Dear Mr. Xenos:
This is to notify you that the Examiner's decision regarding the above
referenced request has not been appealed within the time period
established by ordinance. You will recall that as a condition of
approval of the requested waiver, the Examiner required the posting of
a bond to ensure completion of the required off-site improvements on
Benson Road S. The amount of the bond has been established in the
amount of $35,000.00 by Richard Houghton, the city's Engineering
Supervisor. The bond should be so worded to reflect that it will
remain in perpetuity until such time as required off-site improvements
are installed.
Additionally, if you have not already done so, please contact the
Planning Department regarding preparation of the short plat mylar
which will be filed with King County following submission to the city.
If we can further assist you in this matter, please do not hesitate to

REPORT AND RECOMMENDATION,
APPLICANT: Renton Elks Club FILE NO. Sh. Pl. 029-80,

LOCATION: West of the existing Renton Elks Club facility and east of
Benson Road South.
SUMMARY OF REQUEST: The applicant requests approval of a two-lot short plat on the
subject site along with a request for an exception to the
Subdivision Ordinance to allow access to Lot No. 2 via an
existing easement and a waiver of off-site improvements along
Benson Road South.
SUMMARY OF ACTION: Planning Department Recommendation: Approval of short plat and
exception; denial of waiver.
Hearing Examiner Decision: Approval of short plat and exception;
Approval of waiver subject to posting a bond.
PLANNING DEPARTMENT The Planning Department preliminary report was received on
REPORT: April 24, 1980, and a secondary revised report was received on
May 15, 1980.
PUBLIC HEARING: After reviewing the Planning Department report, examining
available information on file with the application, and field
checking the property and surrounding area, the Examiner
conducted a public hearing on the subject as follows:
The hearing was opened on April 29, 1980 at 10:25 a.m. in the Council Chambers of the
Renton Municipal Building for the purpose of review of a requested rezone of the subject
property and accompanying short plat request (File No. R-028-80) . Due to the necessity
of publication of both waiver and exception requests to be heard concurrently with the
short plat application, the matter was continued by the Examiner to May 20, 1980.
CONTINUATION:
The hearing was opened on May 20, 1980 at 9:00 a.m. in the Council Chambers of the Renton
Municipal Building.
Parties wishing to testify were affirmed by the Examiner.
It was reported that the Hearing Examiner and the applicant had received and reviewed the
Planning Department report. Roger Blaylock, Associate Planner, reviewed the report, and
entered the following additional exhibits into the record:

The Examiner requested testimony by the applicant. Responding was:

Mr. Xenos indicated concurrence in the Planning Department recommendations contained in
the staff report. Regarding the recommendation to deny the requested waiver, he expressed
hope that the Board of Public Works would grant approval of a request for deferral of the
required off-site improvements since improvement of Benson Road at this time would be
premature because elevations and location of curbs, gutters and sidewalks have not yet
been determined.
The Examiner inquired if the applicant had entered into agreements with various owners of
the right-of-ways including power line easements for development of access and parking in
Lot 1. Mr. Xenos indicated that agreements had not been executed. Mr. Blaylock advised

that the Bonneville Power Administration (S.P.A.) must review and approve all proposed
!development under the power lines. Mr. Xenos indicated that a request for use of the
easement would be directed to the agency immediately.
The Examiner inquired regarding the timing of improvement of Benson Road South, and
whether improvement would occur within the maximum two year period allowed for deferral
of off-site improvements. Mr. Blaylock noted that although the intersection of Puget
Drive and Benson Road South would be completed within two years, it was unlikely that
the portion of Benson fronting onto the property would be completed within that time
frame. The Examiner suggested that approval of a waiver contingent upon execution of
restrictive covenants to participate in a future LID may be more effective than approval
of a deferral which would expire prior to the proposed improvement project.
The Examiner requested further testimony in support or opposition to the application.
There was no response. He then requested final comments from the Planning Department
representative. Since no further comments were offered, the hearing regarding File No.
Short Plat 029-80, W-030-80 and E-043-80 was closed by the Examiner at 9:20 a.m.
FINDINGS, CONCLUSIONS AND DECISION: Having reviewed the record in this matter, the Examiner
now makes and enters the following:
FINDINGS:
1. The request is for approval of a two-lot short plat of +2.57 acres together with an
exception for an easement access and a waiver of required off-site improvements.
2. The application file containing the application, SEPA documentation, the Planning
Department report, and other pertinent documents was entered into the record as
Exhibit #1.
3. Pursuant to the City of Renton's Environmental Ordinance and the State Environmental
Policy Act of 1971, R.C.W. 43.21.C. , as amended, the subject proposal has been
determined exempt from the threshold determination by Gordon Y. Ericksen, responsible
official.
4. Plans for the proposal have been reviewed by all city departments affected by the
impact of this development.
5. There was no opposition to the proposal expressed.
7. The subject property was annexed into the city in two stages, the first in 1956 and the
second in 1961. The Elks Lodge, on proposed Lot 2, was constructed in 1967. The site
is the subject of a rezone petition which is currently pending before the City Council.
In that action, the Hearing Examiner recommended that portions of the subject site be
reclassified to B-1 (Business/Commercial) in order to unify the site under one zoning
category.
8. The western portion of the subject site rises steeply above Benson Road and then
levels off somewhat. The Elks Club is built on the eastern portion of the subject
site. The applicant intends to construct a dental clinic on the western portion,
proposed Lot 1.
9. The applicant proposes to subdivide the subject property pursuant to Section 9-1105
which permits the short subdivision of less than five lots.
10. The creation of proposed Lot 2, separate and apart from the westerly portion, Lot 1,
would leave Lot 2 without frontage on a public right-of-way; therefore, the applicant
has requested an exception to Section 9-1102.8 which provides that a lot must front
on a public street. The exception was requested pursuant to Section 9-1109.
11. The applicant has requested a waiver of the required off-site improvements along Benson
Road because that road's design, alignment and elevation may be changed in the near
,future. The Planning Department indicated that fire related water improvements must
be accomplished prior to construction of the clinic.
12. Currently the subject property is served by an access easement across the Bonneville
power line corridor to the south. The easement serves the entire lot via Eagle Ridge
Drive. The property has been served by the easement since construction of the Elks
Lodge in 1967. The easement is a 30-foot wide right-of-way which has a 20 foot paved
surface.
Bonneville and other power line owners have provided easements across property which
would otherwise be landlocked, and similar easements are found in other areas of the
city.

