DURATION
These covenants shall run with the land and expire on
December 31 , 2025 . If .at any time improvements are
installed pursuant to these covenants , the portion of
the covenants pertaining to the specific installed improve-
ments as required by the Ordinances of the City of Renton
shall terminate without necessity of further documentation .
Any violation or breach of these restrictive covenants may be
enforced by proper legal procedures in the Superior Court of King
County by either the City of Renton or any property owners adjoining
subject property who are adversely affected by said breach.

impose the following restrictive covenants running with the land as
to use , present and future , of the above described real property .
NOW , THEREFORE , the aforesaid owner( s ) hereby establish ,
grant and impose restrictions and covenants running with the land
hereinabove described with respect to the use by the undersigned ,
their successors , heirs , and assigns as follows :
INSTALLATION OF OFF-SITE IMPROVEMENTS
The owner( s ) of the above described property , their suc-
cessors , heirs and assigns , hereby agree and covenant to
participate in , sign a petition in support of , and accept
any future Local Improvement District ( LID) or city initia-
ted proposal , and pay their fair share therefore , for the
purposes of providing the necessary off-site improvements
required by the Renton Subdivision Ordinance . Said improve-
ments shall include but may not be limited to the installa-
tion of curbs , gutters , sidewalks , street paving , sanitary
sewers , storm sewers , undergrounding of utilities , and
street lighting .,on Talbot Road South.

REPORT AND RECOMMENDATION .
APPLICANT: Michael E. Baker FILE NO. E-460-79
LOCATION: Vicinity of 2109 Talbot Road South.
SUMMARY OF REQUEST: The applicant has requested an exception from the Subdivision
Ordinance which requires connection to a ,public sewer if
within 1,000 feet of existing lines.
SUMMARY OF ACTION: Planning Department Recommendation: Denial
Hearing Examiner Decision: Denial
PLANNING DEPARTMENT The Planning Department preliminary report was received by
REPORT: the Examiner on January 14, 1980.
PUBLIC HEARING: After reviewing the Planning Department report, examining
available information on file with the application, and field
checking the property and surrounding area, the Examiner
conducted a public hearing on the subject as follows:
The hearing was opened on January 15, 1980 at 9:00 a.m. in the Council Chambers of the
Renton Municipal Building.
Parties wishing to testify were affirmed by the Examiner.
It was reported that the Hearing Examiner and the applicant had received and reviewed
the Planning Department report, and the report was entered into the record as Exhibit #1.
Roger Blaylock, Associate Planner, reviewed Exhibit #1. The Examiner requested the
location of the nearest existing sewer line to the subject property. Utilizing a map
attached to Exhibit #1, Mr. Blaylock designated the location of the existing sewer line
located west of the subject property in Shattuck Avenue S. which is routed in an easterly
direction to Talbot Road S. via S. 160th Street. The Examiner noted that the possibility
exists to extend a sewer line to S. 160th Street along Talbot Road S. from the applicant's
property. Mr. Blaylock also advised the applicant's unsuccessful attempt to initiate
formation of an LID in the area.
The Examiner requested testimony by the applicant. Responding was:

Mr. Baker clarified that although Short Plat ,417-79 had been previously approved by the
Hearing Examiner, conditions had been imposed to require provision of appropriate sewerage
on the site; and therefore, the short plat remains pending.
Referencing Section L.6 of Exhibit #1 regarding inability of the City of Renton to
determine whether public health and welfare would be injured by approval of the exception,
Mr. Baker indicated that the responsibility for such determination belongs to King County
and approval by the city would not diminish King County's authority in the matter.
Referencing Section L.7 regarding the feasibility of obtaining access by contacting
additional property owners in the area, Mr. Baker advised that extension of sewer lines
to both lots on his property a, distance of at least 200 feet to Shattuck Avenue S. and
required provision of a sewer main would be an impractical measure to serve only two lots.
He noted that another alternative entailing extension of sewer lines in Talbot Road S.
to connect to existing lines to the south would require relocation of water feeder lines
to all properties, and the Utilities Division had deemed the alternative as impractical
to serve only one single family residence.
Referencing Section L.8 of Exhibit #1 regarding irrelevance of cost considerations, Mr.
Baker indicated that requirements of the ordinance were the cause of restriction of
development, not economic hardship. He also advised that all options including
acquisition of easements and formation of an LID have been exhausted, and expressed his
opinion that approval of an exception to allow a septic system would create less impact
on the neighborhood than acquiring an easement from unwilling property owners. He
requested clarification of the statement contained in Section L.9 regarding possible

