SUMMARY OF REQUEST: Application for site plan approval to allow construction of
two one-story buildings having approximately 11,688
square feet (6.475 square feet and 5.213 square feet) of
floor area on a 1.03 acre site.
SUMMARY OF ACTION: Approval.
COMMITTEE REVIEW: The review was conducted at 10:13 a.m. on Wednesday.
August 13, 1986 in the third floor conference room of the
Renton Municipal Building.
The Committee review was conducted after receiving written comment from all divisions
of the Public Works Department, both divisions of the Building and Zoning Department.
and the Fire, Police, Parks and Policy Development Departments.
The following exhibits were entered into the record:

FINDINGS, CONCLUSIONS AND DECISION
Having reviewed the written record in the matter, and conducted individual on=site
inspections by each member of the Site Plan Review Committee. the Site Plan Review
Committee now makes and enters the following:
Findings:
1. The applicant, Commercial Design Associates, Inc., for SCD, Inc., has requested site
plan approval to allow the construction of two one-story buildings totaling 11,688
square feet to be utilized for retail commercial activities on a 1.03 acre site.
2. The applicant's file containing the application, the State Environmental Policy Act
(SEPA) documentation, the comments from various City departments. the public
notices requesting citizen comment, and other pertinent documents was entered as
Exhibit No. 1.
3. Pursuant to the City of Renton's Environmental Ordinance and SEPA (RCW 43.21C
1971 as amended), a mitigated declaration of non-significance has been issued for
the subject proposal by the Environmental Review Committee, the responsible
official. The mitigated declaration of non-significance was based upon the modified
plans submitted by the applicant and the dedication of 90 feet of right-of-way for
the extension of S.W. 27th Street.

4. Plans for the proposal have been reviewed by all City departments affected by the
impact of this proposal. The City of Tukwila was also consulted in the review
process, and the applicant will be performing improvements to public streets located
in the City of Tukwila in addition to the City of Renton.
5. The subject proposal is consistent with the Comprehensive Plan designation of
Commercial for the subject site and the existing B-1, Business Use, zoning.
6. The site plan as presented provides sufficient,parking to comply with the Parking
and Loading Ordinance of the City of Renton.
Conclusions:
1. Proposal is a development consistent with policies. specifications, and codes of the
City of Renton.
' 2. Specific design issues raised by various City departments and the City of Tukwila
focus on:
a. Access onto West Valley Highway.
b. Possible future limitation of access onto S.W. 27th Street/Strander Blvd.
extension.
c. The widening of West Valley Highway.
d. Setback from West Valley Highway.
The applicant has agreed to cooperate with the City of Tukwila to add the necessary
lane widening to the City of Tukwila standards. In addition, the applicant
recognizes that the access onto West Valley Highway shall be limited to right-in and
right-out and that some modification of access onto the future S.W. 27th Street
could result from design limitations of the proposed street. It is also understood
that those design limitations are unknown and can only be addressed at the time of
construction of S.W. 27th Street. •
3. The proposal complies with the Comprehensive Plan designation of Commercial and
the present zoning classification of B-1, Business Use.
Decision:
The site plan, file SA-041-86 for Commercial Design Associates, SCD, Inc., is subject to
the following conditions: ,
1. Formal agreement with the City, of ;Tukwila to widen and improve West Valley
Highway per their approval.
2. • Limitation of the access onto West Valley Highway to right-in and right-out with
appropriate on-site design limitation per approval of the City of Renton Public
Works Department or street improvement limitation per approval of City of Tukwila
Public Works Department.
For the purpose of these decisions, the term "should" and "shall" are to be considered
mandatory and the term "may" is considered discretionary.

