REPORT AND DECISION

block of East Valley Road.
SUMMARY OF REQUEST: Application for site plan approval to allow the
construction of a restaurant containing
approximately 14,174 square feet.
SUMMARY OF ACTION: Approval with conditions.
COMMITTEE REVIEW: The review was conducted at 11:15 a.m. on
Wednesday, August 13, 1986 in the 3rd floor
conference room of the Renton Municipal Building.
The Committee review was conducted after receiving written comments from all divisions
of the Public Works Department, both divisions of the Building and Zoning Department,
and the Fire, Police, Parks, and Policy Development Departments.
The following exhibits were entered into the record:
EXHIBIT Ill Yellow file containing application: proof of posting, publication, and
notification of adjacent property owners; along with other
documentation pertinent to this request.
EXHIBIT Ill Revised Site Plan (received August 11, 1986).
EXHIBIT #3 Building Elevation Plans (received June 18, 1986).
EXHIBIT #4 August 5,1986 Letter/Modifying application to pay for off-site
traffic mitigation.
EXHIBIT #5 August 10, 1986 Letter/Modifying application to comply with City
Codes and eliminate convenience store.
FINDINGS, CONCLUSIONS & DECISION:
Having reviewed the written record in the matter, the Site Plan Review. Committee now
makes and enters the following:
1. The applicant, MLA Architects, for Sourdough Mining Company Restaurant, has
requested site plan approval to allow the construction of a one-story restaurant
containing 14,174 square feet to be located on a 1.74 acre parcel.
2. The application file containing the application, the State Environmental Policy Act
(SEPA) documentation, the comments from various City departments, the public
notices requesting citizen comment, and other pertinent documents was entered as
Exhibit No. 1.
3. Pursuant to the City of Renton's Environmental Ordinance and SEPA (RCW 43.21 C,
1971 as amended), a mitigated declaration of non-significance has been issued for
the modified subject proposal by the Environmental Review Committee (ERC), the
responsible official.
4. All City departments affected have reviewed the original plans. The modified plans
received on August 11, 1986 reflect the department's concerns and the
Environmental Review Committee's issues.

5. The subject property is located on the east side of the 3600 block of East Valley
Road. It is bordered on the north by Shurgard Mini-Storage Warehouses and on the
south by Monarch Motor Inn.
6. The property is designated on the Comprehensive Plan as Commercial and is
presently zoned B-1, Business Use.
Conclusion:
1. The revised proposal of May 16, 1986, of a +14,174 square foot restaurant is
appropriate for the subject site.
2. Specific environmental issues raised by the Environmental Review Committee
focused on:
(1) Access to the subject site.
(2) Participation in area-wide traffic improvements. •
(3) Use of the site.
(4) Storm water drainage.
(5) On-site pedestrian circulation.
The applicant in letters dated August 5 and 10, 1986 has committed to revising the 1
plans to specifically address the above issues. The Environmental Review
Committee subsequently issued a mitigated declaration of non-significance based
upon the revisions.
3. To assure that access is provided according to the applicant's intent under his letter
of August 10, 1986, the easements should be obtained prior to issuance of the
building permit, not prior to issuance of the occupancy permit.
4. The applicant should also be aware the City will force vacation of the building if the
applicant does not meet the area-wide mitigation participation as outlined in his
letter of August 5, 1986'which stated-that they would participate in the area-wide
improvements in an amount of $199,656 ninety (90) days after the issuance of the 1
temporary certificate of occupancy.
5. The on-site landscaping provided does not appear to blend the project with the 1
adjacent industrial user to the north. Landscaping should be increased along with
the northern property boundary.
6. On-site pedestrian circulation between the adjacent motel to the south and the
proposed restaurant can be accomplished by providing three (3) walkways instead of•
five (5) located to align more closely with the three (3) primary access points of the
motel. The common access easement between the motel site and the restaurant site
would be a logical location for a separate walkway while the central access stairway
in the motel located approximately half way along the southern property line would
be another reasonable location. Final design should be subject to Building and
Zoning Department approval.
Decision:
The site plan request, file SA-042-86, is approved subject to the following conditions:
1. Landscaping along the northern property line shall be increased to provide both a
vegetational buffer and transition area from the retail commercial restaurant site
to the light industrial site.
2. Landscape plans shall be approved subject to the authority of the City of Renton
Landscape Architect.
3. Three (3) sidewalks shall be located on the subject site to inter-tie with the motel
site to the south. One of the sidewalks can be the public sidewalk along East Valley
Road.