13. The applicant proposes access to Lot 1 via a driveway entering from Benson Road. The
drive would enter the southwest corner of the subject property where the terrain is
less steep.
CONCLUSIONS:
1. The proposed short plat appears to serve the public use and interest. The subdivision
is compatible with the Comprehensive Plan and with the pending zoning classification of
B-1. The creation of the second lot as a buildable parcel will permit the establishment
of a proposed dental clinic in this growing area of the city.
2. Under the conditions imposed on the pending rezone, the site will be heavily
landscaped to comply with the greenbelt designation of the powerline corridor.
3. The requested exception will permit the continued access of the Lodge, Lot 2, via
the easement across the powerline corridor from Eagle Ridge Drive. The exception will
not grant the applicant a new or special privilege; it will formalize the condition
which has been an acceptable solution for access to this lot for the last 13 years.
Similar access easements that cross powerline corridors exist in the city, and
therefore the applicant is not the recipient of a special privilege.
Granting the easement will permit the applicant to make reasonable use of the subject
property by permitting the establishment of two lots on this +2.57 acre parcel.
4. The requested complete waiver of off-site improvements is not justified. The waiver
would permanently free the applicant of the obligation to improve this very busy
arterial. Both lots which will result from the short plat will add considerable
traffic and the applicant should be responsible for providing improvements for the
safe passage of both vehicles and pedestrians. At the same time, the future design
and layout and elevations of Benson Road are under study and it would be a useless
endeavor to install the required improvements only to have to remove them if the
future road is in a different alignment.
Therefore, a waiver of the requirement subject to the posting of a bond to cover the
full costs of installing the required improvements is appropriate. In this way, the
improvements can be installed after the realignment of Benson Road.
5. Those improvements required to provide adequate fire flow are required prior to the
construction of any additional structures on the site.
DECISION:
Exhibit #2 is approved subject to City Council approval of Rezone File No. R-028-80.
The exception to provide an easement access to Lot 2 is approved.
The waiver is approved subject to the posting of a bond in an amount sufficient to cover
the design and installation of the required improvements including but not limited to
sidewalks, gutter, curbs and street lighting. Notwithstanding the waiver, the project
must provide adequate fire flow and such improvements necessary to accomplish that
purpose.

Pursuant to Title IV, Section 3015 of the City's Code, request for reconsideration must
be filed in writing on or before June 10, 1980. Any aggrieved person feeling that the
decision of the Examiner is based on erroneous procedure, errors of law or fact, error
in judgment, or the discovery of new evidence which could not be reasonably available at
the prior hearing may make a written request for review by the Examiner within fourteen
(14) days from the date of the Examiner's decision. This request shall set forth the
specific errors relied upon by such appellant, and the Examiner may, after review of the
record, take further action as he deems proper.
An appeal to the City Council is governed by Title IV, Section 3016, which requires that
such appeal be filed with the City Clerk accompanying a filing fee of $25.00 and meeting
other specified requirements. Copies of this ordinance are available for inspection in
the Finance Department, first floor of City Hall, or same may be pircmased at cost in
said department.

C. &9ISTORY/3,AC GROUND:
The subject site was annexed into the City by Ordinance
#1871 of March 8, 1961 and Ordinance ##1547 of. May 24,
1956 . The Elks Lodge was constructed in 1967. That

portion of the subject site not under the power lines
was rezoned to B-1 by Ordinance #2059 on October 21,
1963 . A public hearing was held on the proposed rezoning
of the subject site from GS-1 to R-3 on April 29 , 1980 .
The Hearing Examiner recommended that the subject area
involved with the rezoning application be rezoned to
B-1 subject to limiting the parking development of the
area under the power lines to a maximum of 50% along
with the retention and addition of natural vegetation
along Benson . The rezone application is now pending
before the City Council .
D. PHYSICAL BACKGROUND:
1 . Topography: The site rises fairly steeply from
west to east, then levels off into a large plateau
where the Elks Lodge is located.
2. Soils: Alderwood gravely sandy loam, 6-15% slopes
(AgC) . Permeability is moderately rapid in the
surface layer and subsoil and very slow in the
substratum. Runoff is slow to moderate and the
erosion hazard is moderate. This soil is used
for timber, pasture, berries, row crops and for
urban development . Alderwood gravelly sandy loam,
15-30% slopes (Ag0) . Runoff is medium and the
erosion hazard is severe. This soil is used mostly
for timber.
3. Vegetation: The natural vegetation is concentrated
on proposed Lot #1.
4. Wildlife: The existing vegetation on the site
provides suitable habitat for birds. and small mammals.
5. Water: No surface water was evidenced on the site
(4-11-80) .
6. Land Use : The existing Elks Club is located on
proposed Lot #2 of the short plat . The remainder
of the subject site is undeveloped.
E. NEIGHBORHOOD CHARACTERISTICS:
The surrounding properties are a mixture of undeveloped
land, power transmission lines and rights-of-way, and
. some condominiums.
F . PUBLIC SERVICES:
1 . Water and Sewer : An 8" water main runs east-west
on Eagle . Ridge Drive and a 10" main runs in a northwestrly-
southeasterly direction in the easterly portion
of the property. 8" sanitary sewers are located
on Eagle Ridge Drive and Benson Road.
2. Fire Protection: Provided by the Renton Fire Dept.
per ordinance requirements.
3. Transit : Metro Transit Route #155 operates along
Puget Drive South approximately 1 mile to the south
of the subject site.
4. Schools : Spring Glen Elementary School and Fred
Nelson Junior High School are both within mile
to the south of the subject site while Renton Senior
High School is approximately 1; miles to the north.