legal avenues available to the applicant and the City of Renton in solving the problem
of sewerage without granting an exception. Mr. Blaylock advised the possibility for the
city to utilize condemnation power to obtain an easement. Mr. Baker felt that ,less
impact would occur by granting the exception and allowing King County to review the
possibility of a septic system on the site than forcefully obtaining an easement through
a condemnation process.
The Examiner inquired if responses had been received to letters transmitted by the
applicant to abutting property owners requesting a sewer easement. Mr. Baker advised
receipt of one response confirming denial of an easement through property located directly
west of the subject site.
The Examiner requested testimony in support or opposition to the application. There was
no response. He then requested final comments from the Planning Department. Mr. Blaylock
stated that if the Examiner should grant approval of the exception, the Planning
Department would recommend requiring the applicant to connect to a public sewer in Talbot
Road S. if constructed in the future. The Examiner noted that the short plat was
predicated on provision of proper sewerage methods.
The Examiner requested further comments. Since there were none, the hearing regarding
File No. E-460-79 was closed by the Examiner at 9:25 a,m. "L.

FINDINGS, CONCLUSIONS & DECISION: Having reviewed the record in this matter, the Examiner
now makes and enters the following:
FINDINGS:
1. The request is for an exception to the Subdivision Ordinance which requires the
applicant to connect to a public sewer in order to allow the applicant to develop
a septic or other sanitary sewer disposal method.
2. The Planning Department report sets forth the issues, applicable policies and
provisions, and departmental recommendations in this matter, and is entered as
Exhibit #1.
3. Pursuant to the City of Renton's Environmental Ordinance and the State Environmental
Policy Act of 1971, R.C.W. 43.21.C. , as amended, the subject proposal has been
determined exempt from the threshold determination by Gordon Y. Ericksen, responsible
official.
4. Plans for the proposal have been reviewed by all city departments affected by the
impact of this development.
5. The proposal is compatible with the required setbacks, lot coverage and height
requirements of Section 4-704 (SR-1; Single Family Residential; 7500 square foot
minimum lot size) of Title IV, Ordinance No. 1628, Code of General Ordinances.
6. The subject property is located on the west side of Talbot Road S.
7. The site slopes downward from the southeast to the northwest at a slope of
approximately 5-6%.
8. The area is developed principally with single family residences.
9. The subject property was the subject of a previous short plat (Sh. P1. 417-79) . That
short plat was contingent upon providing an adequate sewerage disposal method. Since
that conditional approval, it has been determined that the applicant is within 1,000
feet of a City of Renton sewer main, and therefore, pursuant to Section 9-1108.14.A,
the applicant must hook up to that sewer.
10. The applicant has proposed that the subject property be served by a method other
than a sanitary sewer and has therefore requested an exception from Section 9-1108.14.A.
pursuant to Section 9-1109 (exception requirements) .
11. No similar exception' to the sewer hookup requirements has been granted.
12. The applicant has attempted to procure sewer easements to Shattuck Avenue S. through
neighboring lots. The applicant indicated that these attempts have not been
successful.

