WHEREAS, Ray J. Aliment , a single man ,

County of King, State o•f Washington, described as Exhibit 'A'
attached hereto.
WHEREAS , the owner(s) of said described property desire to
impose the following restrictive covenants running with the land as
to use, present and future, of the above described real property.
NOW, THEREFORE , the aforesaid owner(s) hereby establish,
grant and impose restrictions and covenants running with the land
hereinabove described with respect to the use by the undersigned,
their successors , heirs , and assigns as follows :
INSTALLATION OF OFF-SITE IMPROVEMENTS
The owner(s) of the above described property, their suc-
cessors , heirs and assigns , hereby agree and covenant to
participate in , sign a petition in support of, and accept
any future Local Improvement District (LID) or city initia-
ted proposal , and pay their fair share therefore, for the
purposes of providing the necessary off-site improvements
required by the Renton Subdivision Ordinance. Said improve-
ments shall include but may not be limited to the installa-
tion of curbs , gutters , sidewalks , street paving, sanitary
sewers , storm sewers , undergrounding of utilities , and
street lighting.
These covenants are imposed in lieu of Section 9-1105(6)
of Title IX of Ordinance #1628 of the City of Renton.

• These covenants shall run with the land and expire on

installed pursuant to these covenants, the portion of
the covenants pertaining to the specific installed improve-

REPORT AND RECOMMENDATION,

APPLICANT: Ray Aliment
LOCATION: Vicinity of 2421 Meadow Avenue North
SUMMARY OF REQUEST: The applicant seeks approval of a proposed 2-lot short
plat together 'with an exception for street width and a
waiver of the required off-site improvements.
SUMMARY OF ACTION: Planning Department Recommendation: Approval with conditions.
Hearing Examiner Decision: Approval subject to conditions.
PLANNING DEPARTMENT The Planning Department preliminary report was received by
REPORT: the Examiner on.Apri.l 2, 1980.
PUBLIC HEARING: After reviewing the Planning Department report, examining
available information on file with the application, and
field checking the property and surrounding area, the
Examiner conducted a public hearing on the subject as
follows:
The hearing was opened on April 8, 1980 at 9:00 a.m. in the Council Chambers of the
Renton Municipal Building.
Parties wishing to testify were affirmed by the Examiner.
It was reported that the Hearing Examiner and the applicant had received and reviewed
the Planning Department report. Dave Clemens, Planning Department, reviewed the report
and entered the following exhibits into the record:
Exhibit #1: Application File with Planning Department
report and other pertinent documents
Exhibit #2: Applicant's short plat as submitted
Exhibit #3: Short plat with staff comments
The Examiner confirmed with the Planning Department that it is only recommending at this
time that the property be dedicated but no paving of' streets, installations of gutters
and curbs be done.
The Examiner requested testimony by the applicant or his representative. Responding was:
Wayne Chastain (engineer for applicant)

The Examiner asked if Mr. Chastain concurred with the recommendations of the Planning
Department report. He said he did not.
Mr. Chastain indicated that the right of way recommended by the Planning Department is
more than necessary. He indicated that 24th Avenue, the only access to Garden Ct. N. ,
is now only 30 feet in width. The Shook plat directly south had a waiver of that street
requirement width of 50 feet, he commented. He said the existing paving in the area in
most cases is of thickened edge and that there is 20 feet width of driving area. He
further stated that since there are houses directly to the northeast, Garden Ct. is
effectively a cul-de-sac. He corrected the staff report and indicated a house has been
built .on the Keefer short plat. He said there are no sidewalks, curbs, gutters or other
improvements for several blocks and he questioned the need to do so in a small area
where it is physically impossible to do anything greater. Mr. Chastain pointed out that
only one of the proposed lots will access to Garden Court. One existing house already
goes out on a panhandle lot to Meadow Avenue. He said a 30-foot width would be reasonable
and is consistent with what is now to the south and east of this particular plat. He
testified further that a house on 24th is so close to Meadow that you could never dedicate'

additional right of way and that the existing street is adequate for the amount of
traffic brought about by three houses.
The Examiner asked for additional testimony in support or in opposition to the
application.
Mr. Clemens. commented that the subdivision ordinance is specific in its standards, that
the area was developed according to county regulations which required lesser standards for
rural development that a city plat would require. He stated that minimum standards should
be adhered to if possible and that the 40-foot width recommendation is less than it would
have been if there was a larger area involved. He indicated that the right of way width
in this area is questionable due to the slopes. in the vicinity. He said paved surfaces.
could be narrowed somewhat but that ordinances and policies should 'be adhered to as much
as possible. He claimed that it is the Planning Department's recommendation that other,
streets in the area be improved to that extent if possible. He explained that it is
necessary to have additional right of way width to install overhead lights, etc.
The Examiner requested an extra week to consider these matters because he will be attending
a conference during the next week.. There were no objections to this extension.
Mr. Chastain requested to speak again. In response to the Planning Department's comments,
he noted that Keefer short plat had been approved by the City and their standards were
not adhered to at that time. He asked that the applicant receive consistent treatment.
The Examiner inquired about the date of the Keefer approval. Chastain responded that it
was approved on October 5, 1976.

