grant and impose restrictions and covenants running with the land
hereinabove described with respect to the use by the undersigned ,
their successors , heirs , and' assigns .as follows :
INSTALLATION OF OFF-SITE IMPROVEMENTS
The owner( s ) of the above described property , their suc-
cessors , heirs and assigns , hereby agree and covenant to
participate i n , sign a petition in support of , and accept
any future Local Improvement District ( LID) or city initia-
ted proposal , and 'pay their fair share therefore , for the
purposes of providing the necessary off-site improvements
required by the ,Renton Subdivision Ordinance . Said improve-
ments shall include but, may not be limited to the installa-

Referencing Section 0.3 of Exhibit #1, Mr. Smith noted that with the exception of the
property to the south, the proposal is consistent with surrounding developments. He .
corrected Section 0.8, first line, ". . .660 feet longer. . . " to read ". . .100 to 150 feet
longer. . . ". Regarding Section 0.12, Mr. Smith noted that because of the narrow width
between the paved area and the property line at the extreme end of the cul-de-sac, the

a suitable buffer of landscaping and evergreen trees to be provided between the
proposed development and the neighboring residences. He stated his request that the

was necessary for the deviation. He reported an addition by the Utility Division to

investigated with the Public Works Department. He also indicated departmental concurrence
in Exhibits #4 and #5 as submitted.

The Examiner asked the applicant if he concurred in Exhibit #1. Responding was:

Mr. Chastain indicated his concurrence in the report. He advised that the storm drainage
system design as well as calculations for storm drainage and retention had been submitted
to the Public Works Department and utility connection would be made to the plat of
Glencoe No. 2 on the east,side of the property. He concurred in requirements established
in restrictive covenants for provision of a 10-foot screening easement along all rear
lot lines on the north, east and south boundaries for the purpose of providing privacy
to adjacent residences, and reported the applicant's intent to provide a well-planned
development which would be an asset to the area.
The Examiner asked for testimony in support or opposition to the application. There was
no response. Mr. Chastain asked for clarification of Exhibit #4, and Mr. Smith reported
that the Storm Water Management Agreement for the May Creek Drainage Basin required
signatures from all property owners in the area to agree to participate in future storm
drainage local improvement districts if they are deemed necessary. He provided a copy
of the agreement to Mr. Chastain. Regarding proposed improvements along Union Avenue N.E.
south from Glencoe No. 5, Mr. Chastain asked Mr. Smith to interpret ownership responsibility
for the proposed improvements. Mr. Smith noted the location of the proposed improvements
in relationship with the proposed plat and Glencoe No. 5, and the Examiner advised that 1
because Tract A owned by Mr. Lowell Weinberg had been included in the plat of Glencoe
No. 5, the matter of responsibility for improvements was a private matter and not germane
to the subject of the public hearing.
Regarding recommendations specified in Section 0.12 and P.5 of Exhibit #1 relating to
location of the proposed sidewalk adjacent to the curb, the Examiner asked Mr. Smith
to explain how the recommendation interfaced with the 10-foot screening requirement.
Mr. Smith felt that a 10-foot screening requirement would preclude the necessity for
the proposed revision in location of sidewalks because it would provide sufficient
buffer for vehicle headlights between the traveled area between the cul-de-sac and
adjacent properties to the north. '
The Examiner asked Mr. Chastain if the 10-foot landscape easement on the rear of all lots
extended across the northern tip of .the cul-de-sac. Mr. Chastain was uncertain that the
width of the easement would accommodate a 10-foot landscape buffer in addition to other
proposed improvements because of the narrow width at the terminus of the cul-de-sac. Mr.
Smith advised that the proposed sidewalk would utilize five feet, and noted that a
requirement for a cyclone fence imposed during approval of Glencoe No. 5 should be
reviewed in relationship to compatibility with the proposed landscaped area at the
northern end of the cul-de-sac.
The Examiner asked Mr. Smith if provisions in the Subdivision Ordinance would normally
require installation of sidewalks on both sides of the cul-de-sac. Mr. Smith responded
affirmatively and noted the possibility existed to eliminate the requirement for
sidewalks at the extreme end because lots did not radiate from the terminus and access
was not required abutting the cul-de-sac. The Examiner asked Mr. Smith if the
Subdivision Ordinance allowed the Examiner flexibility to deviate from the ordinance
without an application for exception. Mr. Smith indicated that although the ordinance
did not contain specific recommendations regarding such flexibility, he noted certain
circumstances, such as instigation by the staff and not the applicant, to allow for
deviation for certain design specifics. He referred to Section 4-3010. (B) , Land Use
Hearing Examiner Ordinance, which states that the Examiner may recommend or require
such conditions and modifications to applications as are necessary to ensure compatibility
with the environment and carry out the goals and objectives of the comprehensive plan,
zoning ordinance, subdivision ordinance and other ordinances of the city. Mr. Smith
felt that an interpretation of the ordinance may be necessary by the City Attorney, and
noted that testimony had been received at the public hearing regarding the matter to
enable the Examiner to review the alternative if the procedure was determined possible.
The Examiner asked the representative for the applicant if he had further questions. Mr.
Chastain indicated his concurrence in the revision to eliminate sidewalks at the terminus
of the cul-de-sac and stated his preference for a 10-foot landscape buffer at that
location.
The Examiner asked Mr. Smith for additions, corrections or revisions to Exhibit #1. Mr.
Smith noted the previously discussed •revision to Section P.5 relating to the proposed
sidewalks at the extreme end of the cul-de-sac which would include a provision to expand
the planter area. He suggested that the Engineering Division as well as the City Attorney

