REPORT AND DECISION .

SUMMARY OF REQUEST: The applicant requests approval of a four-lot short plat together
with an exception to the Subdivision Ordinance to permit two
20-foot pipestem lots.
SUMMARY OF ACTION: Planning Department Recommendation: Approval with conditions

PLANNING DEPARTMENT The Planning Department preliminary report was received by the
REPORT: Examiner on July 23, 1980.
PUBLIC HEARING: After reviewing the Planning Department report, examining
available information on file with the application, and field
checking the property and surrounding area, the Examiner
conducted a public hearing on the subject as follows:
The hearing was opened on July 29, 1980 at 9:22 a.m. in the Council Chambers of the Renton
Municipal Building.
Parties wishing to testify, were affirmed by the Examiner.
It was reported that the Hearing Examiner and the applicant had received and reviewed the
Planning Department report. Steve Munson, Planning Department, reviewed the report, and
entered the following exhibits into the record:

Exhibit #2: Short Plat as submitted
Exhibit #3: Short Plat with staff comments
Exhibit #4: Short Plat with alternative design
Responding to the Examiner's inquiry regarding specific location of the fire hydrant
referenced] in Section M.2 of the report, Mr. Munson suggested that a representative of
the Fire Department be contacted.
The Examiner requested testimony by the applicant. Responding was:

Mr. Weston indicated concurrence with recommendations contained in the report. He noted
that the alternative design reflected in Exhibit #4 provides a logical method of property
development1and supported approval of that design. Mr. Weston advised that a fire hydrant
currently exists in front of neighboring property, and questioned whether the location
would meet the Fire Department requirement.
The Examiner requested testimony in support or opposition to the application. There was
no response. He then requested final comments from the Planning Department staff. Since
no further. comments were offered, the hearing regarding File No. Short Plat 061-80 and
E-062-80 was closed by the Examiner at 9:32 a.m.

FINDINGS, CONCLUSIONS & DECISION: Having reviewed the record in this matter, the Examiner
now makes and enters the following:
FINDINGS:
j 1 . The request is for approval of a four-lot short plat of +51 ,000 square feet together
with exceptions for pipestem lot and access easements.
2. The application file containing the application, SEPA documentation, the Planning
Department report, and other pertinent documents was entered into the record as
Exhibit #1 .
3. Pursuant to the City of Renton's Environmental Ordinance and the State Environmental
Policy Act of 1971 , R.C.W. 43.21 .C. , as amended, the subject proposal has been
determined exempt from the threshold determination by the Environmental Review
Committee, responsible official .
4. Plans for the proposal have been reviewed by all city departments affected by the
impact of this development.
5. All existing utilities are available and in close proximity.
h. The proposal is compatible with the required setbacks, lot coverage and height
requirements of Section 4-706 (R-1 ; Single Family Residential ; Minimum lot size -
7,200 square feet) of Title IV., Ordinance No. 1628, Code of General Ordinances.
7. The subject site is located in the vicinity of 338 Renton Avenue S.
8. The site is generally level except for that portion of the site adjacent to Renton
Avenue S. where the slope is steep.
9. A vacant single family residence is located on the northwest corner of the subject
site. The remainder of the site is undeveloped and covered with grasses and shrubs.
10. The applicant has proposed to divide the subject site into four lots pursuant to
Section 9-1105. The applicant has proposed to access the internal lots via one
pipestem extension of twenty feet in width. The pipestem would be used by both lots
through the creation of an easement. The exceptions for the pipestem easement have
been requested pursuant to Section 9-1109 and 9-1108.23(F) (3) (d) .
11 . As proposed by the applicant, the four lots would be 13,500 square feet (Lot 1 ) ,
13,500 square, feet (Lot 2) , 12,000 square feet (Lot 3) and 9,000 square feet (Lot 4)
respectively. The existing lot is 300 feet deep and about seven times the size
required under the Zoning Code.
12. The Fire Department has indicated that the interior end of the pipestem would require
a hammerhead turnaround subject to their approval .
13. Development of the subject site with four residences , the existing house and three
new homes, will require a storm drainage detention/retention system.
14. The area is generally single family in character. The existing area is considerably
developed and the existing street pattern due to topographical constraints provides
no access to the rear portion of the subject site.
15. The Comprehensive Plan designates the area in which the subject site is located for
single family uses.
16. Both park (Philip Arnold) and educational facilities are located within one mile of
the subject site.
17. The existing dwelling intrudes into what would be the required five foot side yard
of Lot 1 . The applicant proposes removing a small addition which would eliminate
the side yard violation.
CONCLUSIONS:
1 . The short plat proposed by the applicant appears to serve the public use and interest.
The site is close to both schools and parks, and is within walking distance of
oownt.own Renton. The proposed subdivision is compatible with both the existing
zoning in the area and the Comprehensive Plan.
2. The subdivision will permit the development of three additional single family units
in the city and will expand the tax base by such additions.

3. The exceptions requested by the applicant appear justified. The large lot is quite
deep, 300 feet, and the existing street pattern and surrounding dwellings .coupled
with topography provides no access to the rear. The pipestem exception will permit
the applicant to reasonably develop the interior portion of the subject property.
4. Permitting the single pipestem easement alternative will confine traffic to one
driveway rather than two, and will therefore lessen the impact of the pipestem
exception on neighboring property.
5. The proposed narrow width of the pipestem will require a hammerhead turnaround for
the use of emergency vehicles and the Fire Department should approve any such
turnaround.
6. Since the property is located on a hillside, storm drainage plans must be approved
by the Public Works Department.
7. The existing dwelling must be altered to provide the required side yard and eliminate
the violation on Lot 1 .
DECISION:
Exhibit #4 is approved subject to:
1 . Approval of a hammerhead turnaround by the Fire Department.
2. Approval of storm drainage plans by the Public Works Department.
3. Alteration of the existing building on Lot 1 to conform with the side yard requirements
of the Zoning Code.