4. Participation in area wide traffic improvements as previously agreed upon in Letter
from Merrick Lentz dated August 5, 1986.
5. Documentation showing execution of the secondary access easement from Monarch
Motor Inn shall be provided to the City prior to issuance of the building permit.
For the purpose of these decisions, the term "should" and "shall" are to be considered
mandatory and the term "may" is considered discretionary.

REQUESTS FOR RECONSIDERATION must be filed in writing on or before 5 p.m. on
Tuesday, September 2, 1986. . Any aggrieved person feeling that the decision of the site
Plan Review Committee is based on erroneous procedure, errors of law or fact, error in
judgment, or the discovery of new evidence which could not be reasonably available prior
to the meeting date of August 13, 1986 may make a written request to the Zoning
Administrator for review by the Site Plan Committee within fourteen (14) days of 'the
decision, which is Tuesday. August 19, 1986. This request shall set forth the specific
errors relied upon by such appellant, and the Committee may, after review of the record,
take further action as it deems proper.
AN APPEAL TO THE HEARING EXAMINER is governed by Title IV, Section 3011(B)(1),
which requires that such appeals be filed directly with the Hearing Examiner. Appeals
must be made in writing before 5 p.m. on Tuesday, September 2, 1986.
THE APPEARANCE OF FAIRNESS DOCTRINE provides that no ex parte (private
one-on-one) communications may occur concerning land use decisions. This means that
parties to a land use decision may not communicate in private with any decision-maker
concerning the proposal. Decision-makers in the land use process for site plan approvals
include: (1) the Public Works Director, (2) the Building and Zoning Director, (3) the Policy
Development Director, (4) the Hearing Examiner, and (5) members of the City Council.
All communications after the decision date must be made in writing through the Zoning
Administrator. All communications are public record and this permits all interested
parties to know the contents of the communication and would allow them to openly rebut
the evidence in writing. Any violation of this doctrine would result in the invalidation of
the request by the Court.
The Doctrine applies not only to the initial Committee decision, but to all Requests for
Reconsideration as well as Appeals to the Hearing Examiner.

Dear Mr. Blalock:
Per your request in the letter dated July 30 , pertaining to the
Environmental Review Committee findings as relates to the
Valley Transportation impact assessment applied to the subject
restaurant, we hereby notify you of our responce.
In order to begin construction at the earliest possible date, we
wish to secure a declaration of non-significance with conditions.
We understand that the conditions of non-significance include
the assessment of an impact fee that is determined by the
assignment of vehicle trip counts as they apply to this use. We
will be eliminating the convenience store from this proposal,
which will establish the total assessment charge for this
project as 1062 vehicle, trips times the per-trip charge of $188,
or a total charge of $1'99 ,656 . We propose to submit a bond in
this amount at the time that the permit is issued. Because of
the large amount of the fee, we ask that the collection of the
bond be established as 90 days after the issuance of the
Certificate of Occupancy, in order to allow the restaurant to
generate the funds with which to pay the fee. One possible way
to guarantee collection by the city would be to issue a
temporary C of 0 that would expire 90 days after issuance, and
convertable to permanent status only with the satisfaction of
the payment requirement. The payment up front of the entire
amount would impose a hardship on the restaurant company, and
while 90 days will not solve the problem, it would at least give
the store some means of generating the cash.
Time is of the essence, so we urge the ERC to review and approve
to this project at the earliest possible time. If you have any F
further questions , please let me know as soon as possible.

Per our discussion on August 8 , we are submitting 4 copies of the
revised site plan for your review and approval. Please note the
following changes that are incorporated into this plan:
-the convenience store has been eliminated.
-the driveway aisle widths have been increased to 24 '
on three sides of the building.
The following items are not indicated on, this site plan, but are
being addressed as part of the response to the plan correction
notice. These changes are being made to. comply with all City
standards, and when completed and approved will comply with all
requirements. They include :
-the recorded easement for the second means of access across
the Monarch Motel. property. This document is currently
being prepared and will be submitted to the City at the
time of permit issuance.
-the drainage plan as related to the offsite water from the
state R.O.W. property is being restudied and ammended, and
will be resubmitted with other plan corrections during the
week of Aug. 11 .
Roger, time is of the essence now in the completion of this project
approval. We intend to comply with all items on the correction
notice, and would appreciate any assistance in securing the
immediate approval of the site plan review process. Since all items
still to be resolved are listed on our plan correction sheet, they
.;•:E will have to be resolved to the satisfaction of the various
departments before the permit can be issued. We therefore would
appreciate approval of the site plan at the next meeting.

