WHEREAS , the owner( s ) of said described property desire to
impose the following restrictive covenants running with the land as
to use , present and future , of the above described real property .
NOW , THEREFORE , the aforesaid owner( s ) hereby establish ,
grant and impose restrictions and covenants running with the land
hereinabove described with respect to the use by the undersigned ,
their successors , heirs , and assigns as follows :

The owner( s ) of the above described property , their suc-
cessors , heirs and assigns , hereby agree and covenant to
participate in , sign a petition in support of , and accept
any future Local Improvement District ( LID) or city initia-
ted proposal , and pay their fair share therefore , for the
purposes of providing the necessary off-site improvements
required by the Renton Subdivision Ordinance . Said improve-
ments shall include but may not be limited to the installa-
tion of curbs , gutters , sidewalks , street paving , sanitary
sewers , storm sewers , undergrounding of utilities , and
street lighting .
These covenants are imposed in lieu of Section 9- 1105(6)
of Title IX of Ordinance #1628 of theCity of Renton . 111

DURATION
These covenants shall run with the land and expire on
December 31 , 2025 . If at any time improvements are
installed pursuant to these covenants , the portion of
the covenants pertaining to the specific installed improve-
ments as required by the Ordinances of the City of Renton
shall terminate without necessity of further documentation .
Any violation or breach of these restrictive covenants may be
enforced by proper legal procedures in the Superior Court of King
County by either the City of Renton or any property owners adjoining
subject property who are adversely affected by said breach .

Attached for recording with King County are the mylar
of the Bowen Short Plat and restrictive covenants .
We understand from the Public Works Department that a
bond has been posted by Mr . Bowen and the balance of
the $43 ,407 bond imposed is forthcoming from the
Vehicle Test company by 10 : 00 a.m. this date . On the
above premise , the Acting Public Works Director signed
the mylar and agreed that it could be forwarded for
recording.

Gentlemen:
This is to certify that Vehicle Test Technology, 1500 114th Ave. S.E. ,
Bellevue, Washington, 98004 has' the amount of Fourteen Thousand Dollars
($14,000.00) available in 'the 'Rainier Square Branch of Rainier National
Bank, Account Number 120-005-8164 as a guaranty that all improvements,
as required for short sub-division 138-81, will be completed.
Rainier. National Bank hereby agrees to pay the City of Renton, upon
demand, .up to the amount of $14,000.00 within six months if the improvements
on Grady Way between Thomas and Lind Streets adjacent to the Vehicle
Test Technology property have not been completed according to the
approved plans and profiles of the City of Renton. All work will be
subject to the approval of the Director of Public Works of the City of
Renton.
We further certify that all assignments, releases, signatures necessary
to transfer said $14,000.00 'to the City of Renton have been obtained.
We further agree to hold said $14,000.00 until we have a written release
from the Director, Department of Public Works.

unnecessary in that sufficient right-of-way has already been acquired.
Therefore, since the dedication is unnecessary, you.r request is
justified, and Condition No. 3 is deleted from the decision.

I hereby request for review your decision No. 3 of my short plat
application requesting a dedication of the northern 10 feet on
S.W. Street.
The Dedication of the northern 10 feet of the subject property would
be inconsistent with the City of Renton Street ordinance requiring
60 feet for collector arterials. The present 70 feet exist for only
230 feet between Thomas St. Going east to the Section line. From
Thomas going west to Powell street is only 60 feet.

Reading your findings and final decision on the above ref. short plat, I
find item #3 is not required.
Adequate right-of-way was already obtained in the Earlington Industrial
Park Nos. 1 and 2.

