REPORT AND DECISION

LOCATION:
Property is located immediately adjacent to Carco Theater on the north side of the Cedar
River in the City of Renton's Cedar River Park.
SUMMARY OF REQUEST: Application for site plan approval and a shoreline
substantial development permit to construct a cement
bulkhead to separate the beach area and the adjacent lawn
areas and improve access to the general area from the
parking lots by constructing asphalt walkways.
SUMMARY OF ACTION: APPROVED.
COMMITTEE REVIEW: The review was conducted at 11:25 a.m. on Wednesday.
August 27. 1986 in the 3rd floor conference room of the
Renton Municipal Building.
The Committee review was conducted after receiving written comments from all divisions
of the Public Works Department, both divisions of the Building and Zoning Department.
and the Fire, Police, Parks, and Policy Development Departments.
The following exhibits were entered into the record:
EXHIBIT #1 Yellow file containing application; proof of posting, publication, and
notification of adjacent property owners; along with other
documentation pertinent to this request.
EXHIBIT #2 Site Plan (received May 28 1986).
FINDINGS, CONCLUSIONS & DECISION:
Having reviewed the written record in the matter. the Site Plan Review Committee now
makes and enters the following:
1. The applicant, The City of Renton Parks and Recreation Department, has requested
site plan approval to construct a cement bulkhead to separate the beach area and
the adjacent lawn areas and improve access to the general area from the parking
lots by constructing asphalt walkways.
2. The application file containing the application, the State Environmental Policy Act
(SEPA) documentation, the comments from various City departments, the public
notices requesting citizen comment, and other pertinent documents was entered as
Exhibit No. 1.
3. Pursuant to the City of Renton's Environmental Ordinance and SEPA (RCW 43.21C.
1971 as amended), a Declaration of Non-Significance has been issued for the
modified subject proposal by the Environmental Review Committee (ERC), the
responsible official, on July 16, 1986. No appeals were submitted.

4. The subject property is just north of the Cedar River and west of the Carco Theater
facility located within the Cedar River Park. Cedar River Park lies south of the
Maple Valley Highway, east of I-405 and north of the Cedar River.
5. The property is designated on the Comprehensive Plan as Recreation and is
presently zoned P-1, Public Use.
6. The repair of the river wall shown on the plans was reviewed under a separate
Shorelines Exemption request (SME-004-86)
Conclusion:
1. The proposal is consistent with the Comprehensive Plan and the Comprehensive Park
Plan for the subject site.
2. Specific environmental issues raised by the Environmental Review Committee
focused on:
(1) Timing of construction.
(2) Access for handicapped people.
3. The construction should occur during the late fall or early spring so that it does not
conflict with high user activities on the subject site.
4. The proposal will reduce the impact on lawn and landscaped areas and improve the
general pedestrian access to the public beach.
Decision:
The site plan request, file SA-049-86, is approved as presented.
For the purpose of these decisions, the term "should" and "shall" are to be considered
mandatory and the term "may" is considered discretionary.

Thursday, September 18, 1986. Any aggrieved person feeling that the decision of the site
Plan Review Committee is based on erroneous procedure, errors of law or fact, error in
judgment, or the discovery of new evidence which could not be reasonably available prior
to the meeting date of August 27, 1986 may make a written request to the Zoning
Administrator for review by the Site Plan Committee within fourteen (14) days of the
decision, which is Thursday, September,4, 1986. This request shall set forth the specific
errors relied upon by such appellant, and the Committee may, after review of the record,
take further action as it deems proper.
AN APPEAL TO THE HEARING EXAMINER is governed by Title IV, Section 3011(B)(1),
which requires that such appeals be filed directly with the Hearing Examiner. Appeals
must be made in writing before 5 p.m. on Thursday September 18, 1986.
THE APPEARANCE OF FAIRNESS DOCTRINE. provides that no ex parte (private
one-on-one) communications may occur concerning land use decisions. This means that
parties to a land use decision may not communicate in private with any decision-maker
concerning the proposal. Decision-makers in the land use process for site plan approvals
include: (1) the Public Works Director, (2) the Building and Zoning Director, (3) the Policy
Development Director, (4) the Hearing Examiner, and (5) members of the City Council.
All communications after the decision date must be made in writing through the Zoning
Administrator. All communications are public record and this permits all interested
parties to know the contents of the communication and would allow them to openly rebut
the evidence in writing. Any violation of this doctrine would result in the invalidation of
the request by the Court.
The Doctrine applies not only to the initial.Committee decision, but to all Requests for
Reconsideration as well as Appeals to the Hearing Examiner.

SUBJECT: Proposed Improvements to Cedar River Park
The City of Renton Parks & Recreation Department is applying for site plan
approval for proposed improvements to Cedar River Park. As you are aware,
the site is an existing City park and is zoned P-1. Improvements to the
park are planned to accomplish two goals; stabilization of the river bank
and improving user access to the river beach area of the park.
Stabilization of the river bank is our greatest priority in Cedar River
Park. Erosion in the past has carved an amphitheater area out of the
river bank. An existing, partially submerged, concrete rip-rap wall
helps to minimize erosion, but this wall is deteriorating and erosion
is increasing. Proposed improvements include repairing about 120' of
this wall. This is in-water work involving regrouting loose joints,
resetting the wall in a section which has partially tipped over and
driving steel pipes into the river floor to strengthen the wall.
Besides stabilizing the bank, this work is also seen as important to
public safety. The wall creates an area of sheltered water, away from
the strong river currents. This area is used by young children as a safe
wading area.
In addition to repairing the river wall, a new concrete retaining wall
is proposed to keep the existing amphitheater area from growing. This
retaining wall is about 235 feet long, about 51 feet deep, and is
semi-circular is plan. With this new wall and repairs to the existing
river wall the river bank should be stabilized for the foreseeable
future.
Other park improvements are aimed at improving access to the river beach
area of the park. Both general access and handicapped access will be
improved with a series of asphalt walkways and concrete stairs. In all,
new stairs will be placed in four (4) locations and 580 feet of new
asphalt walkways will be set.
