REPORT AND DECISION .

LOCATION: Northwest corner of N. 24th Street and Meadow Avenue N.
SUMMARY OF REQUEST: The applicant requests approval of a proposed two-lot short plat,
a waiver of the required off-site improvements, and an exception
to the Subdivision Ordinance to permit a 30-foot wide street.
SUMMARY OF ACTION: Planning Department Recommendation: Approval with conditions.
Hearing Examiner Decision: Approval with conditions.
PLANNING DEPARTMENT The Planning Department preliminary report was received by the
REPORT: Examiner on January 14, 1981 .
PUBLIC HEARING: After reviewing the Planning Department report, examining
available information on file with the application, and field
checking the property and surrounding area, the Examiner
conducted a public hearing on the subject as follows:
The hearing was opened on January 20, 1981 at 9:07 a.m. in the Council Chambers of the
Renton Municipal Building.
Parties wishing to testify were affirmed by the Examiner.
It was reported that the Hearing Examiner and the applicant had received and reviewed the
Planning Department preliminary report. Roger Blaylock, Associate Planner,- presented the
report, and entered the following exhibits into the record:

The Examiner requested testimony by the applicant. Responding was:

Referencing staff comments which recommend widening the existing roadway pavement, Mr. Davis
clarified that the survey stakes on N. 24th Street are currently six inches from the existing
roadway blacktop, and it would appear that the blacktop on the south side of that 'roadway
is approximately five to six feet short. Referencing a staff comment from the Engineering
Division regarding installation of off-site improvements, Mr. Davis clarified that provision
of curbs would create an even narrower roadway, and street lighting currently exists adjacent
to N. 24th Street. He requested interpretation of the comment by the Traffic Engineering
Division regarding an assessment for future transportation improvements. Mr. Blaylock
explained the assessment which is based upon average daily trips generated from single
family residences in accordance to ITE standards of 10 per day, noting that only the
proposed residence will be assessed, not the existing residence. He also advised the
purpose of the assessment to assure future maintenance of the entire traffic system in the
city.
Referencing comments by the Police Department regarding future roadway improvements, Mr.
Davis indicated that he had no objection to participating in an improvement project if the
cost is consistently shared with all other homeowners utilizing the access road in the area.
The Examiner requested comments in support or opposition to the application. Since there
was no response, the hearing regarding File No. Short Plat 118-80 was closed by the Examiner
at 9:29 a.m.

FINDINGS, CONCLUSIONS & DECISION: Having reviewed the record in this matter, the Examiner
now makes and enters the following:
FINDINGS:
1 . The request is for approval of a two-lot short plat on approximately .45 acres, a
variance for access on a road of less than the required width, and a waiver of the
required off-site improvements.
2. The application file containing the application, SEPA documentation, the Planning
Department report, and other pertinent documents was entered into the record as
Exhibit #1 .
3. Pursuant to the City of Renton's Environmental Ordinance and the State Environmental
Policy Act of 1971 , R.C.W. 43.21 .C. , as amended, the subject proposal has been
determined exempt from the threshold determination by the Environmental Review
Committee, responsible official .
4. Plans for the proposal have been reviewed by all city departments affected by the
impact of this development.
5. All existing utilities are available and in close proximity.
6. The proposal is compatible with the required setbacks, lot coverage and height
requirements of Section 4-729, G-6000 (General ; Single Family Residential ; Minimum
lot size - 6,000 square feet) of Title IV, Ordinance No. 1628, Code of General
Ordinances.
7. The subject property is located in the lower Kennydale area of the city at 2407
Meadow Avenue N. at the intersection of Meadow Avenue N. and N. 24th Street. The
site was annexed into the city in 1959 and the current G-6000 zoning classification
was applied at that time.
8. An existing single family residence is located on the eastern half of the site. The
remainder of the site is typical of residential landscaping and is covered with lawn
grass and shrubs.
9. The applicant proposes dividing the subject property into two lots, Lots A and B.
Lot A would contain 8,110 square feet and Lot B, the site of the existing residence,
would contain approximately 11 ,390 square feet. The short plat is requested pursuant
to Section 9-1105 of the Subdivision Ordinance.
10. Meadow Avenue N. has a right-of-way of 50 feet. North 24th Street has a right-of-way
of only 30 feet, whereas a 50-foot right-of-way is required pursuant to Section
9-1108(7) (H) . The applicant has therefore requested a variance from the minimum
width standards pursuant to Section 9-1109.
11 . The applicant has also requested a waiver of the required off-site improvements
pursuant to Section 9-1105(6) (B) . The applicant has indicated that off-site
improvements are generally lacking in the area.
12. With the exception of Meadow Avenue N. , many of the streets in Kennydale are less
than the modern standard of 50-foot right-of-ways. The residence situated on Lot B
is only 19 feet from the north end of the N. 24th Street right-of-way. The residence
just west of Lot A is similarly only 19 feet from the current right-of-way. Standards
of 20 feet are currently required by Section 4-706(5) (c) .
13. Similar variances (formerly referred to as exceptions) have been granted for residences
located south and west of the subject site (Helen Shook; File No. Short Plat 199-78) .
14. There are few, 1if any, off-site improvements in the area surrounding the subject site.
The improvements which do exist are paved streets and street lighting.
15. The area is almost entirely zoned G-6000, and the Comprehensive Plan designates the
area in which the subject site is located as suitable for the development of single
family uses.
CONCLUSIONS:
1 . The proposed short plat appears to serve the public use and interest. The area is
designated for single family uses in the Comprehensive Plan and the division will
enable the applicant to add to the single family housing stock in the area.
Both of the lots exceed the 6,000 square feet required in the G-6000 zone and the
additional lot will be compatible with existing development in the area.

