This is to notify you that the above referenced request, which was
approved subject to restrictive covenants as noted on the Examiner's
report of December 4, 1980, has not been appealed within the time
period established by ordinance. Therefore, this application is
considered final and is being submitted to the Planning Department
effective this date.
As you will note, Condition No. 3 of the Examiner's report requires
execution of restrictive covenants restricting division and development
of the subject property to the two lots approved by this subdivision.
This restriction should be placed directly on the short plat mylar.

SUMMARY OF REQUEST: The applicant requests approval of a two-lot short plat together
with an exception for a 20-foot pipestem lot and waiver of the
required off-site improvements.
SUMMARY OF ACTION: Planning Department Recommendation: Approval of, short plat and
exception; Denial of waiver.
Hearing Examiner Decision: Approval of short plat, exception
and waiver subject to restrictive covenants.
PLANNING DEPARTMENT The Planning Department preliminary report was received by the
REPORT: Examiner on November 18, 1980.
PUBLIC HEARING: After reviewing the Planning Department report, examining
available information on file with the application, and field
checking the property and surrounding area, the Examiner
conducted a public hearing on the subject as follows:
The hearing was opened on November 25, 1980 at 9:05 a.m. in the Council Chambers of the
Renton Municipal Building.
Parties wishing to testify were affirmed by the Examiner.
It was reported that the Hearing Examiner and the applicant had received and reviewed the
Planning Department preliminary report. Steve Munson, Planning Department, presented the
report, and entered the following exhibits into the record:

Responding to the Examiner's inquiry regarding existing uses to the east of the subject
site, Mr. Munson referred the question to the applicant. Responding was:

Mr. Brown explained that the property to the east contains the rear yards of residences
facing Meadow Avenue N. He objected to the Planning Department recommendation for denial
of the request for waiver, and advised that his previously approved short plat requests
had included approval of waivers subject to execution of restrictive covenants agreeing
to participate in any future LID in the area. The Examiner reported a recent determination
by the city that approval of a waiver should be unconditional because a number of people
have signed covenants and have retracted them when an LID was proposed. Mr. Brown pointed
out that a previously approved short plat in the area, Kelleher, was granted with
improvements waived, and because few sidewalks, curbs or gutters exist in the Kennydale
area, the improvements should be exempted. Responding to the Examiner's inquiry regarding
timing of latecomers fees, Roger Blaylock, Associate Planner, advised that the fees are
imposed at the time of building permit application.
The Examiner requested further testimony in support or opposition to the application.
Since there was no response, the hearing regarding File No. Short Plat 107-80 was closed
by the Examiner at 9:22 a.m.

FINDINGS, CONCLUSIONS & DECISION: Having reviewed the record in this matter, the Examiner
now makes and enters the following:
FINDINGS:
1 . The request is for approval of a two-lot short plat together with an exception to
permit a pipestem access and a waiver of the required off-site improvements.
2. The application file containing the application, SEPA documentation, the Planning
Department report, and other pertinent documents was entered into the record as
Exhibit Ul .
3. Pursuant to the City of Renton's Environmental Ordinance and the State Environmental
Policy Act of 1971 , R.C.W. 43.21 .C. , as amended, the subject proposal has been
determined exempt from the threshold determination by the Environmental Review
Committee, responsible official .
4. Plans for the proposal have been reviewed by all city departments affected by the
impact of this development.
5. All existing utilities are available and in close proximity.
6. The proposal is compatible with the required setbacks, lot coverage and height
requirements of Section 4-729 (G-7200; General ; Single Family Residential ; Minimum
Lot Size - 7,200 square feet). of Title IV, Ordinance No. 1628, Code of General
Ordinances.
7. The subject property is located in the vicinity of 1401 N. 34th Street in the
Kennydale area of the city. /
8. The +.89 acre lot is currently undeveloped and is covered with scrub grass and some
deciduous and evergreen trees.,
The subject lot is about 129 feet wide with frontage on N. 34th Street and about
303 feet deep.
The applicant proposes dividing the lot-,into two lots. Lot A with 108.5 feet of
frontage along N. 34th Street would be approximately 16,000 square feet in area.
Lot B would have a pipestem access 20 feet wide by 150 feet deep and a lot area,
not counting the pipestem, of approximately 20,000 square feet.
9. The short subdivision is requested pursuant to Section 9-1105. The exception to
allow the pipestem access is requested pursuant to Sections 9-1108(23) (F) (3) (d) and
9-1109.
10. Section 9-1108(23) (F) (3) (c) requires lots to be no less than 60 feet wide and
Section 9-1108(23) (F) (3) (a) permits lots to be no deeper than 2-1/2 times their
respective widths.
11 . The applicant has requested a waiver of the required off site improvements pursuant
to Section 9-1105(6) (B) based on the contention that no similar improvements have
been installed in the vicinity and the residents of the area have recently defeated
an LID for similar improvements in the area.
12. The Planning Department recommended that the waiver for the off site improvements
be denied since such improvements will be required in the future, and delaying such
improvements only increases the eventual costs.
13. The Fire Department indicated that due to the construction of a pipestem access
an emergency vehicle turnaround will be required on Lot B subject to that department 's
approval .
14. The pipestem entry is adjacent to the rear yards of the easterly residences which
front on Meadow Avenue N.
15. A waiver of off site improvements was granted on the Kelleher Short Plat (File No.
Sh. Pl . 058-80) located southwest of the subject property.
16. The Traffic Engineering Division has indicated that a fee of $20 per vehicle trip
generated by the development of this parcel is required for the off site improvements
of roadways in the vicinity of the subject property. Each lot is expected to generate
10 vehicle trips based on standard trip generation data for a total fee of $400.00.

