are the owners of the following real property in the City of Renton ,

3 County of King, State of Washington , described as Exhibit 'A'
attached hereto.
WHEREAS , the owner(s) of said described property desire to
impose the following restrictive covenants running with the land as
to use, present and future, of the above described real property.
NOW, THEREFORE, the aforesaid owner(s) hereby establish,
grant and impose restrictions and covenants running with the land
hereinabove described with respect to the use by the undersigned,
their successors , heirs , and assigns as follows:
INSTALLATION OF OFF-SITE IMPROVEMENTS
The owner(s) of the above described property, their suc-
cessors , heirs and assigns , hereby agree and covenant to
participate in , sign a petition in support of, and accept
any future Local Improvement District (LID) or city initia-
ted proposal , and pay their fair share therefore, for the
purposes of providing th'e necessary off-site improvements
required .by the Renton Subdivision Ordinance. Said improve-
ments shall include but may not be limited to the installa-
tion of curbs , gutters , sidewalks , street paving, sanitary
sewers , storm sewers , undergrounding of utilities , and
street lighting.
These covenants are imposed in lieu of Section 9-1105(6)
of Title IX of Ordinance #1628 of the City of Renton .

DURATION
These covenants shall run with the land and expire on
• December 31, 2025. If at any time improvements are
installed pursuant to these covenants , the portion of

ments as required by the Ordinances of the City of Renton

shall terminate without necessity of further documentation.
Any violation or breach of these restrictive covenants may be
enforced by proper legal procedures in the Superior Court of King.
County by either the City of Renton or any property owners adjoining
• subject property. who are adversely' affected by said breach.

MINUTES
1. CALL TO ORDER - The meeting was called to order by Chairman Gonnason at 9:00 a.m.
2. APPROVAL OF MINUTES - Paul Lumbert noted correction to minutes of October 24, 1979 as
follows: 5.a. Correct to read "28 feet of roadway plus 6 feet of sidewalk, 34 feet from
existing centerline" and correct the motion to read'Public Works and Planning to make the
determination". Moved by PAUL LUMBERT, seconded by JOHN WESLEY, to approve the m.inute4 as
cavtected. MOTION CARRIED.
3. CORRESPONDENCE - None
4, REFERRALS FROM CITY COUNCIL:
a. Street Vacation Petition, Citizens Federal Savings & Loan Association, (VAC-18-79) -
This item is postponed until meeting of November 7, 1979.
5. REFERRALS FROM DEPARTMENTS
a. Deferral of Improvements, Pacific Northwest Bell, Parking Lot at 3408 N.E. 4th St. -
Mr. Nelson commented that the Building Division had the plans that were submitted to the City
for the parking lot, drainage and landscaping and they are under review by the various depart-
ments and division. These plans are for the improvements that were deferred by the Board a
year ago. Mr. Andvik, Pacific NW Bell, said that Ordinance 3214 requires improvement of the
dedicated city street back to NE 4th St. as well as the improvements to the parking lot.
He noted also that the street runs a little to the north of the parking lot and also goes to
a home, cabinet shop and several other businesses. Mr. Gonnason noted that the previous bond,
which was filed after the Board deferral of a year ago, covered two things, the off-site
improvements and the gravelling of the parking lot so that would again come up for considera-
• tion for the permanent improvements the telephone company was now planning. Mr. Andvik noted
the company had now leased the land for a five-year period and propose to stay at the site
and will improve the parking lot. Mr. Clemens commented that the Planning Department felt
that since the company was in the process of permanent improvements that the Board should
consider a deferral for the period of the construction time frame, but the deferral should
be reduced to ninety days or six months until the construction is complete. Mr. Houghton
noted the parking lot is used by the telephone company employees and they have to go down
N.E. 4th St. It would be a 28' street section with 6' for sidewalk, he noted also that

reported the applicant is requesting deferral of off-site improvements including street and
sidewalk in conjunction with the application for a short plat. At the present time street
plans are being prepared for improvement of Puget Drive South. However, there appears to Le
a need in the area at the present timeas the result of the general development of the area.
This is a critical intersection and should not be delayed beyond the approval of the final
design plans by the Public Works Department. The report recommended that a deferral with a

