SUBJECT: Damage to Significant Trees - Mitigation
Enclave at Bridle Ridge – LUA14-000241
Albacore ACH, LLC (Albacore) applied for, and was issued, a permit by the Community &
Economic Development (CED) Department under LUA14-000241 for the Enclave at Bridle
Ridge plat development. During that development, Albacore caused damage to five (5)
significant trees in violation of Renton Municipal Code (RMC) 4-4-130, Tree Retention &
Land Clearing Regulations.
At the time of the damage, RMC 4-4-130H.1.e.iii authorized a payment in lieu of
replacement trees in an amount determined by the city, if the CED Administrator
determined it was infeasible to replace the trees on the site. Such payment was to be
paid into the City’s Urban Forestry Program fund. CED has determined that it is infeasible
to replace the trees on the site.
In 2022, RMC 4-4-130 was amended to add subsection J.4 related to Violations & Penalties
for Tree Removal Mitigation which added a paragraph (RMC 4-4-130.J.4.e) for a tree
replacement fee-in-lieu with substantially the same requirements of the previous code
language.
There is code-based language supporting the assessment and acceptance of the above-
noted fee in lieu. There is an existing City Account number associated with the program
fund referenced in the code language. Taken together, and as further described above,
the fee in lieu payment of $15,545.25 originally deposited by Albacore ACH LLC and held
in the City’s special deposit account (650.000000.000.237.00.00.000) should be
transferred into the Urban Forestry Program fund (316.332017.020.345.81.00.000).