The Examiner asked for further testimony. There was none. •
The Examiner said his report will be issued within 21 days.
The public hearing regarding File No. Sh. Pl. 017-80, W-018-80, E-025-80 was closed by
the Examiner at 9:25 a.m.
FINDINGS, CONCLUSIONS & DECISION: Having reviewed the record in this matter, the
Examiner now makes and enters the following:
FINDINGS:
1. The request is for approval of a 2-lot short plat on +.36 acres together with an
exception for street width and a waiver of the required off-site improvements.
2. The application file containing the application, SEPA documentation, the Planning
Department report, and other pertinent documents was entered into the record as
Exhibit #1.
3. Pursuant to the City of Renton's Environmental Ordinance and the State Environmental
Policy Act of 1971, R.C.W. 43.21.C. , as amended, the subject'proposal has been
determined exempt from the threshold determination by Gordon Y. Ericksen, responsible
official.
4. Plans for the proposal have been reviewed by all city departments. affected by the
impact of this development.
5. All existing utilities are available and in close proximity.
6. The proposal is compatible with the required setbacks, lot coverage and height require-
ments of Section 4-729 (G-6000; General; Single Family Residential; Minimum lot size
6,000 sq. ft.) of Title IV, Ordinance No. 1628, Code of General Ordinances.
7. The subject property is located in the vicinity of 2421 Meadow Avenue N. The subject
lot is a pipestem lot approximately 16,000 sq. ft. in area.
8. The subject property is developed with a single family residence located on the
eastern portion of the pipestem lot. The remainder of the subject lot is undeveloped
and is covered with lawn grass and some trees and shrubs.

9. The subject lot is a through lot with frontage on Garden Ct. N. as well as the pipe-
stem frontage on Meadow Avenue N. Garden Ct. N. has a right-of-way which varies in
width from about 25 feet to about 42 feet. Garden Ct. N. also is effectively a
320 foot cul-de-sac in that a single family residence is located in what would be its

northerly right-of-way at about 2420 north. It is not a through street south of
N. 24th Street.
10. The applicant proposes subdivision of the subject property into two lots. Each
lot would exceed the minimum 6,000 sq, ft. required by the zoning code.
11. The applicant has requested an exception from Section 9-1108.7(H) of the subdivision
ordinance which requires that the right-of-way for access be at least 50 feet in
width. The applicant proposes a right-of-way width of 30 feet to coincide with the
general width of Garden Ct. N.
The exception has been requested pursuant to Section 9-1109.
12. The Planning Department has recommended that the exception for roadway width be
approved subject to a sufficient dedication to provide a 40 foot right-of-way on
Garden Ct. N.
Garden Ct. is located on a terrace of an otherwise steep hillside and in addition
serves and will serve only limited traffic.
13. Proposed Lot 1 would be the pipestem portion of the subject property containing the
existing residence and it would be approximately 9,500 sq. ft. in area. The lot meets
the requirements of the zoning code.
Proposed Lot 2 will front on Garden Ct. N. and will be approximately 6,500 sq. ft. in
area. It, too, meets the requirements of the zoning code.
14. The subject property is surveyed as 59.75 ft. in width which falls 3 inches short of
the requirements of Section 9-1108.23 '(F) (3) (a) . Such a shortfall is "de minimis,"
that is a trifling, existed on the prior lot and is of no consequence to the case.
15. N. 24th Street is 30 ft. in width. Under the terms of previously approved short
plats along both N. 24th Street and Garden Ct. N. no additional property is available
for dedication to the City for expansion of these two roadways. Previously granted
exceptions and existing developments also preclude widening of these respective road-
ways (Shook Short Plat, File No. Sh. P. 199-78; Keefer Short Plat, File No. 16-75) .
16. The area is developed primarily with single family units. Lot sizes vary from the.,
about 20,000 sq. ft. to the 6,000 sq. ft. required by the zoning code.