PUBLIC HEARING: After reviewing,the Planning Department report, examining
available information on file with the application, and field
checking the property and surrounding area, the Examiner
conducted a public hearing on the subject as follows:
The hearing was opened on October 23, 1979 at 10:00 a.m. in the Council Chambers of the
Renton Municipal Building.
Parties wishing to_ testify were affirmed by the Examiner.
It was reported that the Hearing Examiner and the applicants had received and reviewed
the Planning Department report, and the report was entered into the record as Exhibit #1.
Roger Blaylock, Associate Planner, reviewed Exhibit #1, and entered the following additional
exhibits into the record: •

necessity of a short plat application in view of information regarding separation of
legal descriptions of Lots No. 1 and 2 upon sale of Thunder Hills Apartments in 1969
prior to adoption of the city'•s Subdivision Ordinance. Mr. Blaylock advised that both
' lots were' included in a larger portion of property created in 1965, and had not been
legally subdivided-prior to this date.

for the purpose of the covenants. However, he noted that the previous action did not •
legally establish two separate parcels or provide license to sell the property. Responding
to an inquiry .by Mr. Strawbridge regarding reference .to Section C. , History/Background, of
Exhibit #1, which states that the easterly 275 feet of the subject site was rezoned from
• GS-1 to R-4 by Ordinance •No. 2059 on October 21, 1953, the Examiner advised 'that the date`.
. . is in error and should be revised from 1953 to 1963. Mr. .Strawbridge indicated that due
to misinformation that the two lots had been previously legally subdivided, plans to
proceed with development of Lot NO. 2 had occurred: however, the owner .of Lot No. 1 currently
. has no plans for development and imposition of .conditions, upon the subdivision would be
premature. Regarding_ a 'recommendation by the Planning Department contained in Exhibit #1,
Section M. , for denial of the requested waiver, Mr. Strawbridge indicated the 'applicant's •
willingness -to execute restrictive covenants agreeing to participate in a future LID in •
the area if approval of the request is granted by the Examiner. '

Mr. Farrell,. representing the owner of Lot No. 1, indicated his opinion. that imposition
of Conditions' regarding. dedication and installation of off-site improvements could be
established subsequent to. roadway improvements planned by the City of Renton in- the
vicinity of the intersection of Puget Drive and Benson Road South, and he indicated
willingness to coordinate .all 'plans with the•City of Renton at a later date. Referencing
Section M.2 regarding provision of a 15-foot wide slope easement on the south side of
Lot No. 1, Mr. Farrell indicated that excavation accomplished by developers-of Lot No. 2
would reduce the existing slope ,on Lot No. 1. To clarify a proposal for dual access from
Lot No. 1, Mr. Farrell submitted a.conceptual plan of the proposed access. The plan was
labeled as follows by the Examiner: ,

Mr. Farrell indicated that existing and future traffic congestion at the intersection of
Puget. Drive and Benson 'Road South could be alleviated by conformance to the Plan 'at a
future date upon completiOn of development of the site, , The Examiner advised that
required right-of-way width 'is mandated by the Subdivision Ordinance, and requirements
for dedication and'off-site improvements are imposed upon platting of the property. ' He
noted that improvements can be waived or deferred, but dedication must be required upon . .
-creation of the short plat. The Examiner inquired regarding timing of proposed
development. Mr. Farrell advised, that actual development may not occur for another year
• and one-half to four years. The Examiner advised that if a waiver is denied, the. option
for application for a deferral for a period not to exceed two years is possible through
the Board of Public Works. ' .
' Mr. Farrell inquired regarding the curb to curb -width on Benson Road South. The Examiner
requested testimony by a .representative of the Public Works Department. Responding was: •

Mr. Lumbert advised the existence of curbing only on the west side of Benson Road South
which contains an approximate width of 36 feet. He indicated that dedication of 10 feet
on the westerly side of Lot No. 1 is required due to necessity of aligning the roadway
'on the south leg of the intersection of Puget Drive--and Benson, Road South to provide
smooth traffic flow through the intersection. He noted that requirement of as 15-foot
slope easement is necessary to facilitate an improvement project which is,being,planned
by the city at.the current time, and requires participation in an LID .by the developers •
- 'of .Lot No. 1 to provide Off-,site improvements Mr Farrell inquired if the. 15-foot
' easement.is required Only in the immediate area of the intersection or 'along the entire
southern boundary, of the site. ' Mr. Lumbert advised that plans for widening Puget Drive
' . would encompass the entire southerly .boundary. Mr. Farrell indicated that excavation
on Lot' No "•1:,'may,create matching grades'with' the,project and he inquired regarding, the

possibility .of coordinating access design of the''entryway to Lot No. 1.with the Public