be contacted regarding review of the matter.
The Examiner advised that although the public hearing on this matter would be closed,
memoranda clarifying the Examiner's scope of authority in the matter of revising
sidewalk and buffer configurations would be transmitted to the Public Works Department
and the City Attorney, and responses to these inquiries would be incorporated into the
final decision on the application. He asked Mr. Chastain if he concurred in the
proposal. Mr. Chastain indicated his concurrence.
The Examiner asked for further comments. Since there werecnone, the hearing on
Item #PP-132-78 and E-137-78 was closed by the Examiner •t 10:10 a.m.
FINDINGS, CONCLUSIONS & RECOMMENDATIONS: Having reviewed the record in this matter,
the Examiner now makes and enters the following:
FINDINGS:
1. The request is for approval of the preliminary plat of 14 single family lots and
an exception for a 660-foot cul-de-sac.
2. The Planning Department report accurately sets forth the issues, applicable policies
and provisions, findings of fact, and departmental recommendations in this matter,
(is uncontested) , and is hereby attached as Exhibit #1 and incorporated in this
report by reference as set forth in full therein.
3. Pursuant to the City of Renton's Environmental Ordinance and the State Environmental
Policy Act of 1971, as amended by R.C.W. 43.21.C. , a Declaration of Non-Significance
has been issued for the subject proposal by Gordon Y. Ericksen, responsible official.
4. Plans for the proposal have been reviewed by all city departments affected by the
impact of this development.
5. There was no opposition to the proposal expressed.
6. All existing utilities are available and in close proximity.
7. The proposal is compatible with the required lot area and lot dimension of
Sections 4-729(G) , 4-706(R-1) , and 9-1108.23.F of Title IV, Ordinance No. 1628,
Code of General Ordinances.
8. Off-site improvements have not been deferred by the Board of Public Works per
Sections 9-1106. 3.H and 9-1108.21.
9. The Comprehensive Plan Land Use Map indicates single family land use for this area.
10. The proposed right-of-way and street improvements meet the requirements of
Section 9-1108.7.
11. Off-site improvements in Union Avenue N.E. are required for that portion adjacent
to the proposal. In the development of the plat of Glencoe Division No. 5 to the
north off-site improvements include Tract A, Mr. Weinberg's property.
12. A storm water drainage plan has been submitted to the Public Works Department.
13. Restrictive Covenants were submitted (Exhibit #5) .
14. According to testimony and Exhibit #1 an alternative to the long cul-de-sac exists.
The cul-de-sac could be made conforming to the 500-foot limit of Section 9-1108.7.K. ,
but this would create at least two pipestem lots accessing to the end of the cul-de-
sac.
15. Property frontage along Union Avenue N.E. is 286.5 feet which would permit two
lots (80-foot width each - Section 9-1108.23.F. (b) ) and two streets (50-foot width
each - Section 9-1108.7.H) with 26.5 feet remaining. This configuration would
provide a loop road to serve most of the property.
Access is prohibited to the east and north by existing development of Glencoe Divisions
No. 2 and 5. Three separate properties are located south of the site, through which
the applicant testified of access in that area being "unfeasible" (Exhibit #7) .