17. There are no off-site improvements in the area. The Planning Department has recom-
mended that the requested waiver of the required off-site improvements be granted
subject to restrictive covenants to participate in an LID if one is formed.
CONCLUSIONS: •
1. The proposed subdivision appears to serve the public use and interest. The applicant's
proposal„will create an additional lot and help provide additional housing opportuni-
ties in an established and pleasant residential environment.
2. The proposed lots will meet or exceed the zoning requirements of the zoning district
in which the subject property is located. The lots are in conformance with the
Comprehensive Plan and compatible with its goals of developing and utilizing land
to its highest and best use. (Page 18, Renton Land Use Report, 1965) .
3. The additional residence proposed by the applicant will not tax available city
services and the additional development on Garden Ct. will not create any unreasonable
burden on roads in the area.
4. The exception request to permit development o£ a right-of-way of 30 feet, rather than
the 50 feet required by the subdivision ordinance is justified in light of the existing
development and the established street pattern in the area. Existing development,
previously approved exceptions and dedications all limit both the remainder of Garden
Ct. N. south of the subject property and N. 24th St. to about• 30 feet. Garden Ct. N.
is effectively a cul-de-sac off of N. 24th Street which is limited to a 30 foot
right-of-way. Garden Ct. N. is less than a block long, dead ends in the north at a
single family home built in what would be its northerly right-of-way and ends in the
south at N. 24th Street.
5. It would serve no purpose to require the applicant to develop Garden Ct. N. wider
than N. a4th Street, its exit street. The 30 foot right-of-way will not prove detri
mental to the public welfare, nor will it injure neighboring property. Approval of

the exception will also enable the applicant to develop his property in a manner
similar to the development of other property in the area.
6. The applicant should be required to dedicate sufficient property to the City to
provide for the minimum 30 foot right-of-way on Garden •Ct. N. The 30 foot right-of-
way will continue established roadway widths in the area and will provide for safe
passage of vehicles on the road.
7. There are no apparent off-site improvements in the area and therefore a waiver at
this time is justified and should be approved. In the event such improvements are
indicated by a change in conditions in the area, the applicant should participate in
their installation and therefore should execute restrictive covenants to participate
in the formation of an LID for that purpose.
DECISION:
Exhibit #2 is approved subject to the dedication of sufficient land along the western
property line to provide a 30 foot right-of-way• along Garden Ct. N.
The exception to provide access via a 30 foot right-of-way is approved subject to
improvement of the roadway to City standards approved by the Public Works Department.
The waiver is approved subject to the execution of restrictive covenants to participate
in an LID for the installation of off-site improvements.

lawn grass with some scattered short to medium

3b The pipestem lot was created prior to the enactment
of the Short Subdivision Ordinance in 1971 . In
1976, Doug Weston short platted the parcel to the
east (File No . Short Plat 31-76 ) .
4. The property to the west was short platted in
1975 by Mr . James Keffer (File No . Short Plat 16-75 )
and Garden Court North was constructedby the new
owners which according to the available record
was to standards specified by the Public Works
Dept . because there were no streets with curbs
and sidewalks in the general area . None of the
lots in Keffer ' s Short Plat have been constructed
upon . Garden Court North was constructed as a
half street on a right-of-way varying from 24 feet
to 42 feet in width .
The Public Works Department advises that the right-of-way
should be a minimum of 40 feet in width . The applicant
has applied for an exception to the Subdivision
Ordinance , Section 9-1108-23-A(5 ) that requires
a minimum right-of-way width of 50 feet .

5 . Compliance with the 50 ' street width specified
• in the Subdivision Ordinance would create a non-
conforming lot with respect to rear yard setback
fdr the house on lot #1 and reduce the lot sizes
for both lots below. the 6000 sq . feet minimum of
the zoning district . A 25 foot deep rear yard
is required . The existing single family residence
would be only 18* feet • from the modified property
line .
6 . • If the street width recommended by the Public Works
Department is approved by the Examiner , the useable
portion of the lots #1 and #2 will be reduced in .
total depth by an average of 13± feet . If this
amount is equally divided between each lot they
will average 103 . 5± feet in depth by 59 .75 feet
in width . This provides a total lot area of 6184
square feet conforming to the Subdivision Ordinance .
It would also appear from • the available documents
that the rear yard for the existing house would
be 28* feet . Prior to recording of the short plat,
all of these dimensions should be verified by surveys .
7 . The applicant has requested a waiver of the improve-
ment requirements for the short plat . Approval
and recording of this subdivision along with the
adjoining subdivision for Mr . Jack Ring will leave
only 130 ' of the street right-of-way to be improved .
• The Public Works Department recommends approval
of the waiver' subject to restrictive covenants
providing for future installation of the street
improvements .
8 . As noted previously , the improvements on Garden
Court North are less than the normal subdivision
standards . Using the 40 ' street width recommendation,
a 121/2 foot travel lane plus curb and sidewalk would
require approximately 18 feet in width (within
the 20 foot half street) . It is recommended that
the improvements for the street consist of a 122
foot travel lane street section , curb , gutter ,
sidewalk , undergrounding storm drainage , street
lighting and other normally required subdivision
improvements .
M . DEPARTMENTAL RECOMMENDATIONS:

Based upon the foregoing analysis , it is recommended
that the Aliment Short Plat , File No , 017-80 be approved
subject to the following conditions :
1 . . Dedication of an area at the westerly extreme of
the property providing for a 40 ' street right-of-way
width .
2 . Revision of lots 1 and 2 to conform to the right-of-way
width dedication, and minimum 6000 sq . foot lot
area .
3. Confirmation that the new property line between
lots 1 and 2 will not encroach into the required
rear yard of the existing residence on lot 1 . '
4. Prior to recording , the short plat items 1-3 above
shall be confirmed by survey to the satisfaction
of the Planning Department .

Gentlemen:
We are requesting the approval of a two lot short plat with
an exception for street width on Garden Court North. Please
see City of Renton Subdivision Ordinance, Section 9-1109:
Exceptions.
Garden Court North is a 321.26 ft. long cul-de-sac with no
additional potential access and varies in width from 42.67 ft.
to 25.00 ft. It was platted and approved as a half-street in
the L. James Keifer short plat on October 5, 1976.
It has been determined that it would not be feasible to provide
additional right-of-way to Garden Court North since lot two
would not conform to the G-6000 zoning and the back yard from an
existing house in lot one would be reduced to less than the 25.00
ft. requirement. Both of these conditions would place and undue
hardship on the owner . It would force him to eliminate an income
producing lot and also could nullify the short plat since he does
not own any adjacent property.
The Aliment property has legal access to Garden Court North and
short platting would not increase the access requirement.
This exception is necessary to insure that our client's property
will retain the same rights and privileges enjoyed by other
properties adjacent to the easterly right-of-way of Garden Court
North.
We believe granting our client this street width exception would
not be detrimental to the public welfare or injurious to other
property in the vicinity.

RE : MEMORANDUM OF MARCH 6, 1980/PRIVATE RESERVE STRIPS
On Monday, March 10th the City Council approved a latecomer' s
• agreement for the Keefer Short Plat located east of Garden
Court North. The Planning Department presently has two proposed
short plat applications immediately adjacent to the east.
Today the property owner, Mr. Richard Houghton , has transferred
the title of the one-foot reserve strip to the City of Renton
so the reserve strip no longer exists . The documentation has
been filed with King County and the Planning Department will
process the two short plat applications as required by ordinance.

The Planning Department has received two applications for
short plats immediately east of Garden Court in the Kennydale
area. However, between Garden Court and these properties
a private reserve strip has been excluded by the property
developers and filed as a portion of the Keefer Short Plat
in direct conflict with Section 9-1108(23) (A) (9) of the Subdivision
- Ordinance .
The property developers are Mr. Richard Houghton and Mr . •
Ron Olson . I have discussed the problem with Mr . Houghton
and he has stated that he has been in contact with you concerning
the apparent violation . The developers are requesting through
the City Council a latecomer ' s agreement for the connection
of sewer and water to any properties to the east of Garden
Court . This request has not been approved by the City Council
at this time . Mr . Houghton has stated that he has the documentation
ready to deed the 1-foot reserve strip to the City of Renton
at any time.
The two proposed short plats show access directly on Garden
Court ; however, there is this 1-foot reserve strip . The
Planning Department has been reluctant to begin processing
the application until the question _of access has-.been resolved .
Even though the reserve strip -appears to _be =illegal , the -- -
fact remains that the property in question does not border - -
di-r-ectly on- Garden _Court . Should the legal matter of the - - - Cr - -
1-foot dedication be concluded prior tTo the City continuing
the processing of the short plat applications?

Gentlemen:
We are requesting the approval of a two-lot short plat
with a waiver of offsite improvements (curbs, gutters and
sidewalks) to Garden Court North within the L. James Keifer
short plat.
The L. James Keffer short plat was approved on October 5,
1976 without curbs , gutters and sidewalks. These improve-
ments have not been constructed as of this date.
Garden Court North is less than the 50 ft. width required
for a residential access street. It varies from 42.67 ft.
to 25.00 ft. which is inadequate to construct these improve-
ments. Please see City of Renton Subdivision Ordinance,
Section 9-1108: Mimimum Standards for Residential Design.
We believe granting our client this offsite improvement
waiver would not be detrimental to the public welfare or
injurious to other property in the vicinity.