2. The applicant is requesting a two-lot short plat
along with an exception to allow access to proposed
lot #2 by an established easement . The easement
was granted to the Renton Elks Lodge is unusual
in that the 30 ' of right-of-way provided by the
Department of Interior to the Renton Elks Lodge
is in the form of a special agreement dated November
10, 1970.
The access from Eagle Ridge Drive to the Lodge
is completely contained within the property owned
by the BPA. They have required that a 20 ' road
be constructed on the 30 ' easement along with
a provison that any modifications necessary because
of power transmission line changes would be borne
by the Elks Lodge . When the Lodge was constructed
it was anticipated that they would access directly
onto Benson Road South. However, the topographic
features along Benson Road South suggest some
limitations to access. Access in such cases should
be limited and encouraged to integrate into the
circulation system at major points.
This access provided by the BPA does provide a.
safer means for a large number of people accessing
onto Benson Road via Eagle Ridge Drive ., This area
of Renton is typically cross cut with major power
line right-of-ways. In most cases, the BPA or
the electrical utility company does not want a
public street unerneath their right-of-ways. They
would prefer to grant easements or enter into special
agreements with individuals to provide access across
the properties . Therefore , the exception is necessary
to insure that properties cut-off from normal access
patterns are not deprived of their right to develop
because of their specific location to power line
right-of-ways . Granting of the exception does
not appear to be detrimental to the public welfare
or injurious to other properties in the vicinity.
This has been proved , in fact , because of the past
operation of the Lodge over the last ten years
utilizing this access .
3. The applicant has requested the waiver of improvements
along Benson Road South . The applicant is probably
basing their request upon the fact that Benson
Road South is designated as a temporary state route
and a major city arterial . However, the burden
of improving the arterials should not be solely
upon the city. The developing property owners
along 'the right-of-way should be responsible for
constructing normal improvements for a two-lane
road including the curbs and sidewalks. The City .
should not waive the requirement for improvements
along Benson Road. Eventhough it is recognized
that the design concept for this section of Benson
Road South has not been completed and the elevations
are unknown. The applicant can bond for the property
after obtaining a deferral of his portion of those
improvements. That estimate would be made by the
Public Works Department. Fire protection cannot
be. waived because it is a life/safety matter and
any improvement to the water utility would have
to be completed prior to the construction of any
new buildings. .

C . HISTORY/BACKGROUND:
The subject site was annexed into the City by Ordinances
#1871 of March 8, 1961 and Ordinance #1547 of May 24,
1956 . The Elks Lodge was constructed in 1967. That
portion of the subject site not under the power lines
was rezoned to B-1 by Ordinance #2059 on October 21 ,
1963.

D. PHYSICAL BACKGROUND:
1 . Topography: The site rises fairly steeply from
west to east, then levels off into a large plateau
where the Elks Lodge is located.
2 . Soils : Alderwood gravely sandy loam, 6-15% slopes
(AgC) . Permeability is moderately rapid in the
surface layer and subsoil and very slow in the
substratum. Runoff is slow to moderate end the
erosion hazard is moderate. This soil is used
for timber, pasture, berries , row crops and for
urban development . Alderwood gravelly sandy loam,
15-30% slopes (AgD) . Runoff is medium and the
erosion hazard is severe . This soil is used mostly
for timber.
3. Vegetation : The natural vegetation is concentrated
on proposed Lot #1 .
4. Wildlife: The existing vegetation on the site
provides suitable habitat for birds and small mammals .
5. Water: No surface water was evidenced on the site
(4-11-80) .
6. Land Use: The existing Elks Club is located on
proposed Lot #2 of the short plat. The remainder
of the subject site is undeveloped.
E. NEIGHBORHOOD CHARACTERISTICS :
The surrounding properties are a mixture of undeveloped
land, power transmission lines and rights-of-way , and
some condominiums.
F . PUi:;LIC SERVICES :
1 . Water and Sewer : An 8" water main runs east-west
on Eagle Ridge Drive and a 10" main runs in a northwestrly-
southeasterly direction in the easterly portion
of the property. 8" sanitary sewers are located
on Eagle Ridge Drive and Benson Road.
2. Fire Protection : Provided by the Renton Fire Dept.
per ordinance requirements.
3. Transit : Metro Transit Route #155 operates along
Puget Drive South approximately z mile to the south
of the subject site.
4. Schools: Spring Glen Elementary School and Fred
Nelson Junior High School are both within z mile
to the south of the subject site while Renton Senior
High School is approximately 1; miles to the north.
5.
Recreation: Talbot Hill Park is approximately
11/4 miles to the southwest of the subject site.

1 . Natural Systems : Rezone of the subject site will
not directly impact the property.

5. Traffic : No specific clinic plans have been submitted
so the traffic impacts may be better addressed
in a future Special Permit application.
J. ENVIRONMENTAL ASSESSMENT/THRESHOLD DETERMINATION:
Pursuant to the City of Renton 's Environmental Ordinance
and the State Environmental Policy Act of 1971, as amended,
RCW 43-21C, a declaration of non-significance was issued
by the Environmental Review Committee on April 2 , 1980.
The short plat is exempt from an environmental determination.

L . PLANNING DEPARTMENT ANALYSIS: (Rezone)
1 . The proposed rezone to R-3 is not specifically
consistent with the Comprehensive Plan land use
designation of high density multiple family residential
and greenbelt for the subject site. The intent
of the Comprehensive Plan was to retain the areas
under majdr power transmission lines as open space
and greenbelts. Development under these lines
would hive to appear to fulfill the goals of the
Comprehensive Plan designation of greenbelt .
In this specific case, the Renton Elks Lodge is
bounded do two sides by high power transmission
lines . The front portion of the site adjacent
to the Benson Highway is developmentally limited
by those high power transmission lines. The proposal
is to develop that area not under the lines in
a dental clinic and use the area under the lines
for auxiliary parking to the dental facility ..
It would appear that parking and the greenbelt
designation of the Comprehensive Plan are compatible
if the intensity of the parking is severely reduced
to emphasize the greenbelt theme. This would suggest
an unusually high percentage of landscaping in
relationship to the total site. The Parking and

Loading Ordinance requires that any parking lots
over 10,000 square feet have a minimum of 5% of
the parking area in landscaping. With the primary
intent of the Comprehensive Plan to use the area
as greenbelt , it would appear that the parking
would have to be auxiliary to the greenbelt designation.
If only half of the total area was utilized for
parking and the other half was extensively landscaped ,
it would create the appearance of meeting the intent
of the Comprehensive Plan.
2 . The majority of the subject site was rezoned to
B-i by Ordinance 2059 on October 21, 1963. The
Elks Lodge was subsequently built in 1967 . Those
portions of the site under the high power transmission
lines were left in a GS-1 classification and not
rezoned to B-1.
The subject site , under the power lines , has not
been considered for a rezone since the property
was annexed into the City in 1956 (Section 4-3014-A) .
A dental clinic could be constructed on that portion
of the site presently zoned B-l .as an allowed use.
Auxiliary parking could be allowed on those portions
of the site under the transmission lines if the
property was rezoned to R-3. Normally auxiliary
parking lots are on separate , adjacent parcels.
The one parcel, proposed Lot #1 , would contain
two zoning classifications and would not follow
under the procedures of Section 4-2204(3) (C) (2)
as in the regent case of the Boeing Parking Lot
#11 . Therefore the design review would take place
at the building permit application stage by the
Planning . Department .
3. On November 8, 1971 a portion of the power line
right-of-way designated as greenbelt in the Comprehensive
Plan was rezoned to R-4 under Ordinance 2675.
The property lies immediately west of the subject
site on the other side of the Benson Highway.
This' would appear to suggest that there is no definite
policy established to limit the use of greenbelt
areas for vegetation as long as the intent of the
greenbelt area is met it would appear that compatible
uses could be permitted.
4. • No buildings can be constructed under the powerline.
right-of-ways. Development will be limited to
parking.
M. DEPARTMENTAL RECOMMENDATIONS: (Rezone)
It is recommended that the request for a rezone from
GS-1 to R-3, Medium Density Multiple Family Residential,
File No. R-028-80, be approved subject to the filing
of restrictive covenants to limit the maximum lot
coverage (parking and paved areas) of the site to 49%.
The other 51% is to be covered in extensive landscaping
plantings to fulfill the intent of the greenbelt
designation.

