Praperty's drainage facilit�es are shown and/or listed on Exhibit A—Site Plan. The Property's
drainage facilities shall be maintaineci in compliance with the operation and maintenance
schedul2 included and attached herein as Exhibit B—Operatians and Maintenante. Drainage
facilities include pipes, channels, flaw control facilities, water quality facilities, on-site best
management practices [BMPS) and other engineered structures designed to manage and/or

treat stormvtirater on the Property. On-sita BMPs include dispersion and infiltration de�ices,
bioretention, permeable pavements, rainwater harvesting systems, tree retention eredit,
reduced impervious sur�ace footprint,vegetated roofs and other measures deseg�ed to mimic
pre-developed hydrology and minimize stormwater runoff an the Praperty.
2, City of Rentan shall have the right to ingress and egress over those portions of the Property
necessary to perform inspections of the starmwater facilities and BMPs and conduct
maintenance acti�ities specified in th'ss Declaration of Covenarat and in accordance with the
Renton Municipal Code.City af Renton shall provide at least thirty(30)days'written notice to
the Owners that entry on the Property is planned for the inspection of drainage facilities.After
the thirty(30) days,the Owners shall allow the City of Renton to enter for the sole purpose of
inspecting drainage faeilities. In lieu of inspection by the City,the Owners may elect to en�age
a licensed ci�il engineer registered in the state of Washingtan who has expertise in drainage to
inspect the drainage facilities and provide a written report describing #heir condition. If the
engineer aption is chosen,the Owners shall provide written notice to the City of Rentan within
fifteen(15)days of receiving the City's notice of ins�ection.Within thirty(30)days of giving this
notice,the Ow�ers,or engineer on hehalf of the Owners,shall provide the engineer's report to
the City of Renton. If t�e report is not pravided in a timefy manner as specified above,the City
of Rento� may in5�ect the drainage facilities without further notice.
3. If City of Renton determines from its inspection, or from an enginee�'s report provided in
accordance with Paragraph 2,that maintenance, repair, restoration,and/or mitigation work is
required to be done to any of the drainage facilities, City of Renton shall notify the Owners of
the specific maintenance, re}�air, restoratian, and/or mitigation worfc ("Work") required
pursuartt to the Renton Municipal Code. The City shall also set a reasonable deadline for the
Owners to camplete the Work, or to prorride an engineer's report that verifies completion of
the Work. After the deadline has passed, the Owners shall allow the City access to re-inspect
the drainage facilities unless an engineer's report has been provided �erifying campletion of
the Work. If the Work is not completed within the time frame set by the City, the City may
initiate an enforcement action and/or perform the Work and hereby is gi�en actess to the
Property for such purposes. Written notice will be sent to the Owners sta#ing the City's
in#ention to perForm such Work.This Work will nat commence until at ieast seven(7)days after
such notice is mailed. If, within the sole discretion of the City, there exists an imminent or
present danger, the seven (7) day notice period will be waived and Work will begin
immediately.
4. The Qwners shall assume all responsibility for the cost of any Work,or any measures taken by
the City to address canditions as described in Paragraph 3. 5uch responsibility shall include
reimbursement to the City within thirty(30J days of the receipt of the invoice for any such Work
perFormed. Overdue payments will require payment of interest at the maximum legal rate
allowed by RCW 19.52.020[currently twelve percent (12%)). If the City initiates legak action to
enforce this agreement, the prevailing party in such action is entitled to recover reasonable
litigation costs and attorney's fees.
5. The Owners are required to obtain written approval from City of Renton prior to fillir�g, piping,
cutting, or remo�i�g�egetation (except in routine kandscape maintenance) in opero vegetaied
stormwater facilities (such as swales, channel$, ditches, ponds, etc.), or performing any
alterations or modifications to the drainage facilities referenced in this Declaratian of Co�enant.

6. Any notice or consent required to be given or otherwise provided for by the provisions of this
Agreement shall be effec#ive upon personal deli�ery,orthree(3)days after mailing by Certified
Mail, return receipt requested.
7. With regard to the matters addressed herein,this agreement constitutes the entire agreement
between the parties, and supersedes all prior discussions, negotiations, and all agreements
whatsoe�er whether ora)or written.
8. T�is Declaration of Covenant is intended to protect the value and desirahility and promote
efficient and effective management of surface water drainage of the real property described
above, and shall inure to the bene#it of all the citizens of the City of Renton and its successors
and assigns. This Declaration of Covenant shall run with the land and be binding upon
Grantor(s},ar�d Grantor's(s')successors in interest,and assigns.
9. This Declaration of Covenant may be terminated by executian of a written agreement by the