CONCLUSIONS:
1. The City of Renton has adopted the sanitary sewer requirements in order to provide
a uniform and safe method for the disposal of sanitary wastes. The policy requires
all those who are within a specified distance from a public sewer to hook up to that
sewer. In this instance the required distance is 1,000 feet or less.
The applicant is within the zone which requires mandatory hookup. To permit the
applicant to avoid this requirement would set a precedent which could lead to the
granting of other exceptions from a requirement which strongly relates to the
public health, safety and welfare. This would not be a wise precedent to set and
would lead to a violation of city policy.
2. The applicant does have alternatives which would permit a hookup although the
expense of these alternatives may indeed be prohibitive. While the applicant has
failed to gather enough support for an LID along Talbot Road S. the applicant can
provide his own sewer line. This alternative has been used by other property
owners to provide sewer service to lots they desire to develop.
3. The applicant has failed to demonstrate that the requested exception is justified
in light of the record and to grant such an exception would permit the establishment
of a new precedent to avoid sewer hookups which city policy has mandated. It could
also lead to collusion between neighboring property owners to avoid the impact of
the requirement.
4. The applicant is not being denied rights enjoyed by others with similarly situated
property. As indicated above, other development has occurred in the city and those
property owners have extended sewers to their property at their own expense. Those
homes which are presently on a septic system predate the amended Subdivision
Ordinance and have been required to hook up when further development has been
proposed on their respective properties.
DECISION:
Denial.

Pursuant to Title IV, Section 3015 of the City's Code, request for reconsideration must

the decision of the Examiner is based on erroneous procedure, errors of law or fact,
error in judgment, or the discovery of new evidence which could not be reasonably
available at the prior hearing may make a written request for review by the Examiner
within fourteen (14) days from the date of the Examiner's decision. This request shall
set forth the specific errors relied upon by such appellant, and the Examiner may, after
review of the record, take further action as he deems proper.
An appeal to the City Council is governed by Title IV, Section 3016, which requires that
such appeal be filed with the City Clerk accompanying a filing fee of $25.00 and meeting
other specified requirements. Copies of this ordinance are available for inspection in
the Finance Department, first floor of City Hall, or same may be purchased at cost in
said department.

1 . Tonography : The subject site slopes downward from southeast-
northwest at approximately a 5-6% slope.
2 . Soils : Beausite gravelly sandy loam, 6-15% slopes (BeC) .
Permeability is moderately rapid, runoff is medium and the erosion
hazard is moderate. This soil is used for timber, pasture and for
urban development .

J. ENVIRONMENTAL ASSESSMENT/THRESHOLD DETERMINATION:
Pursuant to the City of Renton' s Environmental Ordinance and the
State Environmental Policy Act of 1971 as amended, RCVV 43,T21C,
the subject proposal is exempt from the determination of environmental
significance.
K. AGENCIES/DEPARTMENTS CONTACTED:

L. PLANNING DEPARTMENT ANALYSIS:
1. The applicant has requested an exception from the Subdivision
Ordinance, which requires him to connect to a public sewer,
if he is within 1,000 feet of the public sewer. This section
of the Code was designed to create a homogeneous pattern of
sewer service and not allow the little islands of septic tanks
within the city limits.. King County cannot grant a septic
tank unless the City of Renton releases the applicant from his
commitment to connect .
2 . The applicant has submitted a map and three letters to three
adjacent property owners requesting a sewer easement to connect
to the sewer line in Shattuck Avenue. Please note there are
no responses from these three individuals at this time. Mr.
Baker has also attempted to form an LID to improve sewer service
along Talbot Road (reference Mr. Gonnason' s letter of December
11, 1979 , which suggests that the applicant request an excep-
tion to the Subdivision Ordinance or pursue the easement to
the west) .
3. It would appear that the applicant has attempted several means
of providing public sewer to his property. At this point ,
none of them have been successful. Therefore, the third
proposal of constructing an on-site septic tank drainage system
would be the only logical alternative.
4. The actual physical circumstances of the applicant not being
able to obtain an easement , and the fact that the area property
owners are not interested in forming an LID, are circumstances
beyond the applicant ' s control which deprive the applicant of
reasonable use of the property under the existing zoning.
5. The other property owners along Shattuck have developed their
property because of the availability of sewer. Those same
property owners appear to be depriving the applicant of the
right to develop his property.
6. The determination of whether the public welfare or other property
in the vicinity will be injured by the granting of the exception
cannot really be determined from a public health standpoint by
the City of Renton. Even if the City were to grant the exception ,
it is totally possible that the King County Health Department
would deny the request for a septic tank disposal system.
The policy of allowing the exception is detrimental overall to
the public welfare in that it encourages the individual to use
a sewage disposal system which could pollute neighboring wells.
7. The applicant has attempted to contact three property owners .
It would appear that there is still another adjacent property
owner, or combination of property owners, to the southwest that
could give him access to the sewer. This alternative does not
appear to be exhausted.