L . PLANNING DEPARTMENT ANALYSIS: (Short Plat)
1. The applicant has submitted a short plat which
does not provide direct access onto a public street
from Lot #2. Lot #2 is presently developed with
the Renton Elks Lodge and access is provided over
an easement across P.S.P. & L . right-of-way . The
applicant will have to correct the application
and request an exception of the Subdivision Ordi-
nance to allow access to Lot #2 by easement rather
than the required frontage on a public street .
M. DEPARTMENTAL RECOMMENDATIONS : (Short Plat)
The Planning Department recommends that the public hearing. .
for File No . Short Plat 029-80 and waiver request W-030-80
be continued until the proper application for an exception
is submitted and advertised. Proper legal notices can
be placed in the newspaper to allow the_.public hearing
to continue on Tuesday, May 13th.

This is to notify you that the Examiner's decision regarding the above
referenced request has not been appealed within the time period
established by ordinance. You will recall that as a condition of
approval of the requested waiver, the Examiner required the posting of
a bond to ensure completion of the required off-site, improvements on
Benson Road S. The amount of the bond has been established in the
amount of $35,000.00 by Richard Houghton, the city's Engineering
Supervisor. The bond should be so worded to reflect that it will
remain in perpetuity until such time as required off-site improvements .

CITY OF RENTON
REPORT AND RECOMMENDATION .
APPLICANT: Renton Elks Club FILE NO. Sh. P1. 029-80,
W-030-80, E-043-80
LOCATION: West of the existing Renton Elks Club facility and east of
Benson Road South.
SUMMARY OF REQUEST: The applicant requests approval of a two-lot short plat on the
subject site along with a request for an exception to the
Subdivision Ordinance to allow access to Lot No. 2 via an
existing easement and a waiver of off-site improvements along
Benson Road South.
SUMMARY OF ACTION: Planning Department Recommendation: Approval of short plat and
exception; denial of waiver.
Hearing Examiner Decision: Approval of short plat and exception;
Approval of waiver subject to posting a bond.
PLANNING DEPARTMENT The Planning Department preliminary report was received on
REPORT: April 24, 1980, and a secondary revised report was received on
May 15, 1980.
PUBLIC HEARING: After reviewing the Planning Department report, examining
available information on file with the application, and field
checking the property and surrounding area, the Examiner
conducted a public hearing on the subject as follows:
The hearing was opened on April 29, 1980 at 10:25 a.m. in the Council Chambers of the
Renton Municipal Building for the purpose of review of a requested rezone of the subject
property and accompanying short plat request (File No. R-028-80) . Due to the necessity
of publication of both waiver and exception requests to be heard concurrently with the
short plat application, the matter was continued by the Examiner to May 20, 1980.
CONTINUATION:
The hearing was opened on May 20, 1980 at 9:00 a.m. in the Council Chambers of the Renton
Municipal Building.
Parties wishing to testify were affirmed by the Examiner.
It was reported that the Hearing Examiner and the applicant had received and reviewed the
Planning Department report. Roger Blaylock, Associate Planner, reviewed the report, and
entered the following additional exhibits into the record:

The Examiner requested testimony by the applicant. Responding was:

Mr. Xenos indicated concurrence in the Planning Department recommendations contained in
the staff report. Regarding the recommendation to deny the requested waiver, he expressed
hope that the Board of Public Works would grant approval of a request for deferral of the
required off-site improvements since improvement of Benson Road at this time would be
premature because elevations and location of curbs, gutters and sidewalks have not yet
been determined.
The Examiner inquired if the applicant had entered into agreements with various owners of
the right-of-ways including power line easements for development of access and parking in
Lot 1. Mr. Xenos indicated that agreements had not been executed. Mr. Blaylock advised

that the Bonneville Power Administration (B.P.A.) must review and approve all proposed
development under the power lines. Mr. Xenos indicated that a request for use of the
easement would be directed to the agency immediately.
The Examiner inquired regarding the timing of improvement of Benson Road South, and
whether improvement would occur within the maximum two year period allowed for deferral
of off-site improvements. Mr. Blaylock noted that although the intersection of Puget
Drive and Benson Road South would be completed within two years, it was unlikely that
the portion of Benson fronting onto the property would be completed within that time
frame. The Examiner suggested that approval of a waiver contingent upon execution of
restrictive covenants to participate in a future LID may be more effective than approval
of a deferral which would expire prior to the proposed improvement project.
The Examiner requested further testimony in support or opposition to the application.
There was no response. He then requested final comments from the Planning Department
representative. Since no further comments were offered, the hearing regarding File No.
Short Plat 029-80, W-030-80 and E-043-80 was closed by the Examiner at 9:20 a.m.
FINDINGS, CONCLUSIONS AND DECISION: Having reviewed the record in this matter, the Examiner
now makes and enters the following:
FINDINGS:
1. The request is for approval of a two-lot short plat of +2.57 acres together with an
exception for an easement access and a waiver of required off-site improvements.
2. The application file containing the application, SEPA documentation, the Planning
Department report, and other pertinent documents was entered into the record as
Exhibit #1.
3. Pursuant to the City of Renton's Environmental Ordinance and the State Environmental
Policy Act of 1971, R.C.W. 43.21.C. , as amended, the subject proposal has been
determined exempt from the threshold determination by Gordon Y. Ericksen, responsible
official.
4. Plans for the proposal have been reviewed by all city departments affected by the
impact of this development.
5. There was no opposition to the proposal expressed.
7. The subject property was annexed into the city in two stages, the first in 1956 and the
second in 1961. The Elks Lodge, on proposed Lot 2, was constructed in 1967. The site
is the subject of a rezone petition which is currently pending before the City Council.
In that action, the Hearing Examiner recommended that portions of the subject site be
reclassified to B-1 (Business/Commercial) in order to unify the site under one zoning
category.
8. The western portion of the subject site rises steeply above Benson Road and then
levels off somewhat. The Elks Club is built on the eastern portion of the subject
site. The applicant intends to construct a dental clinic on the western portion,
proposed Lot 1.
9. The applicant proposes to subdivide the subject property pursuant to Section 9-1105
which permits the short subdivision of less than five lots.
10. The creation of proposed Lot 2, separate and apart from the westerly portion, Lot 1,
would leave Lot 2 without frontage on a public right-of-way; therefore, the applicant
has requested an exception to Section 9-1102.8 which provides that a lot must front
on a public street. The exception was requested pursuant to Section 9-1109.
11. The applicant has requested a waiver of the required off-site improvements along Benson
Road because that road's design, alignment and elevation may be changed in the near
future. The Planning Department indicated that fire related water improvements must
be accomplished prior to construction of the clinic.
12. Currently the subject property is served by an access easement across the Bonneville
power line corridor to the south. The easement serves the entire lot via Eagle Ridge
Drive. The property has been served by the easement since construction of the Elks
Lodge in 1967. The easement is a 30-foot wide right-of-way which has a 20 foot paved
surface.
Bonneville and other power line owners have provided easements across property which
would otherwise be landlocked, and similar easements are found in other areas of the
city.