16. No other points of access to the property exist except from Union Avenue N.E.
17. On some portions of the site exist substantial trees.
18. The street names should be changed to N.E. 22nd Place (formerly N.E. 22nd Street) and
Vashon Court (formerly Union Court) .
19. Exhibit #3 includes a 10-foot screening easement around the perimeter of the site,
except for the easterly boundary of Tract A, westerly boundary along Union Avenue N.E. ,
and northerly boundary adjacent to the end of the proposed cul-de-sac.
20. A distance of approximately ten feet separates the end of the cul-de-sac from the
northerly property line abutting Glencoe Division No. 5. Section 9-1108.7 requires
that within this distance be constructed a five-foot sidewalk and four-foot planter
strip. Exhibit #3 shows compliance with this requirement.
Staff recommended that the sidewalk be deleted along this portion of the cul-de-sac
and replaced by additional landscape screening.. According to the attached
memorandum of March Zl , 1978 from the City Attorney, the Examiner is prohibited
from reviewing the recommendation unless an exception application has been filed
and heard. No such application has been submitted.
21. The agreement with King County to participate in the May Creek Drainage Program has '
not been signed, similar to Glencoe No. 5.
CONCLUSIONS:
1. The proposal conforms to the Comprehensive Plan Goals and Objectives and Land Use
Map.
2. The proposal appears to serve the public interest, health, safety and welfare
(Section 9-1106.2.E. (2) ) .
3. Except for the length of the cul-de-sac; the plat conforms to Chapter 11 and
zoning requirements.
4. Existing vegetation on the site should be retained as much as possible to implement
the proposed 10-foot perimeter screening easement (Exhibit #3) and to be included
in the lots.
5. This property configuration is unusual in its constraints imposed upon the
configuration of the access road. However, it was not demonstrated that this
"special physical" circumstance ". . .would deprive the applicant of the reasonable
use or development of his land. . . " (Section 9-1109.1.A) . Use or development is
possible with a different configuration of the lots and access road that may
require less of an exception request from the length of the cul-de-sac. However,
it is obvious that these other alternatives would only create the need for an
exception to allow pipestem lots. Of the two exceptions, in this instance, the
long cul-de-sac appears more appropriate in terms of producing a more typical
subdivision which is more consistent with the pattern of adjacent development.
No testimony was presented that the exception is necessary to preserve the
applicant's rights and privileges (Section 9-1109.1.B) .
That the exception would not be a detriment to the public or other properties was
not shown (Section 9-1109.1.C) . However, it appears clear that in this instance
detriment or injury would not occur.
Therefore, it seems reasonable and appropriate to grant the exception as requested.
RECOMMENDATION:
Based upon the record, testimony, findings and conclusions, it is the recommendation of
the Examiner that the City Council approve the preliminary plat of. Windstar subject to:
1. Installation of off-site improvements.
2. Approval of the storm drainage plan by the Public Works Department.
3. Changing the street names to N.E. 22nd Place and Vashon Court.
4. Signing of May Creek Drainage Basin Service Agreement (Exhibit #4) .

5. Retention of as many of the significant trees as possible. Removal of trees is to
be coordinated with and approved by the Planning Department.
6. Implementing these conditions in or before the final plat application.
Furthermore, it is the decision of the Examiner to approve the requested exception to
allow a 660-foot cul-de-sac.

