. 5 will complete the Tiffany Park development.
The applicant's proposal would be consistent with previous divisions in which the applicant
bonded for improvements while providing for recording of the final plat and completing the
improvements at a later time. The report recommended approval of a one-year deferral of improve-

available information on file with the application, and field

conducted a public hearing on the subject as follows:
The hearing was opened on September 4, 1979 at 9:10 a.m. in the Council Chambers of the
Renton Municipal Building..
Parties wishing to testify were affirmed by the Examiner.

It was reported that, the Hearing Examiner and the applicant had received and reviewed the
Planning Department report, and the report was entered into the record as Exhibit #1.

Mr. Lewis concurred in the Planning Department recommendation for modification Of the
requested four-lot short plat to two lots, 'and advised that the remaining seven acre
parcel contained in Lot No. 2 would be replatted at a later date. The Examiner reviewed
restrictions. contained' in the Subdivision Ordinance which preclude further short platting
within five years of subdivision approval. Mr. ,Lewis advised. the applicant's intent to
develop the remaining property in a long plat. '
The Examiner requested testimony in support or opposition to the request. There was no
response. He then requested final comments from the Planning Department. Since there
were no further comments, the hearing regarding• File No. Short Plat 399-79 was closed by
the Examiner at 9:23 a.m. .
FINDINGS, CONCLUSIONS & DECISION: Having reviewed the record in this matter,. the Examiner
now makes and enters the following:
FINDINGS:
,`. 1. The request is for approval of a proposed four-'lot short plat in the' vicinity of
4827 Talbot Road South.
•
2. The Planning Department report sets forth the issues, applicable policies and.provisions,
findings of fact, and departmental recommendations in this matter, is uncontested, and
;;;f • is hereby attached as Exhibit #1 and incorporated in this report by reference as set
'`` forth in full therein. •

3. Pursuant to the City of Renton's Environmental Ordinance and the State Environmental
Policy Act of 1971, R.C.W. 43.21.C. , as amended, the subject proposal has been
determined exempt from the threshold determination by Gordon Y. Ericksen, responsible
'official.
4. .Plans for the proposal have been reviewed by all city departments affected by the
impact of this development.
•
5. 'There was no opposition to the proposal expressed.
6. IA low pressure water main is located along Talbot Road S. adjacent to the subject
'property. An eight-inch sewer is located approximately 1000 feet north of the subject
;property.
7. The proposal is compatible with the required setbacks, lot coverage and height
requirements of Section 4-729 (G, General) of Title IV, Ordinance No. 1628, Code, of
General Ordinances. '
8. The subject property is a sloping (downward from east to west about 3 to 5 percent) ,
+10 acre parcel. A small pond is located on the subject property and empties into a
small stream with a seasonal flow.
9. An existing single family residence is located on the eastern quarter of the subject
site (proposed Lot No. 1) . This lot is covered with lawn grass and scatteredmeldium
size trees. The remainder of the subject site is covered with numerous tall trees
and heavy undergrowth.

10. The applicant, pursuant to Section 9-1105 of the Subdivision Ordinance, had requested
a division of the parcel into four lots.
The Planning Department. in its recommendation had proposed a two-lot short plat instead
because of the extreme length of the utility extensions necessary to service the subject
plat. The applicant concurred in this recommendation and acknowledged that no urther
short platting would be possible for five years. •
11. The amended plan would create an eastern-most lot (Lot No. 1) of. approximately ' 1/2
acres. The existing residence would remain on this lot. The dimensions of the lot
would be;270 feet, deep by 270 feet wide and would front on Talbot Road South. The
other parcel (Lot No. 2) would have 60 feet of frontage on .Talbot Road South and with
the exception of the pipestem frontage would be approximately 1020 feet deep by 330
feet wide.
CONCLUSIONS: •
•
1. The proposed short plat appears to serve the public interest. Lot No. 1 will be more
than twice the minimum lot size required in the 35,000 square foot G 'zone. The
remaining, lot will be about eight acres and the applicant's representative indicated
that a long subdivision is comtemplated for this remaining parcel.
2. The lots will be in keeping with the large lot character of the surrounding development.
The proposal is consistent with the zoning and the Comprehensive Plan which designates
the area for single family residential development.
•
3. The property with the pond and stream provides a rural and open' setting and is suitable
for and provides amenities for residential development. . The stream and trees should
be protected and incorporated into any future development on the subject property.
"Natural features such as rock out-croppings, streams, stands of native trees, and
the views often available from these locations should be used to the greatest
advantage. " (Comprehensive Plan, Land Use Report, City of Renton, 1965)

DECISION: .
• Exhibit #3 is approved subject to the execution of restrictive covenants to maintain the
natural stream and maintain as much as possible of the natural trees and vegetation.