REQUESTS FOR RECONSIDERATION must be filed in writing on or before 5 p.m. on
Wednesday, September 3, 1986. Any aggrieved person feeling that the decision of the Site
Plan Review Committee is based on erroneous procedure, errors of law or fact, error in
judgment, or the discovery of new evidence which could not be reasonably available prior
to the meeting date of August 13, 1986 may make a written request to the Zoning
Administrator for review by the Site Plan Committee within fourteen (14) days of the
decision, which is Wednesday, August 20, 1986. This request shall set' forth the specific
errors relied upon by such appellant, and the Committee may, after review of the record,
take further action as it deems proper.
AN APPEAL TO THE HEARING EXAMINER is governed by Title IV, Section 3011(B)(1),
which requires that such appeals be filed directly with the Hearing Examiner. Appeals
must be made in writing before 5 p.m. on Wednesday, September 3, 1986.
THE APPEARANCE OF FAIRNESS DOCTRINE provides that no ex parte (private
one-on-one) communications may occur concerning land use decisions. This means that
parties to a land use decision may not communicate in private with any decision-maker
concerning the proposal. Decision-makers in the land use process for site plan approvals
include: (1) the Public Works Director, (2) the Building and Zoning Director, (3) the Policy
Development Director, (4) the Hearing Examiner, and (5) members of the City Council,
All communications after the decision date must be made in writing through the Zoning
Administrator. All communications are public record and this permits all interested
parties to know the contents of the communication and would allow them to openly rebut
the evidence in writing. Any violation of this doctrine would result in the invalidation of
the request by the Court.
The Doctrine applies not only to the initial Committee decision, but to all Requests for
Reconsideration as well as Appeals to the Hearing Examiner.

SUBJECT: Commercial Design Associates Site Approval
Thank you for the opportunity to review and comment. The checklist and
plans were circulated to each of the departments within the City. Enclosed
are their responses. I have summarized the impacts and the requested miti-
gating measures.
1. Dedicate 5-lane 75-foot right-of-way for Strander Extension dependent
upon property lines.
2. Improve Strander right-of-way to grades and design currently available.
3. Improve Strander and West Valley Highway intersection with:
a) rechannelization with left turn southbound.
b) pedestrian crosswalks east/west and south/north.
4. Improve east side of West Valley Highway with a seventh lane and
sidewalk. Sidewalk widths would be a minimum 8 feet without landscape .
buffer or a 6 foot sidewalk with a buffer.
5. Revise landscape plan for swales instead of berms to provide a
biofiltering system for surface water runoff.
6. Redesign location of West Valley Highway access point to the north of .
existing location and restrict to right in right out only.
7. Underground electric power lines adjacent to property lines.
8. Install water and sewer lines in accordance with City of Tukwila
Comprehensive Utility Plan.
9. Provide study of capacity of existing storm sewer system to handle site
runoff.
10. Provide a minimum setback of 20 feet on West Valley Highway, which is
the City' s minimum setback requirement. Twenty feet would create a
move uniform front along West Valley.

2. Right-of-way to be reserved for extension of Strander Blvd. easterly
from West Valley Highway.
3. Entrance roadway on Strander Blvd. must be designed to be compatible
with the intersection traffic signal operation and the traffic signal
may need to be modified to function with the new roadway entry. The
cost would need to be provided by the developer and the traffic signal
modification would have to meet City of Renton standards.
4. 0ff-site improvement will include provisions for future street lighting.
The provisions would be as follows:
a) Conduit run the full length of the property facing onto the roadway.
(Conduit type 1-1/2 inch schedule 40)
b) Conduit runs to terminate in junction boxes at locations determined
by City.
c) Conduit location to be per City standards ( location normally is under
the sidewalk) .