reclassified. The lot size proposed by the applicant though does exceed the iot size
required in the G zc, and therefore the proposed lo`- are an appropriate subdivision
of the property.
3. S.W. Grady Wuy is designated and serves as a major arterial functioning to carry
traffic efficiently through and around the downtown city business district. Further,
it also functions as an alternative to 1-405 which occasionally must be bypassed
because of severe traffic delays.
Since additional driveways intersecting a primary arterial only serve to increase the
accident potential and impede the steady flow of traffic, further driveways should be
limited or eliminated if possible to provide a safe corridor for vehicles. Therefore,
since the subject property has access to S.W. 10th Street, S.W. 10th Street should
serve as the access for the proposed lots with provisions for emergency access to
S.W. Grady Way if the Fire Department determines that that would be advantageous.
4. The dedication of additional right-of-way along S.W. 10th Street would eliminate the
current jog in the already dedicated public right-of-way and provide for a continuous
70 foot right-of-way on a street which will develop as a main link to the proposed
development further to the west as well as from the subject property toward Lind
Avenue S.W. and Rainier Avenue S. , both east of the subject site.
5. The applicant has failed to demonstrate justification for a waiver of the required
ofi-site improvements. Most of the area already has curbs and gutters. Sidewalks
will tie the development to existing and proposed development in the area and enable
people employed within the area and subject property to walk to shopping and food
service areas east of the subject site. Sidewalks will also provide pedestrian acces
to public transit which serves the area.
DECISION:
Exhibit ll2 is approved subject to:
1 . Provision of off-site improvements along both S.W. Grady Way and S.W. 10th Street;
such improvements to include but not be limited to curbs, gutters, sidewalks and
street lighting.
2. The execution of restrictive covenants permitting access for the subject site to be
via S.W. 10th S - - - • • S.W. Grady Way.
3. The dedication of the northern 10 feet of the subject property beginning at
Township 23 N, Range 4 E W.M. , and running to the eastern boundary of pro.• _ - 3.
Requirements denoted in Items 2 and 3 above shall be designated on the face of the plat .

FINDINGS, CONCLUSIONS & DECI N: Having reviewed the recorl i this matter, the Examiner
now makes and enters the foliuwing:
FINDINGS:
1 . The request is for approval of a +3.32 acre three-lot short plat together with a
request for off-site improvements.
2. The application file containing the application, SEPA documentation, the Planning
Department report, and other pertinent documents was entered into the record as
Exhibit #1 .
3. Pursuant to the City of Renton's Environmental Ordinance and the State Environmental
Policy Act of 1971 , R.C.W. 43.21 .C. , as amended, the subject proposal has been
determined exempt from the threshold determination by the Environmental Review
Committee, responsible official .
4. Plans for the proposal have been reviewed by all city departments affected by the
impact of this development.
5. There was no opposition to the proposal expressed.
6. All existing utilities are available and in close proximity.
7. The subject property is located on the north side of S.W. Grady Way between Thomas
Avenue S.W. and Lind Avenue S.W. The site was annexed into the city by Ordinance No.
1745 in April of 1959 at which time the current G (General ; Single Family Residential ;
Minimum lot size - 35,000 square feet) zoning was applied.
8. The southern portion of the site is a Puget Power transmission line corridor, but the
site is otherwise undeveloped. The site is covered by scrub brush and blackberry
bushes and slopes downward from the south to the north.
9. The Comprehensive Plan designates the area in which the subject site is located as
suitable for the development of manufacturing types of uses. The current G zone
would only permit the development of single family residences on 35,000 square foot
lots unless the site is reclassified for some other more intensive use.
10. Pursuant to Section 9-1106, the applicant has applied for a short plat to create three
lots, with Lot 1 containing approximately one acre and Lots 2 and 3 each containing
approximately 1 . 159 acres.

approximately 860 feet of frontage along S.W. 10th Street. The right-o - - or
S.W. 10th Street is 70 feet adjacent to proposed Lot 1 and 60 feet adjacent to he
remainder of the property. Dedication of 10 feet would eliminate the jog in t

12. S.W. Grady Way is designated as a primary arterial which functions to route traffic
around and through the downtown area rather than serving as local access. S.W. Grady
Way also serves as a bypass for traffic detouring off of a congested 1-405.
The Traffic Engineering Division indicated that each additional driveway intersecting
a primary arterial increases the accident potential along the roadway and further
delays the flow of traffic on such roadways. The Traffic Engineer therefore
recommended that access to the site be limited to S.W. 10th Street.
13. The applicant has applied for a waiver of the required off-site improvements. Curbs
and gutters already have been installed along streets in the area and new development
in the area is providing the normal complement of improvements such as curbs , gutters ,

