Subject: Shoreline Substantial Development Permit Timing Letter
PR19-000306 Cedar River Apartments / LUA19-000161, ECF, SSDP, SA-M
Dear Ms. Liaw:
Thank you for your recent letter for PR19-000306 Cedar River Apartments (LUA19-000161) regarding the timing
of the Shoreline Substantial Development Permit (SSDP). SRMRenton LLC has applied for a civil construction
permit (C21005135) and a building permit (B21000429) to construct Phase I and Phase II of the project, which
includes improvements subject to the SSDP. As indicated in your letter, SRMRenton, LLC is not anticipating
issuance of permits until January 2024.
Per WAC 173-27-130, the SSDP for Cedar River Apartments was filed with the Department of Ecology and the
Attorney General on September 9, 2021. In accordance with Renton Municipal Code (RMC) 4-9-190.J.9, the
effective date of a substantial development permit is the date of filing as provided in RCW 90.58.140(6). However,
the permit time period does not include the time needed to obtain any other government permits and approvals
for the development to proceed. Therefore, the duration of the SSDP will be effective following the issuance of
the project’s civil construction permit or building permit.
Finally, the standard period of validity allows the city to authorize a single extension for a period not to exceed
one year based on reasonable factors and other conditions per RMC 4-9-190.J.6.