Mr. Manley, owner of Lot No. .2, , indicated willingness of all 'parties involved to reach
' a viable solution to the problems incurred by the requirements of the short plat, and
encouraged a favorable decision by the Hearing Examiner.
The Examiner requested testimony in opposition to the application. .There was no response.
Mr. Strawbridge suggested that if future excavation of the property results in elimination
of the existing slope, requirements for dedication of the slope easement be removed.
The Examiner requested final comments from the Planning Department staff. Mr. Blaylock
advised that due to the uncertainty of development plans for Lot No. 1, minimum 'requirements >
must be established during short plat procedures for the interim period. He stated that
.1 the department would not object to filing of restrictive covenants to ensure participation
in a future LID for off-site improvements, but development of the area in general will •
generate pedestrian traffic and provision of improvements must be addressed at this time.
The Examiner requested ,further testimony. Since there were no further comments, the •
. 'hearing regarding File No. Short Plat 426-79 and W-429-79 was closed by the Examiner at
10:40 a.m. •
' FINDINGS, CONCLUSIONS & DECISION: Having reviewed the record in this matter, the Examiner
now makes and enters the following:
FINDINGS:' •
1. The request is for approval of a •two-lot short plat of +6.03 acres together with a
waiver of the required off-site improvements.
2. The Planning Department report sets forth the issues, applicable policies and provisions,
findings of fact, and departmental recommendations in this matter, and is hereby attached
as Exhibit #1 and incorporated in this report by reference as set forth in full therein.
•
3. Pursuant to the City of Renton's Environmental Ordinance and the State Environmental
Policy Act of 1971, R.C.W.' 43.21.C. , as amended, the subject proposal has been
determined exempt from the threshold determination by Gordon Y. Ericksen, responsible
official.
. 4. Plans for the proposal have been reviewed by all city departments affected by the
impact of this development.
5. There was no opposition to the proposal expressed.
6. All existing utilities are available and in close proximity.
7. The subject property is located on the northeast corner of Puget Drive and its intersection
' with the Benson Road South. The property is vacant although some. clearing has been
done on the property.
8. The subject property is zoned with 'two separate zoning categories and the applicant
proposes
to create separate parcels which would.be concurrent with the zoning. Lot No. 1,
the westernmost lot, is zoned B-1. Lot No. 2, the easterly lot, is zoned R-4, and
plans for its development, 'an apartment complex, have already been submitted.
•
9. The applicants have applied for the short plat in order to validate a previous sale
agreement and permit the construction on Lot No. 2 of. the apartment complex.
10. While the applicant questioned the necessity for the subject short plat, they were
unable to document any prior legal division into the two proposed lots in question.
11. The Comprehensive Plan designation of the area in which the subject property is located
is for both residential and commercial. The zoning is compatible with those
designations and the .proposed use of the two parcels is also consistent with the
• classifications.
•
12. The .subject parcel is located on a steep hillside with a slope gradient of approximately
11.5% from the northwest_ to the southeast. These slopes adjoin both the Benson Road
• South and Puget Drive South. Both the Planning Department and the Public Works
Department recommended that a slope easement be procured along the south side of Lot
No. 1 along: Puget Drive South. •
Benson Road' South, designated a temporary state route; requires .a 90-foot right-of-way.
There is- a proposl',that .10 feet- of right-of-way be dedicated along the west side of
Lot No.. 1 'for .:this' purpose ..'
The record; •inda;cates} that•the proposed uses of this property will add a considerable