Pursuant to Title IV, Section 3015 of the City's Code, request for reconsideration must
be filed in writing on or before August 15, 1980. Any aggrieved person feeling that the
decision of the Examiner is based on erroneous procedure, errors of law or fact, error
in judgment, or the discovery of new evidence which could not be reasonably available at
the prior hearing may make a written request for review by the Examiner within fourteen
(14) days from the date of the Examiner's decision. This request shall set forth the
specific errors relied upon by such appellant, and the Examiner may, after review of the
record, take further action as he deems proper.
An appeal to the City Council is governed by Title IV, Section 3016, which requires that
such appeal be filed with the City Clerk accompanying a filing fee of $25.00 and meeting
other specified requirements. Copies of this ordinance are available for inspection in
the Finance Department, first floor of City Hall , or same may be purchased at cost in
said department.

Pursuant to the City of Renton ' s Environmental Ordinance
and the State Environmental Policy Act of 1971 , as amended ,
RCW 43-21C, the subject proposal is exempt from the
threshold determination of environmental significance.

1 . The subject proposal is consistent with the Comprehen-
sive Plan and existing zoning which designates
the site and surrounding areas as single family
residential .
2 . The proposal is compatible with adjacent single
family residential uses and similar subdivision
patterns in the area .
3 . The applicant has proposed a 4-lot short plat with
lots #2 and #3 designed as pipestem configuration.
Due to the location of an existing house on proposed
lot #1 and insufficient frontage along Renton Avenue
South , this request is necessary . As prepared ,
the four lots would meet the minimum requirements
of the Subdivision ordinance for size and frontage ,
if the exception standards (maximum 150 feet•,_:in
length and not less than 20 feet in width) are
approved for lots #2 and #3 . ( Section 9-1108-23F ( 3d )
4. Establishing a fully dedicated and improved public
street to the site is neither desirable nor practical
given the close proximity of surrounding single
family residences and the existing subdivision
pattern to the area (Section 9-1109-1A) . A related
pipestem exception (E-121-78 ) was approved by the
Hearing Examiner on February 14 , 1978 , for a nearby
parcel (424 Renton Avenue South) on property owned
by the applicant . (Section 9-1109-1B )
5 . An alternative to the pipestems of #3 above has
been submitted by the applicant . As proposed ,
it would establish two separate 10-foot wide pipestems
side-by-side to be utilized as a singular access
with easements granted for joint use by the owners
of lots 2 and 3 . Although this proposal is not
specifically provided for by ordinance , it may
be within the scope of the Examiner ' s discretion
to consider under Section 9-1109-1 . Granting the
request would not appear to be injurious to adjacent
properties or detrimental to the public welfare
(Section 9-1109-1C) . Given the existing situation
and topography of the subject site , it may well
be a better design for the property .

located within 300 feet of future buildings on

ment comment .

8 . The Engineering Division advises that additional
facilities for storm water runoff will have to
be provided as the properties develop .
9. The applicant has indicated by shading that portion
of the existing dwelling on lot #1 will be removed
to meet setback requirements (see map ) .
10 . All off-site improvements exist along the Renton
Avenue South property frontage .

Based upon the above analysis recommend approval b'f
the short plat and exception requests subject to :
1 . Provision of a pipestem and access as applied for
in the alternative as outlined In L-5 .
2 . Fire Department approval of the hammerhead turnaround
and hydrant location .
3 . Payment of system development charges as per #7 .
4. Provision of storm water facilities as per #8 .
5 . Removal of the portion of the existing dwelling
on lot #1 to meet setback requirements prior to
the filing of the Short Plat . This requirement
can not be bonded .

Dear Sirs:
I am in the process of short platting property I awn at 338 Renton
Avenue South. The property has an expansive vie-- , is close to Shopping
and public transportation, and in general is desirable residential property. •
It is large enough to provide four lots of greater size than zoning requires
and larger than most lots in the area. However, this property like many
others in the city, can only be developed through the use of o;nestem drive-
says--a full city street would leave the property unuseable. The develop-
ment of this property through pipestem is not injurious to the surrounding
properties and affords it the use enjoyed by similar neighboring pipestem
properties to the south.
The plat as drawn meets the requirements of the pipestem ordinance
and can be developed accordingly. However, the attached drawing providing
ten foot. pinestems with easements shows a better method of development while
accomplishing everyt'_i ng intended in a twenty foot elide pipestem. The dra•.;-
ing suggests two ten foot side adjoining oipestems to serve the easterly
lots--each giving an easement for ingress, egress and utilities over the
other's pipestem. Asphalt pavinr- would be installed over the center twelve
feet and a joint maintenance agreement provided.
This method of developing is more desirable than the double twenty foot
side alternative for the following reasons:
1. It minimizes ac-ess points to Penton Avenue South.
2. Rain -ater runoff is less due to less total. paved area.
3. Less excavation for drive :ays.
4. Less installation of utilities lines.
5. Greater emergency vehicle access due to wider single driveway.
6. Great"r size of the Neste'ly lots and therefore less drive.Ways
and more useable yard.
I was present at the City Council meeting a few years ago when the pipe-
stem ordinance was revised. At that time I was assured by Mr. Perry, the
sponsor of the revised ordinance, that its intent was rot to limit the rat-
ional development of -property but to provide flexible_ guidelines for its
development. I feel that t}-is property developed with the ten foot adjoining
pipestems falls within the intent of the pipestem ordinance and ;•rill be an
asset to the area.