C. HISTORY/BACKGROUND : The subject site was annexed into
the City by Ordinance #3268 dated
December 4, 1978. The present
zoning classification of "G" was
applied at that time.
D. PHYSICAL BACKGROUND :
1. Topography : The site slopes downward from east to west at a
rate of approximately 3 to 5 percent .
2. Soils : Alderwood gravelly sandy loam (AgC) . Permeability is
moderately rapid in the surface layer and subsoil and very slow
in the substratum. Runoff is slow to medium and the erosion
hazard is moderate. This soil is used for timber, pasture,
berries, row crops and for urban development . Alderwood
gravelly sandy loam (AgD) , 15-30% slopes. Runoff is medium,
erosion hazard is severe. This soil is used mostly for timber.
Some parts on lower slopes are used for pasture. Snohomish
silt loam (So) . Permeability is moderate in the upper part of
the profile and moderately rapid in the lower part . There is
a seasonal high water table at or near the surface. Runoff

is slow, and the erosion hazard is slight . Stream overflow is
a severe hazard. This soil is used for row crops, pasture, and
hay. Urban land (Ur) is soil that has been modified by disturb-
ance of the natural layers with additions of fill material sev-
eral feet thick to accommodate large industrial and housing
installations. The erosion hazard is slight to moderate. No .
capability or woodland classification.
3. Vegetation : The easterly portion of the site (Lot 1) consists
primarily of low scrub grass and lawn with scattered medium
growth trees while the westerly section ( lots 2-4) is composed
of numerous tall elms, maples, and poplars with very dense
undergrowth.
4. Wildlife : The existing vegetation provides suitable habitat

5. Water: A small pond is located in the yard of the existing
single family residence and a small spring enters the site at
the northeasterly corner on the Talbot Road frontage.
6. Land Use: An existing single family dwelling is located on
proposed Lot #1 near the Talbot Road frontage.
E. NEIGHBORHOOD CHARACTERISTICS :
The surrounding properties are principally large lot , single family
residential in nature.
F. PUBLIC SERVICES :
1. Water and Sewer: A 20" low pressure watermain runs north-south
on Talbot Road South adjacent to the subject site, and an 8"
sanitary sewer is located on the same road approximately 1000
feet north of the site. A high pressure watermain would have
to be brought in 1000 feet from the north.
2. Fire Protection: Provided by the Renton Fire Department as per
ordinance requirements.
3. Transit : Metro Transit Route #145 operates along S .W. 43rd
Street within 1/2 mile to the north of the subject site.
4. Schools : . The subject site is not in close proximity to any
existing schools , and the proposed short plat will not have a
significant effect on existing schools.
5. Recreation: The subject site is within 14 miles to the south
of Talbot Hill Park. In addition, the grounds of Valley General
Hospital (within 1/2 mile to the north) may provide some recrea-
tional opportunities.

Pursuant to the City of Renton' s Environmental Ordinance and the
State Environmental Policy Act of 1971, as amended, RCW 43-21C, the
subject proposal is exempt from the determination of environmental
significance.

J. PLANNING DEPARTMENT ANALYSIS :
1. The subject proposal is consistent with the existing zoning
and land use designation of single family residential for the
site aid surrounding properties.
2. The Subdivision Ordinance does not reasonably address the ques-
tion of what are necessary improvements in large lot short plats.
The ordinance simply requires full improvement and does not
really consider if they are warranted. This results in either
full development or no development because of the cost .
3. In this particular case, the improvements would consist of a full
width street with sidewalks , curbs , gutters , storm drainage , and
lighting. This is unrealistic to consider of a four-lot short
plat . ' Both water and sewer lines would have to be run approximately
1000 feet to the edge of the property and another 1000 feet through
the plat .
4. The street is over 500 feet in length and would require an
exception to the Subdivision Ordinance.
5. The agent for the applicant had originally stated, when applying,
that the owner wanted to sell the front 21 acres to the present
renter of the house. This can be accomplished by considering
a two-lot short plat , which complies with all short platting
requirements (See attached) .
K. DEPARTMENTAL RECOMMENDATIONS :
The staff recommends that the Hearing Examiner approve the short
plat , File 399-79, as amended by the staff to a two lot short plat ,
if the agent for the applicant agrees.
However , if the applicant does not agree, then the staff recommends
a continuation to process an exception to the Subdivision Ordinance
regarding the length of the cul-de-sac.