13. The applicant proposes access to Lot 1 via a driveway entering from Benson Road. The
drive would enter the southwest corner of the subject property where the terrain is
less steep.
•
CONCLUSIONS:
1. The proposed short plat appears to serve the public use and interest. The subdivision
is compatible with the Comprehensive Plan and with the pending zoning classification of
B-1. The creation of the second lot as a buildable parcel will permit the establishment
of a proposed dental clinic in this growing area of the city.
2. Under the conditions imposed on the pending rezone, the site will be heavily
landscaped to comply with the greenbelt designation of the powerline corridor.
3. The requested exception will permit the continued access of the Lodge, Lot 2, via
the easement across the powerline corridor from Eagle Ridge Drive. The exception will
not grant the applicant a new or special privilege; it will formalize the condition
which has been an acceptable solution for access to this lot for the last 13 years.
Similar access easements that cross powerline corridors exist in the city, and
therefore the applicant is not the recipient of a special privilege.
Granting the easement will permit the applicant to make reasonable use of the subject
property by permitting the establishment of two lots on this +2.57 acre parcel.
4. The requested complete waiver of off-site improvements is not justified. The waiver
would permanently free the applicant of the obligation to improve this very busy
arterial. Both lots which will result from the short plat will add considerable
traffic and the applicant should be responsible for providing improvements for the
safe passage of both vehicles and pedestrians. At the same time, the future design
and layout and elevations of Benson Road are under study and it would be a useless
endeavor to install the required improvements only to have to remove them if the
future road is in a different alignment.
Therefore, a waiver of the requirement subject to the posting of a bond to cover the
full costs of installing the required improvements is appropriate. In this way, the
improvements can be installed after the realignment of Benson Road.
5. Those improvements required to provide adequate fire flow are required prior to the
construction of any additional structures on the site.
DECISION:
Exhibit #2 is approved subject to City Council approval of Rezone File No. R-028-80.
The exception to provide an easement access to Lot 2 is approved.
The waiver is approved subject to the posting of a bond in an amount sufficient to cover
the design and installation of the required improvements including but not limited to
sidewalks, gutter, curbs and street lighting. Notwithstanding the waiver, the project
must provide adequate fire flow and such improvements necessary to accomplish that
purpose.

portion of the subject site not under the power lines
was rezoned to B-1 by Ordinance #2059 on October 21,
1963 . A public hearing was held on the proposed rezoning
of the subject site from GS-1 to R-3 on April 29 , 1980 .
The Hearing Examiner recommended that the subject area
involved with the rezoning application be rezoned to
B-1 subject to limiting the parking development of the
area under the power lines to a maximum of 50o along
with the retention and addition of natural vegetation
along Benson . The rezone application is now pending
before the City Council .

D . PHYSICAL BACKGROUND:
1 . Topography: The site rises fairly steeply from
west to east , then levels off into a large plateau
where the Elks Lodge is located.
•
2 . Soils : Alderwood gravely sandy loam, 6-15% slopes
(AgC) . Permeability is moderately rapid in the
surface layer and subsoil and very slow in the
substratum. Runoff is slow to moderate and the
erosion hazard is moderate. This soil is used
for timber, pasture , berries , row crops and for
urban development . Alderwood gravelly sandy loam,
15-30o slopes (AgD) . Runoff is medium and the
erosion hazard is severe . This soil is used mostly
for timber,.
3 . Vegetation : The natural vegetation is concentrated
on proposed Lot #1 .
4. Wildlife: The existing vegetation on the site
provides suitable habitat for birds and small mammals .
5 . Water : No surface water was evidenced on the site
(4-11-80) .
6. Land Use : The existing Elks Club is located on .
proposed Lot #2 of the short plat . The remainder

The surrounding properties are a mixture of undeveloped
land, power transmission lines and rights-of-way, and

2. The applicant is requesting a two-lot short plat
along with an exception to allow access to proposed
lot #2 by an established easement . The easement
was granted to the Renton Elks Lodge is unusual
in that the 30 ' of right-of-way provided by the
Department of Interior to the Renton Elks Lodge
is in the form of a special agreement dated November
10, 1970.
The access from Eagle Ridge Drive to the Lodge
is completely contained within the property owned
by the BPA. They have required that a 20 ' road
be constructed on the 30 ' easement along with
a provison that any modifications necessary because
of power transmission line changes would be borne
by the Elks Lodge . When the Lodge was constructed
it was anticipated that they would access directly
onto Benson Road South . However , the topographic. _
features along Benson Road South suggest some
limitations to access . Access in such cases should
be limited and encouraged to integrate into the
circulation sys.tem ,at major points.
This access provided by the BPA does provide a
safer means for a large number of people accessing
onto Benson Road via Eagle Ridge Drive . This area
of Renton is typically cross cut with major power
line right-of-ways . In most cases , the BPA or
the electrical utility company does not want a
public street unerneath their right-of-ways . They
would prefer to grant easements or enter into special
agreements with individuals to provide access across
the properties . Therefore , the exception is necessary
to insure that properties cut-off from normal access
patterns are not deprived of their right to develop
because of their specific location to power line
right-of-ways . Granting of the exception does
not appear to be detrimental to the public welfare
or injurious to other properties in the vicinity.
This has been proved , in fact , because of the past
operation of the Lodge over the last ten years
utilizing this access .
3 . The applicant has requested the waiver of improvements
along Benson Road South . The applicant is probably
basing their request upon the fact that Benson
Road South is designated as a temporary state route
and a major city arterial . However , the burden
of improving the arterials should not be solely
upon the city . The developing property owners
along the right-of-way should be responsible for
constructing normal improvements for a. two-lane
road including the curbs and sidewalks . The City
should not waive the requirement for improvements
along Benson Road . Eventhough it is recognized
that the design concept for this section of Benson
Road South has not been completed and the elevations
are unknown . , The applicant can bond for the property
after obtaining a deferral of his portion of those
improvements . That estimate would be made by the
Public Works Department . Fire protection cannot
be waived because it is a life/safety matter and
any improvement to the water utility would have
to be completed prior to the construction of any
new buildings .