CONCLUSIONS:
1 . The proposed short subdivision appears to serve the public use and interest . The
division will provide two lots on which two new single family homes will eventually
be constructed. This development will both increase the tax base of the city and
increase the availability of housing in the city.
The two new lots in this area will also result in in-filling in the Kenndale area
and prevent premature development in areas still unserviced by utilities and roads.
2. The pipestem access proposed for Lot B will enable this large interior lot to be
accessed. The pipestem is located along the rear yards of the adjacent easterly
homes and will not be located along a narrow side yard. The pipestem will not impair
these adjacent residents' quiet enjoyment of their respective. properties and will not
injure property values or be materially detrimental to the public health, safety and
welfare.
3. Similar pipestem driveways have been approved for other large lots to allow access
to interior parcels, and therefore the applicant is not being accorded a special
privilege.
4. While there is sufficient frontage along N. 34th Street to allow two 60-foot wide
lots these lots would be both long and narrow and violate Section 9-1108(23) (F) (3) (a)
which provides that lots must not exceed their width by more than 2-1/2 times. The
approximately 300 foot depth is five times the width. An exception would be required
from either the width/depth provision or the pipestem restriction, and the provision
of the pipestem results in a more suitable building site. The approximately 36,000
square foot lot is almost five times the zone's required 7,200 square foot lot area
and is in an area where many lots are only 5,000 square feet.
5. The exception will enable the applicant to develop his lot in a manner which is
compatible with other lots in the vicinity and provide the applicant with rights
afforded others in the area.
6. There are no off site improvements in the general vicinity, and therefore while the
city would like to see improvements made in the area for the general welfare, the
imposition of the burden of such installation for the relatively small area that will
be affected is unreasonable. Therefore, the requested waiver of the required off
site improvements is approved.
At the same time, further division of any portion of the subject property by the
applicant or his successors in interest would increase the density and impact on
N. 34th Street and should be prevented. Therefore, restrictive covenants shall be
required to prevent such division. Development will increase impact on the road
network in the area, and the $400 fee imposed to ensure improvement of these roads
should be provided to the city (Sections 9-1106(2) (E) and 9-1104(1) (A) ) .
DECISION:
Exhibit #2 is approved together with an exception to create a 20-foot pipestem for access
subject to the following requirements:
1 . Provision of an emergency turnaround subject to approval of the Fire Department.
2. Payment of a $400 fee for the off site improvement of the existing traffic ways in
the vicinity of the subject property.
3. Execution of restrictive covenants restricting division and development of the
subject property to the two lots approved by this subdivision.
The requested waiver of the required off site improvements is approved.

1. The proposed short plat is consistent with the
Comprehensive Plan and zoning designations of single
family for the site and surrounding area.
2. The proposal is compatible with the existing single
family uses adjacent to the subject site.

3. The size of the property is large' enough that the
proposed short plat can be considered a reasonable
use of the land. Lots A and B exceed the minimum
lot size requirement of the G-7200 zone and the
Subdivision Ordinance. Although the amount of
frontage on N. 34th Street is sufficient to meet
the 60-foot standard for each lot, the applicant
is seeking an exception to permit a 20-foot pipe-
stem configuration on proposed Lot "B" due to the
fact that standard 60-foot lots would exceed the
21 -foot (width x length) standard of Section 9-1108-23F3a) .
Strict application of the Subdivision Ordinance
would, therefore, not permit a short subdivision.
Given these circumstances, it would seem that resonable
justification can be supplied for the proposed
exception (Section 9-1109. 1A) .

an attempt to establish an LID An the area failed
on July 28, 1980. Other efforts have met similar
fates. Also; -on August 6 , 1980 the Hearing Examiner
granted a similar waiver request in the Kathleen
Kelleher Short Plat at N. 30th Street and Burnett
Avenue North within one-half mile to the southwest.
The waiving of public improvements only delays
the inevitable and adds to the ultimate cost to
the purchaser. Therefore, all off-site improvements
should be constructed now.
5. A vehicle turn-around will be required as per Fire
Department comments.
6. Utilities Engineering advises that the proposed
short plat will be subject to latecomer' s fees
of $1, 637. 66 for utility services. Systems Develop-
ment Charges for water and sewer will also apply
($ . 01/sq. ft. )
7. The Traffic Engineering Division indicates that
in order to accommodate new development, a fee
of $20 per average daily trip generated will be
assessed to pay the cost of off-site improvements.
In this case, the amount totals $400 (2 x 10 x
20) .