Inspection Guidelines
Inspection Summary
o Inspect Pre-Treatment, BiofiEtration and Discharge CharrEbers—a�erage inspection interval is
6 to 12 months.
• (15-minute a�erage inspection time).
o N4TE: Pollutant loading varies greatly from site to site and no two sites are the sarrie.
Therefflre, the first year requires inspection monthly during the wet seasan and every ather
month during the dry season in order to observe and record the amount of pollutant loading the
system is recei�ing.
InSpeCtiOn aVervieW
As with all stormwater BMPs inspectian and maintenance on the MWS Linear is necessary.
Starmwater regulations require that a11 BMPs be Enspected and maintained t� ensure they are
operating as designed to allow for effectirre pollutant removal and pro�ide pratection to receiving
water bodies. It is recommended that inspeckions be performed multiple times during the first
year to assess the site specific loading canditions. This is recommended because pollutant
loading and pollutant characteristics can vary greatly from site to site. Varia3�les such as near�y
soil erosion or construction sites, winter sanding on roads, amount of dai[y traffic and land use
can increase pollutant loading on the system. The first year af inspections can be used ta set
inspection and maintenance intervals for subsequent years to ensure appropriate maintenance
is provided. Without appropriate maintenance a BMP will exceed its storage capacity which can
negatively affect its continued performance in removing and retaining captur�d pollutants.
Inspection Equipment
Following is a list of equipment to allaw for simple and effective inspectivn of the MWS Linear:

The core to any successful stormwater BMP maintenance program is rautine inspections. T�e
inspection steps required on the MWS Linear are quick and easy.As mentianed above the first

more frequent inspections should occur in order ta gather loading data and maintenance
requirements for that specific site. This information can be used to establish a base for iong
term inspection and maintenance interval requirements.
The MWS Linear can be inspected tha�agh �isual observat€on withaut entry into tf�e system. All
necessary pr�-inspection steps must be carried out before inspection occurs, especially traffic
contral and other safety rr�easures to pratect the inspector and near-by pedestrians from any
dangers assaciated wit� an apen access hatch or rnanhole. Once these access covers have
been safely opened the inspection process can proceed:
• Prepare the inspection form by writing in the necessary information incEudir�g project name,
location, date &time, unit number and other info (see inspection form).
• Observe the inside o�the system through the access hatches. If minimal light is aVailable and
vision into t�e �nit is impaired utilize a flashlight to see inside the system and afl of its
chambers.
• Look for any out of the ordinary obstructions in the infiow pipe, pre-treatment chamber,
biofiltration chamber, discharge chamber or outflow pipe. Write down any observations on the
inspection farm.
� Through observation andlor digitak photographs estimaie the amount of trash, debris and
sediment accumulated in the pre-t�eatment chamber. Utilizing a tape measure or measuring
stick estimate the amount of trash, debris and sediment in this chamber. Record tF�is depth on
the inspection form.
• Through visual observation inspect the candition of t�e pre-�Iter cartridges. Look for
excessive buikd-up of sediments on the cartridges, any build-up on the top of the cartridges, ar
clogging
of the holes. Record this information on the ins�ection form. The pre-#ilter cartridges can
further be inspected by removing the cartridge tops and assessing t�e color of the

BioMediaGREEN filter cubes (requires entry into pre-treatment chamber—see nates above
regarding confned space entry�. Record the color of the material. New material is a light green
in color. As the media becomes clogged i#will turn darker in color, eVentually becoming dark
brown or black. Using the below color indicator reco�d the percentage af inedia exhausted.
• The biofiltrakion chamber is generally maintenance free due to the system's ad�anced
pretreatment chamber. For units which have open planters with vegetation it is recommended
that the Vegetation be inspected. Look for any plants that are ciead ar showing signs of disease
or other negative stressors. Record the general health of the �lants on the inspection and
indicate through �isual observation or digital photographs if#rimming of the vegetation is
needed.
• The discharge chamber houses the orifice control structure and is connected ta the outflow
pipe. It is impartant to check to ensure the orifice is in proper operating conditions and free of
any obstructions. Generally, the discharge chamber wili be clean and free af debris. Inspect
the water marks an the side walls. if possible, inspect the discharge chamber during a rain
event tfl assess the amaunt of flow lea�ing the system while it is at 'E00°/a capacity (pretreatment
chamber water level at peak HG�}. The water level of t�e flowing water should be
compared to the watermark level on the side walls which is an indicator of the highest
discharg� rate the system achieved when initially installed. Record on the form is there is any
differer�ce in level fram watermark in inches.

• NOTE: During the first few storms the water level in the outflow chamber should be
observed and a 6" �ong harizontal watermark line drawn (using a large perrnanent marker} at the
water IeVel in the discharge chamber while the system is operating at 100% capacity. This line
is a reference point for future inspections of the systern:
• Water level in the discharge chamber is a functian af flow rate and pipe size. Observation of
water level during the first few months of operation can be used as a benchmark level for
future inspectians. The initial mark and all future observations shall be made when system is
at 100% capacity (water level at maxir�-�um level in pre-treatment chamber). If future water
levels are below this mark when syskem is at 'f00% capacity this is an indicator that
maintenance to the pre-filter cartridges may be needed.
• Finalize inspeckion report for analysis by the maintenance manager to determine if
maintenance is required.
Using a perrrEanent marker draw a 6 inch-long horizontal line, as shown, at the
higher water level in the MWS Linear discharge chamber.