SUMMARY OF REQUEST: The applicant requests approval of a rezone from GS-1 to R-3
and a two-lot short plat on the subject site to allow for
construction of a dental clinic on the newly created lot.

PLANNING DEPARTMENT The Planning Department preliminary report was received by the
REPORT: Examiner on April 24, 1980.
PUBLIC HEARING: After reviewing the Planning Department report, examining
available information on file with the application, and field
checking the property and surrounding area, the Examiner
conducted a public hearing on the subject as follows:
The hearing was opened on April 29, 1980 at 10:25 a.m. in the Council Chambers of the
Renton Municipal Building.
Parties wishing to testify were affirmed by the Examiner.
It was reported that the Hearing Examiner and the applicant had received and reviewed
the Planning Department report. Steve Munson, Planning Department, reviewed the report
and entered the following exhibits into the record:

The Examiner requested the location of existing B-1 zoning which lies south of the subject
site. Mr. Munson designated the B-1 zoned areas located outside the power line right-of-way.
The Examiner inquired if three power line right-of-ways cross the property. Roger Blaylock,
Associate Planner, indicated that two easements exist on the subject property with another
located on the southerly boundary. Mr. Blaylock also corrected an error in Section I.5 of
the staff report which states that traffic impacts may be better addressed in a future
special permit application, and advised that a special permit will not be required for the
auxiliary parking lot located on property zoned R-3, and design review can occur by the
Planning Department at the building permit application stage.
The Examiner inquired regarding proposed access to Lot 1. Mr. Blaylock indicated that in the
original proposal in 1967, a roadway was anticipated from Benson Road South into the Elks
Club facility; however, access was later provided via Eagle Ridge Drive. Regarding the
feasibility of providing access directly to Benson Road, Mr. Blaylock indicated that although
the topography is quite steep, access would be physically possible. He also noted that
emergency fire access is possible from Lot 2.
The Examiner stated that the public hearing agenda does not reflect application for a
waiver, although the Planning Department report denotes the request. Following review,
Mr. Blaylock advised that the public hearing publication notice does not contain the
waiver request, and it will subsequently be added to the legal publication for the short
plat and exception requests to be continued to May 20, 1980.
The Examiner inquired if the Planning Department had considered the B-1 zoning designation
for the entire site in lieu of R-3 and thereby eliminate the necessity for a special permit
to allow for parking facilities. Mr. Blaylock referenced Section 4-2204.C.2 of the Parking
and Loading Ordinance which states that plans for any parking area, when not located on the
same lot with the principal use, shall be approved by the Hearing Examiner as a special use,

but because auxiliary parking is located on the same lot as the medical clinic, plans may
be approved by the Planning Department. The Examiner stated that the R-3 zone does not
permit a dental clinic or auxiliary parking without a special permit, but the B-1 zoning
category would permit the proposal outright as well as provide consistency with the land
use for the existing Elks Club facility. Mr. Blaylock indicated that although the B-1
zone had not been proposed, it could be considered if limitation of maximum coverage
continues in compliance with the general intent of greenbelt requirements.
The Examiner requested testimony by the applicant. Responding was:

Mr. Xenos, representing the property owner and Mr. Hancheroff - potential occupant of the
clinic, submitted the following exhibits into the record:

Real Estate Broker, dated April 29, 1980
The letter encouraged approval of the subject request to fulfill a community need for
suitable medical clinic property in the downtown area of the City of Renton. Mr. Xenos
indicated that the property is difficult to develop due to the topography, and construction
of the clinic will occur on the B-1 portion with auxiliary parking on the existing GS-1
portion. He noted that from 20 to 30 percent of the existing GS-1 parcel will be utilized
for parking, and the proposed landscaping is compatible with the intent of the Comprehensive
Plan.
Mr. Xenos inquired if the subject of improvements could be addressed at this time. The
Examiner explained that the short plat, with accompanying exception and waiver requests ,
will be continued for hearing on May 20, 1980 following publication of appropriate legal
notice. Mr. Xenos felt that a request for exception is unnecessary because Parcel 2 will
remain unchanged and access to Parcel 1 will be provided from a dedicated roadway. Mr.
Blaylock clarified the Subdivision Ordinance requirement for frontage on a public right-
of-way for all lots, and while the lot containing the Renton Elks Club facility contains
frontage on the Benson Road, access is not obtained from that roadway. He noted that
without the exception request for easement, the lot will remain landlocked.
The Examiner inquired regarding the square footage proposed for the clinic in order to
determine the number of required parking spaces and aid in determining the appropriate
zoning category for the site. Mr. Blaylock advised that the plan reflects 14,300 square
feet in the proposal. Mr. Xenos indicated that due to topography on the site it is
difficult to achieve parking requirements without destroying aesthetic qualities of the
property located between the roadway and future development. Mr. Blaylock concurred in
Mr. Xenos' comments regarding severe limitation of development due to topography, and
noted that auxiliary parking is allowed in the R-3 zone, the minimum zoning category
necessary to allow parking.
The Examiner requested testimony in support or opposition to the application. There was
no response. He then requested general testimony. Responding was:

The Examiner requested further comments. Since there were none, the hearing regarding
File No. R-028-80 was closed by the Examiner at 11:05 a.m. , and the requests for short
plat, exception and waiver were continued to May 20, 1980 at 9:00 a.m. in the Council
Chambers of the Renton Municipal Building.