Enclosed for your review is a draft agreement between the City and
Glacier Park containing the provisions we've discussed.
I have incorporated the Examiner' s conclusions where appropriate,
but I would of course appreciate any thoughts you may have. I
have also added an item stating that the City would consider
vacation of the street if the arterial improvement is not built
and if future land use results in no need for the dedicated street
that is being built now. This tracks the concepts we' ve been
discussing,. but its absence seemed to be a loose end, especially
since it' s hard for any of us to predict exactly what the actual
land use and transportation will be twenty years from now.
I have not specifically addressed the question over where the plat
line is (center of road or one side of it) , or whether Tukwila
should acknowledge it as a signatory. We should mutually decide
how we want to handle these and conform the document accordingly.
If we are okay on the agreement' s provisions, we will request ESM
to provide the attachments.
You may recall that city staff recommended this agreement be
completed prior to filing of the plat and receipt of building
permits. This obviously places a high priority on prompt
completion of the agreement, as failure to do so will delay the
approved plat and project.
Please give me a call if you have any questions about the intent
or the drafting. I would also be glad to spend a few minutes
together to go over the document if it would speed the process.

AGREEMENT BETWEEN THE CITY OF RENTON
AND GLACIER PARK COMPANY
This AGREEMENT is made this day of , 1986 by and
between the CITY OF RENTON ( "City" ) , a municipality of the State
of Washington, and GLACIER PARK COMPANY ( "Property Owner" ) , a
corporation of the State of Deleware, their heirs, assigns, and
successors in interest.
I . RECITALS
1 . The Property Owner owns and is in the process of completing a
short plat for the real property depicted in Exhibit A attached
hereto ( "Property" ) .
2 . The Property Owner' s application to the City for a short plat
and for site plan approval for the development of a portion of the
Property for a restaurant has been approved with conditions_ by the
City Hearing Examiner in his Report and Decision on File No.
SA-083-85 and SP-084-85, dated May 16, 1986 ( "Hearing Examiner' s
Decision" ) , based on affirmative recommendations by the City' s
Building and Zoning Department and Environmental Review Committee
( "ERC" ) .

3 . In connection with its recommendations the ERC, as the City' s
responsible official under the State Environmental Policy Act,
evaluated an environmental checklist and issued a Determination of
Nonsignificance, which was accepted by the Hearing Examiner.
4. The decision to approve the proposals requires the Property
Owner and the City to enter into an agreement to implement certain
conditions.
5 . The City' s current Valley Comprehensive Plan, dated August
1985, reiterated the original 1965 Comprehensive Plan policy to
construct an arterial connecting S.W. 27th Street to West Valley
Highway at Strander Boulevard. A segment of this road project
would cross roughly the center portion of the Property (this
segment is referred to herein as the "Arterial Project" ) . The
project is currently designated in the third year of the City' s
Six Year Transportation Improvement Program 1986-1991 .
6. Discussions are underway between Renton and Tukwila
concerning realigning their boundaries, and the Property might be
affected by such modification.
7 . The City has determined that a ninety (90) foot right-of-way
would be needed to implement the Arterial Project.

8. It is not known at this time exactly whether, when, or how
the Arterial Project would be designed, financed, constructed, and
otherwise implemented.
9 . The Property Owner and the City have agreed that appropriate
provision should be made for possible future use of the Property
for purposes of implementing the Arterial Project and for
reversion of the property and related matters if the Arterial
Project is not implemented.
10. The Property Owner has agreed to refrain from developing a
ninety (90) foot wide portion of the property despite history and
uncertainty regarding the implementation of the Arterial Project.
11 . The Property Owner has further agreed to dedicate and
construct a new street at this time to mitigate current and future
traffic impacts of development on the Property.
12 . The Property Owner has agreed to bind itself and its
successors to the obligations in this agreement in the event of
annexation to Tukwila.
13 . The City has agreed to provide assurances to the Property
Owner regarding access, current roadway improvements, and future
land acquisition and road improvement costs.