2. Many of the right-of-ways in lower Kennydale are less than the now required. 50-foot
width. Residences in the area are constructed on 30-foot right-of-ways and the setback
was determined on a 30-foot right-of-way. Further dedication of right-of-way will
further decrease the already non-conforming yards and will not in any appreciable
manner aid the flow of traffic. Since the areas on both sides of the subject site are
almost maximally developed, it will be difficult to widen more than the small section
of N. 24th Street immediately abutting the subject site. The road would have to jog
to its existing narrower width on either side of the subject site.
3. Allowing the establishment of one additional dwelling unit on a road of less than the
required width will not unduly injure neighboring properties nor will the public
welfare be adversely affected by the approval of the requested variance.
4. Similar variances have been granted in the Kennydale area because of the existing
narrow roads, and therefore the approval of the variance will not extend a special
privilege to the applicant.
5. There are few off-site improvements in the area. Those include paved right-of-way
and street lights. The requested waiver of some off-site improvements should be
granted. The applicant should pave those portions of N. 24th Street which remain
unpaved and the applicant should provide additional street lighting if the Engineering
Division so determines.
DECISION:
Exhibit #2 is approved.
The variance to build adjacent to a street with less than the required width is approved.
The waiver of off-site improvements is approved subject to paving N. 24th Street where
required and the installation of additional street lights.

decision of the Examiner is based on erroneous procedure, errors of law or fact, error in
judgment, or the discovery of new evidence which could not be reasonably available at the
prior hearing may make a written request for review by the Examiner within fourteen (14)
days from the date of the Examiner's decision. This request shall set forth the specific
errors relied upon by such appellant, and the Examiner may, after review of the record,
take further action as he deems proper.
An appeal to the City Council is governed by Title IV, Section 3016, which requires that
such appeal be filed with the City Clerk accompanying a filing fee of $25.00 and meeting
other specified requirements. Copies of this ordinance are available for inspection in

L. PLANNING DEPARTMENT ANALYSIS:

'4 . Regarding the Exception request, granting approval
for a 30-foot access street would be consistent
with street widths in the area. The existing steep
slope conditions to the south and west, together
with the location of 2 single family residences
only 19 feet from the right-of-way, present a unique
physical condition making a full street width
difficult.. The resulting limited potential for
development in the area due to the topography also
suggest that a full 50- foot street width is un-
necessary. (The Hearing Examiner granted a similar
• request in the Helen Shook Short Plat 199-78 to
the south on August 28 , 1978) .
5. The applicant has applied for a wavier of the required
off-site improvements. Recent short plats in the
area have varied somewhat regarding the range of
improvements required. In the Helen Shook Short
Plat 199-78 to the southwest the Hearing Examiner
waived the full range required improvements but
referred the applicant to the Public Works Department
for off-site improvements appropriate to serve
the plat 's lots . However, in the Jack Ring Short

the Examiner wavied all off-site improvements
subject to the applicant ' s execution of Restrictive
Covenants to participate on L.I.D. 's. Field
investigation of the subject site and area strongly
indicates that the full range of improvements probably
isn't appropriate. Therefore, the extent of the
improvements required should be limited to those
typically in the area. Specifically this would
consist of widening the pavement as required in
the Helen Shook Short Plat.

During the final analysis of the short plat , it was
determined that inadequate right of way was adjacent
to the subject site and that the street could not be
widdened without the lots becoming non-conforming.
The applicant has been informed that an exception
request to allow narrower public right of way will
have to. be processed. Therefore, the Planning Department
requests that the public hearing be closed and the item
continued indefinitely with new-legal notices published
and posted at the appropriate time.

Gentlemen : •
I am requesting the approval of a two lot short plat
with an exception for street width on N . E . 24th Street,
Subdivision Ordinance 9-1108-23A requires a minimum
street width of 50 feet. •
I currently own the property bordered on the east by
Meadow Avenue North and on the south by N . E . 24th
,Street . A survey of this area conducted in November
of 1980 shows that my current home which . is more than
40 years old . now sets just 19 feet from N . E . 24th
Street; additionally, the existing home on the west
side of the intended short plat area would be partially
taken if the street were enlarged to the 50 foot width .
This piece of property. sets between two existing homes
and is the only vacant area large enough to comply with
the minimum building lot size on the north side of N . E .
24th Street.
Within the past 12 months two new homes have been
built on the south side of N . E . 24th Street. I• feel
that I should enjoy the same privileges. that the new
home construction people enjoy.
I do not believe that granting this street width
exception would be detrimental to public welfare or
injurious to other property in the area .

Dear Mr. Davis:
Review' of your Short Plat 118-80 has revealed that the
street frontage on N.E. 24th Street does not meet the
minimum 50-foot width (50' ) required by Section
9-1108-23A of the Subdivision Ordinance. Since. N.E.
24th Street is only thirty feet wide, you will have to
file an Exception application. Enclosed is a copy of
the criteria which have to be justified in order for
an Exception to be approved. If the Hearing Examiner
does not approve the request, then you must dedicate
a twenty-foot (20' ) wide strip of your property to the
City to be improved as per City standards.
Due to this requirement for an Exception, your hearing
date will have to be postponed. Your timely application
and submittal of the Exception request will help expedite
your rescheduled hearing . If you have questions, contact
this office.