8... In total retrospect , the question of cost cannot be considered.
If the applicant were to pay more than the actual cost of the
lot in providing services, it would still be irrelevant to the
questin of whether the exception could be granted. Economics
should not enter into the analysis of whether the applicant
7. can make reasonable use of the site.
9. It would appear that there are possibly legal avenues open
to both the applicant and the City of Renton to solve the
problem without granting an exception. The applicant does
apparently have some rights of condemnation on other properties
adjacent to him to allow public services. If the applicant
does not wish to follow this route, possibly the City could
to obtain the necessary easement. Therefore, it would appear
that the applicant has not exhausted all other legal and logical
alternatives to the problem.
M. DEPARTMENTAL RECOMMENDATIONS :
Based upon the above analysis, it is recommended that the Hearing
Examiner deny the exception requested from connecting to a public
sewer, file E-460-79 , based upon the fact that there are other
legal remedies which would not compromise a major City policy.

Dear Mr. Baker:
It has come to my attention that in order for a building permit to be issued
for the development of any lot in the City of Renton that a method for
disposing of human wastes must be available to the property. Either of two
methods may be used for disposal. One method is by hooking up to an
established and approved sewer system, and the other method may be a septic
system or other system approved by the Seattle-King County Health Department.
In order to permit the platting of a parcel into separate lots which may
then be made available for sale, the applicant for such plat should provide
information that one of these approved methods of sewerage is available to
the proposed lots. Therefore, as an additional condition of approval and
before final filing of the plat with King County, you must indicate that an
approved method of sewerage is available for Lots No. 1 and 2.
The decision is therefore changed to read as follows:
DECISION:
Exhibit #3 is approved subject to the dedication of five feet of frontage
along Talbot Road South to the City of Renton, approval of the rezone (File
No. R-416-79) , and approval by the Seattle-King County Health Department of
a method of sewerage disposal for Lots No. 1 and 2.
The Exception of the pipestem is approved.
The Waiver for the installation of the required off-site improvements is
approved subject to the execution of restrictive covenants to participate
in an LID for the improvement of Talbot Road South.
A new appeal period will be activated as a result of this revision to
expire on November 16, 1979.

Mr. Baker indicated concurrence .i.n the report with the exception.,of a requirement' to secure
an easement from the adjacent property on the west for the purpose of sewer extension. He
' advised that previous attempts to obtain the easement had failed, and residential response
to a Petition circulated by Mr. Baker for participation in a Local Improvement District had
not been favorable. Mr. Clemens indicated the intent of the recommendation to ensure
provision either in Talbot Road South or to an existing facility in Shattuck Avenue South
of sanitary sewers upon development, . and advised that the Planning Department would assist
the applicant in resolving the matter with the Engineering Division. The Examiner noted
that provision of sanitary sewers is a requirement .o.f the King County Health. Department,
and if such provision cannot be made, the short plat would ultimately be denied.
The Examiner inquired if the applicant concurred in' the recommendation for dedication of
property along Talbot Road South for the purpose of future widening-of the roadway. Mr.
Baker indicated concurrence. •