FINDINGS, CONCLUSIONS & RECOMMENDATIONS: Having reviewed the record in this matter, the
Examiner now makes and enters the following:
FINDINGS:
1. The request is for approval of a reclassification of +2.57 acres of property from
GS-1 (General; Single Family Residential; Minimum lot size - 35,000 square feet) to
R-3 (Medium Density Residential) .
2. The application file containing the application, SEPA documentation, the Planning
Department report, and other pertinent documents was entered into the record as
Exhibit #1.
3. Pursuant to the City of Renton's Environmental Ordinance and the State Environmental
Policy Act of 1971, R.C.W. 43.21.C. , as amended, a Declaration. of Non-Significance
has been issued for the subject proposal by the Environmental Review Committee,
responsible official.
4. Plans for the proposal have been reviewed by all city departments affected by the
impact of this development.
5. There was no opposition to the proposal expressed.
6. All existing utilities are available and in close proximity.
7. The subject property was annexed into the city in two phases--the first in 1956 and
then in 1961. The GS-1 zoning was applied at the time of annexation.
8. The subject property actually consists of two separate parcels, each is located
under a powerline right-of-way. One parcel is located at the •northwest corner of
the Elks Club.. The other parcel is located at the southwest corner of the Elks
Club. Both parcels are part of a larger tract owned by the Elks Club but consisting
of mixed zoning categories.
9. The site has a steep slope which rises from west to east above Benson Road South.
The sites are covered with natural vegetation.
10. The Elks Club facility is located east of the two parcels and a proposed short plat
would separate the Elks Club proper from the western portion of the property. This
western portion would be developed with a dental clinic and the two parcels proposed
for reclassification would serve as parking for the clinic.
11. Property located under the pdwerlines has in most cases been zoned GS-1 and is
designated for greenbelt by the Comprehensive Plan. Under terms of the easements
creating the powerline corridors, no structures can be built under the lines.
12. The Elks Club property with the exception of the powerline easements is currently .
zoned B-1 (Commercial) . The proposed subdivision of the Elks Club B-1 property
into two lots would enable the establishment of a dental clinic on the undeveloped
portion as a permitted use (subject to a threshold environmental determination) .
The applicant has to provide an area in which to establish parking as the western
portion, currently zoned B-1, does not have sufficient area in which to provide
parking.

13. Therefore, the applicant has proposed rezoning the powerline parcels to R-3 in order
to provide a zoning category which would permit the establishment of parking lots
under the powerline corridor. The GS-1 zoning only permits the establishment of
single family residences.
14. As proposed by the applicant, the R-3 zoning would permit the development of accessory
parking lots for the dental clinic subject to the approval of a special permit.
15. The zoning in the area is a mixture of B-1, the main portion of the Elks Club
property and property located west of Benson across from the proposed parcels,
R-4 (High Density Multifamily) east and southeast of the Elks Club; and the GS-1,
the powerline corridors.
16. The Planning Department recommended that no more than 49% of the subject site be
used for accessory parking and that the area be maintained with natural landscaping
so that the proposal would remain consistent with the Comprehensive Plan's designation
of the subject property for open space greenbelt.
17. B-1 zoning on the subject site would also permit the dental clinic's accessory parking
lot.

CONCLUSIONS:
1. The proponent of a rezone must demonstrate that the request is in the public interest
and will not impair the public health, safety and welfare in addition to compliance
with at least one of the three criteria listed in Section 4-3010 which provides in
part that:
a. The subject site has not been considered in a previous area-wide rezone or land
use analysis; or
b. The subject site is potentially designated for the new classification per the
Comprehensive Plan; or
c. There has been material and substantial change in circumstances in the area in
which the subject site is located since the last rezoning of the property or area.
The applicant has demonstrated that the current classification of the property
warrants change.
2. The powerline right-of-ways are limited in potential. Structures may not be built
beneath the power lines. The GS-1 zoning which restricts the use of the property to
single family residential is unrealistic. The proposed use of the land under the
power lines for accessory parking for a dential clinic would permit the applicant to
make reasonable use of his property. Parking is permitted under the power lines.
3. The proposed rezone of the land to R-3, however, would not permit the outright use
of the land below the power lines for a dental clinic's accessory parking without
a further hearing on a special permit. It would also create two rather small areas
of R-3 zoning in the midst of B-1 zones.
More practical and consistent with the surrounding zoning and the zoning of the
remainder of the lot would be a reclassification of the subject property to B-1.
It would be consistent with the adjoining property and would permit the needed
parking without a need for special permit approval.
4. Under either zoning category, B-1 or R-3, the parking use would have to be limited
to a small area to remain faithful to the Comprehensive Plan designation of the
subject site for greenbelt. As recommended by the Planning Department, scattered
parking which is contained in a well-landscaped parking area will permit development
of this parcel consistent with the goals and objective of the Comprehensive Plan and
its designation of the subject site as suitable for greenbelt.
5. The parking lot and roadways under the power line should be limited to less than
50% with the remaining portions of the site landscaped to comply with the
Comprehensive Plan. The execution of restrictive covenants to assure compliance
with the open space/greenbelt designation of the subject property should be required
as a condition of the rezoning of the subject property. The covenants should restrict
use of the subject property to parking, and the parking should be restricted to less
than 50% of the area of the subject site.
RECOMMENDATION:
The City Council should approve the reclassification of the subject property from GS-1
to B-1 subject to the execution of restrictive covenants which:
1. Limit the development to a parking lot on the subject property.
2. Limit to less than 50% of the site area for the parking lot pavement and roadways.
3. Require the installation or retention of natural landscaping on the subject site in
the areas not developed for parking or roads.

Pursuant to Title IV, Section 3015 of the City's Code, 'request for reconsideration must
be filed in writing on or before May 23, 1980. Any aggrieved person feeling that the
decision of the Examiner is based_ on erroneous procedure, errors of law or fact, error
in judgment, or the discovery of new evidence which could not be reasonably available
at the prior hearing may make a written request for review by the Examiner within fourteen
(14) days from the date of the Examiner's decision. This request shall set forth the
specific errors relied upon by such appellant, and the Examiner may, after review of the
record, take further action as he deems proper.
An appeal to the City Council is governed by Title IV, Section 3016, which requires that
such appeal be filed with the City Clerk accompanying a filing fee of $25.00 and meeting
other specified requirements. Copies of this ordinance are available for inspection in
the Finance Department, first floor of City Hall, or same may be purchased at cost in
said department.

interference with the Bonne ille power Administration's present of this easeme li frr electlic
transmission line purposes. Accordingly, there is no objection to such use, subject to the condi-
tion, however, that if such use should at any time become a hazard to the presently installed
electrical facilities of the Administration, or any facilities added or constructed in the future, or
should such use interfere with the inspection, maintenance or Tepair of the same, or with the

You, of course, will have to assume all risk of loss, damage or injury which may result from your
use of the easement area, except for such loss, damage or injury as the United States may be

The subject site was annexed into the City by Ordinances
#1871 of March 8, 1961 and Ordinance #1547 of May 24,
1956 . The Elks Lodge was constructed in 1967. That
portion of the subject site not under the power lines
was rezoned to B-1 by Ordinance #2059 on October 21 ,
1963 .