number of vehicles to those already'present on both the Benson Road South and Puget
Drive South.
14. The two lots each exceed the minimum lot requirement of their respective 'zones, B-1
and R-4. ' .
15. Restrictive covenants filed .at the time of the rezone of the subject property required
site ,review by the 'Planning Commission; that jurisdiction has been' conferred on the •
. • Hearing Examiner. Site review has been accomplished on proposed Lot. No. 2, the '
residential lots. Site .review is still required for the commercial property. ,
16. The applicants requested a. waiver of the off-site improvement along. both Benson Road '
South and Puget Drive South. ' A deferral has been granted for the apartment complex •
by the Board of Public Works.
CONCLUSIONS: .
• 1. The proposed short plat appears to serve the public use and interest.. The proposal ,
will permit the separate development of the two distinctly zoned portions of the •
subject property and the proposed uses will be in compliance with the Comprehensive
Plan's designations of the area for commercial and residential.
2. Due to the 'steep topography,of the area in general and the parcels themsevles,
accommodation Must be made for adequate roadways and proper alignment, Of those
roadways. :Both the dedication of 10 feet of property to permit the .alignment of
Benson Road and the 'slope easement to protect 'Puget Drive South from the steep .
slopes will' aid in accomplishing these aims. These two, methods will improve the
two major roads and accommodate the increased traffic that the proposals will .
eventually generate.
3. There is already increased usage of the roadway edge along Puget Drive, and this .
' trend will increase with the development of these two parcels. Off-site improvements
' have been.accomplished as properties in the area are developed and the applicant's
request for a waiver of the off-site improvements which are required for this property
• is inappropriate in this area. A deferral of such improvements may be justified for
a limited time'and the- applicants .may seek such deferral from the Board of Public
Works.
4. The rezone of the subject property conditioned development on a site review by the
appropriate agency and this condition remains unsatisfied on proposed Lot No. 1 and
is required when development is proposed,
DECISION:

1. , The dedication of 10-feet of right-of-way along the west side of Lot No.. 1; and
. 2. The creation of a 15-foot slope easement along the south side of, Lot No. 1;

C. HISTORY/BACKGROUND:
The subject site was annexed into the City by Ordinance #1871 of
March 8, 1961. The easterly 275 ' of the subject site was rezoned
from GS-1 to R-4 by Ordinance #2059 of October 21 , 1953, and the
remaining portion was rezoned from R-4 to B-1 by Ordinance #2540
of January 23 , 1970. Parcel #30 (see attached map) was established
on November 30, 1965 while Parcel #40 was created on May 28, 1969.

D. PHYSICAL BACKGROUND: .
1. Topography: The subject site rises from northwest to
southeast at approximately an 11.5% slope .
2. Soils : Alderwood gravelly sandy loam (AgC) . Permeability is
moderately rapid in the surface layer and subsoil and very slow
in' the substratum. Runoff is slow to,medium, and::the erosion
hazard is moderate. This soil is used for timber, pasture ,
berries, row crops and for urban development .
3. Vegetation The .dominant feature is scrub grass as much of
the site has been cleared and graded for future development .
4. Wildlife : The existing vegetation may provide some habitat
for birds and small mammals.
5... Water: No surface water was observed on the subject site .
6. Land Use : The subject site is undeveloped at this time . To
the north and east are existing apartment and condominium uses
while to the south a multiple family project is under construction
adjacent to an existing apartment complex. To the west is a
service station and to the northwest the Elks Club.
E. NEIGHBORHOOD CHARACTERISTICS :
The surrounding properties are principally a combination of
multiple and single family residential .
F. PUBLIC SERVICES :
1 . Water and Sewer : An 8" water main runs north-south on Benson
Road while a 16" main extends east-west on the north side of
Puget Drive and 12" main runs the same direction on the south side
of the street. An 8" sanitary sewer runs north-south on Benson
Road.
2. Fire Protection : Provided by the Renton Fire Department per
ordinance requirements .
3. Transit : Metro Transit Route #145 operates along Benson Road
South adjacent to the subject site .
4. Schools : Spring Glen Elementary School and Fred Nelson
Junior High. School are within 1/4 mile to the south of the subject
site while Lindbergh Senior High School is within 2 miles to the
east'.
5. Recreation : . Phillip Arnold Park is located within one mile to
the north of the subject site and Tiffany Park is approximately
12 miles to the east and Talbot Hill Park is within 1 miles
to the southwest .

Pursuant to the City of Renton' s Environmental Ordinance and the
State Environmental Policy Act of 1971 , as amended, RCW 43-21C,
the subject proposal is exempt from the determination of environmental
significance .