SUMMARY OF REQUEST: The applicant requests approval of a three-lot short plat
together with a waiver of the required off-site improvements
on property to be used for future commercial purposes.
SUMMARY OF ACTION: Planning Department Recommendation: Approval of short plat
with conditions; Denial of waiver.
Hearing Examiner Decision: Approval of short plat with restrictions
to be designated on the face of the plat; Denial of waiver.
PLANNING DEPARTMENT The Planning Department preliminary report was received by the
REPORT: Examiner on January 21 , 1981 .
PUBLIC HEARING: After reviewing the Planning Department report, examining
available information on file with the application, and field
checking the property and surrounding area, the Examiner
conducted a public hearing on the subject as follows :
The hearing was opened on January 27, 1981 at 9:00 a.m. in the Council Chambers of the
Renton Municipal Building.
Parties wishing to testify were affirmed by the Examiner.
It was reported that the Hearing Examiner and the applicant had received and reviewed the
Planning Department report. Roger Blaylock, Associate Planner, presented the report, and
entered the following exhibits into the record:

The Examiner requested testimony by the applicant. Responding was:

Mr. Bowen advised that the purpose of the waiver request was due to a concern regarding
provision of sidewalks which he felt are unnecessary on S.W. 10th Street. He noted that
the Duane Wells office building, north of the subject site, had not provided sidewalks.
Since future improvement of Grady Way is uncertain at this time, Mr. Bowen indicated
willngness to participate' in pedestrian improvements if warranted, but he felt that
sidewalk improvements are unnecessary on S.W. 10th.
The Examiner requested testimony in support or opposition to the application. There was
no response. He then requested testimony by the Traffic Engineer regarding impact of
driveway cuts onto access roads from the proposal . Responding was:

Mr. Norris stated that because Grady Way is beginning to serve as a bypass for FAI-405,
it was the desire of the department to limit access to S.W. 10th Street to assure efficient
movement of traffic along the Grady Way corridor. He noted that each additional driveway
access impedes traffic movement, causes delays, and increases accident potential to
vehicles, and the primary consideration on major arterials is to move traffic and not to
provide local access. Responding to the Examiner's inquiry regarding the recommended
number of driveways to S.W. 10th Street, Mr. Norris indicated that any number would be
allowed.

Referencing previous discussion regarding limiting access off of Grady Way, Mr. Bowen
requested that the access decision be delayed until improvement of Grady Way is proposed
in order to determine the effect on the subject site, although he advised that primary
access is proposed to S.W. 10th Street because of existing congestion on Grady Way.
Responding to the Examiner' inquiry regarding the time frame for the Grady Way improvement
project, Mr. Norris advised that although no date is specified, as new development occurs
in the area, assessments will be made against developments for improvements to maintain
the existing level of service.
The Examiner requested further comments. None were offered. He then requested additional
time of 21 days in which to publish a decision to allow for upcoming vacations. There was
no objection. Since there were no further comments, the hearing regarding File No. Short
Plat 138-80 and W-002-81 was closed by the Examiner at 9: 19 a.m.
FINDINGS, CONCLUSIONS & DECISION: Having reviewed the record in this matter, the Examiner
now makes and enters the following:
FINDINGS:
1 . The request is for approval of a +3.32 acre three-lot short plat together with a
request for off-site improvements.
2. The application file containing the application, SEPA documentation, the Planning
Department report, and other pertinent documents was entered into the record as
Exhibit #1 .
3. . Pursuant to the City of Renton's Environmental Ordinance and the State Environmental
Policy Act of 1971 , R.C.W. 43.21 .C. , as amended, the subject proposal has been
determined exempt from the threshold determination by the Environmental Review
Committee, responsible official .
4. Plans for the proposal have been reviewed by all city departments affected by the
impact of this development.
5. There was no opposition to the proposal expressed.
6. All existing utilities are available and in close proximity.
7. The subject property is located on the north side of S.W. Grady Way between Thomas
Avenue S.W. and Lind Avenue S.W. The site was annexed into the city by Ordinance No.
1745 in April of 1959 at which time the current G (General ; Single Family Residential ;
Minimum lot size - 35,000 square feet) zoning was applied.
8. The southern portion of the site is a Puget Power transmission line corridor, but the
site is otherwise undeveloped. The site is covered by scrub brush and blackberry
bushes and slopes downward from the south to the north.
9. The Comprehensive Plan designates the area in which the subject site is located as
suitable for the development of manufacturing types of uses. • The current G zone
would only permit the development of single family residences on 35,000 square foot
lots unless the site is reclassified for some other more intensive use.
10. Pursuant to Section 9-1106, the applicant has applied for a short plat to create three
lots, with Lot 1 containing approximately one acre and Lots 2 and 3 each containing
approximately 1 . 159 acres.
11 . The property has approximately 870 feet of frontage along S.W. Grady Way and
approximately 860 feet of frontage along S.W. 10th Street. The right-of-way for
S.W. 10th Street is 70 feet adjacent to proposed Lot 1 and 60 feet adjacent to the
remainder of the property. Dedication of 10 feet would eliminate the jog in the
right-of-way in this vicinity.
12. S.W. Grady Way is designated as a primary arterial which functions to route traffic
around and through the downtown area rather than serving as local access. S.W. Grady
Way also serves as a bypass for traffic detouring off of a congested 1-405.
The Traffic Engineering Division indicated that each additional driveway intersecting
a primary arterial increases the accident potential along the roadway and further
delays the flow of traffic on such roadways. The Traffic Engineer therefore
recommended that access to the site be limited to S.W. 10th Street.
13. The applicant has applied for a waiver of the required off-site improvements. Curbs
and gutters already have been installed along streets in the area and new development
in the area is providing the normal complement of improvements such as curbs, gutters,