Sourdough Mining Company . Restaurant Project
Dear Jerry:
Thank you for allowing us the opportunity to respond to the
Environmental Checklist comments from various City Departments .
It is our desire to work with the City to resolve any and all
issues that will help to expedite the' review process . We offer
the following information to assist the decision-making process
of the E.R.C.
1 . Police• Department Comment:
-The proposed convenience store will be open 16
hours per day, from 7 A.M. until 11 P.M. A
robbery alarm system, therefore, will be
studied, but not necessarily inplemented as of
the time of this responce.
2 . Utility Department Comments:
-When final fire flow figures are available, the
water supply system will be modified as required
to provide adequate flow. If a loop is needed,
this will be provided.
The sewer and water hook-up fees. are noted and
will be paid at the appropiate time.
-It is our intention to hook up the buildings to
the existing Metro sewer line at the east end of
the property, thereby eliminating the need for

4 . Drainage Department Comments :
-It has been our intention since we first encountered
the drainage question to continue to provide
unrestricted water flow from the drainage ditch
on the east end of the property to the City line
on the west, but only to the extent currently
provided. We cannot be held responsible for
implementing an improvement effecting the entire
regional drainage pattern when the solutions are
not possible within the boundaries of our parcel.
We have shown a covered system that will accomodate
the flow currently controlled within the existing
ditch. We would prefer, however, to work with the
City to have the State provide the originally
intended drainage system north to the existing
interceptors that are capable of handling this
runoff. There is currently no easement for
drainage on the subject property, and the existing
ditch was dug within the last few years without
the proir knowledge or consent of the property
owner. If teh water is allowed to flow north into
the drainage system capable of handling the flow,
all flooding-related would be solved, and the
responsibility of the correction would be born
by the proper agency.

-First, we would ask to have the trip allocation
calculations modified to more accurately reflect
the proposed uses. The rsetaurant building is
CO 14174 . SF, and has included in this area 907 SF
for private offices not directly related to the

Shop and 460 SF for a museum-type display, both
of which are for the use and enjoyment of the
restaurant guests and will not be a separate
attraction. This reduces the actual restaurant
footage to 12134 SF, which compute to 909 trips
generated; using the multiplier provided by the
ITE Manual. In addition, the convenience store
will be in operation 16 hours per day, which
reduces the factor from 625 trips down to 322- trips.
The ammended total for this proposal would then
be 403 trips.
-We feel that there are some additional mitigating
factors that need to be discussed. First, the
hours of operation of the restaurant are compatable
with the traffic impact concerns of the valley.
The unit will not serve breakfast, so there is no
conflict with the morning rush hour traffic.
-Being open for lunch provides an attractive
alternate for local business people to leaving the
valley area. This will reduce traffic impact by
providing a close destination for the surrounding
properties. A survey by another similar concept
restaurant in the immediate area indicates that
80% of the lunch trade is form the local valley

-The dinner hour for this use, again supported by
another similar use, typically begins after 6P.M. ,
which is after the peak evening rush. Thus, even
though traffic is coming into the valley from the
surrounding areas, it is not conflicting with the
heavy traffic times.
-It would be fair to view this use as a •service to
the valley occupants, and one which willreduce the
length of trips within the valley, plus help
reduce the trips out of the valley area.
-Another mitigating factor is the property owner' s
recent participation in the amount of $50 ,000 in
the recent L.I.D. for improvements to East Valley
Road. The owner will be retaining ownership of.
this parcel after development, and hence has
already contributed to the valley improvements to
transportation. For this reason, this parcel should
be considered in the same light. as an existing
property, and be exempted from the improvement
assessment.