During the public hearing on the preliminary plat application, No.
PP-132-78, the issue arose as to whether the Examiner possessed the
authority under Section'4-3010. (B) .1 to deviate from the preliminary
plat requirements of the Subdivision Ordinance, Chapter 11, without
an application for and review of an exception per Section 9-1109.
Section 4-3010. (B) ._1 clearly provides the Examiner the authority to
impose conditions upon an application in response to the specific
circumstances involved. The issue is the character of these .
conditions. Does this section alone permit making less restrictive
or deviating from the requirements of Chapter 11? Or does this
section merely allow the Examiner to stipulate conditions in
addition to the requirements of Chapter 11?
My evaluation of the issue is that only through the exception process
(Section 9-1109) can the requirements of Chapter 11 be deviated from
or made less restrictive. An application must be filed and a public
hearing ,held therein in order for the Examiner to so act. Section •
4-3010. (B) .1 does not replace or precede Section 9-1109.
Furthermore, Section 4-3010. (B) .1 permits imposing only conditions
which are.more restrictive than or in addition to the requirements
of Chapter 11. Do you concur?
Since the public hearing on the subject preliminary plat .was held on
March 7, 1978, I will need your response by March 15 or sooner, if
possible, to integrate it into my decision which is due March 21,
1978.

I have your memo of March 8, 1978 re: Scope of Examiner' s
Authority under Section 4-3010. (B) for reply.
This will confirm our telephone conversation of March 16, . 1978
in which I advised you that we concur with your opinion that
the Hearing Examiner does not have jurisdiction to impose
conditions less restrictive then the requirements of Chapter 11
of the Subdivision Ordinance in the absence of a formal
application for exception.

Section 4-3010 (B) states in part:
"Conditions , modifications and restrictions which may be
imposed are, but are not limited to additional set backs,
screenings in the form of landscaping and fencing, covenants,
easements and dedications or additional road rights of way
(emphasis added)
It ' is clear from the language of Section 9-1109 (2) that an. •
exception may be considered by the Hearing Examiner only after
formal application to the Planning Department. Therefore, in
the absence of such application', the Hearing Examiner has
jurisdiction only to impose conditions , modifications and
restrictions which are mare restrictive than the requirements
of Chapter 11.

2 . Soils : Alderwood Gravelly Sandy Loam (AgC) . Permeability is
moderately rapid in the surface layer and subsoil and very slow
in the substratum. Runoff is slow to medium, and the hazard of
erosion is moderate. This soil is used for timber, pasture ,
berries , row crops , and for urban development.
3. Vegetation : The majority of the site consists of sparse ground
cover with small stands of Douglas fir trees scattered through-
out the site.
4. Wildlife: The existing vegetation of the site provides a suit-
able habitat for birds and small animals .
5. Water: There is no evidence of standing surface water on the
site.
6. Land Use : The surrounding area is predominantly single family
residential in nature, with scatterings of undeveloped parcels .
F. NEIGHBORHOOD CHARACTERISTICS:
The area is primarily a mixture of single family residential with
numerous undeveloped parcels scattered throughout the site .
G. PUBLIC SERVICES :
1. Water and Sewer: An existing 6 inch water main runs along
N. E. 24th Street, while the Mercer Island Pipeline operates
along Union Avenue N. E. Eight (8) inch sanitary sewers are
located along N. E. 24th Street and Union Avenue N. E .
2 . Fire Protection : Provided by the Renton Fire Department as per
ordinance requirements .
3 . Transit: Metro Transit Routes 42 and 242 operate along Edmonds
Avenue N. E. and Union Avenue N. E. approximately one and one-
fourth ( 14) miles to the southeast of the site.
4. Schools : Sierra Elementary School is located approximately
one-eighth ( 1/8) of a' mile to the northwest, McKnight Middle
School one mile to the southwest , and Hazen Senior High School
approximately two-thirds (2/3 ) of a mile to the northwest of
the subject site.
5. Parks : Kiwanis Park is situated approximately one mile to the
south while the proposed neighborhood is to be located one-
fourth (4) of a mile to the northwest. In addition , the recre-
ational playfields of McKnight Middle School and Hazen Senior
High School are available for organized recreational activity.

