LOCATION: South side of S. 15th Street between Davis Avenue South and
Shattuck Avenue South.
SUMMARY OF REQUEST: Applicant seeks approval of a proposed four-lot short plat and
waiver of .the required off-site improvements. Three existing
residences exist on the area to be divided, and the fourth lot
is to be developed.
SUMMARY OF ACTION: Planning Department Recommendation: Approval with restrictive
covenants.
• Hearing Examiner Decision: Approval with restrictive covenants.
PLANNING DEPARTMENT The Planning Department preliminary report was received by the
REPORT: Examiner on October 12, 1979.
PUBLIC HEARING: After reviewing the Planning Department report, examining
available information on file with the application, and field
checking the property and surrounding area, the. Examiner
• conducted a public hearing on the subject as follows:
• The hearing was opened on October 16, 1979 at 9:30 a.m. in the Council Chambers of the
Renton Municipal Building. • .
Parties wishing to testify were affirmed by the Examiner. •
It was reported that the Hearing Examiner and the applicant had received and reviewed the
' Planning Department report, and the report was entered into the record as Exhibit #1.
David Clemens, Senior Planner, reviewed Exhibit #1, and entered the following additional
exhibits into the record:

• Exhibit #3: Short Plat with staff comments
The Examiner inquired whether dedication for street improvement at a future date should
be required. Mr. Clemens advised that due to existence of required• street width, dedication
is unnecessary. The Examiner inquired regarding conformance to ordinance requirements of
a five-foot side yard setback which exists between the structure and the westerly boundary
of Lot C. Mr. Clemens advised that the setback meets minimum ordinance requirements for.
one-story single family dwellings.
The Examiner asked the applicant if he' concurred in Exhibit #1. Responding was:

• • Mr. Tharp advised his concurrence in the recommendations. Regarding restrictive covenants
_ - recommended to ensure participation in a future LID in the area, he inquired if timing
would be determined by. the City Council. Mr. Clemens advised that either a petition would
be circulated by individual property owners who wish to initiate, an LID which would be
submitted to the.City Council for a determination of appropriateness of the project, or
the City Council could initiate an LID to protect the public health and safety• which would
be considered' and reviewed at a public hearing and finalized by adoption of an ordinance
' requiring participation by residents in the district.
•
The Examiner indicated that approval of the short plat ,would be conditioned upon final
approval by the City .Council of the concurrent rezone request which may take an additional
two to four weeks.. Mr. Tharp requested clarification of timing of• final approval of both
rezone and short plat 'requests. The Examiner explained procedures which allow 14 days
in which the Examiner makes a decision, a 14-day appeal period, and an additional approximate
' 14 days in. which the City Council reviews the matter and adopts final legislation.

The Examiner .requested further testimony in support or opposition, or final comments from
the Planning Department staff. Since there were no further comments, the hearing regarding
File No. Short Plat 414-79 and W-415-79 was closed by the Examiner at 9:45 a.m.
FINDINGS, CONCLUSIONS & DECISION: Having reviewed the record in this matter, the Examiner
now makes and enters the following:
FINDINGS:
1. The .request is for approval of a four-lot short plat of +.8 acres of property together
with a request for a waiver of the installation of the required Off-site improvements.
2. The Planning Department report sets forth the issues, applicable policies and provisions,
findings of fact; and departmental recommendations in this matter, is uncontested, and
is hereby attached as Exhibit #1 and incorporated in this report by reference as set
forth in full therein.
3. Pursuant to the City of Renton's Environmental Ordinance and the State Environmental
Policy Act of 1971, R.C.W. 43.21.C. , as amended, the subject proposal has been determined
exempt from 'the threshold determination by Gordon Y. Ericksen, responsible official.
•
4. Plans for the proposal have been reviewed by all city departments affected by the
impact of this development.
5. There was no opposition to the proposal expressed.
6. All existing utilities are available and in close proximity.
7. The proposal is compatible with the required setbacks except for an existing non-'
conforming yard along Davis Avenue S. , lot coverage and height requirements of Section
• 4-704 (SR-1; Single Family Residence) of Title IV, Ordinance No. 1628, Code of General
Ordinances.
8. The subject property is generally level. The parcel is located on the south side of
• S. 15th Street between Davis Avenue S. and Shattuck Avenue S. , south of I-405 and east
of the Valley Highway.
9. Three single family residences are currently developed on the subject property. Two
of these residences are located on the western portion of the subject property and one
lies on the eastern quarter of the property.
•
10. The applicant proposes subdividing the subject parcels into four separate lots each
being in excess'of the required 7,500 square feet required in the SR-1 zone. A
separate application (File No. R-413-79) for reclassification of the subject property •
is•pending review and ,approval of the City Council and any action on this• proposal
would be contingent on that approval.
•
11. The Comprehensive Plan designates the area in which the subject property is located
as suitable for the development of single family residences. '
12.• The area in which, the subject property is located is predominantly developed with
single family homes. One of the existing residences has a non-conforming yard located
' along Davis •Avenue S. ; twenty feet is required and only 13 feet is provided. The
other existing residences provide conforming yards (predicated on reclassification of
the subject property to SR-1) . The proposed new residence, would be built to conform
• to the minimum zoning requirements of the SR-1 zone.
13. The area currently lacks improved streets, curbs, gutters and sidewalks. It appears
though that residents of the area have provided some of these amenities on an individual
basis. There are some larger lots and further development is expected in the area.
. 14. The applicant has requested a waiver of the required installation of off-site improvements.
CONCLUSIONS:
•
1. The proposed short plat appears to serve the public use and interest. The proposal'
will enable .at a minimum the separate sale of the three existing residences into
individual 'ownerships. It will also enable the construction of an additional residential
unit in, the area without burdening the flow of public services in the area.
•