-The convenience store was established to service
the motel patrons, and to serve the anticipated
pedestrian market that will be developing in the
near future. Its size is roughly half of a
comperable "full service" market such as Seven-11
or Plaid Pantry, and its location is not extremely
convenient for mototized traffic. As a separate
use, it will not generate a significant volume of
traffic.
-As property owners and developers, we do not
object to the improvements of the valley. However,
since these improvements will be to the betterment
of the entire valley community, it seems only fair
and right that a method of funding be developed
that encourages the participation of all property
owners , not just the current developers. We would
be happy to sign and notarize an Intent to
Participate letter for any future L. I.D.-type
valley-wide improvement project, or some similar
form of agreement acceptible to the City.
-We ask that you please review the. projected impact
of this project on the valley transportation
system, and modify the trip counts to accurately
reflect this impact. We are not opposed to the
improvements, but we must also be wise stewards of
our available funds, and build a project that will
support itself for many years to come. A major
assessment like the one as suggested, unless
modified, makes a project of this limited scope
infeasible.
-If we are to participate in any way in the valley
transportation improvement system, we should not
be charged separately for the signalization
project at 41st and East Valley Road. A comprehensive
improvement plan needs to be developed to cover all
anticipated projects , and eliminate as much as
possible further separate and isolated projects.

notice . These changes are being made to comply with all City
standards , and when completed and approved will comply with all

-the recorded easement for the second means of access across
the Monarch Motel property. This document is currently
being prepared and will be submitted to the City at the
time of permit issuance.
-the drainage plan as related to the offsite water from the
state R.O.W. property is being restudied and ammended, and
will be resubmitted with other plan corrections during the
week of Aug. 11 .
Roger, time is of the essence now in the completion of this project
approval. We .intend to comply with all items on the correction
notice, and would appreciate any assistance in securing the

Per your request in the letter dated July 30 , pertaining to the
Environmental Review Committee findings as relates to the
Valley Transportation impact assessment applied to the subject
restaurant, we hereby notify you of our responce.
In order to begin construction at the earliest possible date, we
wish to secure a declaration of non-significance with conditions.
We understand that the conditions of non-significance include
the assessment of an impact fee that is determined by the
assignment of vehicle trip counts as they apply to this use. We
will be eliminating the convenience store from this proposal,
which will establish the total assessment charge for this
project as 1062 vehicle trips times the per-trip charge of $188 ,
or a total charge of $199 ,656 . We propose to submit a bond in
this amount at the time that the permit is issued. Because of
the large amount of the fee, we ask that the collection of the
bond be established as 90 days after the issuance of the
Certificate of Occupancy, in order to allow the restaurant to
generate the funds with which to pay the fee. One possible way
to guarantee collection by the city would be to issue a
temporary C of 0 that would expire 90 days after issuance, and
convertable to permanent status only with the satisfaction of
the payment requirement. The payment up front of the entire
amount would impose a hardship on the restaurant company, and
while 90 days will not solve the problem, it would at least give
the store some means of generating the cash.
233 Time is of the essence, so we urge the ERC to review and approve
Eastlake this project at the earliest possible time. If you have any

The Environmental Review Committee met on both Wednesday, July 23, 1986, and
Thursday, July 24, 1986, to discuss the issue surrounding the Valley
Transporation Study as it relates to commercial project's participation in
impact fee mitigation:. Specifically, your proposed ± 14,170 square foot
restaurant was evaluated by the Committee. They based their decision on the
following facts: . •
1. The restaurant generates motor vehicle traffic to support its
operation. Customers must travel by automobile to access the
site. If•the "restaurant'was part of a mixed use complex then
the Committee might has considered a different position.
2. The traffic analysis prepared for the Valley was based upon
total traffic volume with a design for a Level of Service E
for a two hour p.m. peak. "Therefore the issue of the specific
peak use of the restaurant was not considered.
3. During the two hour p.m. peak, the proposed project has
substantially the same percentage of total vehicles entering
the site as would an office complex. (The traffic study
anticipated a 20 percent of total traffic volume peak for
office users, while the restaurant anticipated 16 percent of
their total users would be during this p.m. peak.)

4. The City Council has adopted a rate charge of $188 per vehicle
trip to be utilized by the Environmental Review Committee as
an interim number. This number could increase if certain
political decisions are made. It does not appear that it will
decrease since it represents the low end of the traffic
engineer's assessment.
5. The Committee does agree with your proposal that reducing the
store hours of the convenience store would substantially
reduce the traffic impacts.
Based upon the above change in primary factors, the anticipated participation
in area-wide traffic improvements would be reduced from the initial $497,000
to $275,420. This is broken- down for the restaurant with its 1,062 vehicle
trips to be $199,656, while the convenience store with its 403 vehicle trips
would be assessed $75,764.
The Environmental Review Committee wanted to give you the opportunity to
respond to their present position prior to issuing a declaration of
non-significance with conditions. The option is available to you to agree to
the necessity for traffic improvements and the specific amount and actually
issue a mitigated declaration of significance.