Maintenance Indicators
Based upan observations made during inspection, maintenance of the system may be required
based on the following indicators:
• Missing or damaged internal components or cartridges.
• Obstructions in the system ar its inlet or outlet.
• Excessive accumulation of floatables in the pre-treatment chamber in which the length and
width of the chamber is fully impacted more than 18".
• Excessive accumulation af sediment in the pre-treatment chamber of more than 6'° in depth.
• Excessive accumulation of sediment on the BioMediaGREEN media housed within the
prefilfer cartridges. The following chart shows photos of the candition of the BioMediaGREEN
contained within the �re-filter cartridges. Wher� media Es more than 85% clogged replacement
is required.
• Overgrown vegetatian.
• Water le�el in discharge chamber during 'f00% aperating capacity (pre-trea#ment chamber
water IeVel at max height) is lower than the watermark by 20%.
Inspection Notes
1. Following maintenance andlor inspection, it is recommended the maintenance operator
prepare a maintenance/inspection recard. The record should include any maintenance
activities perForrned, amount and description of debris collected, and condition o#the
system and i#s various filter mechanisms.
2. The owner should keep mainkenanc�linspection record(s) for a minimum of five years from
t�e date of maintenance. These records sho�ld be made available to the go�erning
municipality for inspection upon request at any#ime.
3. Transport all debris, trash, organics and sediments to appro�ed facility far disposal in
accordance with local and state requirements.
4. Entry into chambers may require confined space training based on state and local
regulations.
5. No fertilizer shall be used in the Biofiltration Chamber.
6. lrrigation should be pravided as recommended by manufacturer andlor landscape
architect. Amount of irrigation required is dependent on plant species. Some plants may
not re�uire irrigation after initial establishment.

Maintenance Overview
The time has come to maintain yaur Modular Wetiand System LFnear(MWS Linear}. To ensure
successful and efficient maintenance on the system we recommend the following. The MWS
Linear can be maintained by remo�ing the access hatches aver the systems various chambers.
A16 necessary pre-maintenance steps must b�carried oui before maintenance occurs, especially
tra�c control and other safety measures to protect the inspector and near-by pedestrians from
any dangers associated with an open accass hatch or manhole. Once trafFic control has been
set up per local and state regulations and access covers have been safely opened the
maintenance process can begen. It should be noted that sorne maintenance acti�ities require
confined space entry. A11 confined space requirements must be strictly followed befare entry into
the system. ln addition, the following is recammended:
• Prepare the mai�tenance farm by writing in the necessary infor�nation including project
name, location, date &time, unit number and ather info (see maintenance form).
• Set up all appropriate safety and cleaning equipment.
• Ensure traffic control is set up and properly pasitioned.
• Pre}�are a pre-checks (OSHA, safety, confined s�ace entry) are performed.

Maintenance Equipment
Follawing is a list of equipment required for rr�aintenance of the MWS Linear:
• Modular Wetland Maintenance Form
• Manhole hook or appropriate tools to access hatches and covers
• Protective clothing, flashlight and eye protection.
• 7/16" open or closed ended wrench.
• Vacuum assisted truck with pressure washer.
• Replacement BioMediaGREEN for Pre-Filter Cartridges if required {order from
manufacturer).
Maintenance Steps
1. Pre-treatment Chamber (bottom of chamber)
A. Remove access hatch or manhole cover o�er pre-treatment c�amber and position �acuum
truck accflrdingly.
B. With a pressure washer spray down pallutants accumulated on walls and pre-filter
cart�idges.
C. Vacuum out Pre-Treatment Chamber and remove all accumulated pollutants including
trash, debris and sediments. Be sure to vacuum the floor until pervious pavers are visible
and clean.
D. If Pre-Filter Cartridges require media repEacement mo�e anto step 2. If not, replace access
hatch or manhole coVer.
Remo�al of access hatch to gain aocess below. Insertion af�acuum hose into separation
chamber.
Removal of trash, sediment and debr�s. Fully cleaned separation chamber.
2. Pre-Filter Cartridges (attached to wall of pre-treatment chamber)
A. After finishing step 'f enter pre-treatment chamber.
B. Unscrew the two bolts holding the lid on each car�ridge#ifter and remove lid.
C. Place the vacuum hose o�er each indi�idual media �lter to suck out flter media.
D. Once filter media has been sucked use a pressure washer to spray down inside of the
cartridge and it's containing media cages. Remove cleaned media cages and place to the
side. Once remo�ed the vacuum hose can be inserted into the cartridge to vacuum aut any
remaining material near the bottom of t�e cartridge.