J . IMPACT ON THE NATURAL SYSTEMS:
Transition of the subject site from its current state to 14 single
family residential units will disturb soil and vegetation and
increase storm water runoff. These impacts will be minor in nature
and can be alleviated through proper development controls .

Additional social interactions within the neighborhood will result
from the development of the subject site to single family residential .

0. PLANNING DEPARTMENT ANALYSIS:
1 . The proposed plan is consistent with the Comprehensive Plan
Land Use Element, which designates the site and area for single
family residential land use.
2 . The proposed plat is consistent with objectives number 4 and
number 6 of the Comprehensive Plan Land Use Report, 1965 , pages
17 and 18, and the existing single family residential uses in
the general vicinity.
3. The proposed plat meets or exceeds all zoning and subdivision
ordinances ' requirements relating to minimum lot size ( 7200
square feet ) and dimensions . Corner lots have been platted
larger than interior lots per Section 9- 1108F(4) .
, 4 . Proposed street widths and improvements meet ordinance require-
ments . However., improvements should be installed as part of
this plat along Union Avenue N. E. so that there are continuous
improvements from N. E. 24th Street and Glencoe No. 5 south to
southerly boundary of the subject plat.
5 . Complete engineering design drawings for utilities and storm
drainage will be required before commencement of any construc-
tion and prior to final plat approval .
6. Storm drainage and retention calculations will be required as
part of design approval by the Public Works Department. Oil /
water separators are also required by ordinance.
7. The Building Division has street name corrections to be made
on the plat. N. E . 22nd Street shall be N. E. 22nd Place , and
Union Court shall be Vashon Court N. E.

8. Theroposed cul -de-sac is approximately 660 feet longer than
the 500 feet maximum allowable length established in the ordi -
nance . The applicant has applied for an exception to the ordi -
nance for the proposed cul -de-sac .
9. The subject site abuts Glencoe Division No. 2 on the east and
Glencoe Division No . 5 on the north , neither of which provides
any street access to the subject site. The property to the
south is not of sufficient size or shape to provide a reason-
able continuation of a street, if one were stub-ended at the
south property line of the subject site.
10. If the proposed cul -de-sac were shortened to meet the 500 foot
maximum length , pipestem lots would be necessary to develop
the property between the end of such a cul -de-sac and the ,
northerly property. This situation would also create an
unusual configuration for Lot No. 11 .
11 . The actual number of lots served by the additional 160 feet of
cul -de-sac length is less than what would normally be the case
because the cul -de-sac abuts adjacent property and Tract "A"
instead of lots being locatedi entirely around the cul -de-sac .
Only two additional lots are served along the 160 extra feet
( lots 9 and 10) . It can be reasonably assumed that even if
the cul -de-sac were 500 feet in length , at least two pipestem
lots could be created at the end of the cul -de-sac . The pro-
posed cul -de-sac provides better access to these lots .
12. The sidewalk at the end of the proposed cul-de-sac should be
placed adjacent to the curb and evergreen trees planted n
the planter area to provide a buffer between the proposed
street and adjacent single family residential lots .
13. An additional partial cul -de-sac has also been provided at
the corner of N. E. 22nd Place and Vashon Court N. E. This
provides additional access and emergency circulation within
the subject plat.
14. Suitable utilities are available to the subject site.
15. A number of significant evergreen trees exist on the subject
site. These should be preserved and incorporated into plat
design development (Section 9- 1108. 19. B) .
P. PLANNING DEPARTMENT RECOMMENDATION :
Recommend approval of the proposed preliminary plat based on the
above analysis and the exception for the cul -de-sac length as
proposed subject to the following conditions :
1 . Provision of improvements along Union :Avenue N. E. for the
entire length between Glencoe Division No. 5 and the southerly
boundary of the subject site.
2 . Final approval by the Public Works Department of the detailed
plans for utilities and storm drainage as per ordinance require-
ments .
3. Preservation of as many significant trees as possible. Only
those trees directlywithin the proposed street right-of-way
or utility easements shall be removed as part of the plat
construction . No trees shall be removed without approval of
the Planning Department.