L. PLANNING .DEPARTMENT ANALYSIS :
' 1. The proposed' sh.ort plat is consistent with the Comprehensive
Plan designation of commercial for the site and surrounding
area u
2. The subject proposal is compatible with the multiple family
developments to the north, east and south and the Elks Club
toithe north and service station to the west .
3. Botha of the proposed lots meet or exceed the minimum require-
ments of the Subdivision Ordinance for size and frontage.
4. An Application for a' building permit has been submitted on
proposed Lot 2 to construct an apartment complex of approxi-
mately 100 units. Access to the complex will be via Grant
Avenue South. Access onto Puget Drive South is limited
because of very steep slopes. The Public Works Department
has, required that a 15-foot wide slope easement be provided
along the south line of Lot 1.
5, Benson Highway South is designated as Temporary State Route
515. The Traffic Division advises that 90 feet of right-of-
way is required for the Benson Highway South, Therefore,
an additional ten feet (10 ' ) of right-of-way is required to
be' dedicated. 1978 traffic.,counts indicated daily traffic
volumes of 9 ,27G, trips per day. on Puget Drive South and
15„ 726 trips per day on Benson Highway South. All traffic
impacts associated with the development of the four acres
of commercial property will be directed onto the Benson
Highway South. Over 400 multiple family units' are presently
udder construction, which would access onto Puget Drive South
and focus at the intersection of Benson Highway South and
Puget Drive South.

In addition, the topography of the area requires much of
the/ right-of-way required to be used for slope stablization.
At the present time, the 80 feet of right-of-way on Benson
Highway South is centered 50 feet on the west side of the ,
centerline and 30 feet on the east . Most .of the 50 feet of
right-of-way on the west of the centerline of the existing
paying of three lanes is utilized for slope stabilization.
As a highway, a minimum 80-foot right-of-way is required
pursuant to 9-1108H, Table 1 ( 36 ' curb-to-curb width) .
Therefore, the ten feet ( 10' ) of additional right-of-way •
is necessary to provide the minimum pavement width.
6. The restrictive covenants filed in conjunction with the •
rezoning of the four-acre parcel from R-4 to B-1 in 1969
(R-637-69) requires site plan approval. of the commercial
development by the Planning Commission. This responsibility
was automatically transferred to the Hearing Examiner in '

7, The applicant proposes a waiver of the street improvement
requirements. Plans have been presented for development
of Lot 2. The present use of the intersection by both
motor vehicles and pedestrians suggests immediate construc-
tion of full street improvements.
M. DEPARTMENTAL RECOMMENDATIONS :
Based on the above analysis, it is recommended that the short
plat) 'application, File 429-79 , be approved subject to the
following conditions : '
1. Dedication of 10 feet of right-of-way on the west side of
proposed Lot 1.
2. Pr-o.v.ision for a 15-foot wide slope easement on the south
side .'of Lot. i' '
3. 'Site plan approval by the Hearing Examiner for the B-1
parcel (Lot 1) as per Analysis #6.
It is recommended that the waiver request be denied as per
Analysis #7,

C. HISTORY/BACKGROUND: ; =
The subject site was annexed into the City by Ordinance #1871 of
March 8, 1961. The easterly 275 ' .of .the subject site was rezoned
from GS-1 to R-4 by Ordinance #2059 of October 21 ,. 1953, and the
remaining portion was rezoned from R-4to B-1 by Ordinance #2540
of January 23 , 1970. Parcel #30 .(see, attached map) was established
on November 30, 1965 while Parcel #40 was created on May 28, 1969.

D. PHYSICAL BACKGROUND:
1. Topography: The subject site rises from northwest to
southeast at approximately an 11. 5% slope .
2. Soils : Alderwood gravelly sandy loam (AgC) . Permeability is
moderately rapid in the surface layer and subsoil and very slow
in the substratum. Runoff is slow to.medium, and.:the erosion
hazard is moderate . This soil is used for timber, pasture ,
berries , row crops and for urban development .
3. Vegetation : ';: The..dominant feature is scrub grass as much of
the site has been cleared and graded for future development .
4. Wildlife : The existing vegetation may provide some habitat
for birds and small mammals.

5. water: No surface water was observed on the subject site .
6. Land Use : The subject site is undeveloped at this time . To
the north and east are existing apartment and condominium uses
while to the south a multiple family project is under construction
adjacent to an existing apartment complex. To the west is a
service station and to the northwest the Elks Club.
E. NEIGHBORHOOD CHARACTERISTICS :
The surrounding properties are principally a combination of
multiple and single family residential.
F. PUBLIC SERVICES :
1. Water and Sewer : An 8" water main runs north-south on Benson
Road while a 16" main extends east-west on the north side of
Puget Drive and 12" main runs the same direction on the south side
of the street . An 8" sanitary sewer runs north-south on Benson
Road.
2. Fire Protection : Provided by the Renton Fire Department per
ordinance requirements.
3. Transit : Metro Transit Route #145 operates along Benson Road
South adjacent to the subject site .
4. Schools : Spring Glen Elementary School and Fred Nelson
Junior High. School are within 1/4 mile to the south of the subject
site while Lindbergh Senior High School is within 2 miles to the
east .
5. Recreation : . Phillip Arnold Park is located within one mile to
the north of the subject site and Tiffany Park is approximately
12 miles to the east and Talbot Hill Park is within 1L miles
to the southwest .