sidewalks and street lighting. The applicant has requested the waiver pursuant to
Section 9-1105(6) (B) , citing the lack of necessity for such improvements in this area
of the city, especially along S.W. Grady Way.
CONCLUSIONS:
1 . The proposed plat with access limited to S.W. 10th Street appears to serve the public
use and interest. The proposed lots are each an acre or more in size which can
accommodate smaller manufacturing types of uses compatible with the Comprehensive Plan' s
designation of property in this area for such manufacturing uses.
2. The G zoning currently in effect limits the potential uses of the property. In order
to develop uses compatible with the Comprehensive Plan the property would have to be
reclassified. The lot size proposed by the applicant though does exceed the lot size
required in the G zone and therefore the proposed lots are an appropriate subdivision
of the property.
3. S.W. Grady Way is designated and serves as a major arterial functioning to carry
traffic efficiently through and around the downtown city business district. Further,
it also functions as an alternative to 1-405 which occasionally must be bypassed
because of severe traffic delays.
Since additional driveways intersecting a primary arterial only serve to increase the
accident potential and impede the steady flow of traffic, further driveways should be
limited or eliminated if possible to provide a safe corridor for vehicles. Therefore,
since the subject property has access to S.W. 10th Street, S.W. 10th Street should
serve as the access for the proposed lots with provisions for emergency access to
S.W. Grady Way if the Fire Department determines that that would be advantageous.
4. The dedication of additional right-of-way along S.W. 10th Street would eliminate the
current jog in the already dedicated public right-of-way and provide for a continuous
70 foot right-of-way on a street which will develop as a main link to the proposed
development further to the west as well as from the subject property toward Lind
Avenue S.W. and Rainier Avenue S. , both east of the subject site.
5. The applicant has failed to demonstrate justification for a waiver of the required
off-site improvements. Most of the area already has curbs and gutters. Sidewalks
will tie the development to existing and proposed development in the area and enable
people employed within the area and subject property to walk to shopping and food
service areas east of the subject site. Sidewalks will also provide pedestrian access
to public transit which serves the area.
DECISION:
Exhibit #2 is approved subject to:
1 . Provision of off-site improvements along both S.W. Grady Way and S.W. 10th Street;
such improvements to include but not be limited to curbs, gutters, sidewalks and
street lighting.
2. The execution of restrictive covenants permitting access for the subject site to be
via S.W. 10th Street and prohibiting all but emergency access to S.W. Grady Way.
3. _ The dedication of the northern 10 feet of the subject property beginning at
Township 23 N, Range 4 E W.M. , and running to the eastern boundary of proposed Lot 3.
Requirements denoted in Items 2 and 3 above shall be designated on the face of the plat.

are required on S.W. Grady Way and S.W. 10th Street.
For these reasons and the fact that the applicant
has not cited substantial examples of other waivers
or lack of improvements in the area, it would appear
that justification for the request is insufficient.
Traffic congestion and vehicular movements in this
area have increased substantially during the past
3 years . Traffic capacity on Grady Way is near
critical levels , especially approaching Lind Avenue
S.W. S.W. 10th Street although currently lightly
traveled will be significantly impacted by future
development to the west of this proposal. Without
adequate provision for pedestrian and vehicular
movements on Grady Way and S.W. 10th Street abetting
this plat, the public interest and particularly
safety will not be served. The waiver of improvements
should be denied.
5 . Suitable utilities are available to the subject
site, although storm drainage on the north and
south sides of the property will have to be extended
the length of -Ehe site to the westerly boundary.