14. The Hearing Examiner found there was no opposition from the
public regarding the subject proposal, that the proposal is
compatible with the comprehensive plan, and that the division,
with the proposed dedication and reservation, "is undoubtedly in
the public welfare" .
II . COVENANTS
NOW, THEREFORE, the Property Owner and City agree as follows:
1. Dedication. The Property Owner shall dedicate a sixty (60)
foot wide piece of property in an alignment approved by the
Department of Public Works for the possible future extension of
S.W. 27th Street to implement the proposed Arterial Project
( "Dedication" ) , as specified in the Hearing Examiner' s Decision.
The Dedication is illustrated on the map in Exhibit B attached
hereto.
2 . New Street. The Property Owner shall construct a half street
in the alignment in the Dedication and shall not be responsible
for the cost of signal modification, as specified in the Hearing
Examiner' s Decision. Certain roadway improvements, such as curbs,
gutters, and sidewalks shall be deferred until the implementation
of the Arterial Project. The street improvements are generally
illustrated on the map in Exhibit C attached hereto.

3 . Access. The City shall allow any property adjacent to the
new street in paragraph II . 2 or to that segment -of the Arterial
Project, if constructed, to have access to such roadways, subject
to reasonable requirements for curb cuts as may be determined by
the Public Works Director. If the Arterial Project is designed or
built at such a grade as to preclude direct access from the
adjacent properties, the City shall at its expense simultaneously
provide alternate access . Alternate access could include, but is
not limited to, allowing at least as much traffic to have direct
access to West Valley Highway as could have used the S.W. 27th
Street if the arterial were available for access.
4. Reservation. In addition to the Dedication, the Property
Owner shall reserve a total of thirty (30) feet adjacent to the
Dedication for possible future use by the City for the Arterial
Project ( "Reserved Property" ) . The Reserved Property will be
located in two fifteen ( 15) foot strips on each side of the
Dedication. The Property Owner will not construct any permanent
structures on the Reserved Property for the duration of the
reservation (paragraph II . 8 below) , unless prior written approval
is obtained from the Public Works Director.
5 . Future Property Acquisition. If the Arterial Project is
constructed, the City shall acquire the Reserved Property and any
other real property rights of the Property Owner at the fair
market value at the time of such acquisition. In any action to

condemn the Reserved Property or any parcel including any portion
of the Reserved Property, the unimproved value of such property
shall be determined without reference to the covenants contained
in paragraph II . 4, and such property shall be valued as if
unencumbered or benefits by such covenants.
6. Review of Arterial Plans. If the City proceeds with the
Arterial Project, the City will provide reasonable opportunity for
the Property Owner to review and comment on all engineering,
architectural, and other plans for the construction of the
Arterial Project and associated improvements ( such as lighting,
fencing, access, signage, drainage, and so on) , early enough in
the planning and design process for the City to make revisions
based on the Property Owner' s comments. The Property Owner will
have thirty (30) days to review such plans as they may be
submitted to the Property Owner from time to time .
7 . Arterial Expense. If the City implements the Arterial
Project, the Property Owner shall not be responsible for any of
the costs of said project and shall not be assessed for the same .
8. Reversion. If the City decides not to implement the Arterial
Project, or if the City does not implement the Arterial Project
within twenty (20) years from the date of this Agreement (which-
ever shall occur first) , the Reserved Property shall revert
unencumbered to the Property Owner. If the City decides not to

implement the Arterial Project, the City shall promptly amend its
comprehensive plan to delete the Arterial Project from said plan.
9 . Vacation. If the Reserved Property reverts or is likely to
revert to the Property Owner under paragraph II . 8, and if the
Property Owner desires to replat, rezone, or change the use of the
Property in such a way that the new street constructed under
paragraph II . 2 is no longer needed, the City agrees promptly to
reevaluate and consider a request for street vacation and
reversion of the Dedication to the Property Owner. If the street
is vacated, the Property Owner shall not be required to pay for
the cost of reacquisition.
10. Annexation. If any or all of the property subject to this
Agreement become annexed to the City of Tukwila or any other
jurisdiction, such jurisdiction shall be a successor in interest
to the City of Renton under the terms of this Agreement. The
obligations and covenants contained in this Agreement shall
continue to be binding on the Property Owner and on the annexing
jurisdiction. If an annexation is proposed or pending, the City
shall be responsible for entering this Agreement into the record
of such proceedings before the annexing jurisdiction and the
applicable Boundary Review Board or other reviewing body. The
City further agrees to testify in such proceedings in support of
the Agreement if necessary.