D . PHYSICAL BACKGROUND:
1 . Topography : The site rises fairly steeply from
west to east, then levels off into a large plateau
where the Elks Lodge is located .
2 . Soils : Alderwood gravely sandy loam, 6-15% slopes
(AgC) . Permeability is moderately rapid in the
surface layer and subsoil and very slow in the
substratum . Runoff is slow to moderate and the
erosion hazard is moderate . This soil is used
for timber, pasture , berries , row crops and for
urban development . Alderwood gravelly sandy loam,
15-30% slopes (AgD) . Runoff is medium and the
erosion hazard is severe . This soil is used mostly
for timber .
3 . Vegetation : The natural vegetation is concentrated
on proposed Lot #1 .
4 . Wildlife: The existing vegetation on the site
provides suitable habitat for birds and small mammals .
5 . Water : No surface water was evidenced on the site
(4-11-80) .
6. Land Use : The existing Elks Club is located on
proposed Lot #2 of the short plat . The remainder
of the subject site is undeveloped .
E . NfEIGHI1ORHID®D CHARACTERISTICS :
The surrounding properties are a mixture of undeveloped
land, power transmission lines and rights-of-way, and
some condominiums.
F . IPW ILIC SERVICES :
1 . Water and Sewer : An 8" water main runs east-west
on Eagle Ridge Drive and a 10" main runs in a northwestrly-
southeasterly direction in the easterly portion
of the property. 8" sanitary sewers are located
on Eagle Ridge Drive and Benson Road .
2 . Fire Protection : Provided by the Renton Fire Dept .

Loading Ordinance requires that any parking lots
over 10,000 square feet have a minimum of 5% of
the parking area in landscaping . With the primary
intent of the Comprehensive Plan to use the area
as greenbelt , it would appear that the parking
would have to be auxiliary to the greenbelt designation .
If only half of the total area was utilized for
parking and the. other half was extensively landscaped ,
it would create the appearance of meeting the intent
of the Comprehensive Plan.
2 . The majority of the subject site was rezoned to
B-1 by Ordinance 2059 on October 21 , 1963. The
Elks Lodge was subsequently built in 1967 . Those
portions of the site under the high power transmission
lines were left in a GS-1 classification and not
rezoned to B-1 .
The subject site , under the power lines , has not
been considered for a rezone since the property
was annexed into the City in 1956 (Section 4-3014-A) .
A dental clinic could be constructed on that portion
of the site presently zoned B-l .as an allowed use .
Auxiliary parking could be allowed on those portions
of the site under the transmission lines if the
property was rezoned to R-3. Normally auxiliary
parking lots are on separate , adjacent parcels .
The one parcel , proposed Lot #1 , would contain
two zoning classifications and would not follow
under the procedures of Section 4-2204(3) (C ) (2)
as in the recent case of the Boeing Parking Lot
#11 . Therefore the design review would take place
at the building permit application stage by the
Planning Department .
3 . On November 8, 1971 a portion of the power line
right-of-way designated as greenbelt in the Comprehensive
Plan was rezoned to R-4 under Ordinance 2675 .
The property lies immediately west of the subject
site on the other side of the Benson Highway.
This would appear to suggest that there is no definite
policy established to limit the use of greenbelt
areas for vegetation as long as the intent of the
greenbelt area is met it would appear that compatible
uses could be permitted .
4. No buildings can be constructed under the powerline
right-of-ways. Development will be limited to
parking .
M. DEPARTMENTAL RECOMMENDATIONS: (Rezone)
It is recommended that the request for a rezone from
GS-1 to R-3, Medium Density Multiple Family Residential,
File No . R-028-80, be approved subject to the filing
of restrictive covenants to limit the maximum lot
coverage (parking and paved areas) of the site to 49%.
The other 51% is to be covered in extensive landscaping
plantings to fulfill the intent of the greenbelt
designation .

1 . The proposed rezone to R-3 is not specifically
consistent with the Comprehensive Plan land use
designation of high density multiple family residential
and greenbelt for the subject site. The intent
of the Comprehensive Plan was to retain the areas
under major power transmission lines as open space
and greenbelts . Development under these lines
would have to appear to fulfill the goals of the
Comprehensive Plan designation of greenbelt .
In this specific case , the Renton Elks Lodge is
bounded on two sides by high power transmission
l lines . The front portion of the site adjacent
to the Benson Highway is developmentally limited
by those high power transmission lines . The proposal
is to develop that area not under the lines in
a dental clinic and use the area under the lines
for auxiliary parking to the dental facility.
It would appear that parking and the greenbelt
designation of the Comprehensive Plan are compatible
if the intensity of the parking is severely reduced
to emphasize the greenbelt theme . This would suggest
an unusually high percentage of landscaping in
relationship to the total site. The Parking and

On behalf of the Renton Elks and Dr. Hancheroff, I
am' pleased to submit the attached Short Plat and Reclass-
ification applications. Dr. Hancheroff has been practicing
dentistry in Renton for over seven years and for the last
two years .has been attempting to locate a permanent site
for his practice. •

• 'We wish to request a waiver for any improvements
which would under normal circumstances be required as a
condition of approval of the short plat. . There are no
sidewalk improvements along Benson road at this time and
theoretically -any improvements would not be utilized.
Lot 1 of the' short, 'the parcel which Mr. Hancheroff
'will, be purchasing from 'the Renton Elks, is presently •
zoned B-1 and GS-1. The GS-1 portion of the lot is all of
that portion which is encumbered by transmission right of .
way easements. It was our intention to utilize this area
for parking and landscaping. However, we were made aware
that this could not be done under its existing zoning.
The reclassification which we are seeking will rezone the .
GS-1 portion of the 'property to R-2 for the purpose of
allowing the property to be used to meet the parking and
landscaping requirements of the project. We feel that
this is a logical request and one which will in no way be
detrimental to the surrounding properties.

land use code which would prohibit our utilization of the GS-1
as planned. Please verify this issue at your earliest conven-
ience for the feasibility of the entire project could be at
stake.