rate of approximately 3 to 5 percent .
2 . Soils : Alderwood gravelly sandy loam (AgC) . Permeability is
moderately rapid in the surface layer and subsoil and very slow
in the substratum. Runoff is slow to medium and the erosion
hazard is moderate. This soil is used for timber, pasture,
berries , row crops and for urban development . Alderwood
gravelly sandy loam (AgD) , 15-30% slopes. Runoff is medium,
erosion hazard is severe. This soil is used mostly for timber.
Some parts on lower slopes are used for pasture. Snohomish
silt loam (So) . Permeability is moderate in the upper part of
the profile and moderately rapid in the lower part. There is

is slow, and the erosion hazard is slight . Stream overflow is
a severe hazard. This soil is used for row crops, pasture, and
hay. Urban land (Ur) is soil that has been modified by disturb-
ance of the natural layers with additions of fill material sev-
eral feet thick to accommodate large industrial and housing
installations. The erosion hazard is slight to moderate. No
capability or woodland classification.
3. Vegetation : The easterly portion of the site (Lot 1) consists
primarily of low scrub grass and lawn with scattered medium
growth trees while the westerly section ( lots 2-4) is composed
of numerous tall elms, maples, and/poplars with very dense
undergrowth.
4. Wildlife : The existing vegetation provides suitable habitat
for birds and small mammals.
5. Water: A small pond is located in the yard of the existing
single family residence and a small spring enters the site at
the northeasterly corner on the Talbot Road frontage.
6. Land Use: An existing single family dwelling is located on
proposed Lot #1 near the Talbot Road frontage.
E. NEIGHBORHOOD CHARACTERISTICS :
The surrounding properties are principally large lot , single family
residential in nature.
F. PUBLIC SERVICES :
1. Water and Sewer : A 20" low pressure watermain runs north-south
on Talbot Road South adjacent to the subject site, and an 8"
sanitary sewer is located on the same road approximately 1000
feet north of the site. A high pressure watermain would have
to be brought in 1000 feet from the north.
2. Fire Protection: Provided by the Renton Fire Department as per
ordinance requirements.
3. Transit : Metro Transit Route #145 operates along S.W. 43rd
Street within 1/2 mile to the north of the subject site.
4. School's : The subject site is not in close proximity to any
existing schools, and the proposed short plat will not have a '
significant effect on existing schools.
5. Recreation : The subject site is within In miles to the south
of Talbot Hill Park. In addition , the grounds of Valley General
Hospital (within 1/2 mile to the north) may provide some recrea-
tional opportunities.

J. ENVIRONMENTAL ASSESSMENT/THRESHOLD DETERMINATION:
Pursuant to the City of Renton' s Environmental Ordinance and the
State Environmental Policy Act of 1971, as amended, RCW 43-21C, the
subject proposal- is exempt from the determination of environmental
significance.

J. PLANNING DEPARTMENT ANALYSIS :
1. The subject proposal is consistent with the existing zoning
and land use designation of single family residential for the
site and surrounding properties.
2. The Subdivision Ordinance does not reasonably address the ques-
tion of what are necessary improvements in large lot short plats.
The ordinance simply requires full improvement and does not
really consider if they are warranted. This results in either
full development or no development because of the cost .
3. In this particular case, the improvements would consist of a full
width street with sidewalks , curbs , gutters , storm drainage , and
lighting. This is unrealistic to consider of a four-lot short
plat . Both water and sewer lines would have to be run approximately
1000 feet to the edge of the property and another 1000 feet through
the plat .
4. The street is over 500 feet in length and would require an
exception to the Subdivision Ordinance.
5. The agent for the applicant had originally stated, when applying,
that the owner wanted to sell the front 22 acres to the present
renter of the house . This can be accomplished by considering
a two-lot short plat , which complies with all short platting
requirements (See attached) .
K. DEPARTMENTAL RECOMMENDATIONS :
The staff recommends that the Hearing Examiner approve the short
plat , File 399-79 , as amended by the staff to a two lot short plat ,
if the agent for the applicant agrees.
However, if the applicant does not agree, then the staff recommends
a continuation to process an exception to the Subdivision Ordinance
regarding the length of the cul-de-sac.