L. The request. is for approval of a Lwo--lot short: plat: on +.65 acres together with an
exception for a pipestein lot and a waiver at the required off-site improvements.
2. The. Planning Department report sets forth the issues, applicable policies and provisions,
findings of fact, and departmental recommendations in this.matter, and is hereby
attached as Exlii.bi.t #Il and incorporated in this report by reference as set forth in
full therein.
3. Pursuant to the City of Renton's Environmental Ordinance and the State Environmental
Policy Act of 1971, R.C.W. 43.21.C. , as amended, the subject proposal has been determined
exempt from the threshold determination by Gordon Y. Ericksen, responsible official.
•
4. Plans for the proposal have been reviewed by all city departments affected by the
impact of this development.
•
5. Adequate water service is available along Talbot Road S. and will be further upgraded •
in the immediate future. A sewer main is 120 feet to the west along Shattuck Avenue S.
The applicant has been unable to procure an easement to bring sewer service to the
subject property.
•
6. The proposal is compatible with the required .setbacks, lot coverage and height
requirements of Section 4-704 (SR-1, Single Family Residential) of Title IV, Ordinance
No. 1628, Code of General Ordinances with the exception that. a garage is set back
from Talbot Road S. ' only 17 feet whereas 20 feet is required.
7. An existing single family home is located on proposed Lot 1 which fronts on Talbot
Road S. The non-conforming garage is located on this lot. The lot proposed to be
Lot 2 would require a pipestem extension for access to Talbot Road S.
8. The proposed short plat would create two lots. Lot 1 would be 12,870 square feet and
Lot 2 would be 15,410 square feet. The required lot size in an SR-1 zone is 7,500
square feet. The applicant has applied for a reclassification of the zoning of the
subject property from the present G (General/Residential) to SR-1 and that reclassification
is pending before the. City Council. This short plat would be contingent upon approval
of the rezone by the City Council.
9. The Comprehensive Plan for the area in which the subject property is located is
designated for single family development.
10. The area in which the subject property is located is developed primarily with single
family homes. The predominant lot size in the area ranges from about 7,000 to about
9,000 square feet.
11. Talbot Road S. is a neighborhood collector street and should have a 60-foot right-of-way;
it has a 50-foot right-of-way of which 25 feet is located on the subject property's
side of Talbot Road S. The•Planning Department has recommended the dedication of an
'additional five 'feet of roadway by the applicant.
12. Talbot Road S. .currently carries a large volume of traffic and indications are that this
volume will increase in the future.
13. Pursuant to Sections 9-1105.6B and 9-1109, the applicant has applied for a waiver for
the improvement of Talbot Road S. and an exception to allow creation of a pipestem lot
for access onto Talbot Road S.
CONCLUSIONS: •
•
1. The proposed short plat appears to serve the public use and interest. The approval will
permit the applicant to provide an additional lot for future development of an additional
single family home in the area.
2. The proposal permits the creation of lots more in character with the size of lots already
in the area. Many of the lots in the area range in size from 7,000 to 9,000 square feet.
The proposed lots will be •actually 50% larger than the minimum• required in the zone
which is 7,500 square feet in an SR-1 zone (if the rezone is approved to-SR-1) .

3. The proposed interior lot (Lot 2) will require a pipestem extension for access. There
is currently no other feasible method of providing access to the interior lot and the
short plat as discussed above would serve the public interest. Therefore, since the
pipestem is practical and similar exceptions for pipestem access have been granted
in similar circumstances the exception request should be granted.
•
4. The outright approval of the requested waiver for the installation of off-site
improvements would be inappropriate since the area in which the subject property is
. located is beginning to be developed and Talbot Road S. is already heavily used and
further use is anticipated. At the same time, the improvement of this single area
of frontage would be fruitless and the improvement of Talbot. Road S. should be
,accomplished at one time so that the applicant should execute a covenant to participate
•
in a future LID for the area.
5. To bring the .right-of-way of. Talbot Road S. up to the 60 feet required of a neighborhood
collector, the applicant should dedicate five feet of frontage along the east property
line adjoining Talbot Road S. This will enable the road to be improved to carry the
additional traffic this and other development in the area will generate..
DECISION:
Exhibit 43 is approved subject to the dedication of five feet of frontage along Talbot
Road S. to the City of Renton, and approval of the rezone (File No. R-416-79) .