We respectfully request ,.an exception to the ordinance limiting
the length of a cul-de-sac to a maximun of 500 feet in length
for the following reasons.
The Plat of Glencoe Div. No. 5 abuts us on the North and the
Plat of Glencoe Div. No. 2 abuts us on the East. Neither of
these two plats provide any street access -pôint5that we could
connect to. The property to the South is presently divided into
three separate tax lots thereby making it unfeasible or necessary
to provide any direct street access to the South as any through,
street into these properties would be a detriment to any future
subdividing they may propose.
' In view of the above access limitations, imposed on this tract of
. land by adjacent developments, it would appear the only reasonalble
way to provide access to our subject plat and---allow reasonable
development is by means of a cul-de-sac which is approximately
600 feet in length.
I trust the foregoing is an adequate 'explanation of our request
for an exception to your ordinance. If you have any questions

Reference is made to your letter dated December 23, 1977, regarding
theWINDSiAR TENTATIVE 'PLAT NO. 0J3-77, which has been submitted to your
Office by Mr, George Oberholtzer,
Reference is also made to my visit to your Office on January 9, 1978
regarding the above mentioned Plat .. During this visit, I advised that I
did not desire to have the remaining unsold portion of tax lot #9036
designated "10t number 15" on the Preliminary Plat, as stated in paragraph
4 of your above referenced letter, for the following reasons:
(a) I do not intend to have the remaining, unsold portion of tax lot
n9036 platted at this time, or in the near forseeable future .
(b) The Recorded Glencoe Division #5 Final Plat Drawing, (-Sheet #2 of
2) , designates the remaining unsold portion of tax lot #9036, TRACT "A"
Weinberg Property. This designation must be retained.
You agreed with me that the requirement of paragraph 4 of your letter
of December 23, 1977, would be revised to designate the remaining unsold
portion of tax lot #9036 as TRACT "A" Weinberg Property, on the preliminary
plat map, drawing.
Mr. Oberholtzer visited my home on the afternoon of January 9, 1978..
During this visit, your letter of December 23, 1977, and the WIi'DS AR
TENTATIVE PLAT 'Drawing (Sheet #1 of 1) , and also the recorded McGrath
Development Corporation, Glencoe Division #5 Plat Drawing (Sheet #2 of 2),
Final Plat, were reviewed by him, myself, and my wife. Mr. Oberholtzer
agreed with me and my wife that the extent of the Preliminary Wi1'DSTAR PLAT
would be limited to the 14 lots as shown on my drawing, dated March 21, 1977,
latest revision September 26, 1977, which shows my property tax lots #9036
& #9040. It was also agreed that the Preliminary Plat Drawing of the proposed

Dear Mr. Oberholtzer:
The various municipal departments have reviewed the proposed
tentative plat and approved it subject to the following con-
ditions :
1 . The proposed cul -de-sac exceeds the maximum 500
foot cul -de-sac length established in -the Subdivi -
sion Ordinance . Written request for an exception
tc the Ordinance explaining the rationale for such
request must be submitted to the Hearing Examiner
at the time of preliminary plat approval applica-
• tion.
2 . The sidewalk at the end of the cul -de-sac should
be designed against the curb with the planter
strip located between the sidewalk and north
property line . This area should be planted in
evergreen trees as part of plat improvements to
provide an adequate buffer between the proposed
cul -de-sac and the residential lots to the north .
3 . Streets and utilities plans , together with various
utility charges , should be coordinated with the
Utilities and Engineering Divisions .
4. The lot with the existing residence must be
designated as lot number 15 on the preliminary
plat map .
5 . All existing trees shall be retained on the site
and incorporated as much as possible into all phases
of plat design and construction . No clearing and
grading of the site shall commence until after
preliminary plat approval .
