We’ve taken the time to present this request to city staff, and they agree with the requested amendments. Principal, Senior Project Engineer April 13, 2023 Alex Morganroth City of Renton 1055 South Grady Way Renton, WA 98057 Re: Towns on 12th, PR22-000160 Request for Reconsideration Dear Alex Morganroth: After reviewing the Hearing Examiners Decision for Towns on 12th, I believe that there is an erroneous condition, as well as a condition that requires clarification. In order to correct the record, I am requesting that the city review my concerns and, if the city is in agreement with the requested revisions and clarifications, I would like your support of the request for reconsideration I intend to file. We are generally in agreement with the conditions as written but believe the requested changes will correct the record and provide clarity. The Hearing Examiner’s conditions in question are as follows: Condition of approval number 6: Condition as currently written: The Applicant shall either retain additional trees or plant new trees to meet the minimum tree density for the parent site. In addition, the Applicant shall substitute native large-stature native tree species such as Western red cedars, Douglas fir, and Western hemlock or similar for at least half of replacement trees identified on the landscape plan. The Applicant shall demonstrate compliance by submitting an updated tree density calculation. The retained or new trees shall be shown on an updated Detailed Landscaping Plan submitted with the civil construction permit application for review and approval by the Current Planning Project Manager prior to civil construction permit issuance. Prior to the hearing, the city confirmed that this project is vested to the previous tree code. Under this tree code, tree density requirements are exempt within the RMF zone. For clarification, we request the condition be amended as follows: The Applicant shall either retain additional trees or plant new trees to meet the minimum tree density for the parent site area of the parent site within the R-10 zone. The Applicant shall demonstrate compliance by submitting an updated tree density calculation. The retained or new trees shall be shown on an updated Detailed Landscaping Plan submitted with the civil construction permit application for review and approval by the Current Planning Project Manager prior to civil construction permit issuance. Condition of approval number 16: Condition as currently written: The Applicant shall record a public access easement over the all pathway connections on the site, except for those not located in a common open space area or tract. Prior to the hearing this Staff recommended condition was discussed with City and it was determined that public access easements are needed for the connection of Road A to Sunset Blvd. The remaining pathways within the common open space tracts will be private for use of the Homeowners and guests. The wording of the condition is confusing and leads to concern over its interpretation in the future. In order to clarify the intent of the condition, we are requesting it be amended as follows: The Applicant shall record a public access easement over the all pathway connections on the site from the Road A Right of Way to NE Sunset Blvd. except for those not located in a common open space area or tract. Private Access will be provided within common open space tracts for the homeowners and guests. Based on prior discussions with the city, I trust that the amendment of the conditions above meet with the city’s understanding and intent and am, therefore, requesting city support of the formal request for reconsideration that will be filed.