11 . Binding Covenants. These covenants and agreements shall run
with the land and shall be binding on all parties having or
acquiring any rights, title, or interest in any or all of the
Property described herein.

After reviewing our site approval application with the Owner, several minor
modifications became apparent. They are as follows:
1. Delete two of the maple trees on the west side of Building A. As presently
shown they would block the sign fascia, greatly hindering the leasibility
of the project.
2. Delete the note on Sheet 3 of 3 "Painted accent band". Because final
decision has not been made on the color selections, we do not want to
confuse you as to our intentions.
We would like this to be considered as an addendum to our site approval package
submitted on May 10, 1985. As you can see, these are minor but necessary
modifications. We hope this will not hinder your review process and that a
timely approval can be achieved.

Purpose of Checklist:
The State Environmental Policy Act (SEPA), chapter 43,21 C RCW, requires all
governmental agencies to consider the environmental impacts of a proposal before making
decisions. An environmental impact statement (EIS) must be prepared for allproposals
with probable significant adverse impacts on the quality of the environment. The purpose
of this checklist is to provide information to help you and the agency identify impacts
from your proposal (and to reduce or avoid impacts from the proposal, if it can be done)

Strander Junction

A. BACKGROUND
11. Construct and develop 6,475 sq. ft. and 5,213 sq. ft. one-story
retail buildings on a ± 44,987.5 square foot site located on
West Valley Highway adjacent to the Strander Blvd. Extension,
northeast corner.
12. LEGAL DESCRIPTION - See attached
B. ENVIRONMENTAL ELEMENTS
1. Earth.
e. The building area will need to be preloaded and structural
fill provided. The preload will be approximately 760 cubic
yards, and four feet deep. The structural fill 280 cubic
yards 2 feet deep. The source of the fill is as yet
undetermined. After preload is removed it will be returned
to source.
2. Air.
a. Emissions from heavy equipment should be generated during
construction activities. The exact quantity cannot be
determined at this time, but would be insignificant in
relation to the emissions generated by traffic traveling
on adjacent roads and highways. No significant emissions
are anticipated after construction is complete. HVAC systems
will be electrical heat pumps.
4. The site is presently pervious soil . Proposal will include
City 'of Renton approved stormwater detention system to collect
all storm water from new impervious areas and discharge the
stormwater into the existing storm sewer in the adjacent
right-of-way. Discharge will be slow enough to not overburden
the downstream drainage pattern. No surface water withdrawals
are anticipated.

ENVIRONMENTAL HEALTH
2. Noise generated during construction operations will be limited
to normal working hours only. There are no residential uses
within 1,000 feet of site. After construction, the only noise
generated will be from automobile traffic on and off the site.
The uses within the building will not generate significant noise.
LAND AND SHORELINE USE
1. Proposed use is consistent with existing comprehensive plan
and zoning. Although zoning is projected to be modified in
the near future, to disallow some retail uses, a rezone will
be requested at the opportune time to allow the uses to conform.
LIGHT AND GLARE
a. New building and parking lot lighting will be installed. This
would be controlled by a timer to be on during evening and
nighttime business hours. Security lighting on building would
remain on during nighttime hours. Fixtures would be oriented
so that glare is reduced to a minimum.
TRANSPORTATION
a. The site is bounded on the west by West Valley Highway and on
the south by the proposed Strander Blvd. Extension. The only
access to the site will be via a driveway at the northwest corner
of the site which accesses West Valley Highway and a driveway
long the south property line off of the proposed Strander Blvd.
Extension improvement required for this project.