J. ENVIRONMENTAL ASSESSMENT/THRESHOLD DETERMINATION :
Pursuant to the City of Renton' s Environmental Ordinance and the
State Environmental Policy Act of 1971 , as amended, RCW 43-21C,
the subject proposal is exempt from the determination of environmental
significance.

L. PLANNING DEPARTMENT ANALYSIS :
1. The proposed short plat is consistent with the Comprehensive
Plan designation of commercial for the site and surrounding
area.
2. The subject proposal is compatible with the multiple family
developments to the north , east and south and the Elks Club
to the north and service station to the west ,
3. Both of the proposed lots meet or exceed the minimum require-
ments of the Subdivision Ordinance for size and frontage.
4. An, application for a building permit has been submitted on
proposed Lot 2 to construct an apartment complex of approxi-
mately 100 units. Access to the complex will be via Grant
Avenue South. Access onto Puget Drive South is limited
because of very steep slopes. The Public Works Department
has , required that a 15-foot wide slope easement be provided
alo�ig the south line of Lot 1.
5. Benson Highway South is designated as Temporary State Route
515. The Traffic Division advises that 90 feet of right-of-
way is required for the Benson Highway South. Therefore,
an ' additional ten feet (10' ) of right-of-way is required to
be dedicated. 1978 traffic counts indicated daily traffic
volumes of 9 ,270 trips per day on Puget Drive South and
15, 726 trips per day on Benson Highway South. All traffic
impacts associated with the development of the four acres
of commercial property will be directed onto the Benson
Highway South, Over 400 multiple family units are presently
under construction, which would access onto Puget Drive South
and focus at the intersection of Benson Highway South and
Puget Drive South.

In addition, the topography of the area requires much of
the/ right-of-way required to be used for slope stablization.
At ,the present time, the 80 feet of right-of-way on Benson
Highway South is centered 50 feet on the west side of the
centerline and 30 feet on the east . Most of the 50 feet of
right-of-way on the west of the centerline of the existing
paving of three lanes is utilized for slope stabilization.
As a highway, a minimum 80-foot right-of-way is required
pursuant to 9-1108H, Table 1 (36' curb-to-curb width) .
Therefore, the ten feet (10' ) of additional right-of-way
is necessary to provide the minimum pavement width.
6 . The restrictive covenants filed in conjunction with the
rezoning of the four-acre parcel from R-4 to B-1 in 1969
(R-637-69) requires site plan approval of the commercial
development by the Planning Commission. This responsibility
ws automatically transferred to the Hearing Examiner in
1977.
7. The applicant proposes a waiver of the street improvement .
requirements. Plans have been presented for development
q'f Lot 2. The present use of the intersection by both
motor vehicles and pedestrian§ suggests immediate construc-
tion of full street improvements.
M. DEPARTMENTAL RECOMMENDATIONS:
Based on the above analysis, it is recommended that the short
plat' 'application, File 429-79, be approved subject to the
following conditions :
1. Dedication of 10 feet of right-of-way on the west side of
proposed Lot 1.
2. Provision for a 15-foot wide slope easement on the south
side of Lot 10
3. Site plan approval by the Hearing Examiner for the B-i
parcel (Lot 1) as per Analysis #6.
It is recommended that the waiver request be denied as per
Analysis #7.

Wirth Short Plat
Dear David:
Pursuant to the provisions of the Renton Subdivision Ordinance,
we hereby request a waiver of improvement installation for
frontage along Lot 1 of the proposed Wirth Short Plat. We
feel that there is reasonable justification for this request
based upon the following:
1. Information provided by the City of Renton suggests
that adequate improvements now exist, with the
exception of sidewalks.
2. Development of Lot 1 is not scheduled to occur
immediately upon approval of the proposed short plat;
sidewalks would more logically be constructed as part
of any future site development.
3. Granting of a waiver in this case would not be detri-
mental to the public welfare or injurious to other
property in the vicinity.
4 . . We, as property owner, would be agreeable to join with
and participate in, a future U.L.I.D. to provide these
REAL ESTATE INVESTMENT AND DEVELOPMENT