2. The subdivision will. permit the lots to be divided in a manner which is similar in
character to other lots in the area. .Each of the proposed lots will be larger than the
required 7,500 square foot minimum required in an SR-1 zone. The short plat will
! therefore legally acknowledge the realities of the three existing dwellings, but will
not adversely impact the area in which they are located.
•
3. ' The area will probably see further subdivision of some of the other larger lots.
Some of the homeowners have provided on an individual basis wider streets and curbs
and .the requested outright waiver would be inappropriate. The off-site improvements
should be installed sometime in the future when they become necessary, and therefore, .
covenants calling for the applicant's participation in a future LID should be executed.
DECISION:
Exhibit #2 is approved subject to the approval of the rezone request (File No. R-413-79)
and any further conditions imposed upon that approval by the City Council.
The waiver is approved subject to the execution of restrictive covenants to participate
in a future Local Improvement District to install off-site improvements in the area.

The subject site was annexed into the City by ordinance #1547 dated
May 24 ,' 1956 at which time the present zoning was applied.

1. Topography : The subject site is generally level .
2. Soils : Beausite gravelly sandy loam, 6-15% slopes .(BeC) .
Premeability is moderately rapid, runoff is medium and the erosion
. hazard is moderate. This soil is used for timber and pasture and

L. PLANNING DEPARTMENT ANALYSIS :
1. The subject proposal will be consistent with the proposed
zoning of SR-1 , Single Family Residential , at the time of approval
by the City Council. The short plat proposal is consistent
with the land use designation of single family residential
for the site and surrounding properties.
2 . The proposal exceeds the minimum lot size and dimension
requirements of the Subdivision Ordinance and the SR-1 Zone .
3. T,wo of the three existing residences are conforming with
respect to yard setbacks. The residence on proposed Lot A
isionly 13 feet from the right-of-way for Davis Avenue South.
This is an established non-conforming front yard. The required
front yard in the SR--1 zone is 20 feet .
4. The right-of-way on Shattuck Avenue South is only 36 feet .
However, the additional right-of-way of 24 feet will have to
be acquired to the east to properly align with the centerline
sof, Shattuck Avenue to the north.
5. ;The request for waiver of off-site improvements at first
,glance appears to be a logical request . However, on many
,individual parcels throughout the Talbot Hill area, it appears
individual property owners have widened the street pavement
for parking and pedestrian movement . The area has numerous
,large lots that will probably be divided in the future thus
increasing the need for full street improvements. Presently
' the actual street improvements are minimal and improving
' one small section would seem out of place . Restrictive
covenants should be used to assure a coordinated development
in the future.
M. DEPARTMENTAL RECOMMENDATIONS :
Based upon the above analysis , it is recommended that the Hearing
ExahLiner approve the short plat as proposed. It is further
recommended that the requested waiver of off-site improvements
be denied and that restrictive covenants be filed running with the
land which provide for participation in any future LID for such
street improvements.

2. Soils : Beausite gravelly sandy loam, 6-15% slopes (BeC) .
Premeability is moderately rapid, runoff is medium and the erosion

district and these additions would seem to be out of place

Introduction The State Environmental Policy Act of 1971, Chapter 43.21C, RCW, requires
all state and local governmental agencies to consider environmental values both for their
own actions and when licensing private proposals. The Act also requires that an EIS be
prepared for all major actions significantly affecting the quality of the environment.
The purpose of this checklist is to help the agencies involved determine whether or not a
proposal is such a major action.
Please answer the following questions as completely as you can with the information
presently available to you. Where explanations of your answers are required, or where
you believe an explanation would be helpful to government decision makers, include your
explanation in the space provided., or use additional pages if necessary. You should
include references to any reports or studies of which you are aware and which are rele-