1 . Topography : The subject site slopes downward from southeast-
northwest at approximately d 5-6% slope.
2 . Soils : Beausite gravelly sandy loam, 6-15% slopes (BeC) .
Permeability is moderately rapid, runoff is medium and the erosion
hazard is moderate. This soil is used for timber, pasture and for

J. ENVIRONMENTAL ASSESSMENT/THRESHOLD DETERMINATION:
Pursuant to the City of Renton' s Environmental Ordinance and the
State Environmental Policy Act of 1971 as amended, RCW 43-21C,
the subject proposal is exempt from the determination of environmental
significance.

1 . The proposal is compatible with adjacent single family residential
uses and subdivision patterns in the vicinity.
2. The present size of the property is large enough that the
proposed short plat is a reasonable use of the land. Lot #1 is
approximately 12 , 870 square feet in size while Lot #2 is approxi-
mately 15,410 square feet .
3 . Even though the lots of the proposed short plat exceed the minimum
lot size requirement of the SR-1 zone and the Subdivision Ordinance ,
the amount of frontage on Talbot Road South is insufficient to
meet the 75-foot standard for each lot . The applicant therefore
proposes to establish Lot #2 as a pipestem lot with the required
20-foot minimum width and within the 150 foot maximum length.
4. The establishment of a fully improved and dedicated public
street to the rear lot is not desirable given the general absence
of such improvements in the vicinity and the prevailing large lot
patterns .
5. The Engineering Division advises that a 60' right-of-way is
required for Talbot Road South. Therefore , an additional 5' of
right-of-way is required to be dedicated. 1978 Traffic Counts
indicated daily traffic volumes at 4813 trips per day. Talbot Road
South' serves as a neighborhood collector street serving all areas
adjoining the Valley Freeway. As a neighborhood collector street ,
a minimum 60' right-of-way is required pursuant to 9-1108H-Table 1
(36' curb-to-curb width) .
The applicant proposes a waiver of the street improvement requirement .
Since the vicinity on Talbot Road is not fully improved, a
deferral of improvements to coincide with a larger improvement
project appears warranted, Covenants to insure LID participation
would be appropriate ,
6. Suitable water is available to the subject site. However, the
applicant will have to secure an easement from the adjacent
property on the west to hook up to the nearest sewer lines on Shattuck
Avenue South (approximately 150 feet westward. )
7. The Fire Department notes that water mains and hydrants will be
required. These are to be installed and operable prior to any
building construction and per water engineering requirements .

C. HISTORY/BACKGROUND:
The subject site was annexed into the City by Ordinance #3316 of
May 23, 2_979, at which time the present zoning classification was applied.
D. PHYS I CAS' BACKGROUND:
1 . Topography: The subject site slopes downward from southeast-
northwest at approximately a 5-6% slope .
2 . Soils : Beausite gravelly sandy loam, 6-15% slopes (BeC) .
Permeability is moderately rapid, runoff is medium and the erosion
hazard is moderate . This soil is used for timber, pasture and for
urban development .