2. A new landscape plan will need to be submitted to reflect the new layout of the
site. The Committee is suggesting that a strong accent of landscaping be placed on
the most visible areas of the site. this being primarily from East Valley Road and
along the common property line with Monarch Motor Inn to the south.
3. A second point of access to the site is required for fire access. The plans illustrate
the second route by easement to the south of the property into the Monarch Motor
Inn's parking lot. Provide the Committee a copy of the language agreement with
the neighboring property.
4. The trip generation assessment fee that will be assessed as participation to the
Valley Transportation Improvement Plan is still under consideration, and therefore
an assessment has not yet been agreed upon.
With the exception of item 4, please submit this requested information at your earliest

This letter serves as a formal proposal to provide the follow
on services for. the VTIP study in two specific areas :
1) Market sensitivity of the impact fee on proposed real

2 ) Further assessment of the contribution of the commercial
land uses to the impact fee.
Attachment A summarizes the proposed work scope and estimated
costs . The work is considered to be an extension of the pre-
viously completed documentation for the Renton Valley Trans-
portation Improvements Program. The contractual provisions
and compensation would be accomplished under the same basic
provisions of the original agreement, and treated as "Extra

Environmental Checklist comments from various City Departments .
It is our desire to work with the City to resolve any and all
issues that will help to expedite the review process. We offer
the following information to assist the decision-making process
of the E.R.C.
1 . Police Department Comment:
-The proposed convenience store will be open 16
hours per day, from 7 A.M. until 11 P.M. A
robbery alarm system, therefore, will be
studied, but not necessarily inplemented as of
the time of this responce.
2 . Utility Department Comments:
-When final fire flow figures are available, the
water supply system will be modified as required
to provide adequate flow. If a loop is needed,
this will be provided.
-The sewer and water hook-up fees are noted and
will be paid at the appropiate time.
-It is our intention to hook up the buildings to
the existing Metro sewer line at the east end of
the property, thereby eliminating the need for

-The convenience store was established to service
the motel patrons , and to serve the anticipated
pedestrian market that will be developing in the
near future. Its size is roughly half of a
comperable "full service" market such as Seven-11
or Plaid Pantry, and its location is not extremely
convenient for mototized traffic. As a separate
use, it will not generate a significant volume of
traffic.
-As property owners and developers, we do not
object to the improvements of the valley. However,
since these improvements will be to the betterment
of the entire valley. community, it seems only fair
and right that a method of funding be developed
that encourages the participation of all property
owners , not just the current developers . We would
be happy to sign and notarize an Intent to
Participate letter for any future L. I.D.-type
valley-wide improvement project, or some similar
form of agreement acceptible to the City.
-We ask that you please review the projected impact
of this project on the valley transportation
system, and modify the trip counts to accurately
reflect this impact. We are not opposed to the
improvements, but we must also be wise stewards of
our available funds , and build a project that will
support itself for many years to come. A major
assessment like the one as suggested, unless
modified, makes a project of this limited scope
infeasible.
-If we are to participate in any way in the valley
transportation improvement system, we should not
be charged separately for the signalization
project at 41st and East Valley Road. A comprehensive
improvement plan needs to be developed to cover all
anticipated projects , and eliminate as much as
possible further separate and isolated projects.

1. Submit a revised site plan that meets the requirements of the Zoning
Ordinance. This property zoned B-i (Business Use) requires a ten foot
landscape setback from the property lines along both East Valley Road
and the Valley Freeway (SR-167). Submit seven copies.
2. Provide first class stamps and mailing addresses for all adjacent

SOURDOUGH MINING CO. RESTAURANT
Scope of Work
This proposal will cover the development of a currently vacant
piece of land into an operating restaurant along with a small
convenience store. The scope of work involves site grading,.
installation of a sub-surface drainage and retention system,
tightlining of a existing open channel drainage ditch, construc-
tion of a 14°,000 square foot restaurant and a 1250 square foot
convenience store, and. the site improvements normally associated
with this scale of project, including paving, curbing, striping,
and landscaping. The project is comprised of wood-framed structures ,
with the presentation of a mining town theme as its focus . Since
it is a restaurant, the work will be done as quickly as
possible, with an estimated start date of the first part of July,
and a completion date of November, 1986 . Since the existing
property is flat and vacant, and the project involves no special
uses or reviews , a quick and efficient completion is envisioned.