3. Vegetation: Lawn grass is the dominant feature with scattered
medium to mature growth deciduous trees located along the Talbot
Road frontage. Some fruit trees are found in the southerly and
westerly portions of the property.
4. Wildlife : The existing vegetation on the .subject site provides
suitable habitat for birds and small mammals .
5. Water : No' surface water was observed on the subject site .
6. Land Use : An existing single family residence is located in
the' easterly portion of the property. Single family residences
are also situated adjacent to the site in all directions.
E'. NEIGHBORHOOD CHARACTERISTICS :
The surrounding properties are principally single family residential
in nature .
F. PUBLIC SERVICES :
1 . Water and Sewer : A 4" water main runs north-south on Talbot Road
South adjacent to the subject site and the nearest sewer is an 8"
main approximately 120' to the west on Shattuck Avenue' So. The
water main in Talbot Road South is scheduled for improvement in the
immediate future .
2 . Fire Protection : Provided by the Renton Fire Department as per
ordinance requirements .
3 . Transit ; Metro Transit route #155 operates along Talbot Road
South' adjacent to the subject site.
4. Schools : Talbot Hill Elementary School is within 500' to the south-
east of the subject site while Fred Nelson Junior High School
is approximately one mile to the east and Renton Senior High
School ' is within 1 3/4 miles to the north.
5. Recreation : Talbot Hill Park is located adjacent to the Talbot
Hill Elementary School .

Pursuant t.) the City of Renton' s Environmental Ordinance and the
State Environmental Policy Act of 1971 as amended, RCW 43-21C,
the subject proposal is exempt from the determination of environmental
significance.

1 . The proposal is compatible with adjacent single family residential
uses and subdivision patterns in the vicinity.
2. The present size of the property is large enough that the
proposed short plat is a reasonable use of the land. Lot #1 is
approximately 12 ,870 square feet in size while Lot #2 is approxi-
mately 15,410 square feet .
3. Even though the lots of the proposed short plat exceed the minimum
lot size requirement of the SR-1 zone and the Subdivision Ordinance ,
the amount of frontage on Talbot Road South is insufficient to
meet' the 75-foot standard for each lot . The applicant therefore
proposes to establish Lot #2 as a pipestem lot with the required
20-foot minimum width and within the 150 foot maximum length.
4. The establishment of a fully improved and dedicated public
street to the rear lot is not desirable given the general absence
of such improvements i'n the vicinity and the prevailing large lot
patterns.
5. The' Engineering Division advises that a 60' right-of-way is
required for Talbot Road South. Therefore , an additional 5 ' of
right-of-way is required to be dedicated. 1978 Traffic Counts
indicated daily traffic volumes at 4813 trips per day. Talbot Road
South serves as a neighborhood collector street serving all areas
adjoining the Valley Freeway. As a neighborhood collector street ,
a minimum 60' right-of-way is required pursuant to 9-1108H-Table 1
(36'1 curb-to-curb width) .
Thel applicant proposes a waiver of the street improvement requirement .
Since the vicinity on Talbot Road is not fully improved, a
deferral of improvements to coincide with a larger improvement
prq�j,ect appears warranted. Covenants to insure LID participation
would be appropriate .
6. Sui,table water is available to the subject site . However, the
applicant will have to secure an easement from the adjacent
property on the west to hook up to the nearest sewer lines on Shattuck
Avenue South (approximately 150 feet westward. )
7. The: Fire Department notes that water mains and hydrants will be
required. These are to be installed and operable prior to any
building construction and per water engineering requirements.

Based upon the above analysis , recommend approval of the short plat
and proposed exception for the pipestem lot , subject to the following
conditions :
1 . Final Engineering Division approval of the 30-foot right-of-way
required as per #6.
2. Final Public Works Department approval of easement for the
sewer connection as per #6.

Recommend deferral of off-site improvements on Talbot Road South subject to
filing of restrictive covenants running with the land which provide for

Dear Sirs;
As property owners of the proposed short plat, we request an
exception to the City of Renton Ordinance covering the minimum
lot width adjacent to the service road.
Our lot is approximately 256 feet deep by 125 feet wide.
Considering the location of the existing dwelling and the high
depth to width ratio, the lot must be divided into front and
back sections. The back lot will be served by a 20 feet wide
access road. This width is less than the required minimum and
therefore requires an exception.
This is the only resonable way to short plat this lot.
This approach is very common and no doubt will be used again as
this newly incorporated area reduces their lot sizes to more
conventional dimensions.
